Water and Growth Development could help pay for pipeline, blunt possible water shortages in the future

espite what the recent, welcome spats of rain might suggest, Santa Fe remains in drought.

In 2020, the total recorded precipitation in the city was less than 60% of the 10-year average, and climate models predict that prolonged periods of drought will likely become more severe.

With construction sites for apartment buildings popping up all over town and water use restrictions in effect, it’s easy to wonder if the hundreds of new residents who move into these developments will put a strain on the city’s precious water supply.

In the short term, says Jesse Roach, director of the city’s Water Division, the answer is no.

“We have enough water. Right now, we’re doing fine,” Roach tells SFR. Requirements for developers to supply their own water rights and the city’s proactive water-saving measures mean the last year’s construction boom poses no threat to the current water supply.

But zoom the lens a few decades into the future, and you’ll see a different, more complicated picture.

Studies conducted by the Water Division predict the effects of climate change and continued growth could cause significant problems, even including water shortages as early as 2060 if water use patterns stay the same.

The city’s current methods of offsetting the water use of construction by requiring large-scale developers to buy water rights from farmers downstream on the Rio Grande could also raise ethical concerns about equitable access to water.

Roach is looking to the construction of a return flow pipeline, which would take treated effluent from the city’s wastewater treatment plant and pump it back up to the Rio Grande at the Buckman Direct Diversion, as the most important solution to achieve sustainable growth.

The city’s total yearly water use dropped from a peak of 13,000 acre-feet in 1995 to 9,000 acre-feet in 2020, despite significant population growth.

During that time, the city also built the Buckman Direct Diversion and water treatment plant, allowing it to take water delivered over the Continental Divide from the San Juan/Chama project to the Rio Grande. This water would be used in addition to surface water from the reservoirs above the Santa Fe River and pumped groundwater from the city wells and Buckman well field.

This arrangement allowed the city to rely mostly on surface water and rest its wells. Groundwater levels are rising as a result, placing Santa Fe in a better position during periods of drought, says Roach, noting that the city has a permit to draw a maximum of 10,000 acre-feet of water per year from the Buckman wells alone.

It also allows the city to offset the impact of new development.

Wells can negatively impact nearby rivers by sucking up water that would otherwise flow from an underground aquifer into the river. New Mexico water law requires the city to acquire water rights from farmers downstream to offset the impact of additional well-pumping on the Rio Grande.

Developers must purchase water rights and transfer them into the city’s “water bank” before getting a building permit, allowing Santa Fe officials to pump more water from wells.

The requirement creates an extra hurdle for developers and a competitive market for people buying and selling water rights and third parties who often act as middlemen between farmers and developers.

Kyle Harwood, an attorney who specializes

in water issues, says the market for water rights is so tight that developers are paying a premium to get their hands on the documents that will allow them to move forward with proposed projects and add new rights to the city’s water bank.

“We’ve got developers going under contract and closing six months or a year ahead of when they actually need the rights, because they’re terrified there’s not going to be any when they need them,” Harwood tells SFR. Smaller-scale home builders, on the other hand, can simply pay a fee to the city.

In the long run, this scheme is not sustainable because it could cause the city to rely too heavily on its wells for regular use, leaving no safety net for times of severe shortage, says Roach.

The city has also not conducted any analysis of how buying up agricultural water rights could impact small communities downstream.

That’s part of the reason the city is keen on moving forward with the plan to build a pipeline from the wastewater

treatment plant south of Santa Fe to return treated effluent to the Rio Grande in exchange for “return flow credits,” says Roach. The credits would allow Santa Fe to draw more water out of the river.

However, the plan has met resistance from many locals. Paige Grant, a hydrologist and the founder of the Santa Fe Watershed Association, worries that reusing wastewater will have a negative impact on farming communities along the lower half of the Santa Fe River.

Grant writes in a May 18 letter to city councilors that the credits would only “satisfy a theoretical demand.”

The city counters that it would only return the portion of wastewater to the Rio Grande that is equivalent to the amount of water that was diverted—a cheaper option than others considered.

“With the return flow pipeline, we will be able to stretch our San Juan/ Chama water...rights further,” says Roach. “And so there’s the possibility that we could change the paradigm away from, ‘OK, if you want to build here, you have to bring us water rights so that we can pump more out of the Buckman’s well field’ to ‘OK, if you want to build here, you’re going to pay us for the water that we are creating with the return flow pipeline.’”

Instead of getting water rights from farmers downstream, the city could consider requiring developers to help pay off the bond for the new pipeline.

On May 18, the city began the NEPA scoping process and submitted an application for return flow credits to the Office of the State Engineer.

In addition, city officials are considering revamping green building codes to make them applicable to new apartment buildings. The codes only apply to new single family homes as of now, and require buildings to meet energy and water standards 30% more efficient than the status quo.

City Sustainability Planner Neal Denton says he expects to make the change in early 2022.

“The usage of the water within that facility is up to the person who lives there, but what we can do is make the home more efficient,” Denton says. “That will make a difference.”

rate increase until January 2022.

“It’s not a hard-and-fast date, just the current target,” Shirlene Sitton, director of Santa Fe’s Environmental Service Division, writes to SFR in an email.

The increase comes courtesy of several pressures.

China’s ban on importing raw recycling in 2017 from high waste-producing nations like the United States, Canada and those in the European Union is one. Around the time of that announcement, the US produced roughly 38 million metric tons of plastic waste a year.

Previously, waste managers happily sent recycling to China on empty container ships making their return journey across the Pacific Ocean, where the materials found new life as recycled plastic products.

But the sudden shift put US cities and counties in an awkward position. Now that their recycling programs were no longer financially viable, what to do with all that waste?

or the past nine years, the team at the Buckman Road Recycling & Transfer Station has quietly soldiered on, sorting and processing Santa Fe’s waste. From hazardous waste to car tires, they take what residents cast aside and find the right place for its future life.

But a significant shift in how the center processes recycling, among other factors, will force the waste management agency to charge more for disposal for the first time in nearly a decade. The county commissioners and city councilors who represent their two jurisdictions on the Solid Waste Management Agency Joint Powers Board approved the funding step last Thursday, guaranteeing a rate increase for all incoming waste at both the Caja del Rio Landfill and BuRRT facility.

The cost increases take effect in October and increase incrementally for the following three years to meet the budgetary needs, while working to make up for additional, unexpected recycling charges the agency has incurred since 2019.

Rates per load brought to the landfill or transfer station will cost an additional $2.50 to $90, depending on the type of waste, but how the increase will translate to most consumers who only deal with city collections remains to be seen. The City Council and County Commission will decide later whether to pass on the extra costs to users, though the city estimates residents will not see collection

“Some communities, back in 2019 and I’m sure through 2020, they shut down their recycling program,” Randall Kippenbrock, executive director of Santa Fe Solid Waste Management, tells SFR. That would-be recycled paper and plastic ended up in the landfill.

Instead of dumping the county’s recycling program, Santa Fe’s waste managers opted to dip into their savings to continue the service. But maintaining that practice carried a hefty price tag: $2 million.

In May of 2019, instead of shipping all recyclable materials to Friedman Recycling of Albuquerque—as BuRRT had done for years—the agency reopened its Material Recycling Facility after four years of closure due to unsustainable operations costs. The “MeRF,” first opened in 2007, enabled the site to process mixed paper and some mixed container waste, which includes sorting and baling the materials.

know we’ll make our money on the back end,” Kippenbrock explains. “Now today, the recycling model is: We need to charge you up front to make sure we are going to recover our cost.”

The cost will only be passed on to consumers who already pay for waste collection; dropping off recycling at the center on Buckman Road remains free.

“Recycling is intermittently increasing,” Kippenbrock told the joint powers board. “About two years ago we were looking at 9,400 tons. Last year it was around 10,400; the last 12 months is just over 11,000 tons.” But with the increase in recycled materials came more contamination—largely in the form of food scraps, green waste and wood mixing with the plastics and other inert recyclables—which Kippenbrock estimates has increased as much as 10% since 2020.

The past year has challenged the city’s waste collection team, says Sitton. The pandemic caused a sharp decline in commercial waste, which in turn led to an uptick in residential collection.

“The big discussion among the solid waste world really is, how permanent is this shift gonna be?” Sitton tells SFR, adding that the stress on the recycling business emerged from an increase in packaging.

“We did a lot of online shopping,” she says. “I personally have cardboard piling up every week.”

Recycling crews noted the change in the set-out rate—the percentage of households that put out bins on collection day—which hovered around 50% before the pandemic and soared to 90% in some neighborhoods.

Alongside the recycling pressure, aging equipment and inflation of operation costs necessitate the agency’s rate increase. But the future profitability and sustainability of the county’s recycling program depends on how meticulously Santa Feans can dispose of their waste.

“If you can get everyone on board,” says Kippenbrock, “then you can have a very successful program that can probably lower your cost.”

fficer Gene Gonzales drew a bead with his AR-15 rifle on Richard Romero after a long vehicle chase.

Romero had fired a gun at law enforcement. Gonzales, a 12-year veteran of New Mexico State Police, pulled the trigger eight times, striking Romero with all but one of his bullets.

Romero, who was 49 and from Los Lunas, was likely living with an undiagnosed mental illness and suffering from suicidal ideations. He died at the scene along Interstate 40 near Laguna Pueblo.

A fellow officer said Gonzales appeared “tense” after the exchange of gunfire on Oct. 17. As is common practice, he was placed on paid leave after the shooting to gather himself and let an investigation proceed—but only for about three weeks, a relatively short period of time, experts say.

He was back on patrol by Nov. 13.

Six days later, Gonzales fatally shot Rodney Applewhite, a 25-year-old Black man who was traveling through New Mexico from South Bend, Indiana. The case grabbed national attention and, initially, few answers from the consistently transparency-averse State Police.

Though Romero was allegedly armed, there are similarities in the two cases.

Applewhite, who was unarmed during his traffic stop, showed signs of living with mental health problems after five years in the Indiana prison system for taking part in a robbery. A forensic toxicologist found methamphetamine in his body.

SFR is revealing for the first time that Gonzales had killed another man just weeks before he fatally shot Applewhite twice, including once in the back. And it was, in fact, Gonzales’ third on-duty shooting at State Police, the first in 2010.

A two-month SFR investigation that included numerous interviews, and a review of hundreds of pages of police documents and more than 10 hours of video released

by State Police in response to a records request, as well as consultation with police practices experts, raises several troubling findings.

It is not clear, for example, whether State Police offers the sort of robust train-

ing for its officers in how to deal with people in mental crises that other departments require—let alone how much counseling, time off and other services are provided to officers after they shoot people, which can be traumatic experiences for police. That’s because State Police refuses to make interim Chief Robert Thornton available for an interview.

Further, SFR has found that State Police apparently violated several of its own policies during officers’ encounter with Applewhite. And details of the subsequent investigation of that shooting were leaked to one of the officers, potentially compromising the case that a special prosecutor may use to determine whether the shooting crossed the line into a crime.

How the shooting will be reviewed for possible criminal prosecution is in limbo because of the state’s hodgepodge of secretive systems for such reviews— despite recent efforts from lawmakers and even the state’s Attorney General to create a more transparent, uniform system.

And finally, according to SFR’s review, Officer Gonzales’ supervisor who was on scene offered a disturbing response to a question from investigators when asked why he broke from State Police policy when trying to arrest Applewhite.

“You know, the guy was Black, you know, the coverage in the media,” he said.

“Um, he gave no indication that he was gonna fight.”

The comment came five months after George Floyd, a Black man, was murdered by white Minneapolis Police Officer Derek Chauvin—and six months before Chauvin was convicted.

Joseph Cotton, state president of the New Mexico NAACP, says he had a “very good conversation” with Thornton and interim Public Safety Secretary Tim Johnson on Nov. 23 to discuss Applewhite’s mental health and to ask why the officers didn’t take more time with him before using force. Just one minute and 20 seconds passed between the time officers got out of their cars and when Gonzales shot Applewhite.

Cotton says he initially felt empathy for Gonzales, but after hearing more of the evidence in the case in a May 4 interview with SFR, he wants both officers fired and to lose their police certifications. He also wants another meeting.

“It’s about changing the way the policing [is done] and holding policing accountable in this state,” he says.

Edward Molina, a Phoenix-based attorney who represents Applewhite’s family, tells SFR he’s put State Police on notice that he intends to sue the department for wrongful death.

‘Is this my house?’

Applewhite reportedly left the Indiana National Guard in 2015. While a student at Indiana University South Bend, he was convicted of being the getaway driver in a robbery and was incarcerated at a “community-based residential facility” that provides inmates with programming in job readiness, substance use disorder and cognitive skills.

“Rodney was not a killer or a person that would hurt somebody,” his mother Katrina Cox told a TV station in South Bend. “He was trying to get his life together.”

Court records show he failed to return from work release in 2017 and a judge sentenced him to three years.

“Going to prison is clearly going to have a negative impact on anyone,” Molina says. “From there, that was it.”

“It seemed pretty insane that this guy [Gonzales] killed someone, gets reinstated a month later, and then immediately kills somebody,” Molina says. “If they just let this guy go right back to the streets again, like, oh my God.” The officers’ attorney Luis Robles has 30 years of experience representing cops.

He says the most important piece of the case is that Applewhite tried to grab the weapon of the officer responding with Gonzales, Sgt. Robert Carrejo.

That action left Gonzales “no other choice but to shoot him,” Robles says.

“I cannot imagine what crime Sergeant Carrejo committed trying to keep Mr. Applewhite from disarming him,” Robles tells SFR. “I don’t know what drove him to do this. Something did. But certainly, Gene Gonzales didn’t know what that was. And neither did Sergeant Carrejo.”

It’s unclear whether Carrejo or Gonzales have ever been disciplined for on-duty conduct at State Police, because the agency refuses to release their discipline records.

lease any records of Applewhite’s time inside to SFR. He got out in January 2020. That fall, he set out to see his mother in Phoenix for Thanksgiving. He had spotty cell phone service during the trip, Molina says.

Applewhite ended up in Belen, New Mexico. A woman told detectives he had grabbed a tool from the back of her house around 8 am on Nov. 19, a Thursday, and walked into her living room through her unlocked back door. She asked him, “What are you doing here?”

“Is this my house? Where’s my house?” he asked.

“I don’t know where your house is.

Where do you live?”

“South Bend.”

“Well, this isn’t South Bend, and you need to get outta here.”

Applewhite calmly turned around, left the way he came, dropped the tool on the back porch and quickly drove away. The resident initially decided against calling 911, but a relative convinced her otherwise.

“And I’m like, ‘He didn’t do nothing,’ you know what I mean?” the resident said.

Arrest broke with policy, training

About 30 minutes later, Gonzales was on traffic patrol when he pulled over Applewhite for speeding. Applewhite stopped, but then drove away.

Video shows Applewhite speeding on the wrong side of the highway toward an oncoming truck, swerving just in time to miss it and a spike strip laid by Carrejo.

“Oh my God, he’s gonna try to—he’s trying to kill this person, or, I don’t know,” Gonzales recalled thinking to himself during his statement to detectives.

The officers called off the chase, checked on the truck driver and headed back to their office. They restarted the chase when two more 911 calls came from farther up the highway, in the direction Applewhite had fled.

PULLING THE TRIGGER

The specter of being involved in a shooting of an African American would be daunting for any law enforcement in this country. So there was a break from his standard, but you have to admit that this was anything but standard.

guns at him after exiting their police vehicles. He was on his knees with his hands up, and the officers watched him gesture with one hand as if he was pulling the trigger of a gun to the side of his head.

“I think if it were any other officer, number one, he probably wouldn’t have had his gun drawn out when he stepped out,” Molina says. “That elevated the level of fear or whatever in [Applewhite] at that point.”

Carrejo has 20 years of experience at State Police. When detectives asked him about stops like this one, he told them he was trained to “have the suspect prone out” before handcuffing them.

Seth Stoughton, a former police officer turned law professor, agrees. He says police are trained to get a person subject to arrest into a “tactically disadvantageous” position, usually lying face-down on the ground with arms and legs spread out.

Instead, as both men stood, Carrejo grabbed Applewhite by the webbing of his hand and slapped the handcuffs onto his wrist. At that moment, Applewhite tried and failed to grab Carrejo’s handgun.

The autopsy and dashcam video show Gonzales shot Applewhite twice, first in the legs and then in the back as he was falling down.

The Office of the Medical Investigator found that Gonzales’ first shot went through Applewhite’s left thigh and then his right thigh, and the second shot

went into his back, broke one of his ribs and tore through his liver, diaphragm and right lung.

That is “the shot where he’s falling down and the tussle was clearly over,” Molina says.

A toxicology analysis also found amphetamine and methamphetamine in Applewhite’s blood.

Molina says he’s not aware of Applewhite ever being diagnosed with any mental illness but his aunt, Sherian McCray, tells SFR he was never the same after he got out of prison.

State Police policy advises against touching someone who shows signs of mental illness, including homicidal or suicidal intent. Most officers know not to touch someone with handcuffs first, Stoughton says, because that is one of the points when people are most likely to transition from compliant to resistant.

When detectives asked why he broke with his training, Carrejo said, “Well, just uh, the sensitivity of the situation.”

Then he made the comment about Applewhite being Black.

Cotton says Carrejo’s comment is a clear statement that he would treat Black citizens differently than anyone else.

“That’s who [Carrejo] is. He’s already told you, this officer has already made a statement of the type of person he is and the type of law enforcement officer he is, which tells me that there’s no room in law enforcement for this individual,” Cotton says.

Robles says Carrejo was trying to be sensitive to Applewhite’s fear of being shot.

“Of course, the specter of being involved in a shooting of an African American would be daunting for any law enforcement in this country,” Robles says. “So there was a break from his standard, but you have to admit that this was anything but standard.”

Gonzales told investigators he was not carrying his Taser during the shooting and he had tried to get its holster fixed a month earlier. As they approached Applewhite, he asked Carrejo for his Taser, but Carrejo ignored him.

Policy requires them to carry their Tasers at all times while on duty. Robles says the Taser is irrelevant.

Molina says it’s key: “If he would have had a Taser, number one, he wouldn’t have killed him.”

Carrejo told detectives he and Gonzales were “not a hundred percent successful” in trying to help Applewhite. Immediately after the shooting, video shows they waited four and a half minutes before Gonzales

asked Carrejo where to find his first aid kit. Carrejo said Applewhite “wouldn’t let us put on bandages” and “was just moving too much.”

Robles says the officers fulfilled their duty to ask for the serious medical aid that could address the situation. Gonzales can be heard on video asking for an ambulance as soon as he shoots Applewhite, who died that day at a hospital.

Gonzales said his body camera was malfunctioning on the day of the shooting. He said it was supposed to turn on automatically whenever he turned on his lights and siren, but it was not, so he had to turn it on manually.

Carrejo did not turn on his body camera at all—a violation of a state law passed in 2020.

Organizers soon staged simultaneous protests in New Mexico, Indiana and Arizona calling for State Police to release information.

“I can’t sleep, I can’t eat. I’m heartbroken,” Applewhite’s mother said at the time, according to a media release by Faith in Indiana, a racial and economic justice organization. “Why is it always shoot to kill?

Because he’s tall and he’s a Black man?”

Two killings in five weeks

Outside a gas station on the morning of Oct. 17, Belen police allegedly spoke with Richard Romero, who told them “federal agents followed him from Arizona and he wanted to report them for harassment.”

Later that morning, Romero reportedly shot a woman in the arm outside a restaurant in Belen and fled from Valencia County Sheriff’s deputies. A dispatcher and a crisis negotiator got him on the phone and convinced him to

throw a handgun out of his car.

Police allege he led them on a chase back and forth along the highway until they stopped him. That’s when he shot at them with a hunting rifle. They shot back, killing him instantly.

Gonzales fired eight rounds and hit Romero seven times. Afterward, Officer Leo Palmer tended to Gonzales and noticed he was “tense” and still holding his rifle. Palmer told him to put away his rifle and belt in a police vehicle to make him “more comfortable.”

Romero’s mother told detectives “he has been acting very weird for the last couple weeks.”

Two weeks passed before the officers gave formal statements to detectives. It was during that period when someone leaked information from witness interviews to Carrejo.

Gonzales and Carrejo had abandoned their initial pursuit of Applewhite, but went out searching for him again after a second series of 911 calls. When they pulled up on Applewhite, who was outside his vehicle in the roadway, it appears the officers weren’t certain it was the same car they’d been chasing before. But Carrejo learned sometime between the shooting and the day of his 47-minute interview that Applewhite had tried to get witnesses to pull over. “That’s information we learned after,” Carrejo said, noting someone who saw Applewhite just before police arrived had talked with other agents immediately after the shooting.

The investigators did not follow up by asking Carrejo how he learned the information. Robles says he doesn’t know who divulged that detail to Carrejo.

“She said she tried for a long time to get Richard to see a doctor, but he never would,” State Police Agent Brandon Murphy wrote after interviewing her. She told him her son had an undiagnosed mental illness and a history of drug use and threatening suicide.

Robles says Gonzales saw a psychologist once after each shooting—all that’s required by policy—but declined to say whether he received additional treatment.

Reached for comment by phone on May 12, Gonzales referred all questions to Robles.

Typically, departments will reassign an officer away from interacting with the public during an investigation into a deadly shooting, acknowledging that it will end at some point, Stoughton says. Officers at most large agencies are also now required to go through psychological screening, and those agencies are increasingly recognizing that a single session with a mental health provider does not count as a screening, he says.

“A single session is a check-in,” Stoughton says. “But officers or anyone exposed to a traumatic event, even a completely unavoidable, totally legally justified traumatic event, may require more than that.”

State Police spokesman Officer Ray Wilson ignored SFR’s emails from April 8 and May 10 seeking to discuss the findings of this story. On May 18, he confirmed by email Gonzales’ additional on-duty shooting from 2010.

State Police records custodian Regina Chacon told SFR over the phone that it is policy to release records showing the fact of discipline, but never released discipline records for Gonzales and Carrejo in response to requests filed in February and March, respectively.

Other homicide suspects don’t get information about parts of the investigation that will help them justify their conduct, Porter says.

“The idea with holding police accountable is that although a great deal of police officers are well-trained and follow [standard operating procedures] and certainly do important work protecting the community, they shouldn’t get special treatment when it comes to the death of another human being. And they did,” Porter says.

The leak could jeopardize both the internal affairs and criminal investigations into the shooting.

State Police failed to immediately separate Gonzales and Carrejo, another violation of department policy. The pair rode together in a police vehicle with Capt. Leonardo Ornelas from the scene to the district office in Los Lunas. Carrejo told detectives he and Gonzales weren’t separated until they reached the office.

“They all know they’re not supposed to talk about it,” Robles says. “That’s why you had a supervising officer transport them where they would be processed.”

Ornelas did not document the trip, according to the Department of Public Safety’s response to a records request.

“What’s troubling is that the officers are not being treated as other homicide suspects would be treated,” says Barry Porter, an attorney with decades of experience practicing criminal defense and constitutional law. “They’re getting special treatment. They’re being put in a situation where they can get their stories straight,

They temporarily reassigned him to State Police’s “community engagement” team.

State Police detectives completed their review of the Applewhite shooting and sent their findings to 13th Judicial District Attorney Barbara Romo’s office on April 12, says Melissa Howden, her chief of staff.

Howden says Romo’s office forwarded the case to a special prosecutor, citing a conflict of interest because they work so closely with police. As of May 11, the special prosecutor had not decided whether to take on the case, Howden says.

The status of detectives’ review of the Romero shooting is unclear.

An SFR and New Mexico In Depth investigation in 2019 found that the way district attorneys decide whether an officer’s actions cross over into criminal conduct in a shooting differs from one district to the next, and the processes are secretive. Shooting reviews also can drag on, sometimes for years, and once they’re done, those making recommendations to a DA aren’t required to describe how they reached their decisions.

Criminal prosecutions of cops are rare in New Mexico, despite the state consistently ranking among those with the highest rates of police killings in the country.

The only one in recent memory is the trial of former APD officers Keith Sandy and Dominique Perez in the killing of James Boyd, which resulted in a hung jury.

And many legislative efforts at the state level get little traction. For example, out of seven bills related to police use of force and misconduct introduced in the Legislature in 2021, just one was passed, while the rest never reached a full vote.

On May 18, Molina filed a notice of tort claim alleging wrongful death in the Applewhite case.

“He was a person in crisis, and unfortunately police officers are not equipped or trained to help people in crisis because this is what they do,” Molina says. “They’re too authoritarian, unfortunately. Even if we don’t get a dollar out of this thing, what we want is for somebody to be held accountable, and for people to change the way that they approach these people. Because people dying in the road is not how this stuff should be. It is really not OK.”

So when the New Mexico Museum of Natural History & Science in Albuquerque announced a new dinosaur had been found in New Mexico, it felt improper to not ask more about our dead friends down below in the bedrock.

SFR spoke to curator of paleontology at the museum Spencer G. Lucas for more sweet dinosaur deets regarding this new discovery. FYI, the museum hopes to have the sorta-Triceratops on display

(Riley Gardner) Can you tell us a little more about how this is a new fossil discovery?

This dinosaur was actually found back the 1990s. So when you dig one up, it’s a bit of a project—a lot of plaster and coating. Only parts of it could be studied at the museum back then. We knew a general idea of what [the fossil] was, but we weren’t seeing enough of it. Come 20 years, we finally got to do a full prep of the fossil. In the process, we learned a lot more about the horned dinosaur. We found it was new—and it’s rather old for the group it represents. This turns out to be one of the oldest Centrosaurs yet found, somewhere around 81 to 82 million years old. And it’s rather far south.

All the other ones known in North America are identified from states farther north.

It’s a new kind of dinosaur, which is exciting to say. We analyzed how we think they are related to each other [this to a Triceratops], and

the analysis suggests this is very primitive. This animal is right near the base of the Triceratops’s evolutionary tree.

There’s a lot of old fossils in museum drawers. But our understanding scientifically changes, and better tools come along. Now we want to go back and look. We [at the museum] have a bunch of them.

We can collect fossils faster than we can prep and study them. We’ve got a lot. We could argue now that this species originated in the Southwestern part of North America—that’s the big scientific impact.

What kind of dinosaur is it? Close to the popular imagination kind of Triceratops, or something totally new to us?

The first difference would be it’s about half the size, at 13 to 15 feet long, while a Triceratops is around 30. We normally can tell them apart by the horns and the shape. This one didn’t have a nasal horn. The frill looks a lot different too. Along the edges are small bones that are kind of ornamented. It looks distinctive and fits the mold. They were plant-eaters too, like a Triceratops.

What’s the state’s history with dinosaur fossils like this one?

Since we’re arid, we’ve got a lot of bedrock exposed. Other places have soil and vegetation on top. What happens is that the bedrock continues to erode through weather patterns. You identify a place with one fossil and then go back a few years later, and you can find more that are newly exposed. It’s like harvesting a crop. That’s why [the northwestern region of the state] has produced the most fossils. There have been thousands of finds out there, and it’s just a tiny fraction of what remains to be found. These new discoveries show you how much we need to keep working.

For younger people who want to go out and look for fossils, there’s tremendous opportunity to go searching, and the museum can help with that—150,000 school-age children visit the museum every year from around the state. We’re one of the biggest informal science learning centers in New Mexico, and we want to educate and train young people. So I hope these discoveries encourage people to go into the sciences.

*Swoon!* Brooklyn-based multimedia maven Swoon gets in the gallery game You might have heard of New York street artist Swoon from portraits she painted of Alicia Keyes or Swizz Beatz, or even from her fateful sojourn down the Grand Canal during the 2009 Venice Biennale— but what you might not know is that her showing in galleries is relatively rare. As Tonya Turner Carroll of Canyon Road’s Turner Caroll Gallery points out, Swoon has first and foremost been a street artist—a multimedia purveyor of collage, sculpture, illustration, painting and found material murals applied with wheat paste and meant to affect change and embrace impermanence. In other words, Swoon (real name Caledonia Curry) showing as part of Turner Carroll’s 30th anniversary with the exhibition Wholeness in Mind is a big freaking deal.

“She’s had trepidations about working with galleries because she was riding around [New York City] on her bicycle putting up murals,” Turner Caroll tells SFR. “She likes to create happy surprises.

We chose her. We asked ourselves who we’d want to embody our values and mission; where we’ve come from, the legacy we’ll take with us and what we’ll leave behind.”

Turner Caroll connected with Swoon through longtime friend and artist Judy Chicago.

“Judy says she kind of adopted Swoon as her ‘radical adopted daughter,’” Turner

Carroll explains. “The more I know about her, the more I absolutely love her, her art, and I wholeheartedly believe in what she’s doing.”

For her Santa Fe show, Swoon presents multimedia pieces on panel—like smaller and more collectible versions of her street work—and the gallery went to great lengths to import “The House Our Families Built,” a box truck reconfigured to be an immersive and interactive artpiece and statement on family and legacy. Word is there’s no way to truly appreciate the truck without seeing it firsthand—another feather in Turner Carroll’s multi-decade cap. The artist will be on hand during the opening as well. The show’s relatively short monthlong runtime means you’ll have to be on top of things to attend—and you really should attend.

“Her work is about transformation,” Turner Caroll adds, “and this is kind of like our gift to the Santa Fe art community for 30 great years of our gallery.”

with the married and dangerously bored Mona Birk. Pete happens to love Mona, too, but he’s also courting Josepha O’Neil, the virtuous half-Spanish daughter of a local grocer.

The course of these lovers does not run smooth, but their troubles are the least interesting part of the novel. It sings most sweetly when Evans invokes a longgone way of life in this familiar landscape, detailing northeastern New Mexico’s evolution from farmland to hardscrabble cattle country after the Dust Bowl.

wo friends asked what I’d been reading lately—one who grew up in New Mexico, one who didn’t.

When I said I was engrossed in (­really, obsessing over) Max Evans’ seminal 1961 novel The Hi Lo Country, they both said the book sounded familiar, but they couldn’t say why.

The evocative title does tend to ring a faint bell. “The hi lo country” is a term Evans (1924-2020) coined for the vast, unknowable landscape of windswept plains and peaks in northeastern New Mexico where the author ran cattle in the years after World War II. Anyone who’s driven out past Wagon Mound on I-25 and watched the prairie rise up to meet the sky can see why the “hi lo” moniker sticks. But it’s more likely the 1998 movie adaptation—a box-office disappointment filmed locally with a big-name producer (Martin Scorsese), director (Stephen Frears), and cast (Woody Harrelson, Billy Crudup, Patricia Arquette and Penélope Cruz)—that tugs lightly at our memories.

After reading and watching The Hi Lo Country back to back (with a dram of the 2017 documentary Ol’ Max Evans: The First Thousand Years thrown in for good measure), I’m still mulling over the elusive existentialism Evans puts forth in his most famous novel. It’s based on real-life events: in this case, the violent death of the writer’s best friend, Big Boy Hittson. The back cover of University of New Mexico Press’ new 60th anniversary reissue of The Hi Lo Country frames its story as a love triangle, but it’s really a star-crossed lovers’ square.

The narrator is Pete West, just back from WWII and barely eking out a living with a small herd of cattle outside Hi Lo, a stand-in for the real-life Des Moines, New Mexico. His best friend is Big Boy Matson, an outsized roper, wrangler, brawler and gambler who falls in love

strips the grasses of moisture, depriving the steers of sustenance, and hungry bands of coyotes who prey on valuable calves. Both the wind and the coyotes are beautifully and viciously wrought.

The men keep these demons and others, some surely originating from what Evans saw when he landed at Omaha Beach on D-Day, at bay by alternating between two saloons on Hi Lo’s main drag. The appallingly drunken adventures they get up to in those watering

holes make up the most picaresque passages. One surreal episodes originates from a real-life adventure Evans, an enthusiastic bar brawler, had one night in the late ’40s when he got thrown in a Raton jail after a friend’s pet monkey started a fight.)

The Hi Lo Country is seminal beyond the word’s first definition—it’s myopically masculine. Even in Evans’ looser code of the West, where most women are down for a roll in an arroyo, Josepha and Mona still represent a dull virgin-whore dichotomy. Both women, along with a Hispanic witch character straight out of central casting, are much more clumsily drawn than the nuanced, back-storied cast of Big Boy and Pete’s barroom associates. (Arquette and Cruz do heroic work in fleshing out Mona and Josepha’s motivations in the movie.)

Whether Evans’ myopia is a fault or a virtue may depend on your own experience. Certain characters’ ethnic traits are clunkily described at best, wince-inducing at worst. Anglos take center stage in every scene; we might expect that from Westerns of this era.

Indeed, watching Ol’ Max Evans, with its narration by Peter Coyote and Sam Elliott, it seems the author’s work resonates most with self-styled White Men of the West of a certain age. (The

late Forrest Fenn provides onscreen commentary, and mercurial director Sam Peckinpah, a close, hard-drinking buddy of Evans’, spent several decades trying to make Hi Lo into a movie.) For what it’s worth, however, The Hi Lo Country’s unflinching depiction of a rape makes for a deeply fascinating plunge into a toxic masculine psyche.

Evans says in the documentary, “All the guys that survived in that lonely country up there, we went pretty crazy for a while.” It’s this generational snapshot of young men who returned from war, scarred and complex and to a rapidly industrializing rural West, that forms The Hi Lo Country’s dark, intriguing heart. The rest of the novel’s gravy is in its careful attention to the highs and lows of the land, a lovingly drawn portrait that explains the hold this capricious country has over its cowboys.

Nothing in the novel resonates quite so timelessly as a description of long-awaited rain during drought. It comes as it finally did to Santa Fe last weekend: “in torrents, cascading down the crevices, soaking into the dried earth, washing the dust from trees and bushes.” This, for Evans, is where redemption lives. “Along the banks below the draw, tender pale shoots of grass unfolded and reached for life.”

Full disclosure: I worked with Sellars a million years ago at Santacafé, but we weren’t best friends or anything. Besides, the years leading up til now found him outside the brick-and-mortar milieu and in the food truck game with beloved nonprofit culinary/business education outfit Street Food Institute.

What’s up at Horno?

“We’re calling it an Italian-leaning gastropub,” he tells SFR. “It’s hard to put it in a box, but we want it to be casual and fun and not a fine dining atmosphere—my wife has coined the term ‘fine food, but not fine dining.’ The gastropub thing lets you do anything.”

Sellars says he’s taking a page from the playbook he wrote as executive chef at now-defunct Amavi restaurant. This means things like house-made pasta and a Mediterranean flavor, but Horno will also lean into sandwiches and simpler items for lunch. Also, Sellars says, “a quarter of the menu has some Asian aspects to it.”

s Marcy Street in the midst of some kind of super-rad renaissance?

Already we’ve seen tattoo shops Shrine and Ikigai flare into existence a stone’s throw from City Hall, adding a younger bent and a hipper atmosphere to a slew of popular restaurants, coffee shops and retail offerings—but somehow eateries always seem to be the things that get people places more than anything else (we like to eat, don’t we?). Promising, then, that chef David Sellars’ fine dining and food truck background seem to be coming together in a perfect storm of culinary awesomeness at Horno (95 W Marcy St., 310-1065), which is slated for a June 20 or 21 opening.

Sellars and crew took over the former Il Piatto space in December and have spent the ensuing months renovating, developing a menu, hiring staff (which Sellars is still doing, btw) and installing

Sellars also says he’s self-curating the wine list. Amavi, where he did the same, had roughly 400 bottles on its list; Horno will be more focused and about by-the-glass consumption, but the point’s the same: Sellars knows wine. Pair that with desserts from Sarah Greene (whom Sellars met when she undertook the program at the Street Food Institute) and a planned semifreddo situation (it’s like un-churned ice cream, is creamy and I can’t think of any place around here that has it), and you’ve got a sit-down spot in the heart of downtown catering to quick lunchers, non-rush dinner guests and anyone else in the midst of a “what do we eat?” standoff.

Meanwhile, roughly a block north, Agapao Coffee’s Dave Black is a couple weeks into his new venture, The Mud Hut (105 E Marcy St., 670-5446), which inhabits the former Madame Matisse outpost across from the old SFR offices. You might know Agapao from its drive-thru stand (run by Black’s son Jared) in the St. Michael’s Village West shopping center, but the new space comes with even broader opportunities.

Black comes with the experience of years working with Aroma Coffee, and

Agapao already provides coffee to local spots like the Cowgirl, Dulce, Boxcar, Joseph’s, Tia Sophia’s and many others, but Black is always looking to upgrade his service game. At both Agapao locations, you’ll find organic, fair trade and shadegrown coffees, all roasted to Black’s precise specifications at a facility in Denver.

He’s also got vegetarian burritos from Posa’s, Taos-based Zia brand root beers and, soon, salads from Kaune’s and snow cones (Ecco does amazing gelato, Black says, and La Lecheria does delicious ice cream—he’s not trying to horn in on anyone’s game). Plus—no joke—when I visited last week, Black made me one of the best shots in the dark I’ve ever had in my life, and I was glad to hear him say that “I think third-wave coffee is slowly going away.”

Don’t get me wrong; techniques and newness and flavor variety are great, but I miss a good medium roast now and again.

The Mud Hut delivers. Black says he’s even looking at a possible third space in the Railyard. For now, though, if you’re downtown, give The Mud Hut a whirl.

“Anybody can open a coffee shop,” Black says, “but you’ve gotta give people a place to come back to.”

How Cold War-era Brits and Russians averted nuclear disaster and felt feelings

You probably don’t know the name Greville Wynne, but the British businessman-turnedspy is at least partly responsible for putting the kibosh on what very well could have been the end of the world during the Cold War. Benedict Cumberbatch plays Wynn in The Courier, a new docu-drama that delves into Wynne’s contributions to British intelligence’s leaking of documents proving Russia had installed nukes in Cuba during the Kennedy/ Khrushchev standoff. The real-life Wynne was sent by England’s MI6 (like their CIA) to warn deep-seated Russian asset Oleg Penkovsky about impending dangers. Fearing for his family, Penkovsky signaled the Brits about Khrushchev’s desire for confrontation circa 1960 and, working with Wynne over a few years, the pair was able to steal and leak classified information that tipped the scales in America’s favor. War, as we know, was averted, and the rest is history.

State Funeral is a heck of a slog—but it’s an effective one. An hour in, I kept wondering if it was really going to be two-plus hours wherein people amble about Russia looking forlorn, yet, at its conclusion, viewers might be thoroughly converted to its historical value.

At its core, the film is a narratorless archival footage fest that focuses on the Soviet people’s silent reactions to Stalin’s death in 1953. It’s a bit of a drudge if you don’t know your history—though, to be fair, it’s a bit of a drudge even if you do, just with a little more oomph. The repetitive imagery isn’t lacking purpose, however, and it gives viewers a chance to truly peer into ’50s-era Soviet Russia. That alone is at least a little fascinating, even if everything else feels more like something we should know even if we don’t wanna.

The masses stood dumbfounded in the wake of Stalin’s death. Many likely never knew another leader, or at least couldn’t recall one; to them, the man industrialized a peasant land and defeated the greatest invasion into their

2014’s The Imitation Game felt more inspired).

Here as Wynne, Cumberbatch’s take on terrified-yet-resolute is palpable, but Merab Ninidze as Penkovsky is the real winner of the film. Even borderline hackneyed speeches about two people being the start of change feel moving with Ninidze’s stoic delivery, and as the truth of his risks unfold, we learn why Wynne was so willing to risk his own life in reciprocity.

Elsewhere in the film, Ms. Maisel star Rachel Brosnahan provides a serviceable turn as the American CIA agent Emily Donovan, whose efforts to protect both Wynne and Penkovsky makes the ultimate fallout of Khrushchev’s—and indeed Russia’s—paranoia feel all the more heartbreaking. Scenes with Wynne’s family (played by Fargo’s Jessie Buckley and some fucking kid) feel tacked on, or at least like semi-hollow attempts at

nation after hundreds of years of God knows how many invasions. Were his crimes against humanity widely known to the Soviets by the 1950s, or were his mourners hung up on what brutal regime might have come next? What’s that saying about the devil you know? Either way, Stalin killed millions. But still, when a national radio “suggested” it, the entire Russian nation, from the Mongolian border to the Polish border, stood at attention, together, as their fallen leader’s portrait was hoisted over an in-progress dam amidst rising smoke and the clatter of work hammers.

The irony there is beautiful—a society built on collectivism indulging in Godlike worship for one man. But the grand irony is in how, within three years of Stalin’s passing, Nikita Khrushchev began the de-Stalinization of the USSR and condemned his predecessor for crimes against the Soviet people and beyond.

This haunts the footage and gives State Funeral a creeping effectiveness, even if it feels 40 hours long. While tedious, director Sergey Loznitsa offers proof that a society can flip on itself with shocking speed. We should probably remember that. (Riley Gardner) MUBI, NR, 135 min.

adding drama; it kind of stings that Buckley’s turn as Sheila Wynne at worst amounts to little more than an obstacle in the grand scheme of things and, at best, an offscreen motivator.

No spoilers here, though the true history is readily available online, but The Courier may best be described as harrowing and a bit tedious. Yes, it’s fascinating and perhaps a lesser-known chapter in international history—but it’s not the nonstop thriller its trailer would have us believe.

Frankie (Maya Hawke of Stranger Things) lives a monotonous life as a disrespected bartender with dreams of making mainstream online content— whatever that is—but things haven’t quite panned out. After meeting Link (Andrew Garfield), an eccentric drifter with contempt for people’s low entertainment standards, the two hatch a plot to degrade the beautiful people ­industry by infiltrating it, with Link becoming the i­nfluencer type he’s long despised.

Despite its head-scratching setup, Mainstream is an energetic if perplexing ride. It can be ­funny and shocking, yet the more versed you are in modern internet culture, the less shocked you’re bound to be by its machinations.

Like Garfield’s character here, influencers are often good-looking winners of some cosmic genetic lottery who are rewarded for ultimately doing very l­ittle (“Viewers aren’t looking for entertainment, they’re just horny,” one character muses). There’s a lot to unpack there, and plenty to criticize, but rather than dive into a more astute or nuanced analysis of the what and why of influ-

encer culture, Mainstream’s commentary comes across like the crotchety old person screaming at youths who embrace a system put into place long before they could work within it. What the film hints at, however—like how race, socioeconomics and corporate forces fuel marketing in terrifying ways and keep the capitalist juggernaut going—is unceremoniously pushed aside for the more obvious points about internet celebrity.
