Serial Trash Can Arsonist Arrested in SM Los Angeles County District Attorney's Office charges Joesph Burchett with 17 counts of arson.

By Sam Catanzaro On Tuesday, the Los Angeles County District Attorney's Office filed 17 counts of arson on suspect Joesph Brent Burchett for a series of arson-related incidents in Santa Monica over the past month.

On Friday, January 3, the Santa Monica Police Department arrested 57-year-old Burchett on the 1900 block of Arizona Avenue. Hours earlier, SMPD officers had responded to a call for service regarding trash can fire in an alley of the 2800 block of Montana Avenue.

The January 3 trash can arson incident is just one of 17 prosecutors believe Burchett to be responsible for. A majority of the incidents occurred in two separate sprees on December 22, 2018, and January 1, 2019.

While the crimes occurred throughout the city,

At their regular meeting on Tuesday, January 8, Santa Monica City Council accepted Councilmember Tony Vazquez’s resignation, declared a vacant seat and discussed options to fill his vacancy.

“Applications for the vacant seat will be accepted and Council will select a replacement for the remainder of Vazquez’s term, which will end November 3, 2020, absent any earlier special election that may be required in connection with the pending case of Pico Neighborhood Association, et al. v. City of Santa Monica,” the City said in a statement.

of Equalization. State law governing incompatible offices prohibits an individual from serving simultaneously on both the State Board of Equalization and the City Council of the City of Santa Monica.

Therefore Councilmember Vazquez has submitted a letter of resignation stating his intent to voluntarily relinquish his seat on the City Council effective January 7, 2019, the date on which he was sworn into the State Board of Equalization.

“I am thankful for the opportunity to have worked towards and accomplished so many City objectives during my tenure.

I have been honored to serve with so many committed elected officials who have worked so hard to achieve our City goals, and I am still passionate about the City of Santa Monica’s mission,” reads Vazquez’s letter of resignation.

Santa Monica City Charter Section 603 states that any vacancy on City Council “shall be filled by appointment by the City Council, with the appointee holding office until the first Tuesday following the next general municipal election and until the appointee’s successor is elected and qualified.”

Section 603 goes onto say that, should the Council fail to fill a vacancy by appointment within thirty days after the office has been declared vacant, the Council shall immediately force an election to be held to fill the vacancy.

In the past two decades, the Council’s custom when a City Council seat has become vacant has been to adopt a motion to accept applications from residents for the vacant seat, direct staff to publish announcements of the vacancy in relevant locations and establish a deadline for the receipt of applications and letters of interest.

Notices advertising the vacancy are posted on the City’s website and social media sites, by distribution to local media sources and in other appropriate locations.

Applications for the vacant seat are available online at smgov.net/councilappoint. To be eligible, an applicant must be a Santa Monica resident and registered to vote and cannot be a City employee.

The application deadline is noon on Thursday, January 17, 2019. All applications will be considered by City Council at the January 22, 2019 Council meeting.

City Approves 9% Water Rate Increase

Changes to go into effect on March, 1.

At the January 8 Santa Monica City Council meeting, council approved a 9 percent water rate increase for the 2019 calendar year. City staff put forward the recommendation based on a 2015 water rate study.

“Based on the 2015 rate study and city’s plan to achieve water self-sufficiency—as presented to council [this] past November,” said Alex Nazarchuk, the Santa Monica water resource manager. “Staff recommended that city council authorize a previously approved 9% water rate increase for calendar year 2019.”

The 2015 rate saw an increase of 9 percent, but due to better than expected financial performance, the rate only increased by an annual amount of 5 percent in the years 2016, 2017 and 2018. The reason staff is now trying to reinstitute the annual increase to 9 percent is a result of the council’s plan for Santa Monica to achieve water self-sufficiency by 2023.

“This would result in the monthly increase of $4.33 for an average single family customer,” Nazarchuk said, later adding that multi-family homes would see an average increase of $10.06 per month and that commercial customers would see an increase of $21.19 per month.

eral projects which will aid the city on the path to becoming water self-sufficient. One of the main undertakings will be the replacement of water main pipes which are now reaching the 100 year mark. Staff presented a map of the city, stating that about 4 percent of the pipes need to be replaced to avoid potential disasters due to burst pipes. Staff cited several cases from this past December in which water mains burst, such as the

Another usage for the rate increase will be the planning and development of enhancements for the Arcadia water treatment plant, with a goal of increasing the plant’s efficiency by 90 percent, according to the staff report.

The third main usage will go towards the acquisition of a new groundwater well, to reduce the need for imported water in the city.

Councilmember Kevin McKeown spoke in favor of the increase, bringing up another potential motivator for passing the increase. “[Council] made a really tough, and really right decision four years ago based on basically the same information,” McKeown said. “...

One thing we haven’t mentioned yet tonight...the water we now rely on...that comes from distant reservoirs and the mountains in the northern part of California, [it] comes in aqueducts that will be disrupted in a big earthquake.”

“If we want to protect our residents when ‘the Big One’ comes—and it will come—this is something we need to do,” McKeown added. “It was the right decision to make four years ago, it’s the right action to take tonight.”

Also speaking in support of the increase was Mayor Pro Tempore Terry O’Day. Referring to the map of older water mains that staff had shown earlier, which depicted that approximately 4 percent of the water mains in the city are around 100 years old, O’Day requested that staff return with a similar map of water mains that are currently in the 80-90 year age range. This move will hopefully allow the city to better plan and prepare for future water main replacements.

SM Police Dept. Seeks Public Assistance in Shooting Investigation SMPD looking for middle-aged male suspect.

By Staff Writer The Santa Monica Police Department (SMPD) is seeking the public’s assistance with any information related to a shooting investigation.

On November 16, 2018 at about 7:22 p.m., officers from the SMPD responded to a radio call for service at the Eddie’s Liquor, 2045 20th Street, parking lot regarding a shooting.

scene; however, evidence of a shooting was located. A short time later, a victim was located at a nearby hospital.

SMPD Detectives responded for the investigation. A preliminary investigation determined occupants in a car, a male driver and female passenger, were involved in a verbal altercation with a suspect on a bicycle. The altercation escalated and the suspect produced a handgun from a saddlebag attached to the bicycle. The suspect fired several rounds upwards in the air and at the victim’s vehicle. The victims drove to a nearby hospital for medical treatment. The female victim suffered minor injuries from a bullet strike and was treated at the hospital and released.

The suspect is described as a male White or Hispanic in his 40s, long hair in a ponytail, unshaven and wearing a long sleeve flannel shirt at the time of the incident. The suspect was riding a dark bicycle with rear saddlebags. A small white dog was inside one of the saddlebag pouches. A red food delivery style bag was also attached to the rear of the bicycle.

A parolee has been charged with killing Tristan Beaudette, a man camping with his two daughters in the Santa Monica Mountains at Malibu Creek State Park on June 18, in addition to shooting at 10 other campers and drivers dating back to 2016, according to Los Angeles County prosecutors.

On Monday, January 7, 42-year-old Anthony Rauda was set to be arraigned in Los Angeles County Superior Court for one count of murder, 10 counts of attempted murder and five counts of burglary in asso-

ciation with a spree of crimes in the Santa Monica Mountains between Malibu and Calabasas. However, the hearing has been postponed to January 22.

In October, Rauda was arrested by L.A. County sheriff’s deputies who spotted him on a ridgetop carrying a rifle in a backpack.

The deputies had been searching the area for an armed burglar who had been breaking into homes and businesses. At the time, Rauda was not considered a suspect in the Santa Monica Mountains shootings.

Rauda was arrested and released on probation but returned to jail in December after violating the terms of his probation by being a felon with a gun. While Rauda was back in jail, the sheriff’s department investigated potential connections to the murder of 35-yearold Beaudette.

Santa Monica Architects for a Responsible Tomorrow

The case was tried, the decision is in, and the City lost. The judge has ordered that all future City Council elections be district based in accordance with a seven-district map submitted by the Plaintiffs.

Now what?

Well, the city reiterated its intention to exhaust all appellate remedies to avoid having to give up the at large system found by the trial court to violate the California Voting Rights Act. It responded to the court’s invitation to submit its own draft map involving public process by stating it would undertake such a task only after all appellate rights have been exhausted. Meanwhile, based on that position, the voting rights violations the court found should continue on unchanged and unchallenged. No wonder the judge decided to make a specific order about elections and districts. I trust that she researched her authority to do so carefully before making it.

As a practical matter, this has been very costly litigation. In terms of dollars spent, estimates run from $6 to $12 million and the meter is still running. Plus, the City has now been labeled as a violator of voting rights. Ouch!

The initial decision to fight the suit may have been made in good faith, but the decision to continue the litigation should be evaluated. It is unlikely however, that those who fought term limits

(overwhelmingly favored by the electorate) are going to give up on something, which directly jeopardizes their chances of staying in power.

Hence, the continuing challenge to the ruling coupled with the demand that even if they lose they still get to control the details of districting.

Why not come to the table now? Settle pending appeal. Better yet, settle before entry of judgment.

Bring their gripes with the Plaintiff’s map to the table and/or propose a rapid public process to draw a new one both sides agree is acceptable Do the right thing.

Whether and how much public process is required if this case carries on is subject to legal interpretation and the subject of argument. That it will be time-consuming and result in further delay and cost is certain. Having faith in that process is difficult if it is going to be in the exclusive control of those who vehemently opposed district elections and scorched the earth trying to prevent them.

The court found violations and ordered a remedy. The City as of now intends to fight both. That is unfortunate for the Latinos in our community whose voting rights have been and continue to be violated and for the rest of us as well who support those rights.

I am a convert to the concept of district elections. I converted a few years ago for reasons other that those in the lawsuit. The two minute snippets of time grudgingly provided to members of the public to state their position is hardly meaningful in the face of a well prepared, directed and about to be if not already accepted by individual

Council members staff report to the contrary. Resident voices were lost in a sea of development and lobbying and outside money interests when trying to get Council’s attention.

Districts aren’t independent city-states with autonomous control, so the Balkanization argument

against them is ridiculous. All elected Council members will continue to work for the well being of the city as a whole. Including the Pico neighborhood, which really does seem to have been the

SM Civic Auditorium’s Illustrious History

Picture it. Santa Monica. 1964.

The Santa Monica Civic Auditorium was packed to the brim with legions of screaming teenagers for the Teenage Awards Music International.

The Civil Rights Act of 1964 had recently passed, and the roster was the stuff rock and roll dreams are made of. West Coast staples Jan and Dean emceed, and Chuck Berry took the stage to open the show, performing chart toppers “Maybellene” and the 1958 classic “Johnny B. Goode.” Both songs would go on to become two of the most important songs in rock and roll history.

Other names on the bill included Smokey Robinson and the Miracles, Marvin Gaye, the Beach Boys, and the Supremes. Lesley Gore electrified the stage with her performance of “You Don’t Own Me”- the feminist anthem that shook a male dominated entertainment industry. Also on the bill: James Brown and the Famous Flames who brought the house down with one of the most iconic performances of the night, followed by the Rolling Stones who closed the show with classics like “Time Is on My Side.” Keith Richards admitted in interviews afterwards that James Brown was a tough act to follow and no matter how well the Rolling Stones performed, they couldn’t top the Godfather of Soul himself, James Brown.

film, the show would be televised on movie screens everywhere as the concert event of the decade. It was a groundbreaking project that altered the course of entertainment history and immortalized rock legends.

variety of concerts throughout the ‘70s, ‘80s, and ‘90s where the likes of Queen, David Bowie, Prince, Bob Dylan, and the Clash graced the stage. In 2013, the Civic Auditorium held its final concert but plans of a potential encore are in the works.

Jason Harris, Economic Development Manager for the City of Santa Monica, explains the process leading to an upgrade of the facility. “The City has spent considerable time and effort envisioning the future renovation of the Civic Auditorium,” Harris explains. “In 2007, City Council adopted a long-range cultural plan which emphasizes the importance of retention, development and reuse of cultural facilities that reflect the community’s unique identity. The plan emphasizes the need for significant with a desire to retain the auditorium in something close to its current configuration or to adaptively reuse it for other purposes.”

Harris continues, “In 2018, the City issued a request for proposals inviting qualified persons or firms interested in entering into public-private partnership and a long-term ground lease for the renovation, management and operation of the Civic Auditorium in order to achieve key community goals to preserve the Civic, provide a venue for cultural/entertainment activity, and serve the needs of the community. The City received one proposal in response. After a preliminary review and discussion of the proposal, the development team stated an interest to update and revise their proposal.” The City is currently awaiting a revised proposal from the development team that submitted the proposal. Harris explains, “If a revised proposal is submitted and the parties can come to agreement on the terms and conditions of a public private partnership to advance the proposal forward it would take a few years for the various ap-

It quickly became a hot spot for the best musical acts of the day. The venue’s playlist reads like a timeline of the evolution of the American music scene starting in the 1950’s with Andre Previn, Duke Ellington, Dean Martin, Frank Sinatra, Ella Fitzgerald, Lawrence Welk and the Los Angeles Philharmonic playing to capacity crowds.” Harris continues, “In the 1960’s through the early 1980’s, rock concerts dominated the Civic’s schedule with acts including the Doors, Bruce Springsteen, Elton John, and U2 filling the Civic with fans.” The Civic was also home to the Academy Awards ceremonies from 1961 to 1968.

In addition, county prosecutors charged Rauda with attempted murder for the shooting of a wildlife biologist who was hit by a bullet in the arm while sleeping in a hammock in the south part of Malibu Creek State Park in November 2016.

Less than a week after the shooting of the biologist, Rauda is charged with discharging a gun on another individual who was sleeping in a vehicle, in addition to being accused of firing at three other vehicles in 2017. Less than a week before Beaudette was murdered, Rauda opened fire at a Tesla near the park, according to prosecutors. None of these other incidents resulted in fatalities. “ A concentrated effort by Detectives to unearth the past activities of Rauda correlating with this investigation, has revealed that he apparently acted alone during this identified crime spree, stretching from November 2016 to October 2018. No similar crimes have been reported in the area since the October 2018, arrest of Rauda,” said the Los Angeles County Sheriffs Department in a press release. “The results of this collaborative effort, illustrate the value and strength of coordinated communication, as well as the cooperation among the multiple agencies and stakeholders that helped end this crime spree.”

At the time of publishing, it is unclear who Rauda’s lawyer is. Rauda remains in jail and if convicted, faces up to life in prison.

The line suddenly goes dead and what ensues is a cat and mouse narrative as the officer must use all his wits to save this woman. Mölle’s directorial debut meticulously drives the tension-filled narrative, which will keep you on the edge of your seat until the very last second of the film.

Rating: R Running Time: 88 Minutes This visually stunning black and white film directed by Pawel Pawlikowski, with haunting cinematography by Łukasz Żal, got my vote for Best Foreign Language Film.

It is a sizzling, epic love story beginning in the shadow of the Cold War in 1950s Poland and takes us through a fascinating, passion filled fifteen-year journey, as two star-crossed lovers, magnificently portrayed

by Joanna Kulig as Zula and Tomasz Kot as Wiktor, are magnetically drawn together through the years but fail to sustain their viscerally passionate relationship. In addition to Poland, their adventures take them to Berlin, Yugoslavia, and Paris. In his quest to restore Poland’s traditional folk music, Wiktor and his team tour the Polish countryside recording and auditioning singers and musicians for their folk music troupe Mazurek, based on an actual troupe. At the opening, we hear a cacophony of voices as young men and women audition. It is a most delightful beginning, which fully captures your attention and makes you smile. It is in this setting that Wiktor becomes hopelessly infatuated with the young, beautiful and quite sexy, but perhaps duplicitous Zula who allows herself to fall under the spell of his raging attraction.

You might recall that the director won an

Oscar® for his brilliant “Ida.” “Cold War” is equally compelling filmmaking and in countless ways, because of the complexity of the narrative, more deserving to be feted than the current favorite “Roma”. Although another example of excellent filmmaking, in comparison to “Cold War,” it is a small slice of life story exquisitely written, directed, and photographed by Alfonso Cuarón Orozco. Yalitza Aparicio gives a knock-out performance as the family maid Cleo while his direction captures the drama and textures of a small, affluent Mexican family set against the backdrop of street violence. His use of water images almost becomes a fascinating character within the film.

draws on a very personal story from his childhood when during World War II his family took in a young Italian girl named Giovanna who his parents eventually adopted. Using that as a springboard, he illuminates the unimaginable harsh conditions facing refugees trying to escape from Africa to Europe. Zooming in on painful close-ups of the overcrowded boats and the desperate faces of those trying to flee to safety, his camera brings into sharp focus the harsh reality of what these desperate people endured on the Mediterranean Sea, in Lebanon, Italy, Germany, and in Switzerland.

Although the story telling is very confusing at times, the film couldn’t be timelier in view of what’s happening as refugees from South America try to reach our southern border in search of sanctuary from the dangerous, life threatening conditions from which they are fleeing. Perhaps some day the current administration will re-read and honor the words written on the Statue of Liberty: Give me your tired, your poor Your huddled masses yearning to breathe free The wretched refuse of your teeming shore Send these, the homeless, tempest-tossed to me I lift my lamp beside the golden door Watch for my next three capsule reviews: “The Eighth Commissioner,” (Croatia) “Champions” (Spain) and “The Resistance Banker” (The Netherlands).
