Over the years the SDTA has built a working relationship with all of the Government entities within the State of South Dakota that deal with transportation. To name just a few there is the DOT, SD Highway Patrol, SD Motor Carrier Division, DMV, IFTA, and the states FMCSA department. Through seminars we are not only kept informed and updated on the new and changing transportation regulations, but also asked for input on almost everything that deals with transportation. We all constantly nurture these relationships because it is in everyones best interest. Regulators have enough to do. They prefer to keep us informed and compliant rather than reprimand us for noncompliance. It is much easier and less stressful to just do it right. We witness the benefits of these relationships every day, but occasionally one will just stand out and slap you in the face. This year at the Fall seminar in Rapid City Sgt. Stern and Master Inspector Ryan Lindblom from the SD Motor Carrier division not only spoke on a number of issues, but also informed us that SD Motor Carrier Divisions has purchased a second brake testing machine. I have observed several demonstrations with this machine and it intrigues and fascinates me, so I had a number of questions. I also inquired about demonstrations. Some will say be careful for what you ask. A couple weeks later I was entering the Port in Tilford and I see the brake testing machine set up in the lot. As I crossed the scale, my normal green light suddenly changed to the OH NO green arrow. Well as I circled around Inspector Lindblom exited the rear of the building and directed me to the brake machine. So I got to try it firsthand. Suddenly I realized I was also getting a level one inspection, but the irony of it was because of the working relationship we all have, it was pleasant and productive. We joked and laughed a little, we discussed the regulations and issues from a regulators point of view. From a user’s point of view and we even roasted a few. How often and in how many other States can you have a positive and productive outlook on a level one inspection. Down side is, I did not drive away incident free. I have to confess, I was and am embarrassed. I was 60 days expired on my annual inspection. In this case, I think regulator and operator both had a sense of gratification of all the educational seminars. Again this year’s 2020 Legislative Reception and `Social was a grand success. It is impossible to explain, if you have never attended one you should next year.

After our winter meeting of the SDTA Board, we had the annual social with the legislators. I feel it was one of the best attended socials we have had to date. I want to thank everyone that took the time to drive to Pierre and represent this industry that is vital to the economy of this state. I am writing this message on the 17th day of the 2020 South Dakota Legislative Session. We are almost half way through with consideration of around 500 Bills. Most of this industry’s desires are being met either by killing or passing an issue. I will keep you posted through my bi-weekly legislative updates sent by email. If you closely review my legislative updates, you will see there are some repeated issues and some that are a new concept or idea. There is another bill that is attempting to solve our distracted driving issues in this state. House Bill 1169 - Prohibit the use of certain handheld electronic wireless devices for electronic messaging while driving will be having its first hearing this week. If you recall, the same bill got within one vote of being adopted last year. I am hoping it gets over the line this year; it is time for the drivers of 4-wheelers to have the same requirements the trucking industry has had for several years. As you know, commercial truck drivers are presently prohibited from texting and holding a cell phone while driving. Coupled with the fact that when a truck has an accident with another motor vehicle, more than 75% of those crashes are NOT caused by the truck driver. Yet, in this state, noncommercial motorists continue to text while driving; it’s time to stop this practice! Please take a few minutes to review the bill tracking list that appears in this publication or review the latest email that highlights some of the issues. As always, if you have questions or comments regarding what is happening with a particular bill, please do not hesitate to reach out to your SDTA Office and one of the staff members will quickly get me a message. The session does not officially end until Monday, the 30th of March. Until then, I will try my best to keep you updated. Stay safe and stay warm! Until next month...

The Federal Motor Carrier Safety Administration (FMCSA) announced a full delay of the Entry-Level Driver Training (ELDT) final rule, until February 7, 2022. The ELDT final rule established minimum training standards for individuals applying for a commercial driver’s license for the first time. FMCSA states the decision to transition from a partial delay to full delay of the ELDT requirements was due to delays in the development of the Training Provider Registry (TPR) and also delays with the integration of State Driver License Agencies. In comments to the Agency’s initial ELDT delay, the ATA did express similar implementation challenges and concerns, but suggested the Agency pursue a phased-in approach. Due to setbacks with the TPR, a critical piece of the ELDT requirements, the Agency has decided to delay the entire rule.

Did you know that employees who receive benefits communications are 30% more satisfied with the value of their plan1? With that in mind, it’s Age-Related Macular Degeneration Awareness Month. And we’re committed to arming you with the best information to share with your employees. So let’s take a look at how we can take care of our eyes and minimize visual disruption as the years go by. Have you heard of age-related macular degeneration? More commonly known as AMD, this progressive eye condition is the number one cause of severe vision loss and legal blindness in adults over age 65 in the United States.
Wondering what AMD is? It’s a condition that attacks the macula of the eye and eats away at your clear, “straight ahead” central vision, necessary for daily tasks like: • • • •
Driving Identifying faces Watching TV Reading this
There are several factors that can increase the risk of AMD outside of age (which is the biggest factor): • • • • • •
Family history High-blood pressure Diabetes Excessive fat intake Smoking Vitamin D deficiency
While there is no cure for AMD, treatments are available that may alleviate some of the effects: • • •
Adding certain vitamins to your daily routine, Low vision aids—like magnifying devices and reading machines Dietary supplement lutein/zeaxanthin
To learn more about AMD symptoms and treatments visit the website at: www.vsp.com. Visiting your VSP® network doctor (https://www.vsp.com/eye-doctor) annually is a crucial aspect of early AMD detection. Thank you,
Theresa Hammergren
