Open Secrets Santa Fe DA pledges public, accountable reviews for possible criminal conduct in police shooting cases

early four years had passed since local police or deputies fatally shot someone in Santa Fe. That changed quickly last week, when Santa Fe Police officers opened fire on 29-year-old Francisco Javier LinoGutierrez, who was running alongside a tourist-packed downtown street. Twelve hours later, a Santa Fe County Sheriff’s deputy killed a man after a vehicle pursuit.

Details remain sparse.

Both agencies have said the men pointed guns at cops, but neither has answered further questions, aside from the Sheriff’s Department confirming that one of its deputies who fired last week killed another man in a previous police shooting.

New Mexico State Police, which is investigating the two shootings, has not identified the man killed by sheriff’s deputies or the cops who fired shots in either incident.

When that agency’s investigations conclude, authorities must decide whether the gunshots veered from legal on-duty actions into criminal conduct—and they’ll do so in an age of protest, tension and politics around the way police use force.

The choices will fall to First Judicial District Attorney Mary CarmackAltwies, a first-term Democrat who ran last year on a progressive platform that included accountability for violent lawbreakers, even if they’re cops.

She inherited a system in tatters for reviewing police shooting cases that dates back decades.

From secretive, misleading “investigative grand juries” that were designed to clear police, to vague, responsibility-shifting “district attorney panels” composed of prosecutors from other districts whose poorly explained findings raised more questions than they answered, the result was always the same: Nothing to see here.

Carmack-Altwies proposes a more transparent path forward, one that diverges from previous DAs’ approaches and her own initial thinking during the campaign.

In her first public comments about police shooting reviews since taking office, Carmack-Altwies lays out her plan in a lengthy interview with SFR this week.

Here’s how it’ll work: Once she receives a completed file from State Police, Carmack-Altwies promises a 30-day turnaround to make one of two announcements.

“If I think it’s justified, I will put together a memo with my reasoning, and I will release that to the public,” she tells SFR. “If I do not...that’s when I will bring in the special prosecutor, and that person will then get to re-review my decision. If they agree that it’s not justified, they will then be in charge of prosecuting it.”

Carmack-Altwies acknowledges the timeline could be tight in more complex cases.

Special prosecutors could include DAs from other districts or qualified, expert attorneys from the community, she says.

She plans to post a written policy on her official website within the next week.

All records detailing her legal decisions will go online as well.

Carmack-Altwies says she’ll release police body camera video and other materials showing “pure facts” as

soon as she receives them. Certain police reports, officer statements and other records with possible omissions or mistakes won’t come out until she’s finished her review.

In cases that end in police killings, “like the two most recent ones in Santa Fe, I will absolutely be meeting with the family,” she says. “Police shootings have become a huge deal in this country, and one of the main complaints has been that the families never hear from anyone in authority that they’re sorry that life is lost.”

Leon Howard, a longtime observer of police shooting reviews and the legal director for the American Civil Liberties Union of New Mexico, applauds CarmackAltwies for abandoning the broken systems used by her predecessors—and for her transparency pledge.

However, the DA’s is just one role in ensuring justice when police commit crimes behind the badge, Howard tells SFR. State Police investigate police shootings in Santa Fe, as opposed to the agency that employs the cop who fired, as is done in some other districts. That creates one layer of needed distance, he adds, but police investigators are often biased in favor of one another, regardless of where they work.

Loaded investigations can hamstring prosecutors who later review them, Howard says.

He favors a model similar to a recently created bureau within the New Jersey Attorney General’s Office—an independent outfit that investigates and reviews shootings, eliminating the inherent

conflict that arises when local DAs consider charging the officers they rely on as court witnesses.

New Mexico AG Hector Balderas and some lawmakers have supported that idea, but recent legislative efforts have foundered.

“The reality is that New Mexico keeps ranking No. 1 or No. 2 in police shootings every year,” Howard says. “Our lawmakers should prioritize figuring out this issue by funding an independent agency.

Whatever type of independence you can create, the more you’re going to build community trust....I understand why Mary believes this is her job and she needs to make these decisions. But it’s hard to think of how this doesn’t put her office in a bad place if she determines there is criminal conduct in a police shooting.”

First, she must clear an 11-case backlog of non-fatal police shooting cases left by former DA Marco Serna. She has quietly resolved four of them, penning “relatively short” memos describing her decisions not to pursue charges.

The DA says her new policy won’t apply to shootings that occurred before she took office.

Among the unresolved cases is SFPD officer Brandon Deets’ non-fatal shooting of Joseph Galassini in a questionable incident last June outside the Big R farm and ranch store on St. Michael’s Drive.

And then there’s the 2017 fatal SFPD shooting of 24-year-old Anthony Benavidez, a man who lived with serious mental illness and died in one of the city’s most violent police encounters in recent memory. Publicly, Serna offered conflicting statements about the case’s status.

But internally, Carmack-Altwies tells SFR, he closed the case. She won’t commit to reopening it, but says she’ll “have some conversations, review some memos and see if that’s something that I need to do a review of.”

In addition to the two cases arising from last week’s shootings in Santa Fe, Carmack-Altwies says her new policy will cover the Española Police Department’s killing of 38-year-old Luis Nathan Leyba on June 8—and all other fatal police encounters from the time she took office in November forward.

It’s her job, the DA says, to answer to those who elected her.

“If it’s justice to indict a cop, I’m going to indict a cop,” she says. “If it’s justice to stand up in front of the community who’s mad about it and say, ‘Sorry, guys, this was justified,’ I’m gonna say that.”

Campus Caution When Santa Fe Public Schools opened its doors to students—and possible transmissions of COVID-19— schools saw few cases or transmissions

anta Fe Public Schools administrators and district leaders have summer homework ahead to ensure the beginning of the next school year rolls out smoothly and safely.

Veronica Garcia, outgoing superintendent, says the successful reopening of schools in the spring has earned parents’ trust to safely resume full in-person learning in August.

“We’re expecting pretty much 99% back in classrooms,” Garcia tells SFR. “Very few parents have opted for remote learning.”

Rewind six months to when Garcia and her team were fielding strong concerns over further spread of COVID-19 in district buildings. Reflecting on the two months of in-person learning in April and May, the district identified the number of transmissions that occurred in its buildings.

SFPS collected data for every positive case of COVID-19 found on its campuses since schools allowed willing students back into buildings the week of April 6.

Subsequent contact tracing found few instances of transmission in buildings during the short period of in-person learning in the second half of the spring semester.

The numbers, which the district compiled at SFR’s request, show 39 positive cases among students and staff within school buildings. That’s among an average of 6,500 students and staff who were back in facilities at the height of in-person learning last spring. Nine of those 39 cases were related to previous cases in one of the school buildings. In some instances, the positive case was related to a single transmission, but in one instance a positive case at Kearny Elementary School in late April was related to three other infections.

Though Capital High School had the highest number of positive cases (nine) over the semester, no documented transmissions resulted from them. Santa Fe High School reported a total of five cases during the time students were in the building, with two separate instances of transmission—one in early April and the second in mid-May. Garcia tells SFR that school nurses followed New Mexico’s Department of Health guidelines when someone on campus tested positive as part of SFPS’ surveillance testing program. As part of the contact tracing process, nurses notified and monitored people who came in contact with the infected individual.

At the state level, Public Education Department spokeswoman Judy Robinson tells SFR the department has not collected the number of cases by district, “only the state as a whole and only on a weekly basis.”

“One reason for that was concern that for very small districts/schools, those numbers could present a [privacy law] violation (as a student/staff member could be easily identified even without naming)”, Robinson writes in an email to SFR. However, PED calculates school-based

spread rate statewide for the 2020-2021 school year at just 2.4%.

With schools slated to welcome all students back to classrooms on Aug. 6, the number of people in buildings will almost double. PED guidelines for the return to in-person learning are still pending.

Meanwhile, parents remain concerned for their children’s safety, according to Jasmin Holmstrup, chief development officer with La Familia Medical Center, which ran a back-toschool vaccination event last weekend.

“There was a real push to vaccinate communities of color and underserved communities,” Holmstrup says of the event.

As part of its preparations, SFPS has spent almost $5.4 million to better equip schools to prevent spread, including $1.7

million to hire additional custodians and another $1.5 million to install plexiglass screens.

“Air quality was going to be a big part of this,” says Gabe Romero, the district’s executive director of operations. “You know, being inside a building with hundreds of students and staff.”

Gregory Frostad, director of the state’s Safe & Healthy Schools Bureau, says despite the low rate of documented transmissions, children remain at risk in schools.

“There is not much evidence to support schools as a driver of community spread of the virus,” Frostad writes via PED’s spokeswoman to SFR. “Evidence suggests that child-to-child transmission is relatively rare but is still a significant risk, which is why we continue to implement COVID-safe practices.”

n the shallow gully of the Arroyo de los Chamisos, late afternoon light illuminates the sandy soil and rocks lining the basin. The ditches’ short walls hide traces of other humans. The wind carries bird songs instead of revving car engines.

In this private canyon, nature controls what’s so close to the world of paved roads and roofed structures. Willows grow unmanicured, grasses poke from between the rocks, and leafy branches stretch over the wandering channel.

Another lone walker with a dog bouncing from one bush to the next passes with a silent nod. Ahead, a coyote stares over its shoulder before trotting up the berm, out of the wash. The weight of warm, dry air shunts any scent of water that’s supposed to flow through after storms.

Places for recreating, socializing and inhabiting, the arroyos of Santa Fe fill a different niche for everyone: sites for early-evening walks, spots for sharing a joint, camps for the unhoused. The presence of arroyos in the city is largely welcomed and unquestioned by their users.

Scientists see something else. “Arroyos are really scars—the remnants of poor landscape management,” Morika Hensley says of the channels that stripe the city.

The expansion of the arroyo system emerged as a consequence, she explains, of livestock’s arrival via the railroad and, later, the paving of the land to make way for cars.

Hensley grew up in Santa Fe with a fondness for these natural corridors. Arroyos, just outside many of our doors, provided an accessible place for her to walk in nature and experience the beauty of the Southwest in her backyard.

Now, as the director of planning, education and restoration at the Santa Fe Watershed Association, Hensley recognizes arroyos as symptoms of the human forces that altered the landscape.

When these channels swell with water, the land they cut through loses moisture and the vital element rushes out of the city. It’s known as desertification, and it threatens to dry an already arid landscape, pushing out native plant species and depriving Santa Fe of a valuable resource: water.

Given the violent monsoons in this region, marked by short, heavy downpours, Santa Fe built stormwater systems generations ago that exploit arroyos to ship water out. With the incredible efficiency of these drainages, many longterm planners see water flowing down arroyos as an unacceptable resource loss.

Advocates of more sustainable water management argue that obstacles in the city’s procurement process—favoring “hard-engineering” designs—have exacerbated the drying and, in turn, transformed Santa Fe from the prairie grassland it once was and still ought to be.

As the pressure of water scarcity mounts in the Southwest and renewed calls for conservation vie for attention, an incremental shift is occurring in the city.

Officials seek to balance concerns over protecting property with fears and consequences of further desertifying the surrounding landscape.

A return to ancient ways of thinking about water and recent changes to the city’s stormwater management are poised to help the community brace against the dangers of coming wa-

ter shortages. If the positive changes gain wider application, successfully preserving the water that falls in the watershed, these scars may yet heal.

Land, water, people, animals

Hilario Romero grew up in a very different Santa Fe from Hensley in the 1950s.

And for those with generational roots in this region, like Romero, the story of these water systems cannot be untangled from historical forces that shaped the city.

“The culture of arroyos, acequias, water, all of that—it has been ingrained in our brains, even those that don’t even realize it,” the former state historian and professor of New Mexico history says over a map of Santa Fe acequias from the 17th and 18th centuries.

Romero speaks of the acequia culture that demanded the collaboration, and often bickering, of mayordomos and parciantes.

Stanley Crawford, the noted Dixon, New Mexico-based novelist and garlic farmer, describes it this way: “Next to

blood relationships, which rule the valley, come water relationships. The arteries of ditches and bloodlines cut across each other in patterns of astounding complexity.”

Many of the acequias have since been paved over, which led to the formation and deepening of new arroyos.

He points to signs of the land drying out: compacted soil, steeply eroded banks, deep-rooted plants.

“We are desertifying the landscape and arroyos are a good indication of that,” the hydrologist and founder of Southwest Urban Hydrology says.

Prior to the arrival of settlers, and the subsequent desertification, shortgrass prairies dominated the landscape.

Kauffman describes the scene as “parklike.” Grassy swales, without distinct channels, would have allowed water to flow across the land as a sheet, enabling more water to sink into the soil.

Next to blood relationships, which rule the valley, come water relationships. The arteries of ditches and bloodlines cut across each other in patterns of astounding complexity.

The arrival of the railroad in the 1800s enabled colonists from the Eastern United States to bring sheep and cattle that grazed on the grasses that would otherwise hold the soil in place. The loss of grass cover, alongside trampling by the livestock, induced widespread erosion in the form of gully formation, which created the vast system of arroyos that characterizes much of the Southwest.

Though the grazers have moved elsewhere, a new threat to the land has since built up.

“What I would say now, instead of overgrazing problems, it’s the impervious development,” Kauffman explains. “So it’s the roads, the streets, the parking lots, the rooftops, which essentially prevent water from entering the soil surface and so have to be directed somewhere.”

That water flowing into these natural channels, coming off the asphalt and metal roofing, has a higher velocity (think of a ball rolling on wooden floors versus CONTINUED ON NEXT PAGE

A shift in thinking

Ditch management has evolved over the decades as the dominating philosophy toward water has developed.

“Arroyos around Santa Fe are a good indication that we are effectively drying out the landscape,” says Kauffman. He acknowledges this is counterintuitive because we see water filling these channels.

But it’s on a fast track to somewhere else.

That was exactly the intention of hard-engineering enthusiasts, who held that water was a nuisance—eroding soil, leading to property damage—and needed to be removed from urban centers as quickly as possible.

“In the 20th-century model, it was like, ‘Let’s get it out of here as quickly as you can,’” Melissa McDonald, the city’s river and watershed manager, tells SFR. Alternatively, the 21st-century model is

to slow the water and get it in the ground, says McDonald.

The old-school approach is more recognizable to the average observer through structures like cement culverts and banks reinforced by metal and rock gabions.

These hard-infrastructure projects reinforce the channeling, rather than promoting the infiltration of water. Experts say the latter is a much more sustainable approach to stormwater management.

Just as flooding presents risks to people seeking shelter in riverbeds and arroyos, the stormwater also poses risks to property. The city sought to minimize the damage through the construction of hardened surfaces like cement and rock to control the flow of water and stabilize channels.

But those techniques have worsened desertification, advocates of low-impact water management say. Kauffman points

Impervious surfaces prevent water from infiltrating into the ground, further drying out soils. The fast-moving water also struggles to soak into the dirt. During large rain events, stormwater creates potential for flooding, which prompted the development of drainage networks around the city that rely on, and deepen, these channels.

Humans are not entirely to blame.

“Arroyos can still be a natural phenomenon,” Kauffman says, adding that they sometimes form naturally after a large fire or in response to a drying climate. Though there’s a clear link between the modern arroyo system and poor land management decisions.

Erosion happens relatively quickly; recovery does not.

“Arroyos can take decades or two centuries to form,” Kauffman says. “They can take millennia to recover, to go back to a stable system.”

In their ever-shifting state today, arroyos in Santa Fe provide much more than just channels for water or walkers.

On his way to work at New Mexico Coalition to End Homelessness, Mark Oldknow sees a large number of people coming up out of Arroyo de los Chamisos, where they’ve camped for the night.

Arroyos around the city offer shelter and a place to sleep uninterrupted.

Oldknow acknowledges the relative containment of arroyos helps those experiencing homelessness feel safer, but that can quickly change. Flash flooding of the river and arroyos presents serious risks to people living in these spaces, in addition to damaging their property.

“Every time that it rains, I go across the street to the river and I can spend the next week picking up stuff because somebody’s camp, someplace upstream, got washed away,” Oldknow says, emphasizing “every time.”

Tricks to slow water down have been given short shrift.

“It’s been treated like a highway project,” Steve Vrooman, president of Keystone Restoration Ecology, says of work done on the Santa Fe River near Siler Road. The river, which saw renovations beginning in 2008, is not technically an arroyo, but it presents many of the same challenges.

The problem is procurement, Vrooman explains. City projects go to firms that typically favor large-scale, engineered systems to control water flow. This has left out contractors who would prefer to build loose, lower-impact rock structures—work that Vrooman and Kauffman practice.

McDonald says the city awards projects based on the needs of the system and the qualifications of the firm. The City of Santa Fe follows the state’s procurement code, and requests for proposals often go to the lowest bidder.

“There’s times where we use a more conventional engineering. Usually when we do the conventional engineering, it’s in areas where we don’t have a lot of space and we have a lot of homes nearby,” McDonald says.

She points out that hard infrastructure is necessary to prevent severe erosion where buildings stand during large storm events.

The growing tension over what model best suits the city’s needs reflects the slow shift from practices that defined the 20th century to those that scientists like Vrooman and Kauffman hope to see more prominently used.

“We’re still having, 20 years later, the argument of natural channel design versus classic engineering and why can’t we integrate them,” Vrooman says. “It’s not getting fixed here, or anywhere else. It’s not Santa Fe’s fault in particular.”

Vrooman concedes hindsight is 20/20 and acknowledges a consensus: Water is dynamic and it’s very difficult to control.

What water means

Kauffman points to a clustering of rocks shaped like a crescent moon—cobbled together intentionally—which most might not notice if the architect himself wasn’t pointing it out. The semi-circle of stones laid in the ground is known as a “media luna” structure, and it works to fan out and slow down the upstream water, coming from a channel, to minimize its erosive effects.

This technique, among others, is one practice that Kauffman and his fellow natural channel designers employ to work with the landscape of arroyos rather than force a shape onto them. Other practices, such as Zuni bowls and one-rock dams, gained prominence as scientists looked to address arroyo health.

Bill Zeedyk, founder of Zeedyk Ecological Consulting, learned of Zuni bowls while working with the Northern New Mexico Pueblo. The parallels between Indigenous agricultural practices and these loose rock designs originate from the idea that “every little bit of water counts.”

Beata Tsosie-Peña, program coordinator for Tewa Women United, says that “erosion control is one piece of it; there are multiple benefits to slowing down water as far as recharging the landscape.”

These structures require little more than stones and dirt, but Tsosie-Peña explains that plants are the true remedy for erosion.

“You can build all the dams and berms and soils you want, but if you don’t have plantings it’s not going to be effective,” she says.

Romero, the professor and historian, agrees, noting natural channel design follows the same principals of the original stewards of Northern New Mexico.

Since the city’s approach has begun to incorporate low-impact erosion control projects, McDonald says that softer philosophies, in the form of green infrastructure, have become more of a priority in the last few years as part of the city’s 2018 Stormwater Management Strategic Plan.

Rain gardens are another strategy: pool-shaped holes, lined with rocks and plants, that fill when rains come and allow the water to sink into the ground.

For scientists losing sleep over future water shortages, the overlap of desertification and the coming crisis reflects the messy web of relationships that define the natural environment. The ongoing drought underlines the need to capture every drop of water, and the shifting climate reinforces the urgency for more

resilient and sustainable urban environments that reflect heat and preserve moisture.

Though it’s not just future challenges that catchment strategies are poised to address.

Tsosie-Peña explains that mushrooms can be used to remediate water runoff from roads, carrying with it petroleum products and sediment. “You can grow mushroom bricks and bury them in the soil,” Tsosie-Peña explains of how these living filters work in conjunction with rain gardens to help clean stormwater.

“I don’t want a chicken in every pot, I want a rain garden in everybody’s yard,” quips Andy Otto, executive director of Santa Fe Watershed Association. “We can put these things in everywhere, and the more we do the better off we are on recharging our aquifer.”

While he considers himself an optimist, Otto explains that the Santa Fe Watershed, an area of 182,400 acres, receives an average of 12 inches of water a year. This total volume of rain (an estimated 59 billion gallons) dwarfs the amount of water the city consumes (just under 3 billion gallons a year.)

“We have more than enough water falling on our watershed that could be used now,” he says. “Part of the reason we don’t use it is because so much of it runs off into the Rio Grande.”

William Schneider, the city’s water resource coordinator, explains aquifer recharge is complicated and difficult to measure. He says the jury’s out on how much these techniques, which capture and sink stormwater into the ground, actually contribute to recharging the aquifer, but he acknowledges the need to address future water shortages.

Initiatives like the Santa Fe Watershed Association’s Adopt an Arroyo program push arroyo health and sustainable land practices forward, but the increasing pressures of the drought and climate change demand that stormwater be factored into decisions about resources.

With the rapid continued development around Santa Fe, more impermeable surfaces means more stormwater runoff. And given the complexity of relationships between land and water and people in Santa Fe, the impact of these decisions will affect everyone.

On the linking of these waterways, Hensley, of the watershed association, reflects: “The arroyos are a very visceral representation of how we are all connected through water in this watershed.”

With an arroyo in so many backyards— coupling all reaches of the city—efforts to stop the drying of land help remind Santa Fe of what water means.

Country Returns Greg Butera takes over Tumbleroot It’s been almost five years since we crowned local country king Greg Butera’s Tell Me Now as one of our 2016 albums of the year, and though the singer/guitarist/fiddle champ says he’s got at least an album’s worth of new tunes that he’s yet to record, his focus hasn’t entirely been on his own music lately. Butera, who also plays with John Francis and the Poor Clares, took to welding projects during COVID-19—but, he says, “the pandemic got me anxious to play; not doing it for so long makes you look at music in a new light without so much pressure involved; it’s good to play music when people want to hear music.”

And the people want to hear music. That’s at least partly why Butera reconvened his regular players (pedal steel guitarist Ryan Little, bassist Casey Anderson and drummer Joe Hecker) for an upcoming Fourth of July show at Tumbleroot Brewery & Distillery. The rest, he explains, is because of Lost Padre Records owner George Casey, who is behind the show’s promotion duties.

“Attribute it to George for being so supportive of the music scene,” Butera says. “I couldn’t say no.”

As for the set, Butera envisions a mix of danceable numbers, some slower sad ones and perhaps even a solo tune or two. John Francis Mustain (of the Poor Clares) is set to sit in on vocals as well.

Tumbleroot just added a number of extra tickets for this one since COVID restrictions are lifting come July 1, so if ever there were a time to kick up your heels and catch one of the best performers our city has to offer, it’s right now.

As for a future album from Butera?

“My friends are always telling me I need to,” he says with a laugh. “It’s always a possibility.”

Forget about fireworks this year. Find yourself some country jamz instead.

After 8 years serving as the Museum of Indian Arts and Culture’s Director, Della Warrior (Otoe-Missouria) is retiring this August, and the museum’s Deputy Director Matthew J. Martinez will step in as acting director. Since SFR staffers are pretty big MIAC fans, we caught up with Warrior before she hangs it up.

(Alex De Vore) Why is now the right time to retire?

There’s no ideal time. There are always exciting things to do. I had planned to retire last year, but then it was the pandemic, and I certainly didn’t want to leave during the pandemic. Now that we’re coming out of that and things are moving again, I’m sad to leave because it’s exciting work and I love it, but I have to recognize I’m not as young as I used to be. I’m actually past the age of retirement, so it’s just trying to recognize it’s a demanding job, I’ve enjoyed it, but it’s time for me to slow down.

Will you stay in the museum field? In Santa Fe? What’s next?

I’ll stay in Santa Fe for a couple of years, but I do plan to move back to be near my home community in Oklahoma. That’s what I’m planning to do, anyway, but it’s a major move, so it’s going to take awhile.

I came to work in the end of 1993 at the [Institute of American Indian Arts] in the development office— initially, I was the tribal liaison, then director of development, then interim president at the end of 1997, and I was [president] until 2005. Then I retired from that and did some consulting work for three or four

years before I decided to apply for this position. I was encouraged to apply for it.

I’m not from a museum background, but because of my experience overseeing the museum at IAIA and being the president there, everyone felt I could do the job. I was a little reluctant, but after I got into it, I figured it all out. It’s been an exciting, whirlwind eight years. But you know, I kind of consider myself an entrepreneur—not in a business sense, but in that I always have some project. I’m sure there’s some project I’ll get involved in, but I don’t expect to have a full-time job ever again. I want to enjoy retirement, but I also like to build and create and do things, so I know I’m not going to be bored.

Is there anything from your tenure of which you’re particularly proud?

What I was asked to do by all the committees who hired me was, number one, to do something about the ongoing Here, Now and Always exhibit—to update it, because it had been up for years. I was also asked to increase attendance, to get more Natives into the museum and to generate more money. Those were my marching orders from all the constituent groups at MIAC, and that’s how I built my agenda.

I raised money so we didn’t need to have exhibits up for two years, so we could rotate them annually....

You have the same exhibit up for two years; that impacts your attendance.

I counted them all up, and we had 30 exhibits in the last eight years.

The Here, Now and Always renovation is well under way—they’ve got the plans, the objects have been selected, they’re settling on the cases, the colors of the floors, the graphic design; in February they should start the installation and the exhibit should open in June. I feel good that I brought it this far.

Our attendance has gone up, and I worked closely with the Museum of New Mexico Foundation to raise sizable private dollars as well as grants. And one of my main things was to bring in Native artists or Native scholars to talk about their work; to have programs about Native issues and to educate the public about Native issues. I believe with good leadership now, with Dr. Matthew Martinez [Ohkay Owingeh], it’s in good hands. I’m comfortable with saying goodbye sadly.

Brunch Rush: Only Fools Rush In Can’t help falling in love with Dulce Capital’s new brunch menu

I

t’s not an ideal morning for the art of brunch when Santa Fe gets our first downpour in weeks. Such a precious ritual is often reserved for blue skies, warm sunlight and patio dining. There’s virtue in that, and as Pride month comes to a close, it’s a stark reminder we need to take our brunch procedure seriously.

With that in mind, I violated said procedure by arriving outside of designated brunch hours far before 11 am. The world was awash in gray skies, but the pastel colors of the Dulce Capital (1100 Don Diego Ave., ­989-9966) interior were a welcome hideaway. There wasn’t a need to rush, though people were trickling in at a consistent rate.

“It began as a fundraiser for Santa Fe High’s baseball team, a little while ago,” a staff member told us of the new brunch menu, “and it was this big success.

We wanted to try it out to see what everyone else thought.”

Adding brunch is part of a push to increase options for customers while also trying to maintain consistency when it comes to Dulce Capital’s popular baked products. Longtime employee Molly Martinez and her husband Armando purchased the bakery in September 2020 from original co-owners

Kirk Barnett and Dennis Adkins (who’d resumed ownership of the bakery after a less-than-stellar period under different management).

The menu remains limited for now with a build-your-own omelette option, classic huevos rancheros, smothered breakfast burritos, cheesy or sweet grits, and French toast formed from dough usually destined to become hand-crafted cinnamon rolls.

Thank goodness that dough found other paths: We were some of the first people in, and as a result I have the title of first paying customer to try the new cinnamon roll French toast. I confess I’m a cinnamon roll skeptic—I’ve had one, maybe two in my entire life that I thought were wonderful—so a French toast made from would-be rolls? I was going in hot, but my fears were allayed.

The presentation is adorable and the toast itself is topped with strawberries, blackberries and a light snowfall of powdered sugar. Home fries and bacon round out the plate, but I

was surprised to find no syrup anyplace­— and for the very dish we’re supposed to drown in maple syrup to a degree that would make nutritionists gasp?!

This is where the cinnamon roll idea kicks in. Sweetness from the strawberries and powdered sugar matched with the sweetness of the bread itself. Surprisingly, pleasantly, you don’t need syrup. This was actually well done with a fine crust on both sides, a soft interior and only a light touch of cinnamon mixed in that accented but didn’t dominate the flavor profiles. Given that French toast can often wind up being little more than flavorless, wet bread, this sparked a profound curiosity in me, even if I can’t call it an outright victory for cinnamon rolls.

The bacon was excellent with nary a burn anywhere, but crisp enough to crumble and keep a flexibility that amateur cooks (and even some pros) can’t seem to master. Something about bacon at momand-pop enterprises hits different, and though the home fries could’ve spent a handful more minutes cooking to soften up, their rich butter coating helped build a savory flavor that contrasted spectacularly with the sweeter French toast.

Call me basic all you want, but I had to try the breakfast burrito, too, because if a restaurant in Santa Fe

cannot master a breakfast burrito, hope is lost for the rest of the menu. The first fears abated when we saw the dish: Like the French toast, its presentation was unexpectedly superb. The smothered red chile didn’t flood the dish to create a soupy mess, and the cheddar cheese didn’t dominate. Plus, the toasted tortilla held its own against the liquid forces until the very end.

My dining partner remarked how so many places stuff their breakfast burritos with potatoes to just fill it out, but Dulce Capital doesn’t skimp on the scrambled eggs, offering a fluffy alternative with the proper ratio of toasted, cubed potatoes to give the burrito its fullness. The thin slices of bacon inside are reminders this is as classic as it gets, and though experimental breakfast burritos are cool every now and again, give the world a Tia Sophia’s-like presentation and setup, and you’ll win every time.

I’m also a big proponent of Dulce Capital having the greatest blueberry muffins in town. While the normal bakedgoods shelf wasn’t present (so they could focus on the food, the staff told me), they did grace us with mini-muffin versions of that blueberry masterpiece. It feels like a requirement to have at least one pastry in place of a full array of baked wonders.

Mini muffins neutralize the sting. And even beyond the food, I couldn’t help but be impressed with how smooth the rollout was. There was no scramble from the staff, nothing to note they weren’t wholly prepared.

Dulce Capital’s new brunch menu isn’t anything fancy, nor is it trying to be. For a first-time brunch program, this is solid stuff. Whether the menu lasts into the future or merely remains a pop-up program is yet to be seen, but if your next Sunday is dreary and grey (figuratively or literally), give Dulce’s new brunch options a try.

Remembering Benito Martinez III

T

hree years ago, Santa Fe musician Benito Martinez III, aka Benzo, told me, “Some of the most dark and personal songs I’ve written are some of the best songs I’ve written.”

At the time, Martinez was preparing to release his first and only solo album, Head Trip, which proved a deeply personal—and yes, dark— melange of hip-hop, jazz, rock and soul released through local outfit Outstanding Citizens Collective. In that interview, he opened up about his youth, his present, his passions and mental illness within his family. It was candid and moving and indicative of the type of guy Martinez’s friends say he was.

On June 10, Martinez died at 32, sending shockwaves through the Santa Fe music scene and putting an emphasis on the importance of mental health, particularly as we continue to navigate COVID-19, as well as access to help and how sometimes the people who shine brightest are struggling the hardest.

“Apart from being a prolific writer, he was an amazing performer who was impossibly committed to music,” writes former Benzo bandmate Daniel MenchThurlow. “Sometimes, we would be about to play a gig, and he’d show up 10 minutes before the downbeat, wearing boots and his dirty work clothes. The dude would work like 15, 16 hours chopping wood (or whatever he was doing that day), then head straight to the gig, walk in with a huge smile on his face and absolutely kill it all night.”

Local MC/DJ Pablo Paz (who goes by DJ Shatter) agrees, adding that “Benito just had this energy, and whatever he did, he’d go to the fullest.”

Paz met Martinez in elementary school, and the two grew up on the same street. Later, during high school, they got into music production in parallel, along with longtime Benzo friend and collab-

orator Dylan Delgao, aka Wolfman Jack.

At the time, Paz says, Martinez lived in a trailer without AC or fans. As such, they dubbed it The Sweatshop. There, they’d spend hours sweating over a sweltering computer, learning to make music and producing original songs.

“He was the cog, you know?” Paz says. “He was the most naturally talented in the group from the beginning, the first to make beats and the first to show us we could make songs of our own. We were obsessed.”

“Me and Pablo and this guy Dan Martinez would just mess around freestyling, but Pablo played football with Benito, and kept saying we need to get with this guy, that he was really good.”

Delgado explains. “At first I said, ‘This jock isn’t going to give us the time of day,’ because we were skater nerds. But Benito was really receptive and cool, and since he was miles ahead of us skillwise, he kind of pushed us to take music more seriously and to be better at what we were doing.”

That original group was dubbed Line of Sight, and Paz says that even later, when Martinez had gone off to college at New Mexico State University and, later, New Mexico Highlands University, then on to teach language arts and wrestling at Pecos Middle School, music was still a major part of his life. Martinez even spent time drumming for short-lived punk act Scapegoat—the man contained multitudes.

“Not many people know he was one of the best wrestlers in the state,” Paz notes. “He was really devoted to that, but even as we became adults and he was teaching and coaching wrestling, he still always had that energy for music.”

By 2008, with Martinez away at school, Delgado and brothers/MCs Eric and Max Scott (who went by Fluid and Symmetry, respectively) formed the group Outstanding Citizens with a healthy foundation of beats produced

by Martinez. When he’d visit from college, he’d crash with friends and work

on music nonstop. By 2010, Delgado and Martinez had formed an offshoot duo called Osmosis. The formations would change and MCs would come and go before late 2016, when Martinez, Delgado and others officially formed Outstanding Citizens Collective, a broader hip-hop umbrella that to this day includes music releases, art and design, performance, podcasts and anything else they could think up.

“We were all getting a little older and realizing we had all this potential and skill, and we decided to bring it together into a more unified group,” says co-founding member Zach Maloof. “So then Wolfman and Benzo did a show at Meow Wolf with Sage Francis, and it gave us the confidence for this thing we were doing.”

“Benito was like my little brother,” says DJ and local hip-hop royalty Sol Bentley. “I worked with him a lot when he was a younger guy, talking about what it is to be a vessel, what it means to inspire people through your actions, your words, your music. We had these discussions when he found out he was going to be a father, when he was starting these crews, when he was going to teach wrestling, and those things never really changed throughout the years.”

Bentley says he and Martinez had been working closely together when Martinez died, and that the last year heralded some of their best talks.

“We all go through stuff, and it’s nice to have people who actually care and who you can reach out to,” he tells SFR.

“I was happy he trusted me enough to reach out. He had no idea what it meant.”

“He just had this magnetism,” Delgado adds. “If he was there, you wanted to be around him. He’d make you laugh, make you feel good, be real with you. He would push you to be a better version of yourself. He was good at everything he did, and being around people was something he did extremely well. He was a shirt-off-his-back kind of guy.”

Oustanding Citizens Collective, Paz (as DJ Shatter), Delgado (as Wolfman Jack), Bentley and numerous others will come together at Tumbleroot this Saturday to honor Martinez with what turned out to be a fairly large collection of unreleased Benzo songs; some will perform, selections from Head Trip will be honored and, according to Maloof, other surprises might be in store. All proceeds will go to Martinez’s family and the two children he left behind.

“It probably would have all fizzled out for me if it wasn’t for Benzo,” Delgado says. “It’s up and down. Every now and then I just kind of stop and can’t believe it. There’s a big hole.”

MOVIES The Sparks Brothers Review How to make music and win friends for 50 freaking years

++ WILD AND FUN;

Turns out pretty much every band you’ve ever loved in your life was influenced by California weirdo pop-rockers Sparks. OK, that’s a stretch, but if you’ve bumped any pop-rock record after 1974 (or any synth record after 1979), just know the purveyors of those albums were almost undoubtedly inspired by or otherwise indebted to Sparks’ Ron and Russell Mael—and filmmaker Edgar Wright (Baby Driver) is out to prove that with his first-ever documentary, The Sparks Brothers.

Following the notorious, mysterious and ­ever-evolving career of the brothers Mael becomes a veritable schooling on the who, what, where, when, why and how of the very trajectory of rock music, from the glam rock-meets-classical weirdness of “This Town Ain’t Big Enough For Both of Us,” to the Giorgio Moroder-produced No. 1 in Heaven and up through the band’s unexpectedly wonderful FFS project with Scottish post-rockers Franz Ferdinand in 2015 (and beyond). Through interviews with collaborators, former bandmates, current musical titans and actors, comics, singers, artists, etc., Wright tours it all—early sojourns

++ STUNNINGLY BEAUTIFUL -- PLAIN NOT THAT GOOD; LACKING IN SURPRISE AND ORIGINALITY

While we can definitely give points to Pixar’s newest foray Luca for its gorgeous animation and light queer underpinnings (positive queer relationships in mainstream cinema are almost always a plus; see this week’s cover story, page 19), its tone, pacing, style and even narrative are so derivative of the great anime director Hayao Miyazaki that it practically passes homage for straight-up hero worship—only without bothering to understand what’s so special about films like Kiki’s Delivery Service, Ponyo, Spirited Away, etc.

Here we find Luca Paguro (Jacob Tremblay), a young sea monster living underwater near some sun-kissed and impossibly beautiful Italian ­village (think Cinque Terre) who longs for something more than his family’s underwater farming business. Said family (voiced capably but uninterestingly by Maya Rudolph, Jim Gaffigan and Sandy Martin) is forever warning him to not think about the surface and its “land monsters” but, of course, our hero has feelings.

Enter Alberto Scorfano (Jack Dylan Grazer), another young boy with a secret that is so painfully and obviously telegraphed, they should’ve just named him Alberto Plot Device and been done with it. This guy likes taking it to the surface on the reg (because apparently these sea monsters become passable human 24

to Beatles shows, elusive American success (and bonkers European adulation), coffee breaks, McCartney tributes and on and on and on...Seems no one who made or makes music since the mid’70s didn’t have Sparks on their radar, and getting a documentary film while Ron and Russell are still alive feels both timely and vital.

They’re funny, you know, and this winds up being much of the point (which would obviously resonate with a filmmaker like Wright, what with his particular brand of wit)—that a band could take its work incredibly seriously while poking fun at everything possible, as does a career that spans five decades without ever selling out, corrupting or otherwise morphing into anything other than what its creators desired. That simply doesn’t happen often enough, if at all, and if you don’t know Sparks, you really should rectify that immediately.

Wright does veer into a sort of hero worship position rather than that of objective storytell-

people when they’re dry, which we’re just supposed to accept), and he gets Luca to do the same. There on land, the two meet Giulia Marcovaldo (Emma Berman), an adventurous young cycling enthusiast who lives with her dad in the summers. And so the three enter a triathlon inexplicably sponsored by a pasta company in hopes of winning prize money for a Vespa—Pixar’s idea of Italian people being that they’re all obsessed with Vespas and pasta. Luca’s family, meanwhile, wants to know where he’s going all the time, and the town bully is none too pleased, either. The rest of the town hates sea monsters...there’s an angry cat.

Setting aside the coming out/fish-outta-water idea here, Luca drags. And whereas a director like Miyazaki is a master of Ma—the Japanese concept of negative space wherein, by showing his characters experiencing normal or even boring human events, we subconsciously form attachments to them—director Enrico Casarosa’s shambling, unoriginal story feels like it’s constantly searching for things to fill the silence and rarely finding meaningful ways to do so. Maybe there’s something to be said about leaving the womblike ocean for the scary unknown, or maybe there’s an adage about friends and family someplace in there, but even film newcomers like young kids will probably figure out this formulaic piece a few minutes in and wonder why they’ve been so underestimated.

er, and there are only so many times we can hear Beck or Jane Wiedlin or Todd Rundgren repeat how Sparks were ahead of their time or important to everyone or deliciously weird. Still, it’s hard not to fall in love and impossible not to bob one’s head along with 25 albums’ worth of jams.

Sparks remains cutting-edge and charismatically, pitch-perfectly captures hearts during their own appearances in The Sparks Brothers. A good music doc should leave one feeling at least mildly obsessed. With luck, Wright’s opus will finally give Sparks that kind of attention in America. As one of the talking heads says in the film, to those who come late to the party, the point is not to gatekeep, but to simply and warmly say welcome aboard.

++ BODY CONTORTIONS; POP MUSIC -- POOR SCARE DISTRIBUTION

Watching scary movies is like eating spicy foods—they’re acquired tastes, and if you aren’t used to it, they can make for an unpleasant experience.

Fortunately for us, Vera Farmiga (The Departed) is not an acquired taste, she’s just plain pretty good, and in the newest entry in the long-running Conjuring series (annoyingly subtitled The Devil Made Me Do It), Farmiga reprises her role as real-life “psychic” Lorraine Warren for the fifth time. She not only carries the movie by virtue of her natural performance, but because her character has the psychic skills to move the plot forward. Her husband Ed (Patrick Wilson; Hard Candy), meanwhile, is too typically 1980s man-in-charge for us to care, and he moves literally nothing forward. Either way, the Warrens are back to investigate demon shit, and it’s scary.

THE SPARKS BROTHERS Directed by Wright Violet Crown, VoD, R, 140 min.

Like too many horror films before it, the new Conjuring flashes its “based on a true story” title card before delving into the tale of Arne Johnson (Rauiri O’Connor), the first defendant in US history to plead not guilty due to demonic possession. Turns out it totally is based on a real story known as the Devil Made Me Do It case (oh, that’s where the subtitle came from!), but unlike too many horror movies before it, The Conjuring throws us right into the action.

In the first half alone there are six jumpscares and five creep-outs (times you brace for a jump-scare but your expectations are subverted), and director Michael Chaves (who helmed the video for Billie Eilish’s “Bury a Friend”) keeps the movie tense with these and similar elements. Everything is intensified by Joseph Bishara’s score; everything is relaxed by Blondie’s “Call Me,” which totally reminds you it’s the ’80s.

Still, as the film progresses, the tension becomes more palatable. This is both a relief and a disappointment, but once the demon speaks you really can’t unring that bell; further disappointment comes in the form of a lack of motivation from particularly important characters. A shoddy revelation coupled with no reason to care about anyone other than Farmiga’s character make The Conjuring a hard sell, even if its creepier first act scares cast a semi-memorable shadow over its more forgettable scenes. BILLY BOB is a sweet, talkative, friendly boy that is FIV+, but otherwise in good health. He is extremely lovable and a very wonderful cat.

He is 16 years old. His best friend BEKKA is a big girl with adorable markings. She loves to be snuggled and is 13 years old. This pair of senior kitties need to be fostered or adopted together. They can be seen by appointment.

GEMINI (May 21-June 20): In her essay about education, “Don’t Overthink It,” philosopher Agnes Callard reminds us, “No matter how much we increase our investment at the front end—perfecting our minds with thinking classes, long ruminations, novel-reading, and moral algebra—we cannot spare ourselves the agony of learning by doing.” That will be a key theme for you in the next four weeks, dear Gemini. You will need to make abundant use of empiricism: pursuing knowledge through direct experience, using your powers of observation and a willingness to experiment.

SCORPIO (Oct. 23-Nov. 21): My unexpected interpretation of the current astrological omens suggests that you will be wise to go naked as much as possible in the coming weeks. Being skyclad, as the pagans say, will be healing for you. You will awaken dormant feelings that will help you see the world with enhanced understanding. The love that you experience for yourself will soften one of your hard edges, and increase your appreciation for all the magic that your life is blessed with. SAGITTARIUS (Nov. 22-Dec. 21): If you analyzed the best-selling songs as measured by Billboard magazine, you’d think we were in the midst of a dangerous decline in population. The vast majority of those popular tunes feature lyrics with reproductive themes. It’s as if there’s some abject fear that humans aren’t going to make enough babies, and need to be constantly cajoled and incited to engage in love-making. But I don’t think you Sagittarians, whatever your sexual preference, will need any of that nagging in the coming days. Your Eros Quotient should be higher than it has been in a while.

CAPRICORN (Dec. 22-Jan. 19): Pulitzer Prize-winning author Donna Tartt, born under the sign of Capricorn, writes, “Beauty is rarely soft or consolatory. VIRGO (Aug. 23-Sept. 22): In 1750, more than 250 years after Columbus first visited the New World, Native Americans were still a majority of the continent’s population. But between 1776 and now, the United States government stole 1.5 billion acres of land from its original owners—25 times the size of the United Kingdom. Here’s another sad fact: Between 1778 and 1871, America’s federal administrations signed over 500 treaties with indigenous tribes—and broke every one of them. The possibility that these sins will eventually be remedied is very small. I bring them up only to serve as possible metaphors for your personal life. Is there anything you have unfairly gained from others? Is there anything others have unfairly gained from you? The next six months will be prime time to seek atonement and correction.
