Assessment Payment

Dear Kelly: Recently our board stopped dues collection for 6 months because they said some homeowners were experiencing financial hardship. The board has no plans to ask owners to pay back dues. Is this legal?

– P.B. Dear P.B.: One of the HOA board’s fundamental responsibilities is to make sure the association’s bills are paid, and that means also collecting the money to pay those bills. Civil Code Section 5600 states that “the association shall levy regular and special assessments sufficient to perform its obligations…” A similar situation came up in the Great Recession of 20082009, when many owners were in financial distress and some boards struggled with whether to require such owners to pay their assessments. However, members who fail to pay assessments harm those who are paying their share of the HOA costs, so associations must insist that all members pay their assessments.

The HOA’s bills do not stop during the pandemic so assessments cannot stop either. The board should be businesslike in its handling of HOA finances, which includes good stewardship of the HOA’s income — and not cutting it off!

– Best regards to your HOA, Kelly Mr. Richardson: Our HOA over the last 20 years has used up its reserves because of increasing maintenance and irrigation costs. The CCRs forbid raising the annual dues and special assessments are only permitted for litigation emergencies. We have tried to modify the CCRs but we cannot get a majority of the homeowners to vote to OK a change. What would you suggest?

– A.B. Dear A.B.: The law has a provision which allows HOA boards to adopt modest increases in assessments, and that is Civil Code

Smart way to spend fun money

Section 5606(b). Under this statute, HOA boards can increase regular assessments by up to 20% per year without member approval, regardless of anything contrary in the governing documents.

The same statute allows boards to impose a special assessment each year of up to 5% of the association’s annual budgeted gross expenditures. Such an action must occur in an open board meeting, and it is helpful to explain to the members the necessity of the increase. Depleting reserves to subsidize long term operating cash deficits is a bad idea; discipline is better.

Kelly: Can members delinquent in payment of their HOA dues be on the board?

– Thanks, J.P Dear J.P.: Civil Code Section 5105(c)(1) allows associations to “disqualify a person from nomination” due to assessment delinquency unless that person is in a payment plan with the HOA to catch up.

Under the law as it changed in 2020, delinquency in assessments is one of four optional eligibility qualifications that associations may adopt along with the mandatory qualification of membership in the HOA. Such eligibility standard, if desired by the HOA, should be adopted in a change to the HOA’s election rules.

Many bylaws contain provisions also disqualifying sitting directors if they are delinquent in their assessment obligations. One of the many unanswered questions from this new law is whether in addition to the four specified optional candidacy standards there can be additional disqualifications of sitting directors (such as, for example, missing several meetings. Many HOA attorneys believe that the new law applies only to candidacy and not disqualification of sitting directors.

Question: Hi Ed, I’ve saved up a little fun money and wanted to buy one of those “smart” toilets. But after doing some research it looks like a smart toilet is out of my budget.

Why are they so expensive and do I have other less expensive smart options?

–Brad, Texas

Answer: Smart toilets combine electronic technology with state of the art plumbing system designs. So, it’s no surprise that these toilets can be expensive. If you can afford a high-tech toilet, features include: Remote control operation of the toilet, a built-in bidet washing system, motorized high power flushing, self cleaning UV light sanitization, deodorizing fan with filter, LED night lights and hands free seat lifting/closing complete with a heated seat. That’s why these toilets can be out of reach for many homeowners, including myself. But, there is a less expensive option if you want smart toilet technology and have an elongated toilet.

You can purchase just a “smart toilet seat” that combines some of these features with bidet washing. Bottom line: Installing a smart toilet seat in place of a smart toilet can be an intelligent money-saving choice that won’t flush away all your fun money!

How to take the best real estate photos

By Cathy Hobbs When it comes to properly presenting your home for sale, next to pricing, solid photography tops the list. Photography serves as your first point of entry to potential buyers, the portal to first impressions. Can you take photos yourself, can your broker, or should you hire a professional?

When looking to elevate your property, there are some key tips to keep in mind.

1. Pay attention to the sun. Sun can make a difference, especially in a space that may get a lot of daylight. Even lighting conditions and sunny days are best.

2. Use natural light as much as possible.

3. Consider hiring a professional. Working with a profes-

sional photographer doesn’t have to break the bank.

Great photography can do wonders for properly showcasing a space.

4. Look for interesting angles. Creative angles can help add interest.

5. Highlight architectural features. Beyond just wide angles, highlight special or unique features.

6. Be careful when shooting toward windows or glass doors.

Often light can spill into a room, creating a washed-out effect.

7. Avoid cloudy or rainy days. These will require considerable additional light, which may look too artificial.

Architectural elements create an interesting angle in this living space.

8. Add pops of color to a neutral space to add a sense of contrast.

9. Use lighting to create a mood or emotion.

10. Use reflective surfaces such as mirrors to help bounce light in a room, which will help extend a feeling of spaciousness.

Sunstar Red pentas performed like champions

In Georgia we had a year that was pretty much miraculous for butterflies. As you might guess, The Garden Guy had an abundance of plants making sure pollinators of all sorts felt welcome in the garden. In May I wrote a column telling you about a new Sunstar pentas series of making their debut.

I had already grown Sunstar Pink that seriously had the largest florets of any pentas series I had ever grown. It was a favorite of the Gulf Fritillaries in my 2019 testing. This growing season I put the Sunstar Red to the big test and I am delighted to tell you this has champion written all over it.

At The Garden Guy’s house the flower beds are full of a lot of “race horses,” so-to speak. What I mean is that I have everything a butterfly or a hummingbird could want and they grow at full throttle for the entire long hot summer. If you aren’t tough and fairly vigorous, you get swallowed up by those that are.

Sunstar Red was a champ growing right alongside the new Luscious Golden Gate lantana and Blue Boa hummingbird mint. Not only did they compete and hold their space at 2 feet tall and wide.

They were visited by swallowtails and hummingbirds throughout the summer. Gulf Fritillaries liked them like the Sunstar Pink and there were frequent stops by American Ladies and Common Buckeyes.

But it was the variety of swallowtails that kept me mesmerized.

There are four colors in the series coming from Proven Winners: pink, red, a stunning lavender that I combined with Truffula Pink Gomphrena and a rose. They have all won awards from north to south.

In fact, there were 78 awards before the 2020 set of university trials.

As I told you in May, these aren’t just any awards but, Best of the Best, Perfect Score or Top Performer all season, and awards for hanging baskets. The one that caught my eye was Top Performer Pollinators Award in the Ohio State University trials. After an-

other year at The Garden Guy’s’house, I concur.

You will relish the fact that maintenance is low and there is no need to deadhead. Last summer in the new house it seemed I was always frantic about something, and I kept saying to myself I needed to deadhead. Every time I ventured out to do the task, the plant had increased its branches and blooms to the point I finally put away the shears.

Blooms will be produced in abundance all summer long if beds are prepared correctly. Choose a site in full sun for best flower production.

If you are plagued by tight clay prepare the bed by incorporating 3 to 4 inches of organic matter. A little slow release fertilizer incorporated at planting time and a side dress in mid-summer will keep you in blooms until fall.

Sunstar pentas fit any style of garden, from grandma’s cottage to your tropical paradise retreat. But by all means don’t forget the role they can play in the backyard pollinator habitat. Again, I used Sunstar Red with the new Luscious Golden Gate lantana in what is referred to as an analogous color scheme of colors next to each other on the color wheel.

You may be wondering why is The Garden Guy telling me about Sunstar pentas now? Well, mine just froze and this is a good time for evaluation while it is fresh on my mind. But there will be a lot of pentas in the market in the spring and I want you to be able to get these award winners.
