DON’T FORGET WORMS I am happy that Reunity Resources’ Doorstep Program has been successful, but I was disappointed that there was no mention of any successful home composting programs in the Santa Fe area, like straw-bale vermi-composting with red wiggler worms. Over 200 Eldorado residents use this system and it provides a great compost as well. While it’s true that avocado pits and citrus peels take a long time to break down, vermi-composting does an excellent job on veggie wastes and coffee grounds. Pam Walker should give it a try!

WE’RE NOT DONE Thank you for your reporting on this! I see that this is the most recent article covering the removal of colonizer-celebrating monuments and it was written almost two months ago. I have not seen any follow up on the CHART proposal, or any proposals for moving forward on Mayor Webber’s promise to remove three monuments [De Vargas in Cathedral Park, the Plaza obelisk and the Kit Carson obelisk by the courthouse]—one of which is still standing.

itself, but we will not forget what still needs to be done. We need to fight for a restorative justice approach which explicitly means we engage in a process of reconciliation and not criminalizing. City officials: Drop the charges for the “Obelisk 6.” Lead the way in taking action to remove the Kit Carson obelisk. I do not see how we can move forward with a reconciliatory process of any kind while folks are being charged and promises are not being followed through on.

I highly encourage anyone who wants a thorough history of the obelisk and the events leading up to its removal to check out Santa Fe Art Institute’s (SFAI) Tilt podcast series Unsettled.

irst Judicial District Attorney Mary Carmack-Altwies has had a challenging first week in office after taking over from former DA Marco Serna: recovering from COVID-19, a major shift in policy away from prosecuting felony drug possession cases and confusion around one of the Plaza obelisk protester cases.

Carmack-Altwies tells SFR she feels fine following a bout with coronavirus and has since tested negative for COVID-19 after her initial diagnosis, though she is frequently out of breath and stuck with a nasty-sounding cough.

COVID-19 didn’t stop her decision to bring an “effective end” to the felony prosecution of drug possession cases—fulfilling a campaign promise and her desire to treat substance abuse and mental health disorders as just that.

The shift announced Monday, Carmack-Altwies says, will free up time and resources for homicide, rape and residential burglary prosecutions.

“If we’re spending a third of our time focusing on possession charges, that only leaves two-thirds to focus on literally every other case,” she says. “The war on drugs has failed. We have done nothing to accomplish the end of drug use in America. So since we’ve been doing it one way for 40 years, I’m going to try it another way.”

Carmack-Altwies says she has instructed her prosecutors to move such

cases to diversion programs, including treatment and community service, for incoming cases and will attempt to plead all current felony possession cases down to misdemeanors.

There hasn’t been any pushback to the change in policy yet, though CarmackAltwies does anticipate some. She says there’s a “hunger” among public defenders, judges and even Española Police Department’s police chief to do things differently.

“Some people think a crime is a crime is a crime and should be punished accordingly,” the Democratic prosecutor tells SFR. “I believe this class of crimes needs to be treated differently.”

With a diversion policy in place, Carmack-Altwies acknowledges there will be an increase in people seeking help, but she hopes to “spread the diversion around” to 12-step recovery groups as well in-patient treatment.

Carmack-Altwies was also embroiled in the confusion around Sean Sunderland, one of two people arrested on Indigenous Peoples Day before other protesters brought the obelisk down.

Sunderland’s case was dismissed by the presiding judge after the prosecuting officer failed to appear for one of the hearings. (The case is now back on after the Santa Fe Police Department found the department never received the notice to appear.)

Carmack-Altwies previously told the Albuquerque Journal that SFPD declined her office’s help in the case but Deputy Chief Paul Joye maintains he requested help and that Assistant District Attorney Richard Wilson had been working with prosecuting officer Jesse Campbell.

C a r m a c k-A l t w i e s clarifies that her office is helping Campbell with technical issues such as reviewing pleadings and that one of her deputy attorneys is giving a training at SFPD on Friday instructing officers on how to prosecute their own cases. Wilson will serve as prosecutor for felony cases related to the destruction of the obelisk while the police will handle the misdemeanors until the case is ready for trial.

While Carmack-Altwies has been recovering and quarantining at home due to her bout with COVID-19, she says a few people have tested positive in her office over the course of the pandemic, though no one seems to have gotten it from work.

A

Jan. 6 New York Times story reported US scientists’ call for a national surveillance program to monitor the coronavirus genomes for new mutations, particularly in light of a new variant, known as B.1.1.7, surging in the United Kingdom, which appears to be more transmissible, as well as a variant in South Africa. According to the story, the US has only been sequencing a few hundred genomes a day for the international GISAID database.

One of the scientists studying those genomes is Bette Korber, a Los Alamos National Laboratory fellow in the Theoretical Biology and Biophysics Group. Korber leads an interdisciplinary team that provides bioinformatics, theoretical and statistical support in collaborative efforts with experimental researchers, focusing on the areas of HIV-1 viral diversity, the human immune response to infection and vaccine design. Korber’s own mosaic HIV vaccine concept is currently being evaluated in human clinical trials. She has received numerous awards for her work, including Battelle’s Inventor of the Year in 2019, R&D Scientist of the Year in 2018 and the Secretary of the Department of Energy Award for her work on the Ebola Task Force in 2017. SFR spoke with Korber about SARS-coV-2 mutations, the GISAID database and her work. The interview has been edited for style, clarity and concision.

SFR: Given that viruses constantly change, is the news of the UK and South African SARS-coV-2 variants solely notable because they appear more fast-spreading?

Bette Korber: Solely is an odd word to me there. It does seem to me more fast-spreading and the two variants are distinct, but…when you spot something that’s different that seems to be coming up in frequency in the population anywhere in the globe, you want to take a

look at it and understand what it means.

So, you can verify in the laboratory if it really is more infectious. You can test if it has an impact on vaccines or convalescence sera so people who have been infected are likely to be quite well protected from subsequent infections, at least for a while—how well protected is still being sorted out.

A scientist in a recent Science Magazine story said if B.1.1.7 does have a higher transmission rate, the trajectory of the pandemic could become less predictable than it’s been.

Does that seem correct to you?

I guess so. We also found a strain that is more transmissible [D614G, first identified by Korber and colleagues last spring] and it was very controversial when we first pointed it out, although there was extremely strong evidence for it. That strain was proven in the laboratory to be more… transmissible…and it’s now the common form throughout the world. It’s very difficult to say what the pandemic would have been had that transition not happened.

People try to look at the transmission rates and use that in the epidemiological models, and when that changes you have to adjust the models and think about it differently. You might try to isolate the variant [as] they have tried to do in the UK…to limit travel so if this thing is really a problem, it stays more contained.

Certainly, it has a presence in a lot of places. Whether it’s increasing in those places remains to be seen.

It’s going to take a few more months to really understand. It seems to me the really good thing is when they notice something like this, people start looking at it very carefully and trying to understand what that implies for the pandemic, for transmission and mostly for the vaccines.

These aren’t the only two variants in the world. This virus is evolving. All viruses evolve and this one is evolving slowly, compared to something like HIV or hepatitis. Sometimes the mutations are very, very rare, but they cause resistance to certain antibodies. If those mutations

start coming up, you want to know it, you want to know what that implies. And I think the scientific community is trying really hard to look at this and be very systematic and be prepared.

Can you say a little about the importance of GISAID in doing your work?

It’s just extraordinary. GISAID [was founded] in response to influenza.

Influenza also changes…so the scientific community around the globe collects sequences and they go into GISAID and people can analyze GISAID data to try to come up with the best vaccine for this year and to try to figure out if the vaccine needs to be changed up to be current. The scientific community at large has a lot of experience [with] a virus adapting to an immune response. So, when [COVID-19 happened], the scientific [community] adapted quickly to be able to accommodate this new virus and be able to collect sequences. People from all over the world were contributing sequences, and it was amazing. We got an excellent global portrait of the diversity of this virus.

In the fall, the UK made a decision to really emphasize sequencing…I don’t know why the submission has gone down in other places, but it has really skyrocketed from the UK. The US has also really stopped sequencing to the level it had been. I think this is a serious problem because now is exactly the moment we need the sequences, and when I say ‘we,’ I mean the global scientific community, because we’re rolling out the vaccine and we want to make sure nothing changes that would impact the efficacy, the beautiful protective effects of that vaccine.

Is that how New Mexico would know if the strain was here?

I have a special site that I look at for New Mexico and I’m on the safety board for the state, so I’m keeping an eye on it, but I can only look at what’s in GISAID, and

I watched a talk you gave for the Human Vaccine Project last spring where you described GISAID as a firehose of data. How do you take in that much information?

I have this wonderful colleague named Will Fischer and another wonderful colleague named Hyejin Yoon, and they are very excellent computer scientists.

We have a very nice relationship with GISAID…and they make daily updates and they provide [all the new sequences] to Will, [who] filters out the problematic sequences…and he makes automated alignments and makes a phylogenetic tree and then he organizes the sequences by their relationship through that tree…He provides those to Hyejin, and Hyejin and I have worked out all of the tools you see on [cov.lanl.gov] and there are a lot of tools for tracking mutations.

Both [Fischer and Yoon] worked incredibly hard to accommodate the data, and it becomes difficult because a lot of our codes, when it hits 250,000 sequences, if you want to build a phylogenetic tree, it becomes very computationally intensive.

You’ve designed an AIDS vaccine that’s currently undergoing human clinical trials. Why has it taken a lifetime to design an AIDS vaccine and less than a year to design one for COVID-19?

There are two elements to this. One is some of these methods [for the coronavirus vaccines] have been studied in HIV and other vaccines venues…so the delivery strategies…were kind of ready.

An even more critical aspect is this virus evolves very slowly, where HIV evolves incredibly rapidly.

Has the COVID-19 pandemic impacted the work on HIV? For the study in South Africa, COVID came up and they were almost done…but people are afraid to go into the clinic…so they put extremely safe mechanisms…in place and they finished the study under the stress of COVID; it was a heroic effort and a beautiful effort. The study in the Americas definitely got slowed down… but it’s been re-initiated. I’m hopeful.

HIV is still killing vast numbers of people and it would be wonderful to have the vaccine.

New Mexican Economists Warn: Change Course Now

More than 40% of New Mexico’s income relies on oil and gas, leaving the state vulnerable to the boom and bust resource curse

ater this month, New Mexico lawmakers will have another chance to fix an economic problem that has plagued the state for decades.

“For at least 40 years people in the state government and the Legislature have known that they are overly dependent on oil and gas for state revenue,” says Jim Peach, regents professor of economics at New Mexico State University.

Right now, more than 40% of the state’s income relies on the boom-and-bust fortunes of oil and gas. Now, according to a trio of New Mexico’s leading economists, the time has come to change course.

“Like it or not, we’re at the tail end of the fossil fuel age,” Peach says. “We really are.”

The industry itself was already rethinking its future when COVID-19 wreaked havoc with oilfield jobs and revenues. The biggest oil and gas companies in the world —some of which have huge holdings here in New Mexico—are protecting themselves against impending changes in the marketplace by diversifying their portfolios and investing in wind and solar. BP is investing in electric charging stations in China, for

example, and Shell is selling its refineries as it works to become carbon neutral by 2050. “They can see the handwriting on the wall,” Peach says.

Worldwide, economies are ever more rapidly turning from fossil fuels to renewables, as green technologies become cheaper and the consequences of climate change more dire.

That change is stark as New Mexico faces yet another season of extreme drought, decreasing water resources and heightened risk of wildfires. And what gets drilled out of the ground and taxed here exacerbates these problems.

If New Mexicans are to weather these changes, too, the state government needs to change where it gets its money.

It’s not like New Mexico’s reliance on oil and gas has led to great outcomes in education and social welfare: The state is constantly at the bottom of national development lists. And the state isn’t the only place where a boom-and-bust economy hinders progress on education and social welfare. It shares this misfortune with countries like Nigeria, Angola and Venezuela.

The problem is known internationally by a few different names: the paradox of plenty, or the Dutch disease, or more commonly, the resource curse. It hits when a country has an abundance of developed natural resources—yet underperforms economically and socially.

The influx of cash and capital from one industry bends the economy, and government warps and loses initiative as politi-

cians avoid annoying the goose that lays golden eggs.

Two more things New Mexico has in common with Nigeria, Angola and Venezuela? Exxon and Chevron, two of the state’s largest well operators.

Peach started studying the resource curse in the United States after noticing how places like West Virginia and Oklahoma had huge coal and oil industries, yet remained mired in poverty. In New Mexico he saw that oil and gas pumped money and jobs into just two or three counties, and the rest of the state saw few benefits beyond taxes redistributed through the state budget.

That bottleneck makes state politics contentious when it comes to spending.

“People in the oil and gas industry are not exactly happy about the fact that they provide so much of the state budget, and from their perspective get so little in return,” Peach says.

He points out, though, that the money comes from selling resources that belong to everyone in the state, not to the industry.

Every drop of water used to drill an oil well, every unit of natural gas, every chunk of land carved up for wells and roads belongs—directly or indirectly—to New Mexicans. Yet, while industry exports those resources and earns profits for their shareholders, New Mexicans are left with desiccated lands, polluted waters and uneven investments in schools and futures.

At a Legislative Finance Committee meeting in early December, the state’s economists said that revenues for fiscal

year 2021 will be $850 million lower than in 2020; 70% of that drop is from reduced oil and gas income brought about by the COVID-19 disaster. Much of that gap can be filled from the state’s rainy day fund— the Tax Stabilization Reserve—which is filled by oil and gas taxes. Clearly, revamping the economy won’t be an easy task.

Another difficulty is a deep resistance to economic development, Peach explains.

Economic growth happens when an oil boom sends more money flowing into the state. But economic development happens when the state’s jobs diversify, creating more business sectors to fuel the economy.

“Economic development always means a structural shift,” he says. “And that’s threatening.”

It threatens bankers and politicians— the people with money to fund development. Bankers don’t like lending to untested businesses, Peach says, and they don’t want to support anything that might undermine the profitability of what they already fund.

Politicians also tend to fear offending current tax-paying industries, or raising taxes—for anything. “Nobody in the Legislature wants to go back to their constituents and say, ‘I helped raise taxes,’” Peach says.

But taxes fund large-scale education and infrastructure development—the basic investments that pay out in timeframes longer than any political career.

“Short-term thinking does not lend itself to the big sort of infrastructure investments that the state needs,” says James Jimenez, the executive director of New Mexico Voices for Children.

Improving education, health care, basic infrastructure and tax reform will allow New Mexicans to thrive, but those are long-term projects hampered by the state’s reliance on unstable revenue from oil and gas.

In addition, the state tax structure leaks money through exemptions in the gross receipts tax—the state’s other main revenue generator. “We’ve exacerbated that problem by doing things like slashing corporate income taxes and drastically cutting personal income taxes, too,” says Jimenez.

“All the tax breaks in the world for business aren’t going to make a difference if people don’t have money to spend,” he says. “They get more money to spend by working at better jobs. And they get better jobs through better education, and through businesses attracted to a state with better infrastructure.”

When she came into office, Gov. Michelle Lujan Grisham set forth a spread of initiatives to improve those things.

“What the governor did with her policy proposals was a recognition of areas in

which New Mexico had been failing our residents,” says Jimenez, who began his career as an economist for the state in 1986 and served as chief of staff to former Gov. Bill Richardson. “You know, they’re not dramatic.” They are basic improvements, he says.

Jimenez says it’s up to the governor and legislative leadership to set a different direction and say, “That. That’s our North Star. That’s where we’re going.”

State politicians aren’t necessarily blind to the problem.

“We’re just a small little state,” says state Rep. Angelica Rubio, D-Las Cruces.

“That’s why I was so blown away by this resource curse [idea], because nations are dealing with this and we’re not even a nation.”

In her efforts at the Roundhouse to redirect how the state funds itself, she’s received a lukewarm response from other legislators. “How do we make it OK for other legislators to believe the same thing without feeling like they’re going to leave people behind?” she asks.

Rubio grew up in the Permian Basin, and most of her family works in or adjacent to the oil and gas industry. But she sees the need to move the state away from those jobs.

“I think it’s really hard for people to just come out and say, ‘We need to transition away from oil and gas, and these are the ways we’re going to do it,’” she says.

“We just keep saying we’re going to diversify our economy, but we just don’t lay out the road map.” She compares it to removing a Band-Aid: It’s going to be painful but “you just have to rip it off.”

It’s not just a Democratic issue. State Rep. James Strickler, a conservative Republican representative from the San Juan Basin who deals in oil and gas leases, says, “We absolutely need to diversify.

Everybody’s in agreement, I think from both sides of the aisle. But how do you attract those businesses?”

If the state doesn’t figure that question out, it faces even greater shortfalls if the oil and gas industry shrinks further in the future—which appears increasingly likely.

The oilman’s prayer comes in a couple of versions, but it generally goes like this: “Please God, let there be one more oil boom and I promise I won’t piss it all away.” Google it and entries pop up from Alberta to Texas to West Virginia. It was a popular bumper sticker in the ’70s.

The saying reflects what Janie Chermak, professor and graduate director in the Department of Economics at the University of New Mexico, calls the “continual roller coaster” as workers—

and state economies—chase jobs and dollars as the price of oil rises and sinks. “It’s like Groundhog Day every few years,” she says.

Legislators might feel unable—or unwilling—to get themselves off that roller coaster. But you can’t grow an economy centered on a single, volatile industry. Only Alaska, Wyoming and North Dakota rely more on oil and gas revenues than New Mexico. All three are facing similar budget shortfalls.

But one resource-rich state has shown that change can happen toward a more robust, diversified economy.

When Colorado’s shale oil industry went bust in the 1980s, state leaders decided to diversify the economy. “And so if you look at it today, there is a tech industry,” Chermak says. “There is an energy industry. There’s a number of different pieces there, but it didn’t happen overnight.” Colorado also heavily promotes outdoor recreation, which contributed more than $35 billion to that state’s GDP in 2017. By comparison, in 2019 New Mexico’s outdoor recreation industry brought in $2.4 billion.

It takes people with the foresight and the political will to steer the state down a new path, she says, because it’s a challenging path. And it’s hard to fight against an industry that is so big and has so much money.

“You know, the lobbying capabilities of the oil and gas industry are fairly substantial,” Chermak deadpans.

In the 2020 election cycle, oil and gas companies and their proxies spent $1.5 million on local political campaigns and PACs in New Mexico.

Post-election periods like now offer a short-term window when politicians float new ideas before they begin to worry about reelection, Chermak says. It’s not easy to diversify an economy that has relied on one industry for nearly a century. “Diversifying an economy has to be nurtured.

“You know, 10 years, if you came back and I was still living and breathing, I’d hope to God we weren’t going to have the same conversation,” Chermak says. “But you never know.”

For his part, Jimenez is optimistic.

“For the most part, legislators want good things for our children and want good things for our families and want good things for our state,” says Jimenez.

“I found legislators on the whole to be fitted to try to make New Mexico a better place.”

As lenders continue to prey on New Mexicans, advocates push again for legislative reform

he potential morass of a debt spiral spread out from a car accident.

An Española man, sole caregiver for his granddaughter, took a financial risk that thousands of New Mexicans do each year: He borrowed $8,545 from a local storefront lender to help cover expenses stemming from the accident. The money, however briefly, came in handy— until the grandfather realized the interest rate was 130.68%.

Quickly, the gravity of the situation began to hit him as he realized he now had 48 monthly payments to make over four years at $962 a pop. With various finance and other charges stacked on top, it all added up to an impossible-to-meet $30,000plus over the term of the loan.

The man’s monthly income on Social Security: $1,248 a month.

By signing the loan documents, he was well on his way to debt that could crush him.

The rescue came from Guadalupe Credit Union President and CEO Winona Nava and her team who, along with counseling services and even local law enforcement, had created an association in the summer of 2019 specifically to help grandparents raising their grandchildren.

“He was going to lose his car because [the lender] didn’t care if he could afford to pay them,” says Nava, who recounted the man’s plight for SFR. “He gets home and realizes that…they’re either going to have to live in the car and make that payment, or he’s going to lose the car and won’t have a way to go get groceries, take his granddaughter to school, all that stuff. He was really panicked. So…the counselor told him to go to Guadalupe Credit Union and they’ll help you, and that’s what we did.”

Nava and her team created ways to catch people before they start circling the drain of debt. This story is not a deviation from the norm of what happens when people, desperate to make ends meet, take out a short-term loan with dizzyingly high interest rates.

New Mexico is among the last states in the nation to allow triple-digit interest rates on short-term, small-dollar installment loans—not to mention stacking fees and other costs common for this sector of the lending industry.

The 175% rate cap here is third-highest nationally for a $500, six-month loan, and highest in the country for a $2,000, two-year loan, according to the National Consumer Law Center.

Government consumer protection lawyers have won court victories that could have reined in the “predatory loan” industry, but enforcement has been sparse in the handful of years since. And legislative attempts to align New Mexico with national best practices, such as a mean rate cap for these types of loans at around 35%, have foun-

-Sen. William Soules, D-Las Cruces dered for more than a decade, as the industry has showered politicians of both parties with campaign donations and deployed powerful lobbyists to lean against reform.

Our state’s 175% cap came in 2017, with what many lawmakers called a “compromise” that would at least place some limits on the industry.

That didn’t go nearly far enough, reformers say, pointing to a Morning Consult poll from January 2020 that shows New Mexicans favor much stiffer regulation by a wide margin. A week ahead of the 2021 legislative session, there’s fresh hope that a more progressive Legislature might tighten the screws.

State Sen. William Soules, D-Las Cruces, tells SFR he’ll sponsor a bill— and not for the first time—that would force lenders to restrict annual interest rates, including fees and costs, to 36%.

This year’s bill, which is still in the works, is modeled after legislation in other states and the 2006 federal Military Lending Act, which restricts lenders to a 36% rate cap for active service members and their families, plus several other rules.

The new legislative landscape, with its leftward turn during last year’s elections, taken together with economic hardships brought on by the COVID-19 pandemic, have created a feeling of more urgency this year, Soules says.

“Many of the more conservative legislators who were against this in the past I think are not around anymore,” he says.

The pandemic “has just exacerbated inequities and inequalities, and it has made it even more crucial for us that we don’t let more people get trapped into that debt cycle, because this is tough for everyone and can get even tougher for those on the bottom levels.”

Soules expects resistance from familiar corners. The southern New Mexico senator, who has been in the Legislature since 2013, and others acknowledge that Gov. Michelle Lujan Grisham’s agenda for the session isn’t likely to feature lending

reform prominently, given the lengthy list of weighty issues awaiting lawmakers starting Jan. 19.

“I am hopeful. There’s a strong coalition, there’s a lot of community support,” says Karen Meyers, an Albuquerquebased consumer attorney with decades of experience working on storefront lending concerns, including a stint as Consumer Protection Division chief at the state Attorney General’s Office and another at the Consumer Financial Protection Bureau in Washington, DC. “More and more people are understanding that 175% was perhaps the first step toward reducing the rate, but isn’t anywhere near what’s affordable for New Mexicans. And New Mexicans know that.”

Tripp Stelnicki, a spokesman for Lujan Grisham, says it’s too early to comment on whether she’d sign a bill that hasn’t yet been filed, but adds: “In general, the governor is supportive of cutting down or cutting out predatory lending to protect New Mexico workers and families.”

To present a picture of how the storefront lending industry operates in New Mexico and elsewhere, SFR interviewed lawmakers with lengthy histories of pushing for reform and two consumer attorneys with CONTINUED ON NEXT PAGE

She points out that debt has been shown to create financial instability for families and, in turn, negatively impacts health outcomes, their ability to maintain housing, provide adequate food for children and other intractable problems, including emotional impact “because of the stress that debt causes.”

“When they default, they are subject to debt collection, which can be abusive,” Meyers says.

Albuquerque-based attorney Raymond Sanchez, who wielded the speaker’s gavel in the state House for years, does lobbying work these days. Among his clients are short-term lenders, and he tells SFR he’ll oppose Soules’ reform bill—as he has with previous efforts.

His reasoning: The cap would put mom-and-pop lenders out of business and push bigger companies out of New Mexico and online instead, all the while further disadvantaging low-income people in the state.

“Installment lenders have been around since the ’50s and they’ve been a mainstay in the state of New Mexico where banks or credit unions don’t lend money to people who don’t have any background with financial institutions,” Sanchez tells SFR. “They take care of the local people and they’d be out of business. I’ve talked to all of them. They’d be out of business if 36% goes into effect.”

Sanchez admits that while the lenders that he represents might sometimes require an APR that is higher “than people would like,” the owners of the companies are still running a business and have to make a profit.

“I don’t understand what Soules and anybody else is doing trying to do this,” Sanchez tells SFR. “I guess it’s a political issue. If I were in the Legislature, I wouldn’t be introducing stuff like that. It just makes no sense. Why run people out of state and have people go to the internet to borrow money where there is absolutely no regulation?”

lengthy histories in the state. SFR also reviewed campaign finance filings and data and analyses gathered by the National Consumer Law Center, the Center for Responsible Lending, the Consumer Federation of America and Think New Mexico, a Santa Fe-based think tank that is aiding in this year’s push for a 36% rate cap.

Of the companies with the biggest footprint in the state, as identified by Think New Mexico, SFR tried to contact 21 of them. Only two got back to us: OneMain Financial, which already imposes a 36% cap on its loan products, and Regional Finance, whose representative declined to comment.

Maps created by SFR and advocacy groups show that the lending stores are almost always clustered in lower-income neighborhoods and, in many cases, near Native American communities.

For example, SFR analyzed the locations of the 16 lending storefronts in Santa Fe County. Just one is located near downtown, or the north side of the city, which also has the lowest percentage of Hispanic/Latino residents and significantly higher median incomes by Census tract.

The other 15 stores are located on the Southside and middle sections of Santa Fe, where the percentages of Hispanic/ Latino residents are at least 50% and as high as 77%, with median incomes between $30,000 and $54,000.

Reform advocates point to sales tactics and marketing techniques used by the lenders that offer the promise of shortterm relief for those struggling, but leave out what comes after borrowers sign on the dotted line.

“Looking at many, many loan files over the years, what’s evident is that these loans put people in long-term debt which they struggle to get out of,” Meyers says.

“Many times they cannot, so they refinance or roll over the loan repeatedly, keeping them in debt for years.”

They have to come in and see a financial coach.

This allows them to show some commitment to wanting to improve the situation.

The former speaker’s argument is familiar to advocates and policymakers who have wanted to change the lending industry.

Meyers points out that 85% of the lending companies that operate in New Mexico, many of which are massive, multi-state corporations, are based in other states. Their business models target states with weak regulation where they can come in, set up storefronts and take profits out of the state, she says. In 2019, those companies charged over $220 million in finance charges to New Mexicans.

“If a profitable business means that they are exploiting New Mexicans, I don’t think that’s a reason to allow them to continue to profit by putting people into long-term debt,” Meyers says. “There are some of these companies that have complied in states with much lower rates that have continued to do business. It’s their choice: how much profit they say they need to continue doing business.”

Companies with storefronts in New Mexico also operate in Arkansas, which has a 17% rate cap, and Georgia, where the cap is 36%. Those are states with similar generational poverty to what’s seen in New Mexico.

Even with the lax regulatory and legal framework in New Mexico, not all storefront lenders charge borrowers the full 175% interest.

OneMain Financial, a lender with storefronts across the state, voluntarily imposes an APR cap of 36% on all loan products, according to spokeswoman Kelly Ogburn. OneMain also helped about 2,500 customers in New Mexico by allowing more people to qualify for borrowers’ assistance and suspending income verification requirements and late fees for 40 days, she says.

Guadalupe Credit Union created two lending, including what used to be known Peter Wirth, D-Santa Fe, took his first shot at reducing the rate cap to 36% in programs specifically to help people spi- as “payday loans.”

Legislative reform efforts have been 2009, with a bill supported by then-state raling into debt, including Predatory Debt Relief Loans, which help people who have stymied for years, as lending companies Attorney General Gary King. Neither Moores nor Lundstrom responded to SFR’s requests for interviews.

For John Thompson, a former colleague of Meyers in the AG’s Office who now works for the Consumer Financial Protection Bureau in DC, the hurdles to change in the Legislature aren’t surprising.

“Our efforts to do something substantive at the legislative level tended to die in committee,” he tells SFR. “My stomach turned every time I went to the Roundhouse.”

So, along with Meyers, he set his sights on litigation, spearheading two landmark cases in which government lawyers won significant court victories in 2013 and 2014 that could have laid the groundwork for more enforcement going forward.

“When [lenders] constantly hector existing borrowers to take out new loans for increasing amounts; when they constantly try to upsell borrowers into loans for larger amounts than they even asked for; when they try to get borrowers to refinance their loans rather than pay off their loans and get off that debt treadmill that they’re on, that is a procedurally unconscionable,” Thompson says, using the court’s verbiage. “And it is at the core of small-dollar lending. It is a crucial component of their profitability. The New Mexico Supreme Court said you can’t do that and gave the AG’s Office the power to investigate businesses that engage in those practices.”

There appears to have been little, if any, such investigation in recent years.

Thompson favors reform through a different mechanism: ballot initiative.

Nationally, Arkansas, Arizona, Montana, Ohio and others have put the question on the ballot. Montana, a historically red state, passed it by a margin of 72-28 in the 2010 midterm elections, which saw a red wave across the country.

Soules tells SFR the ballot initiative route in New Mexico would be difficult, because voters are only asked questions about proposed amendments to the state constitution. But he is hopeful that, finally, his bill has a real chance to pass this year with support from multiple corners, including most New Mexicans.

“Every time voters have been given the opportunity, no matter whether they are red or blue voters in red or blue states, they have voted by a supermajority to cap interest rates for small-dollar lenders,” Thompson says. “I don’t think the poor in New Mexico are different from the poor in Arkansas, Ohio or Montana, in that the experience of poverty just isn’t that different.”

Keep Laughing Canada’s Gerald McMaster Zooms into town for Wheelwright talk Ontario-based educator, curator and former artist Gerald McMaster (Plains Cree) looks back on his time at Santa Fe’s Institute of American Indian Arts in the 1970s as a good thing—even though, he says, his classes didn’t really delve into Indigenous art history the way he’d have liked. That’s partly why he founded his own curriculum through what was then known as the Saskatchewan Indian Federated College (today it’s called First Nations University of Canada, and it still teaches McMaster’s stuff). Around that time, he gave up his own practice to focus on the scholarly aspects of the arts, but the Wheelwright Museum of the American Indian’s Chief Curator Andrea Hanley still snagged a McMaster painting for Laughter and Resilience, the institution’s big 2019 show which comes to a close in March.

In the piece, a Native man in full-on headdress aims a novelty gun at a white man in uniform—think American soldier from an era when stealing land was the norm. A flag emblazoned with the word “BANG!” unfurls from the barrel. In the broader context of the show—the long history of humor in Indigenous creativity—it’s a silly take on old-school wit and comedy; from McMaster’s point of view, it’s more of a thinker.

“I remember when I was sketching it... the work just kind of came out,” he tells SFR. “I think a part of me was thinking about how ‘cowboy’ is an occupation, how anyone can do it; I was thinking about the time when the American Army was moving west, the expansion; I was thinking of the early days of these kinds of opposition, these struggles, and about counting coup.”

The concept of counting coup, McMaster says, refers to the wargames of his people, wherein the goal was not killing, but besting your opponent through smarts and trickery.

“That was the historical context I was thinking about…you have this kind of tricksterism on one side and this other kind of reality of not understanding the other’s side,” McMaster adds. “The viewer must understand the different ideologies on display.”

At his upcoming Zoom talk with Hanley, viewers will get more context about the piece, as well as McMcaster’s current work with the Ontario College of Art and Design University and Southwestern arts collective Postcommodity. (Alex De Vore)

Martin Luther King Jr.’s nonviolence is still for protesters, police officers, the state and the world

A

s we approach January 18—only the 35th annual Martin Luther King Jr. Day commemorating the iconic civil rights leader who extolled a nonviolent philosophy while pushing the country to reconsider its history of racism, poverty and oppression—we have recently been shocked by the kind of protest which King could never countenance.

The events of Jan. 6 are what violent insurgency looks like: Assailants carrying weapons attacked the Capitol building, breaking windows, aggressing security, threatening sedition, brandishing weapons and making bomb threats. The insurgents wanted to stop Congress from formally counting votes from the Electoral College. Their actions, unredeemed by a higher morality, demeaned the tradition of civil disobedience practiced by King. What values did they uphold? Anarchy, misdirection and white supremacy.

At the same time, this is a teachable moment, and chance to return to King’s legacy. The insurgents at the Capitol stand at the opposite end of the spectrum. One side exhibits the protest tradition informed by love, the other what happens when protest is driven by self-entitlement, conspiracy theories and hate.

MLK Day also remains an occasion to show how King’s legacy has been conveniently simplified by conservatives who’d remake him into a polite, palatable figurehead. Such simplification focuses

Violence and Nonviolence on MLK Day

on King’s career up until 1963, but ignores much of what he said and did afterward. Conservatives seemingly love taking certain quotes out of context; for example, spinning King’s hope that someday his children would “not be judged by the color of their skin, but the content of the character,” to suggest he would have opposed affirmative action. Or preposterously translating calls for integration as opposition to diagnoses of racial dynamics.

Rather than honoring King’s spirit of activism, MLK Day celebrations and memorials, at their worst, become subtle invitations to complacency lacking an adequate sense of how beleaguered King was during his lifetime—by the FBI, which monitored his every move, but also his peers, who disapproved of his stance against the Vietnam War, and far-left radicals who felt King’s ministerial style was outdated.

Yes, most MLK Day celebrations convey the man’s commitment to nonviolent tactics. They rightly describe King’s efforts to end segregation with boycotts and sitins and have in recent years focused more on his anti-poverty message. The overall effect, unfortunately, is to honor King’s accomplishments without underscoring how he did it, or highlighting how much more he wanted to accomplish before he was assassinated in 1968.

King’s nonviolence was engaged and rooted in activism. If we forget this, we can easily fall into the trap of believing nonviolence is synonymous with inaction.

Sometimes the term “nonviolent” is used like a schoolmarmish admonition with the backhanded racist insinuation that Blacks are inherently violent.

“Remember King was nonviolent!” becomes shorthand for “Don’t challenge the authorities! Don’t protest at the Capitol!”

Whites, meanwhile—and obviously—are free to violently break windows at a federal building and then get politely escorted away.

Nonviolence disavows retaliation and aggression. It means leaving weapons behind. Nonviolence as practiced by King nonetheless involved direct action and disruption. He’d go to segregated business at the heart of the Christmas season and inform them that they would not burn the business down, but they would picket, they would hand out leaflets encouraging boycotts. As he said in his Letter From a Birmingham Jail, for nonviolence to be successful, it must “create tension that is necessary for growth…a situation so crisis-packed that it will inevitably open the door to negotiation.”

Don’t be duped by the sanitized version. I myself have been in activist groups wherein nonviolence was construed as the

prohibition of any discussion about white privilege, as though we should protest the effects of racism—inadequate schools or police shootings—without analyzing what it actually is. King encouraged selfexamination, including for white allies, writing: “I have been gravely disappointed with the white moderate…who is more devoted to ‘order’ than to justice, who prefers a negative peace which is the absence of tension to a positive peace which is the presence of justice.”

We simultaneously limit King’s principles if we believe they only applied to protest activists. His intent was for the principles of nonviolence to be upheld in every aspect of society. Hunger, deprivation, lack of access to healthcare, unjust law enforcement and nuclear proliferation are violence. He often asked why the nation spent so much on the military and prisons, but so little on social programs. His agenda was consistent with the contemporary rallying cries: “Black Lives Matter!” and “Defund the Police!”

But then, King wasn’t so naive to believe he could transform the world using a small band of activists. His primary dream, one seminal to the others, was for the spirit of nonviolent protest and civil disobedience to spread nationwide, even internationally.

Come Monday, Jan. 18, let us remember how King challenged consciences. Let us ask ourselves meaningful questions.

Do King’s criticisms of white moderation apply to some of us? Have we followed his example of commitment to ending bigotry, poverty and unjust war? Have we committed ourselves to the most that we can do?

If the honest answer remains “no,” or even “maybe,” let’s change.

Pack a Bowl On the bright side of our apocalypse, Santa Fe Build-a-Bowl has arrived

anta Fe foodies already know Martin and Jennifer Rios and their establishment, Restaurant Martín.

It’s been a local pinnacle of fine dining since 2009, and Martín’s culinary creations have earned him more than a few James Beard Award nominations. Still, as public health orders seem forever in flux, dining’s old world doesn’t have a clear future path, but Martin and business partner Corey Fidler aren’t ones to sit idle.

“They can’t sit still for long,” Jennifer tells SFR. “They needed something to do—a totally new creative project.”

From that creative desire comes the aptly named Santa Fe Build-A-Bowl (santafebuildabowl.square.site), our fair city’s newest pop-up eatery, a joint effort between the Rioses and Hotel Santa Fe General Manager Fidler and a clever modular take on some of Martin’s favorite dishes. It’s not Restaurant Martín, but an entirely new dining style meant for an entirely new type of clientele.

It works like so: Diners choose a base item, such as cilantro-lime rice or tri-colored quinoa, from a list of many. Proteins come in a wide variety, too, whether that be grilled steak or Scottish salmon. Sautéed mushrooms, fresh zucchini noodles or shaved carrots make up the vegetable options. I’ve never been

asked what glaze I wanted on meat before (I was given options of sweet and tangy hoisin, Cajun-tamarind or al pastor), but after getting past the initial intimidation of such freedom, I appreciated that I even had a choice at all. I mean, who else gives you power over your glaze?

Also, do you notice a pattern here? It’s all about choice.

“The main idea is to choose your ingredients so you’re getting exactly what you want. It’s fun for us and for the customers.”

Martin explains, adding that the response has been immediate. “Since we opened, the first day was steady. But all of a sudden the second and third day were crazy. We had to keep up with all this demand.”

Amongst the fervor, some dishes have proven more popular than others.

“The tuna’s popular. We serve it rare, glazed with a Cajun soy reduction, sliced atop the rice,” Martin says. “People love the mushrooms glazed with balsamic and Asian seasoning [and] Asian Southwestern-style slaw atop that.”

Bowls start as low as $13 and, with addons for extra protein ($4-$6) or vegetables and toppings ($2-$6), you can really come out with great portion sizes without burning a hole through your wallet.

This is high-quality food, and a duo won’t pay more than at any other middle-class restaurant in Santa Fe. Two diners could theoretically spend less than $40 for a night out, though with the choice for extra proteins, vegetables, sauces, etc., you could go for a wild splurge, too.

taking it seriously. After ordering online, customers drive up to Restaurant Martín’s parking lot at 526 Galisteo St. Everything is then navigated by text and brought out to the car. It’s simple enough, though there are still some logistical hurdles to tackle. Tiny parking lots make much of downtown a difficulty for parking, period, and Build-A-Bowl is no exception. High demand means longer wait times for now, but for a new dining option with a sudden boom in popularity, those growing pains are natural.

Besides, within a minute of eating, the food made up for it. Our household tried the steak with al pastor glaze over the cilantro-lime rice, which proved expertly cooked and flavorfully tender. We also tried the Scottish salmon with sautéed mushrooms over brown rice. The latter was described by my companion as “the best salmon I’ve ever had.” Our landlocked state makes good fish hard to find, but Build-a-Bowl proves Martin is not kidding when he says the ingredients are fresh.

The best part, though, might be that meat-eaters, vegetarians and pescatarians can all find common ground. Still, as Jennifer explains, Build-a-Bowl has its eye on a key kind

of customer.

“We’re targeting a younger demographic,” she says. “We wanted to go for the lowest price point we could. You shouldn’t have to be older and have X number of dollars to really eat great food.

It was the young locals who placed the earliest orders.”

For the moment, Build-a-Bowl is slated to run for a limited 90 days and only operates from Thursday-Sunday, 4-7:30 pm.

Jennifer says she and Martin are already looking ahead, though, and if demand keeps up, perhaps there’s a brick-andmortar in the cards.

“Maybe there’s a life for this after the pop-up,” Jennifer muses. “Maybe we can make this a standalone business.”

Martin, meanwhile, is already experimenting with the possibility of more complex chef-curated dishes, like an al pastor glaze served on chicken and shrimp.

Trying out a Mexican adobo-style sauce, he says he’s fast finding new concoctions he thinks will work.

“It’s becoming my favorite,’ he says slyly, “but for now, it’s just for me.”

You remember David Arquette, right? The actor from the Hollywood family that also boasts Rosanna, Patricia and Alexis Arquette? He was in Scream? Eight Legged Freaks? He married Courteney Cox? Yeah—that guy.

Anyway, turns out Arquette once had this super-promising acting career until the year 2000, when he joined the WCW pro wrestling league as a promotional stunt for the notvery-good movie Ready to Rumble (also with Scott Caan...ugh) and became its Heavyweight Champion of the World. This set off a firestorm of hate among the wrestling faithful, who’ve spent the last 20 years hating Arquette’s guts— and it almost certainly derailed his acting.

What’s a guy to do? Well, according to the documentary You Cannot Kill David Arquette, the answer is to start wrestling for real, start training in earnest, hopefully to win the respect of…whoever…while simultaneously clearing out the cobwebs of mental illness and undoing two decades’ worth of ire from the wrestling community. And

Pieces of a Woman opens with a praiseworthy sequence—a phenomenal 30-minute uncut take featuring a home birth that ends in tragedy. For Boston-area couple Martha and Sean (Vanessa Kirby of The Crown and Shia LaBeouf of Honey Boy), their infant daughter’s death ripples through their family and circles beyond. Patterns of grief follow, namely the larger question of what it means to build an entire life for a singular purpose, like having children, only to have it pulled out from under you. Buying a minivan pre-disaster, Martha asks, “Is this us now?” only to be packing away a crib a month later.

It’s not fun, but it is oddly pleasant to witness.

Smooth steadicam gives the torment tranquility—it’d be tempting to go handheld for a project like this to express panic like the audience is a divine witness afforded a privileged peek at life’s miracles and griefs.

As Pieces goes along, there’s a foreboding that we’re actually here for the actors to fatten up their reels. It’s reminiscent of Jennifer Aniston’s 2014 Cake, and not for plot alone (despite basically being the same movie)—a path for some accolades we’ll forget about within a year, a way

You Cannot Kill David Arquette didn’t feel like it was worth the $19.99 rental on Amazon when it dropped a few months back, but now that it’s found a home at Hulu, it’s endlessly watchable in a trainwreck kind of way. Arquette produces his own redemption story, one in which he gets fit, travels to Mexico to train with luchadores, enrolls in a real-life wrestling school and ultimately finds himself while being accepted within the wrestling world. It honestly feels like a long con bit at first, but as scenes wherein backyard wrestlers seriously mess him up or even an ER visit that comes after a bout results in a nicked throat artery show, there’s something to learn from the star of See Spot Run—homeboy is dedicated and, as the people who sincerely love wrestling are quick to remind you, even if it’s akin to a play, it’s

for drama teachers to play scenes on repeat in an introductory course.

Trying to live up to what the first half-hour promises proves fatal. You can be a victim of your own success, especially when a film begins in such a Alfonso Cuarón-inspired way. Director Kornél Mundruczó has the chops, as his earliest venture White Gods proves, but while his heart is in the right place, the writing knows what it wants to be but doesn’t grasp what it wants to say.

McLarty’s insistence that hubs is for real lends credence to the journey, and it’s heartwarming to see her support in action. Both give the audience even more of a reason to root for the guy. You’ll almost surely come to respect Arquette by the end, and you’ll appreciate how much he really, truly means it.

country’s far from perfect, but as the only one in the whole region to permit same-sex marriage and other civil rights, filmmakers there are on a mission to capture the queer experience in case it falls victim to stereotypes or bizarre audience expectations. So comes Your Name Engraved Herein, just reaching American audiences on streaming services after garnering a whopping $100 million in Taiwan this past fall.

Director Kuang-Hui Liu’s second feature opens as Taiwan’s decades-long martial law ends circa 1987. A new freedom dawns and the students at an all-male Catholic school find themselves in the midst of a cultural euphoria. Reserved Jia-han (Edward Chen) is smitten with the mercurial, wild-spirited Birdy (Tseng Jing-Hua), but despite the hopes of a new enlightenment, the patriarchal sway of the old ways still holds firm in the mind of Taiwan’s citizens.

Herein’s path forward is familiar, but expressed in such a literary quality that its tropes feel fresher. Cinematographer Hung-i Yao steals the show (his work here won him the Golden Horse, Taiwan’s highest film award, for Best Cinematography) with frames that ooze copper-tinted nostalgia. Skillful blocking from Liu builds quiet scenes wherein Birdy and Jia-han mull their attraction—

these are some of the best moments in recent international cinema. Liu brings such a wonderful naturalism to his project, in fact, that you’ll want to see more young lovers steal movie posters as a way to bond.

The youthful optimism reaches its inevitable halt, however, demonstrated by a sequence which finds the students participating in competitive military drills. Birdy leads what becomes an impromptu musical march that faces harsh rejection from the powers that be. When our leads realize “new” is still tantamount to “dangerous,” Herein’s strengths begin to falter. It descends into repetitive, soapy melodrama, and while boys screaming and crying about love can be a lot of queer fun, you can’t help but wish it would speed up. Given its strong start, this is a sad stumble. Thankfully a wonderful finale keeps Liu’s film afloat, even if Herein sails into port weighted down.

Thus, it isn’t a knockout, but folks who like sentimental storytelling (yours truly) will fall hard; audiences unfamiliar with Taiwan’s cinematic style and output not so much. Still, Liu’s directorial future is bright and hopefully his subsequent works can find a better balance within the melodrama while holding tight to the naturalism at which he excels.
