Defending the industry with a bold move.

T

he SCRHA made a bold move last month in filing the necessary paperwork to proceed with its lawsuit against the County. An initial hearing has been set for June 21, however, SCRHA asked the County to agree to suspending enforcement of the ordinance until the injunction hearing. Sadly, the County did not agree so the SCRHA has filed for a temporary restraining order against the moratorium and ask the court to shorten the time for the injunction motion. Additionally, ACCE (a tenant’s rights group) - a strong proponent of the ordinance, filed to intervene in the case, meaning they will also be working to defend the law alongside the County.

This effort to defend the industry is estimated to cost us approximately $150,000. The initial suit is estimated to cost $40,000, and, if an appeal is necessary, it will likely cost another $40,000. We are also taking the fight public and raising $70,000 to support a strong and targeted Public Relations endeavor. We need to ensure the community knows the struggle of owners and managers and the risks laws like this pose to their safety and that of their residents and neighborhoods.

In the last few days alone, we have heard from owners about a tenant harassing and yelling at a neighbor, another constantly berating management who is doing their best to complete repairs in their unit, and a tenant who is running a prostitution business from their apartment. All cases in which the housing provider’s hands are tied because of the County’s eviction moratorium. We must educate homeowners, renters, elected officials and more on the unintended consequences of excessive regulation if we are to stop these kinds of risky proposals going forward. understands how this ordinance impacts the community.

Improving the member experience.

s vaccination efforts continue and California starts to emerge from mask mandates, limited capacities and social distancing, it’s important to remember the critical role that technology played in everyone’s life over the past year. Whether you finally embraced the convenience of Instacart while learning how to connect with colleagues and clients in a virtual space, there is no denying that the online experience became more important than ever.

As the need for online resources grew during the year, we found that our online membership experience needed an upgrade. With the launch of the Member Compass, you are now able to access your member benefits and account information with increased security and more convenient online payment options. While we can no longer accept credit card payments over the phone, the Member Compass allows you to pay online and save payment information for your convenience.

In order to get the most out of your member experience, you will need to create a new login.

Your previous username and password will not work on the new website, and we no longer use member account numbers. Each individual on your account will need to set up their account with their individual email address. The system will not allow you to create an account with a duplicate email address.

With your new login, you will be able to register for events, update your profile information, track event attendance, view and/or pay invoices. View your membership status, detailed information in the tabs on the left, and your upcoming events and open invoices front and center. You'll also be able to view news articles we've recently published about legislative issues. Note: if you are not registered for any upcoming events or do not have outstanding invoices, that corresponding information will not

display.

Any Logged user can see their Dashboard, which includes your membership status, personal profile information, event registrations (current and past), plus any orders and transactional history. You may see company information if your account is granted certain access permissions.

If you are the Primary Contact, Billing Contact, or have been granted Management Access for your Company, you will be able to update Company information. This includes adding staff or updating their contact information. You will not be able to edit the company's name. Contact SCRHA for assistance if your Company Name needs to be updated.

Things You Need to Know about Trauma Scene Cleanups

Trauma scene cleanup is a vague term that can cause some confusion about exactly what it entails. It's used to cover many situations that are not all traumas.

A biohazard remediation is the removal of anything that involves handling blood, bodily fluids, and other potentially infectious materials. They are not all the result of a violent crime, trauma, or death. The need for this service can be caused by many things such as; a fight, suicide, or by someone who cuts themselves and bleeds on a property you manage. I know nobody likes to talk about this, but someone defecating or urinating on your property can also be defined as a trauma scene cleanup.

Who you choose to clean up a biohazard can lead you and the property owner into a minefield of liability issues and health risks for your tenants, employees, and the public. Whoever does the remediation has to be very careful to protect themselves from biohazards during the cleanup process and to prevent spreading the pathogens. This type of remediation is usually outside the expertise of your in-house

maintenance staff or janitorial firm. There is just too much that can go wrong and a great deal of liability exposure. Hepatitis, HIV, and COVID-19 are very real diseases that one can be exposed to when cleaning up bodily fluids or biological matter. Many people mistakenly believe that if the mess is outside, it can just be mopped up or hosed off. However, water or bleach do NOT effectively remove the dangerous pathogens.

Here are some examples of how long pathogens can remain infectious: • MRSA can live for up to 7 months on surfaces • HIV can live for up to 6 days in blood • Hepatitis A can live for months in fluids How to choose a Trauma Scene / BioHazard company: 1. Make sure the company you hire is fully licensed and insured to provide Trauma Scene Cleanup, which can protect you from any potential liability.

2. Confirm the technicians are Trauma and Crime Scene Cleanup

certified by the IICRC (Institute of Inspection, Cleaning and Restoration Certification).

3. Ensure the company will fully comply with OSHA, State, and Local regulations.

4. Make sure odor removal is part of the service the company provides.

5. Always get at least a verbal quote before the company starts, so there are no surprises when you get the invoice.

Again, having your in-house maintenance staff or janitorial firms handle this type of issue at your property can present a large liability and health risk for their health and the health of your tenants if not done correctly.

Having an IICRC certified firm clean things up to make sure the area is safe for your employees and the public. Preparation is the key to success- Be proactive and have a plan in place with a reputable company so they can respond quickly and clean things up safely.

San Marcos City Council adopts new rules on Targeted Protests

While general protests remain allowed in residential neighborhoods, the ordinance prohibits protesters from protesting in front of a specific residential property requiring protesters to maintain a distance of at least 300 feet from the property. Protesters violating the ordinance could receive an infraction resulting in a fine. The ordinance takes effect within thirty days of its adoption.

At the May 11 hearing, representatives from several tenant groups and their supporters voiced opposition to the language saying it limits their First Amendment right to protest. Over the past several months, several tenant groups organized targeted protests in San Marcos in front of several rental properties and the mayor’s residence.

SCRHA members are encouraged to contact the Association if a targeted protest was organized at their rental property. Download our white paper, Responding to Protests for more information.

Council members that approved the ordinance change and its supporters say the ordinance was not in response to several recent protests, but to promote right to privacy, peaceful enjoyment, and maintain public health, safety, and welfare. The language is intended to prevent protests that harass and intimidate residents living on the property. The language does not restrict protests held in public places, but it does allow people and properties to maintain their safety and well-being. Advocates say cities such as San Diego have similar ordinances limiting targeted protests in place.

San Diego County Board of Supervisors approved a Land Use Transportation and study of a proposed fee on development last month. The fee would be assessed on new developments depending on the “vehicle miles traveled” (“VMT”) caused by the project.

Last month, San Marcos City Council voted 4-1 to approve new language amending the city’s ordinance regarding protests targeting specific residences in the city’s residential neighborhoods. The new language sets limits on protests and picketing in front of private residences.

Menifee holds Workshops on its Housing Element Update

City of Menifee, like many other cities and counties in California, is updating its Housing Element. SCRHA has been posting articles regarding California’s 6th Cycle of its Regional Housing Needs Assessment (RHNA), 2021-2029, in recent months. Earlier this year, the Southern California Association of Governments (SCAG) committed to collectively plan or build approximately 1.3 million new residential units between 2021-2029 cycle. SCAG approved and assigned each local government members, including Menifee, to accommodate a specific number of new homes.

California state law mandates all local governments to update their Housing Elements prior to each cycle. The update requires each local government to declare how many new homes they will accommodate for their residents based on Area Median Income (AMI) during the cycle. Cities and counties must submit their housing elements to the CA Department of Housing & Community Development (HCD) for review and final approval.

Housing-Element-Update. On Menifee’s Housing Element webpage, residents are asked to take surveys, view presentations, and submit their feedback to the city. Menifee City Council is expected to hold hearings on its Update this Summer, but no hearings were scheduled at the time this article was created.

Navy releases draft document that would add thousands of units to NAVWAR site

The U.S. Department of the Navy in May released a 730-page draft Environmental Impact Statement (EIS) proposing a revitalization of the 70-acre NAVWAR site located in San Diego’s Midway Community.

Currently known as the Naval Base Point Loma, Old Town Complex, it houses the Naval Information Warfare Systems Command and Naval Information Warfare Center Pacific divisions housing more than 6,000 personnel and contract employees.

Servicemembers and employees presently work in hangars constructed during World War Two to assemble bombers. The site potentially could bring thousands of housing units, commercial office and retail space, and hotels to the site.

station and mixed used project on the site. The Navy and SANDAG in 2020 considered a plan in which SANDAG will acquire the site from the Navy, but the transfer remains uncertain until SANDAG can identify the funding.

The EIS identified four potential alternatives for the NAVWAR site with the Navy determining the fourth plan as the most attractive. The fourth alternative could add 10,000 new residential units and a new modern facility to house the Navy’s Cyberwarfare Divisions. The Navy last month announced that it is searching for a developer to enter a partnership to revitalize the site. If a partnership is created, the developer would be responsible for building the project including building of 1.7 million square feet of Navy Cyberwarfare facilities within the first five years of construction.

The revitalization would dedicate 75 percent of the project area for 10,000 new apartments with 14,400 new parking spaces. 250,000 square feet would be reserved for retail commercial with another 1.35 million square feet would be reserved for office space with space to build two new hotels providing

an additional 450 rooms. The site would include a 140,000 square foot transit center with 500 additional parking spots for commuters. The total worth of all construction is estimated at $1.9 billion and could generate $154 million in local and state tax revenue annually.

However, the Draft EIS identified the fourth alternative project could create significant traffic, noise, and other environmental impacts to the Midway and adjacent communities. The project could add more than 70,000 daily automobile trip increasing traffic congestion to roads and freeways and create visual impacts to Point Loma, Old Town San Diego, and other communities.

The public has 60 days to review the EIS and submit comments between May 14 and July 13. The Navy has two virtual public workshops scheduled for June 8 and June 23. The public can review the NAVWAR revitalization project at NAVWAR-revitalization.com.

The Navy is expected to release its Final EIS report at the end of 2021.

Pool Safety and Maintenance Regulations (Title 22 CCR)

A White Paper from Southern California Rental Housing Association Effective January 1, 2015, public schools, condominiums and apartment complexes, and home owner associations must comply with new swimming pool safety and maintenance regulations under Title 22 of the California Code of Regulations. Only private pools are exempt from the new regulations which are defined as swimming pools for use by occupants of three or less residential units.

The regulations address pool chemistry requirements, such as disinfectant and pH levels, variation of flow rates, new incident response requirements, and new safety equipment requirements for pools exceeding a certain size and for pools with on-duty lifeguards.

Operating/Safety Equipment Requirements

• Variation of flow rate now must not fall below seventyfive percent (75%) of system’s requirements.

• Pools must meet requirements for rescue poles and life rings.

It is mandatory that all pools exceeding seventy-five feet (75’) in length and fifty feet (50’) in width have two (2) rescue poles and life rings at opposing sides of the pool at centralized locations.

• A Red Cross 10-Person Industrial First Aid Kit or equivalent1 • An operating telephone 1 • A backboard and head immobilizer1 If two or more lifeguards or pool users at a public pool report to the pool operator within 5 days that they have had diarrhea within five (5) days of each other, the pool operator is required to report it to the County’s Environmental

Health Department.1 The following information must be recorded and logged daily: • Water temperature for heated pools2 • Readings on equipment2 • Calibration2 • Corrective actions taken2 Chemical Requirements The concentration of free chlorine/bromine and pH levels must be recorded daily; the cyanuric acid level (if used in the swimming pools) must be recorded monthly. All records must be maintained for two years.

In addition to free chlorine/ bromine and pH levels, the following records must be kept.

incident involving fecal, vomit, blood contamination, drowning, or near-drowning incident. A record of the incident must be maintained in accordance with section 65523 as follows:

Use of the pool(s) is prohibited until the disinfection procedure has been completed.

4. The number of pool users in the public pool, amount of time between the most and last occurrence, how the incident was detected, and resolution of the incident.

The pool operator must remove all contaminating material and discharge the material directly to the sanitary sewer or other approved wastewater-disposal system in accordance with state or local regulations.

After the incident, the pool operator must immediately close the affected pool to all users. If the pool in question shares the

If that public pool water contains a chlorine stabilizer such as cyanuric acid, the pool operator shall lower the pH to 6.5 and raise the free-chlorine concentration in the public pool to 40 ppm and maintain that concentration for at least 30 hours.

If the pool was contaminated with blood, the pool operator shall check the free-chlorine concentration in the public pool at the time of the incident. If it is below the required minimum free-chlorine concentration, the swimming pool must be closed immediately until the required minimum free-chlorine concentration is achieved.

Signage for Community Swimming Pools A White Paper from Southern California Rental Housing Association

The California Building Code last updated in September 1, 2012 setting minimum standards for community or public swimming pools.

No Diving - Pools with water depths of 6 feet or less must have “No Diving” signage visually illustrating the dangers of diving.

No Use After Dark - For pools constructed where lighting was not required, signage must be posted stating “No Use of Pool Allowed After Dark.”

Keep Closed - Signage must be posted on exterior gates or entrances to pool area stating “Keep Closed.”

Diarrhea - Signage must be posted in area visible from the entrance to the pool stating that any persons having currently active diarrhea or who have had active diarrhea within the previous 14 days shall not be allowed to enter the pool water.

Emergencies - Signage must be posted with the emergency number 9-1-1 and the number for the nearest emergency services.

CPR - Illustrated diagrams with information on performing artificial respiration and CPR procedures must be posted.

Emergency Shut Off - Information must be posted near any Spa pool’s emergency shut off with a sign posted stating “Emergency Shut Off Switch.”

No Lifeguard - If a pool has no lifeguard service, a warning sign stating “Warning: No Lifeguard on Duty” must be posted and a sign that states, “Children Under the Age of 14 Shall Not Use Pool Without a Parent or Adult Guardian in Attendance.”

Spa Warning - A “Caution” sign must be posted near spas as well as signage stating: • Elderly persons, pregnant women, infants and those with health conditions requiring medical care should consult with a physician before entering the spa.

• Unsupervised use by children under the age of 14 is prohibited.

• Hot water immersion while under the influence of alcohol, narcotics, drugs or medicines may lead to serious consequences and is not recommended • Do not use alone.

• Long exposure may result in hyperthermia, nausea, dizziness or fainting.

Capacity - A sign shall indicate the maximum number of persons allowed for each swimming pool.

Flow - The direction of flow for the recirculation equipment shall be labeled clearly with directional symbols such as arrows on all piping in the equipment area.

I have a maintenance worker who was terminated and was given seven days to vacate his apartment. He has not left, and I would like to know if I need to send him through the eviction process or if there is anything else I can do to get him out.

There are no state laws requiring that interest be paid on the tenant’s security deposit. However, some rent control ordinances and/or other local ordinances do require interest to be paid.

Is it illegal for an owner to charge for his own labor (as long as it is the going rate for that type of work) and deduct that amount from the tenant’s security deposit?

A

It is not illegal to deduct for your own labor from the tenant’s security deposit. You can charge a reasonable hourly rate and must state the time and rate in your security deposit disposition statement.

There is a very loud tenant in the apartment building across the alley from our rental. I have asked them to quiet down on numerous occasions and have even called the police. They keep playing their music late at night and into the wee hours of the morning.

What else can we do?

In California, 30-days written notice is required to terminate a month-to-month tenancy and can be served by either party at any time during the tenancy. If the occupants have been in possession for one year or longer, the landlord must serve a 60-day notice.

If you have a clause in your lease which prohibits the assignment or sublet of your lease agreement, you do not have to consent to the roommate. You could ask the roommate to fill out an application to rent and thereby identify who the roommate is.

Once identified, you could choose to either (a) allow the roommate to live there if he meets your qualifications, and signs the lease or (b) start eviction procedures based upon the breach of the assignment and sublet clause of your lease.

California law does allow an owner or manager of rental property to serve a 3-day notice to quit the premises based upon the commission of an illegal act on the property. The illegal conduct must, however, relate to the rented property. For instance, if you can prove your tenant was dealing with or possessed illegal drugs on the premises, you could serve the 3-day notice. If the tenant failed to quit, an unlawful detainer action could be filed in court to recover possession.

One of our tenant's guests broke a window of the recreation room by throwing a ball through it. The host tenant claims he should not be responsible because the damage occurred outside the apartment and while they were playing catch in the common area. My tenant also refuses to give me the name or any information about his guest who caused the damage. What can I do?

My great grandfather died last year and left me his home. I am trying to rent the house and my realtor told me that I am required to inform prospective tenants of the death of my great grandfather because he died in the home. Is this really true?

A

In California, to avoid potential claims, residential landlords should disclose in writing all deaths occurring on the property in the previous 3 years.

I want to rent out our condominium (we are buying a new house) and I need to know how much I can charge for a security deposit. Can I also charge a cleaning, pet and key deposit?

A

California law limits the amount of a residential security deposit to twice the amount of the monthly rent if unfurnished, or three times the amount of the monthly rent if the property is furnished, an additional ½ month’s rent for a waterbed or other water-filled furniture. If the tenant is a military member, the maximums may be less.
