DIRECTOR’S NOTES YVONNE TAYLOR

As hard as it may be to believe, we are only one year away from another election. While most of us don’t want to face the endless advertising and nasty Facebook posts from people who don’t agree, it IS time to start looking around at how races are shaping up, who is contemplating a run for office, and to start supporting the good folks who want to be elected to work for the betterment of our state.

In recent years, we seem to hear more from people we’ve termed WMDs – Weapons of Mass Distraction. It is a term that applies to those in public life who lob their verbal or written grenades, then duck back and let those who are truly leaders deal with the mess they’ve made.

You are probably thinking of your own local human WMD right now.

The human Weapons of Mass Distraction take a popular position (for example, telling citizens they are overtaxed) but take no responsibility for the fallout: citizens who expect to receive services, but see no connection with the taxes paid.

Somehow, these human WMDs have turned government into the only place where people think there actually IS a free lunch. We aren’t supposed to pay property taxes, we should only pay sales taxes on things we don’t need, prices are artificially inflated because some government somewhere is lining its pockets.

At the same time, we expect ever-cleaner water; better roads; an excellent education for our kids; safe, police-patrolled communities; fast response from our fire and ambulance departments; convenient air travel; environmentally safe emissions from everything; nice 4

parks; government-assisted economic development efforts; care for the poor; assistance with health care costs; job training; housing assistance; and on and on…

Being a leader is a tough job. We are lucky there are some with the gift of leadership, with the commitment and stamina to try and face down the human WMDs. But the true leaders are, if not outnumbered, certainly outshouted.

When the human WMDs can irresponsibly say anything they think is popular, they get re-elected. When the true leaders have to clean up the mess, and tell us things that are true, but that we don’t necessarily like to hear, it is very hard to get re-elected. Term limits have amplified this in our legislature. The true leaders are not given enough time to develop their skills and knowledge base. Meanwhile, the human WMDs don’t need skills or knowledge to spout the kind of popular nonsense that gets them re-elected.

Now is the time to start looking for true leaders to represent us in our governments. Another group of good legislators is going to fall victim to term limits. We need to look for new candidates with the guts to tell us the truth (hint: these people often have a background in municipal government)!

And once we get a good candidate, we all need to help him or her by calling out the human WMDs who say the popular thing, but can’t back it up with any facts. If reasonable people all shout together, we might just drown out the human WMDs. Think – if truth in advertising principles were applied to a candidate’s speech, would the candidate be in violation?

When it comes to the upcoming campaigns, if it sounds too good to be true, it probably is.

PRESIDENT’S REPORT STEVE ALLENDER

It’s an honor to be named president of the board of directors for the SD Municipal League. The League and its duties fit well with my personal belief that municipalities are the most important government entity in America.

I’ve often said, and you will hear me say again, that cities are the best example of a citizen government. Elected officials and city employees rub elbows with their constituents every day of their lives. They are easily recognizable and therefore easily accountable to the public they serve. Those contacts in grocery stores, baseball games, and across the backyard fence are invaluable when it comes to representation.

The Municipal League plays an important role in maintaining the relationship between city officials and the public they serve. One major role is the advocacy and lobbying efforts provided by the league. There are many moving parts in government and occasionally there is friction between the parts. When that friction is a neighboring city, your county, or the state government, you may find yourself in need of assistance. The value of building and maintaining a robust network of city employees and elected officials cannot be overstated.

I will go on record now saying I believe cities are under-involved when it comes to

interacting with the state legislature; specifically advocating, even fighting for what is best for their communities. The legislature is a big machine and runs at top speed 40 days out of the year, and there are occasionally issues that need to be worked out.

Private and special interests do a much better job than us wining and dining legislators, and it sometimes shows when a bill is introduced. To make things more complicated, now we must navigate around the political divide that is currently ever-present in America. Thank God for the lobbyists within the League, namely Yvonne Taylor.

Over the next year you’ll hear from me on a variety of issues. I don’t always claim to be correct, but I do always offer thoughts and opinions. I would like to spend some of the next year listening to yours as well. Please communicate with the League. Let us know what you are facing, and maybe we can face it together.

2022 STATEMENT OF POLICY SOUTH DAKOTA MUNICIPAL LEAGUE

The Municipal League’s Statement of Policy for the coming year was adopted in its final form at the SDML annual business meeting held during the SDML Conference Oct. 8, 2021, in Spearfish.

This statement guides the League staff and lobbyists during the legislative session and functions as a reference for the League’s position on various issues affecting local government.

This Statement of Policy is also posted on the League’s website, www.sdmunicipalleague.org.

POLICIES

9.

The SDML supports amending state law to clarify residence requirements for municipal elected officials. (GG – 2014)

The SDML supports efforts by the Secretary of State to provide consistency in election statutes. (GG – 2017)

11.

The SDML supports working cooperatively with other state entities to clarify residence for voter registration. (GG – 2015)

12.

The SDML supports legislation limiting the time to circulate a petition to change the form of government to six months. (GG – 2021)

13.

The SDML supports making provisions for supplementing municipal budgets consistent with provisions found in county law. (GG – 2015)

The SDML supports clarifying the procurement law exemption to include IT and technology consulting services.

The SDML supports legislation to make municipal laws consistent as to the use of the term “finance officer” rather than “clerk/treasurer.” (GG – 2010)

The SDML supports legislation that would exempt municipalities from the regulations of the unclaimed property laws. (GG – 2000; 12)

The SDML supports amending SDCL 12-1-5 to include municipal election officials on the State Board of Elections. (GG – 2000; 13)

The SDML supports clarifying signature requirements on all municipal election petitions. (GG – 2016)

(PW – 2019) The SDML supports planning and zoning legislation that will encourage continuity between city and county planning and zoning procedures and reduce ambiguities within the adoption process, enabling municipalities to more effectively adopt and administer their comprehensive plan, zoning regulations, and subdivision regulations. The SDML would strongly oppose any legislation to overrule local zoning or building codes pertaining to mobile homes, manufactured houses or trailer houses. (PW – 2000; 11)

The SDML supports the right and authority of municipalities to have at least an equal voice in platting, zoning, planning, code enforcement, and flood management control in the extraterritorial area. The SDML also supports legislation to enhance municipalities’ ability to gain extraterritorial jurisdiction, and permissive legislation allowing cities and counties to enter into intergovernmental agreements for Urban Growth Areas. The SDML would support legislation to prohibit creation of any entity with municipal powers within five miles of any existing municipal boundaries. (PW – 2015)

The SDML supports revising the business improvement district statutes to allow municipalities and counties to enter into joint projects and to locally determine all rates. (T&R – 2003)

The SDML supports creating incentives within the REDI fund for investment, not just job creation.

The SDML supports allowing maximum local control of tax increment financing (TIF) districts, an economic development tool that has led to millions of dollars in increased property value, benefitting both the state as a whole and the local entities sponsoring the districts, while at the same time maintaining the integrity of the process. The SDML supports legislation allowing a local vote on up to an additional one cent temporary municipal sales tax to be used for improvement projects. (T&R – 2014)

The SDML supports legislation that directs American Rescue Plan Act (ARPA) funds to finance grants and/or principal forgiveness for high priority infrastructure projects through the South Dakota Department of Agriculture & Natural Resources (SDDANR). This state initiative would decrease local costs associated with infrastructure expansion, thereby providing needed incentives for new housing stock and reducing the cost to construct new homes in South Dakota. The SDDANR and its Board of Water and Natural Resources are well-equipped to deploy funds in an efficient, forward-thinking manner. (T&R - 2021)

The SDML strongly opposes any formula-driven redistribution of sales and use tax revenues. The SDML strongly supports maintaining the current system of returning revenues based on sales actually attributed to that point of delivery. (T&R – 2002; 15)

The SDML supports allowing broad, local-option authority to municipalities that would enable the return of any potential tax revenue increases to entities or persons deemed appropriate by the municipality. (T&R – 2002; 20)

The SDML supports a requirement that all prior debt obligations be covered regardless of any potential initiative, referendum, or legislative action. (T&R – 2002; 22)

The SDML is opposed to de minimus exceptions.

(The exceptions do not serve to level the playing field and the collection allowance will reimburse sellers for the costs of collecting the taxes.) (T&R – 2002; 23)

SDML CONFERENCE RETURNS WITH ENGAGED CROWDS After a virtual conference in 2020, the annual SDML conference returned for an impressive in-person session in Spearfish on Oct. 5-8.

With just over 300 people registered, attendance was consistent with previous conferences, but organizers noticed increased engagement and interaction this year.

“Not only were sessions well-attended, but there were great follow-up questions and discussions that continued into the hallway afterwards,” says Yvonne Taylor, SDML Executive Director. “I think we all realized how important physical presence is when networking and collaborating. It’s much easier to do great things together when you can actually be together.”

The conference featured sessions on several timely topics, including cybersecurity, marijuana legalization, and redistricting. Networking time allowed colleagues to connect and for attendees to visit with exhibitors.

The conference was held at the Holiday Inn Convention Center in Spearfish. Next year’s conference will take place in Watertown on Oct. 4-7, 2022. ■

ERICKSON RECEIVES EXCELLENCE IN MUNICIPAL GOVERNMENT AWARD Christine Erickson, City Councilor of Sioux Falls, was named the recipient of the 2021 Excellence in Municipal Government Award.

The award is presented by the South Dakota Municipal League each year to a municipal employee or elected official who has made significant contributions to their municipality and community.

“Christine has a passion for her city and her state,” says Sioux Falls City Councilor Marshall Selberg, who nominated Erickson for the award.

“She sets big goal, tackles daunting projects, and most importantly - she delivers results time and again.”

members to support workforce development, seeking funding for innovation-focused economic development, working on a comprehensive housing strategy, and developing the first ride-sharing ordinance and service in South Dakota.

Erickson has served her local community on the Sioux Falls city council for the past eight years. She also shares her skills and passion as a member of the South Dakota Municipal League Board of Trustees, and as an active member of several community organizations. She previously served in the SD House of Representatives.

Selberg says Erickson works hard in any role she takes on to improve her home, neighborhood, and town.

SDML ELECTS NEW LEADERSHIP A possible record crowd attended the annual business meeting Oct. 8 in Spearfish, where SDML members approved incoming leadership for 2021-2022.

Steve Allender, mayor of Rapid City, accepted the role of president. In his address, he encouraged members to be involved, be heard, and be passionate.

Allender succeeds Debbra Houseman, Lake Andes, as president after an unprecedented twoyear term. Due to the Covid-19 pandemic, all 2020-2021 League positions were carried over from the previous year, the only time that has occurred in the history of the League.

SDML HALL OF FAME 2021 INDUCTEES The SDML Hall of Fame honors elected and appointed officials and employees who have served municipalities in South Dakota for 20 or more years. Inductees were recognized during the annual conference on Oct. 7 at the Excellence in South Dakota Municipal Government Award Luncheon.

SUE FALCONER

ARLINGTON | 26 YEARS Sue has worked with the Arlington community for over 50 years in various areas.

Being a graduate of Arlington High School, she has been in charge of several All-School Reunions.

Shortly after graduation, Sue began working at Citizens State Bank in a variety of departments for 24 years.

Sue then took over as Finance Officer with the City of Arlington where she has served for over 26 years.

Sue is an active member at Badger Lutheran Church where she served as Sunday School superintendent and music director for 30 years. She is currently the financial secretary and a member of the choir.

Sue is the proud mother of four and grandmother of five. She spends her spare time in bleachers cheering them on in various activities.

Sue plans to retire in the spring.

DANIEL WALDNER

BADGER | 35 YEARS Daniel F. Waldner retired from the Town of Badger, SD, in May 2021 after 35 years of service.

In 1972 Dan moved to Badger and became a volunteer fireman. He began a 15-year term as Badger Town Treasurer in 1986. In 2001, Dan was elected to the Badger Town Board as Council Trustee and served in that capacity for 20 years.

In addition to his Town Board duties, Dan could often be found helping maintain the “neat little town” with its sewer, roads, potholes, dump ground, schoolhouse sump pump, and Christmas lights.

In May 2021, the Badger Town Board honored Dan with an open house retirement party, complete with a dinner and live band.

BELLE FOURCHE | 20 YEARS Colleen has been a dedicated team member of the Belle Fourche Rec Center since 2001.

Colleen started as a group fitness instructor and has stepped into many roles over the years. She was involved in Camp Oasis as a program aide and coordinator, and most recently has filled in as building manager.

Colleen’s loyalty, willingness to help, and her reliable and kind personality help to make our center successful. We are very grateful for Colleen and all she does to serve our community.

CUSTER | 21 YEARS Scott was hired as the inter-department opperator for the City of Custer in April of 2001. He was promoted to Public Works Supervisor in October of 2006 and is set to retire in February of 2022. Scott has been busy passing his years of knowledge down to the crew.

CUSTER | 24 YEARS After serving as public works director with the City of Custer for 24 years, Bob retired in January of 2020.

Bob was involved in many organizations such as the Custer YMCA, SDWWA, SDWARN, SBHWS, and more. Bob is greatly appreciated for the support, dedication and knowledge given to the Public Works Department over the years.

FREDERICK | 35 YEARS Scott graduated from Frederick High School and received a bachelor’s degree in business administration from USD. He started working at the First National Bank of Frederick after graduating from college in 1987. Scott’s community involvement includes Town Council Member since 1988 and Board Chairman since 2012, Frederick Development Corporation, past WEB water development director, NECOG-DC Board Member, Past Board Member and Chairman of the Independent Community Bankers of SD, Elm Valley Community Club, Frederick Area Fire Department and is an EMT for Frederick Ambulance.

Scott and his wife, Teresa, have two sons, Casson and Dane. The Town of Frederick is very appreciative of the time and energy Scott has dedicated to our town.

RON HOFTIEZER

MILLER | 34 YEARS Ronald J. Hoftiezer, Sr. was hired at the City of Miller on Oct. 5, 1987, to the position of street operator and took over as superintendent on July 1, 1998.

Ron graduated from Miller High School in 1985. He has served on Miller’s volunteer fire department since July of 1988. He is married to his wife, Julie, and has one son, Ronald Jr., and one daughter, Hiedi. Ron enjoys fishing with his dad and helping his wife at her restaurant, The Ranch Café in Miller.

TERRY MANNING

MILLER | 25 YEARS Terry L. Manning was hired at the City of Miller on March 27, 1996, to the position of water operator and took over as superintendent in July 2016. He has overseen the massive $23.9 million water/sewer/ storm sewer project in Miller since 2016 along with a municipal airport CIP project totaling $2.7 million.

Terry graduated from Miller High School in 1982. He has served as an EMT and a volunteer firefighter since 1990. He is married to his wife, Kim, and has one son, Jason, and one daughter, Katie. Terry enjoys car races, camping at Lake Louise over Memorial Day weekend, and attending the South Dakota State Fair as an EMT every year.

JOE ZELLER

MILLER | 24 YEARS Joe D. Zeller was elected to Alderman Ward II in May of 1991 and has served 24 cumulative years. During this time there were multiple airport projects, a buried electric system, and replacement of water and sewer within the city. He has also volunteered on the board for On Hand Economic Development since 2009.

Joe graduated from Miller High School in 1972. He is married to his wife, Gail, and has two sons, Adam and Aaron, and one daughter, Adrienne. Joe has run his own construction business in Miller since 1977. He also does the maintenance at the Miller Plaza and Kanyon Krossing Apartments. He enjoys spectating at the baseball diamonds during the summer and is involved in most community events. You will find Joe shoveling snow at multiple locations around town as a good Samaritan.

MIKE WOLF

PARKSTON | 22 YEARS Mike Wolf has worked for the City of Parkston since 1999. Mike has put a lot of sweat and work into the City of Parkston to make it what it is today - whether that's sweeping streets at 2 a.m. after a storm or up all night plowing snow to make sure the streets would be clear for people to get where they are going safely.

The City of Parkston is lucky to have such a knowledgeable individual apart of crew. The City of Parkston staff would like to thank him for his many years of service!

MICHELLE DENEUI

SPEARFISH | 20 YEARS Michelle started in Aug. 2001 as a police dispatcher with the Police Department, working in both part and full-time positions. In Feb. 2005, she was promoted to finance accountant and in March of 2011, she was promoted to assistant finance officer.

Michelle was granted a professional certification as a Certified Governmental Financial Managers in October of 2016. In 2018, Michelle completed the Master of Professional Accountancy program through the University of South Dakota with a cumulative GPA of 3.7. June of 2019, Michelle was promoted once again, this time to finance officer for the city.

STEVE HOFMANN

SPEARFISH | 20 YEARS Steve started with the City of Spearfish in March of 2001 as a police officer. In April of 2003, Steve was assigned as the school resource officer. In Dec. 2005, Steve was promoted to police corporal and then to police sergeant in March of 2010. Most recently, Steve was reassigned to police sergeant over investigations.

Steve is an essential part of the team that has been building a positive culture within the department since 2001.

PAT ROTERT

SPEARFISH | 20 YEARS Pat started with the City of Spearfish in June of 2001 as the chief of police. He is the longest serving chief of police in the history of the Spearfish Police Department, serving for just over 18 years. Pat was instrumental in creating a work environment which fostered trust and respect within the police department.

In August of 2019, Pat was promoted to the public safety director. He assisted in creating the first Department of Public Safety for the city, where he currently oversees the police, fire, building services, and the code enforcement divisions.

KATHY DYKSTRA

STURGIS | 22 YEARS Kathy Dykstra, or Miss Kathy as she is fondly known by the children of Sturgis, has been the children’s librarian for the Sturgis Public Library since 1999.

Kathy’s warm energy and enthusiasm for reading greets children as they come into the library. Kathy is a wizard with crafts and projects, creating the most amazing things. Kathy served for many years as the rural schools’ librarian traveling all over western Meade County. Most recently Kathy capably switched to virtual children’s storytime and summer reading programs during Covid. Kathy has just become the circulation librarian, taking on new challenges.

There is no greater challenge and there is no greater honor than to be in public service.

STURGIS | 24 YEARS Dan Cass joined the City of Sturgis as a Mechanic in April 1997 and continues to help keep our fleet in operations.

Dan’s knowledge of equipment and vehicles is deep. There isn’t a vehicle or piece of equipment in the City fleet that Dan hasn’t worked on. Dan often performs miracles during the Rally to return vehicles to operation.

Dan is always one to participate in the holiday celebrations and has enjoyed watching the staff toy drive grow every year. Dan doesn’t just stay in the shop – he gets out and drives truck to help with PWD’s snow removal efforts.

STURGIS | 20 YEARS Chief Scott Lensegrav has been a member of the Sturgis Volunteer Fire Department since May 2001.

Scott started as a volunteer firefighter and served many years as an assistant chief before being named chief in 2019. In 2016, Scott was honored with the Sturgis Municipal Medal of Honor for his lifesaving heroism at a residential fire.

Scott also serves as a mechanic for the City of Sturgis, keeping our ambulance and fire vehicles and equipment operational. (Scott is also a firefighter / EMT for the Rapid City Fire Department.)

Scott’s dedication and commitment to the Sturgis community is extremely valued.

STURGIS | 24 YEARS Doyle Schaefer started with the Streets Department for the City of Sturgis in November 1997. In February 1999, he transferred to Parks and continues to serve as a Parks Maintenance Tech.

Doyle was involved in building all the current shelters and structures in the parks system. He especially enjoyed watching the 6th Street Park come together in the green space near our Community Center. Being a senior employee, he took on a leadership role in the Parks Division while a new superintendent was being sought.

Doyle’s work ethic and attention to detail are evident in the upkeep of the city's many parks.

STURGIS | 23 YEARS Doug Wagner started with the Sanitation Department for the City of Sturgis in May 1998. He transferred to Streets in 2009 and is currently a heavy equipment operator.

Doug has been an integral part of the crews that made repairs following several Bear Butte Creek flooding events. Doug also played a role in seeing the improvements to the many railroad crossings.

Doug will sleep on a cot in the PWD shop to make sure he is at work to remove snow after a winter blizzard.

Doug is a dedicated employee who has developed good working relationships with his coworkers.

WALL | 30 YEARS Jim Kitterman was born and raised in Wall, South Dakota.

He is an active community member and is currently serving his 37th year with the Wall Volunteer Fire Department. He also serves on the board for the Eastern Pennington County Ambulance District.

He began his career with the City of Wall as a council member from 1990 to 2001 and then became a public works employee from 2002 until retiring in 2021.

2022 Annual Report Workshops The South Dakota Municipal League and the South Dakota Department of Legislative Audit are cosponsoring on-line Zoom workshops on preparing this year’s annual report. Remember, annual reports are required to be filed by ALL municipalities.

The workshops are brought to you free of charge and will be conducted by the staff of the Department of Legislative Audit. Finance officers, clerks, auditors and treasurers should plan to attend.

DEADWOOD

DEADWOOD HISTORY, INC.

The partnership between the City of Deadwood and the nonprofit organization Deadwood History, Inc. (DHI) began more than 90 years ago and is still going strong today. The person responsible for creating this partnership was William Emery Adams: Deadwood pioneer, six-term mayor, successful businessman, and generous civic benefactor.

In 1930, while much of the country was feeling the devastating effects of the Great Depression and concerned about the future, Adams was focusing his attention on the past, specifically Deadwood’s remarkable history.

He knew if all of the historical artifacts, documents, and firsthand stories in the community were not collected, preserved, and shared, they could be lost forever.

With great foresight and encouragement from family and friends, Adams fully funded the building of a state-of-the-art museum to honor Deadwood’s past. When construction was complete, Adams deeded the new facility to the City of Deadwood, stipulating that an independent organization be created to manage the historic collections and day-today operations.

In 2000, the Historic Adams House, a Queen Anne-style Victorian home built in 1892, was brought into the partnership. The City purchased the house in 1996 and then underwent a meticulous two-year restoration with the intention of providing tours. Realizing the existing partnership with Deadwood History, Inc. worked so well at the Adams Museum, this same arrangement was entered into at the Historic Adams House. For more than 20 years, the architecturally impressive historic home - complete with original furnishings has been welcoming visitors from all over the world.

Fast forward to the year 2011 when another property was added to the partnership. The Homestake Adams Research and Cultural Center houses more than 20,000 cubic feet of the finest archival materials documenting the history of Deadwood and the Black Hills.

It also hosts an impressive array of educational, entertaining, and engaging public programs for community residents and visitors.

Just one year later, in 2012, the partnership grew again when the Days of ’76 Museum officially began greeting visitors from all over the country to the impressive new facility. This property was built to house an extensive and

valuable collection of animal-powered vehicles that are the main attraction in the annual Days of ’76 Celebration. It also houses an impressive array of pioneer, Native American, and celebration memorabilia.

The most recent enterprise between the two entities is The Brothel Deadwood, located on the second floor of a former brothel that operated on Deadwood’s Main Street. The Brothel Deadwood tells the 104-year history of prostitution and the brothels in Deadwood, which until now was an often underrepresented and misrepresented part of Deadwood’s history. It is a unique, adaptive reuse of a Main Street historic building whose second floor sat vacant and ignored for more than 40 years.

2022 FMCSA Changes May Impact CDL Costs JOSHUA J. BAUMGART & LISA MARSO For example, school in the South Dakota area charge as follows:

The Federal Motor Carrier Safety Administration (FMCSA) has passed a new training regulation which poses new requirements to obtain a Commercial Driver’s License (CDL). The Entry-Level Driver Training (ELDT) rule will come into effect as of February 7, 2022. The ELDT establishes minimum training requirements for entry-level operators of Commercial Motor Vehicle’s (CMV) for interstate and intrastate commerce. This rule will apply to drivers that are attempting to: • Obtain a Class A or Class B CDL for the first time; • Upgrade an already existing Class B CDL to a Class A CDL; or • Obtain a school bus (S), passenger (P), or hazardous materials (H) endorsement for the first time.

Note that drivers that have already obtained a valid CDL or a P, S, or H endorsement before February 7, 2022 will not be subject to the new ELDT requirements, unless they plan to upgrade their existing Class B CDL to a Class A CDL. The ELDT rules do not create any new exceptions (e.g. exempting out small employers). But any individual who currently meets the exceptions for skills tests as listed under 49 CFR Part 383 still remains exempt from the new ELDT requirements.

Employers should note that the ELDT training courses are required to be administered by a Training Provider that is listed on the FMCSA’s Training Provider Registry (TPR) and the training must be appropriate to the license/endorsement for which that person is seeking.

Employers should also be aware that after February 7, 2022, if their existing employees need a CDL upgrade, or are obtaining their CDL for the first time, the employer will likely have to cover/reimburse the fees charged for ELDT training. Now is a great time to review job descriptions and determine which positions listing a CDL requirement are necessary according to the job duties.

Additionally, knowing which positions may require a CDL upgrade ahead of time could save on costs.

It is also important to note that employers may but are not required to cover expenses for new employees to obtain their CDL. For example, if a new job applicant applies for a position that requires a Class B CDL but they do not yet have one, the employer may help pay for fees incurred for the CDL certification but it is not required.

Employers are encouraged to evaluate these issues prior to February of 2022, particularly as costs required for CDL courses can get expensive.

Annual Meeting Review Spearfish has always been a special place for me since my grandpa graduated from Black Hills State University in 1965. I have only been to Spearfish a handful of times, but I am always fascinated with the beautiful landscape and unique layout of the hillside community.

This year I was unable to attend the SDML golf tournament, but I always look forward to that event as it is always a great time to network and meet new city employees. I do recommend that anyone attending the SDML annual conference to participate in the golf tournament whenever they can.

After the SDML golf tournament this year, Heartland Consumers Power District and Missouri River Energy Services hosted a South Dakota Public Power event and invited all of their member communities to enjoy hors

d’oeuvres and comradeship with other municipal electric utility communities. Special thanks to Heartland and MRES for getting our municipal electric communities together.

The South Dakota Municipal Electric Association meeting and annual business meeting took place on Wednesday morning.

There were 24 people in attendance and the meeting was kicked off by yours truly giving a year-in review of the SDMEA, highlighted by the reveal of the new SDMEA website that will be a great opportunity for our municipalities to get involved and take the opportunity to market for our public power municipalities.

The SDMEA will also be offering associate membership opportunities that will benefit by having more interaction and advertising opportunities with our member municipalities for the associate members. Please reach out to me if you are interested and watch for emails from the SDMEA for opportunities to become an associate member!

Next, we heard from Senator Casey Crabtree and Kelly Dybdahl from Heartland about economic development opportunities and our role as municipal employees. From workforce housing to daycares, we have a lot of challenges that face us but the key takeaway that I had from Senator Crabtree is finding out who to contact for help for your specific community.

Reaching out to the SDMEA, Heartland, and MRES can be a starting point for our member communities, and we will help in any way that we can.

After our presentation on economic development, we heard about another interesting topic - electric vehicles (EVs). Kurt Hauser from

Missouri River Energy Services was our presenter and did a great job of explaining the current issues that we as electric providers may face. Kurt also pointed out that there are more and more EVs being produced by major car companies. Naturally, after the presentation it seems like I see more and more commercials for electric vehicles. If anyone has any questions, please let me know and I will get you in touch with Kurt for more information!

who is great for our municipalities and is also great to the league staff. League staff: Lori Butler, Lisa Nold, Lori Martinec, Carla McGregor, and Sandi Larson once again did a wonderful job running a great conference.

Newcomer Emilie Miller had big shoes to fill and did so wonderfully as the conference was as smooth as each of the previous conferences that I have attended. Hats off to her for stepping in and helping it to be smooth.

When Kurt finished his presentation, we began the SDMEA annual business meeting. We had our trustee election and trustees Mike Antonson and Monty Munkvold had terms ending in 2021. Bert Magstadt was appointed to the election committee and cast a unanimous ballot to re-elect Mike and Monty to a threeyear term. We are also looking forward to our SDMEA Conference and Technology Expo in 2022 and are excited to have any employees from our member communities attend our meeting to learn more about municipal electrics. Be on the lookout for emails and information for the SDMEA conference.

My last thank you would be the Spearfish Holiday Inn Convention Center Staff. They did a great job of being proactive and efficient for the conference. They seemed to take pride in hosting the conference and their hard work showed me why their HOMETOWN is great! ■

Finally, I want to praise the SDML staff for another great conference. With a recent back injury, I wasn’t able to fulfill my role of picking things up and setting them down, so I have to thank them for all they do.

Executive Director Yvonne Taylor completed the one task that I know that I am responsible for and had the hospitality room all picked up on Friday morning before I even had a chance to help. Mayor Mike Grosek from Webster, Al Cerny from Gregory and I typically handle the cleanup duties and had set a time to meet and get it all cleaned up. When I walked in, Yvonne had everything picked up and loaded. She is an amazing person

SDML Workers' Compensation Fund Continues Grant Programs for 2022 For over a decade the SDML Workers’ Compensation Fund has offered three grant programs to its members. The Stryker EMS grant, the Stan Houston ICS® Saw grant and the Trenching and Confined Space Entry Safety Equipment grant, which was created to assist members with the purchase of approved safety equipment such as trench boxes, hydraulic shoring, gas detectors (with and without calibration kits), full body harness, tripods and blowers.

Because these grant programs promote safety for our members, the SDML Workers’ Compensation Fund Board of Trustees approved all three grant programs for the 2022 year on a first-come, first-served basis until the grant funds are exhausted. The 2022 grant period will open and applications will be accepted beginning January 1, 2022. Keep reading for more details about each grant program opportunity.

The Stryker EMS grant program is a grant to assist our members in purchasing a Stryker Power-PRO™ ambulance cot, Stryker Stair-PRO® stair chair, a Stryker PowerLOAD™ system or a Lucas®3, v3.1 Chest Compression System. The grant pricing hasn’t been finalized, but will be available by January 1st.

• The average age of an EMS worker is 40 years old • Lower back strain is the cause of 78% of compensation days in the US • 1 of 4 EMS workers suffer from a career-ending back injury within the first four years of employment • Lifting causes more than 70% of back injuries of EMTs

The intent of this grant program is to provide a safer workplace for the ambulance personnel, firefighters, law enforcement, and all local government employees that assist their ambulance services to provide emergency transfer of patients. These products have been proven to reduce and eliminate back injuries due to lifting patients.

We have 1 member that prior to purchasing a Stryker Power-PRO™ ambulance cot, had 10 lifting injuries over a 7-year period resulting in over $150,000 in medical and lost-time expense. Since being awarded a grant in 2011, this member has not had a single lifting injury with over 18,000 patient transfers.

Stryker EMS has used the SDML Workers’ Compensation Fund grant program as a model of success and has rolled out similar programs in several other states.

Stryker also reported a 100% reduction in back injuries in another service and a 62% decrease in the risk of developing a low back disorder when using these safety products during the loading process. Other relevant stats are: • 69% of the US adult population is obese • A typical strain injury cost $70,408 in direct and indirect costs

This is a 50-50 matching grant. Beginning in 2022 the match is being increased from a maximum of $1,000 to $1,500 per grant. A member may apply once per calendar year and the grant only applies to one piece of equipment or equipment package.

The member may purchase the equipment from a vendor of their choice, but prior to a grant being awarded, Safety Benefits, Inc. will review the requested equipment to verify that it meets all current standards for its intended purpose. Fast forward to now, where products are more readily available and while we still have some restrictions and concerns, we are getting closer! The reason we are able to be closer to the normal is because people want to be safe, they want to be prepared for what’s coming next! The South Dakota Public Assurance Alliance partners with the SDML Workers Compensation Fund to sponsor safety awards which are presented to our members each year.

In addition to individual recognition, all Pool members have the opportunity to achieve recognition via Safety and Loss Control Recognition Awards. There are four levels: bronze, silver, gold, and platinum.

Bronze level recognition requires members to put into place ten safety or loss control practices such as having safety and personnel manuals and providing and attending training exercises.

Silver level recognition is achieved by completing the ten bronze level requirements, and then nine additional requirements. The additional requirements include items such as appropriate contracts in place with vendors, and adopting the twelve critical law enforcement policies recommended by the South Dakota Public Assurance Alliance.

Gold level is reached by attaining the bronze and silver level requirements, and then six additional loss control and safety measures. The additional requirements include appointing a formal safety committee or appointing a safety coordinator, and documenting complaints from citizens and the member’s response to the same.

Platinum level recognition is given to those members who have achieved gold level recognition and a combined three-year loss ratio of less than 60% for the pools to which they belong.

VA C C I N AT E V E R M I L L I O N S W E E P S TA K E S GIVES RESIDENTS A SHOT AT BIG PRIZES The City of Vermillion’s unique approach to fighting COVID-19 not only intended to keep the community safe, but support the local economy at the same time.

The Vaccinate Vermillion Sweepstakes launched in August, thanks to a partnership between the City of Vermillion and United Way of Vermillion. Through the sweepstakes, county residents who got their COVID-19 vaccine could enter for several chances to win $2,500 or more in Vermillion Bucks.

“We know that high vaccination rates can help us keep case numbers and hospitalizations low, which is good for the individual being vaccinated, protects kiddos and others who can’t be vaccinated, and helps our businesses by improving consumer confidence,” said Vermillion Mayor and United Way Executive Director Kelsey Collier-Wise. “Councilmembers Steve Ward and Julia Helleweg thought an incentive program might be effective, and both the Council and the United Way board jumped at the chance to do something proactive.”

Being proactive definitely paid off for the program.

Vaccination clinics during the sweepstakes were wellattended, local press covered the announcement of

each drawing’s winner, and the sweepstakes enjoyed a healthy social media presence. Local businesses participated by promoting nearby vaccination clinics and offering product discounts to participants.

The response to the sweepstakes was high.

The program saw more than 1,600 total entries, with over 500 people entering in the first week alone.

Erin Burrow (assited by a young friend) recieves $2,500 in Vermillion Bucks from Mayor Kelsey CollierWise. Burrow was one of 22 winners in the VACCINATE VERMILLION SWEEPSTAKES, a promotion which uniquely combined the goals of encouraging residents to get vaccinated and to shop local.

The sweepstakes was open to anyone living in Clay County who had received at least one dose of vaccine, even if they received it before the start of the sweepstakes. Individuals could enter online, via phone, text, email, or by using a QR code located on flyers throughout the city. Once entered, participants’ names stayed in the drawing pool throughout the sweepstakes.

The city awarded a total of $60,000 in Vermillion Bucks to 22 winners. Two drawings for $2,500 each were held weekly for 10 weeks. In addition, two random drawings for $5,000 were held throughout the course of the sweepstakes, which ran Aug. 27-Oct. 29.

Drawing winners received their prizes in the form of Vermillion Bucks, which are issued by the Vermillion Chamber and Development Company. Vermillion Bucks act just like cash at participating local businesses. Since they can only be spent locally, the sweepstakes winnings will also benefit the community by staying in the local economy.

Which seems to be a good deal, according to participants.

As Erin Burrow, winner of $2,500 Vermillion Bucks in the Sept. 3 drawing put it: “That’s 166 loaves of yogurt cake from Red Wagon Bread!” ■

Bridging the Digital Divide “Bridging the digital divide” is something that’s often discussed in the halls of Congress. While there are plenty of divisions in Washington, a digital divide isn’t one of them. You have to leave the Beltway and travel to places across America where you actually have to think twice about whether or not you’re going to have an internet connection – places like rural South Dakota where certain connectivity challenges can remain frustratingly unresolved. It’s 2021, and private companies have developed technology to send customers into outer space, yet we’re still talking about the importance of connecting rural America with reliable, high-speed internet. That needs to change.

As a member and former chairman of the Senate Commerce Committee, which has jurisdiction over the internet and everything from planes, trains, and automobiles to the depths of the ocean to the heights of outer space, expanding mobile and fixed broadband access in rural America and to tribal communities has long been a priority of mine. And as a senator from a rural state, I’ve always looked for opportunities for South Dakota to help lead the nation in its deployment.

The good news is that things have come a long way over the last few years because of the sustained investments made by telecommunication providers across South Dakota and the rest of the country.

In 2019, Sioux Falls became one of the first communities in America to become 5G-enabled. As we 48

continue to lay the groundwork and pave the way for future development and deployment, South Dakota has frequently attracted the attention of, and visits from, leaders at the Federal Communications Commission, the federal agency where the majority of the government’s broadband expertise resides. We’re doing the right things, and we’re heading in the right direction.

The bad news is that there are still corners of our state that don’t have the benefits of reliable broadband services. A strong internet connection is critical for small businesses to connect with customers, for farmers who rely on precision agriculture technology to maximize crop yields, and for patients who depend on telemedicine to get the care they need when a hospital or medical professional is physically out of reach.

For many, it can mean the difference between success and failure or potentially life and death.

I’m glad broadband is now being recognized as vital infrastructure.

We need to continue investing in its success, but we have to do it wisely.

We must prioritize our needs and identify the appropriate partners, both in and out of government, to help reach our goal of fully connecting every South Dakotan who wants it. But simply dumping more federal funds into a pot and spinning the acronym wheel to see which federal government agency it lands on is not the way to do it.

I fully support using targeted government funds to help meet these

needs, but the federal government cannot solve this problem on its own. It certainly can’t just spend its way out of it. We must be effective with our planning and efficient with our investment as we look for a holistic approach that continues to move broadband from luxury to necessity – that leverages available government resources and incentivizes private sector innovation to push the boundaries of this effort toward success.

For too long we’ve talked about bridging the digital divide. It’s time to actually do it. Access to reliable broadband has the potential to connect South Dakotans to a larger marketplace, to increase the quality of education for students, and to continue enhancing parts of our everyday lives. I’ll continue to support smart investments that use taxpayer dollars responsibly – because government waste won’t help anyone. ■
