Americans Caring for Each Other One election down, one to go this year!

Congratulations to all for the defeat of Constitutional Amendment C, and congratulations to our friends, old and new, on their success in this step of the legislative races. While we regret the loss of a few supporters, overall the incremental improvement of the legislature looks like it will continue.

In the November general election, you will see the SDML supporting Constitutional Amendment D – this may be the first time in my memory that we have supported a ballot measure! But it is probably also the first time we’ve seen a way to offer better service, to more people, and actually save South Dakota taxpayer dollars.

Amendment D would see South Dakota joining 39 other states and expanding access to Medicaid. Because of the Federal funding formulas, in the first two years alone, South Dakota taxpayers will save $63 million.

Medicaid expansion will also put more money in people’s pockets. Neighboring states estimate it has created more than 2,000 new jobs, many in health care. In Montana, Medicaid Expansion was found to have supported 6,000 jobs and contributed $350 million in personal income growth. Studies have also found it causes a significant reduction in poverty, as low-income families are no longer burdened with high-cost medical bills.

And lastly, we have 11 rural hospitals that are vulnerable to closure – which would be a disaster for those areas of the state. Medicaid Expansion lowers uncompensated care costs, and states that have expanded Medicaid have seen rural hospital closure rates decrease by 34%.

As the Medicaid Expansion issue shows, Americans caring for each other is one of the finest reasons we love our country – and I hope you all enjoy celebrating that this 4th of July!

PRESIDENT’S REPORT

Divided Communities The first disagreement among human beings took place in the Garden of Eden.

Disagreements are common among people and have become a necessary part of our lifestyle.

From an early age, our disagreements are managed by parents, siblings, or teachers, until such time as we can manage them ourselves. At about the same time, we start learning about the U.S. Constitution.

The First Amendment, protecting freedom of speech, is an important component of the Constitution. It sets the stage for allowing different opinions and for giving them as well.

Throughout our life we are forced to put the conflict in our lives into a context that will allow us to come to a point of agreeing to disagree.

Then, along comes politics. This topic provides a unique challenge for people due, in part, to the inherent responsibility of one becoming an informed voter. Once a person invests in learning about candidates and important issues, they become attached to them. Whether or not people choose to defend their candidates or beliefs on issues usually depends on the audience. We probably all know that person with whom we don’t dare discuss politics, due to their “enthusiasm” around the subject.

There are some friends and family that are fairly safe to talk to about issues such as politics, and there are some who are not.

Starting in about 2020, the political landscape

changed and so has people’s willingness to battle over political issues.

We are now living in a time when political issues will divide family and friends. Total strangers will profess hatred for one another based on a bumper sticker promoting a candidate or issue. It seems to be a terrible symptom of a divided community. I think it seems that way because this type of behavior attracts the attention of public servants. Even though we interpret this as a sign of dysfunction, I think the evidence fails to confirm this belief.

Even though there appears to be a significant decline in discourse regarding political issues, we should try to look past this noise. I believe you will find that our communities are doing well. Even the obnoxious or circus-like public meetings do not appear to take away from the progress in communities.

For me, and I assume for some of you, we have become too focused on the negative interactions. We should try to refresh our minds and recalibrate toward the positive people, events, and progress in our communities.

South Dakota is a great place to live – and it’s made even greater by the cities, towns and people who share it. ■

With each hurricane, wildfire, or flooding event that we see in the headlines, more residents in communities across the country are being forced out of their homes. According to the Internal Displacement Monitoring Center, 1.7 million Americans were displaced by weather-related disasters in 2020 alone. Although coverage of these extreme weather events is growing in the news and in academic journals, there is no single resource for city leaders to better understand how the problem of climate-related displacement and migration trends may impact their community now and in the years to come.

The National League of Cities and Buy-In Community Planning, Inc. has launched a new report, The Next American Migration: What Cities Should Know About Climate Change and Populations on the Move, to provide our local leaders with the information they need to better understand this complicated topic and to proactively plan for the future. The report is the outcome of conversations with a handful of city and local staff across the country who are thinking about the intersection of climate migration with their local planning goals.

One of the many things the last few years has taught us is that climate change is no longer just a problem for future generations. It is here now and is affecting the lives of millions of Americans in cities, towns, and villages across the country each year.

A row of houses for sale reflects a new study that indicates people across America are relocating to escape the threat of growing climate hazards. For cities, these new residents provide both welcome development opportunities and challenges in providing services.

WHAT DID THE RESEARCH UNCOVER?

While many residents are being forced out of their homes due to disasters, people across America are relocating in advance of catastrophes if they can afford to do so. Some cities, like Chico, CA, that are already struggling to handle stressors like a lack of affordable housing, have been hit hard receiving evacuees when disasters strike in nearby communities. Other places, like Cincinnati, OH; Flagstaff, AZ, and the state of Vermont, cite anecdotal evidence that people are moving there to escape the threat of growing climate hazards. These new residents provide both welcome development opportunities as well as challenges in terms of providing services.

Every community in the U.S. is and will continue to be affected by climate change. However, every community has a different history, cultural context, set of resources

and capacity to prepare for climate impacts and other stressors. This report provides a simple framework for local leaders to consider what type of city they are living, working, and playing in, and how they can start planning for climate-related risks and demographic changes in their own communities. As part of the research’s proposed framework, cities may identify with one or more of the following categories: Vulnerable cities: These are typically small and mid-sized cities facing high climate risks (e.g., wildfires, drought, flooding, sea level rise, etc.), but that may still be rapidly growing in light of other factors such as lower taxes, better job markets, or a more desirable climate (such as warmer weather). Portions of these communities will likely need to retreat from high-risk areas such as coasts, forests or floodplains in the coming years or invest in extremely expensive protective infrastructure, which can pose a significant cost burden on local budgets.

Recipient cities: These are communities that are already experiencing social stressors (e.g., housing affordability crisis, severe gridlock, and lack of public transportation, racial or economic inequity, etc.) or even their own share of climate impacts. However, they may also be receiving new residents from neighboring communities severely affected by climate change impacts or extreme weather. These cities may not be large enough to handle an influx of new residents and subsequently struggle to provide services for all residents.

PEOPLE ON THE MOVE (CONT) With limited capacity and mounting challenges in the wake of the COVID-19 pandemic, city officials must demonstrate bold leadership and creativity, particularly when it comes to mitigating the impacts of climate change and supporting their communities. With once-ina-generation federal funding streams passing through states and often directly to localities, now is the time for local leaders to change the way their cities operate in order to effectively prepare for what’s next.

HERE’S WHAT CITY LEADERS CAN LEARN FROM THIS REPORT

Do not ignore your city’s climate risks or social stressors. Consider working within your regional area to address issues that lay beyond city lines. Even if your city is not facing immediate climate risks, it may be affected by evacuations from a nearby city. Local leaders should consider how regional evacuation patterns could tighten housing supply and stress local services.

Long-range planning matters. It may be another decade or two before some cities experience climate impacts, but keep in mind that the lifespan of large

infrastructure projects are often 100 years or more.

Using the best available data and engaging in local or regional scenario planning can help you identify whether or not your city should plan for growth, shrinkage, or even both, in response to climate change.

Invest in climate preparedness and affordable housing, regardless of what category of climate risk and migration trajectory your city falls into. Preparing for the effects of climate change must be a “whole of government” approach. Cities can’t do this work on their own and will need non-partisan, sensible leadership that acknowledges current and future climate risks, in order to envision opportunities to create safer, more equitable communities. Use the recommendations in this report to inform how your city can approach and engage with your state officials and federal agencies.

Across the country, we need to be realistic about what the consequences of the climate crisis look like in our communities. By doing so, we can ensure that our cities are future-ready, equitable and resilient places to live – now, and for many decades to come. ■

SDML Statement of Policy Review Begins, Committees Seek Member Input Over the next few months, the South Dakota Municipal League will be conducting its annual review of the association’s official Statement of Policy.

The policy guides the League staff and lobbyists during the legislative session and functions as a reference for the League’s position on various issues affecting local government.

In June, SDML President Steve Allender appointed policy committee members - representing all sizes of cities and all regions of the state - to serve on four policy committees. (See pages 12 and 13 for a list of committee members.) The committees review and recommend changes to the Statement of Policy which are submitted to the Resolutions Committee. The SDML

membership votes to accept these recommendations at the annual business meeting in October.

Input from SDML members is a crucial part of the process. Members can review the current policy, view committee members, and submit their suggestions online at sdmunicipalleague.org/statementofpolicy.

Suggestions may also be brought up from the floor on Oct. 7, during the Annual Business Meeting held at the SDML Annual Conference, October 4-7, 2022, in Watertown, SD. ■

CHRIS HILL | SDML DIRECTOR OF MUNICIPAL ELECTRIC SERVICES The annual SDMEA Golf Tournament was held June 7 at the Madison Country Club in Madison, SD. It was raining on my way to Madison from Plankinton, but when I arrived at 7 a.m., the weather took a turn for the best and it ended up being a wonderful day for us to visit with businesses throughout the electrical industry.

Yankton receives Infrastructure Grant SIOUX FALLS, SD – The Governor’s Office of Economic Development’s (GOED) Board of Economic Development approved several funding applications last month, including a grant for the City of Yankton.

“It is great to see communities and businesses continue to expand and grow,” said GOED Commissioner Steve Westra. “I am proud that our office can help with funding to assist with these projects.”

The City of Yankton was approved for a grant through the Local Infrastructure Improvement Program (LIIP). The $213,379 will be used for 31st Street and Broadway Avenue improvements.

Other approvals included: • The North Bend Wind Project, LLC. was approved for a sixmonth extension in Hughes and Hyde counties through the Reinvestment Payment Program (RPP.) • Millborn Seeds of Brookings was approved for a REDI fund loan. The $2.2 million will be used for a major expansion of storage space, loading docks, and equipment to handle, clean, package, and distribute more seeds.

City of Gary Amends M u n i c i pa l Ta x R at e Beginning July 1, 2022, the town of Gary has amended their municipal tax rate from 1% to 2%. In addition, they implemented a new municipal gross receipt tax rate from 0 percent to 1 percent.

The municipal gross receipts tax is applied to lodging accommodations, eating establishments, alcohol sales, and admissions. The municipal gross receipts tax is in addition to the general municipal tax.

South Dakota municipalities are able to implement new tax rates or change existing tax rates on January 1 or July 1 each year, according to South Dakota Codified Law 10-52-9.

The South Dakota Department of Revenue has municipal tax information bulletins available, which list all municipal sales and use tax rates statewide, along with information on tribal sales, use and excise taxes.

Rapid City's Sumption Named 2022 Finance Officer of the Year Pauline Sumption, Finance Director for the City of Rapid City, was named Finance Officer of the Year last month by the South Dakota Governmental Finance Officers’ Association.

The award is given each year to a member of the association who has made significant contributions to their municipality as a finance officer and their community as citizen.

Sumption was recognized for her experience, strong leadership, and expertise of a wide variety of subject matter. As the city’s finance director for the past seven years, her insights are highly respected and sought out by the mayor and city council.

Recently, Sumption proactively and strategically refinanced several bonds for the city, saving Rapid City taxpayers millions of dollars.

Sumption was also commended for her community involvement, serving on a number of boards, including the YMCA and United Way, and for being involved in several sports leagues and her church. She has championed investments in the city’s economic growth through the Opportunity Capture Fund, which provide strategic funds to help bring jobs to Rapid City.

The award was presented during the association’s annual Finance Officers’ School, held June 8-10 in Huron, SD. ■

IRS increases mileage rate for rest of 2022 WASHINGTON, D.C. — In June, the Internal Revenue Service announced an increase in the optional standard mileage rate for the final 6 months of 2022. Taxpayers may use the optional standard mileage rates to calculate the deductible costs of operating an automobile for business and certain other purposes.

In recognition of recent gasoline price increases, the IRS made this special adjustment for the final months of 2022. The IRS normally updates the mileage rates once a year in the fall for the next calendar year. For travel from Jan. 1 through June 30, 2022, taxpayers should use the rates set forth in Notice 2022-03.

For the final 6 months of 2022, the standard mileage rate for business travel will be 62.5 cents per mile, up 4 cents from the rate effective at the start of the year.

The new rate for deductible medical or moving expenses (available for active-duty members of the military) will be 22 cents for the remainder of 2022, up 4 cents from the rate effective at the start of 2022. These new rates became effective July 1, 2022. The IRS provided legal guidance on the new rates in Announcement 2022-13, available on their website, www.irs.gov.

"The IRS is adjusting the standard mileage rates to better reflect the recent increase in fuel prices," said IRS Commissioner Chuck Rettig. "We are aware a number of unusual factors have come into play involving fuel costs, and we are taking this special step to help taxpayers, businesses and others who use this rate.”

The optional business standard mileage rate is used to compute the deductible costs of operating an automobile for business use in lieu of tracking actual costs. This rate is also used as a benchmark by the federal government and many businesses to reimburse their employees for mileage.

Short-Term Occupancy Rentals: Licensing and Sales Tax ERIC GLASGOW | REVENUE AGENT, SD DEPT OF REVENUE, RAPID CITY With individuals feeling the relief from COVID restrictions, more and more are traveling this great state in search of a little rest and relaxation. These travels used to mean a stay in a hotel. However, many private individuals are now opening their homes to travelers to make a little extra money.

A multitude of online platforms, such as Airbnb, VRBO, HomeAway, FlipKey, and Tripping.com, serve as an online marketplace for lodging and vacation rentals. By using online booking websites, travelers can plan and

execute an entire vacation plan. Due to the increase in lodging rental options, questions arise regarding the tax responsibility of private individuals renting out their homes.

South Dakota sales tax applies to all lodging rentals that are less than 28 consecutive days. Some online platforms are licensed by the Department of Revenue to collect and remit South Dakota sales tax on behalf of hosts. The host must still have a sales tax license issued by the Department of Revenue. If the online platform is not licensed to collect South Dakota sales tax, the host must report and remit the tax. Hosts may also use methods other than online platforms to rent their homes, in these instances the host is also responsible for the sales tax on these transactions.

The Department of Revenue collects the South Dakota state sales tax, municipal sales tax, municipal gross receipts tax, and state tourism tax that applies to lodging rentals. The municipal sales tax and municipal gross receipts tax due is based on where the lodging facility is located. Business Improvement District (BID) taxes are not collected by the Department of Revenue.

DANR Announces More Than $98 Million for South Dakota Environmental Projects PIERRE, S.D. – The South Dakota Department of Agriculture and Natural Resources (DANR) recently announced the Board of Water and Natural Resources has approved $98,703,620 in grants and loans for drinking water, wastewater, and solid waste projects in South Dakota.

The $98,703,620 total includes $73,634,334 in grants and $25,069,286 in low-interest loans to be administered by the Department of Agriculture and Natural Resources.

“I am pleased to announce this financial assistance is available,” said DANR Secretary Hunter Roberts. “This funding will result in upgraded drinking water and wastewater infrastructure and support solid waste cleanup projects which will benefit the system users and the environment.”

The grants and loans were awarded from DANR’s Drinking Water State Revolving Fund Program, Clean Water State Revolving Fund Program, Solid Waste Management Program, and American Rescue Plan Act (ARPA) to the following: Box Elder received a $1,540,000 Clean Water State Revolving Fund loan and a $2,460,000 ARPA grant to upgrade its wastewater collection system to accommodate recent growth. The project includes replacing undersized sewer mains and adding lines. These improvements will address needs 20

on the west side of town for areas of new development. The loan terms are 2.125 percent for 30 years.

Canistota received a $584,267 ARPA grant to make sanitary and storm sewer infrastructure improvements. Funding for this project was previously awarded by the board in June 2021.

Canistota also received a $256,966 ARPA grant to replace water main lines. Funding for this project was previously awarded by the board in June 2021.

Castlewood received a $354,627 ARPA grant to make improvements to its distribution system and rehabilitate the water tower.

Funding for this project was previously awarded by the board in March 2021.

Chancellor received a $210,000 Clean Water State Revolving Fund loan and a $1,190,000 ARPA grant to install a new PVC sanitary sewer main, replace sewer services within the right-of-way, and install 13 sanitary sewer manholes.

Storm water improvements include installation of storm sewer and culverts, including extending the storm sewer trunk line. The loan terms are 2.125 percent interest for 30 years.

Chancellor also received a $195,000 Drinking Water State Revolving Fund loan and a $1,105,000 ARPA grant to install new PVC water main, curb stops, fire hydrants, valves, and fittings;

replace water services within the right-of-way; and loop the system to improve hydraulics. The loan terms are 1.875 percent interest for 30 years.

Crooks received a $161,763 ARPA grant to for a new lift station and sanitary sewer expansion. Funding for this project was previously awarded by the board in June 2021.

Custer received a $125,100 ARPA grant to upgrade its wastewater treatment facility. Funding for this project was previously awarded by the board in March 2021.

Dell Rapids received a funding package at the April board meeting to make sanitary and storm water improvements on 3rd Street and for non-point source improvements.

This funding was adjusted at the May meeting based on available local ARPA funds. The new funding package is a $2,645,080 Clean Water State Revolving Fund loan and a $2,887,379 ARPA grant. The loan terms are 1.375 percent for 30 years.

Department of Agriculture and Natural Resources received a $400,000 Solid Waste Management Program grant amendment for waste tire and solid waste cleanup projects. The grant will allow ongoing collection and disposal of waste tires and other solid waste cleanups which the department has provided for over 20 years.

Groton received a $664,547 ARPA grant for water main improvements.

Funding for this project was previously awarded by the board in March 2021.

Hudson received a $656,180 Clean Water State Revolving Fund loan and a $721,820 ARPA grant to replace wastewater collection line and sewer services in the right of way. These improvements will replace aging vitrified clay pipe, eliminate sags, reduce infiltration, and improve system reliability.

This package and other funds will support the project costs. The loan terms are 2.125 percent for 30 years.

Hudson also received a $831,649 Drinking Water State Revolving

Fund loan and a $967,656 ARPA grant to replace hydro-pneumatic water tanks with a ground water storage tank and booster system.

The project includes replacement of aging water distribution lines to address breaks and water loss and the addition of water main loops to improve flow throughout the community. The loan terms are 1.625 percent for 30 years.

Joint Well Field, Inc. received a $1,656,900 ARPA grant for water treatment plant improvements.

Joint Well Field, Inc. is a jointly owned and operated water source and treatment facility that serves both Brookings-Deuel Rural Water System and Kingbrook Rural Water System. Funding for this project was previously awarded by the

board in March 2021.

Kingbrook Rural Water System received a $108,000 ARPA grant for improvements to the Carthage water tower. Funding for this project was previously awarded by the board in March 2021.

Lake Norden received a $652,463 ARPA grant to construct a new water tower storage. Funding for this project was previously awarded by the board in March 2021.

Lake Poinsett Sanitary District received a $1,809,749 Clean Water State Revolving Fund loan and a $2,790,251 ARPA grant to make improvements to its existing wastewater system including upgrades to existing lift stations

These funds and local ARPA funds will cover the project costs.

North Sioux City also received a $5,627,193 Drinking Water State Revolving Fund loan and a $1,723,807 ARPA grant to make improvements to the Streeter Drive Water Treatment Plant. This will involve updating the chemical feed, electrical, and other systems. Other improvements will increase aeration, detention, filtration, and backwashing capacity. Terms of the loan are 2.125 percent for 30 years.

Northville received a $179,758 Drinking Water State Revolving Fund loan and a $1,044,562 ARPA grant to replace water meters, loop lines, and improve aboveground water storage. Improvements include building a glass lined, above-ground water storage tank and pumphouse. This project will address issues with water storage, pressure, quality, and water loss. The loan terms are 2.125 percent for 30 years.

Salem received a $370,293 ARPA grant for storm sewer improvements. Funding for this project was previously awarded by the board in June 2021.

In addition, Tea received a $1,009,280 Drinking Water State Revolving Fund loan and a $593,634 ARPA grant to extend municipal water service to existing industrial and commercial properties in the Hagedorn Industrial Park. The loan terms are 2.125 percent for 30 years.

Tea also received a $3,694,231 ARPA grant to connect its wastewater treatment system to the City of Sioux Falls. Funding for this project was previously awarded by the board in March 2021.

White also received a $1,786,189 Drinking Water State Revolving Fund loan and a $715,611 ARPA grant to construct several improvements to its water distribution system. The city will replace aging water distribution mains, refurbish its water tower, and replace cast iron pipes. The loan terms are 1.625 percent for 30 years.

The American Rescue Plan Act provides grants for eligible water, wastewater, storm water, and nonpoint source projects. The state of South Dakota is making a historic investment in infrastructure by dedicating $600 million of American Rescue Plan Act funding for local water and wastewater infrastructure grants.

The Solid Waste Management Program provides grants and loans for solid waste disposal, recycling, and waste tire projects. The Legislature annually appropriates dedicated funding for the Solid Waste Management Program through the Governor’s Omnibus Water Funding Bill.

The State of South Dakota and the U.S. Environmental Protection Agency fund the Drinking Water State Revolving Fund Program, which provides low-interest loans for public drinking water system projects. The program is funded through a combination of federal appropriations, loan repayments, and bonds.

They Made the Ultimate Sacrifice, Now South Dakota is Honoring Them GREG WHITLOCK | SECRETARY, SD DEPT OF VETERANS AFFAIRS South Dakota’s Fallen Hero Bridge program dedicates state bridges to South Dakotans who were killed in action while serving their country or classified as missing in action.

These young men and women, so young and in such a short time, met their destiny on far-off battlefields.

In return for their great gift, there is nothing more complex or important that we can do but to ensure the memories of their shortened lives go on.

They need to be remembered, not as victims ambushed by some cruel twist of fate, but as idealists who chose to serve and risk their lives.

Idealists who were struck down in the pursuit of something bigger than themselves and are forever deserving of our respect, admiration, and remembrance.

These brave warriors who fell in battle were, more often than not, young and in the prime of their life.

They were brimming with promise and optimism, and possessing

energy, enthusiasm, idealism, and hope. They were and are truly the strength of our country.

For the greater good of our nation and our citizens they knowingly marched into harm’s way. They put everything on the line to ensure our future, even though it meant endangering their own. The veterans we dedicate these bridges to did not just give us their lives, they gave us their futures. Most had more life ahead of them then behind them and did not experience their college

graduation, their wedding, or the birth of their first child.

The men and women we honor on these bridges were American soldiers, sailors, airmen, marines, and coast guardsmen who sought service when times were troubled and our values were challenged.

We are committed to preserving their memories and in demonstration of our will to remember. I ask everyone to participate in one of the 12 bridge dedications scheduled in 2022.

SDPAA Welcomes Becky Brunsing as its new Member Services Representative!

The South Dakota Public Assurance Alliance (SDPAA) is pleased to announce the hiring of Becky Brunsing to serve as the SDPAA’s Member Services Representative.

For the past twenty years, Becky has served as the City Administrator/Finance Officer for the City of Wagner, SD. She has served as President and on the Board of Directors of the South Dakota Municipal League, and she recently served as the Chair of the SDML Audit Committee. She has also served as President of the South Dakota Government Finance Officers Association (SDGFOA). She was the SDGFOA’s Finance Officer of the Year in 2014. She fills other leadership roles within her community, including currently serving as the President-Elect of her local Rotary Club.

Becky is a Wagner native. She and her husband Mike have three children and live on her family's homestead that recently turned 125 years old. Their son is the fifth generation to farm the homestead. In her spare time, she helps on the farm and enjoys gardening and canning all the produce. There is always a fresh jar of pickles at the Brunsing household! Her passion for public service is shared by her husband Mike who serves as the Superintendent of Lawrence Township.

In 2017 SDPAA Members first elected Becky to serve on their Board of Directors. The SDPAA has benefitted from

her stewardship until she recently resigned to accept full-time employment with the SDPAA. We will miss her service on the SDPAA Board but welcome her as part of our internal team.

Becky’s passion for public service BECKY BRUNSING began when she served as a sales tax Auditor for the State of South Dakota from 1990 to 1993. She then served her community by providing financial and human resource management for a local health care system and for a local accounting firm before she began her two decades of service to the City of Wagner. She holds a bachelor’s degree in accounting and brings a wealth of governmental and financial knowledge to the SDPAA. We are excited she is joining our team!

Becky looks forward to continuing her relationships with cities as well as getting better acquainted with the counties, townships, conservation districts, and other SDPAA Members while serving your coverage needs.

She shares your enthusiasm for public service and will eagerly assist you in furthering your public service mission.

There have not been any legal developments regarding coverage of COVID-19 exposures or illnesses. Legal authority advises that these are not compensable claims under workers’ compensation. The legislature passed HB 1046, which states that one may not bring a claim or action unless the exposure is intentional and results in the COVID-19 diagnosis. Section 21-68-6(3) states that COVID-19 is not an occupational disease.

KIDS’ CHANCE OF SOUTH DAKOTA

Kids’ Chance of America is a national organization offering need-based higher education scholarships to children affected by a workplace injury. At least four students have been children of employees covered through SDML Workers’ Compensation Fund. SUBROGATION

For lack of better explanation, subrogation means reimbursement. If there is a work injury as a result of another party’s wrongdoing, workers’ compensation will pay benefits and send a subrogation claim to the responsible party. We will seek reimbursement for the monies paid. A couple of notable statutes apply: • SDCL 62-4-40 indicates that the insurer/provider may collect recovery “in his own name.” This means that the work comp carrier can pursue recovery regardless of the intention of the employee to pursue a liability claim.

• SDCL 62-4-38 explains that if an employee receives a recovery from a third party, the recovery is an offset against any further workers compensation benefits.

Municipal volunteers are considered employees under the workers’ compensation statute 62-1-5.1 if they are duly appointed and that appointment is entered into the official records or minutes. Please remember to

U.S. SENATOR MIKE ROUNDS

Strengthening Our Armed Forces The United States military is the best in the world. Our all-volunteer force is made up of men and women from different backgrounds and different states, but what they all have in common is a love of country and a desire to serve. We are eternally grateful to them—and their families— for the incredible sacrifices they make to protect our freedoms. One way we can show our thanks is by making sure they have the tools and resources necessary to do their job.

In Congress, we do this by passing a National Defense Authorization Act (NDAA) each year.

The Senate Armed Services Committee, which I’ve worked on since coming to the Senate in 2015, recently voted to approve the NDAA for fiscal year 2023. It will be debated by the full Senate before we vote on final passage.

Additionally, the House is working to produce their own version of NDAA. The differences between the House and Senate bills will be reconciled in a conference committee. Each chamber must then pass this final version before it can be signed into law by the president.

Our committee put in a lot of work this year on the NDAA and I’m pleased that we were once again able to pass it with strong

bipartisan support. In fact, this will be the 62nd consecutive year that we will have passed a widely-supported NDAA. As our near-peer competitors, like China and Russia, continue to grow their own militaries, it’s critically important that the U.S. makes sure our troops have better weapons systems, better tools and more resources than our adversaries. We never want to send our men and women into a fair fight—we always want them to have the advantage. The NDAA authorizes Department of Defense (DoD) programs and provides defense policy to make sure the United States maintains irreversible momentum when it comes to implementing the National Defense Strategy. The National Defense Strategy provides clear direction for restoring our military’s competitive edge in an era of re-emerging, long-term great power competition. The B-21 Raider bombers coming to Ellsworth Air Force Base in the near future are a part of this long-term National Defense Strategy. As I said earlier, we have the best armed forces in the world, but we need to make sure we remain the best well into the future.

The men and women who wear the uniform of the United States put their lives on the line to protect and preserve our freedom. We’re forever grateful to them for their service and sacrifice. Passing the NDAA each year is one way for us to make sure they and their families are taken care of and have all the resources they need as they serve our nation. ■

July 1 – One of two dates (the other being January 1) a new or amended municipal tax ordinance may become effective. The municipality must notify the Department of Revenue of the ordinance at least 90 days prior to the effective date. (SDCL 10-52-9; 10-52A-13; See Hdbk., sec. 12.260) No later than July 1 – Each municipal governing body shall provide to the Department of Public Safety, Division of Emergency Management, information that will enable emergency agencies to reach the members of the municipal governing board and the mayor at any time, day or night. The information necessary shall include home, business, and other personal telephone numbers including any facsimile transmission machines and cellular or mobile telephone numbers; home, business, and other personal addresses; employer’s name and telephone number; and home, business, and other personal email or internet addresses.

In addition, each municipal governing body shall provide contact information for the municipal employees responsible for the following functions if the municipality employs a person in such a capacity: City administrator or city manager; Building inspection; Engineering; Electrical; Fire; Police and law enforcement; Public works; Streets and highways; Sewer

and waste water; Water; Telephone; Utilities; Emergency services or civil defense; Coroner; and 911 coordinator. (SDCL 33-15-11.1; 33-15-11.2; See Hdbk., sec. 9.400) July 4 – Independence Day – State holiday (SDCL 1-5-1) First meeting following election – Except as otherwise provided, every officer of the municipality will begin to discharge the duties of the office as soon as the officer has qualified by filing an oath or affirmation of office.

The oath must be filed within ten days after the first meeting of the month following the election or appointment.

(SDCL 9-14-5; See Hdbk., sec. 5.115) First meeting following election – Appointed municipal officials are usually appointed. The appointment may be annual, or for an interval determined by the governing body.

(SDCL 9-14-3) First meeting following election – In municipalities having the mayor and common council form of government, the council must elect a president and vice-president for the ensuing year.

(SDCL 9-8-7; See Hdbk., sec. 2.520) First meeting following election – In municipalities governed by a mayor and four commissioners, the board must designate by a majority vote, the following commissioners: Public Safety, Public Works, Utilities, and Finance and Revenue.

Commissioners are assigned areas of responsibility under the law. (SDCL 9-9-18 to 9-9-24; See Hdbk., sec.

2.590) First meeting following election – In municipalities governed by a mayor and two commissioners, the board shall by a resolution adopted by a majority, assign and apportion between the members, all duties that

are not assigned to the mayor. (SDCL 9-9-27; See Hdbk., sec. 2.595) First meeting following election – In those municipalities employing a city manager and under the commissioner form of government, at the first regular meeting in the month following the annual election, the commissioners must elect one of their members to serve as mayor for a term of one year.

(SDCL 9-10-6; See Hdbk., sec. 2.615) On or before July 15 – The governing body of the municipality may impose an excess tax levy with an affirmative two-thirds vote of the governing body on or before July fifteenth of the year prior to the year the taxes are payable. The decision to increase taxes must be published within 10 days of the decision, (certain publication size restrictions apply), and may be referred upon a resolution of the governing body of the municipality or by a petition signed by at least five percent of the registered voters in the municipality and filed within twenty days of publication of the decision.

The referendum election shall be held on or before October first preceding the year the taxes are payable. (SDCL 10-13-36; See Hdbk., sec. 12.170)

By July 15 – The secretary of revenue shall apportion the money in the local government highway and bridge fund.

12.255(6)) Boundary changes – Municipalities must notify the Department of Revenue of any resolution or amendment enacted which changes the boundaries of the municipality. Notification shall be in written form, shall contain a copy of the resolution or amendment, and may be sent by electronic means or registered mail.
