Breathing Easy Again: Evelyn’s Journey Through Aortic Valve Replacement

Evelyn Greenberger had been experiencing shortness of breath and a fluttering heartbeat – symptoms she thought indicated she had pneumonia. She got quite a surprise, though, when she went to the emergency room and doctors told her that it was not pneumonia. Instead, she was in heart failure.

Juan Pablo Umana, M.D., chair of the Division of Thoracic and Cardiovascular Surgery at Cleveland Clinic in Florida, says Evelyn had a leaky aortic valve. The shortness of breath she was experiencing was due to the blood volume

overload in her heart, which was causing a backup to her lungs. Her symptoms were typical of her condition.

Dr. Umana recommended an aortic valve replacement to restore the normal flow of blood through her aorta to prevent it from flowing back into her heart.

“The earlier you have the operation the better and easier the recovery,” Umana says.

Greenberger says she chose to have the aortic valve replacement at Cleveland Clinic because she knew it was “an amazing organization.” Being a resident of Boca Raton she was grateful Cleveland Clinic Weston Hospital was nearby. She also says she felt confident in Umana and his team.

“I could not have been in better hands,” she says. “When I went in on the day of surgery, I had every question answered. (The Cleveland Clinic team) just embraced you.

There was no fear because everybody wanted to be there and comforted you for who you were.”

Umana used a minimally invasive approach to Greenberger’s surgery. The minimally invasive approach allows surgeons to make smaller incisions without having to open up the chest. This way causes less scarring and pain and a faster recovery than traditional open surgery.

“This was a team effort,” Umana says. “The patient is at the center not only of the care but of the decision making.”

Greenberger couldn’t be more pleased.

“There’s a whole new world that’s open to me now. There’s nothing stopping me,” she says. “I’ve got the energy and the same zest I had when I was 30-something or 40-something. Umana gave me this gift and it’s now my chance to use it.”

Book Review

Dictionary Of Fine Distinctions: Nuances, Niceties, And Subtle Shades Of Meaning

Nils began his career as marketing director for a major book publisher. He has since edited the authors’ manuscripts’ for more than 20 published books, written more than 200 book reviews, served as publisher of several million-plus circulation national magazines, created the official yearbooks for teams in Major League Baseball, the National Football League, National Basketball Association and National Hockey League, and “retired” as president of a successful telecommunications company.

I had intended for this book to take its place alongside the dictionary and Roget’s Thesaurus in my home office as a helpful reference. Instead, I have been carrying it around to share with friends as a source of not only important helpful information but to spark a round of appreciative good humor with the turn of almost every one of its 200 pages.

I believe you will be tempted to do the same once you get your hands on this handy-sized, 5-1/4” by 7-1/4” hardcover volume.

My initial decision to purchase it is my need, as an editor and writer, to always select the correct word when more than one option may seem to be available … and the purpose of The Dictionary of Fine Distinctions is to point out the more than 100 examples of two words that most people mistakenly believe are interchangeable, but which are not … and in each case to explain the differences. The text by author Eli Burnstein is laced with such a wonderful sense of humor that you hardly realize you are learning so much, and many of the explanations are illustrated with delightful cartoon illustrations.

If you care about using the correct words in your own conversations or in your writings this is a must-have reference book. If that is not a problem you care much about, then it is a must-have for the fun it will add to your life. Here are just a few examples of words you may be using incorrectly. For lack of space here I offer only the author’s brief opening statement for each. He almost always follows up with a fuller explanation, but you will have to see the book for those.

• Poisonous vs. Venomous. Poisonous is when you bite it (as with a toadstool mushroom). Venomous is when it bites you (as with a snake).

• Irony vs. Sarcasm. Irony is when you say one thing but mean another. (Lounging on the beach: “It’s a tough life.” ) So is sarcasm, only what you mean is insulting. (After someone trips: “Smooth move.” )

• Pronunciation vs. Enunciation. To pronounce a word is to say it correctly. To enunciate a word is to say it clearly.

• Hors d’oeuvres vs. Canape. Hors d’oeuvres are bite-size appetizers. Canapes are bite-size appetizers on bread, crackers or pastry.

• Schlemiel vs. Schlimazel. Shlemiels are bumbling fools. Schlimazels have bad luck. Hence the Yiddish crack that when a schlemiel spills their soup, it’s the shlimazel whose lap it falls on.

• Assume vs. Presume . To assume is to suppose without proof. To presume is to do so with confidence or authority.

• Gala vs. Ball. A Gala is a large, upscale social event. A Ball is a large, upscale social event with dancing.

In any case, from now on I will have no more excuses for using incorrect words in any of my columns. You have my permission to chastise me if I do.

The Importance of Annual Physicals: Prioritizing Your Health with Dr. Luisa Brito and Dr. Althea Watson

Your health is your most valuable asset. Taking the time for an annual physical is one of the most proactive steps you can take to ensure your well-being. These routine check-ups are essential not only for maintaining good health but also for catching potential issues before they become serious.

Annual physicals allow doctors to assess your overall health, discuss any concerns, and run necessary tests to detect underlying conditions. High blood pressure, diabetes, and cholesterol levels are just a few examples of silent conditions that may go unnoticed without regular screenings. Early detection can lead to timely treatment, significantly reducing the risk of complications and improving outcomes.

At Palm Beach Health Network Primary Care, Dr. Luisa Brito and Dr. Althea Watson are committed to helping you stay on top of your health. They understand the importance of personalized, compassionate care and offer next-day appointments to fit your busy schedule. Whether you’re due for your annual well visit or have specific concerns, their expertise ensures you’re in good hands.

Both Dr. Brito and Dr. Watson provide comprehensive services, including same-day appointments, walk-in visits, pre-and post-op care plans, annual physicals, and pre-surgical medical clearance. They are dedicated to creating a comfortable environment where you can discuss your health concerns and work together to achieve your wellness goals.

Real Talk: Your Love Life

“To truly change the way we approach love, we have to go to the source of everything we do: our minds.” — Todd Perelmuter

Romance has arrived and you have front row seats. Cupid’s arrow is aimed, and couples are falling in love all over town, thanks to us. February is all about LOVE. Whether you’re actively looking for it or quietly wishing for it, LOVE is on everyone’s mind this month. You can run, but you can’t hide from the magic of Valentine’s Day. So, how is your love life? (Take a moment to think about it). Do you need a little extra help from our sweet, professional cupids this month? Well, good news—we’re right here in your local area, ready to help! As always, don’t forget to share this valuable info with your single family and friends—especially during this inspiring month. They might just be more motivated to take action than they think.

The Power of a Two-Some

Countless studies have shown that we’re at our best when we’re in a healthy relationship. It’s not money, fame, or beauty that brings true happiness—it’s togetherness. We ask people of all ages—from 20 to 80-plus—what their happiest moments have been, and the overwhelming answer is always the same: “The best time of my life was when I was in a loving, committed relationship.”

It Makes Perfect Sense

When you’re in a relationship, you have someone to share life’s joys with, and someone to lean on during the tough times. You have a partner to help you plan your future, and a person who becomes your rock, your sounding board,

and your biggest cheerleader. Two beats one, any day of the week. Not only does this connection improve your emotional health, but it’s also essential for your physical well-being. A supportive relationship gives you something to look forward to every day, and that’s crucial for mental and physical wellness.

Taking Responsibility for Your Love Life

Deep down, no one wants to be single forever. Yet, many will be alone this February—and possibly longer— because they’re not owning their love life. They’re too comfy in their comfort zones, waiting for something to happen instead of making it happen. Some people blame others (or even an ex) for their single status, but here’s the truth: you are responsible for your relationship status.

Facing the Truth

In the world of dating, it’s easy to get stuck in patterns of blaming external factors rather than reflecting on our own actions, dating style, or mindset. Taking ownership of your love life requires self-awareness, self-improvement, and a willingness to face the discomfort of stepping outside of your comfort zone. Fear of rejection, getting hurt, or losing freedom often holds people back, but this is precisely what keeps them from finding happiness. Online dating is a risky platform, and we get that. This is why we’re here! Unlike online dating, we vet every single candidate and connect with them personally. We act as cheerleaders, and sometimes we hold up a mirror when we see our clients standing in their own way. Tough love leads to success, and we’re fortunate that most of our clients listen to us.

Taking Control Leads to Growth

Taking responsibility for your love life is a mindset that opens the door to personal growth and increases your chances of finding your grand finale relationship. Dating isn’t for the faint of heart—it’s a combat sport. You will take a few hits along the way, but you must keep going if you want to score the touchdown.

Know

Your League

It’s crucial to understand what “league” you should be dating in. You can’t be a third-string player on a community football team and expect to date the head

cheerleader of an NFL team. If you have incredibly high standards, make sure your attributes match what you’re looking for in a partner. Ask a brutally honest friend or, better yet, ask your matchmaker. We’ll give you the truth (while your friends might sugarcoat it). Most of our clients appreciate this transparency.

Optimism and Open-mindedness

Remember, there is a pot for every lid. Don’t let low self-esteem hold you back from believing in love. If you find yourself thinking, “No one will ever love me,” STOP. You are lovable, and you deserve the best partner in the world. Start telling yourself: “I am lovable, and love is on its way.” Stay optimistic, and get off that negative train—it’s headed nowhere. Is that really where you want to go?

More Amazing Singles Than Ever

We’re excited to report that we’re meeting more incredible, like-minded singles than at any other time in our history. Nationwide exposure and a recent article in The Shiny Sheet have been an astronomical experience for the club and its members. Times have changed, and so has our matchmaking style. New candidates for men and women are walking through our doors every day. Our database is growing and ever-changing, and the quality of matches pack a powerful punch.

The Right People Are Out There

We feel so fortunate to work with such attractive, successful, and positive clients. Our clients are too wise and too busy for the bar scene or online dating. They want quality, and they deserve it too.

In honor of love month, here’s one final piece of advice. “Treat yourself the way you want to be treated by others. Love yourself, and you will be loved.” Love the world, and it will love you back. It’s the LOVE MOVEMENT. Join us and enroll today--before we book solid!

Happy Valentine’s Day Wishes and Caviar Dreams to all of you! May you find love in 2025—with yourself and with others. We are obsessed with 2025 and can’t wait to make this year even better—together!

Dining Out: Here’s The Only Review You Need To Read!

Hungry Al’s love for food started very young. Never satisfied with his Mom’s dishes, he started to cook his way through her “Betty Crocker Cookbook.” During the years to follow he spent many hours working in restaurants, both as server and cook, attending cooking classes and traveling the world in an effort to expand his palette. As a professional writer, Hungry Al offers his perspective on current food trends and guides you through your local restaurant options.

rosebudrestaurants.com

Food For Thought. Before I visit any new restaurant, Hungry Al does a bit of research online. My method is to read the negative reviews before the good ones. And yes, I can decipher between the ones generated from foolishness to those more sensible. Most comments lean toward the obvious: the food, the portions, the service. This is acceptable. We all have different expectations due to our taste palette, personal demands on how much we eat and how it’s delivered. What I scratch my head about is why folks leave comments that are mean and destructive to any new business trying to make a go of it. It’s not a week after opening and reviewers are throwing hurdles before the restaurant gets off the starting block.

So, if you are about to complain about the noise levels, the service delays, the poor drink pours, the prices being so high, and even the parking and traffic, keep in mind that not every restaurant can please every patron. Besides, it beats cooking at home!

With that said I can assure you that the positives outweigh the negatives when it comes to reviews about Mia Rosebud. It’s going to be worth the drive downtown to experience what most Chicagoans would say is the best Italian restaurant in town!

First Impressions. For a bit of history, this restaurant chain started in Chicago in 1976 by a restaurateur and resident of Boca named Alex Dana. With eight restaurants now in the windy city, this restaurant group has cast its first bait to downtown Boca. If they can consistently please their patrons with family recipes and hearty portions (an understatement) they will win the best catch of the year!

As for the ambiance, it doesn’t get any better. Contrary to some reviews, the noise level is not blaring. Yes, it probably will get louder on weekends but they are playing to a different demographic on those days. If you are looking for a great dining experience you will have no issues on weekdays.

As for the décor, you can definitely imagine the famous rat-pack of celebrities eating here. The interior design mirrors their Chicago Rosebud on Taylor Street. They cleverly created a modern setting with a transitional blend of light and dark chocolate-wood furnishings with fresco-inspired wall coverings.

For you outside diners there is a nice open patio with fans and cooling misters. For those of you who like grabbing a stool at the bar this one is a well-appointed mahogany-bar where cocktails are masterfully mixed. If you’re having a special occasion definitely consider the elegant semi-private room that handles at least 30 and is a throwback to years gone by with velvety-red walls, crystal chandelier and photographs of the owner alongside such greats Frank Sinatra and Tony Bennett.

Prime Your Taste Buds. By now you know, if there is a meatball on the menu Hungry Al is going to try it. It’s one of my favorite measures of the authenticity of an Italian restaurant. This one didn’t fail my high standards. A mixture of beef and veal, this baseball-size portion was actually cooked with a medium-center temperature, not like most that are pulverized well done.

We also sampled the Baked Clams ($21), a favorite of Hungry D since she hails from the shores of Rhode Island. I’m not a fan of this preparation, only because I think the flavor of the clams is buried in breadcrumbs. The clams were slightly over-done in the broiler, but the sauce made up for it.

Since we are labeled the “Hungry Squad” we had no problem taking on another appetizer with Rosebud’s Crab Cake ($33) special. Close friends from Baltimore claim the best version of crab cakes is from a small dive restaurant in Greenacres called Eagle Grill and Oysters. Since I’ve had

my share of crab cakes in and out of Baltimore I would wage a bet these might top any other options you throw my way. Save the gas money! Mia Rosebud’s cakes are totally void of any filler and are huge enough to make a meal out of them. Worth every dollar!

Straight From The “Open Kitchen.” After all we had eaten to this point we figured it was going to be a long day in the gym tomorrow, so why not go for broke! Hungry A and Hungry D ordered three entrees to boot hoping to leave a slither of room for dessert. And it’s not going to be Jell-o! Hungry D gravitated to the fish-of-the-day, which was Swordfish ($48). You’ve got to love a fish entrée when you can say it’s as good as a filet mignon! With just a bit of seasoning and a mild lemon-wine Beurre Blanc sauce it was my trophy catch for the evening. I do note that the roasted potatoes were a little overcooked and seemed like an afterthought.

As for Hungry Al, I decided to try their signature Veal Chop Milanese ($79). This pan-fried parmesan breaded bone-in chop was pounded to the size of a frisbee. It was then topped with a fresh arugula, tomato salad. The breadcrumb coating on the chop had to be freshly made, packing plenty of flavor and far from any food store variety. I will admit most of it came home with me and lasted for another two meals.

How can you leave an Italian restaurant without sampling at least one of their pasta dishes? Not me! On request, the waiter was able to serve us an appetizer size of Rosebud’s Spicy Rigatoni Alla Vodka. These large noodles cooked perfectly were dressed with a smooth and creamy sauce that was well-balanced with a hint of Calabrian Chile. Somehow there was no noodle left standing, and obviously never made it into our take home bag!

From The Dessert Cart. I’m stuffed! Oh...Mia has a dessert menu? I’m a cake lover. Mia Rosebuds bakes them in-house and most likely ships them from their Chicago bakery. I decided on the mile-high Coconut Cake ($16) and it also took me three days to finish it at home. It was worth every calorie. Hungry D thought she could handle a dish of vanilla Gelato ($12) but needed reinforcements before it melted. I happily obliged since most of my “half-mile high” cake was homeward bound.

WORLD CLASS HEART CARE REDEFINING

Healthy Answers – A Guide To Healthy Living: ‘Life’s Necessary Losses’

Dale is a motivational speaker who has spent many years as a Certified Life Coach and has written numerous articles and e-books relating to selfimprovement and ways to build a high-performance team. She is the author of the book, “Small Steps... Big Changes: The Personal Stories of a Life Coach.” Her education and years of experience in physical fitness and training of elite athletes has enabled her to sharpen her knowledge in many healthrelated areas. The following introduces a new approach to Ms. Brown’s series of columns devoted to many topics that deal with the mind/body connection and the importance of living a healthy lifestyle. Dale, a Bocaire resident, can be reached at dalebrown@lovingmondays.com.

In this life I’ve learned that in order to grow we must give up and let go of things and people we love. The road to human development is paved with necessary losses along the way. At some point in our life we lose our parents, friends and other family members. As we age, letting go can mean many things: our vigor, our sense of adventure, our playfulness, our waistlines, our 20/20 vision – the list goes on.

When you’re young it’s easy to look ahead to what you’d like to accomplish, never realizing that someday that vision may shift. There will come a time that changes your ability and your view of what you can and cannot do. You may have to hang up your skis, sell your golf clubs, give up your bike riding or adjust your lifestyle to suit your later years. As much as this sounds like a downer it’s not. It’s simply the evolution of life.

The past year has made me understand this concept more than ever before. Close friends have passed away and, worst of all, my sister. Loss has an uncanny way of bringing to light your own mortality and reminds us how fragile life really is. While the loss of a loved one is deeply painful the reflection can lead to personal growth, resilience and a renewed commitment to living a meaningful life. Acceptance of this reality and how you deal with it is all important to your own health and happiness.

Grief often leads to reevaluating what is important in life. It can inspire us to prioritize meaningful relationships, experiences and goals over trivial or material concerns. Pain of loss can deepen gratitude for people and moments still in your life. This newfound appreciation may lead to more intentional living and savoring the present.

Sometimes you go through the motions of living, not fully aware that time is slipping away. Then one day you look back and wish you had laughed, loved and lived more fully. You reflect and appreciate the little things and may wish you had been more thankful for what you had. Mundane concerns seem insignificant and help you focus on a deeper purpose and joy.

Check Please. Remember, wherever you decide to eat nowadays you should expect the prices of your dinner to be a bit higher than those pre-pandemic ones. Look at all the money you saved for two years not dining out. So treat yourself and whomever you dine with to a nice dinner once in a while at a restaurant that can deliver quality and quantity. When you lose a friend, loved one, or even people you may not know very well, it makes you stop to reflect. Maybe for a day, sometimes longer, you recognize that life is transient. You vow to make some changes, let go of things that don’t matter, make amends with estranged family.

Inherently, we all long to be present in the world around us. There are many books describing the importance of being in a conscious state of mind. The death of a loved one is often the wake-up call that brings a heightened awareness of life’s fragility and the finite nature of time.

This profound experience can spark a desire to live more fully for several reasons:

Reflection on priorities – Step back and take a look at what’s really important in your life. So often we become bogged down in minutia, spending valuable moments stressing over stupid stuff that is insignificant in the big picture.

Appreciation of the present – Remembering the love shared with those you’ve lost can inspire you to express love more openly and more often. It may prompt a renewed focus on kindness and understanding toward your fellow man.

A catalyst for change – Death reminds us of the universal nature of loss and the shared human experience. It may lead to empathy toward others who are experiencing a similar loss. As a result of loss, it may prompt you to take risks, pursue passions or address unresolved issues.

A shift in perspective – The loss of a loved one may encourage you to focus on a deeper purpose and a sense to live more authentically. This means being true to yourself, aligning your actions, thoughts and choices with your values, beliefs and genuine self. It involves expressing yourself honestly and living in a way that feels meaningful and fulfilling.

Inspires Acts of Kindness – Awareness encourages compassion. Helping others can bring a profound sense of joy and fulfillment.

The acceptance of death, often called mortality awareness , can affect happiness and overall well-being. While the idea of death may initially evoke fear or discomfort, embracing its inevitability can lead to a deeper appreciation of life and more meaningful experiences.

Multivitamin Intake

And Mortality – A Long-Term Study

I attended a commuter college in Brooklyn – a part of the outstanding New York City Public University System Brooklyn College. I would drive in every day with my friend and lab partner Stu. Before we would leave for school his mother would make him take about fifteen vitamins, mineral and supplement pills each day. He was neither frail nor sickly and he ate well. When he moved to Italy to attend medical school in Sardinia, a package would arrive each day from his mom in Brooklyn with his daily vitamins. I always wondered if that would improve his health long-term.

One in three adults in the United States consumes a daily multivitamin and multiple supplements. Does it help you live longer?

Lotfield and associates at the National Institute of Health published a study in JAMA looking at mortality and multivitamin usage. They followed 390,000 adults for over 20 years and found that taking a multivitamin had absolutely no effect on mortality. A multivitamin is a product that contains three or more vitamins at a dosage below the maximal daily requirements. The article and an accompanying editorial did not downplay the importance of micronutrients in our health. They just explained it does not contribute to us living longer.

We need these micronutrients with a case in point being scurvy which is caused by a deficiency of vitamin C but was prevented when sailors ate limes. Brown rice being converted to white rice removed the thiamine that prevented beriberi. We give pregnant women folate to prevent neural tube defects from forming in their developing child. We encourage use of beta carotene, zinc, vitamins C and E in adults with macular degeneration to slow its progression down. Adults with traditional gastric bypass surgery used to treat obesity need vitamin and mineral supplementation to absorb these nutrients due to changes in post-surgical absorption. While these are all positive outcomes of vitamin supplementation there are also negatives.

Smokers and humans exposed to asbestos have an increased risk of lung cancer if they ingest supplemental beta carotene. Fat soluble vitamins A, D, E and K store excess intake in cells and can cause toxicity as opposed to water soluble vitamins B and C which simply pass through the kidneys and are eliminated in our urine.

I will stick to getting my micronutrients from fresh healthy food in my diet. As for my friend Stu, now a retired 73-year-old cardiologist in Southern California, he told me how each day in Sardinia he opened the package from his mom, read the letter enclosed walked out onto the pier and enriched the micronutrients of the Mediterranean Sea.

Boca Raton Government Campus

The redevelopment of the 30-acre Government Campus in downtown Boca Raton is finally moving forward, nearly a decade after the city first set its sights on revitalizing this aging area. The process, which started in 2016, has faced delays, but now, in 2025, we are closer than ever to realizing a more vibrant, sustainable, and connected downtown.

By the time you read this the City Council will have heard proposals from four groups competing to become partners with Boca Raton to transform this critical space. At the February 11 th Council meeting these plans will be ranked, marking a major milestone in what promises to be a transformative project. The proposed redevelopment aims to blend essential public services with modern spaces for residents, business, living and recreation, creating a more pedestrian-friendly downtown, connected to the Brightline station and better suited to the evolving needs of our community.

A Long Journey. The idea of redeveloping the Government Campus was first explored in 2016 when the City issued a Request for Proposal (RFP) to rethink the outdated infrastructure. In 2017, Song + Associates, an architectural firm, was selected to lead the charge. However, their proposed plans faced pushback due to high costs, leading to further delays. Then, in 2020, the COVID-19 pandemic shifted priorities and the project stalled.

But the vision never disappeared because the need is clear. The City Council kept the redevelopment on its radar, listing it as a priority in strategic public planning sessions. By late 2024 the private sector responded and the city received two unsolicited proposals for the redevelopment, prompting an open call for transparent, competitive options under a state statute designed to save taxpayer dollars and spur innovation. Months later, at the January 2025 deadline, four groups had submitted their proposals.

These proposals—by Boca Raton City Center, LLC; Namdar Group; Related Ross; and RocaPoint Partners—have undergone initial financial, planning and infrastructure review. Each offers a unique vision for the Government Campus, but all share a focus on enhancing connectivity, sustainability and mixed-use development. Responding to Current and Future Needs of Boca Raton. This project is not just about new structures; it ’s about reimagining what downtown Boca Raton could be. The goal is to create a space that fosters a sense of place, promotes economic vitality and enhances the quality of life for residents. The development will focus on improving public services, creating pedestrian-friendly streetscapes and offering new opportunities for business and residential growth.

As part of this process the city has committed to a transparent, inclusive approach. Residents will have the opportunity to weigh in at every City Council meeting, during all stages, with public engagement at ongoing feedback opportunities. The City Council is taking a leadership role to ensure this effort is successful, sustainable and right-sized for a sunny future for all of us. What Comes Next. The timeline for the redevelopment process is responsible, ambitious and eminently achievable. Once the Council ranks the proposals in February the next step will be negotiating an interim agreement with the top group, setting clear terms in the detailed planning, financial and infrastructure components

of the initiative sometime in March/April of 2025. As part of the process the city has also established a Frequently Asked Questions (FAQ) section on its website to help residents stay informed. Some key takeaways include: Impact on Taxes: The project will not raise property taxes but will generate new property taxes and land lease revenues for the city.

Public Input: Residents are encouraged to provide feedback via an online form or by attending ongoing public meetings. Of course, I am always available to you via email or phone for any thoughts or ideas.

Community Improvement: A focus of the initiative is to improve the area’s infrastructure, better utilize the mobility and economic benefits of our Brightline partnership and create a more pedestrian-friendly environment while preserving the vibrant, welcoming character of downtown.

Moving Forward. As this exciting project moves through the review, selection and negotiation process I welcome your engagement. The Government Campus redevelopment will be a new landmark that blends civic needs with a more connected, sustainable future. The next few months will be critical as we collectively work toward shaping a better future for our downtown. For more information visit the city ’s Government Campus Master Plan page or contact me at fnachlas@myboca.us or (561) 221-7902. As always, I ’ d love to hear from you.

Asset Protection in Estate Planning

You’re beginning to accumulate substantial wealth, but you worry about protecting it from future potential creditors. Whether your concern is for your personal assets or your business, various tools exist to keep your property safe from tax collectors, accident victims, health-care providers, credit card issuers, business creditors, and creditors of others.

To insulate your property from such claims, you’ll have to evaluate each tool in terms of your own situation. You may decide that insurance and a Declaration of Homestead may be sufficient protection for your home because your exposure to a claim is low. For high exposure, you may want to create a business entity or an offshore trust to shield your assets. Remember, no asset protection tool is guaranteed to work, and you may have to adjust your asset protection strategies as your situation or the laws change.

Liability insurance is your first and best line of defense

Liability insurance is at the top of any plan for asset protection. You should consider purchasing or increasing umbrella coverage on your homeowners policy. For business-related liability, purchase or increase your liability coverage under your business insurance policy. Generally, the cost of the premiums for this type of coverage is minimal compared to what you might be required to pay under a court judgment should you ever be sued.

A Declaration of Homestead protects the family residence

Your primary residence may be your most significant asset. State law determines the creditor and judgment protection afforded a residence by way of a Declaration of Homestead, which varies greatly from state to state. For example, a state may provide a complete exemption for a residence (i.e., its entire value), a limited exemption (e.g., up to $100,000), or an exemption under certain circumstances (e.g., a judgment for medical bills). A Declaration of Homestead is easy to file. You pay a small fee, fill out a simple form, and file it at the registry where your deed is recorded.

Dividing assets between spouses can limit exposure to potential liability

Perhaps you work in an occupation or business that exposes you to greater potential liability than your spouse’s job does. If so, it may be a good idea to divide assets between you so that you keep only the income and assets from your job, while your spouse takes sole ownership of your investments and other valuable assets. Generally, your creditors can reach only those assets that are in your name.

Business entities can provide two types of protection — shielding your personal assets from your business creditors and shielding business assets from your personal creditors

Consider using a corporation, limited partnership, or limited liability company (LLC) to operate the business. Such business entities shield the personal assets of the shareholders, limited partners, or LLC members from liabilities that arise from the business. The liability of these owners will be limited to the assets of the business.

Conversely, corporations, limited partnerships, and LLCs provide some protection from the personal creditors of a shareholder, limited partner, or member. In a corporation, a creditor of an individual owner is able to place a lien on, and eventually acquire, the shares of the debtor/shareholder, but would not have any rights greater than the rights conferred by the shares. In limited partnerships or LLCs, under most state laws, a creditor of a partner or member is entitled to obtain only a charging order with respect to the partner or member’s interest. The charging order gives the creditor the right to receive any distributions with respect to the interest. In all respects, the creditor is treated as a mere assignee and is not entitled to exercise any voting rights or other rights that the partner or member possessed.

Certain trusts can preserve trust assets from claims

People have used trusts to protect their assets for generations. The key to using a trust as an asset protection tool is that the trust must be irrevocable and become the owner of your property. Once given away, these assets are no longer yours and are not available to satisfy claims against you. To properly establish an asset protection trust, you must not keep any interest in the trust assets or control over the trust.

Trusts can also protect trust assets from potential creditors of the beneficiaries of the trust. The extent to which a beneficiary’s creditors can reach trust property depends on how much access the beneficiary has to the trust property. The more access the beneficiary has to the trust property, the more access the beneficiary’s creditors will have. Thus, the terms of the trust are critical. There are many types of asset protection trusts, each having its own benefits and drawbacks. These trusts include:

• Spendthrift trusts

• Discretionary trusts

• Support trusts

• Personal trusts

• Self-settled trusts

Since certain claims can pierce domestic protective trusts (e.g., claims by a spouse or child for support and state or federal claims), you can bolster your protection by placing the trust in a foreign jurisdiction. Offshore or foreign trusts are established under, or made subject to, the laws of another country (e.g., the Bahamas, the Cayman Islands, Bermuda, Belize, Jersey, Liechtenstein, and the Cook Islands) that does not generally honor judgments made in the United States.

A word about fraudulent transfers

The court will ignore transfers to an asset protection trust if:

• A creditor’s claim arose before you made the transfer

• You made the transfer with the intent to defraud a creditor

• You incurred debts without a reasonable expectation of paying them
