appy New Year! I hope you were able to celebrate the holidays happy and healthy with your loved ones - even if only virtually!

I am looking forward to serving our membership as 2021 SCRHA President – I want to hear from all of you, our valued members.

We are feeling a renewed sense of optimism and are ready for what should be a promising and successful 2021

My most important priority this year is listening. I want to know how the SCRHA can better serve you and what we can do to help you improve your investment whether you are a Housing Provider or a Product/Service Provider. If you have an idea or suggestion, address your email to me at info@ scrha.org.

My predecessor Kendra Bork talked about creating positive change and changing the image of the rental housing community because we are community, not an industry, of professionals that provide housing to the community at-large. I thank Kendra for her service as 2020 SCRHA President. To our Rental Property Owners and Rental Property Managers, let’s please intentionally start referring to ourselves as “Housing Providers,” and reject using the term “Landlord.” That term is not only obsolete, but it does not convey who we really are: we are providers of one of the most basic and essential services. We are not landlords; we are housing providers. Supplier members, you are providers as well. As Product and/or Service Providers, your products and services help housing providers assure quality homes to our residents. This year, we will continue expanding our community through more connections, increasing our level of engagement among ourselves and others, and creating new opportunities to learn. Just as important, we must provide leadership to advocate for the rental housing community, and we must offer leadership to business and civic groups.

What made you join the SCRHA -- was it because our education, networking, access to resources and operational advice, and/or the advocacy? I hope those are all reasons you became and will remain an SCRHA member. Please share with us what SCRHA is doing well and what we could improve. SCRHA needs your insight and input to remain proactive and responsive to your needs. Please send your emails to SCRHA with the email address I provided. I encourage all members to visit http://socalrha. org to see what SCRHA provides you. Begin 2021 by enrolling in a class or seminar, registering for an event or activity, reading the SCRHA’s weekly communications and monthly RentalAdvisor magazine OR by volunteering on a committee. You are investing in yourself being an active SCRHA member. Promote and protect the financial and mental well-being of each other by doing business with an SCRHA member. Let’s make 2021 a great year. Thank you for your membership.

elcome to 2021 and I hope everyone enjoyed their holidays. While I am personally relieved that last year finally is behind us, I know many of us are anxious to see what happens in 2021. But do not let uncertainty discourage you. The SCRHA is here to assist you. Are you up to date with the latest information concerning local and state laws affecting your property or workplace? Do you know the latest sexual harassment and compensation laws? Are you aware of AB 3088 and its noticing requirements? If you are not, you must visit the SCRHA website or contact us for the latest news. Every SCRHA member should take a moment to review their membership to check if they are utilizing everything available to them. Members that maximize their SCRHA membership will be better informed and prepared for unanticipated circumstances. Over the last quarter, the SCRHA has been working diligently behind the scenes to bring you some big improvements. We have been busy deploying new membership software, which A) helps us manage your accounts and services and B) is how you access them. Regarding B), when you log into the web portal, you are seeing the membership software. Some of you may have already noticed the new platform when you log in. It’s called Member Compass. This dashboard is where you can pay balances, see your account history, check out any events you are registered for or have attended, access rental forms and white papers, and manage your team member access.

As part of this software upgrade, our website will be enhanced too as the membership software and website are tied together. Many may not even notice the changes, but members will experience a cleaner and faster experience, and better mobile experiences too. We avoided moving items around to ensure continuity and a positive user experience. SCRHA members will have access to more services. Along with our Successful Solutions Health benefits program, we now have a pooled 401k program available to members with 5 or more employees. Our InfoLink Screening product is getting fresh new tools as well. Owners and property managers can have their tenants submit their rent payments electronically via our new partner PayRent. Members can sign up with Livable, San Diego Employers Association, InfoLink Resident Screening, BlueInk and Successful Solutions for their health insurance needs. Members also can access the National Apartment Association’s, NAA Open Door Savings Programs including Cintas, Home Depot, and Lowes. What are your professional goals for 2021? SCRHA classes will remain virtual until the pandemic is under control, but this is still an excellent opportunity to learn from the convenience and safety of your home or office. Check out the SCRHA calendar to view upcoming classes. SCRHA will continue to work tirelessly to ensure our services benefit all members. Call us at (858) 278-8070 or visit socalrha.org for more information. Thank you for your membership.

Public Safety Power Shutoffs (PSPS) and Wildfire Smoke Preparation Planning

By Madeleine Rebullida and Michelle Rosales, MPH, CIH, FACS Wildfire preparation plans are essential for helping staff at schools, hospitals, and other commercial buildings prepare for smoke intrusion and other complications that may arise from wildland fires, but they often fall short on covering something that can be just as critical: power outages. Last year’s fire season in California provided real-life examples of the tremendous impact an extended power loss can deliver to communities. A major takeaway was that power blackouts can occur as a precaution during heavy winds, even when there are no fires nearby and the threat doesn’t seem to exist. Many people and businesses were not adequately prepared for what happened when electricity from the public utility stopped flowing, even though there were advance warnings from the power companies. In this article, you’ll find lessons learned from last year’s wildfire season and tactics you can use

to get better prepared for next season. If your property isn’t in California, you’re not exempt from concern. This topic also matters to anyone responsible for the safety of building occupants in Oregon, Washington, and other areas of the country where wildfire is a threat. PG&E Intensified Fire Prevention Protocols Still reeling from the devastating financial consequences of the Camp Fire, Pacific Gas and Electric (PG&E) intensified the “deenergization” strategy termed Public Safety Power Shutoffs (PSPS) to prevent their equipment from sparking wildfires during high-risk periods, and other California utilities followed PG&E’s lead.

Effects of PSPS on Businesses in Affected Areas Estimates on how many California residents lost power as the result of a Public Safety Power Shutoff in 2019 (a relatively mild fire season) vary, but hundreds of thousands of homes and businesses were affected — not just once, but several times.

Those pre-planned power outages left millions of Californians without electricity, virtually immobilized the transportation grids in affected areas, and posed problems many wildfire preparation strategies weren’t prepared to handle.

This report from Grass Valley is similar to many others from around the state:

Worse yet, dealing with planned blackouts is something those in fire-prone areas should plan on getting used to, according to the CEO of PG&E. He told the state’s energy regulators the shutoffs will necessarily continue for at least another ten years. How did the shutoffs impact California communities?

The blackouts shuttered small businesses for days, leaving owners without revenue and employees with diminished paychecks. Thousands of residents

also lost water, while even more saw their internet and cell phone coverage evaporate. This communication collapse only made things worse as people scrambled to take care of isolated seniors and the sick and disabled who rely on power for their medical equipment. Some schools in the county reportedly lost nine days of class time. Many California residents blame PG&E for the problems. California public utility officials have opened a probe into the situation and suggested new guidelines to lessen the impact. Some have even suggested that the state should take over the operation of PG&E, but no quick and easy solution has been proposed, nor is it likely that one will soon be found.

taking proactive measures. Pacific Power and Light, for instance, recently posted an announcement on their website to advise their customers of PSPS possibilities: A Public Safety Power Shutoff is a new measure designed to help keep people and communities in high-risk areas safe, by proactively shutting off power during extreme and dangerous weather conditions that can result in catastrophic wildfires … As part of this effort, Pacific Power is working with local emergency services agencies, the Oregon Department of Forestry, and community leaders across Oregon, Washington and California to expand and enhance existing emergency response plans and work in coordination with our communities.

One thing is certain: When the fuel is dry and the power lines are energized, the possibility for another Camp Fire is present — and nobody wants to see that happen again.

Given that there’s little a building owner or facilities manager can do about the severity of the next fire season or the actions utility companies will take to keep their equipment from sparking another fire, how should wildfire protection plans

Utilities in other states are also

Common Concerns for PSPS

Preparation In a way, it’s not so much that a power outage is possible — standard checklists can help with that. It’s that power outages in wildfire high-risk areas can be expected. It’s no longer a matter of what to do IF you lose power, but what to do WHEN you lose power. That means you’ll need more supplies and better preparation. Examples of steps to take before a PSPS outage • Safety always comes first. Check your wildfire strategic plan to make sure the smoke intrusion and evacuation instructions are sufficient and up-to-date. • Prepare extra emergency supply kits. You may need to draw on the contents more than once, and it may be difficult or impossible to replace items after a series of PSPS events begin. • Make sure your facility has a sufficient number of back-up power generators. They are among the first items to sell out when power troubles begin. Train staff on how to maintain and use them. Make sure your wildfire preparation strategy includes a detailed plan on internal power generation and what it will be used for. • Determine which features in your building will be affected by a power outage (lights, elevators, etc.), then plan an alternative way to either operate the features manually, go without them, or circumvent their loss via another method. Examples are routing traffic to stairs (make sure you have proper signage) and installing emergency lighting in

strategic areas. • Check your stock of batteries and generator fuel. When PSPS blackouts increase, you’ll want to have enough on hand to last long enough to carry you through the times when replenishments are difficult or impossible to get. Examples of steps to take during a PSPS power outage • Continue your safety-first perspective. Make sure your employees and all building occupants are safe and know you are taking steps to deal with the situation. • Turn off all non-essential appliances and equipment, then check to ensure your generator system is working properly. Make sure surge protectors are in place as needed. • Keep advised on local weather forecasts and power company customer updates to help inform your decisions about next actions and how your business or building will be impacted. • Continue to monitor indoor environmental quality. Confirm the operational condition of the air filtering system in your building. Make backup plans for ventilation and cooling. •Step up security to match the situation. With security systems and/or communication lines compromised, security concerns increase. That’s not an extensive list, because there is no one-size-fitsall set of steps that will work for all buildings and all businesses. Concerns like water purification,

cooling tower (CTI) procedures, and the threat of mudslides will apply to some, but not for others. There are many variables that must be taken into account.

Once wildfire emergencies are underway, the resources, supplies, and equipment you need will be harder to obtain and may not be available at all.

If you’re convinced the threat is real, get started NOW with a review of your current wildfire preparation and comprehensive emergency preparedness plans. Make sure your strategies recognize and address the very real possibility of recurrent PSPS power blackouts when conditions warrant.

Wildfire season won’t wait, and you shouldn’t either.

How to Get Help With Your Wildfire Preparation Planning Pre-planning is critical. Don’t put it off until fire season is underway and power outages are looming. Some things are too important for hesitation, this is one of them. Reduce stress, get well-prepared, and avoid many of the headaches suffered by those who fail to plan: • If you already have a wildfire preparation plan in place, review and update that plan as needed. You can also get assistance with educating staff on how to carry out your strategy effectively and efficiently. • If you’ve yet to develop a wildfire preparation plan, consult an expert to guide you through the process by providing templates, advice, and as much hands-on help as you need. Remember, don’t assume you’re exempt from concern just because your facility isn’t located in California. If wildfire is a threat, get prepared. The best advice anyone can offer on the topic of emergency preparedness is to get ready now.

Years ago, young and both working, we tried to live on one working income. Soon we could afford living in our duplex, renting the other half. The rental duplex then brought us to a small home for our new family. The rents were aiding us as Mom now was not working. Next, a larger home was bought -- now for four children. The rents from the duplex and small home later paid for four college educations after Mom returned to work Now elderly and retired, we have sold the larger home and moved back to the smaller one, using those added funds, plus duplex rents, to live on. Now you can see why rental ownership is important to us. SCRHA Independent Owner Members, 2020

Hemet scraping its Crime-Free Housing Under Hemet’s Crime-Free Rental Housing Ordinance, rental property owners were required programs in light of HUD allegations The City of Hemet eliminated several housing programs in agreement with the U.S. Department of Housing and Housing Development (HUD) to settle accusation that the programs in question discriminated and violated property owner and residents’ civil rights. In its Voluntary Compliance Agreement with HUD announced in December, Hemet dismantled its housing programs and created a fund to assist low- and moderate-income residents and in exchange HUD will not take legal action against the city going forward.

In October 2013, Hemet established three housing programs: 1) Rental Registration, 2) Crime-Free Rental Housing, and 3) Abatement of Chronic Nuisance programs which were designed to deter crime and code safety violations. HUD’s Office of Fair Housing and Equal Opportunity (FHEO) began reviewing housing programs of Hemet programs for violating the Civil Rights Act of 1964. The FHEO determined Hemet’s housing programs, while using $1 million federal Community Development Block Grants (CDBG) funding, were discriminatory and violated the civil rights of both property owners and tenants.

to submit a Crime Free Certification and pay fees to the city. Property owners were required to include the City's Crime Free Lease Addendum to their rental agreements and tenants were required to sign the document. Property owners were required to attend crime-free training and properties must undergo initial and annual code inspections. A property could face fines and penalties if it triggered 5 or more calls to law enforcement annually or cited for housing code violations. Rental properties also were mandated to evict residents for a single criminal act and the programs did not allow for safeguards in situations concerning domestic violence victims or disabled persons. At the same, the policies in Hemet’s housing programs discriminated and violated the civil right of tenants and of applicants who were denied equal treatment to housing. Hemet must cease the three programs in 90 days from the signing of the agreement. Hemet must send written notices to all affected owners and residents that they are no longer subject to the programs’ rules and post public notices stating the programs have ceased. Ahead of the agreement with HUD, Hemet City Council voted to repeal its Crime-Free Housing Ordinance that started the programs in January 2021 socalrha.org | 11

October 2020. City also agreed to establish a $200,000 fund to help remediate code violations and improve living conditions for low- and moderate-income households. HUD will not initiate any further action against the city in accordance with the agreement. Hemet is among dozens of California cities and counties to face similar scrutiny for instituting housing programs deemed unlawful by HUD in the last few years. Many local governments have repealed their Crime-Free ordinances to avoid legal action, but some cities are facing legal action. In 2019, HUD charged the City of Hesperia for discrimination and presently facing several lawsuits from the federal government and ACLU.

Del Mar Residents gather signatures to protest City’s Up-zoning Policy

A group of Del Mar residents have submitted signatures to protest and block a recent Del Mar City Council vote updating the city’s Housing Element. The Housing Element included a policy to up-zone several commercial properties in the Northern area of the city potentially for multifamily housing. The group submitted the signatures in November to force the City Council to rescind its decision or take to a public vote before city residents. The group acquired 602 signatures, well above the 342 signatures needed to force a referendum.

In October, the Del Mar City Council voted to update the city’s Housing Element in adherence to California’s Regional Housing Needs Assessment mandate. Included in the element’s approval, the council voted 3-2 to up-zone several parcels located in the northern area of the city. While the parcels remain for commercial use only, the up-zone would allow potentially for multifamily residential development up to 20 unit per acre. Earlier this year, Del Mar agreed with the CA Department of Housing and Community Development (HCD) recommendation that it up-zone the properties for housing in the future. However, the city council’s action never actually changed the parcels’ zoning to allow for residential use. The group contends the council’s action to up-zone the land for multifamily housing is inconsistent and invalid with city’s General Plan and state law. City council members who voted for the up-zoning said it was necessary to keep Del Mar compliant with the state’s 6th cycle of the Regional Housing Needs Assessment (RHNA). All local governments must adopt their Housing Elements by April 2021. State mandated RHNA requires all California cities and counties plan and build a certain percentage of units for low, lower, and moderate-income residents. Del Mar will be responsible to plan and build 175 new units during the RHNA, 2021-2029, 6th cycle; 113 of the 175 units must be designated for rent-subsidized affordable homes. If Del Mar does not up-zone the properties, it risks violating state law and could be subject to legal action from the state and private interests. Del Mar agreed to plan and build a total of 76 units during the previous RHNA, 2013-2021, 5th cycle, but none of the 35 units that were built were for low- and lower-income residents.

Del Mar City Clerk has the task of validating the signatures submitted by the group. If the Clerk determines there are at least 342 valid signatures, the Del Mar City Council must schedule a hearing either to vote to rescind its October 5, 2020 decision or call for a public vote to city residents

to decide. The group’s attorney says it is considering legal action against the city. It is likely Del Mar will face legal action from the state or private entities should the city council or residents vote to rescind the up-zone action, or the city fail to approve its Housing Element by April 2021. https://thecoastnews.com/opponents-of-del-mar-rezoning-will-get-referendum/

Jennifer Campbell becomes new San Diego City Council President, appoints new Council Committee Chairs

San Diego City Council appointed Council Member, District 2, Jennifer Campbell to serve as the City Council’s 2021 Council President. Campbell on a 5-4 vote won over Council Member District 4 Monica Montgomery Steppe. San Diego City Council Presidents hold considerable power in determining the full city council’s agenda for the year among their other powers. Among her first actions as Council President, Campbell made her chair appointments for the city council committees. The Chair of each City Council Committee also determines that committee’s agenda for the year. The council committees cover specific policy areas reviewing and voting on proposed policies and ordinances before going to the full city council for final consideration. Council Member John Whitburn will be the Council President Pro Tem and Chair of the Land Use and Housing Committee. Council Members Marni Von Wilpert will the chair the Active Transportation & Infrastructure Committee and Raul Campillo will chair the Economic Development Committee. Council Members Montgomery Steppe will serve as Chair of the Public Safety Committee and Sean-Elo Rivera will chair the Environment Committee. Council Member Vivian Moreno will chair the Audit Committee and Council Member Chris Cate will chair the Budget Committee. Although Council Member Joe LaCava was not appointed to chair any council committees this year, he will act as Vice-Chair of the Audit and Active Transportation and Infrastructure Council Committees. SCRHA members can visit each Council Committee on the City of San Diego’s webpage at www. sandiego.gov/council-committees to see council

committees’ roster, dockets, and legislative actions. Council President Campbell act as chair of the Rules Committee As for regional appointments, Council President Campbell with Mayor Todd Gloria will represent San Diego on the San Diego Association of Government’s (SANDAG) Board of Directors. Mayor Todd Gloria, and Council Members Montgomery Steppe, EloRivera and Moreno will serve on the Metropolitan Transportation Authority (MTA). https://www.sandiegouniontribune.com/ news/politics/story/2020-12-15/campbell-tapsmontgomery-steppe-for-san-diego-public-safetypanel-a-move-that-could-quell-divisions

Temecula’s Harveston Specific Plan amended to include Residential Uses

Last month, the Temecula City Council voted unanimously to amend the city’s Harveston Specific Plan. The change adds a new “residential overlay” to approximately 88 acres of land located in Area 12 of the Harveston Specific Plan. The land was previously designated for commercial use only prior to the City Council’s decision; Area 12 is located near Date Street, Ynez Road and Temecula Center Drive south the Murrieta-Temecula city limit east of Interstate 15. The Harveston Specific Plan was originally approved in August 2003 designating the 88 acres specifically for commercial use. A developer interested in developing the sites filed a General Plan Amendment (GPA) in May 2018 requesting the city amend the Specific Plan by adding the residential overlay in Area 12. City approval would allow for the development of as many 1,000 new multifamily residential units in that area. The General Plan Amendment was reviewed and approved several ad hoc city committees and approved by the city’s Planning Commission in November 2020. The overlay includes architectural and design standards specific for multifamily housing; the overlay does not mandate if the units will for-sale or rentals. In initial analysis of adding the overlay, the city could lose up to $374,000 in revenue annually if the land January 2021 socalrha.org | 13

was dedicated only for residential use; however, the city could gain approximately $5 million in revenue annually if a mix of commercial and residential projects on the sites. On December 1, the Temecula City Council endorsed the Plan Amendment and accompanying CEQA documents. No specific projects have been proposed for the sites, but the addition of 1,000 new units would significantly boost Temecula’s chances of achieving its commitment to build 4,183 new homes during Regional Housing Needs Assessment (RHNA), 2021-2029, 6th cycle.

I've Been Sued!

© Yee Xin Tan | Dreamstime.com

By Norman Cullen, Independent Owner Before COVID-19, many of the worst notifications that you could receive as an apartment owner could be a fire at the apartment, someone’s been hurt or passed away, or you’ve been served with a summons to appear in court. As an independent owner, and having just gone through a Small Claims Court Trial, here are the steps that I took to prepare for the trial. I’m not an attorney, and this neither is legal advice nor purported to be a complete list of everything that can be done, but it may contain some useful information for when your time comes up. My first line of defense started before I had even met my tenant and during the initial rental process: 1. Photos were taken of the empty apartment for advertising and proof of condition. 2. The SCRHA Move-In/Move-Out form was filled out completely and signed by the tenant(s) when they moved in. 3. A picture of the tenant’s Driver’s license/ID was taken showing what they looked like. 4. A picture of the tenant’s car was taken showing the license number. 5. A picture of the check/ ledger entry showing how the deposit was paid and who paid it. During the tenancy and upon eviction or obtaining possession of the unit, pictures were taken of

all rooms, appliances, windows, and any other items that may have been damaged by the tenant. The original Move-In/Move Out form was filled out showing the condition of the unit at the end of the tenancy. Within 21 days of obtaining possession of the unit (This may be longer than 21 calendar days if the unit was left with bed bugs or other health issues), but to be safe send an estimated letter before the 21-day period. Send the SCRHA form “Itemization of Security Deposit” with either the Estimated or Final Accounting Box checked, to the tenant’s last known address by First Class mail and obtain a USPS “certificate of Mailing” stamped receipt ($1.50). In addition, mail a copy to the owner/manager which is kept unopened in the tenant’s file. THE COURT DOCUMENTS Detailed instructions are given in your summons to appear and on the website that you are directed to. 1. TIME IS OF THE ESSENCE – All of your Exhibits must be served on the plaintiff (this is where the picture of the tenant and their car info may be handy if you have someone serve the plaintiff) AND UPLOADED to the proper court website at least 10 court days before your trial date, otherwise they may not be admissible at your hearing.

2. All of your documents and pictures must be scanned and individually labeled per page with the required court case names, etc. and put into ONE file to upload to the proper court website. 3. To facilitate the proper spacing and size – scan all of your documents and pictures as JPEG files. This will allow you to resize the “picture” so that each will fit on one page with the required information –names, Case number and Exhibit 1, 2, at the top of each page. It may be advisable to talk with an attorney about your case, however during your actual hearing no persons other than yourself are allowed in the room as they might be called as witnesses. Your trial will be held in a Microsoft Teams meeting (similar to Zoom). If you are using a desktop computer, and don’t have a camera, this would be a good time to purchase one as you may have to produce evidence to the judge during your hearing by putting it in front of your camera. Preparation and documentation will be your friends, and a lack of these may be your downfall. The author, Norman Cullen has been an independent owner member of the Association since October 1977. UPDATED OPERATIONAL ADVICE SYSTEM We are experiencing a high number of calls requesting Operational Advice. Due to the high volume of calls, we will be instituting a new voice message system to better handle the demand. Please call (858) 751-2201 for Operational Advice and leave a detailed voice message. The new system will help ensure the first-come first-served policy associated with operational calls, allowing for prompter service. Counselors will do their best to reach you within 48 business hours during regular office hours Monday-Friday, except holidays. They will attempt to reach you twice. In case they need to leave you a message, please be sure your voicemail box is set up and is not full. On occasion we will be working with some of our top attorney members to assist with the higherthan-normal call volume. They will identify themselves and let you know they are responding on our behalf at no charge to you. Finally, receiving operational advice is an exclusive benefit available only to SCRHA members. As a result, we cannot provide advice for anyone other than the caller. Please do not call with questions on behalf of family or friends. We encourage you to refer those who have operational questions to contact us directly regarding membership so they can also take advantage of this member benefit. We very much appreciate your support as we deploy this new system.

My husband and I had San Diego rentals for 35 years. He did all maintenance on weekends. I took care of tenants and vacancies. I especially looked out for single moms with children to have a safe home environment. Suddenly my spouse was let go by a huge company downsizing. Age 55! We had planned ahead. Rental income property was a major part of our plan. SCRHA Independent Owner Member, 2020 50 | Southern California Rental Housing Association Rental Advisor January 2021
