Dear Mr. Richardson: Does the summary of executive session minutes need to show how long session was? – C.L.

Dear H.F.: The Open Meeting Act limits what can be discussed in closed session. Boards that violate this by going beyond the limited topics allowed by Civil Code Section 4935 risk not only the mistrust of their neighbors, but also risk the argument that the board’s decisions are legally invalid because they were outside the association’s legal boundaries. The Open Meeting Act is not perfect, but it is generally good for HOA governance, and there is no reason to suspect it will go away in the future. – Regards, Kelly

Dear C.L.: The Davis-Stirling Act does not specify if the starting or ending time of a board meeting (closed or open session) must be recorded in the minutes. Corporations Code Section 1500 requires corporations to “keep minutes of the proceedings of its shareholders, board and committees of the board...”Civil Code Section 4935(e) requires only that the minutes of the next open meeting contain a “general note” of actions taken. Minutes serve to document board motions and outcomes, reports received by the board, and which directors were in attendance.When I take minutes, I customarily note the beginning and ending times, but I cannot find any provision in the Corporations Code or Civil Code requiring this. –Thanks, Kelly

Dear Mr. Richardson: The board closed meeting agenda is posted on the window of the HOA office as follows: “Legal, contracts, personnel, members matters.” There is no detail under those categories. My contention is that the posted closed session agenda is not an actionable agenda and that the detailed agenda provided to each board member should be the one posted but with redacting names.Would you please provide your position in this matter. – Sincerely, H.M. Dear H.M.: The posted agenda should be sufficiently informative so that homeowners can know generally what is planned for discussion, even in the closed session. Some more specificity than just listing the blanket categories is necessary to provide some transparency while still protecting the privacy of the members involved.Since the minutes of the next open meeting must per Civil Code 4935(e) “generally note” the “matters discussed in executive session,” it would seem reasonable that the posted agenda should match this level of specificity. – Sincerely, Kelly

Kelly: Is an HOA management company a third party so the board can discuss its contract in executive session? Our new manager says so. I disagree. – M.M. Dear M.M.: A manager who is not a direct employee of the association is not “personnel” but is a vendor, so discussions about the management contract should ordinarily be in open session. Per Civil Code Section 4935, the only discussions properly in closed session about any vendor would be attorney-client discussions, possible litigation risks, or “formation of contracts.” “Formation of contracts” within the meaning of Civil Code Section 4935 does not mean EVERYTHING to do with contracts but only FORMATION of contracts. Therefore, what should be in closed session is the discussion of negotiating strategy and contract contents. Selection of vendors should occur in open session, with the confidential issues saved for closed session. – Best regards, Kelly

A Safe Front Door Ramp Question: My wife recently took a serious fall at our home, she was hospitalized for a while at Cottage Hospital and thankfully is now back at home, but she needs to use a walker to get around. The front porch of our house has only three steps and it is very difficult for her to get up the steps even with me helping her. Please tell us what kind of ramp we can build that is not awfully expensive that will allow her to go to the front door with her walker. Your Handyman: Since the passage into law of the Americans with Disabilities Act (ADA) in 1990 it is now commonplace to see sometimes very long twisting ramps at public places like courthouses, schools, and office buildings. A safely designed ramp can be a life changer for a person like your wife who suddenly needs the assistance of a walker to move around her home after a lifetime of mobility and independence. There are many important details that need to be considered in the design of a ramp so that it is safe and possibly the most important detail is the slope. A ramp that is even slightly too steep can prove to be a hazard for your wife to use with her walker and could cause her to tumble forward or to fall backward. The correct maximum slope for an ADA complaint ramp for your porch is 1:12, which means that for each vertical inch in elevation that the ramp goes up overall, it must extend 12 horizontal inches in distance. This maximum slope limit is why ramps that we see in public places seem to be much longer than one would expect. So, in the case of your front porch which has 3 steps, each step is probably about 8” high, which when added together give a total height of 24” to reach the porch from the walkway. Using the formula of 1:12 the length of your ramp will need to be 24 feet long assuming that the front yard is level. If the front yard slopes down away from the porch, the ramp will need to be even longer and if the yard slopes up, then the ramp can be a shorter length. Building a 24’ long ramp that can safely support groups of people who may walk over it to enter your home, has a non-slip surface, safe handrails, and a minimum open width of 36”, may become a much bigger project than many homeowners are ready to take on, especially if the ramp is intended to be temporary. However, building a steeper ramp to make the project more affordable might have terrible consequences if your wife were to lose her footing and take another fall. Possibly there is a side or back entrance to your home that has fewer steps that would prove to be a better location for an affordable ramp, but it still would need to be constructed in a safe design.

lmost everyone is aware that the real estate market has been on a roll. After the initial “Covid Crash” in from March through June last year, the market headed to recovery with the “Covid Bump,” which started a year ago and picked up steam like a runaway train. Since last summer, the South Coast median price for houses and PUDs (planned unit development homes) has moved higher than ever and at a faster rate than we’ve ever seen. The pace of sales activity has been sustained at an unbelievable rate for the past 12 months with no let-up and with no end in sight. Overall, by the end of June this year, 65% more homes sold compared to the same period in 2020, and the median sale price, now $1,995,000, is an increase of 55% from last year. Not all areas of the South Coast are experiencing this exciting real estate ride to the same degree. Our “Tale of Three Communities” goes something like this: Crazy (Goleta), crazier (Santa Barbara), and off-the-charts crazy (Montecito), all relative to what we would consider a “normal” year of real estate sales activity. Goleta has the highest proportion of entry level housing compared to Santa Barbara and Montecito. In Goleta’s real estate market, the median

home price increased 18% since a year ago and now stands at $1,250,000. Although 18% is a big yearly jump compared to the historic average annual increase in home values of around 5%, we actually have seen this level of increase before. In addition, with 167 houses selling from January to the end of June, Goleta showed a 48% rise in the number of sales over 2020. The pace of sales is running at a good clip, measured as “months of inventory” — theoretically how long it would take for all properties on the market to sell if no other homes were listed. For Goleta, months of inventory is 0.8 month, or about 24 days. That’s about as strong of a seller’s market as you can get. Then there’s Montecito at the high end of the “crazy prices” spectrum, with basically no entry-level housing and a preponderance of luxury homes. Buyer competition has been fierce in Montecito to say the least, with overbids occasionally coming in $1,000,000 or more higher than list price. By spring of 2020, Montecito real estate was well into its comeback from the horrible jolt of the 2018 debris flow, and the past 12 months have been an absolute marathon! With 171 sales so far this year, Montecito has had 97% more sales than in 2020— almost double! The median sale price of home in Montecito jumped up 49% compared to the end of June last year and now stands at $4,850,000

— and that rate of increase is something very new indeed. Regarding the pace of sales, two years ago Montecito’s months of inventory was at 8.9, well into buyer’s market territory. By June 2020, months of inventory had decreased to 3.1 months, moving into seller’s market conditions. Now at 2.6 months of inventory, Montecito remains in a solid seller’s market. In between is Santa Barbara, both geographically and statistically as far as this year’s real estate market goes. As of the end of June this year, 62% more homes sold than last year at this same time, and the median sale price — $1,750,000 — is an increase of 42%—again, something we have never seen before in a year’s time. These increase percentages, less dramatic than Montecito but more than Goleta, reflect Santa Barbara’s mix of entry-level, mid-range and luxury properties compared to Goleta and Montecito. Not surprisingly, the months of inventory is very low in Santa Barbara—24 days (0.8 month), just like Goleta. This continues the strengthening seller’s market trend experienced over the last two years in Santa Barbara, with this year being the strongest.

Lastly, a note on the condo market, where perhaps the best buys may be found at this time. Compared to last year, the median price of condominiums is $797,000, up 17%, and a whopping 79% more condos sold the first half of this year compared to the same months last year. Looking closer at the data, the median price of Goleta condominiums rose 12% compared to last year, and the Santa Barbara condo median rose 20%. Oddly, however, the median sale price of Montecito condominiums ticked down 1% this year, dramatically underperforming with regard to price compared to the rest of the local real estate market. Despite the stagnating median price, the number of Montecito condo sales this year is nearly double that of last year. With this fast-paced market and such variability between and within communities, now more than ever a licensed Realtor is an invaluable asset for buyers and sellers. By Katie Laughridge I love to explore seasonal scents and pair them with looks. The aroma of a room is an important factor in creating the ambiance you want and should not be overlooked. It’s fun to tie candles into the color and overall vibe of the spaces in which you are lighting them. I took a few of our displays and chose candles I think complement and enhance the decor within. This first area I chose is right inside our bright and airy front doors. Full of soft natural light and a wide range of wood tones, an earthy element permeates the space. There is a nice balance between the wood elements and the comfort of the upholstered pieces that look ready for an afternoon nap. With the lovely cream, blue and crimson fabrics, this setting just shouts weekend at the lake. For a scent pairing, we chose a subtle mix of water hyacinth, light moss, lily of the valley, freesia and soft woods that bring to mind the sunshine, fresh air and gentle waves of a Midwest lakeside escape. The aroma enhances the outdoorsy elements while keeping the relaxed sophistication of the furniture.

Microspray emitters in landscaping aren’t enough to satisfy the needs of older trees.

By Maureen Gilmer Drought has changed roots of our older trees and shrubs. Many of them grew up under spray irrigation and more generous rainfall. Still others were formerly in lawns. The root system reflects this with widespread surface feeders. When we are forced to transition to drip irrigation with individual emitters, only roots close to the emitters will flourish. Elsewhere, the roots in dry ground die back. When irrigation is turned off and rain falls, the dry roots aren’t ready to take it up immediately without active root tips. So despite rain, this may cause trees under drip irrigation to lose access to rain moisture early in the season. In drought regions, the effects of changes in water regime show up boldly in trees with unsightly dead branches or tip dieback. Where lawns were ditched for water-wise landscapes and gravel, the trees are too often neglected despite their significance to the home site. The new drip irrigation carefully installed for all the drought-tolerant plants used rarely make special accommodations for existing older trees. They need far more water to survive the heat of summer, particularly in areas of decreasing water table and diminished rainfall. The consequences of failure to provide adequate moisture to a mature tree are dieback, borers and diseases spread by insects that flock to struggling plants. With dehydration, the hydrostatic interior pressure falls and natural defenses are lost. This is when opportunists move in to take out your favorite shade tree.

Those who live in areas that did not receive adequate rainfall this year should stay vigilant this summer. Trees already showing drought issues last year will have double trouble this year if not remedied. If you don’t assess your trees and become proactive with hydration, they will not have enough moisture this summer. With trees contributing high property values, you can’t afford to lose them to neglect. When creating a drip system to replace your old spray heads, there are some important things to remember. The root systems were trained to feed on surface water applied by full coverage spray heads. When you switch to emitters, the water goes deep in a narrow column beneath each emitter. Roots there will grow and feed off that tube of moisture while the rest of the roots may be dry as a bone. Unless you periodically flood that root zone, it will take even longer for new root tips and hairs to form before water can be taken in. Just imagine the trunk of your tree growing out of the hub of a bicycle wheel. The spokes are all the feeder roots on the surface drawing up water from daily spray irrigation. If you create a ring of drip emitters around your tree like the rim of that bicycle wheel, you can maintain a circular ring of active root growth. This ring keeps all sides of the tree able to take up rainwater or an occasional flooding with living roots. When the system is turned off for the rainy season, it’s easy for the tree to make its transition to absorbing rainfall. This is why irrigation design and maintenance is the most important aspect of any drought related changes to a landscape. Adequate delivery won’t cut it. Plants need efficient, well designed coverage with quality products you can obtain, repair or replace for many years without failures. Find a good irrigation contractor or gardener with great skills to review your older plants and make sure they’ll be properly watered this summer. The rush to remove lawns and change our landscapes to a whole new kind of irrigation is not allowing much time to work out the transition effects. All over the West, folks forgot about their trees in the process, perhaps because they once survived on deep ground water. Last summer they started whispering their grievance, If not remedied before high temperatures arrive, they will punish our omission with an unprecedented rate of attrition.

By Paul F. P. Pogue Your HVAC system may be the first line of defense against summer heat, but it also burns up quite a bit of energy, so you may wish to turn it off every so often. Or, you may simply prefer to turn off the air conditioner for a while and try more natural means of cooling down. Worst-case scenario, you might have an HVAC problem that puts you out of air conditioning for a few days. Here are some tips for beating the heat without running your HVAC system all summer long. Run fans: Ceiling or box fans can move the air, making your skin feel cooler even if the temperature remains the same. If you have a ceiling fan, set it to rotate counter-clockwise to push cool air down to the floor.

Install an attic fan: A powerful fan installed on a roof or through an exterior wall into the attic pulls air up through the attic and out of the house. It’s an effective way to draw heat out of the home. Use insulation wisely: Your attic is a big heat attractor. As heat rises and builds up in the attic, it pushes back into the home. By effectively insulating your attic, you cool down the home, improve the attic structure and help the roof last longer. Don’t overlook ridge and soffit vents, to allow heat to escape.

Don’t cook inside: Fire up the grill, make a salad or eat out. As temperatures rise in your oven, they also heat up the house. Running the dishwasher and laundry machines, using the stove, bathing (without using ventilating fans) and leaving lights on also contribute to heat gain. Limit these activities to the cooler times of day, like mornings or evenings.
