AIDS Healthcare Foundation Accuses California Apartment Association of Antisemitism Tensions Rise as AHF Calls Out Alleged Antisemitic Language, Unconventional Tactics By Dolores Quintana Los Angeles-based AIDS Healthcare Foundation, a sponsor of the Justice for Renters Act on next year’s state ballot, has leveled accusations of antisemitism against the California Apartment Association’s political communications. AIDS Healthcare Foundation placed a full-page ad on Nov. 24 in Jewish News of Northern California; the non-profit and activist organization accused the CAA of employing language in political communications that it considered

antisemitic, particularly in reference to AHF co-founder and President Michael Weinstein. The AHF advertisement stated, “You characterize him as a selfish, cheap, greedy slumlord and a scamming drug manipulator who is only out for himself. In other words, you are saying Michael is a modern-day Shylock — an antisemitic trope if there ever was one.” AHF also expressed offense at CAA activists dressed as cockroaches who distributed flyers critiquing AHF during the Democratic Party’s state convention in Sacramento on the weekend of Nov. 18. Statements from the CAA-sponsored initiative Protect Patients Now rejected AHF’s accusation, asserting that the cockroach suits were intended to show people at the convention some of the charges in media reports of substandard conditions at AHF-owned and managed buildings. Protect Patients Now, a proposed ballot measure aims to strip nonprofit status from drug programs that have spent more than $100 million on issues other than direct patient care. Nathan Click, a representative for Protect Patients Now, stated that voter

signatures are currently being collected to place the measure on the November ballot. AHF argues that the public funding program 340B, which allows it to purchase prescription drugs at a deep discount, also permits a certain percentage to be spent on political activity. Bob Hertzberg, former speaker of the California State Assembly and member emeritus of the California Legislative

Jewish Caucus, an ally of Protect Patients Now, denied claims of antisemitism. Hertzberg stated, “We are living in difficult times. During these very painful times for our Jewish community, it is wrong, in every sense of the word, for Michael Weinstein to now claim antisemitism to distract from this important story when the City [of Los Angeles] is working so diligently to find good and decent homes for the unhoused.”

Beverly Hilton Workers and Hotel Reach Tentative Agreement, Ending Months-Long Labor Dispute Employees Secure Unprecedented Benefits and Key Benefits By Dolores Quintana In a significant breakthrough, hundreds of employees, including housekeepers, cooks, dishwashers, servers, and front desk workers at the Beverly Hilton, have reached a tentative agreement, bringing an end to a months-long labor dispute. The hotel and the union are delighted to announce the resolution just before the upcoming awards season, following recent labor disputes within the actors’ and writers’ communities. The joint statement says, “UNITE HERE Local 11 and the Beverly Hilton are pleased to announce that we have reached a tentative agreement. Together, the iconic Beverly Hilton and its employees set the stage for the awards season, and we are delighted to be able to do so once again.” Ana Cortez, a housekeeper at the Beverly Hilton, expressed her satisfaction, stating, “This new contract will allow me to spend more time with my kids and retire with dignity. I am proud of all my coworkers for sticking together, and we will make sure our sisters and brothers in other Beverly Hills hotels get the same.” Upon ratification, the agreement will provide workers at the Beverly Hilton

with several key benefits, including unprecedented wage increases to keep up with rising housing costs, affordable and comprehensive family healthcare, humane workloads with safe staffing, improved pension increases for dignified retirements, and numerous enhancements such as historic Equal Justice language. The latter will facilitate access to union jobs for formerly incarcerated individuals and introduce unprecedented protections for immigrant workers. The Beverly Hilton marks a notable milestone as the first hotel in Beverly Hills and the sixth overall to reach a tentative agreement. Kurt Petersen, co-president of UNITE HERE Local 11, remarked, “Hotel workers at the Beverly Hilton are eager to kick off the awards season now that Hollywood is back in full swing because they have a contract with a living wage. The Beverly Hilton is a leader in Beverly Hills, and we challenge the Fairmont Century Plaza and Beverly Wilshire to quickly follow suit.”

Pope Francis Approves of Baptism and Godparent Roles for Transgender Individuals Vatican’s Official Stance on Transgender Inclusion in Church Draws Mixed Reactions By Dolores Quintana Pope Francis has sanctioned a document from the Congregation for the Doctrine of the Faith affirming that transgender individuals are eligible to act as godparents during baptism, stand as witnesses at weddings, and receive baptism themselves. The right to receive baptism also extends to children in same-sex couples, including those adopted or conceived through surrogacy. This response to inquiries by Monsignor José Negri, Bishop of Santo Amaro in Brazil, was signed by Prefect Victor Manuel Fernandéz. “A transgender person, even if they have undergone hormone treatment and gender reassignment surgery, can receive

baptism under the same condition as other faithful,” the document states, emphasizing that the situation must not lead to “public scandal or confusion among the faithful.” While there are conservative Catholics who were not in favor of this decision, Jesuit priest the Reverend James Martin, SJ, stated, via his social media page on Twitter, “The Vatican’s new ruling that transgender people can be baptized, serve as godparents

and be witnesses to Catholic marriages. In some dioceses, they were prevented from doing so by local pastors. As such, this is an important step forward in the church, seeing transgender people not only as people (in a church where some say they don’t really exist) but as Catholics. The move aligns with Pope Francis’ broader message of inclusivity within the Church. Last August, he reiterated that the

church is open to all during a conversation with the Jesuits of Lisbon on his visit to Portugal for World Youth Day. While Pope Francis has welcomed transgender individuals seeking refuge in Roman churches, he maintains a stance against what he terms “gender theory” and upholds the Church’s teachings on homosexuality.

Ontario Court Clears Path for Defamation Suit Against “Groomer” Accusations Targeting 2SLGBTQI+ Community Ruling Upholds Right to Legal Action, Rejects Protection for Baseless Child Sexual Abuse Claims

The Ontario Superior Court of Justice, in the case of Rainbow Alliance Dryden et al. v. Webster, has ruled in favor of allowing a defamation suit to proceed against an individual who publicly labeled members of the 2SLGBTQI+ community as “groomers.” in a press release from the legal team of Egale Canada. The court emphasized that baseless accusations of child sexual abuse against the 2SLGBTQI+ community are not protected under Ontario’s anti-SLAPP law, reinforcing the right to pursue defamation

claims in such cases. This is a landmark case in Canada and shows that this method of defaming the character of LGBTQ+ people might be actionable in other countries. The court considered Egale Canada’s intervention, highlighting the historical weaponization of false accusations of pedophilia against 2SLGBTQI+ individuals to deny them equal rights and opportunities. The decision underscores the importance of allowing those targeted by homophobic and transphobic myths to seek legal recourse, especially amid rising levels of hate, harassment, and violence fueled by misinformation. The term “groomer” was addressed as a slur used against drag performers, perpetuating harmful stereotypes. The court recognized the slur as rhetoric based on hurtful and hateful myths and stereotypes, emphasizing the right of those accused to take legal action to protect their reputations. In Dryden, Ontario, Brian Webster referred to a drag performer and the local 2SLGBTQI+ community organization, Rainbow Alliance Dryden (RAD), as

“groomers.” The lawsuit for defamation was initiated in response to Webster’s Facebook post, which included screenshots of a news article about an all-ages drag event, attracting violent threats and placards linking drag performances to pedophilia. Webster sought to dismiss the defamation suit using anti-SLAPP legislation, arguing that his post expressed an opinion on a matter of public interest. However, the court rejected this argument, acknowledging that baselessly accusing drag performers of child abuse is not a matter of opinion or public interest, allowing the case to proceed to trial. Egale intervened, providing the court with context about the relationship between drag performance and 2SLGBTQI+ culture, as well as the impact of accusations of child abuse against the community. The court considered Egale’s submissions, recognizing drag performances as a form of cultural expression and condemning the equation of drag performances to child grooming as rooted in homophobic and transphobic beliefs. The court relied on Egale’s intervention

to affirm that the term “groomer” functions as a slur against drag performers and the broader 2SLGBTQI+ community. Referencing the Supreme Court of Canada’s recent findings in Hansman v. Neufeld, the court emphasized the unique marginalization of trans and gender-diverse people, deeming public comments exposing them to hatred and contempt, such as the accusation of child abuse, as less worthy of protection. Daniel Girlando, Natalie Kolos, and Lauren Malatesta of Borden Ladner Gervais LLP represented Egale’s intervention. For additional technical details on the decision, please refer to the analysis by Judson Howie LLP, the plaintiffs’ representatives in this motion.
