• This compares to the same period in 2017 where there were 230 closed sales transactions ranging in price from $157,000 to $1,450,000 for $127,671,042 in total sales volume.

There are two takeaways…First, the price per square foot continues to slowly (and safely) rise at 5%. Second, the lack of inventory continues to hold sales volume down.

Looking for Board Members – Is that you?

In community associations, each board member is considered a fiduciary and is bound to act in the best interests of all residents.

In general terms, fiduciary duty is the highest standard of care imposed under law, and it occurs when one or more persons are responsible for the money or property of another. The fiduciary is expected to be honest, free from fraud and faithful to his or her obligations.

The mere mention of fiduciary responsibility may scare some homeowners away from board service, but it shouldn’t. Managing the association’s finances is one of the board’s most important duties, but it doesn’t have to be complicated.

Fiduciary duty means protecting assets, budgeting responsibly, planning for the future, investing wisely and observing laws and regulations that affect association resources. Fiduciary duty requires the board to ensure that the assessments you pay are used properly to maintain the community and cover insurance, contracted services, utilities and other needed materials and services.

The board is obligated to make ethical and legal decisions that best serve the entire association.

Do you have what it takes to be a good board member?

Chances are- you do.

If you have a mix of some of the following traits and skills, consider running for a seat on the board. We’d love to have you.

Plus, it’s a great opportunity to become more familiar with your community, grow your relationships with neighbors and our staff, and experience everything offered at Scottsdale Ranch!

Respect If you can give others respect and expect it in return, you can help keep board discussions civil, productive and on point. We’re looking for people who can lead by consensus, not by command.

Good listening People want to be heard. Can you listen to board members and residents with sincere interest? You may have a few ideas of your own, but everyone benefits by sharing and discussing.

Agenda aside Members who come to the board looking to help only themselves are a problem. A board is more productive when members don’t have a personal punch list. Are you able to look after the community, not just your own interests? Are you willing to compromise?

Skill An association is a business. So having board members with accounting, organizational behavior and teambuilding backgrounds can help. Someone with a financial background, for example, might make for a good treasurer.

The ideal board comprises a mix of management styles, professional skills and temperaments. If you know people with some of these traits or relevant skills, ask them if they’d be interested in joining the board. Some people don’t think about running for a seat unless asked.

You don’t have to know everything when you join, but you should be familiar with the governing documents and the responsibilities of the job. Fellow board members and association staff members can help you with the transition and train you on board responsibilities, current work, projects and hot issues.

Leaders can come from different places and backgrounds. There’s no one mode that fits all. Share your knowledge and passion with our community.

There will be four open positions for the SRCA Board of Directors’ election in April 2019. If you have the time and desire to contribute, we encourage you to apply. We are looking for passionate residents who have it in their heart to volunteer their time for the betterment of Scottsdale Ranch. Board applications can be found on our website homepage at www.scottsdaleranch.org or in our office. Board applications are due no later than Thursday, January 31, 2019 by 5:00 p.m. Candidates will be voted on by the membership and announced at the SRCA Annual Meeting which will be held on Thursday, April 18, 2019 at 7:00 p.m. at the SRCA Community Center. President’s Message

Who Do They Think They Are? Members of our community association board have a big responsibility, and they have the legal authority to carry out their roles. Where do they get this authority?

First, most states have statutes—such as a condominium act or homeowner association act—that legally empower elected volunteer community association boards to act on behalf of all owners collectively. Also, our association is subject to the state’s nonprofit corporation code, which confers on the board the authority to act on the corporation’s behalf.

Second, the association’s governing documents—such as the declaration; bylaws; and covenants, conditions and restrictions—which are recognized by the state as binding documents, bestow legal authority on the board and define the scope of that authority. On the f lip side, however, the same statutes and documents that give boards legal authority to levy assessments and make rules, also create an obligation for elected board members to act responsibly.

What’s So Great about Community Associations?

Community associations offer one of the best opportunities for Americans to own their own homes. They are for the 21st century what land grants were in the 19th century, and what the New Deal and GI Bill were in the 20th. Why? Collective Management Protects Value Americans have accepted, for the most part, the collective management structure of community association living. Covenants and rules are no longer a new concept to most of us: renters are used to lease agreements with restrictions; single-family, detached-home owners are used to zoning ordinances and building codes. The difference is that in traditional, singlefamily housing, restrictions are administered by public bodies rather than by private boards.

Most Americans have accepted private governance because they understand that collective management and architectural controls protect and enhance the value of their homes.

Privatizing Public Service Allows Growth Wherever a new community is built, local infrastructures are

stretched. School populations, snow removal, storm water management, road maintenance, utilities, traffic, everything increases leaving the local jurisdiction unable to support new community development. Yet housing is sorely needed.

Therefore, local jurisdictions often require community associations to assume many responsibilities that traditionally belonged to local and state government.

This privatization of public services has allowed local jurisdictions to continue developing needed housing without increasing local taxes. Instead, the developer must build the infrastructure and create an association to maintain it after it’s developed.

Community Associations Make Owning a Home Affordable Almost from their inception in the 1960s, condominiums have provided housing for low-to-moderate income Americans. In fact, in some areas, builders are required to include a certain percentage of affordable homes in new developments.

Also, converting rental apartments and commercial buildings into condominiums not only revitalizes many decaying neighborhoods, it’s also made ownership more affordable for those wanting to live in urban centers.

Community associations have made home ownership possible for millions of Americans partly because 21st century families tend to be smaller, the number of single-parent homes has increased, and more retirees are staying in their homes after retirement.

Community Associations Minimize Social Costs Community associations also minimize social costs. Because they have mandatory covenants that require certain obligations from homeowners and the association, associations ensure that all who benefit pay their share and everyone is equally responsible. Community associations have sufficient enforcement authority that local government is seldom, if ever, needed to resolve assessment disputes. Many associations use alternative dispute resolution because it’s a faster and cheaper way to solve problems than legal action.

Community Associations Make the Market Efficient Many community associations—especially condominiums— have greatly reduced urban sprawl. Because of their collective management and protective covenants, they are precisely what the Housing Act of 1949 intended when it called for “decent home(s) and suitable living environments.” Community associations, as alternatives to traditional single-family homes, are shining examples of free-market efficiency. The factors that make community associations great places to live are easily ignored or misunderstood. Critics prefer to look at a few sensational issues instead of the whole picture. But for many community associations are affordable, enjoyable, efficient places to live.

2018 Annual Assessment Due January 1st

It’s getting to be that time of year! All residents of Scottsdale Ranch will receive an invoice in mid-December as a reminder that the SRCA annual assessment of $375.00 per unit will be due January 1st.

If your address has changed or you would like your invoice sent to a different address, please contact SRCA staff member, Ricki Stamos at (480) 860-2022, or by email at rstamos@scottsdaleranch.org to update the information we have on file as the assessment payments are due January 1, 2019, whether you have received an invoice or not. Please note that any assessments deemed delinquent will be subject to a 10% late fee and will accrue interest at a rate of 12% per annum.

There are a few different ways you can make your payment as we have tried to make paying the annual assessment as convenient as possible for our residents.

The quickest and the preferred method is to mail your payment check to the lock box address located at the bottom of the invoice that will be sent out in December (please make sure to write your account number on the check) or you can visit our bank’s website at https://www.mutualpaypropertypay.com/ where you can pay using an eCheck (no charge) or credit card (fee). You must have your invoice available if you choose to use this method to ensure that your payment is credited to the correct property.

Alternately, you can sign up for our convenient ACH service of an automatic debit from your checking or savings account. The preauthorized electronic assessment payment form is available on our website at www.scottsdaleranch.org under Resident Resources. You can also stop by our administrative office to complete the form in person or you can request one be sent to you via email by emailing your request to rstamos@scottsdaleranch. org. A voided check is needed to complete this process and our office must receive the completed form no later than December 21, 2018 in order to process the 2019 assessment in January.

We thank you in advance for paying your annual dues promptly and for avoiding any additional charges. We are looking forward to an even better year ahead in 2019!

I would like to take the opportunity first to introduce myself. I am Brian Munson, current treasurer and chair of the Finance Committee and Board Member. This is my second “tour of duty” with the Ranch Board of Directors. I served as a Director, Treasurer, Vice President, and President several years ago. It is my pleasure to be serving once again.

I am happy to report that the Ranch finances are in very good shape on several accounts and we are committed to operate accordingly through this next year. We have been busy and have had some interesting challenges over the past six months.

Our committee was presented with the results from a 2017 audit in February of this year by Butler and Associates who reported that SRCA had a good system of financial controls in place and remains in sound financial condition. In June of this year, we met with a third-party insurance analyst who recommended that we stay with our current coverage into the next year. The SRCA Finance Committee conducts such a review on an annual basis and makes recommendations to the board on how to proceed. In August of this year, the committee reviewed a proposed budget for FY 2019. The committee approved the budget which was then passed on to the Board of Directors for final adoption and was approved. Only minor adjustments were necessary and there is no increase in the 2019 annual assessments.

Scottsdale Ranch and individual properties have experienced a great deal of damage due to storms over the past few months.

This has stressed our landscape budget to an extent and Ranch management is addressing much of the damage through insurance claims.

As of September 2018, according to recent financial reports, the Association remains in very good overall financial condition.

Board Adopts Policy Regarding Improper Treatment of Residents, Employees and Contractors The SRCA Board of Directors wishes to ensure that Scottsdale Ranch is maintained as an environment free of harassment and that all Members and Residents of the Association maintain a high standard of ethical conduct while residing within Scottsdale Ranch. At its October board meeting, the following anti-harassment policy, standards and behavior, ethical rules, and enforcement procedures was adopted. This policy is applicable to all Members and Residents of the Association: It is the policy of the Association to create and maintain an environment free from all forms of discrimination and conduct that can be considered harassing, coercive, or disruptive, including sexual harassment. Sexual harassment is defined as unwanted sexual advances, or visual, verbal, or physical conduct of a sexual nature. The Association will not tolerate hostility or favoritism toward an individual based on race, color, creed, sex, national origin or age. Furthermore, actions, words, jokes, or comments based on an individual’s sex, race, color, national origin, age, religion, disability, or any legally protected characteristic will not be tolerated. The Association will not condone such behavior by or from any Member, Resident, guest, or invitee (collectively “Persons”).

• All Person shall refrain from harassing other Persons, directors of the Board, Association committee members, or management staff. Persons shall not in any way harass, threaten, or otherwise attempt to intimidate any other Persons, director of the Board, Association committee members, or management staff. All Persons shall refrain from any inappropriate or unwanted touching of other Persons, directors of the Board, Association committee members, or management staff. The Association shall deem any Person who harasses, threatens or otherwise attempts to intimidate, or touches inappropriately or without consent, other Persons, directors of the Board, Association committee members, or management staff, to be in violation of this resolution.

• All Persons must conduct themselves in a civil and courteous manner at all times and must not jeopardize or interfere with the rights and privileges of others. Conduct is considered uncivil or uncourteous if a person is visibly intoxicated, or engages in rudeness, personal attacks, insults, name-calling, or uses derogatory language towards another, or engages in aggressive behavior towards another, or engages in behavior that tends to cause embarrassment or discomfort to others.

• Loud, profane, indecent or abusive language is prohibited.

• All Persons shall refrain from interfering with the duties of directors of the Board, Association committee members, management staff and contractors. No Person shall interfere with the duties of the management staff or any contractor executing a contract in process. All communications with

contractors must go through the President of the Board or management, or must otherwise be in accordance with Board policy.

• All Persons shall show respect to fellow Persons, directors of the Board, Association committee members, and management staff.

• Persons shall report any inappropriate and discourteous conduct, or conduct believed to be in violation of this Policy, to the appropriate management staff.

• All Members shall be responsible for the conduct of their Residents, family members, guests and invitees while within Scottsdale Ranch. Members shall be responsible for ensuring that their Residents, family members, guests and invitees comply with this Policy and all documents governing the Association.

Violations of Policy Any Member or Resident who is found to be in violation of this policy will be subject to appropriate remedial action. Such remedial action shall include all remedies available at law or in equity, and may include, but not be limited to, injunctive relief being sought against him/her, fines, requiring all further communications from the Member or Resident to be in writing, and suspension of membership privileges. Such remedial action shall be at the sole discretion of the Board of Directors.

According to Article XII, Section 2 of the Declaration, the cost of enforcing this policy, whether or not suit is filed, including but not limited to, reasonable attorneys fees, court costs, out of pocket expenses, costs of investigation, and other expenses related to the enforcement, together with interest thereon from the date the costs are expended, constitute a lien on the Lot owned by the Member against whom action is taken, and shall also be the personal obligation of the Member.

Hi everyone! It is already my 5th month as your new Architectural Liaison and I am loving my time here at Scottsdale Ranch Community Association! If I haven’t had a chance to meet you, feel free to stop by and say hello.

Painting is in the air! As more of our SRCA residents are returning to the ranch for winter, there have been a lot of architectural application submittals for paint approval for a face lift. As part of our service for our homeowners, we are compiling a list of compatible colors from Sherwin Williams to give you additional options while shopping for paint. This is all in an attempt to provide our homeowners with more choices. There are color books available in our office for both Dunn Edwards and Sherwin Williams as well as information available on our website at www.scottsdaleranch.org.

The rules for painting have not changed. When looking at the selection of color palettes to choose from, it is important to remember the rules.

1. Always stay within your palette for all colors on your home.

Upcoming Weeks of Brush Collection: December 3rd. January TBD. The earliest items can be placed out is the Wednesday prior to the week of pickup and must be placed out no later than 5:00 am on Monday the week of the scheduled pick up. Residents, please be considerate of your neighbors - do not put your items out before the designated dates. Please be patient as the City has all week to pick-up in our area.

NOTICES FROM THE CITY OF SCOTTSDALE: Please separate your brush and bulk pickup into two piles – one for green waste and one for everything else. The piles will be picked up by separate trucks during your designated brush and bulk pickup week. *Please refrain from placing trash containers or bulk trash where it blocks the sidewalk and would prevent pedestrians or wheelchair bound residents from passing along the sidewalk.

Scottsdale Ranch FAQ & Answers I trust everyone had a wonderful Thanksgiving and are gearing up for all the December holiday festivities. With a lot of our winter residents back in town, I thought it would be a good time to answer some of our most frequently asked association questions. Please remember if you live in a sub-association, your community documents may be more restrictive.

1. Can I have a garage sale anytime I want? Where can I place signs?

ANSWER: Residents can have individual sales outside of the community wide sales that are held twice a year. They may only place one sign on their own property the day of the sale.

No other signs are permitted.

2. Can I park in the street?

ANSWER: Before any vehicles may be parked on the street, all parking spaces on the Lot located within an Owner’s garage and on an Owner’s, driveway must be used for parking vehicles. In other words, if an Owner has a two-car garage and a two-car driveway, two vehicles must be parked in the garage and two vehicles must be parked in the driveway before any vehicles may be parked on the street.

3. Can I have a dumpster or Port-a-Potty?

ANSWER: Trash dumpsters used during construction may be placed only on the Owner’s Lot or Parcel and shall not be permitted to block any sidewalk or street and shall not remain on the Owner’s Lot or Parcel for a period not to exceed ninety (90) days unless otherwise approved by the Architectural Committee. The Owner must obtain the prior approval of the Architectural Committee before placing any dumpster on a Lot or Parcel.”

Trash dumpsters used during construction shall be no less than 5’ in height and steel sided. No soft-sided dumpster containers or wooden crates are allowed. The Owner must obtain the prior approval of the Architectural Committee before placing any dumpster on a Lot or Parcel.

Chapter II, Section 6 of the Maricopa County Environmental Health Code states: “No person shall initiate or proceed with construction, erection, alteration, repair, or razing project without first having provided an adequate number of suitable sanitary job toilet facilities for the use of persons on the project in a ratio of at least one toilet per 20 persons. Such toilets shall be of the water-f lushed or chemical type approved by the department and located on or within 200 feet of each work area within the project site.”

No toilet shall be installed within 20 feet of an occupied premise or within 10 feet of any public thoroughfare or sidewalk, unless authorized by the Solid Waste Program.

4. We just bought a home and will have a moving POD. Where can we put it and for how long?

ANSWER: A moving and temporary storage container may be stored on an Owner’s property for no more than 30 days by any one Owner in any given year. The only allowable location for the container is in the property Owner’s driveway. The container must be registered with the Association prior to delivery to the property.

5. I am having my roof replaced. What time can my workers start? What about in the summer?

ANSWER: Construction and maintenance activities which may interfere with the right of peaceful enjoyment of Neighboring Properties must begin after 7:00 a.m. Even though the City allows work to begin at 6:00 a.m. in the summer, the 7:00 a.m. rule for Scottsdale Ranch remains in effect year around.

6. I want to rent my property. What are the rules?

ANSWER: An Owner of a single-family residence may not enter into more than a total of two (2) leases for his Lot during any 365-day period. Additionally, all leases must be for a minimum of a thirty (30) day term. No new lease may begin less than thirty (30) days after the start of the prior lease. No advertisement offering a lease or rental for less than thirty (30) days shall be allowed. All advertising shall limit leasing to only a Single Family. (v) Upon commencement of the lease term, the Owner shall submit a tenant registration form for each new tenant and each new lease, to the Association. Please check with your sub-associations in multi-family subdivisions for their rules.

7. When can I put out trash for City bulk trash pickup?

ANSWER: Brush should be set out by 5:00 a.m. Monday morning the week of the scheduled pick-up. SRCA’s rule is that brush may not be set out before the Wednesday prior to the scheduled week of pick-up. Brush should not block the sidewalk or be placed in the street. Brush pick-up includes all materials other than construction/remodeling debris, tires and hazardous materials.

8. When can I put up holiday lights and when do I have to take them down?

ANSWER: Holiday lights and decorations may be installed no more than thirty (30) days prior to the identified holiday and must be taken down within fifteen (15) days after that same holiday.

Winter Wonderland

How lucky are we! Yes, we swelter for 6 or 7 months, but fall and winter brings back our smiles, our sense of humor, and our appreciation of what a beautiful place our Arizona Desert is.

While our friends or family living in the east or Midwest are dealing with snow or icy rain, we are out playing golf, taking long walks, hiking in our beautiful foothills, toiling in our gardens, and just enjoying the Sonoran Desert mild winters.

Hopefully your Petunias, Snapdragons, and Geraniums are in full bloom!

We are approaching the time of the year when we might start to see colder weather. Garden requirements are at a minimum this time of the year. If you over-seeded your lawn, you should continue to feed them every other month with a feeding of 21-7-14 or 22-39. Usually these fertilizers have an iron product component. You should be cutting your winter rye at 2-3”. Watering times and cycles will depend on how much rain we are getting, but 3-4 cycles a week, with anywhere from 5-25 minutes depending on the type of sprinklers you have on your system.

October was one of the wettest Octobers recorded. This really helped set the tone for irrigating our trees and shrubs this winter. If you have an established garden most of your trees and shrubs could easily go 2-3 weeks without being irrigated, if not longer. There

is always the exception if you planted new shrubs or trees in your yard in the fall. You will just have to gauge how they are looking.

A good investment is a simple soil probe that can be purchased at a home depot or a local landscape retail center.

With the onset of colder weather, make sure you have you frost protection clothe available. Make sure you are using burlap or a specific frost protection clothe. Do not use plastic! It would be a shame to have your f lowers that have been growing the last couple of months effected by a freeze. This goes for many of your tropical and citrus plant material as well. Plants commonly affected are your annual f lowers and vegetables, Bougainvillea’s, Hibiscus, Lantana, and Natal Plums. Most desert natives might get a slight burn from the freeze, but rebound well in the spring.

Pruning is at a minimum during the winter. Desert natives, especially Sages can be pruned during the winter. Deciduous trees actually prefer some crown cleaning and thinning in the winter.

Remember restrict pruning to no more than 20% of the tree.

December is a good month to start preparing and planting bareroot specimens, Rose and fruit trees start to show up at the local garden centers.

Continue to dead heat your winter annuals, a monthly application of liquid fertilizer is appreciated as well.

My recommendations are to enjoy your gardens! weather!! Enjoy your friends and family!!!

News From Laguna

Tis the season for lots of activity here at Laguna Elementary!

In the spirit of giving, our staff, students, and parents just finished up our Turkey Trot and Food Drive to support families in need and we are set to launch a toy drive running December 4th - 14th . We will be collecting new toys to support children in the holiday season. If you have donations to drop by, come see us in the front office!

Our students are participating in our school Spelling Bee on December 5th and our 100th day of school celebration is January 28th. The week of December 21st is National School Choice Week, and we will be celebrating all the wonderful things Laguna has to offer. If you have a kindergarten student, we will be hosting our Kindergarten Round-Up on January 14th from 6:00 PM - 7:00 PM in room 201. Come to learn more about our programs and what a great learning environment we offer students.

We are a STEAM-focused school, with innovative, engaging curriculum in science, technology, engineering, the arts, and math!

Laguna is on Winter Break from December 21st - January 7th. The office will be closed and students and staff will be home enjoying time with family and friends. Announcing the New CamerEyes Registry

The Scottsdale Police Department has announced the new CamerEyes registry. Citizens and businesses may voluntarily register their security camera systems in the registry. This is a confidential database that will allow police employees to quickly know where there may be cameras in an area when trying to apprehend a criminal. The police department will not have direct access to the cameras and owners are not obligated to provide video footage. The program is voluntary and registration only takes a few minutes to complete. Citizens can withdraw from the program at any time. Citizens can register for the program at www.scottsdaleaz.gov/police/securitycamera-registration.

As we enter the holiday season, the Scottsdale Police Department will likely see an increase in citizens reporting charity scams. It is important to research the charity that you want to donate your money to. If you get a call from someone requesting money for a charity, you can ask for the website or phone number to call after you research the organization prior to donating any money.

A legitimate charity will be happy to provide this information to you and shouldn’t try to pressure you into donating money before you hang up the phone. After you get the contact information, be sure to follow up and research the organization online. One good website to research charities is give.org, which is run by the Better Business Bureau. Some other suggestions are Charity Navigator, CharityWatch and GuideStar.

Once we get through the holiday season and into the start of the new year, scammers will often change their strategy and begin trying the IRS tax scam. The scammers may contact you and claim to be an IRS agent, for example. They may tell you that you owe money for back taxes and claim that if you don’t pay immediately, then you will be arrested. They will likely say that they need payment with a gift card or by wire transfer. Or they may request some of your personal information, such as your social security number. Remember, the IRS is not going to initially contact you by phone or email. We have even seen an increase of scammers attempting to contact victims on social media. A government agency will never ask for payment by gift card. Just ask yourself, why would this organization want to get paid in gift cards? Even Apple doesn’t want to get paid in Apple gift cards.

As a general rule of thumb, if someone calls you and asks for payment by gift card or wire transfer, it is almost certainly a scam.

Another sign that a caller is trying to scam you is if they try to pressure you into making a payment or donation immediately.

Be aware that scammers can change the caller ID to make it appear they are calling from a legitimate organization. Don’t ever give out credit card information or personal information, such as your social security number, to an unsolicited caller. The best place to report a scam is to the Federal Trade Commission on their website at FTC.gov/complaint.
