DIRECTOR’S NOTES

DAVID REISS | SDML EXECUTIVE DIRECTOR The 2023 calendar year is nearing its conclusion—as is my first year on the job as your executive director.

As a new director, I have had the opportunity to meet so many people across South Dakota that care deeply for their communities and dedicate immense amounts of time and devotion to improving services, facilities, and engagement with citizens.

From elected leaders to municipal employees to volunteers, I encounter opportunities daily to appreciate the role municipalities play in improving the lives of community members. I am humbled to work with and for you.

Throughout the year I have had the chance to hear from our members about many topics and learned much about the issues South Dakota municipalities currently face. From administrative needs to burgeoning construction costs to revenue concerns, our cities face legitimate issues that require serious planning and thoughtful citizen engagement to bring about positive outcomes.

Municipalities work on hard issues and as public servants we endure a significant amount of scrutiny in our decision-making and how we implement policy and programs. We lean on our co-workers, local experts, and peers within other local units of government to solve problems through mutual respect and the need to meet community needs where they occur.

Our ability to communicate with neighbors and peers is paramount to identifying and advancing local issues, and through communication we find

solutions. It is important that we build our capacity to communicate and engage with our community members, our local government peers, and with state and federal entities to impress the importance of local control and maintain our affordances to address local issues where they occur, locally.

With the turn of the calendar year, we also near the 2024 legislative session. I look forward to working with legislators and statewide leaders to develop solutions to the problems facing South Dakota communities and citizens. Our team is ready to represent municipal concerns, address needed legislation for municipal governance, and promote local control of decision-making within South Dakota cities. Look for our legislative recap email that recounts the happenings during each week of the 2024 session. The first edition will be sent the first week of January just before session starts.

Lastly, I want to highlight how grateful I am to work with a dedicated, expert staff to serve our League members. Each of us at the League have a passion for serving the employees and elected leaders of South Dakota cities. We’re especially excited to begin planning for the future with you and celebrating our past as the South Dakota Municipal League recognizes its 90th anniversary next year. Look for exciting 90th anniversary happenings throughout 2024, culminating at our annual conference in Sioux Falls.

Myself and the League staff are excited to serve you in 2024 and wish you a very Merry Christmas season.

PRESIDENT’S REPORT HARRY WELLER | SDML PRESIDENT

Some of my best memories of the season years ago was the Sunday School Program at Zion Lutheran Church on Christmas Eve. Now, I look forward to time with family and friends; and hopes of good travel times. We will have one addition this year - President Harry and First Lady of Kadoka, Nancy, will be great grandparents!

What will the Christmas season be like in your community? Yes, I know it gets to be a busy time with all the

hustle and bustle that goes on, plus school programs for some and parties for others. I encourage you to share the holiday spirit as best you can.

Please take the time to say “thank you” to your first responders in your community that keep us safe. Also say thank you to the family members of these people who give up weekends and holidays in our communities.

Sometimes I wonder why we do all these special things at Christmas, when we could - and should - do them all year long.

Also, remember the “bell ringers” in many of our larger cities, if at all possible.

Drones: The New First Responder Tool?

Congress reauthorizes the Federal Aviation Administration (FAA) every five years and is currently working on renewing the FAA, which is crucial for the future of drone technology.

Congress is considering language that would require the FAA to create regulations for drones to fly Beyond Visual Line of Sight (BVLOS). BVLOS refers to the operation of a drone when it is not within the pilot’s direct visual line of sight. In other words, the drone is flying at a distance from the pilot where they cannot see it with the naked eye.

The regulatory approval to allow licensed and trained pilots to fly drones beyond line of sight is crucial for Drones as First Responder (DFR). DFR is an emerging technology that involves the use of drones to support the role of first responders in emergency situations.

DFR aims to augment and enhance the efforts of first responders by deploying drones equipped with various sensors, cameras, and payloads to perform and support in critical tasks in emergency situations. Right now, more than 15 DFR programs in the U.S. operate with a BVLOS waiver from the FAA. The Chula Vista Police Department in California is the leader in DFR programs, as they took on the difficult task of piloting the concept of DFR. Both the US Senate and House included legislative language in their FAA reauthorization bill. This language would require the FAA to create and publish BVLOS regulations within 24 months. This would allow for nationwide Drones as First Responder programs.

The DFR program can provide great benefits to communities, support the safety of our first responders, and support them in their critical work: • Rapid Assessment: Drones can quickly fly to the scene of an emergency, such as a car accident or shooting, and provide real-time aerial footage and data to first responders. This helps them assess the situation, identify hazards, and plan their response more effectively and safely.

• Search and Rescue: Drones equipped with thermal cameras and other sensors can be used to locate missing persons in search-and-rescue operations, especially in remote areas or in times of natural disasters.

• Emergency Medical Delivery: Drones can transport essential medical equipment at speed or to inaccessible or dangerous areas where traditional means of transportation is too difficult and slow.

DFR has great potential to improve the efficiency and effectiveness of first response efforts. There are important privacy considerations to think through as well, to make sure everyone is protected, governments should review and create policies that balance the privacy and benefits of this new technology. ■

Applications Open for 2024 All-America City Award WASHINGTON, DC – The National Civic League is now accepting applications for the 2024 All-America City Award.

The theme for 2024 is "Strengthening Democracy through Local Action and Innovation." The National Civic League is looking forward to celebrating the 75th anniversary of the All-America City Award and will be working with communities to identify local threats to democracy and innovative ways of addressing them.

As the 2024 elections approach, many communities are experiencing some of the same threats to democracy we see at the national and international levels, including polarization, economic inequality, anti-democratic activities, and racial and ethnically motivated violence.

We are at a decisive moment in history, and strengthening and improving

democracy begins locally. When people have meaningful opportunities to help make decisions and solve problems, they build trust, create a stronger sense of community, and help address important challenges.

The 2024 All-America City Award will recognize communities that are finding innovative ways to equitably engage community members in activities that strengthen democratic processes, like making it easier to vote, engage in community affairs, and serve in leadership roles.

Communities interested in applying for the 2024 All-America City Award should submit a letter of intent to apply by Dec. 14, which saves applicants $100 on the application fee. Please note that a letter of intent is not required to apply.

All-America City applicants for 2024 will be asked to demonstrate innovation, impact, equity and inclusiveness, civic engagement, and cross-sector collaboration by discussing the strength of their civic capital—the formal and

SD AIRPORT MANAGEMENT ASSOCIATION

The purpose of this association shall be: • To foster the planning, development, use and operation of public airports in the State of South Dakota; • To assist its membership in resolving problems though mutual experiences in airport operations; and • In cooperation with the South Dakota Municipal League, to take an active part in legislation that may affect public airports in the State of South Dakota.

ANNUAL DUES of the association are $50 per city; Associate membership is $75/person.

SD MUNICIPAL ATTORNEYS’ ASSOCIATION

The purpose of this association is to establish a forum by which municipalities may promote matters of mutual interest and provide a closer working relationship in municipal government and administration by the following means: • Holding meetings for the discussion of legal and other questions affecting municipal governments; • The furnishing of information to municipal law officers and departments in order to enable them to better to perform their functions; and • Studying legislation, court decisions and administrative rulings relating to the public interest of municipalities.

ANNUAL DUES of the association are $35 for each city represented that is over 5,000 population and $20 for each city that is under 5,000 population.

SD BUILDING OFFICIALS’ ASSOCIATION

The purpose of the association shall be: • The consideration of principles and practices underlying the laws and ordinances relative to the construction, maintenance and occupancy of buildings, use of land, and methods of uniform administration; and • To develop requirements and regulations pertaining to training of building officials and administration officers.

ANNUAL DUES of the association are as follows: • Governmental Membership (GM) is $50; each additional Governmental Individual (GI) membership is $5.

• Governmental Members shall be a designated individual, usually the building official, of a government agency (state, county or municipal), which is responsible for the enforcement or administration of laws and ordinances relating to building construction.

• Governmental Individual Members shall be additional employees of governmental agencies which are responsible for the enforcement, or administration of laws and ordinances relating to building construction.

• Professional Membership (PM) is $50; each additional Professional Individual (PI) membership is $10.

• Professional Member shall be a designated individual of a firm, incorporated or unincorporated, engaged in the practice of architecture, engineering, inspection, research, testing or related activities.

• Professional Individual Member shall be additional employees of professional firms that practice architecture, engineering, inspection, research, testing or related activities.

• Annual Associate Membership (AM) is $25.

• Associate Member shall be a representative of firms or corporations of commercial and industrial concerns engaged in the sale, manufacture or processing of materials and assemblies.

The purpose of this association shall be: • To increase the proficiency of managers and administrators of local governments; • To strengthen the quality of local government through professional management;

• To encourage and support the precepts of the council/ manager plan; • To maintain the high ethical standards of the profession of city management; and • To provide opportunities to enhance the professional development of its members.

ANNUAL DUES of the association are as follows: • Full membership is $150 per person.

• Full Members: Any person who is a City Manager or Administrator, or an assistant to City Manager or Administrator of a South Dakota City shall be eligible for full membership in the Association.

• Associate membership is $75 per person.

• Associate Members: Persons holding responsible administrative positions in South Dakota cities and other persons who are interested in the objectives of the Association shall be eligible for associate membership.

• Student membership is $15 per person.

• Student Members: Any person currently enrolled full or part-time in a graduate or undergraduate program with an interest in local government.

SD ASSOCIATION OF CODE ENFORCEMENT

The purpose of this association is: • To operate, without profit to the Association, or its members, as a state association to advance, educate and improve efforts of state, county, city and other political subdivision employees who are actively involved with and responsible for the enforcement of housing, municipal, county, state or federal codes without regard to race, creed, color, national origin, or sex; • To encourage professionalism with regard to the standardization of enforcement of environmental and housing codes; and • To supply and advance the science and practice of code enforcement through certification and to provide training workshops, seminars and conferences facilitating and advancing the administration of the various codes with which the Association is concerned.

ANNUAL DUES of the association are $75 per city.

SD MUNICIPAL ELECTRIC ASSOCIATION

The South Dakota Municipal Electric Association, formed in 1950, serves member municipalities that provide electricity to approximately 100,000 South Dakotans.

The Annual Meeting is held each October during the Municipal League Annual Conference.

The Electric Superintendent-Foreman Conference is held each spring in Watertown.

The purpose of this association is: • To establish a forum by which cities and towns may promote matters of mutual interest and provide a closer working relationship that there may be improvement in municipal government and administration; • To promote the improvement of methods of governmental finance in South Dakota including the development of mutually understandable procedures of accounting, budgeting, and financial reporting; and the encouragement of the use of common terminology, classification, and principles in regard to those subjects; and • To take an active part in legislation that may affect municipalities of the state through the South Dakota Municipal League.

ANNUAL DUES of the association are $40 for the first person and $30 for each additional person of the same city.

SD GOVERNMENTAL HUMAN RESOURCE ASSOCIATION

The purpose of this association is: • To advance the profession of human resource management in governmental entities by promoting matters of mutual interest and providing a closer working relationship so that there may be improvement in government and administration; and • To promote the improvement of all aspects dealing with Human Resources in South Dakota through information sharing and consolidated training with a special emphasis on assisting smaller communities and to take an active part in legislation that may affect the governmental entities of the state through the South Dakota Municipal League.

SD POLICE CHIEFS’ ASSOCIATION

The purpose of this association shall be of an educational, scientific, benevolent, fraternal and charitable nature and to develop a closer official and personal relationship between the various law enforcement officials of the State of South Dakota.

• To maintain a steadfast resolution to guard the rights, liberties, and welfare of all citizens; • To foster any project which will help bring law enforcement officials recognition as professionals, to increase the efficiency of the member of aiding in the improvement of the laws of the State of South Dakota and demanding the enforcement of the same; and • To encourage the members to attain a high degree of skill and efficiency in law enforcement work, thereby advancing the standards of all enforcement officers.

ANNUAL DUES of the association are $200 per city. Dues include all law enforcement from the member city that wish to participate.

SD MUNICIPAL STREET MAINTENANCE ASSOCIATION

The purpose of this association is to provide education and instruction for municipal street maintenance workers and to assist in meeting their goals through encouragement and friendly exchange of knowledge and experience among its members.

ANNUAL DUES of the association are $35 per city. ■

Key cases for local governments to watch include issues relating to a possible new standard for employment liability, the First Amendment regarding a public official’s social media account and the ability of local governments to collect legislatively enacted exaction or impact fees. As the court regularly accepts additional cases to their current term docket until the end of January or early February, there may be additional significant cases that touch on local government interests in the cases yet to be determined for this term.

The Supreme Court agreed to take on the issues in two important First Amendment social media cases. The issue in both of these cases is almost identical and relates to whether an elected public official’s social media activity can constitute state action under the First Amendment when the social media account in question purports to be personal in nature although it is sometimes used to communicate matters related to the official’s public office or role.

Courts have used different tests to determine what constitutes “state action” for the purposes of lawsuits brought forth under Section 1983. This law allows individuals to sue government employees and officials acting “under the color of state law” for civil rights 12

A ruling that weakens the requirements of showing an adverse employment action would create unwarranted liability for local governments as employers.

he issue in this case is whether a landuse exaction or impact fees authorized by legislation are exempt from the unconstitutional-conditions doctrine found in previous decisions (Nollan v.

California Coastal Commission and Dolan v. City of Tigard, Oregon). The U.S. Supreme Court has identified land-use exactions as a special kind of “taking” under the Fifth Amendment and “Takings Clause”. The Takings Clause says private property cannot be taken for public use without just compensation.

and must show “rough proportionality” between the exactions and proposed impact of the development. The question for the Court to determine now is whether the Nollan/Dolan tests apply to exactions that are authorized through legislation, which are different than the ones imposed on an individual or implemented on an ad hoc basis as they apply to a broad class of property owners.

Since exactions have become an important tool to help local governments balance the need for smart growth with the impacts of that growth on their community, a decision that rules in favor of the application of the Nollan/ Dolan test to legislatively enacted exactions would negatively impact local governments’ ability to assess these fees as they would need to meet a more demanding legal standard than most states currently require.

There have been two separate cases consolidated for the U.S. Supreme Court’s review in this matter and both involve the issue of whether the Due Process clause requires state or local governments to provide a post-seizure probable-cause hearing to occur prior to a statutory judicial-forfeiture proceeding and, if so, when such a hearing must take place. This will be the second time the court has granted agreed to take on this issue since 2009, when they accepted a case with similar issues but ultimately dismissed the case as moot – meaning the underlying controversy had been resolved in one way or another.

The determination of whether the Due Process clause requires a probable cause post-seizure hearing directly impacts local governments as it could open new avenues for liability if such a hearing is required. New requirements that such a hearing must be held in a

certain time frame will raise issues of financial liability on local governments and may cause additional operational strains if the ruling imposes an unreasonable speedy hearing requirement.

As argued by local government interest groups when the 2009 case was accepted by the U.S. Supreme Court, this case raises federalism concerns as states can and do impose their own requirements on this matter on top of what the Due Process clause requires to protect innocent owners from onerous forfeiture proceedings.

Therefore, the proper way to address concerns regarding the requirement of a probable cause post-seizure hearing and the timings of such should be handled through the state legislative process as they are better equipped to weigh in on the competing interests versus the federal courts. ■

We cannot stress the importance of this document enough.

The information assists with determining the assigned adjuster and initial reserves. The details explain the extent of injury and gives an indication if subrogation is applicable. We also contact the persons listed on the form so having the names and phone numbers clearly identified is of great assistance.

The information from the form is submitted to the Department of Labor and Regulation and to Insurance Benefits for data and reporting. It is important that the job classification and injury codes, as well as the body parts, are accurate.

VOLUNTEERS

Municipal volunteers are statutory employees under the workers’ compensation statute 62-1-5.1 if they are duly appointed and that appointment is entered into the official records or minutes. Please remember to document your roster of volunteers and obtain board or city council approval.

SUBROGATION

For lack of better explanation, subrogation means reimbursement. If there is a work injury as a result of another party’s wrongdoing, workers’ compensation will pay benefits and send a subrogation claim to the responsible party. We will seek reimbursement for the monies paid. A couple of notable statutes apply: SDCL 62-4-40 indicates that the insurer/provider may collect recovery “in his own name.” This means that the work comp carrier can pursue recovery regardless of the intention of the employee to pursue a liability claim.

Oaths of Office: There is nothing in Administrative Rule that outlines the form/wording of an oath of office. A South Dakota map will tell you that Volga lies southeast of the intersections of U.S. Highway 14 and County Highway 5. In reality, Volga sits at the intersection of big town opportunity and South Dakota hometown community feel.

Volga’s growth is vigorous, boasting a 20 percent increase in population each of the last two census periods. Despite this growth, Volga has maintained a friendly, welcoming environment on main street, in its churches, and schools.

This workforce growth has not gone unnoticed by business owners, with six businesses locating in our newest Creekside Industrial Park, joining longtime Volga firms South Dakota Soybean Processors and Prairie Aqua-Tech (now called Houdek). Manufacturing is complimented by new retail enterprises with franchises like Dollar General and Ace Hardware, and new restaurants and coffee shops such as Hello Larsons, Subway, and Los Tapatios all locating in Volga in this same time period.

All this growth has evidenced itself in attractive new homes, new parks, an archery range, and a dog park to complement the city’s gardens plots, golf course, and swimming pool.

Volga has responded with upgrades to its water and sewer systems as well as electrical infrastructure to ensure steady service for industrial, commercial, and residential customers. Our new water tower was recently named one of the Top 12 Tanks in an annual design contest.

Volga is also home to the Sioux Valley Cossacks, a well-respected K-12 public school system serving 700 students. The K-8 Volga Christian School serves an additional 50 students in its programs.

Both school systems boast state-of-theart facilities with new construction in the last five years.

VOLGA'S NEW WATER TOWER stands at the edge of town, overlooking the surrounding farmland.

The tower was recently named one of the Top 12 Tanks of 2023 in annual design contest by Tnemec, a company that supplies tank surface coating across the U.S. and Canada.

Volga is not only about the “new” but honors the town’s heritage in the complex housing the Brookings County Historical Museum located in Peeke Park, named for the legendary medical professional who lived in Volga and whose storied career as the classic country doc, was captured in the book, “Doc Peeke” by Deanna Boone. Peeke is a member of the South Dakota Hall of Fame.

Volga is mentioned prominently in the popular children’s “Little House” books.

SIOUX VALLEY HIGH SCHOOL provides top-notch education to over 700 students from Volga and the surrounding area.

Chapter 11 in “The Long Winter” is titled “Pa goes to Volga” and tells the tale of Charles Ingalls and other pioneers digging out a snow bound train to reach food supplies in Volga for the starving citizens of DeSmet.

Volga was also home to Dell Paddock who was a major league ball player for the Chicago White Sox and the New York Yankees. Paddock’s career was not long, but few towns our size can boast a big leaguer amongst its citizens.

Turn off Highway 14 and you will witness the variety of Volga that attracts more and more visitors and its 2,113 residents who are happy to call it home. ■

Electric Vehicle Charging Station Grants Available PIERRE, S.D. –The South Dakota Department of Agriculture and Natural Resources (DANR) is accepting applications for round three of the Volkswagen Electric Vehicle Charging Station Program. The goal of the program is to improve and protect ambient air quality across South Dakota.

The application deadline is February 16, 2024.

Applicants may be reimbursed up to 80 percent for lightduty electric charging stations installed in South Dakota.

Stations must be available to the public 24 hours per day, seven days per week. Eligible participants include federal, state, or local governments, businesses, and nonprofit organizations.

Approximately $1.2 million is available for the Volkswagen Electric Vehicle Charging Station Program. The charging station program is part of the Volkswagen Settlement - South Dakota Mitigation Trust fund authorized by the legislature in 2019.

Guardians of the Inbox: Unraveling the Human Element in Cybersecurity Breaches While not quite as cool as the Marvel Universe version of the Guardians, your staff are in fact, the guardians of their inboxes. Despite the finest efforts of IT staff and software creators across the country, there is one thing that you cannot fully control... the human running the clicker! Unfortunately, there has been a significant increase in the frequency of cybersecurity breaches via email, and by significant, I mean an increase by over 400% so far this year when compared to the number of breaches in 2022. Over the next few paragraphs, we are going to talk through some of the ways we can attempt to steer clear of those bad intentioned requests.

Before we get to the people inside your entity, let’s talk about the people who are outside your entity either trying to get in, or trying to mislead you in some fashion. There are a few techniques that are employed by cyber criminals.

One of the most common is phishing.

We’ve talked about phishing previously in articles and training, and we all can agree… it’s not the fishing on the river… but the concept is similar. In both cases, bait is cast with the hope that someone (or a fish!) will take the bait, and once they do, all the person on the other end of the line has to do is pull the hook and reel in their catch.

or supervisor and ask the recipient to email back as they have a task for you to do. Assuming you fall for this request, the follow up would be instructions to secure gift cards, etc. These are the emails we don’t typically fall for. The more successful socially engineered emails cross over into that compromise zone where you are led to click a link or make a change.

Phishing by definition is an email sent by someone claiming to be reputable and making only legitimate requests.

One example of this type of phishing is an email received purporting to confirm a purchase you have made and including a link for you to click to review your purchase. Unfortunately, the link does not take you to purchase, but rather opens the door for hackers to access your system.

In each of these situations, you’ve released control over funds or allowed access to your system, and now you have to figure out how to get it back.

A more specific type of phishing is business email compromise. In this scenario, the typical end goal is for money to be sent to the hackers.

Some of these types of emails are less sophisticated and easily spotted.

However, the emails that we do often fall for are the ones where we receive an email from a familiar entity asking us to update banking information or click a link to access shared information. For example, you receive an email from an employee asking for their payroll information to be updated before the next payroll cycle, or a vendor asks for banking information to be updated. Once the banking information is updated, rest assured that any payments that are made will very likely never be recovered.

Another form of phishing is social engineering. Here the hackers get into your email and claim to be a manager

This is where we pause for a bit and think about how we avoid getting into this situation in the first place. To put yourself in the best position possible to avoid a cyber attack via your email system, it is important to recognize the most unpredictable factor of your operating system - the human factor.

We must understand that these email attacks are successful because they have been monitoring and learning how you and your employees interact, and what prompts responses. The requests are not made flippantly, but rather intentionally to generate responses.

Sophisticated hackers will not ask the recipient to do something that seems out of their typical comfort zone or would be outside of their normal assigned duties.

This is how the hacker will leverage trust and achieve their goal.

The hackers also understand the basic vulnerabilities of nearly all employees.

They understand that people in general have an over-reliance on technology.

We trust that the spam filter will catch those bad actors’ emails, that the QR code on the bulletin board was put there

by only someone with good intentions, and that the firewall will keep the bad people out. Additionally, the hackers know that as a whole, we have an overall lack of awareness of what types of emails hackers are sending. While we still may see emails from the prince of some foreign country seeking to send us our vast inheritance, we now see an email from our colleague down the hall asking for a favor. Those who seek to exploit our vulnerabilities know that lack of training and an increased level of stress in our workforce create the perfect storm for them to sneak in that request for an update to someone’s banking information.

If you still don’t think it happens in our state, I can, firsthand, guarantee that these emails are still out there. Just last month, I received an email purporting to be from one of my teammates, asking that I make sure that I update their

banking information. Some key things that I looked for were, first and foremost, the sender’s email. The email address was not that of my teammate, so it was easy to find. However, I have seen other emails which were so sophisticated that without a VERY close look, it would appear to be legit.

If I thought that the email was in fact from my teammate, the next step would have been to call them, not email them, but call them to confirm that they did request that banking change. I wish I could say that this has been isolated within our own organization. We have received several claims over the past few months where emails, and even a fax, were sent asking our finance folks to make an update or change to banking information ahead of payday.

Let’s just say that come the Monday after payday, there were some very unhappy employees waiting at the door.

Another example of phishing attacks that seemed legit came in similar fashion, but from two different entities. Both emails came with an attachment that looked like an email within an email was being forwarded to me. One purported to contain some financial information from an organization that I frequently would receive this type of data from, and the second purported to be sending me data for an upcoming quote. While I had not expected anything from either of these two specifically, I had to stop and think about the logistics of the email and whether or not I should be opening them. A phone call later and I was informed that there was not in fact an email meant for me, and that those email boxes had been breached.

So how do we help reduce the likelihood of our human factor being the weak link in our cyber security chain? First and foremost, we need to embrace

SDPAA CYBERSECURITY (CONT) that technology is a part of our day-to-day lives, and that unfortunately, it’s an avenue that hackers are going to try to merge into for their own self-serving purposes. Each organization must take steps to create a culture of cyber awareness. Through training and testing, this culture will be reinforced and will grow.

Members of the SDPAA have access to some online training opportunities through the NEO-Gov platform.

Everyone who has access to the internet has resources which are available through the Department of Homeland Security and CISA, for absolutely no cost to you.

For those entities ready to really develop their cyber culture, there are other opportunities for cybersecurity awareness and development. You can work with your IT professionals to conduct regular phishing simulations and base follow-up training on the various responses, successes, and failures of these simulations. In 2022, the SDPAA encouraged all Members of the Pool to sign up for the DSU Project Boundary Fence analysis which would help to identify those vulnerabilities within your system. While the credit incentive program is no longer offered, Project Boundary Fence is still an opportunity available to all public entities across South Dakota!

Beyond these training opportunities, we encourage your organization to encourage collaboration between your IT professionals and your employees. Dissolve the notion that the only purpose that IT serves is to take away access to the “fun” sites on the internet and reinforce that they are a critical part of the team that is protecting the organization from bad actors. Introducing updated protective technology solutions such as an advanced email filtering system and email authentication as well as installing and enabling Multi-Factor Authentication will significantly decrease your vulnerability to those seeking to take advantage of your humans, and your organization.

The sooner we embrace the notion that technology isn’t going away, and that we must be vigilant protectors of our systems, the sooner the bad actors will find more productive uses of their time. Arming your human resources with the technological tools and basic training that they need will significantly help reduce your exposure to those cyber bad actors. Remember that just having a policy doesn’t do much good unless you’re training and reinforcing the how and why of the policy. Define your cyber culture, train, and develop it.

Stay vigilant friends. As technology becomes more sophisticated, so must our awareness. Oh, and tell anyone who will listen… DO NOT CLICK THE LINK! CALL BEFORE YOU (yes dig, but also) CHANGE THE BANKING INFORMATION! ■

Deadwood Fund grant applications Due Feb. 1 PIERRE, S.D. – The South Dakota State Historical Society announced that the applications for the first round of the 2024 Deadwood Fund grant program are due on Feb. 1, 2024, for work beginning no earlier than May 1, 2024.

Grant forms are available online at https://history. sd.gov/preservation/fundingopportunities.aspx.

The program is designed to encourage restoration or rehabilitation of historic properties by individuals, organizations, or public agencies, according to State Historian Ben Jones, director of the State Historical Society, whose historic preservation office administers the program.

Grants will be awarded in amounts ranging from $1,000 to $25,000. The grant amount must be matched at least on a dollar-for-dollar basis from nonfederal and nonstate sources. Nonprofit organizations will be allowed to use in-kind services for one-half of their match.

Funding for the program is from Deadwood gaming revenue earmarked by state law for historic preservation projects throughout the state and distributed by the State Historical Society.

Payroll Concerns When Paying Bonuses to Hourly Employees AARON CLARK | McGRATH NORTH When employers pay bonuses to hourly employees, they often overlook payroll issues relating to the calculation of overtime. For example, employers may pay nondiscretionary bonuses to hourly employees based on production, quality of work, attendance, or longevity.

In many cases, the employer simply pays the bonus without considering how this could impact the employee from a payroll standpoint with respect to overtime.

Non-exempt employees working more than 40 hours a week, must be paid 1.5

times their “regular rate” for all overtime hours under the Fair Labor Standards Act (FLSA). When nondiscretionary bonuses and other payments are made to an hourly employee, this can have an impact on the calculation of overtime.

Under the FLSA, the “regular rate” used to calculate overtime must include “all remuneration for employment.” Failing to include certain payments or bonuses when calculating overtime may violate the FLSA and give rise to overtime liability.

Some bonuses do not have to be

included when calculating overtime. For example, discretionary bonuses do not have to be included. Generally, a bonus is discretionary if the employer has the sole discretion to determine whether the payment will be made and the amount of the payment. Such payments are not made pursuant to any promise or contract. Nondiscretionary bonuses, on the other hand, are generally promised and expected to be paid if the underlying conditions are met (e.g., the employee meets the criteria to earn the bonus based on production, work quality, attendance or longevity).

The FLSA requires that nondiscretionary bonuses must be included in the regular rate for purposes of determining overtime. There are a variety of ways in which the bonus can be allocated to comply with the FLSA. Here is one example that may help clarify the issue: Example: Suppose a non-exempt employee earns $10 an hour and works 50 hours during the workweek. The employee also receives a $20 production bonus from the Company.

Many employers overlook the overtime issue and simply pay the employee as follows: $500 for the employee’s 50-hour workweek ($10 an hour x 50 hours) $50 for overtime pay ($10.00 an hour x .5 = $5.00 x 10 hours) $20 for the production bonus $570 total weekly compensation Under the FLSA, the production bonus must be considered in determining the “regular rate” for of calculating overtime.

To calculate the overtime during the workweek the production bonus is earned, the employer must first calculate the new “regular rate” for the workweek, given the impact of the bonus.

To do so, the employer would add the production bonus to the total regular pay received by the employee for the week and divide that amount by the total number of hours worked.

The resulting pay rate (known as the new regular rate) is then halved and multiplied by the number of overtime hours worked to calculate the overtime due.

Using the above example, the employee’s total pay with the production bonus would be $520 ($10 an hour x 50 hours + $20 production bonus). The employee’s new hourly rate for overtime purposes would be $10.40 ($520 ÷ 50 hours = $10.40). Therefore, the employee’s compensation under the FLSA would be calculated as follows:

Although this seems like an insignificant amount, it can really add up when applied to multiple employees over an extended period of time.

The Department of Labor (DOL) has been cracking down on this issue. If the employer is ever audited or a claim is pursued by an employee, the DOL could require the employer to go back and pay all employees over the previous two years (or three years if determined to be willful) plus interest and possible penalties.

If you are paying nondiscretionary bonuses to hourly employees, it is always a good idea to check with legal counsel to ensure that you are calculating overtime consistent with the FLSA regulations. ■

America Cannot Retreat Isolationist: favoring a policy of remaining apart from the affairs or interests of other groups (Oxford Dictionary).

America must protect our national security. The crisis at the southern border is just one example of why prioritizing national security is essential to protect our citizens’ safety.

Illicit drugs and individuals on the terrorist watch list are coming into our country and must be stopped. Beyond our border, America needs a strong, prepared, and focused military to keep us secure at home while our servicemen and women fight wars abroad.

But America does not exist as an island. We must have an engaged and strong presence in foreign policy. In the face of international conflict, America has a choice – to lead, or retreat.

The decision we make affects the globe. The whole world takes note of how America responds to threats of war, invasion, and attacks on our allies.

They look to America’s leadership.

At the beginning of 2022, President Biden described how America’s response to a Russian invasion of Ukraine would depend on how “Russia went about it.” One month later, Russia launched a full-scale invasion of Ukraine, and since, America has failed to produce a strong plan of opposition to Russia’s tyranny.

When America retreats from fighting violence and terrorism, our enemies are all too eager to take our place. This doesn’t mean we need boots on the ground in every country, but we must remain a beacon of freedom and demonstrate peace through strength.

Leaders like Harry Truman, John F. Kennedy, Ronald Reagan, and Teddy Roosevelt rejected isolationism. Under their administrations, authoritarian, communist, and tyrannical rule could not stand. Their leadership helped bring peace to world wars, led to the fall of the Berlin Wall, and the ultimate collapse of the Soviet Union’s communist policies.

Our lack of leadership in foreign policy over the past few years has led to more conflicts, like Russia’s invasion of Ukraine, Hamas’ attack on Israel, and China’s looming threat to invade Taiwan.

Right now, in America, we are once again faced with opportunities to lead or retreat in the fight against authoritarians, communists, and terrorists.

We are at an inflection point. America should stand for democracy in Israel, Ukraine, Taiwan, and all across the globe, and stand in strong opposition to those who disagree.

Right now, we are experiencing the highest number of violent conflicts since the Second World War, and several of these began after the Biden Administration’s weak foreign policy took effect.

The unfortunate fruit of the lack of leadership is seen in the power vacuum created from the sloppy, and deadly, withdrawal of troops from Afghanistan,

We must take a strong stance to promote democracy and freedom on the world stage. Each country does not have to look like America, but we must be clear in our mission, ready to act, and steadfast in keeping our word. We cannot retreat, for the world is a safer place when America leads. ■

Notification shall be in written form, shall contain a copy of the resolution or amendment, and may be sent by electronic means or registered mail. Municipalities shall also provide any changes and additions to streets and addresses. (SDCL 10-52-13; See Hdbk., sec. 14.172) ■

First meeting of the year – A complete list of all the salaries for all officers and employees of the municipal corporation shall be published with the minutes of the first meeting following the beginning of the fiscal year or within 30 days thereafter. Added salaries of new employees and increased salaries of the old employees should be shown in the month in which they occur. A total of payroll by department shall be published monthly in the minutes. (SDCL 6-1-10; See Hdbk., sec. 5.095)

By January 14 – If the governing body chooses an election day other than the second Tuesday of April, as provided in SDCL 9-13, that Election Day must be established by January 14 of the election year. (SDCL 9-13-1; See Hdbk., sec. 7.050)

By January 15 – The secretary of revenue shall apportion the money in the local government highway and bridge fund.

(SDCL 32-11-35; See Hdbk., sec. 12.255(6)) Between January 15 and 30 – Publication of the notices of vacancies of the municipal election to be held in April is required to be published in the official newspaper once each week for two consecutive weeks between January 15th and 30th. This notice shall identify the vacancies to be filled and the time and place for filing nominating petitions. (SDCL 9-13-6; See Hdbk., sec. 7.650) Follow the Municipal Election Calendar for all election deadlines.
