Get your house in order

The Fair Work Ombudsman, has announced it will take a tough new stance on compliance as of 1st July, and businesses can expect to find themselves subject to greater scrutiny.

What will the focus be? The Government has provided additional funding to Fair Work to be spent on enforcement, underpayments, educating vulnerable workers and influencing non-compliant industries.

Areas of particular interest will be: l Fast food restaurants and cafes (FRAC) l Horticulture Industry l Supply chain risks l Franchisors l Sham contracting

There will be a step up in compliance notices (a notice issued by a Fair Work Inspector which requires an employer to fix a breach of an Australian workplace law), if a business is involved in: l underpayments l breaches of awards and l breaches of the National Employment

Standards. “If an employer [then] doesn’t comply with the terms of our compliance notice, the Fair Work Ombudsman won’t resile from taking them to court to seek penalties,” Sandra Parke, Fair Work Ombudsman said.

In addition, Fair Work will also run social media awareness campaigns and intends to publicly name employers that break the law in order to enforce the message that it is not acceptable to underpay workers or deprive them of their entitlements.

And even those bigger businesses doing the right thing and “selfreporting,’ should be prepared to make a “contrition payment” (a payment reflecting the seriousness of their contravening conduct), in addition to any back pay owing.

But I don’t belong in any of these “areas of interest” Ah, but you just might.. For example, you are liable if a contractor arrangement is a sham and contravenes the Fair Work Act, along with applicable awards and enterprise agreements.

What is a sham contracting arrangement? This is when an employer tries to disguise an employee/employer relationship as an independent contracting arrangement, so they can avoid paying employee entitlements, superannuation or penalty rates and overtime.

What proves that there is sham contracting in my business? If you are reported or investigated for: l Misrepresenting an employment relationship or a proposed employment arrangement as an independent contracting arrangement l Dismissing or threatening to dismiss an employee for engaging them as an independent contractor l Make a knowingly false statement to persuade or influence an employee to become an independent contractor

What are the ramifications of entering into a sham contracting arrangement? You could be in the firing line for a financial penalty along the lines of l Up to $12,600 for individuals, per contravention; and l Up to $63,000 for a company, per contravention You may also be liable to compensate the worker for any employment benefits they would have accrued, for example, annual leave.

What if I have mistakenly categorised a worker as an independent contractor? The distinction between an employee and a contractor can be unclear sometimes. However, you may be liable regardless of whether the error is unintentional and regardless of whether the worker is happy with the arrangement. If in doubt as to how the relationship should be categorised this may be a good time to call the SSAA Helpdesk on 1300 01 SSAA (1300 017 722). l

Navigating the MAP

HOW HAS THE WEBSITE IMPROVED?

You will see a significant change to Member Services – the Member Services Section has been designed, with Members in mind. There is information on Agreements, Manual of Advice and Procedures (MAP), Legal FAQs, Legal Help Desk, StorerCheck, HR Help Desk, Mystery Shopping and Member Assets.

The new format allows the MAP to become a “living” document with regular reviews and updates. If there is an increase in contact and queries to the Legal Help Desk on a particular topic, we will expand the information in the MAP section or add new information if required, which will ensure the MAP is always up to date.

The MAP is a valuable resource, but while 68 pages of text, can seem somewhat overwhelming, the MAP is now interactive and broken down by relevant topics (see above).

Under each heading, there are the chapters or clauses that relate to that topic. For example, if you are researching an issue with an Overdue Storer, just click on the Overdue Storer icon and all of the relevant chapters or clauses of the MAP will be displayed.

In addition, we recognised the wealth of information contained in the SSAA Library, so there are links to the Library with articles relevant to the topics being researched. All of which ensures Members will be able to selfhelp and resolve any enquiries quickly and effectively.

For those Members who like to review the MAP in its entirety, this option is still available.

Members can also access the latest storage agreements and the associated letters, Privacy Policy Statement, information on the Personal Property Security Register (PPSR) through their login. Information will be updated regularly, so Members need to ensure they are accessing the website for latest information as it is updated and released.

If Members are unable to resolve their enquiry through the Member Services Section, they can access assistance from the Legal Help Desk by sending an email to legalsupport@selfstorage.com.au.

The Self Storage Association of Australasia’s Code of Ethics are fundamental to the values of the SSAA and essential to achieving its mission to lead the storage industry in Australasia by promoting the highest standards of ethics and professional excellence for the ultimate benefit of all members and customers. As a SSAA member, you are required to follow the Code. 1. Members will ensure that their workplace is a safe environment for employees, customers and other visitors to the site. 2. Members will treat all employees, customers and visitors to the site with respect. 3. Members will promote the positive image of the industry through ethical and honest advertising and business practices. 4. Members will undertake to report any suspected criminal activities to the relevant authorities. 5. Members will comply with all relevant local, state and federal government laws and regulations regarding a self storage business. 6. Members will use a current approved SSAA storage agreement or develop an alternative that delivers the equivalent contractual agreement. 7. Members will ensure that staff are competent in their duties and complete appropriate training in current industry practices. 8. Members will participate honestly, cooperatively and transparently with any investigation by the SSAA into any alleged breach of this Code of Ethics.
