ello and warm greetings from Weldon.

It is a pleasure to share this edition of Hearsay with you. Hearsay gives us an excellent way to celebrate our alumni and their many achievements. As Dean, I have the opportunity of spending time with our graduates from coast to coast to coast.

This past year I met with many of you individually and at alumni events in Halifax, St. John’s, Toronto, Ottawa and Vancouver.

It was wonderful to welcome many of you back to Weldon for our annual Law Alumni Reunion Weekend. We will be hosting alumni receptions in 2017–18, some of which will coincide with Dalhousie University’s 200th-anniversary celebrations. Stay tuned for details.

We are excited to be welcoming four new colleagues this year; you can read about them on page 11. They come with varied backgrounds and expertise in a broad range of subjects, including intellectual property, business, environment, family and criminal law. They will join us in July, but already, from a distance, they are contributing ideas and energy. Speaking of ideas and energy, we welcomed Professor Naiomi Metallic this year as our inaugural Chancellor’s Chair in Aboriginal Law and Policy. This Chair was

made possible by a generous donation from our Chancellor, Anne McLellan (’74).

We are losing to retirement this year four faculty members whose names will be familiar to you: Professors Vaughan Black, Wayne MacKay, Lorraine Lafferty and Faye Woodman. We will say goodbye to them at the end of June, and we are planning a suitable celebratory send-off. We will also honour them and their contributions at this year’s Convocation ceremony.

On the subject of goodbyes, I must mention a sadder one: Professor Dianne Pothier passed away in January of this year. We were so very sad to see her go, but we are glad to be able to remember her in this edition of Hearsay. She will be missed. We will honour her memory with a scholarship (see page 60) and, as she had a beautiful voice and was a fan of karaoke, we have already honoured her memory with a karaoke evening at the Lion’s Head Tavern in Halifax (a good time was had by all).

One of our significant undertakings this year has been a strategic-planning project. I would like to take this opportunity to thank the alumni who accepted the invitation to participate in our consultations, whether in

person or by email. We heard from faculty, staff, students, alumni and university leaders, and the result will be richer because of that input. We will send you a copy of our strategic plan and welcome all comments, ideas, questions and suggestions.

You will see in these pages that our faculty is, as usual, involved in interesting ventures, from national and international conferences on food law, cyber warfare, restorative justice and end-of-life care to presentations and publications on all sorts of topics—legal ethics, business law, aquaculture, immigration and climate change, among others. We are also collaborating with the Faculties of Arts and Management to sponsor public seminars on topics of current interest. In January, we hosted a seminar entitled “Trump: Now What?” In the fall, we have two such seminars planned, one on Brexit and the other on the legalization of marijuana. These are an excellent way to collaborate across faculties and bring the broader community to the university.

Our students are still as special as they were when you were here! This year, four of them succeeded in obtaining clerkship positions with the Supreme Court of Canada, and continued next page 2 0 1 7 H E A R S AY

a number of others were chosen for provincial appellate and Trial Court clerkships. We have high student-participation rates in pro bono activities and an active student society culture. Our students are creative, hard-working and full of energy and ideas. As I reflect on Greg Johannson’s story (page 28), I would also add courageous and determined. His is a remarkable story of resilience that reminds us how important it is to support students who are struggling with addiction and mental health issues.

We are growing our student summer internships program. This summer, 21 first- and second-year law students received funding ranging from $5,000 to $12,000 to take up internships locally, nationally and internationally. In addition to providing paid work, these internships offer practical work and life experience and are an excellent recruitment tool.

We are currently working on adding some new student internship opportunities for 2018. It is through the generosity of our donors that we are able to offer such a rich internship program.

Finally, our building renovations are complete—no more scaffolding! Drop by and see for yourselves. I think you will love what we have done to the place, as they say. We have already had plenty of compliments from alumni and friends. All that remains is to finish renovating a few classrooms, which we are planning now, with work to begin next spring.

I will end with a warm thank you to all of our alumni and donors—for your support in so many ways, and for the credit you bring to our law school. You are a great example to our students of the possibilities and opportunities that a legal education offers, and we are proud to claim you as our graduates.

As with any of the past editions, a quick flip through the pages quickly reveals the depth, diversity, strength, intelligence and integrity of the law school’s alumni. Plenty to celebrate! The Dalhousie Law Alumni Association has a rich history of engagement with its over 7,000 members and 11 branches, as well as three international chapters, one in each of the United Kingdom, Asia and the Middle East.

The Alumni Association has been working hard, and will continue to do so, to ensure strong connections between law students and alumni and their alma mater.

A great Alumni Association does not just happen; you make it happen with your support and involvement. The world moves at such a frenetic pace, with complicated issues arising every day to consume our time and thoughts—you may lose touch with those outside your close circle of family and friends. The Dalhousie Law Alumni Association can help you stay connected to former classmates, colleagues, friends and professors, as well as introduce you to new members of the alumni community who join each year as they finish their law degree.

Both the Law School and alumni have a

This is the Atlantic Regional Competition for the Sopinka Cup to select the team to go to Ottawa for the trial moot competition. 08 President Trump: Now what?

Now what, indeed. On Jan.18, just two days before Donald Trump‘s inauguration,thefacultiesofLaw,ManagementandArtscollaborated tosponsorthisevent.Anindicationoftheinterestinthetopicwasthat over300membersoftheuniversityandthewidercommunityattended tohear10experts.DeanFrankHarvey(Arts)introducedthetopicand the two panels, and Dean Camille Cameron (Law) and Dean Sylvain Charlebois(Management)moderated.Thepanelistsaddressedavariety ofissues,fromtrade,tomigration,todefence,tomediaand“alternate facts.”(Note:Whenwesayover300peopleattended,thisreallyisaccurateandnottakingtheleadfromthePresident’sestimateofthenumber of people who attended his inauguration.)

SARA SECK’S research and teaching interestsareattheintersectionofenvironmentallaw,internationalhuman rights law and business law, with a focusonnaturalresourceextraction andclimatechange.Since2007,she hasbeenamemberoftheFacultyof Law at Western University. In 2015, shereceivedtheEmergingScholarshipAwardfromtheAcademyofEnvironmentalLawoftheInternational UnionfortheConservationofNature for her work in advancing environmentallawresearch.Thatsameyear, SeckwasappointedaSeniorFellow withtheInternationalLawResearch ProgramattheCentreforInternational GovernanceInnovation,toundertake newresearchonbusinessresponsibilitiesforhumanrightsaffectedby climate change.

JODILAZAREisenrolledinherfourth yearofthedoctorofcivillawprogram atMcGillUniversity,wheresheholds aJosephArmandBombardierCanada GraduateScholarship.Shehasbeen a part-time Schulich School of Law facultymembersince2015andwas a2014–2015SchulichFellow.Lazare’s doctoralresearchexaminesthepracticeofjudicialrelianceontheSpousal SupportAdvisoryGuidelines,including the underlying theoretical bases of the spousal support remedy, comparativeunderstandingsofmarriage anddivorceacrossprovinciallinesand thelegitimacyofjudicialrelianceon non-legislatedinstruments.Jodihas degreesincommonlawandcivillaw andwasaSupremeCourtofCanada Law clerk for the Honourable Mr. Justice Michael Moldaver.

ADELINA IFTENE is a SSHRC postdoctoralresearchfellowatOsgoode Hall Law School. Currently she is working on transforming her PhD dissertationintoamonograph,which is under contract with University of Toronto Press, regarding the legal issuesraisedbytheincarcerationand treatmentofolderCanadianprisoners. Iftene’s main areas of research andteachinginterestsareprisonlaw, criminallaw,sentencing,evidenceand Charterrights.Herworkisofteninterdisciplinary,employingsocialscience empiricalmethodology,aswellasfeministandcomparativetechniques,to answerresearchquestionsregarding publiclawandcriminaljusticeissues.

She is also a member of the Prison LawAdvisoryCommitteewithLegal Aid Ontario.

n January, Alex Neve (’87), Secretary General of Amnesty International Canada,spokeabouttheglobalrefugeecrisistoapackedMiniLawSchool publiclectureinRoom105attheWeldonLawBuilding.“Thesewordsare whereweneedtobegin,”hesaid:“Allhumanbeingsarebornfreeandequal in dignity and rights.” They are the opening words of the UN’s Universal Declaration of Human Rights.

Refugees are also born free and equal in dignity and rights. Today’s globalrefugeecrisisisanassaultonthathumanrightspromise,andNeve’s mantra is “No right left behind.”

Hearsay had a chance to chat with Neve after Mini Law School, to ask him somepressingquestionsabouthisthoughtsonimmigrationlawandpolicyand how lawyers can help solve the global refugee crisis.

What changes would you like to see made to Canadian immigration law and policy?

Canada has the need and capacity for greater levels of immigration, including higher levels and faster processing of family reunification applications and independent immigration applications. The fundamentals are there— we don’t need a great overhaul, but we do need more resources.

What must Canada do for refugees?

This can and should be Canada’s time to shine.

Last year marked the 30th anniversary of a true high point for Canada when it comes to global refugee protection leadership. In 1986 we were awarded the Nansen Medal, the equivalent of the Nobel Peace Prize in the refugee world. It was the only time the medal was awarded to an entire nation, as opposed to an activist or organization. What better way to mark that anniversary than to devote real diplomatic capital and political leadership to do even more to protect refugees’ rights?

You’ve said that Canadian leaders need to “get scrappy” about standing up for refugees. What’s your definition of scrappy?

In the previous government, more leaders were vilifying refugees and calling them “bogus.” We need leaders who passionately and eloquently talk about protecting refugees and their importance to society. They must

be willing to take it on when they hear and see negative comments about refugees, and then counter those comments through interviews and social media. We’ve seen passion and eloquence from Prime Minister Trudeau, but he needs to be ready to get scrappy under a Trump presidency—he needs to be willing to say to anyone, from the U.S. president to a local negative activist, “That was wrong and cannot stand.” He needs to be willing to fight for refugees.

You’ve also said that the flip side of crisis is opportunity. Where do you see opportunity?

The drowning death of three-year-old Syrian refugee Alan Kurdi in the Mediterranean Sea in 2015 opened people’s hearts. His story raised awareness and changed attitudes.

Suddenly, there were opportunities—there was an election in Canada and leaders made promises to help refugees, Germany opened its borders and two international refugee meetings were held in New York. Those are good first steps, but more work needs to be done.

What discourages you about your advocacy work?

The sadness, sorrow and suffering that’s at the heart of the global refugee crisis. Learning of one death, unjust imprisonment or a boat sinking. When progress is stalled or when we lose ground dramatically at a time when we still have a long way to go.

What inspires you?

The unbelievable resilience and courage of the people on the front lines—the refugees themselves, especially the women, and their determination to survive and thrive. Also the people who work with the refugees, often with little or no resources and at great risk to themselves and their families. The Syrian program in Canada was inspiring, in how it took root right across the country.

What is the Global Refugee Compact you talk about?

There’s a need for such a compact or even a treaty of some sort that will fill the international co-operation gap. Amnesty International certainly agrees, and we have proposed a human rights-based vision of what that would look like. It would include a permanent distribution system of resettlement places, strengthened refugee-determination systems and measures to boost respect for the rights of refugees in countries of asylum, particularly in such areas as adequate standard of living, access to education, health care and economic self-reliance.

What can lawyers do to effect change?

There’s a central place for all lawyers in this struggle, not just immigration lawyers.

They can represent refugees pro bono, which aligns with the law school’s Weldon Tradition. Sometimes refugees have a family law problem, an employment situation or discrimination in trying to find housing. We need to think broadly on how we can help.

Lawyers are a privileged, powerful, articulate sector in society, and they should speak out with some of the extra background and aptitude they carry. Advocacy groups across the country can benefit from their volunteerism. One great initiative is the Refugee Sponsorship Support Program, which trains lawyers to help groups that want to privately sponsor refugees.

This is a troubling time. The refugee crisis isn’t going to go away. Over the next couple of years, we’ll see an intensified assault. It’s more important than ever for Canada to stand firm with a strong message for refugee rights. • H E A R S AY 2017

STUDENTS BRING REFUGEE FAMILIES BACK TOGETHER

ince January 2015, a team of volunteers from the law school has been working with the Immigrant Services Association of Nova Scotia (ISANS) to support refugees from such countries as Uganda, Kenya and Eritrea who are desperate to reunite with a family member they had to leave behind when they fled their homeland.

The Refugee Family Reunification Project is led by supervising lawyer and director of Dalhousie’s Health Law Institute Prof. Constance MacIntosh and retired law professor Dick Evans. Twelve law students—Jennifer Power, Nadia Shivji, Cat Torraville, Nathaniel Ng-Cornish, Paul Chudnovsky, Ryan Gauvin, Liam Campbell, Eric Dwyer, Hussein Rehmanji, Vanja Mitrovic, Sathesh Yogendranathan and Sarah Boucaud—and two practising lawyers, Lori Hill (’03) and Lara Green (’14), round out the team.

Dick Evans attended a public meeting after the call to help Syrian refugees in HRM went out late last fall; after it was over, he asked the organizer what he could do. The response? Help refugees reunite with their families. Evans approached MacIntosh with the request, knowing that she had been supervising a Pro Bono Dalhousie legal-information clinic at ISANS for almost a decade.

“We suddenly were a team of 12,” says MacIntosh. “The students have quickly come to understand that good lawyering turns on developing relationships of trust and being absolutely honest with your clients, especially when the news

is not what they are hoping to hear. I think that having Prof. Evans take a lead role, with his decades of experience with Dalhousie Legal Aid, has been key for the project’s success.”

IMPROVING LAW & POLICY

The team works with governmentassisted refugees who have been referred by ISANS . Family reunification is an objective of the Immigration and Refugee Protection Act. “We can’t guarantee any kind of outcome,” says MacIntosh. “We’re giving the clients hope insofar as we’re giving them legal information about their rights and responsibilities, and a guide through the unbelievable bureaucracy.”

The student-volunteer team lead is Jennifer Power, a 28-year-old former Canadian naval lieutenant who saw a lot of pain and suffering when she was deployed in the Middle East. Last September, when she started law school, she began volunteering at ISANS through Pro Bono Dalhousie. “After my experience in the military, I wanted to help people who were coming to Canada to make a better life for themselves and their families,” she says.

Power plans to volunteer with the Refugee Family Reunification Project until she graduates in 2018. She wants to be a corporate lawyer and calls this her passion project. In addition to reuniting families, Power believes the student volunteers have a responsibility to lobby the government to improve refugee and immigration policy and legislation.

in teams of two, which allows them to support each other while they listen to what are often upsetting stories. Sometimes they have to tell a refugee that they can’t help them because they don’t fit the application criteria.

“It can be completely heart-wrenching,” says Power. “ISANS has great supports if a situation gets too emotional, but we know that we have a job to do—to tell the clients’ story in the best, most honest way we can.

You have to try to set your emotion aside.”

EXTENDING THE WELDON TRADITION

Lara Green and Lori Hill practice at Halifax’s North Star Immigration Law, the largest Canadian immigration law firm in the Maritimes. They were happy to lend their support to the project as pro bono legal advisors. “We’re a resource for the students, and we meet with them one-

on-one if they have questions about their client files,” says Green. “It’s rewarding being part of a team that’s trying to reunite families, especially if they’ve been separated for years.”

Mira Musanovic, ISANS ’s crisis intervention counsellor, can’t overstate the value of the project. “It’s wonderful how quick and passionate the response was of the Dalhousie Pro Bono student program,” she says. “The volunteers jumped in to help at a time when there was no similar service available. If you’re separated from your family, you can’t move on with settlement.

It gives people so much hope when they hear that someone is going to help them with the family-reunification application.

This project is making a huge difference in people’s lives, and the process is part of their healing.”

ect is now under the auspices of Pro Bono Dalhousie, which will help it create more of a structure as it evolves. “We have so many big questions about how to pass on knowledge and keep the momentum going when students leave the project,” says MacIntosh.

She looks back at the past four months.

“It’s incredible how quickly a community of support was mobilized, because we all felt so compelled by the horror of family members being separated and unable to find a way to reunite with their relatives,” she says. “But in order for this project to stay viable we need more pro bono help from practicing lawyers, legal organizations and students.” • For more information, contact probono@ dal.ca or constance.macintosh@dal.ca.

Mandy Woodland’s legal education helped prepare her for the challenges of entrepreneurship

W

hen Mandy Woodland took a criminology course as part of her undergraduate science degree at Memorial University, she found it interesting but had no grand design to become a lawyer. But in 2003, although she liked her job as a medical researcher in a lab at Memorial, she found herself disillusioned with the working environment. That’s when a friend who was attending law school at Western suggested that she might like it. “Law school was random, not a plan,” she says.

In fact, Woodland had an opportunity to do a PhD in molecular biology in the United States.

Instead, she wrote the LSAT, then applied to

Dalhousie and the University of New Brunswick.

She was accepted at UNB and placed on the waiting list at Dal, accepting a position in the first-year class when it was offered.

“Dal was an obvious choice for many reasons,” says Woodland, 40, who is based in St. John’s and was born and raised in Conception Bay in Newfoundland. “It has a strong health law specialization, which is one of my areas of interest. The faculty was so impressive— in diversity, in gender, thought and research.

They were well-published and well-recognized for offering cutting-edge courses, including intellectual property and Internet law, which I was interested in.”

A SOLID FOUNDATION At the time, Woodland had no idea that her legal education would provide a solid foundation for her later entrepreneurial ventures. After earning her law degree in 2006, she worked as a corporate lawyer at Cox and Palmer in St. John’s until November of 2013, when she left to launch Mandy Woodland Law. A registered trademark agent who provides legal services and advice to companies and individuals at all stages of growth, she specializes in Internet and technology law.

“A legal education prepares you to question things and think critically,” says Woodland. “That’s helpful, because as an entrepreneur, you’re expected to know and do everything. You also learn how to work really hard at law school, which you’ll have to do if you want to be successful in business.”

Mooting and contract law were particularly useful to Woodland. “Mooting makes you able to prepare an argument well and think about things from the other side,” she says. “It helps in all aspects of running a business—it allows you to see the perspective of your customers, suppliers and vendors. It also helps you develop the confidence to speak in public.”

ENTREPRENEURIAL DNA In May of 2014, Woodland became an equal partner and the CEO of Caetum. The tech start-up aims to make clinical research easier and more successful through a cloud-based application for budgeting and organizing clinical trials. Caetum grew out of Woodland’s participation in the Master of Technology, Entrepreneurship and Innovation program at Saint Mary’s University.

MooresWoodland—a partnership with digital strategist and PR consultant Karen Moores—was incorporated in May of 2015. Their venture allows the partners to offer consulting services in digital media and privacy (Woodland is the privacy and legal partner).

Woodland has entrepreneurial DNA in her blood; her family owns and operates Conception Bay South-based trucking company Woodland Transport. “When I was ready to open my own firm, I talked to my dad about it,” she says. “He was supportive and said, ’I thought you were going to do that five years ago?’ ” Woodland considers her father to be a role model; he’s still working full-time at age 67, with no plans to retire.

GROWTH AND EXPANSION

By March of 2016, Woodland’s practice had grown enough both in St. John’s and nationally that she hired a full-time lawyer, Emily Lukaweski (’12), whom she met when Lukaweski was living in St. John’s but who now lives in Toronto, where Woodland has clients. In August of that year, she hired UNB articling student Meghan Keating, who lives in St. John’s.

“It’s challenging for us to not have a central office and for us to be in different places, in terms of isolation and communication, because social

interaction in the workplace is important,” says Woodland. “We use Slack, which is a great cloudbased team-collaboration communications tool, and I’m often in Toronto for meetings.”

This spring, Woodland rebranded her business and renamed her firm Splice Legal. “It was time for a refresh,” she says. “When I started it was just me with no long-term plan. As time went on and I acquired more clients outside the local area, I needed a national brand that wasn’t just associated with me. It will still always be me, though, and how we use the brand and interact with our clients won’t change.”

The vast majority of Splice Legal’s clients are entrepreneurs, and many of them are launching their businesses. “They don’t know how to start, so most of their questions are business questions,” says Woodland. “We’re experienced working at the start-up stage—how to incorporate, intellectual property, hiring—the legal building blocks. I like to think that we’re a tiny grain of sand that helps entrepreneurs build their business. We love that!”

Her advice for entrepreneurs? “Surround yourself with your A-team—lawyer, accountant, insurance person and good peers—and make sure everyone is the right fit for you, because those are the relationships that will develop and grow over time. And don’t be afraid to call someone to ask a question. Entrepreneurs are all ’doers’ who think, ’I’m going to deal with this,’ even if they aren’t sure how to do something. I’ve learned that it’s OK to ask for help.”

THE WELDON TRADITION Woodland ensures that the Weldon Tradition of unselfish public service is part of her business model. Over the years, she has volunteered for various community organizations, including the Newfoundland and Labrador Organization of Women Entrepreneurs (NLOWE), the Canadian Bar Association’s Privacy and Access Law Section and the Canadian Diabetes Association (her father has type 2 diabetes, as did his mother).

Last year, Woodland started taking on a couple of pro bono clients. “Giving back is so important,” she says. “It’s how things happen, change and get better. Volunteering was such an important part of

my law school experience—I did Pro Bono Dal and volunteered on student committees and for the Law Journal.” In 2016, Woodland won the St. John’s Rotary Club’s Aidan Maloney Young Professionals Award for community service, and she was also named NLOWE’s Entrepreneur of the Year.

Equally passionate about law and business, Woodland doesn’t plan to focus solely on one over the other at some point in the future. “Both are part of my identity,” she says. “It’s the mix of the two that excites me.” If she had any advice for students or recent graduates, it would be this: “Never think there are closed doors. Always question the norm—there are always options.” •

o what you love—it’s the motto for building a successful career. For Glenford Jameson (’11), that means food, and lots of it.

His passion for being in the kitchen percolated while he was working in hospitality part-time during university.

So it’s no surprise that his culinary interests have led him to become one of the leading food lawyers in Canada.

“It’s important to do something you’re passionate about,” says Jameson, a lawyer and the principal at G.S. Jameson and Company in Toronto. “I wanted to engage with and speak about issues in the food system. I also saw a change in how consumers were thinking about food policy.”

Food law is finally having its moment.

The first national conference, The Future of Food Law & Policy in Canada, was held at the Schulich School of Law last November.

After years of standing in the shadows of health and environmental law, this field is emerging as one of the fastest-growing trends in legal practice. What’s fuelling its growth is more public awareness of food policies and a growing interest in food in pop culture, thanks to such documentaries as Food, Inc. and Fed Up and such books as Michael Pollan’s In Defense of Food and The Omnivore’s Dilemma.

“In 2013 when I opened my firm, food law was still fairly new,” says Jameson.

“Now there is significant interest in the area, particularly from young lawyers.

They’re concerned about what they’re eating. There are major changes now to how food reaches their plate. This is true of food sector organizations as well. They care more about service professionals like lawyers understanding issues unique to

their work. Ultimately, lawyers cater to the needs of their clients, and having an industry focus gives clients comfort that they’re receiving specialized corporatecommercial advice from someone who can also spot sector-specific issues.”

The appetite for food law is growing thanks to rising public awareness about the importance of food safety, new technology involved in food science and increased regulation. In 2014 Jameson, along with five lawyers, founded Food Lawyers of Canada to encourage more networking and support.

“The public is now hyperaware of issues like allergens, the ethical treatment of animals and specialized diets,” says Jameson. “This awareness has driven people to try formerly niche products and think critically about how best to feed themselves. At the same time, the science is changing. Our understanding of what’s healthy, and in what amounts and contexts, 2 0 1 7 H E A R S AY

is rapidly evolving in a regulatory environment where our ability to test and trace is also faster, cheaper and more precise than ever before. It can lead to some unintended legislative consequences and unintuitive regulatory approaches to food problems.”

Being a food lawyer in Canada isn’t easy.

Because it’s a new and emerging field, it’s difficult for lawyers to find support. The food law conference aimed at bridging the gap among not only food lawyers but also between legal academics, law students and policy makers. The idea for the conference came through conversations between Jameson and Baxter, whose research focuses on farmland access, land regulation and how to facilitate sustainable food production.

“The U.S. and Europe are further down the road with programs,” says Baxter.

“Glenford was writing about this, and we connected. He’s a Dal grad and I’m on the faculty, so it was a natural place to hold the conference. Dal gave us strong support.”

That came in the form of financial support through the assistance of Dean Camille Cameron and faculty, staff and students as volunteers.

The conference featured panels on economic development, food and human rights and Indigenous and Northern food systems.

“People sparked conversations and were connecting the dots,” says Baxter.

“This conference was a valuable foundation. The participants came out of the conference with new relationships to others working at the intersection of law and food, including researchers, lawyers and policy makers. We had such a diverse group of speakers and attendees.”

What made the conference special compared to others was the format.

Conference organizers incorporated the Devour! The Food Film Fest in Wolfville, N.S. into the program and hosted a public discussion on food justice at the Halifax Seaport Farmers’ Market with Bryant Terry, the chef in residence at the Museum of African Diaspora in San Francisco.

“We tried to design the conference so people could craft their own experience,” says Baxter. “We provided several different entry points into the conversation around law and food, from panels, to

film, to a public talk. At the same time, we wanted to ensure that there were enough opportunities for everyone to be in the same room and to connect with each other around shared insights. It was also important to us to include the public and to bring some of the key issues into the public consciousness, such as the role of food and law in empowering local communities.”

The conference was a good step forward for Canada to connect with the international food movement. Some American and European law schools have more advanced programs in food law; for example, Harvard Law School has a Food Law and Policy Clinic, and the University of California in Los Angeles (UCLA) plans to open its own clinic this year.

“We want to develop deeper roots in thinking about food law in Canada, by including more course and clinic offerings in law schools,” says Baxter. “Food law today is probably where other legal fields like environmental law or health law were 30 or 40 years ago, so we have a lot to learn from comparative experience in those areas.”

One way that food law is gaining prominence is through Jameson’s popular podcast, Welcome to the Food Court. Considered one of the top legal podcasts in the country, it focuses on a variety of issues.

Currently in its second season, the first four episodes focused on food recovery, public health, local sourced grain for whiskey and food crime.

“I’m amazed that people are listening to it,” says Jameson. “I’ve gotten calls from journalists seeking comprehensive answers to complicated food law questions for 400-word pieces. That’s tough to do, so the concept for the podcast was simply to capture those long-form conversations and present a deep-dive analysis of food law issues.”

Those conversations will continue.

The next food law conference, which will be held at the University of Ottawa, and hosted by Jameson and five other lawyers in November, will cover international policy.

“We want to keep the momentum going, and we need a better sense of who is involved,” says Baxter. “Everyone in this field has a big opportunity to work together.” •

Althoughtheconferenceisover,itsorganizersarealreadythinking ahead. “There’s a lot of enthusiasm for what’s going to happen next year,”saysBaxter.“WeseethisasaconferencethatadifferentCanadian universitymighthosteachyear,tokeepitnational.There’sarealenergy andcommitmentamongfoodlawandpolicyfolks,andwehopethat the next organizers will build on this experience.” •

SEEING THEBEAUTY INCONFLICT INTERVIEW BY PROFESSOR DIANA GINN

P

aul Hutchinson is no stranger to conflict. Born in Belfast, Northern Ireland, he comes from a divided society that was deeply suspicious of difference, fearful about certain geographies and tribal in politics, with people killing and being killed for a cause they believed in while invoking God on their side.

From 1969 to 1998, the Northern Ireland conflict saw over 35,000 shootings and over 10,000 explosions. With the ceasefires in 1994 and a peace agreement in 1998, a new hope came to the country.

Hutchinson is a trained mediator and has worked with community and organizational conflicts and race relations. He was the director of Corrymeela, the oldest peace and reconciliation centre in Northern Ireland, which seeks to model reconciliation in a divided and contested society.

Currently, he works part-time as a member of the Northern Ireland Parades Commission, a quasi-judicial body set up to arbitrate, regulate and mediate contentious parades. He visits Canada regularly and teaches a course in mediation and conflict resolution to second-year students at the law school. He believes that conflict can be good and shares his thoughts on how lawyers are uniquely positioned to be change agents for better societies.

You work in the field of conflict transformation in Northern Ireland and have made five trips to Nova Scotia. How did that come about?

I got involved with Dalhousie and the law school through Martha Martin, a Dalhousie chaplain who spent three months at Corrymeela on sabbatical where I was then director. Martha asked if I’d ever thought of coming to Canada, and I said, “Invite me!” My first trip was in 2014.

You’ve given a number of public lectures in Halifax. In one titled “Don’t make a fuss, we’re Canadian!” you suggested that conflict shouldn’t always be viewed negatively. Can you elaborate on that?

Culturally, many societies perceive conflict as a threat, that only bad can come of a conflict—violence, losing face, injury, loss of status. But there are other options.

When people have a difference of opinion, it need not be the end of the world. In fact, difference is what gives us the delight, wonder, freshness and life that is most enriching about being human. We need to find ways to recognize that conflict is inherent in every relationship, that this isn’t necessarily always a destructive thing and that there are different ways to nonviolently communicate and engage with our differences.

Tell us about the one-credit course at the law school you teach called Theory and Practice of Mediation and Conflict Transformation in Northern Ireland.

The focus is on gaining an understanding of conflict and ways of responding to it.

There is an emphasis on both personal awareness and practical skills. It uses Northern Ireland as a backdrop against which to examine conflict more generally and to consider ways of responding to conflict that will be transferrable to other contexts.

I use Northern Ireland as my primary source of case studies because it looks at the role of policing in society, the powers of the state, the importance of democratic politics and the systemic impact of conflict on a society. I look at cultural responses to conflict in Northern Ireland and see if there are resonances for those living

in Canada. Sometimes it’s easier to see a concept in a new or strange context.

Topics may vary slightly from year to year and could include storytelling as a foundation for the practice of mediation; the personal, interpersonal and structural elements of conflict; the challenges and opportunities offered by mediation, particularly against the backdrop of long-standing conflict; and methods used to build the trust necessary for mediation to proceed.

How are the skills you teach in that course relevant for lawyers?

One, lawyers meet conflict in their personal and professional lives. If they can become aware of their own responses to conflict and develop a few skills, this will assist in both work and home contexts.

Two, learning how to listen is a key task for any mediator or therapist (my background). Listening plays a foundational role in being a good lawyer. However, how many formal training courses in listening have lawyers taken? So my course opens up the concept and practice of deep listening, to ourselves and to others.

You’ve also worked with the Nova Scotia Barristers’ Society and the Young Lawyers Section of the CBA–NS. What are some of the highlights of that work?

I have delivered taster sessions on mediation, mental health and diversity in the workplace. Rather than give 10 easy tips for dealing with each of these subjects, I have focused on making participants personally aware of these subjects in their own lives, then on seeing how these have influenced how they engage with conflict.

Power, who has it and how it’s used have come up in every session.

There aren’t many places where people can talk openly about these subjects in a safe way. We can be afraid of sounding biased, judgmental or flawed. And, of course, we are all of these things! But it’s my experience that if we can create healthier relationships and stronger communication, we will be more productive and effective in our personal and professional lives. This is good for lawyers and their clients.

What insights has your work with the Northern Ireland Parades Commission given you about the relationship between law and responses to conflict?

Parading has had a contentious history in Northern Ireland, with cases of rioting, public disorder, protests and enormous policing operations.

In 1998, local communities couldn’t agree on contested parades, and powers were removed from the police and given to the Parades Commission. By placing legal restrictions on certain parades, violence and protests have significantly reduced.

By calling for certain standards of behaviour, most parades now proceed without trouble. By encouraging communities (in dispute) into dialogue with each other, there are now significantly fewer contentious parades than ever in Northern Ireland. We are constantly trying to balance the right of peaceful assembly, the right to protest and the right to live safely in your home.

There has been much suffering in Northern Ireland, and this can be manifested in a parade. Sometimes the law can assist in limiting destructive behaviours (from both parader and protestor), but it will not heal relationships.

The law can protect the rights of various parties, but it is less able to deal with the painful legacy issues of the Northern Ireland conflict.

What role do you see for lawyers, and for the law itself, in finding ways to live well together with those with whom we disagree?

Good law is foundational for a healthy and prosperous society. Good application of law builds confidence in democracy and seeks to administer justice.

Trust in state actors is vital for building a safe and nurturing society. I come from a society where politics was tribal and partisan, where policing was at times biased and where the state was prejudiced against certain groups. I come from a society where protest against the state sometimes took the form of physical violence. For peace to come in Northern Ireland, all of these institutions needed transformation.

You say lawyers and law students can play a significant role as change agents. What would you tell them?

Lawyers in Canada have an amazing opportunity to be change agents for the greater civic good.

Awareness is key. The more aware you are of what makes you tick, the more skilled you can become as a change agent. Are there certain people you find difficult to listen to? These people can be your teachers. Are there certain issues where you are passionate? You can harness that passion in a way that progresses the issue without dehumanizing yourself or other people.

Become aware of your status when you meet clients—you have power: they are anxious. You can create spaces that allow them to tell their stories in a way that is empowering.

Become aware of how little power you have—systemic issues make us all feel powerless at times. Issues such as racism have a long and entrenched history. These things change slowly—become a marathon runner and not a sprinter.

Lawyers have a strong role to play as educators. The more that citizens are aware of their rights and the laws that can protect them, the more they can seek assistance.

The university could also play a key role in educating students on campus, setting up 'taster sessions' in understanding law for any student to avail themselves of.

Lawyers must create access for minority groups and the marginalized—there is unfortunately not a level playing field when it comes to accessing all services.

I will leave you to consider these questions: Are there clear and easy access points for legal support? Are there certain groups who don’t access legal support because of their position in society or previous negative historical relationship with the law?

People typically come for legal support at a point of crisis and vulnerability—how might knowing this affect how you practice? Law is a high-status role in Canadian society—how will you use this power for the good of your client and for society?

Coming clean

GREG JOHANNSON SHARES HIS STORY OF ADDICTION SO OTHERS WILL KNOW THAT WITH THE RIGHT SUPPORTS, RECOVERY IS POSSIBLE

“

Voluminous readings, high-stakes exams and difficult content” are the main reasons for high levels of mental illness among law students, according to a Lawyers Weekly readers’ survey. Now imagine being a student who is addicted to drugs and alcohol trying to cope with the pressures of legal studies.

Greg Johannson was that student when he began his first year at the law school in September of 2012.

He had started using heroin daily that summer, but he had been abusing alcohol and other drugs since he was 15. “Through that first year of law school my life went downhill fast,” he says. “I didn’t make it through first semester.”

Today Johannson is 33 and looking forward to graduating from law school and continuing his articles in Gander, N.L., where he started last summer.

He has come a long way since his journey with addiction began in his hometown of Vancouver. He says that by the time he was 18, drugs and alcohol were no longer fun—they were something he needed just to get by.

“But I didn’t stop,” says Johannson. “And at 25, I discovered opiates after breaking an ankle and being prescribed oxycodone for pain.” By 29, he

was spending his days getting and using drugs in Halifax’s North End. During his first semester at law school, Johannson began missing classes and assignments and finally spoke to Elizabeth Hughes, the law school’s former Assistant Dean, Academic, and Michael Deturbide, Associate Dean, Academic. They advised him to apply for a medical deferral, which was granted by the law school’s Studies Committee.

“I was struggling to get by,” he says, “but I knew I wanted to come back.”

HITTING ROCK BOTTOM

In the winter of 2013, Johannson was homeless in Halifax. He was alone and had nowhere to go. “As an opiate addict, you wake up every morning with an overwhelming and unbearable physical and emotional pain. Every day is a struggle for survival,” he says. “You live in squalor and you hate who you have become, but the only thing that matters is getting your next hit.” Johannson returned to Vancouver and eventually came clean to family and friends about what had been happening in Halifax.

to Insite, a supervised drug-injection site on Vancouver’s downtown East Side. On a day when his dealer didn’t have anything to sell, Johannson walked to the Vancouver Library to look up rehab centres in British Columbia. He got the number for a treatment centre called Cedars at Cobble Hill on Vancouver Island. Johannson returned to Insite and, after using, sat on a milk crate around the corner from the facility and called Cedars at Cobble Hill.

“The guy who answered the phone heard the sirens in the background and said he had been where I was,” says Johannson. “I thought if he could do it, so could I. Three days later, I was there. Detoxing off heroin was probably the hardest two weeks of my life, but things have been infinitely better ever since.”

After two months, Johannson was sober, and he has remained so since the day he left rehab on May 20, 2013, what he calls his “Clean Day.” He’s grateful for the support he has received from family and friends.

MAKING HIS WAY BACK

For the next seven months, Johannson lived in a recovery house in Victoria, moving out in February of 2014. He and four of his housemates moved into an apartment in Victoria for four months, where he worked in a gourmet restaurant and attended recovery meetings. He moved out in July and returned to Halifax; he had been readmitted to law school and was ready to start first year again in September.

“Professors Hughes and Deturbide were so supportive when I came back,” says Johannson. “An essential part of the law school experience is having someone to sympathize and not judge. It’s easier to be candid about my experience because society has become more accepting of addiction and other mental health conditions. The law school and the faculty and students exemplify that acceptance.”

When Johannson returned to school, he attended an eight-week Mindfulness in Law course, where he benefited from

meditation—it’s something he continues to do because when he does it regularly, it lowers his anxiety and helps him sleep.

“That course is a wonderful support,” he says, citing meditation as the single most important part of his recovery, along with attending regular recovery meetings in the community. To reduce stress, he plays squash, SCUBA dives and does art projects.

GIVING BACK

During second year, Johannson volunteered as a health mentor for students in Dal’s Faculty of Health Professions. He told his addiction-and-recovery story to them to build compassion and so they could learn how patients can manage their own conditions and care in tandem with the support of health professionals.

That same year, Johannson worked in a recovery house on Robie Street called Alcare Place, where he was a night-shift supervisor. “I loved it,” he says. “Most of the time nobody broke curfew and nothing went wrong, so I just did homework.” In 2015, he was on the executive of the law school’s Sober Support program, which helps students be safe at events where alcohol is present.

Johannson is very active in his recovery; he has a sponsor who helps him come to terms with his demons, attends weekly recovery meetings and tells his story at Halifax detox and treatment centres and hospitals. He was available to do informal peer support with other law students because he knows firsthand how important it is to have accessible support systems. In addition to turning to Professors Hughes and Deturbide when he needed help, he also talked to a counsellor at Dal’s Counselling and Psychological Services.

“I want other students to know that I understand what it’s like to feel hopeless, and that with the right supports, recovery from addiction is possible,” says Johannson. “We’re all in this together at law school, and knowing you aren’t alone as you struggle through mental health issues is so important.” •

At the Scene of the Crime Social media intelligence for trial lawyers

by Rachael Kelly Shifting uncomfortably on a bench in Halifax’s Point Pleasant Park, a 23-year-old bank teller glared at his digital watch: 3:13 a.m. Closing his eyes, he questioned his decision to wander into the park in the middle of the night. He squinted in the dark, trying to sort out the different shapes in front of him.

Something snapped a few metres to his left. Reflexively turning toward the sound, the teller was surprised to see another man stumbling through the treeline, angrily pushing branches away from his face. When the man noticed he wasn’t alone, he came to an abrupt, startled stop. The newcomer was wearing a red sweatshirt and jeans, but the teller couldn’t see his face clearly. He could, however, make out the glint of the gun that he held tightly in his right hand.

Police found the teller’s body a few hours later. Cordoned off with strips of yellow tape, his shoulders were slumped. A single bullet had punctured the left lapel of his winter coat.

L

ooking to recreate that event a few months later, a trial lawyer clicked on a program on her laptop called TrialDrone. The intelligence-gathering software tool was designed to search and analyze billions of social media posts published under “public” privacy settings. Entering the geographic location of the murder into a more nuanced version of a search box, along with keywords and phrases associated with the case, she drew a 300-metre circle around the crime site.

Finalizing her search criteria, she started looking for information posted within 48 hours of the murder. She was looking for any and all posts that could either identify a potential witness or describe the event in question.

A list of posts that TrialDrone considered to be relevant to the lawyer’s case materialized on her screen. Bingo! It turned out the two men weren’t alone in the park after all. A Twitter user had updated his status at 3:16 a.m. just 20 feet from the scene.

He had posted something about a “shot heard round the park.”

While the events described above are fictitious, the software described to find the Twitter user isn’t. Launched in February of 2016, TrialDrone uses a set of algorithms and data-visualization tools to navigate the seemingly unnavigable ethosphere of social media and turn it into “actionable social media intelligence” for lawyers.

result of a keen investigative mind and a passion for wrongful conviction law. The program searches and tracks open-sourced posts (where source code is available to the general public) such as photos, blogs, boards, newsfeeds and videos on major social media platforms like Twitter, Instagram, Tumblr, YouTube, VKontakte (otherwise known as VK, a Russia-based social networking service) and Sina Weibo (a Chinabased social media and microblogging platform).

The software has four main uses: event recreation, to find eye witnesses and evidence intentionally or unintentionally documented on social media; witness intelligence, to see what and when a witness publicly posted about a case; social media link analysis, to identify a witness’s social circle and hone in on potentially undisclosed relations; and real-time alerts for live monitoring, to receive social media updates made by a witness in real time—something that could alter the trajectory of a case currently in front of a judge.

Traditionally, an investigator would go to a scene, knock on doors, take statements and present the resulting evidence to a lawyer. While it’s unlikely this kind of hands-on approach will ever completely disappear, TrialDrone’s seek-and-find technology is an efficient, costeffective way to scour hordes of data related to a case on the Internet.

“There are billions of potential users whose libraries we’re able to look at. That’s a lot of people,” says MacDonald. “Think of the largest corporations in Canada or the United States— even they wouldn’t be able to pay for the investigative resources to physically go out and manually search for all this information. It would be next to impossible.”

Prof. Robert Currie (’98), the Director of the Law & Technology Institute at the Schulich School of Law, met MacDonald in law school

(MacDonald was one year behind him). Currie recalls MacDonald being “bright, intense and more mature than the average law student.”

He believes TrialDrone is a “great evidencegathering tool” for both the Crown and the defence. While Currie touches on the idea of social media surveillance in his International Criminal Law course, his approach is usually from the perspective of the state. He admits that TrialDrone’s capabilities—and its potential to shape the practice of criminal law—would “definitely be of interest” for future Evidence and Criminal Procedure classes.

The biggest impact social media has had on criminal law is that it has created “a great deal more evidence than ever before,” says Currie.

This is two-pronged. More generally, the existence of social media means there’s a greater amount of evidence that is admissible in court.

It also means there’s much more evidence available to help police with their investigations.

“People who witness crimes will sometimes comment about it on social media, regardless of whether they call the police,” says Currie.

“A famous example of this was the Stanley Cup riots in Vancouver, where people posted a lot of video—so much that the police were able to put together a massive video database that let them identify numerous perpetrators and witnesses.”

When MacDonald was seven years old, he used to help his father, Blaise (’77), study for his law school exams. “My dad would have cue cards, and we’d go through precedents together,” says MacDonald. “He would ask me to name a case, and then he’d tell me what the ratio was.”

When MacDonald was 16, he started working for his father’s firm part-time, serving statements of claim and subpoenas. He was always interested in witnesses’ reactions to being served, and that work eventually inspired him to become a full-time private investigator.

The existence of social media means there’s a greater amount of evidence that is admissible in court. It also means there’s much more evidence available to help police with their investigations. �I used to be the person who would go to a scene and knock on doors to see if anyone had any information. I’ve been through the manual part of this equation, so when I talk about TrialDrone in terms of its efficiencies, I know what kind of manpower it takes.”

Although MacDonald retired from investigative work when he was called to the Bar, he uses those research skills every day. “The rationale behind starting the company was my dream to work exclusively on wrongful conviction files,” he says. “The problem with that dream is that wrongful conviction files are pro bono files. I wanted to figure out a way to generate income and, at the same time, practice the kind of law that I Iove. This technology came around at the perfect time.”

TrialDrone’s software is modelled after the Navigator program created by a Halifax-based company called LifeRaft. The cloud-based, opensource intelligence program was designed to help corporations identify and prepare for threats to corporate security. Like TrialDrone, it targets and gathers real-time open-source data, specifically filtering posts to identify issues that could affect staff or assets.

But where Navigator is tailored for global security operations and fraud and loss-prevention professionals, TrialDrone is restricted to lawyers who are preparing for real or anticipated corporate transactional work or criminal or civil litigation. “Our clients are exclusively people who are members of the Bar and are involved in preparing a file for a client,” says MacDonald.

“This is groundbreaking technology. It’s kind of like having a cable television licence before cable television became the norm.”

A proud Cape Bretoner, MacDonald headquartered the company in Halifax because he feels it’s where TrialDrone is best suited to grow.

“Nova Scotia is my favourite place in the world,”

he says. “I want to come home permanently.”

If the company grows, MacDonald wants the jobs to be in Nova Scotia. “I believe TrialDrone has the potential to be an unbridled success.

When you go to New York or Washington or Virginia or Los Angeles, it becomes clear that we are the first company in the world to offer this kind of technology specifically to lawyers. The dream is to have a company that is successful so I can do things I want to do in the area of law that I love.” •

LIKE BIRDS OF A FEATHER Glenn Dodge (’94) shares how the class of 1994 stays connected 23 years after graduation

A

s with most university graduates, law students tend to go their separate ways and lose touch, with the exception of a few people meeting every 10 years to celebrate a reunion. The Class of ’94 is unusual in this respect, and for that I take the blame. Elected a “life officer” for our class just before graduation, I decided that it would be a shame for us to fall out of contact, so I’ve kept a directory for our group that has been updated and shared annually for the past 23 years.

We’ve celebrated major milestones throughout the years, including marriages, births of children and grandchildren,

appointments and awards. We have also grieved together for the two members of our class who have passed on, Donna Smith and Lloyd Symons. We see each other every five years to laugh over greying hair and the need to put on reading glasses to see our dinner menus, and we remember fondly the years at Dal Law that brought us together in the first place.

Having an annual record of our comings and goings also puts our class in the rather unique position of tracking where we’ve ended up after such a long time, and the results are interesting, and in some cases, surprising. What follows are the results of my very unscientific survey of my classmates over the years

Though Dal Law prides itself as a national law school, and with good reason, the vast majority of our class did call Nova Scotia home, and it seems that most are happy to keep it that way. Over a third of our class, more than 50, still live in Nova Scotia. Similar trends appear for Ontario and B.C., whose numbers together roughly equal the Bluenosers.

For the most part, the graduates originally from those provinces have also chosen to return. The Class of ’94 was often on the move, especially in our first years after graduation, but it seems the call of home was irresistible, except for those with the urge to continue roaming.

As someone who was an international vagabond for several years, with Nigeria, Tajikistan and Laos among my ports of call, I understand the lure of a new location. Their numbers aren’t legion, only a dozen or so, but some members of the Class of ’94 have relocated farther afield.

The United States is the most popular destination, particularly California, but others have opted for England, Kenya, Turkey, Hong Kong and the Cayman Islands, providing some exotic possibilities for future reunions.

TAKING CARE OF BUSINESS

For a profession that is often maligned as

overly stressful and demanding, many of our class have found private practice to provide a rewarding career. More than a third of those who confirmed their places of employment are still working in a law firm. These vary from those who opened their own small firms to those working in national and global firms. A small percentage articled with the same firm that they now support as senior partners.

Almost equal to this number are those who decided to work in the provincial or federal governments, either as Crown counsel or in another capacity.

Private industry, including those who serve as in-house counsel, has been the

calling of approximately 30 classmates.

From there, the numbers drop rather dramatically. Despite the stellar examples found within the Dal Law faculty, only a handful of the Class of ’94 decided to follow their lead and opt to become professors, including Cynthia Chewter, or otherwise support the world of academia. The not-for-profit world also has limited representation among our group, with seven people working for societies, foundations and other charitable organizations.

Surprisingly, given the number of highly charged political debates that

were heard around Weldon and, more sloppily, at the Dome, the number of people who have chosen a life in politics is minimal. Only one identified this as her primary profession.

Queen’s Bench (Jolaine Antonio). Twice that number have now retired after long careers in their chosen profession, much to the envy of those like me who are likely on the Freedom 90 plan.

TO THE BEACH

After more than 20 years in the workforce, the Class of ’94 has contributed much to its profession, and this service has begun to be recognized in a number of ways in recent years. At least five members of our class have been awarded the prestigious Queen’s Counsel designation: Tamasine Davies,

Two of our classmates, Shawna Hoyte and Heather McNeill, have been recognized for their years of community service, including their work with Dalhousie Legal Aid Service. Shawna was inducted into the Bertha Wilson Honour Society in 2014, and Heather received the Distinguished Service Award from the Nova Scotia Barristers’ Society that same year as well as the 2015 Weldon Award for Unselfish Public Service. Juan O’Quinn received the Gordon M. Stirling Distinguished Service Award from

the Law Society of Newfoundland and Labrador. And if I can be forgiven for blowing my own horn, I’m the proud recipient of the 2016 Dalhousie Alumni Association Award for Volunteerism.

The past 23 years have seen many changes for the Class of ’94, both personally and professionally. I’m sure few of us could have guessed all those years ago the turns that our lives have taken, and fewer still are likely to make any predictions as to what is yet to come. It has been a fascinating journey to share with my classmates and my privilege to record it. •

STEWART MCINNES

Halifax, Nova Scotia

Stewart McInnes (’61) gave back to his community and country in the broadest sense of the word. He made exceptional contributions to the legal profession, his community, business, non-profits and charities as well as to Canadian and politics.

Nova Scotia. He was president of the School for the Blind, the Hearing and Speech Clinic, the Halifax Club and the North British Society. He was instrumental in bringing back Symphony Nova Scotia from bankruptcy and breathing new life into it. And this highlights just a few of his contributions.

McInnes practised at McInnes Cooper in Halifax for over 38 years. He was the president of the Nova Scotia Branch of the Canadian Bar Association, a member of the Nova Scotia Barristers’ Society Bar Council and a director of the Law Foundation of Nova Scotia.

He served on the board of governors and board of directors at Dalhousie University, Grace Maternity Hospital, the Halifax Foundation, the Canada Summer Games, the CNIB and the World Wildlife Fund Canada.

McInnes also served as a Member of Parliament for Halifax and as a Member of the Federal Cabinet from 1984 to 1988.

McInnes’s work in his community was extraordinary. He fundraised for many organizations, including the Brunswick Street Mission (an organization to help those struggling with poverty) and the ALTA Gymnastics Club. He also made a difference by leading the way on philanthropic initiatives, including his role as Chair of the Halifax United Way, the Dalplex Campaign and the Canadian Mental Health Campaign

McInnes received the Queen’s Gold and Diamond Jubilee Medal in 2002 and 2012, respectively. He was an honorary degree recipient of Dalhousie University and received the Dalhousie University’s Alumnus of the Year recognition in 1998.

The law school is proud to call Stewart McInnes one of its own. His daughter, Sarah McInnes ('12), accepted the award on behalf of the family at the school's 2016 Law Alumni Reunion Dinner. He died on Oct. 4, 2015, of heart failure. He was 78. •

InthewordsofRossiter(’78),“ChiefJusticeEdmondBlanchardwasadiligent,confidentandbright individual.”Fromfollowinghispoliticalcareerasa cabinetministerinFrankMcKenna’sgovernment tohisappointmenttotheFederalCourtandlater ChiefJusticeoftheCourtMartialAppealCourtof Canada,thetwobecameclosercolleaguesfollowing their25threunionin2003andthroughBlanchard’s work with the Tax Court of Canada.

Speaking of his colleague’s time on the Canadian Judicial Council and Federal Court, Rossiter remarked, “He carried himself with a quiet demeanor,alwaysveryrespectfulofotherswitha pleasantwitandstrongcommunicationskills.He madeahugecontributiontoCanadainhislifetime not only as a politician but also as an impressive jurist, and handled (in a very professional confidentmanner)manytasksfortheCanadianJudicial Council.Hewasrespectedbyhiscolleaguesand held in great esteem.”

TohonourthelifeandlegacyofalumnusCharles J.Meagher (’83)—whosedistinguishedlegalcareer anddedicationtopublicserviceearnedhimaplace in the BerthaWilson Honour Society in 2012— afundhasbeencreatedinhisnametosupportthe lawschool’slong-heldtraditionofLawHour.The fundwasinitiatedwithagenerousgiftof$10,000 fromtheestateofChuckMeagherandover$15,000 fromthefirmandlawyersofBurnettDuckworth andPalmerinCalgary.Thefundcontinuestogrow withthefundraisingeffortsofDarylFridhandler (‘83) and John Rogers (‘83).

Since1960,LawHourhasbeenanopportunity forstudentstorelateclassroomtheorywithreallifeperspectivefromlawyers,judges,politicians, academicsandprominentpolicymakersacross Canada and the world.

Affectionatelyreferredtoas“Chuck”throughout hislife,MeagherwaspresidentoftheDalhousie LawStudents’Societyfrom1982–1983 and,asa student, hewasactivelyinvolvedinorganizing speakers for Law Hour. The Charles (Chuck) J. MeagherLawHourFund ismeanttoembodyhis commitmenttothelawschool,legaleducationand the greater Dalhousie community as a whole. •

In 2015, the Class of ’74 received the inaugural Dean’sCup,whichisawardedtoclassfundraising projectsthatreacha$100,000milestone.Alumni membersandformerclassmatesMaryClancy,Brent CotterandBruceArchibaldwereonhandtoreceive theCupfromDeanCamilleCameronduringthe annualAlumniReunionWeekendcelebrations.

“This is a group that makes things happen,” said Clancy at the time.

The award, which was established in 2009 by classmatesJimColeman,FredFountainandDavid Meadows, provides up to six bursaries annually tostudentsinneedatthelawschool.Eachofthe bursaries is named after a “beloved” professor: MurrayFraser,InnisChristie,JohnYogis,BillCharles, Hugh Kindred and Peter Darby.

Thefundhasgrownfromamodest$7,400to agrandendowmentofover$165,000withanadditional$20,000inpledges.Since2010,13students havebenefitedfromatotalof$25,100inawards.

“Simplyput,ifyoudowell,youshouldgiveback,” saidClancy.“Universitiesarehugelyimportantto the community in every way.” •

IN MEMORIAM

EDWIN ADLARD LEBLANC (’52)

died on Jan. 10, just four days before his 92nd birthday. He attended the Maritime School of Pharmacy, then obtained commerce and law degrees from Dalhousie. He was secretary and general counsel of Nova Scotia Light and Power Company and Nova Scotia Power Corporation for 33 years.

He was actively involved in the community and the prime force behind Junior Achievement in Nova Scotia, having introduced the program to the business and education communities in 1959 as a project of the Halifax Junior Chamber. He was known for his interest in sports, particularly hockey with Dalhousie Varsity and Halifax Junior Centrals (Nova Scotia Champions) and his participation in the first round of the Memorial Cup. He also had a passion for trout and salmon fishing.

GLAUDIO (JOSEPH) RIZETTO (’54)

died on Nov. 19, 2016, in Glace Bay, N.S. He graduated from high school at the age of 16 and obtained a bachelor of science degree from the University of Ottawa in 1951, followed by a law degree from Dalhousie. He led a passionate life with a wide array of interests, including hockey, cooking and bargain hunting. He was always active, dancing and socializing all night long on his 90th birthday in August.

DAVID I. JONES (’56) died on

March 2, 2017 at the age of 89. He was educated at Saint Mary’s University before attending law school. He practised law for over 50 years in Dartmouth. At retirement, he was a partner of Russell Piggott 58

Jones, in practice with his son, Martin Jones (’83). He was an active member of the provincial and federal Liberal associations. He was a member of the Barristers’ Society’s Committee for the Establishment of Nova Scotia Legal Aid and of the board of directors of Nova Scotia Legal Aid. He was also a member of the board of governors of Saint Mary’s University and the board of Metropolitan Community Law Clinic. He was a member of the Nova Scotia Barristers’ Society and Canadian Bar Association. He served as an executive member of Banook Canoe Club and was a founding director of the Society for Canoe Championships and Associations. David incorporated the East Preston Day Care Centre and was a member of its board for several years. He was Advocate of Dartmouth Council 3133 and State Advocate for Nova Scotia.

DAVID W. GRUCHY (’57) died on May 22, 2016, at the age of 84. He was educated at the University of King’s College and Dalhousie. From 1958 to 1990 he practised law with Burchell, MacDougall and Gruchy and was solicitor for the Town of Truro from 1975 to 1990. He was appointed to the Supreme Court of Nova Scotia (Trial Division) in 1990, where he remained until his retirement in 2007. After retirement, he served on the Nova Scotia Criminal Review Board, the Nova Scotia Securities Commission and as chair of the Nova Scotia MLA Pension Review. He was an active member of his community and enjoyed musical and sporting pursuits.

ALLAN ROBERT BREMNER O’BRIEN (’57) died on Feb. 24, 2016, in

Paris, where he loved spending his winters. He attended the University of King’s College, then Dalhousie, where he obtained a law degree, after which he earned an MBA at the University of Western Ontario.

During his career he held a number of positions, including solicitor for the Interprovincial Pipeline Company, national director of the Liberal Party of Canada and partner with Gowlings LLP. He was also gourmet chef and head gardener at The Manse Country Inn in Mahone Bay, N.S., from 1996 to 2007.

JOSEPH PELRINE (’58) died on March 12, 2017. After graduating from Dalhousie University with his law degree he practiced five years in Halifax and then in Vancouver, retiring from the former Davis & Company in 1997. He took delight in logical and rational thought and conversation, followed political events around the world and enjoyed the intricacies of classical music and opera. He also had a great sense of humour and was a lifetime fan of the Montreal Canadiens.

GEORGE FRANCIS WALLACE INRIG (’58) died on May 21, 2016,

at the age of 87. He earned a Bachelor of Arts from Queen’s University and then his law degree at Dalhousie University followed by a master’s degree in comparative law from the Southern Methodist University in Dallas, Texas. After completing his education he taught law at Dalhousie for two years before moving to Ontario where he was appointed judge of the Provincial Court of Ontario

(Criminal Division), a position he held for over 30 years.

George believed in keeping journals, and when something memorable happened he would say, “Write it down!” His greatest gift to his family, a 631-page book of memoirs entitled Who Cares!, was completed in 2013 for his grandchildren.

WENDELL EARLE FULTON (’60)

died on Sept. 18, 2016. After obtaining a bachelor of arts degree, a master of arts degree and a law degree, he spent his career as a teacher, civil servant, lawyer, journalist and politician.

F. B. WILLIAM KELLY (’67) died on May 13, 2016, at the age of 79. He obtained a bachelor of arts degree from St. Dunstan’s University at UPEI, then a law degree at Dalhousie. At the beginning of his career, he practiced civil litigation and criminal law and served as a labour arbitrator and Small Claims Court adjudicator. He retired from the Nova Scotia Supreme Court in 2009 after 24 years on the bench as a justice. He was a judge of the Nova Scotia Family Court in 1984. In 1985 he was appointed a judge of the Nova Scotia Supreme Court, Trial Division, and when that court merged with the County Court in 1993, a member of the Nova Scotia Supreme Court.

JOHN BAIGENT (’69) died on Dec. 3, 2016. He obtained a bachelor of arts degree at Loyola College (now Concordia), then spent two years in Ghana teaching high school as a CUSO volunteer. When he returned to Canada, he ran CUSO’s West Africa program. He obtained

law degrees from Dalhousie and Harvard, then spent 20 years practising labour law in Vancouver. He then founded and ran Partners in the Horn of Africa, a Canadian aid organization that focused on efforts of Ethiopians to partner on projects they chose for their communities. He spent much of the last 15 years living and working in Ethiopia.

THOMAS BERNARD AKIN (’77)

died on Sept. 28, 2016. He earned a bachelor of science degree, an MBA and a law degree from Dalhousie. For over 40 years, he was a tax lawyer at McCarthy Tétrault in Toronto and one of the most respected tax practitioners of his generation. He was named one of Canada’s top tax advisors

by International Tax Review.

DENNIS PATRICK HOLLAND (’80)

died on April 29, 2016, at the age of 62. He spent 27 years in law as a civil servant and dedicated 14 years of volunteer service to the Canadian Red Cross.

PETER ERIC JAMES (JIM) PRENTICE

(’80) died on Oct. 13, 2016. He

obtained a bachelor of commerce degree from the University of Alberta in 1977, then a law degree from Dalhousie.

He practiced law for 20 years, specializing in property rights and in the resolution of First Nations land claims. He served as commissioner and co-chair of Canada’s Indian Land Claims Commission from 1993 until 2000. He was elected a federal member of Parliament for Calgary Centre–North in 2004, and from 2006 to 2010 he was one of the most senior ministers

in the Canadian government, serving time as Indian affairs and northern development minister, industry minister and environment minister. In 2010 he returned to the private sector as senior executive vicepresident and vice-chairman of the Canadian Imperial Bank of Commerce. He returned to public life in 2014 and became the 16th premier of Alberta, serving until May 2015.

MICHAEL EMERSON DUNPHY

(’81) died on Oct. 11, 2016, at

the age of 63. He attended the University of Notre Dame in Indiana, completed his MBA at the University of Western Ontario and, after obtaining a law degree at Dalhousie, enjoyed a distinguished career at Cox & Palmer for over three decades. He was a leading civil litigator and was recognized by the American College of Trial Lawyers, Lexpert, Best Lawyers and Benchmark.

WAYNE MARRYATT (’81) died on Sept. 15, 2016. He obtained his bachelor of commerce, master of science and law degrees from Dalhousie, then began practicing law with Daley Black and Moreira (a predecessor firm to McInnes Cooper) in 1982.

He joined McInnes Cooper in 2006, at the time of the merger with Patterson Palmer. Among his career highlights, and true to his sense of adventure, he represented four investors in connection with the purchase of an interest in Oak Island and the hunt for its treasure.

DIANNE LOUISE POTHIER (’82)

died on Jan. 3, 2017. She earned an undergraduate degree at Dalhousie, followed by a

master’s in political science at Carleton and spent a year as a parliamentary intern. She then obtained her law degree at Dalhousie, winning almost every academic prize available, including the University Medal in Law. She clerked with Justice R.G. Brian Dickson of the Supreme Court of Canada, then served as senior advisory counsel to the chair of the Canadian Labour Relations Board. In 1986, she became a faculty member of the law school, where she made leading contributions in her teaching and research to constitutional law, labour law and public law.

She was Canada’s leading legal scholar and activist on disability and the law.

COLIN HUNTER MACLEAN (’90)

died on Feb. 21, 2017. He obtained a bachelor of arts degree from the University of King’s College, then a bachelor of education and bachelor of law degrees from Dalhousie.

While at law school, he was appointed university ombudsman. During his career he both taught at and worked with the administration of the Nova Scotia Community College. He later became president and CEO of the Waterfront Development Corporation.

BERNADETTE CHRISTINA

MAXWELL (’91) died on Sept. 11,

2016. For nearly 20 years, she worked as a nuclear medicine technologist and earned bachelor of arts and law degrees.

Following law school, she and her husband, Ron, and their dear friend Nancy Elliott set up the law firm Stockton, Maxwell & Elliott, from which she retired in 2009. She was also an accomplished painter.

SHAUN MACMILLAN (’09) died on Aug. 27, 2016. He earned his bachelor of arts (honours) degree and master of arts in English from Dalhousie, then his law degree. He began his legal career with Blois, Nickerson & Bryson LLP and later joined Eastlink as in-house counsel.

FRIENDS OF THE LAW SCHOOL MAIRI TERESA ST. JOHN MACDONALD died on March 4, 2017. She

was the beloved sister of Ronald St. John Macdonald.

NIGEL SIMON RODLEY died on Jan. 25, 2017. He attended Clifton College in Bristol, England, obtained his law degree at Leeds University and did postgraduate degrees at Columbia University and New York University. He later became Amnesty International’s first legal officer. Nigel was not only a diplomat who focused on the need to stop torture but also a scholar and an educator.

IAN TOWNSEND-GAULT died in August 2016. He served for several years as Associate Professor at Dalhousie, in both the Schulich School of Law and the Institute for Resources and Environmental Studies. He co-founded the Marine Affairs Program as well as the Oceans Institute of Canada.

JAMES TIMOTHY (TIM) YOUNG

died on Dec. 31, 2016. He was beloved by the students at Dalhousie, where he worked for many years as a custodian and groundskeeper, so much so that he won an award for favourite university employee that is normally given to faculty. • 2 0 1 7 H E A R S AY

In a decision released in March 2017, the Nova Scotia Court of Appeal, in reasons penned by Justice Jamie Saunders, included the following paragraph: Sadly, Ms. Dianne Pothier, of counsel for the Disability Rights Coalition, died shortly after the hearing. Her customary wise counsel, meticulous preparation and ability to identify and explain the truly important features and consequences of any given case will be missed. Not surprisingly, she advanced very strong and persuasive arguments on behalf of her client at the appeal hearing. I intend to borrow heavily from her submissions in explaining my reasons.

This apparently unprecedented paragraph both captures the respect the legal community had for Dianne Pothier (’82) and signals the magnitude of the loss caused by her untimely passing.

ianne was a daughter, sibling, aunt, great-aunt, friend, colleague and inspiration to many. Born into a workingclass community in the north end of Halifax, she excelled in school and took her first degree at Dalhousie, majoring in political science. She pursued her MA at Carleton University where she met several colleagues, some of whom went on to become Canada’s leading progressive political scientists and commentators. But in 1979 Dianne chose law rather than political science as a career path, although her subsequent work was infused by her political science background.

As a visually impaired student at Dalhousie Law School in the late 1970s and early 1980s, Dianne experienced barriers, challenges and discrimination. Nonetheless, her spirit and passion were strong and her intellectual brilliance was undeniable. She graduated in 1982 winning almost every prize available, including the University Medal in Law. Ottawa then beckoned. Dianne was offered perhaps the most prestigious job open to any law student: a clerkship with the Chief Justice of the Supreme Court of Canada. The incumbent was Brian Dickson, who is still venerated as one of Canada’s most significant Chief Justices. This was the early years of the Charter, and Dianne assisted the Chief Justice with some very significant cases. On completion of her term at the Court, Dianne remained in Ottawa for several more years working with the Canada Labour Relations Board.

In the mid 1980s, Innis Christie (Dianne’s former professor and then Dean) decided that Dianne’s talents were underutilized in

Ottawa, and that it was time for her to come home. It took a while to persuade some colleagues that a visually impaired person could teach law, but in 1986 Dianne was hired as an assistant professor, with a mandate to focus on public law, constitutional law and labour law.

Over the course of 25 years, Dianne became one of the pillars of Dalhousie Law School. Her contributions to teaching in the areas of public and constitutional law helped Dalhousie create one of the best public law offerings in the country, especially because of the strong emphases on equality law and Aboriginal rights. The truth, however, is that Dianne found teaching very difficult, even exhausting. She spent countless hours not only during term but also in the summer and winter breaks, preparing the materials and ensuring a rigorous legal education for the students. Unfortunately, neither we the faculty nor the students ever fully acknowledged her contributions in this regard.

However, Dianne did receive appropriate respect and recognition for her scholarship and advocacy. For three decades, she was driven by one core value: to fight for social justice and the equality rights of Canadians who were marginalized and oppressed. Unlike many legal academics, Dianne was an idealist—she truly believed that law, properly developed and interpreted, could be an engine for progressive social change. This commitment manifested in her scholarship where she combined compelling personal narrative and incisive legal analysis to destabilize conventional wisdom and identify achievable alternatives. In so doing, she became recognized by many (and feared by some) as one of Canada’s most important equality rights scholars. This was especially true of her contributions to critical disability theory.

Dianne converted her idealism into practice. She was deeply involved in multiple equality rights cases, running the gamut from race, class and gender to sexual orientation and disability. Sometimes she was an advocate in court; in many other cases she was in the background drafting memos, facta and providing critically constructive feedback. Think of the groundbreaking cases R.D.S., Eldridge, Meiron, Blencoe, Auton, to name but a few. Dianne also contributed to progressive advocacy organizations, including the Disabled Women’s Network, the Legal Education Action Fund, the Court Challenges Programme and the Canadian Association for Community Living. For this work she was appropriately celebrated through, for example, the Frances Fish Women Lawyers’ Achievement Award, the CBA President’s Award and the Bertha Wilson Honour Society Award.

Dianne retired from Dalhousie in 2012, but she did not retire from social justice practice. In fact, she redoubled her efforts. She intensified her commitment to Dalhousie Legal Aid, she rejoined the Nova Scotia Barristers’ Society and she reignited her litigation practice in various contexts, including challenging the newly enacted assisted dying legislation and advancing the human rights of those who require supportive housing.

There is so much more to be said about Dianne: her extensive but underappreciated contributions to the Dalhousie Faculty Association; her support for generations of students with disabilities and accommodation needs; her fearless directness; her pride in being Acadian; her (ironically) inaccessible office; her poignant

interventions in faculty seminars; her frustrating perfectionism; her baking; her ritualistic slaying of her breakfast eggs; her wry wit; her capacity to work all night and wear pyjamas all day (if she could get away with it); her joy in swimming for hours in the freezing waters at Summerville Beach; her disconcerting capacity for silence when travelling or having dinner together; her exquisite taste in vernacular arts and crafts; her generosity, both material and spiritual; her incomparable karaoke talents (including “The Rose” and “White Rabbit”); and her quiet, but profound and unwavering, love for her family and friends.
