The Art of Practicing Medicine Anthony M. Zacharek, MD MHA

P

hysicians today are faced with an endless number of challenges. From taking call to balancing personal and professional responsibilities to trying to stay up-to-date in their field, doctors have a lot on their plates. With all this commotion of practicing medicine today, it can be easy to lose sight of the important reasons why we all chose medicine as our careers. At the heart of all of our practices is the care of our patients.

While that involves using advanced technologies and the best medicines, a lot of what we do as physicians also involves the art of medicine.

What exactly is the art of medicine? There is no one answer

to this question, but I will attempt to provide my opinion on this important issue. The art of medicine refers to how we as physicians treat one another, and especially our patients. The art of medicine is a mindset, a behavior, that considers the patient as a real, genuine, unique individual. The art of medicine is how we treat patients as people, and should involve treating patients with respect and understanding.

It is easy to get overwhelmed by all the pressures placed on doctors today, such that these pressures get in the way of seeing our patients as people just like you and me. If we can remember to always see our patients as people who have

a unique story to tell, perhaps the pressures of our day-to-day jobs will seem less significant.

To learn how to practice the art of medicine requires time and practice.

It also requires good mentors, both medical and non-medical. Practicing the art of medicine requires compassion and a desire to serve the greater good. I encourage all my colleagues of the Saginaw County Medical Society to keep practicing the art of medicine and to remember that all our patients are individual people who deserve to be heard and treated with respect.

The art of medicine is a mindset, a behavior, that considers the patient as a real, genuine, unique individual.

R

ecently, a public official in Dallas encouraged mask wearing in reluctant parents by pointing out: “Pediatric ICUs in Dallas are full, and if your child is in a car wreck, or has Covid, and needs an ICU bed, we don’t have one. Your child will have to wait for another child to die.”

Obviously, he was exaggerating a bit.

These days, we can transfer patients by helicopters in a pinch. But he has the general idea correct. When ICUs are full, it becomes harder to shift those new arrivals from the ER, patients must wait under less-than-ideal circumstances and mortality goes up. But, instead of putting all this in general terms, which can be taken generally, and ignored easily, he puts it in terms no parent can ignore.

YOUR child may have to wait for care.

ANOTHER parent’s child may DIE! His goal: When some misinformed parent hands them a petition against mask-wearing in schools, they may just decline to sign it.

Plain speaking like he demonstrated can be useful in breaking through other destructive behavior. We’ve all done this in the exam room. When “take your pills, stop smoking, stop drinking, keep your appointments, exercise, lose weight” don’t work, blunt talk can be just what ‘the doctor ordered.’

Examples: • One fellow kept putting off his cardiac surgery, until the cardiologist held up, to his face, his angiogram film, and bluntly declared “this is incompatible with life.” He got the surgery.

• Another with emphysema, resisted all calls to stop smoking “for his health,” until one doctor flatly told him that he “would die soon” if he didn’t quit.”

He did.

• An alcoholic, in the ICU with his umpteenth GI bleed, his weary doctor, tired of the endless counselling, prescriptions, pleadings; simply said “I’m tired of this Joe, this is the end for you, if you don’t stop drinking, you are going to die.”

He stopped.

My mother always taught me to be nice to people. Don’t ever use harsh words. Don’t make people uncomfortable if you can help it. Be polite. Don’t argue. Don’t offend. Similar admonitions to me in medical school and residency. Your job is to comfort patients, to make them feel better. Don’t argue with them. Don’t use harsh words, such as “death,” “should,” or “should not.” Better to be indirect. “You would be better off if you could,” and “your health is at risk if you continue this.”

The question is whether we can fulfill our charge to heal the patient without fully engaging his attention and motivating him by using attentiongetting HARSH words.

Since the start of this epidemic, many of us have used reassuring words with the public, our “patients.” We’re “increasing our -staffing, -hospital capacity, -ventilators.” The implication is that “we’ve got this,” the medical infrastructure - doctors, hospitals, nurses, pharmaceutical industry, all of the above - will step up and take care of you, the American public, as we have always done, and you won’t necessarily have to change your behavior at all. Just like the patients in the examples above.

What would happen if we all got serious about telling our patients, our friends and our relatives…everyone in our extended social circle…the real story behind this epidemic: • What it’s like to struggle for every breath, then have a tube shoved down your throat • What it’s like to have an amputation because of gangrene in an arm or leg • What it’s like to have brain damage • What it’s like not to be able to taste and smell your food • How families are affected when a loved one dies continued on page 7

Blunt talk for sure. But maybe, after 600,000 deaths, and 100,000,000 in denial, it’s time for blunt talk. There are over 600,000 of us physicians in our country. We could deliver the message. We could break through the denial and motivate the change that is needed.

We commonly use prescriptions and scalpels, but we should never forget that words may be our most powerful tool of all.

Words have moved people to do amazing things…to go on crusades and start revolutions. And words have moved people to do the most amazing thing of all - to change their behavior.

Powerful words - like DEATH - and other blunt, shocking words get people’s attention then they can focus and change their behavior. Perhaps even create a society of mask-wearing, vaccinated, socially-distanced people.

Dow Great Lakes Bay Invitational We spent the week of July 12th at the Midland Country Club for the Dow Great Lakes Bay Invitational, following LPGA golfers Emma Talley and Jodi Ewart-Shadoff. Team #Precious ended the week in 31st place. As one of the chosen non-profits to #TeamUp with golfers, we will be awarded $4,500. It was a great week of networking, raising awareness, team building and fun in the sun!

On August 8, we had another VERY successful Walk for Hope at Saginaw Valley State University! We brought 1,200 people together and raised over $115,000 to go towards our mission to prevent suicide through education and support those impacted by suicide.

THANK YOU to everyone who attended, raised/donated funds, set up a vendor booth and volunteered. We could have never been this successful without each and every one of you!

COVID-19 Booster Shots Available Starting September 20 Christina Harrington, MPH, Health Officer Delicia Pruitt, MD, Medical Director COVID-19 “booster” shots will be available to vaccinated residents in Michigan starting September 20, pending recommendation from the CDC's Advisory Committee on Immunization Practices (ACIP). The CDC, U.S. Surgeon General and the FDA have concluded that booster shots of the Pfizer and Moderna COVID-19 vaccines will be needed to maximize the protection these mRNA vaccines provide against the virus.

In mid-August, we began providing third doses to vaccinated residents who are moderately to severely immunocompromised such as those who have received organ or stem cell transplants, have advanced HIV or are in active treatment for cancer. Those who are immunocompromised don't appear to have the same robust immune response to the vaccine as healthy individuals.

Therefore, they can receive a third dose at least 28 days after their second dose.

Planning is now underway for booster shots for other vaccinated residents. They will be eligible to receive a booster shot at least eight months after their second dose. For example, anyone who received a second dose on February 4, 2021, will be eligible for a booster shot in October 2021.

The SCHD is planning to offer a wide range of opportunities for boosters, including clinics in locations around the county. These will be walk-in clinics with no appointment scheduling. We will be posting our schedule on Facebook soon and recommend that those attending vaccination clinics plan accordingly to avoid the busy rush at the beginning and end of clinics.

In addition, other vaccine providers are also planning to offer booster shots including: • Great Lakes Bay Health Centers – at Lapeer location and Bagley UAW Hall • Covenant HealthCare – at MedExpress locations and physician offices • Ascension St. Mary’s – at physician offices and other clinics • Local pharmacies – at their facilities

We are reminding folks that they may or may not get notification about third doses from the provider who gave them doses one and two. It is up to individuals to seek out a third dose at least eight months after their second dose at any convenient location and time.

While many experts recommend sticking with the same “brand” (Pfizer or Moderna) as their first two doses, it is acceptable to take whichever mRNA vaccine is available.

Those receiving Johnson & Johnson are not yet cleared for additional doses.

If you are unsure of the date of your second dose, you can now look it up in the Michigan Care Improvement Registry (MCIR). The portal can be found online at www.michigan. gov/immunize and is available on computers or smart devices.

The state plans to focus their initial booster shot response on long-term care facilities, such as nursing homes and adult foster care facilities. Here in Saginaw County, healthcare workers and first responders are likely to receive boosters first as most will be eligible based on receiving second doses in January.

We are encouraging everyone who is vaccinated to seek out a booster shot when eligible. We also want to reassure you that there is no need to be anxious about limited supplies (like this winter). According to a recent announcement from Governor Gretchen Whitmer, Michigan has an ample supply of the COVID-19 vaccine to meet the projected demand.

Caduceus Meeting for Recovering Health Care Professionals Third Thursday of each month at 7 p.m.

Caduceus meetings are available to health care industry professionals, and have adopted many of the principles of 12-Step programs.

Caduceus meetings are “closed” meetings for recovering health care professionals including, but not limited to, nurses, doctors, dentists and pharmacists.

We engage in group discussions where members may want to speak up, ask questions or share thoughts with fellow members.

The Centers for Medicare & Medicaid (CMS) has released the Calendar Year 2022 Physician Fee Schedule Proposed Rule, which proposes to implement phase 2 of Section 2003 of the SUPPORT Act requirement that Medicare Part D prescriptions for schedule II, III, IV, and V controlled substances be prescribed electronically. The statute provides the Secretary with discretion on whether to grant waivers or exceptions to the EPCS requirement, and specifies several types of exceptions that may be considered. It also gives the Secretary authority to enforce non-compliance with the requirement and to specify appropriate penalties for non-compliance through rulemaking.

In this rule, we are proposing to implement the following proposed exceptions: • Where the prescriber and dispensing pharmacy are the same entity; • For prescribers who issue 100 or fewer controlled substance prescriptions for Part D drugs per calendar year; and • For prescribers who are in the geographic area of a natural disaster, or who are granted a waiver based on extraordinary circumstances, such as an influx of patients due to a pandemic.

We are proposing that prescribers be able to request a waiver where circumstances beyond the prescriber’s control prevent the prescriber from being able to electronically prescribe controlled substances covered by Part D. We are proposing to initially enforce/induce compliance by sending compliance letters to prescribers violating the EPCS mandate. In addition, we are seeking comment on different types of compliance actions,

so that we may ensure prescribers electronically prescribe controlled substances covered under Part D without overly burdening them.

CMS is also proposing to extend the start date for compliance actions to January 1, 2023, in response to stakeholder feedback. However, we are soliciting comment on whether the original date of January 1, 2022, should remain, in light of the proposed exceptions to the mandate. We are also proposing to extend the compliance deadline for Part D prescriptions written for beneficiaries in long-term care facilities to January 1, 2025.

E-Prescribing is a prescriber's ability to electronically send an accurate, error-free and understandable prescription directly to a pharmacy from the point-of-care - is an important element in improving the quality of patient care. The inclusion of electronic prescribing in the Medicare Modernization Act (MMA) of 2003 gave momentum to the movement, and the July 2006 Institute of Medicine report on the role of e-prescribing in reducing medication errors received widespread publicity, helping to build awareness of e-prescribing's role in enhancing patient safety. Adopting the standards to facilitate e-prescribing is one of the key action items in the government’s plan to expedite the adoption of electronic medical records and build a national electronic health information infrastructure in the United States.

The MMA created a new voluntary prescription drug benefit under Medicare Part D. Although e-prescribing will be optional for physicians and pharmacies, Medicare Part D will require drug plans participating in the new prescription benefit to support electronic prescribing.

Health Can’t Wait is a coalition of patients, physicians and health care providers dedicated to putting Michigan patients first and ending delays in patients’ access to health care.

This past spring, the Senate unanimously passed SB 247 - prior authorization reform that reduces the red tape patients and providers are forced to navigate.

The bill has now moved on to the House of Representatives for consideration. To be as proactive and productive as possible in the lead-up to this critical fall legislative session, we are asking for your help in reaching out to these lawmakers on SB 247.

Making direct contact with Representatives on this issue will go a long way towards helping us duplicate the success we experienced with this legislation in the Senate. We have also produced two new action alerts - one for patients and one for providers - that make it easier for an individual to quickly contact their Representative and communicate the importance of the reforms outlined in SB 247.

The Council of Residency Directors in Emergency Medicine (CORD) , in collaboration with ACEP, AAEM, ACOEP, EMRA, RSA, RSO and SAEM have come together to annually dedicate September 17th as National Physician Suicide Awareness (NPSA) Day. The organizations issued Vision Zero, calling on “individuals, residency programs, health care organizations and national groups to make a commitment to break down stigma, increase awareness, open the conversation, decrease the fear of consequences, reach out to colleagues, recognize warning signs and learn to approach our colleagues who may be at risk.”

One of Us Marking this moment in 2021 feels especially heavy as we continue to endure one of the most challenging years in emergency medicine history. And this year’s NPSA Day theme “One of Us” is especially personal when we consider the recent loss of one of our own.

In late April 2020, Lorna Breen, MD, FACEP, died by suicide after contracting COVID-19 and returning to work at one of the hospitals in New York City that was inundated with coronavirus patients. Her loss was felt around the country, but especially within the emergency medicine community where Dr. Breen was a standout colleague and contributor.

Her family created the Dr. Lorna Breen Heroes’ Foundation in her honor with a mission to improve mental health support for healthcare heroes.

College of Medicine Welcomes Class of 2025 One hundred and four future physicians officially began their medical education during the Central Michigan University College of Medicine's White Coat Ceremony. The event creates a commitment to compassionate care at the very beginning of medical training.

"Your odyssey to becoming a physician formally begins the moment you slip on the white coat," Dr. George E. Kikano, CMU Vice President for Health Affairs and Dean of the College of Medicine, told the new students. "More than any other item, the white coat denotes the medical profession – and the knowledge, compassion and care required from the person who wears it."

Dr. Amy Kuechenmeister, '17 gave the keynote speech.

Kuechenmeister is a member of the College of Medicine's inaugural class. She told the medical students that they would feel the weight of the white coat. "Medicine is not a job, it's a calling. It is our weight to bear, and through our training, our shoulders are made strong," said Kuechenmeister. "The weight of the coat represents…love, hope for the future, compassion, integrity, honesty, ethics; it represents a profession filled with honor, empathy and servitude."

Chosen from more than 6,500 applicants, the class of 2025 is one of the college's most diverse, comprised of 15 percent underrepresented minorities in medicine. The students come from 17 states plus Canada, and completed

their undergraduate coursework at 45 different colleges and universities.

Dr. Arnold P. Gold at Columbia University initiated the White Coat Ceremony in 1993. Gold was a professor, pediatric neurologist and passionate advocate for humanistic health care. He believed that the oath taken by new physicians at the end of medical school came too late.

Through the nonprofit organization that he and his wife, Dr. Sandra Gold, started, The Arnold P. Gold Foundation has expanded the White Coat Ceremony around the globe.

The CMU College of Medicine and nearly every medical school in the United States participate in this traditional ceremony. CMU's ceremony was broadcast via livestream and a recording of the ceremony remains available.

First-Year Medical Student Sets Swimming Record While Raising Money for Diabetes Research The week before arriving at CMU’s College of Medicine, Marian Cardwell completed a record-breaking swim while raising awareness and supporting research for Type 1 Diabetes.

Cardwell swam the length of Torch Lake two times - more than 35.6 miles in 18.5 continuous hours - and, at the time of this writing, has raised approximately $35,000. Cardwell uses her athletic ability and endurance to complete marathon swims on behalf of her late uncle’s chosen diabetes research foundation, the Chicago Diabetes Project. Her uncle was diagnosed with Type 1 Diabetes in 1955.

“Observing his perseverance and zest for life while living with the disease was continually inspiring,” said Cardwell.

While safety concerns cut short her audacious 106-mile planned course, Cardwell said she has learned from the Type 1 Diabetes community that “…no amount of planning or preparation means perfection. This disease is often unpredictable, and I will continue fighting on behalf of this community.”

Cardwell has been swimming her entire life. She swam the English Channel in 2012 and earlier this summer placed second in the 36-mile ultra-marathon END-WET race. continued on page 14

CMU Psychiatry Resident Meets U.S. President, Advocates for Mental Health When Dr. Jonathan Broadwell, psychiatry resident with the CMU College of Medicine and medical officer in the National Guard, watched the 2021 United States presidential inauguration ceremonies, he was so moved, he went onto the website and wrote a letter to President Joe Biden, Vice President Kamala Harris and their families.

“It was so in the moment, I didn’t even tell my wife,” said Broadwell. “I felt a restored faith in our country and humanity.”

He signed the letter on behalf of his entire family.

Nearly six months later, on July 1, 2021, he received a phone call from a Washington, D.C. area code. “I let it go to voicemail,” said Broadwell. “I thought it was a sales call.”

That call was from the White House inviting Broadwell, his wife, Yeagi, and their two children, 5-year old Rose and 18-month old Jace, to meet President Biden, who was coming to Traverse City on July 3.

“I was totally blown away!” said Broadwell. The family immediately began speeding through a checklist of tasks security checks, COVID-19 tests, haircuts, dry cleaning and clothes for the children.

Broadwell’s College of Medicine family also sprang into action with fellow residents agreeing to cover shifts and his former attending, now practicing in Traverse City, offering housing.

When the young family arrived at the cherry orchard where they were to meet the president, Broadwell recalls noticing they were the only family present – most of the people were elected representatives or represented organizations. “I had my white coat with me, and I talked with people about the gravity of mental health in Michigan,” said Broadwell. “It was an awesome opportunity to be an advocate.” When Biden arrived, Broadwell said the president left him feeling like a million bucks. “He said thank you for all that you do and thank you for the letter. Words cannot describe how kind, generous and personable a guy he is.”

CMU College of Medicine Receives Grants to Support Hemophilia Research and Student-Run Clinic Hemophilia of Georgia, Inc., awarded a Hemophilia of Georgia Clinical Scientist Development Grant to Central Michigan University and Dr. Katherine Regling, CMU assistant professor of pediatrics-hematology/oncology and pediatric hematologist/oncologist with University Pediatricians at DMC Children’s Hospital of Michigan.

Blue Cross Blue Shield of Michigan Social Mission Department awarded Central Michigan University Street Medicine a grant as part of BCBS’ Strengthening the Safety Net initiative. The grant will support College of Medicine students’ free clinic, which provides services to rural and medically underserved areas in our region. Neli Ragina, Ph.D., CMU associate professor of genetics and director of students and residents clinical research, is the principal investigator on the grant.

MEMBERSHIP T he Saginaw County Medical Society (SCMS) is the professional association of physicians in Saginaw County, and a component of the Michigan State Medical Society (MSMS). In order to be a member of one, you must be a member of both.

Sterile Processing Renovation and Enhanced Equipment Polishes Efficiency The Cooper Sterile Processing Department recently unveiled a newly renovated (and relocated) space in the lower level of 700 Cooper. Sterile processing is the method by which medical and surgical instruments are cleaned and sterilized for reuse. Decontamination and sterilization are fundamental components of patient and employee safety, as well as, one of the most vital elements in preventing hospitalacquired infections.

The modernized Sterile Processing space improves efficiency and introduces supplementary and enhanced equipment offerings, including: Three additional instrument washers; three new autoclaves (two extra-large capacity and one large capacity) with the capability of sterilizing up to 50 instrument trays an hour compared to the previous 20 instrument trays per hour maximum; four instrument processing tables with all equipment and supplies in close range to optimize productivity; two decontamination full workstations complete with height-adjustable sinks and automatic detergent dispensers to reduce variation and an assortment of specialty cleaning attachments for water and air hoses; and a cart washer - a new addition to our sterilization process. Used surgical case carts were previously washed by hand, hindering productivity. The new device can disinfect up to two carts at a time with its speedy 15-minute wash and dry cycle.

Another notable upgrade is the application of CensiTrak instrument tracking system, which traces the location/usage of instrument trays in real time and gives staff a content list and instructions for each tray.

Additionally, the Cooper Sterile Processing team will soon implement a complete Case Cart System (currently utilized by Harrison Sterile Processing) and house supplies/trays presently stored in the OR. The Case Cart System will enable Sterile Processing to prep carts for individual surgical cases in addition to general supply replenishment. Prepped enclosed carts will be transported via the designated clean elevator to the OR. Radiation oncologist, Nicholas J. Damico, MD, recently joined the Ascension St. Mary's cancer care team. Dr. Damico received his bachelor's degree from the University of Michigan and his medical degree from Case Western Reserve University School of Medicine. Ascension Continues its Investment in Northern Michigan Hospitals On Tuesday, August 31, northern Michigan ministry leaders were informed that Ascension approved $37.7 million in operational capital to continue the reinvestment in our facilities, patient care and services. This funding will support six prioritized projects identified through the development of the three hospitals' master facility plans from 2019-20. The projects include upgrades to cardiac catheterization and electrophysiology labs, replacement of two linear accelerators for radiation oncology services provided in Marlette and West Branch, relocation and expansion of the obstetrics unit at Ascension St. Joseph Hospital, and a new emergency department waiting room and medical office building for primary and specialty care physician offices, laboratory and rehabilitation services at Ascension Standish Hospital.

This latest investment from Ascension’s capital operating fund is a continuation of their commitment to the growth and success of the northern Michigan hospitals that was initiated in May 2018. Details and timelines for the projects will be established and shared in the coming weeks.

completed in phases, individuals can see the progress being made. As of August 31, Phase 4 renovation is completed and the newly constructed areas of the Emergency Care Center will begin to be used.

In addition, a new 256 slice CT scanner was added and is now operational. This highly innovative technology allows clinicians to provide low-dose CT scans with higher quality scans of the heart in a single heartbeat, an image of the entire brain in less than a second and detailed bone imaging and whole organ diagnosis faster than ever before. Ascension St. Mary’s is the only hospital in the Great Lakes Bay region to offer this technology for inpatient and outpatient testing. The total investment for the project was $2.7 million.

Diabetes Education and Malnutrition Treatment Available at Ascension St. Mary’s Ascension St. Mary’s offers a diabetes self-management and malnutrition program with one-on-one counseling and education by a registered nurse and registered dietitian.

They provide professional and personal continuous glucose monitoring, insulin teaching and adjustment and insulin pump training. In the diabetes group education, a variety of topics are covered including diabetes physiology, nutrition, physical activity, problem solving, medications, stress management, prevention of complications and sick days. Most insurances cover this education. Medicare allows 10 hours of diabetes education and three hours with the dietitian initially, and another two hours of diabetes education and two hours with the dietitian yearly.

Ascension St. Mary’s also provides care and education for malnutrition. It is estimated that 20-50 percent of hospitalized patients are malnourished which leads to higher hospital costs, longer stays and increased mortality rates. Registered dietitians and nutritionists at Ascension St. Mary’s are focused on reducing the incidence of malnutrition by providing educational support and resources to the medical teams and patients.

AMA Releases Educational Resources to Advance Equity in Health Care In alignment with its commitment to inform and educate physicians on topics important to health equity, the American Medical Association (AMA) recently announced a series of CME and educational activities aimed at addressing the root causes of inequities, including racism and other structural determinants of health. The new content - featured on the AMA Ed Hub™ Health Equity Education Center and curated by the AMA’s Center for Health Equity - will equip physicians and other learners with core health equity concepts needed to support them as they continue to take action and confront health injustice.

An innovative online platform that supports continuing medical education (CME) and other professional training, the AMA Ed Hub™ serves as a centralized source of high-quality, vetted educational content from the AMA and other trusted sources. DOs and DON’Ts for Discussing Face Masks and COVID-19 Vaccinations with Patients and Visitors “Do facemasks work?”

“Should I get the COVID-19 vaccine?”

These are just two of the many questions and concerns physicians and other health care providers frequently encounter when discussing face masks and COVID-19 vaccines with patients. The following guidance is intended to provide some suggested practices for physicians when engaging patients in these discussions.

DO encourage patients to “mask up” indoors and receive the COVID-19 vaccine.

Due to the rapid spread of the highly contagious Delta variant, patients and visitors should be encouraged to follow guidance from the CDC and other public health organizations which recommend that individuals wear a face mask indoors in public spaces, regardless of vaccination status. In addition, based on CDC and FDA guidelines, patients should be encouraged to receive the COVID-19 vaccine to help build

protection from the virus. Physicians should counsel patients, who are not candidates for the vaccination due to medical conditions, on risk mitigation strategies, such as wearing face masks indoors, social distancing and hand washing.

DO use effective communication that is tailored to the patient.

Physicians should consider using words which will better resonate with each patient. For example, when discussing the benefits of COVID-19 vaccination, explain the safety of the vaccine and the benefits to the patient and his or her family.

Physicians should also be transparent with patients, such as discussing potential side effects of the COVID-19 vaccine or the effectiveness of cloth vs other types of face masks in preventing the transmission of COVID-19 indoors or in crowded places.

Physicians should avoid using judgmental language against individuals with face mask or vaccine concerns, which could negatively impact the patient’s trust and the overall physicianpatient relationship. In addition, sharing facts about face masks and the COVID-19 vaccine, as opposed to personal opinions, may be more effective. continued on page 26

DO continue to implement COVID-19 policies and other infection prevention measures recommended by the CDC and MDHHS. The CDC continues to recommend that medical practices and facilities use additional infection prevention and control practices during the COVID-19 pandemic, including, but not limited to, telehealth visits where medically appropriate, screening patients and visitors entering the facility for signs and symptoms of COVID-19, and implementing source control measures, such as face masks.

If a patient or visitor objects to or refuses to comply with the practice’s COVID-19 policies, such as refusing to wear a face mask, physicians should ensure its policies include a protocol for explaining the CDC’s guidelines for health professionals, which may be different from mandates or guidelines for individuals, and that a patient must comply with the policies while inside the facility. If necessary and appropriate, the patient’s appointment may be rescheduled to a telehealth visit, or the patient may be referred to another physician for treatment.

DON’T routinely terminate patients who refuse to receive the COVID-19 vaccine.

It has been reported in the media that some physicians are refusing to treat unvaccinated patients. In other instances,

some physicians have declined to treat children based on the parent’s vaccination status, although the American Pediatric Association advises against refusing to treat pediatric patients based on parental vaccination status or position. Generally, a physician is legally free to determine whom to treat and to end the physician/patient relationship with appropriate advance notice. Until consensus develops on any potential ethical, licensing or liability risk exposures that physicians could face by routinely declining to treat individuals who are unvaccinated or due to the vaccination status of others, physicians should consider making treatment decisions based on the facts and circumstances of each situation.

DO implement a process for handling patient claims of medical exemptions from the practice’s COVID-19 policies applicable to patients.

Medical practices are generally considered places of public accommodation and must comply with the federal Americans with Disabilities Act, as well as, Michigan’s Persons with Disabilities Civil Rights Act, when enforcing the practice’s own COVID-19 policies. Physicians need to have a process to address requests by patients and visitors for exemptions from the practice’s face mask mandate or similar policies based on medical grounds and to assess whether or not reasonable accommodations are possible. not assume that an unmasked patient or visitor cannot medically tolerate a face mask or comply with other COVID-19 policies, but physicians are permitted to accept the patient or visitor’s verbal representation to that effect. Best practices advise to not request medical documentation from the patient or visitor to determine whether the patient or visitor has a disability warranting a reasonable accommodation.

DON’T provide face mask or vaccine exemption letters or documentation to patients which are not medically necessary.

Several media sources have reported on several physicians who have been disciplined by various state medical boards for issuing medical exemptions to patients without an objective medical basis for the exemption. Some physicians individually oppose policies which mandate face masks or COVID-19 vaccinations. Other physicians may empathize with patients who may be negatively impacted by their refusal to comply with mandatory COVID-19 policies, such as a patient who may face termination from employment unless the patient receives the COVID-19 vaccine. Regardless, physicians should not attempt to help patients circumvent COVID-19 policies applicable to patients by drafting letters or other documentation regarding the patient’s medical condition that is false or misleading.

Prevent, Communicate, Document: Medical Malpractice Data Helps Us Manage Risk David L. Feldman, MD, MBA, FACS, Chief Medical Officer, The Doctors Company and TDC Group

One way to think of reducing malpractice risk is to consider the three-P model: (1) Prevent adverse events, (2) Preclude lawsuits from being brought if adverse events do occur, and (3) Prevail in lawsuits when a suit cannot be precluded. All three Ps can be informed by a careful examination of medical malpractice data.

Not only do malpractice claims provide a richer source of data than typical hospital-based adverse event investigations, but because malpractice data has a direct correlation to large sums of money, it is easier to use claim-related findings to drive tangible, system-wide improvements to patient safety that no one wants to pay for.

Prevent, Preclude, Prevail Prevent adverse events. “We can’t fix what we can’t see,” says Dana Siegal, RN, CPHRM, CPPS, Director of Patient Safety Services for CRICO Strategies. The Doctors Company employs CRICO’s coding taxonomy when we analyze medical malpractice claims.

When considering this first P, it’s important to remember that some adverse events may represent a fairly large percentage of the events named in lawsuits, but a small percentage of the events in a hospital, most of which do not result in a lawsuit. Having robust malpractice data allows risk managers to better understand which adverse events are highly associated with claims and the factors that led to those events.

Preclude lawsuits with good communication. When we analyze medical malpractice claims across specialties and settings, communication gaps crop up again and again. Those gaps can stem from medical team members miscommunicating with each other or with patients or families. While the former may result in an adverse event (see the first P: Prevent), the latter may result in a lawsuit. A patient’s desire to pursue litigation after an adverse event frequently derives from a misunderstanding about possible outcomes.

If your institution participates in a disclosure program, follow it carefully when responding to adverse events. A swift, compassionate, effective response to a patient’s needs in the aftermath of an adverse event or undesirable outcome is both ethically superior and practically advantageous for all parties, when compared to a lawsuit as the likely alternative.

Prevail when there are lawsuits via documentation. While undesired outcomes - even those that fall within the realm of a known complication for the treatment or procedure - may motivate patients to sue, it is often poor documentation that motivates a plaintiff’s attorney to take a case. In addition, defending a case is easier for defense attorneys when there is clear, concise, and timely documentation, especially when the adverse event occurred despite optimal care.

Prevent, Communicate, Document Experience has taught us that patients may bring suit either in the presence of actual medical error or in their perception of medical error. Either way, through medical malpractice data, we have an opportunity to learn how to prevent the next claim.

The ultimate decision regarding the appropriateness of any treatment must be made by each healthcare provider considering the circumstances of the individual situation and in accordance with the laws of the jurisdiction in which the care is rendered.
