DIRECTOR’S NOTES Yvonne Taylor

JOB OPENING: The luckiest person on the planet is retiring after 30 years with the Municipal League, and the SDML Board will soon be seeking a candidate for the position of Executive Director.

The job entails working with the absolute best people in South Dakota. They will be welcoming, kind, helpful, and appreciative of your work. They are also a lot of fun.

The candidate will find there are challenges every day, and new topics and issues to address. At the same time, many things are perpetual – needing another penny of sales tax for infrastructure, fighting over the number of liquor licenses, deciding whether it is still worth the money to publish notices in the newspaper, and dealing with the Legislature. The old person is willing to share some thoughts on that last item and will stick around for a bit to help.

The new person will find immense satisfaction in helping improve South Dakota by helping the people who do nearly all the groundwork. From elected officials, to finance officers, to the street crews, electrical systems, utilities and more – thousands of people spend all day, every day, working to make their cities and towns better. The new person gets to help make their jobs easier.

The old person was very proud to serve as Executive Director and wishes for nothing more than a great career for the new person and a long future of success for the Municipal League.

The old person is a little teary-eyed now but wishes to thank all of you for the great years working for you. I have sincerely loved it.

Let the people’s voices be heard Amendment C is on the ballot for the June 7 primary election. If passed, the amendment would require a 60% favorable vote by the citizens for any measure or constitutional amendment initiated by the citizens or the legislature - if that measure results in the expenditure of $10 million over the first five years or will result in the addition of a new tax or increase of an existing tax.

The rationale given by proponents is that South Dakotans are heavily burdened by taxes and need protection when contemplating measures that will cost money. On the surface, this is a good thought, however requiring 60% rather than 50% approval will likely kill most initiated measures.

The rationale of the bill is one thing, but maybe not the most important thing. The timing of this measure appearing on the ballot definitely tells a story.

First, this measure will appear on the ballot in June, likely due to the fact Medicaid expansion will be on the ballot in November. In essence, Amendment C is being used as a tool to kill Medicaid expansion. This is a political strategy by legislators to protect the people, from the people who would vote for Medicaid expansion.

Okay, fair enough, but the significance of the placement on the June primary election cannot be ignored.

Who will be motivated to vote during the primary election? Only Republicans. Based on the Republican nature of our communities in South Dakota, there are rarely Democratic candidates featured in primary elections. Therefore, the volume of Republican voters showing up at the polls in June is guaranteed. Also guaranteed is that a significant portion of those voters will learn about Amendment C for the first time when reading the ballot language in the voting booth.

It’s an easy analysis when a voter only has a few minutes to decide. No one wants higher

taxes, so the default vote will be to approve Amendment C. For the Democrat or Independent voter, first, they must become aware of Amendment C, understand it to a great extent, then make a trip to the polling place where they will only be allowed to vote on this amendment.

Call it coincidental if you want, but it is strategic gold if you are against Medicaid expansion.

Medicaid expansion is just one recent issue that would be impacted by Amendment C’s requirement of 60 percent, rather than 50 percent, approval. The unintended consequence of Amendment C would be to handcuff citizen or legislative efforts to initiate measures that are clearly intended for the people of the state to ultimately decide. It’s not hard to imagine that Amendment C would restrain all of the people's efforts – Republican, Democrat, Independent, liberal, conservative, etc. – to bring forth an issue for the state’s voters to decide. At a time when participation and interest in government, issues and the democratic process is at rockbottom levels, we should be encouraging citizen and voter interest, not placing undue obstacles, hurdles, and barriers in front of citizens’ initiated efforts.

This political strategic tool will be used over and over to place a higher approval rate on measures brought by the people, or the ’s representatives.

It will demotivate the people from taking an active role in their government. It will redefine our version of democracy.

Be Aware of New Laws Taking Effect July 1 Yvonne Taylor

Below are some of the most relevant bills for municipalities to be aware of following the 2022 Legislative session.

It was a great year for infrastructure!

SB 62 – Allocates $600 million of the State’s ARPA funding into the SRF funds in Department of Agriculture and Natural Resources. Many of you have already applied – to participate in this money, you’ll need to get your project on the State Water Plan.

HB 1033 – Allocates $150 million of state general funds and $50 million of state ARPA funds to the Housing Opportunity Fund within the SD Housing Authority. The money is to build infrastructure for housing, with $100 million (including the $50 million ARPA funds) for grants, and $100 million for revolving loans. Cities under 50,000 population may access both types of funding and have 70 percent of all funds allocated to them. Cities over 50,000 population split the remaining 30 percent. Funds may be used for housing infrastructure, which is defined in the legislation as: rights-of-way; water distribution systems; sanitary and storm sewers; streets, roads, and bridges; curbs, gutters, and sidewalks; lift stations; excavation and compaction; traffic signals; street lighting; the purchase of land necessary to accommodate projects listed in this section; and any other infrastructure project determined by the South Dakota Housing Development Authority to be consistent with the purposes of this Act. SB 162 – Discretionary formulas allow lowered

property tax valuation for specified types of property.

This bill would allow cities to adopt any part of a discretionary formula not adopted, or not fully adopted, by the county for qualifying housing and extends time allowed for a discretionary formula from five to seven years for qualifying housing.

SB 90 – Clarifies local option to adopt the International Residential Code and creates a group at the state level to review changes to versions of the building codes every three years and report so municipalities, counties, and the state can use the information when determining their own needs for the IRC. SB 156 – Allows use of entire census estimate (rather

than the current 90%) for purposes of determining whether new on- and off-sale licenses are available.

SB 190 – Provides some cover for cities without zoning

ordinances to regulate the place of operation of any medical cannabis-related establishment, and to provide for “sensitive use areas” such as schools, churches, day cares, parks, and the like.

SB 24 – Limits the number of “home-grown” plants – which is two flowering and two not flowering – for medical marijuana card holders SB 5 – Defines “safety sensitive jobs” as any position

with tasks or duties the employer reasonably believes could cause illness, injury, or death of an individual, or result in serious property damage. It also defines “under the influence of cannabis” as any condition that tends to deprive a person of clearness of intellect and control that the person would otherwise possess. The bill puts those two definitions to work by saying people aren’t allowed to perform safety sensitive jobs while under the influence of medical cannabis. It also clarifies that employers can still establish and enforce a drug free workplace policy that may include a drug testing program.

HB 1292 – Prohibits the sale, use, or possession of products containing Delta 8 by anyone under 21.

HB 1076 – Allows municipalities to consider a new form of government - letting the aldermanic form to continue, but with only one ward – so essentially it would allow the aldermanic form to have at-large seats. Like all changes of form, it will take an election to switch.

HB 1025 – Adds Juneteenth (June 19th) to the list of legal holidays in SD. ■

New Website hosts Meeting Info for local Governments Sara Rankin

The SDML, in collaboration with the Counties Association and Associated School Boards of South Dakota, have established the Local Government Boards and Commissions website. The site allows local governments to post meeting agendas and minutes as well as other meeting documents.

The public can access the information at sdlocalgov.appssd. sd.gov.

Municipalities can use the website to any extent that you wish; for something as simple as posting a link to your own website for meeting information, to using it as a primary website for posting all meeting

information, meeting documents and governing body information.

The goal is to have all municipalities post, at a minimum, your minutes for all council meetings.

Each municipality will need to create an account at https://sdlocalgov. appssd.sd.gov/cms/login.aspx.

The account will be electronically approved by SDML staff. You will be notified of that approval and then you will be able to update your account profile and begin updating and posting information.

Each South Dakota Local Government Board and/or Commission will have at least one person assigned admin privileges for the site. These privileges allow

the user to post information about the board or commission they are affiliated with.

All SD Counties saw increased Visitor spending in 2021 PIERRE, S.D. – In 2021, visitor spending in South Dakota reached a record high of $4.4 billion. A recent analysis shows all areas of South Dakota rebounded significantly.

The detailed analysis, done by Tourism Economics, indicates a majority of visitor activity took place in Minnehaha, Pennington, Lawrence, Brown, and Custer counties, making up 68% of all visitor spending.

While the majority of visitor activity took place in these five counties in 2021, all counties in South Dakota saw an increase over 2020. The counties that experienced the largest year-over-year growth compared to 2020 were Todd (44%), Pennington

(40%), Meade (39%), Lawrence (37%) and Buffalo (36%).

“In addition to the impressive growth over 2020, we were pleased to see 43 counties surpass pre-pandemic levels of visitor spending,” said Jim Hagen, Secretary of the Department of Tourism. “The impact these visitors have on communities across our state is significant. These visitors come to enjoy the beauty of our open prairies, fish our pristine lakes and abundant rivers, hunt our bountiful fields and stand in awe at our monuments. These visitors support the diners, marinas, hotels and attractions in communities large and small.”

The resiliency of South Dakota’s tourism industry has proven to be the best in the nation. South Dakota was the first state in the nation to fully recover from the pandemic, and visitor activity helped keep South Dakota citizens employed during a challenging time.

“Our industry has so much to be proud of,” said Hagen. “This industry supported more than 54,000 jobs and provided 1.8 billion dollars in household income to South Dakota families.”

SDML Stands Firmly Against Amendment C ►South Dakotans for Fair Elections is a group of individuals and organizations who believe South Dakota is strongest when the majority rules, not out-of-state special interests.

Municipalities throughout South Dakota are encouraging their citizens to vote no on Amendment C on June 7, which they warn would lead to unintended consequences for the state and its people.

“Cities leaders recognize that Amendment C is confusing, unnecessary, risky, and that it will permanently change our constitution,” said Yvonne Taylor, Executive Director for the South Dakota Municipal League. “It shreds the sacred majority rules tradition that this country and our state was founded on, allowing a small minority to block important decisions that most voters want.”

The South Dakota Municipal League, which is the association of over 300 incorporated municipalities in the state, joins South Dakotans for Fair Elections and several industry groups in opposing Constitutional Amendment C. If passed, the amendment would permanently change the constitution to end majority rule for ballot measures, requiring any future ballot measure that increases taxes, or spends $10 million over five years, to pass by at least 60%.

South Dakota has operated on a simple majority vote since creating the ballot initiative process in 1898.

The Municipal League warns that this amendment would severely inhibit voter engagement and citizen-initiated ballot measures.

“It’s unfair for 41% of the electorate to be able to thwart the other 59% on tax policy,” explained Taylor.

“Amendment C limits the citizens’ ability to implement important public projects – even if the majority of voters want them funded. We’re talking law enforcement, rural hospitals, nursing homes, schools – just a few voters would be able to shut those all down.

“When you amplify the voice of the few, you silence the voice of the many,” she said.

The Municipal League provides a break-down of the proposed amendment on their website, SDmunicipalLeague.org.

In the piece, Taylor explains the amendment step-by-step and also points out its other issues: the timing of placing it on the ballot, the lack of clarity to determine which measures would be affected, and how it benefits out-of-state special interest groups.

The primary election is June 7. All registered voters can weigh in on the amendment regardless of party affiliation. ■

Amendment C will lead to unintended consequences for our state. It’s confusing, unnecessary, risky, and it will permanently change our constitution in ways we can’t even imagine yet. If it ain’t broke, don’t fix it.

The truth is that out-of-state lobbyists and special interests will be the real winners if C passes.

Amendment C gives power to special interests while undermining the will of South Dakota voters – perhaps that’s why an out-of-state special interest group is bankrolling the campaign to pass it.

Here’s the fine print: Amendment C would permanently change our constitution to end majority rule for ballot measures, allowing just 41% of voters to block decisions that most voters want, including funding for law enforcement, rural healthcare centers, our schools and more.

Amendment C is also unconstitutional, and a lawsuit has already been filed against it.

Amendment C faces widespread opposition from business owners, workers, mayors of our cities, and rural residents alike. They all oppose C because they know it’s wrong for South Dakota’s future.

Primary Election Ballot Measure Attorney General's Statement Constitutional Amendment C A constitutional amendment requiring three-fifths vote for approval of ballot measure imposing taxes or fees or obligating over $10 million.

Sponsor: Proposed and passed by the 2021 South Dakota Legislature Attorney General's Statement Currently the constitution requires that any new tax or tax increase must be approved either by voters or by two-thirds of the members of each legislative branch. To be approved by voters, such a measure must obtain a majority of the votes cast.

This constitutional amendment requires that any initiated measure, proposed constitutional amendment, or referred measure imposing or increasing taxes must obtain three-fifths of the votes cast to be approved.

This constitutional amendment also adds the requirement that any initiated measure, proposed constitutional amendment, or referred measure obligating the state to appropriate $10 million or more in any of the first five fiscal years must obtain three-fifths of the votes cast to be approved.

This constitutional amendment additionally requires any initiated measure, proposed constitutional amendment, or referred measure which imposes or increases fees to obtain threefifth of the votes cast to be approved.

chris hill SDML director of municipal electric services During April I had the pleasure of attending the Heartland Consumers Power District (HCPD) annual meeting and the Missouri River Energy Services (MRES) annual meeting. Both HCPD and MRES had great news for their customers and have positive things coming in the near future. I always enjoy attending meetings that are held by both HCPD and MRES as SDMEA members are also their customers. This means I can visit with my members all in one location. Luckily, the SDMEA is also having more events to get everyone together so we can collaborate and build our association.

Member engagement has been my message for 2022 and I feel it’s crucial for the success of our association. Legislative session is over, district meetings are over, conference is over, and annual meetings are over. This means it is time to get on the road. I am excited to make membership visits again and I will be contacting you all soon to set up visits to discuss what is new with the SDMEA and find out what is new in each of your communities!

When people ask about the SDMEA I always tell them that the best part of my job is visiting the members. I love seeing the communities and the progress that has been made since my last visit. Progress in these communities might seem slow to residents, but much like watching trees grow, it’s the folks that only see the tree occasionally that realize how much progress has been made.

Our SDMEA golf tournament will be held shortly after this publishes, and I hope that several members are able to attend to support our sponsors. We are also currently looking 12

at arranging a trap shoot in the fall and will be locking down dates on that soon.

I also want to mention a couple people that I heard speak and visited with during the HCPD and MRES meetings. I enjoyed all of the presenters and they all did a great job, but two people that I am a huge fan of presented. One at each. First, Senator VJ Smith presented at the Heartland annual meeting. If you have not heard VJ speak, I highly recommend it if you have the opportunity. He is an inspiration to humans and is a great man. Listening to him speak leaves you wanting more – even more impressive since he spoke for two hours. His book, The Richest Man in Town, is a story about a cashier at the Brookings WalMart. In the book, the cashier, Marty, shows appreciation to everyone at a level that you would not expect, but everyone stood in his line because Marty’s acknowledgement of his customers let them feeling better about their day almost magically. VJ Smith has decided to retire from the legislature and I will miss him at the Capitol. I hope our paths cross again soon so I can learn more from him. As VJ would say, send letter before it’s too late.

The next person has similar traits and is an electric person to be around – no pun intended. His calm demeanor makes you feel important, and he doesn’t even realize it. I met Colin Hansen at the Midwest Municipal Utilities meeting in 2017 when he was the executive director for the Kansas Municipal Utilities. His kindness and passion for public power makes it easy to listen to him and excited to be around him. Colin’s presentation was on small town public power and focused on many smaller

communities from the Midwest.

His speech centered on resilience, resourcefulness, and living each day in full, which he tied into his personal life and his work in the public power industry. Colin is now the CEO and General Manager of the Kansas Power Pool and is Chair of the Board of Directors for the American Public Power Association.

VJ and Colin both have a quality about them that we should all be lucky to have. Their message is simple, even if they aren’t speaking directly about it. Be nice to people.

Take time for people. Work together to find a solution and always take time to listen. I can assure you that if we strive to be more like VJ and Colin, our HOMETOWNS will be even more great! ■

Why Your Municipality Needs a Website, Not Just a Facebook Page Miranda Hampton

Some municipalities only rely on a business Facebook page to share information with residents. While a Facebook page is important, it’s not a substitute for a website. Having a website gives you the opportunity to offer a robust set of services, detailed and organized information, and ways for citizens to contact you that a Facebook page lacks.

Authoritative Information That You Control

On a Facebook page, you need to monitor comments—meaning you can either stifle engagement or open up the opportunity for negative and false information to appear in comments. Depending on who administers your Facebook page (probably one or two people), if they get busy, negative comments can linger for a long time or, the opposite, positive comments may sit unapproved for so long that people stop engaging with your Facebook page.

A website is “owned content,” meaning that you own and control the information you present to the world. Most residents will view your website as the authoritative source of information about your city or town.

Your residents can trust your municipal website. However, many unauthorized Facebook pages exist for cities. Despite declaring that your Facebook page is valid, it can get lost in the noise. A search for most cities on Facebook brings up many unofficial pages that people may click on instead of yours. Anyone can create a Facebook page, and they do! Having an official website removes the credibility issue and assures residents that the information they receive from you is correct. (You can also link to your correct Facebook page from your website.)

Thoroughly Provide Organized Resources

Your municipality’s website can host resources your residents may need in a clear, organized way with multiple pages. By having online forms, FAQs, and other citizen services easily accessible, you are able to provide citizens information more effectively than on your Facebook page.

While you could link to a city form on your Facebook page, critical information can get lost when mixed in with other information.

Facebook gives you one page and little flexibility when presenting information. On a website, your municipality can publish many easily findable webpages where citizens can access important documents and information.

Detailed Contact Information

Your municipality’s website can provide a directory page for contacts while also sprinkling relevant contact information on various webpages.

Facebook pages severely limit the prominent contact information you can display—merely a physical address, general email, and general phone number. Residents need more specific contacts for different departments and needs. Only a municipal website allows you to present such contacts in a thorough, convenient way for residents.

More Customization

Facebook barely allows you room to customize your page. Sure, you can update your profile and cover photo to show off your beautiful city or town, but Facebook’s options are limited.

A website gives you more room to fully showcase your municipality any way you choose. Whether you want to show off local businesses or highlight popular tourist attractions,

you can customize your website to fit your municipality best.

Use Social Media for Interacting—Not as Your Website

The original purpose of social media is to engage in two-way interaction with people online—not as a broadcasting tool. A website works better as your broadcasting tool. By focusing on your website as your library of information, you can use social media such as Facebook more for engaging with residents rather than as a website substitute. A Facebook page works great to push out timely announcements, publish fun and light-hearted content, and, most importantly, engage with residents.

These are just some of the many reasons why municipalities need more than just a Facebook page for their residents to access information.

Use your municipality’s Facebook page in alignment with your website, and not as your website. ■

Property Assessment and Cleanup Funds Available PIERRE, S.D. - Many South Dakota communities are dealing with dilapidated buildings or potentially contaminated properties that prohibit redevelopment within their communities. Funding necessary environmental work can be challenging. The good news is that the Department of Agriculture and Natural Resources (DANR) Brownfields Program continues to offer assistance to cities, counties, and non-profits by hiring professionals to perform Phase I & II Assessments and testing for asbestos, lead paint, petroleum, or other hazardous materials.

Beginning this year, the US Environmental Protection Agency (EPA) will begin to distribute some of the $1.5 billion in additional Brownfield funding that was allocated to the federal Brownfields Program under the 2022 Bipartisan Infrastructure Law (Infrastructure Investment and Jobs Act). Much of this funding will be made available to communities and non-profit entities to spur redevelopment and support housing initiatives, by assisting with assessment and cleanup costs. Some grants are even available to provide funding to support planning efforts at the local level. Municipalities and other organizations may access federal funding by applying for funding directly from EPA.

Medal of Honor Trooper Michael Dale South Dakota Highway Patrol, Rapid City On the night of Dec. 12, 2021, the Rapid City Police Department received a 911 call of a man floating in Rapid Creek. When the subject was located, responders attempted to get them to swim back to shore, but they did not respond to commands.

Nominator Sgt. Austin Schmitz They turned face down with Trooper Michael Dale. and went under the water several times as they continued to move farther out into the water. A lifeline was thrown to the individual, but he was unable or unwilling to grab it.

Rather than staying along shore, Trooper Michael Dale sprung into action, taking off his duty belt and wading into the frigid and fast-moving water. The individual was very intoxicated and uncooperative, making the rescue even more difficult. Dale grabbed the individual, secured the lifeline around them, and pulled them back to safety.

The individual was transported to Monument Health where they were treated for possible hypothermia and other medical and mental health conditions.

“Trooper Dale’s quick, selfless actions exemplify this award,” said Sgt. Austin Schmitz of the South Dakota Highway Patrol. “Had he not acted quickly and decisively, this individual would have most certainly lost their life.

Only Troper Dale’s direct actions saved this individual.”

The Medal of Honor is given jointly by the South Dakota Police Chiefs’ and South Dakota Sheriffs’ Associations and is for law enforcement officers who willingly distinguish themselves through an act of courage, involving a risk of imminent serious injury or death, for

the purpose of saving or protecting a human life or while taking an armed and immediately dangerous suspect into custody.

Farmers Coop, who was suffering from a heart attack. Chief Schurch immediately started CPR while Sergeant Meinzer quickly attached the AED. When the ambulance arrived, Austin was alert and responsive.

“Both Meinzer and Schurch took control of the situation in calm and professional way,” said Larry Bork, Southeast Farmers Coop Safety Coordinator. “And because of that, our employee is still with us today.”

The Chief John Wainman, Sr. Service Award is given for contributions by a member of the SDPCA which exceed the high standard and contributions normally made by members. ■

Dept. of Transportation To Host STIP Meetings The South Dakota Department of Transportation (SDDOT) has announced dates for informational public meetings to discuss the development of the 20232026 Statewide Transportation Improvement Program (STIP).

The STIP is a four-year program that lists projects developed through the coordinated efforts of the Department of Transportation, Transportation Commission, state and federal agencies, local and tribal governments, metropolitan planning organizations, public agencies, transportation providers, citizens, and other interested parties.

The program identifies highway and intermodal improvements to preserve, renovate, and enhance South Dakota's transportation system.

Interested parties can take part in the development process by attending an informal or formal public meeting held across the state this summer.

Traffic Control Device Grants Awarded The South Dakota Municipal Street Maintenance Association recently awarded four Traffic Control Device Grants at their Spring Training on April 26 in Rapid City.

The cities of Kimball, White Lake, Alexandria, and Martin were each awarded a $2,500 grant.

Grant applicants are required to be SDMSMA members and the grant funds are to be used for Traffic Control Devices such as speed display units, traffic count units, and flashing warning signs for pedestrians. ■

Pierre’s Heaton Named Code Officer of the Year Pierre Police Officer Drew Heaton has been named the Code Enforcement Officer of the year by the South Dakota Association of Code Enforcement (SoDACE).

O ff i c e r H e a t o n w a s nominated by Pierre Police Chief Jason Jones and Officer Drew Heaton, Pierre selected by the Association Police Department. for his work mitigating property maintenance violations.

“Property maintenance enforcement is tricky business, often requiring a lot of patience and interpersonal skills,” said Chief Jones. “Drew uses compassion and heart to bring voluntary compliance to nuisance properties, and our community is all the better for it.”

Officer Heaton, a Sioux Falls native, has been a member of the Pierre Police force since 2014. Prior to becoming the Community Resource Officer in 2017, Officer Heaton served as a patrol officer.

The award is given each year to a member of the association for their years of service as well as outstanding contributions to their municipality as a Code Enforcement Officer, contributions to their community as a citizen, and personal accomplishments.

The award was presented during the annual SoDACE Information and Training Conference held at Drifters Event Center in Fort Pierre on May 11. ■

Officer Heaton was caught off guard when his name was announced as the Officer of the Year.

“They asked me to say a few words. ‘Thank you’ was about all I could muster,” said Officer Heaton.

“Now that I’ve had a minute to collect my thoughts I’ll tell you this was a team effort. The award and the progress we’ve made wouldn’t have happened without the City Building Department.”

Heaton says that he works side-by-side with Andrew Mentele, City Building Inspector, and Matt Elberson, City Building Official on nearly every nuisance property issue.

“Our team is about so much more than enforcement,” said Pierre Mayor Steve Harding. “They spend a lot of

Pool Testing Guidelines Municipal swimming pools are no longer regulated by the State of South Dakota.

However, these facilities should be tested for coliform bacteria during each week of operation. All pool samples should be tested for total coliform, which is an indicator bacteria for drinking water and pools.

Total Coliform – Negative means that no coliform bacteria were found and the water is safe.

Total Coliform – Positive means that coliform bacteria were found.

Two or more consecutive positive samples indicates a general trend of bacteria presence in the pool. Corrective measures should be taken, such as super-chlorination, to prevent a health related incident caused by poor water quality.

“This historic preservation grants program is designed to encourage restoration or rehabilitation of historic properties and is one more way we can promote and protect our history and culture,” said Ted M. Spencer, State Historic Preservation Officer.

The grants are awarded through the State Historical Society’s Deadwood Fund grant program. Funding for the program is from a portion of the Deadwood gaming revenue earmarked by state law for historic preservation projects throughout the state. The program is administered by the society’s State Historic Preservation Office at the Cultural Heritage Center in Pierre.

Pickstown July 21, 1948

Pickstown was incorporated in 1986, originally built by the U.S. Army Corps of Engineers to house the influx of workers to construct the Fort Randall Dam. Construction began in 1946 and continued through 1949.

Peak population was 3,150 in 1950.

The finished town site consisted of 13 dormitories, 262 duplexes, 125 cabins, 225 trailer spaces, 25 permanent houses, 3 cafeterias, a school, movie theater, recreational center (with an 8-lane bowling alley), hospital, hotel, interdenominational church, fire and police station, shopping center, post office, credit union, laundry, garage/car dealer, gas station, and governmental offices.

Currently the town consists of 17 duplexes (3 have been converted to single family dwellings) and the

original 25 homes are still here along with another 80 single family homes.

The first school was in a duplex on James Avenue for the 1947/48 school year with 20 students and two teachers. As attendance grew, some students attended in the mornings and the rest in the afternoon. The new school opened in the fall of 1948. At its peak there were 540 students in 1950. The school closed in 1968. The group has held ten reunions with people returning to town from 20 states.

Another reunion is scheduled for June 2022.

The town has a refurbished community park named after NBC Anchor Tom Brokaw. The local community group has done countless fundraisers to raise

dollars to update equipment. They host a craft fair, a hog roast and 4th of July parade/run/picnic to name a few events.

The City offices recently moved from the Police/Firehall to the former Credit Union Building. The city also owns three additional buildings which date back to the original town building: one houses the City Shop, another is rented, and the third is referred to as the Rainbow Room. It is used for community events such as reunions and wedding receptions.

It also houses the Pickstown Fort Randall Museum - a must see for any history buff, it covers early areas of old Fort Randall, the building of the town, dam construction, and the school to name a few.

The town provides water/sewer and electric services to around 135 residential customers and 24 commercial customers. Roughly a third of the houses are considered weekend/vacation homes. Two RV campgrounds accommodate over 30 campers.

There are two hotel/motels located in town as well as two bait shops (both providing gas and meals), a boat dealership repair shop and a nine-hole golf course. The town recently entered into an agreement to develop 17 lots along the golf course. ■

Good luck to our retiring team member!

This June will witness the retirement of Jerry Krambeck as SDPAA Member Services Representative. We are sad for us but happy for him as he embarks on the next stage of his life to be with his family and to tend to the many projects which he left unfinished while working diligently for the people of South Dakota. His “honey-do” list must be very long—on second thought maybe I am not quite as happy for him!

Jerry has served the SDPAA over the span of 20 years, first as a member of the SDPAA Board of Directors starting in 2002, then later joining our internal team as a Member Services Representative.

He has visited every community in South Dakota multiple times.

Jerry Krambeck, SDPAA He can tell you where to eat or Member Services Representative, to sleep in any locale. Whenever will retire at the end of June after a one of us had an issue with a lifetime of public service in various hotel reservation, we could drop positions.

Jerry’s name and the issue would be quickly resolved—i.e., if you are a friend of Jerry’s, then no problem. He loved visiting with folks in every community and has all positive reviews of their local establishments so you never could call him a “critic.”

Jerry is the epitome of a public servant. He first served on the Spearfish City Council for 3 years then was elected mayor where he served for an additional 13 years. He somehow found the time to be a local volunteer firefighter for

25 years where he also served as fire chief for 2 years!

Jerry is a past president and board member with the SD Municipal League where he influenced policies affecting local governments on a national and state level. His countless activities demonstrated his passion for servant leadership for his community, his state, and his country. Jerry even extended his influence abroad by leading many exchanges with fellow community leaders in Germany and other countries. He maintains those friendships and those productive dialogues to this day. He will be sorely missed. I am honored to have known Jerry as a co-worker and a friend!

In the words of Lynn Bren, who worked most closely with him on a daily basis: “We love Jerry. We are blessed to have him in our lives. He is a true mentor and role model to everyone he meets.”

Jerry’s “replacement” will have big shoes to fill and will be expected to continue his demonstrated concern for local government and the public they serve in South Dakota. To paraphrase Vince Lombardi, the SDPAA will achieve excellence as we strive for perfection!

This seminar addresses the various provisions in the 2021 IBC dealing with the fire-resistance of exterior walls and the protection of doors and windows in such walls. Although exterior walls are primarily regulated due to their location on the lot, many other requirements are set forth in the code. Exterior bearing walls are regulated by Table 601, while the use of exterior exit stairways, exit courts and exterior areas of assisted rescue will also typically mandate some degree of fire-resistance.

Safety Training for Seasonal and Temporary Employees Whether your entity calls it new hire orientation, training, or onboarding, it is important to take time and make the effort to share key information and job expectations with new hires.

Seasonal and temporary employees are no exception. For the purpose of this article, both groups will be referred to as seasonal employees.

Because many seasonal employees are hired leading up to the busiest season of the year (think summer: park and recreation programs,

swimming pools, water parks, conservation district planting, street and highway projects, etc.), it can be difficult to carve out the time needed to provide an effective safety orientation.

Employees have the right to expect a safe and healthy workplace free from discrimination and harassment.

Below are some areas to consider when training seasonal employees.

• Every employee injury should be reported to a supervisor (or designee) before the end of the employee’s shift.

• In case of a medical emergency (911 call) be sure employees understand medical care for the victim is primary, a call to the supervisor or management should happen immediately thereafter.

• Advise your employees on what to do if there is an emergency and they are working in an area without cell phone coverage.

SAFE LIFTING

• Teach employees what a safe lift looks like: how to stand, where to hold the load, lift with the legs, etc.

• Do you have a policy on the maximum amount an employee is permitted to lift? Most experts report a safe weight for the average adult male to lift is somewhere between 40 and 50 pounds. However, it is important to understand that some employees will not be able to lift that much safely.

• Train employees on options available for lifting items that are too heavy or awkward for one person to lift safely. Are there carts, pallet jacks or forklifts?

Employees need to be properly trained before using equipment like electric pallet jacks or forklifts.

FIRE SAFETY

• Where are fire extinguishers located? They should be available in the work environment and in each primary work vehicle.

• Employees need to learn how to use a fire extinguisher.

They must also understand

that different classes of fire extinguishers must be used for different classes of fires.

• Address the fire hazards a seasonal employee might encounter on the job.

• Not every fire can be safely put out with a fire extinguisher. It is important to know when it is safe to use a fire extinguisher and when the fire department should be called.

HAZARD COMMUNICATION

• What chemicals might your seasonal employee work with?

Chlorine, weed spray, paint, etc.

• Employees must be trained on any hazardous chemical before working with it. A safety data sheet (SDS) is one of the best ways to familiarize employees with hazardous chemicals.

• Ensure employees know where SDSs are stored. The SDS will advise on first aid procedures, what to do if there is a chemical spill or release, as well as what extinguishing agent should be used in the event of a fire.

• The SDS will also note what personal protective equipment (PPE) should be used to keep employees safe when using the chemical.

PERSONAL PROTECTIVE EQUIPMENT (PPE)

• PPE is worn to minimize exposure to hazards in the workplace.

• Job tasks must be evaluated to address any hazards present and to identify PPE that is to be worn to protect the employee.

Employees need to understand proper fit, maintenance, and use of PPE. • For seasonal positions consider things like safety glasses, goggles, gloves, hearing protection, proper footwear, high visibility vests or clothing, hats, sunscreen, bug repellent, etc.

• Address clothing restrictions/ requirements as well. Employees need to dress in a manner safe for the job they will perform. For example, loose jewelry, baggy clothing, and untied long hair could get caught in moving tools or machinery.

SLIPS, TRIPS AND FALLS

• Preventing slips, trips, and falls (from the same level, from heights, and from equipment) is an ongoing challenge in the workplace.

• Teaching employees to identify slip, trip and fall hazards so they can be eliminated is key to preventing these kinds of injuries.

• Considerations for reducing such injuries include proper footwear, awareness of surface conditions, using three points of contact when getting on or off equipment, housekeeping, and taking precautions when working at heights – on lifts, ladders, etc.

VEHICLE/EQUIPMENT AND SITE SAFETY

• Employees should be trained on safe operation before driving a work vehicle or using any piece of equipment.

• A walk-around inspection is important before every use of a work vehicle or equipment.

• Always using a seatbelt and never texting/taking phone calls when driving for work should be requirements.

• Keys should be removed from vehicles and equipment when not in use.

• Ensure that employees know what steps to take if they are in a vehicle accident.

• Consider work tasks such as operating a riding lawn mower, working in traffic - proper worksite signage; equipment tie-down and transport (hauling a mower form one place to another); etc.

• It is important for employees to have an awareness of harassment, bullying, and discrimination in the workplace. Employees need to be trained to understand both the laws and entity policies around these issues.

• Questions to be answered in such training include: • What might these issues look like in the workplace?

• Why are they unacceptable (or even illegal) at work?

• What should employees do if they believe they have been subjected to any of these behaviors?

• What are the potential consequences for an employee who engages in such behaviors?

OTHER

When planning safety training for seasonal workers, be sure to consider the tasks to be assigned and the environment in which they will work. Will lockout tagout procedures be a part of the job? Will they need to enter confined spaces or trenches? Might it be necessary to act in the event of inclement weather (lightening near a swimming pool or ball field)? If the answer to any of these questions is yes, the employee will need additional training specific to these activities.

DELIVERY

There is no single best way to provide safety training for seasonal employees. If time permits, meeting with employees individually can get the job done. Training groups of new employees can be very effective as questions asked by one new employee can inform the whole group. If meeting face to face or in a classroom setting is not an option, consider online safety training.

Members of the South Dakota Public Assurance Alliance and/or the SDML Workers Compensation Fund have free access to hundreds of online safety training titles.

Regardless of the method chosen to provide safety training, be sure to document each training event – training topic, date of training, trainer, attendee(s).

Belle Fourche Named Community of the Year

Andrew Nilges receives award for Excellence in Economic Development SIOUX FALLS, S.D. – The Governor’s Office of Economic Development (GOED) gave an official salute to a successful year of growth during its annual conference earlier this spring. During the event, Governor Kristi Noem announced two major award winners: Belle Fourche as the Community of the Year and Andrew Nilges as the recipient of the Excellence in Economic Development Award.

“South Dakota has shown America these past two years that the right decisions can have a big impact on a small state. In that time, we have led the nation in home construction growth per capita as well as personal income growth for individuals and families. We also rose to the top five in the nation in GDP growth,” said Governor Noem. “It was an honor

today to celebrate the individuals and communities who have been helping us raise the bar to build the strongest economy in America.”

The Community of the Year award honors a community that has made strides in economic development, added jobs, and invested in the quality of life for its residents. In the past year, Belle Fourche has expanded its rail park from 27 cars to 90 cars. They also successfully brought Albany Farms, a ramen noodle manufacturing company, into town from Los Angeles, California.

The company is filling an empty spot in its industrial park, with plans to hire 500 new workers. IDIC Specialty Drilling Chemicals LLC also opened its second operation in Belle Fourche and plans to hire approximately 40 employees.

The Excellence in Economic Development award recognizes an individual who has excelled in the economic development arena over the past year. North Sioux City has some amazing opportunities happening in their community, and Andrew Nilges has been instrumental in the success of these projects.

He has been a key leader in economic growth in North Sioux City, leading the community to create a vast new industrial park that will also include a significant expansion of workforce housing in the area.

He has worked alongside GOED on several business expansions in the past year and has strengthened the partnership between local, state, and federal agencies to further the economic development goals of his community. ■

Toolkit Assists Cities in Nature Access Goals A new toolkit provides cities with tangible ways they can achieve multiple city goals aligned with nature access, particularly for young children, ages 0-5.

The toolkit is published by the Cities Connecting Children to Nature (CCCN) initiative, a joint partnership between the National League of Cities and Children & Nature Network, and includes a wide range of resources - from peer-reviewed research to a state policy brief to various strategies that cities can take to incorporate nature into young children’s daily lives. It also provides city leaders with tools to implement citywide efforts to regularly connect young children to nature where they

live, play and learn, all with a focus on equity. CCCN gathered these resources via a national listening tour that looked at ways cities currently connect young children to nature.

Documents provide an overview of what it looks like to execute the pathway, steps for implementation, ideas for local partnerships, and examples from cities across the country that have implemented that particular pathway.

Reducing Vulnerability Between 85-90% of the beef processing in this country is done at just 30 plants – in fact, 12 plants do more than half of all the beef processing. Having such a large percentage of meat packing done at such a small number of plants is a vulnerability in our markets.

We’ve experienced many “black swan” events in the past couple years— from the Holcomb fire, COVID-19, and weather, among others. This market concentration poses a significant risk to food security in our nation. This can mean shortages at the grocery store, skyrocketing prices for meat, nowhere for producers to sell their cattle, and further complications with the supply chain.

In May, I participated in the House Agriculture Committee hearing entitled “Price Discrepancies, Transparency, and Alleged Unfair Practices in Cattle Markets.”

The hearing focused on market share and practices of the “Big Four” meat packers — Cargill, JBS, National Beef Packing Company, and Tyson.

We were joined by two panels. The first panel consisted of three producers who expressed frustrations with the current state of the meat packing industry. The second panel was made up of the CEOs of each of the Big Four meat

packers. We heard each panel talk about their role in the industry, where they think the problems lie, and what steps should be taken to improve cattle markets.

It was great to hear other Members and witnesses point to legislation I have introduced as solutions to address cattle markets. The Cattle Contract Library Act passed the House overwhelmingly in December 2021 and would increase price transparency for sellers. A lack of transparency is not good for the producer.

Increasing our transparency will decrease our market vulnerability. The Butcher Block Act would assist small meat processors who are looking to expand operations or add shackle space. It is imperative to diversify the meat and poultry industry to allow smaller, independent processors more of the market share.

While we have been lucky to have not experienced a black swan event in about a year, we cannot be naive that we won’t have another. We may not know what the event will be, but we need to take steps to decrease vulnerabilities in our food security and supply chain. I’ve been urging Members and leadership for months to get my legislation signed into law. These bills are not just going to benefit producers, but will benefit consumers, packers, and grocers. Increasing food security is not just in America’s best interests, but the world’s. ■

June elections – Follow the Municipal Election Calendar for all election deadlines.

Third Tuesday in June – A municipality may combine its election with a school district and hold the election on the third Tuesday in June.

(SDCL 9-13-1.1; See Hdbk., sec.

7.050) First meeting following election – Except as otherwise provided, every officer of the municipality will begin to discharge the duties of the office as soon as the officer has qualified by filing an oath or affirmation of office. The oath must be filed within ten days after the first meeting of the month following the election or appointment. (SDCL 9-14-5; See Hdbk., sec. 5.115) First meeting following election – Appointed municipal officials are usually appointed. The appointment may be annual, or for an interval determined by the governing body.

(SDCL 9-14-3) First meeting following election – In municipalities having the mayor and common council form of government, the council must elect a president and vice-president for the ensuing year. (SDCL 9-8-7; See Hdbk., sec. 2.520) First meeting following election – In municipalities governed by a

mayor and four commissioners, the board must designate by a majority vote, the following commissioners: Public Safety, Public Works, Utilities, and Finance and Revenue.

Commissioners are assigned areas of responsibility under the law.

(SDCL 9-9-18 to 9-9-24; See Hdbk., sec. 2.590) First meeting following election – In municipalities governed by a mayor and two commissioners, the board shall by a resolution adopted by a majority, at the first meeting following the annual election, assign and apportion between the members, all duties that are not assigned to the mayor. (SDCL 9-9-27; See Hdbk., sec. 2.595) First meeting following election – In those municipalities employing a city manager and under the commissioner form of government, at the first regular meeting in the month following the annual election, the commissioners must elect one of their members to serve as mayor for a term of one year. (SDCL 9-10-6; See Hdbk., sec. 2.615) Tax levy – The governing body of the municipality may impose an excess tax levy with an affirmative two-thirds vote of the governing body on or before July fifteenth of the year prior to the year the taxes are payable. The decision to increase taxes must be published within 10 days of the decision (certain publication size restrictions apply), and may be referred upon a petition signed by at least five percent of the registered voters in the municipality and filed within twenty days of

publication of the decision. The referendum election shall be held on or before October first preceding the year the taxes are payable. (SDCL 10-13-36; See Hdbk., sec. 12.170) June 19 – Juneteenth was declared a legal federal holiday in 2021.

By June 30 – Applications for renewal of licenses for the sale of malt beverages should be filed before the expiration of June 30.

11.465) No later than July 1 – Each municipal governing body shall provide to the Department of Public Safety, Division of Emergency Management, information that will enable emergency agencies to reach the members of the municipal governing board and the mayor at any time, day or night. The information necessary shall include home, business, and other personal telephone numbers including any facsimile transmission machines and cellular or mobile telephone numbers; home, business, and other personal addresses; employer’s name and telephone number; and home, business, and other personal email or internet addresses. In addition, each municipal governing body shall provide contact information for the municipal employees responsible for the following functions if the municipality employs a person in such a capacity: City administrator or city manager; Building inspection; Engineering; Electrical; Fire; Police and law enforcement; Public works; Streets and highways; Sewer and waste water; Water; Telephone; Utilities; Emergency services or civil defense; Coroner; and 911 coordinator. 12.255(6)) Boundary changes – Municipalities must notify the Department of Revenue of any resolution or amendment enacted which changes the boundaries of the municipality. Notification shall be in written form, shall contain a copy of the resolution or amendment, and may be sent by electronic means or registered mail. Municipalities shall also provide any changes and additions to streets and addresses. (SDCL 10-52-13; See Hdbk., sec. 14.172) ■
