To TOW or NOT To TOW Inside a new Tennessee law that impacts towing, booting

T

he Tennessee General Assembly passed Public Chapter 1017 (2024) enacting the “Modernization of Towing, Immobilization, and Oversight Normalization Act,” a comprehensive law designed to overhaul and standardize regulations surrounding vehicle booting and towing in commercial parking lots. This legislation seeks to enhance consumer protections and regulate the practices of parking lot operators.

by the state Attorney General. Individuals have the right to pursue private legal remedies.

Key Provisions of the Act

• The Act mandates visible identification for operators, accessible payment options, and timely removal of immobilization devices.

It also limits removal fees to $75 and requires compensation for vehicle damage if proper notices are not posted.

The act introduces several important measures: • Commercial parking lot owners are restricted from booting or towing vehicles unless they are abandoned, immobile, or unattended. This aims to prevent unnecessary immobilization.

• Local ordinances will require annual licensing for parking lots and attendants. These ordinances must detail permissible actions (booting, towing, or both) and set standards for signage, payment methods, and response times.

Additional Provisions

• Parking lots must adhere to local ordinances, if they exist, while also complying with the new state regulations.

• Licensed parking lots cannot charge removal fees to individuals who have paid to park but were improperly booted. Violations can lead to license revocation.

• Violations of these regulations are considered breaches of the Tennessee Consumer Protection Act (TCPA), with enforcement

property, provided they adhere to specific notice requirements.

• Parking lot owners must post clear signage before using automatic license plate readers and cannot charge excessive penalties for nonpayment. Late fees are capped at $50.

• The Department of Revenue must create an online platform by July 1, 2025, for police to log abandoned vehicles.

• Consumer Rights and Enforcement: Violations of the new provisions are subject to penalties under the TCPA. The attorney general is empowered to investigate and enforce these violations without incurring costs. Individuals affected by violations can seek injunctive relief, actual and punitive damages, and attorney fees.

• The act defines “curbstoning” as selling vehicles without proper title endorsements or exceeding a threshold of sales for unlicensed dealers.

• Police can seize abandoned, immobile, or curbstoned vehicles from both public and private property. They can also hire resources for vehicle removal and storage. Curbstoned vehicles are subject to seizure and forfeiture under state law.

• Police departments must verify ownership and notify registered owners and lienholders within a specified time frame after seizing a vehicle.

• Prohibits a commercial parking lot owner from booting or towing a non-abandoned vehicle until 12 hours have elapsed since it was first observed to be abandoned.

•Unless the vehicle is creating a hazard, blocking access to public or private property, or parked illegally.

News & Events

• Requires a tow truck operator to immediately release a motor vehicle that the operator has begun to tow but which has not left the parking area if the motor vehicle owner arrives and pays a release fee.

Notice and Appeal Procedures • When a vehicle is taken into custody, the notice must include details such as the vehicle’s year, make, model, and identification number; the location where it is held; and the right of the owner and lienholders to reclaim the vehicle within 20 days upon payment of all associated charges.

Failure to reclaim the vehicle within this period is deemed a waiver of all rights and consents to the vehicle’s sale at public auction.

• If a vehicle is found to be abandoned, immobile, or unattended, a preseizure notice must be sent to the last known address of the owner and lienholders. This notice must include similar details as the post-seizure notice and inform them of the right to appeal or remove the vehicle within 20 days.

• If a vehicle is towed, the towing entity must notify local law enforcement of the vehicle’s details within 15 minutes.

Failure to do so is a Class B misdemeanor.

• Entities involved in towing must verify vehicle ownership through the Tennessee Information Enforcement System (TIES) or, if necessary, the Department of Revenue’s title and registration division. A garage keeper must also verify ownership and notify the owner within three business days after taking possession of the vehicle.

• Garage keepers must verify ownership and notify the vehicle owner within set timeframes to claim storage fees.

Failure to comply could limit storage fees to six days and may result in civil liability for failure to release the vehicle upon payment.

Meet the Candidates GNAA BOD election set for Oct. 17 Voting starts Sept. 17, 2024 16

For Board Chairman Tammy Lee Tammy oversees a portfolio of new development and stabilized properties for Willow Bridge Property Company (formerly Lincoln Property Company).

She has been active in the multifamily industry since 1992. Before joining Willow Bridge in 2017, Tammy served as a regional manager at Riverstone / Greystar, Brookside Properties and held community manager roles at RAM Partners as well as JLC Southeast.

An active member of the Greater Nashville Apartment Association (GNAA), Tammy has been a member of the organization’s board of directors since Lee 2009, serving as a member of its executive committee from 2010 to 2015. She serves as a past chair of the GNAA board and has chaired and/or served on the organization’s governance, apartment tour, golf tournament, community service, communications, and membership committees.

She was also a graduate of the inaugural leadership lyceum program class for GNAA. In addition, she is an active member of the Tennessee Apartment Association (TAA) . She has been a member of that organization’s board of directors since 2018, served on the executive committee since 2019 and currently serves as the board chair.

She has chaired or co-chaired the business exchange committee for TAA since 2018. Tammy is a member of the National Apartment Association, a 2017 NAA leadership lyceum program graduate and served on the NAAEI RPM careers committee for eight years while also having served on the marketing and communications and membership committees.

Tammy holds a certified apartment manager (CAM) designation.

For Board Chairman-Elect Stephanie Burns With an impressive career spanning over two decades, Stephanie Burns brings a wealth of multifamily experience and expertise to her role as Vice President for NTS Development Company and as an Active Past Chairman for GNAA. Stephanie has served on GNAA’s Board of Directors since 2012 and served as Chairman of the Board in 2019.

A few of her notable achievements during Burns her tenure at GNAA include creating the NextGen Committee and collaborating with the Communications Committee to overhaul the GNAA website and social media channels.

In addition to her NTS and GNAA duties, Stephanie actively participates and volunteers on the State and National level, currently serving as a TNAA Nashville Board Member and proudly represents NAA Region 4 as a 2020 NAA Leadership Lyceum graduate.

Stephanie also holds a Bachelor’s Degree in Communications from the University of Memphis and is certified with CAPS, CAM, and CALP credentials from NAAEI.

For Board Chairman-Elect Andrew Klahn Andrew began his career in 2006 as a grounds keeper and has worked his way through all positions on-site into a Regional Property Manager.

As a Regional Property Manager, Andrew has managed multi-family portfolios of all asset classes throughout Tennessee and Alabama. Andrew has earned his Certified Apartment Leasing Professional (CALP), Certified Apartment Klahn Manager (CAM), and Certified Apartment Portfolio Supervisor (CAPS) designations through the National Apartment Association, his Housing Credit Certified Professional (HCCP)

through the National Association of Home Builders, and his Tax Credit Specialist (TCS) through the National Center for Housing Management.

Andrew has served on the Greater Nashville Apartment Association (GNAA) Board of Directors since 2012, co-chairing numerous committees. In 2018, Andrew served as Chairman of the Board and is the current Vice-Chairman. Andrew’s passion for property management lies in providing exceptional living experiences where residents truly feel at home to live their most fulfilled lives.

For Board Vice Chairman Eddie Ivey As VP of Operations, Eddie brings over 30 years of experience in multifamily housing beginning his full-time career in 1994. Prior to joining Freeman Webb, he served as Vice President of Conventional Housing for SPM in Birmingham, AL, where he oversaw a diversified residential portfolio that included high-rise, mid-rise and garden-style apartment communities. His significant experience in new construction Ivey has led to the successful lease-up of over 30 communities. Additionally, Eddie has been involved with property rehabs, asset repositioning and largescale capital improvement projects culminating in profitable, stabilized asset performance and growth. Previously he worked with Davis Development, Lane Company, Dovetail Development, and the William H. Lyon Company.

Eddie holds a bachelor’s degree from Pfeiffer University in North Carolina and a Certified Apartment Property Supervisor (CAPS) designation from the National Apartment Association. He has also served in various positions with the Greater Birmingham Apartment Association, Alabama Apartment Association, Atlanta Apartment Association and Greater Dallas Apartment Association including board member, Treasurer, Vice President, and President. He has received several industry awards including Executive of the Year, Volunteer of the Year and he has served as a board member for Hatching Hope of Alabama and Apartment Life.

For Board Secretary/Treasurer Alicia Jones Alicia brings an impressive wealth of knowledge and expertise to the table, with over 20 years’ experience in the Nashville multifamily market.

She returned to Freeman Webb in 2019 and is happy to be back with her work family!

She earned her CALP designation in 2013, CAM designation in 2018, and CAPS designation in 2022.

Alicia has been in a multi-site community manager role at Ashwood Cove in Murfreesboro since 2022, and

For Board Secretary/Treasurer Nicole Samson Nicole Samson (CAM, CPM) serves as a Regional Vice President for Carter-Haston with oversight of communities in Tennessee, Alabama, and North Carolina.

Nicole joined Carter-Haston in 2011 with the acquisition of a large institutional community in Franklin, TN. She has 28 years of experience with RAM Partners, ARA Advisors, Feld Company, and Carmel, as well as CarterHaston.

She currently serves on the Board of Directors for GNAA as a Management Director.

For Management Director Melanie Brink Melanie Brink has been an active member of the GNAA for 9+ years, currently serving in her second term as Manager’s Director.

She has been co-chair of multiple committees to include Membership, News & Events, & Education and currently sits as co-chair of Golf & Apartment Tour. Melanie completed the Leadership Lyceum course in 2019 and holds her Brink CAM designation, also received through GNAA. During her 12+ years in property management, Melanie has become known as the lease-up

queen.

Most recently she led her rock-star team to stabilization of a 415-unit high-rise in just 15 months. Next, she will tackle the 637-unit, twotower residential campus of Nashville Yards.

On the water is where Melanie spends most summer weekends with her family. She enjoys embroidery, reading, traveling to historic coastal towns, and is always down for queso and margaritas.

Melanie is ready and eager to serve you in her third term as Manager’s Director. “Brink is the link to success!”

For Management Director Jay Cathey Jay Cathey is a Regional Manager with Freeman Webb and has over 23 years of knowledge in multi-family housing with experience in the conventional and affordable markets.

He started his career as a maintenance professional with ambitious goals in 2001 allowing for career growth. As an industry leader, he has successfully guided teams through new developments, lease-ups, acquisition rehab, capital improvements, and revitalizing distressed properties.

Cathey

Jay is a Nashville native and has witnessed the growth and changes in this great city.

He is a two-time graduate of Trevecca Nazarene University, earning an MBA in Management and Leadership and a BA in Management and Human Relations.

He volunteers with various organizations and has recently started working with a local organization to make an impact in Bwera, Uganda providing educational opportunities to over 500 students.

For Management Director Haley Flood Haley has had the privilege of working for Freeman Webb Company at several different multi-family communities, serving in various roles over the past 9.5 years.

During her career with Freeman Webb, she has worked on multiple garden-style assets including renovations, new construction, and stabilized properties.

She currently serves as a Multi-Site Community Manager managing The Whitney Franklin and Sussex Downs, in Franklin.

She also leads the Freeman Webb Manager’s

Council and is an involved member of the GNAA, including being a part of this year’s Leadership Lyceum Program.

For Management Director Amy Heskett Amy is responsible for operation excellence and business development over Greystar’s Tennessee and Alabama portfolios and directs a team of 280 people working specifically for 3rd-party clients. Her portfolio consists of 58 communities and 15,896 units including garden, midrise, high rise and single-family rental options.

She develops and leads programs that promote customer satisfaction and market growth while implementing policies and initiatives that achieve Heskett budgeted financial results. Amy also supervises the staffing and talent acquisitions for her markets. You can count on Amy to ensure your projects’ real estate value will be maximized.

Since joining Greystar as a Regional Manager; she has

worked with the Greystar Investment Group, Greystar Development Group and 3rd Party Clients. Amy was awarded Regional Manager of the Year in 2016 and 2018. For Management Director Chad Vasquez Coming from 14 years of property management experience, Chad worked to grow the Hollywood and Downtown LA markets focusing predominantly on Class A+ luxury high-rise assets in both stabilized and leaseup efforts.

This experience included leading a twin tower lease up that was comprised of 700 residential units, restaurant/retail mixeduse, transient public parking, and revenue Vasquez from advertising signage.

Although Chad has been with Greystar since 2015, once transitioned to the Nashville market, he began working for one of Nashville’s local developers, Tony Giarratana. In 2022, Chad returned to

Greystar and is currently in the role of Director of Real Estate for the Nashville office. Through proven successes in multiple markets in luxury sectors, Chad has continued to use his knowledge, and tools of experience, to train onsite team members to provide logistical operations and elevated customer service.

For Management Director Laura Watkins Over the course of my 20-yexar career in multi-family, I have had the privilege of being part of several different communities around the greater Nashville area, serving in various roles. For the majority of these years, I have called Willow Bridge/ Lincoln Property Company home. Working on garden-style and mid-rise assets, including new construction/lease-ups, renovations, and stabilized properties, I found a special Watkins niche with lease-ups. Although I enjoy many facets of my position as a Property Manager, the most rewarding is creating teams and communities, where

After leaving Northern Virginia in April 2015, she relocated to Houston, Texas where – within seven months - she advanced from Leasing Orso Professional to Assistant Manager of a 240-unit, stabilized, garden-style community in the Central South Division for Greystar. During that time, she trained several leasing professionals earning her a nomination for Leasing Professional of the Year for the market in 2015. For Maintenance Representative Cory Aswegan I began my career in multifamily residences after moving to Nashville 3 years ago. I was able to successfully build and lead a team at The Sound at Pennington Bend, a Garden Style Property, as a Maintenance Supervisor.

Along the way I obtained my CPO and EPA through GNAA. Almost a year ago, I moved to a MidRise Property at The Margaux Midtown Aswegan Apartments as a Maintenance Supervisor.

What is your favorite thing to do on the weekends?

On the weekends, you can find me spending time with friends, hanging out with my cat or taking short road trips around to explore.

What brought you to the apartment industry?

I was previously in retail sales for quite some time, and a friend who was already a manager in the industry told me I should look into it. She was able to help me get an interview with my first company and the rest is history.

I started at a 635-unit community in the suburbs of Washington, DC and have experienced quite a bit since 2013!

Was this career path something that was always on your radar?

It actually was not! I had always thought it would be an interesting job to undertake, but didn’t think I had what it took to be in the industry. Boy, was I wrong!

Did you have any unrelated jobs growing up that unexpectedly prepared you for the apartment industry?

Do you have any pets?

I do! One cat – his name is Scott! And he’s the most handsomest and sweetest boy in all the land!

Coolest place you’ve ever traveled?

Coolest place, thus far, would have to be Puerto Vallarta, Mexico. However, ask me in January when I return from London for the first time!

Give us a fun fact about you.

I’m a native Texan, but I have lived in five different states since I was 19: Texas, Utah, Florida, Virginia and Tennessee.

What upcoming GNAA event are you excited to attend and why?

GALA! Gala is my absolute most favorite event out of the entire year. Seeing everyone all dressed up and snazzy is just so much fun!

Do you have a motto you live by?

I would say working in the food service industry prepared me for days when there is high demand, whether that be high traffic days or residents who can, sometimes, be a bit overwhelming.

Why is property maintenance an attractive career path?

I have a lot of respect for my maintenance team.

Without them, I would not be able to do my job; neither would any of my office staff. If you’re asking about property management being an attractive career path – it’s lucrative, it’s rewarding, and it’s ever-changing.

Being an Assistant Manager was, by far, my favorite position in my career. I enjoyed it the most. If I could do that all over again, I absolutely would. Is there anything I regret doing in my career? No, absolutely not. That’s because everything I have experienced and learned has brought me to where I am now. “You learn through what you grow through.”

Best professional advice you have ever been given?

Any advice you could give to the rising stars of GNAA?

Read the lease. Know the lease. “Reading is fundamental.”

What’s your best productivity hack?

“To Do” Lists. I always have “To Do” lists.

What does happiness mean to you?

“I feel like people get lost when they think of happiness as a destination. We always think that someday we’ll be happy. When we get that car or that job or that person in our lives who will fix everything. But happiness is a mood and it’s a condition. Not a destination. It’s like being tired or hungry. It’s not permanent. It comes and goes and that’s OK. And if people would think that way, they’d find happiness more often.” –Julian Baker, One Tree Hill

Do the ends justify the means?

It kind of brings me to my answer for the next question. Integrity is what you show, even when nobody is looking. Do the right thing, at all times. What you do in the dark, comes to the light.

In my opinion this is a slightly controversial phrase in that aspect.

If you could see a measuring scale above people’s heads, what would you want this scale to measure?

Integrity. Because that is something you show, even when nobody is looking.

When in your career did you reach success?

I feel successful overall. I wouldn’t say I’ve reached my pinnacle just yet, but I am certainly – and constantly – working toward it.
