Having just learned that the city has decided to take responsibility for the redevelopment of the midtown campus, I felt compelled to suggest the seemingly obvious highest and best use for the property: truly affordable housing. Much hand-wringing and worrying has been reported for too long on the seemingly intractable problem of affordable housing here. It would be a no-brainer to systematically examine every structure on the property, rehabilitate those sound enough, raze the rest, and then build a community of TRULY affordable apartments to be leased to the low-income inhabitants of our community who find it increasingly impossible to find housing. City-owned and -managed, tailored to the needs of the folks most in need, and providing a much-needed safety net, such a resource is long overdue and unlikely to be created within a development scheme where developers are allowed to avoid building such housing by paying a fee.

How to use your taxes to support affordable housing

anta Fe’s median home price just hit a staggering new high of $560,000, according to a recent report by the Santa Fe Association of Realtors.

If you happened across that number last week while procrastinating on your taxes and found yourself too bummed out to do more paperwork, hang in there: The IRS has extended this year’s tax deadline to May 17. On top of that, SFR discovered two different ways that you can actually use your taxes to help make a dent in Santa Fe’s affordable housing deficit.

Donate Your Refund

If you are lucky enough to be doing OK financially despite the pandemic and your income is moderate enough that you will receive a refund on your per-

sonal income taxes, consider making a “voluntary contribution” to the New Mexico Housing Trust Fund.

This small but mighty fund has had an outsized impact on affordable housing in New Mexico by providing affordable housing projects with just enough cash to qualify for millions more in federal, state and private funding.

The fund has helped back half a dozen projects in Santa Fe, including the Stagecoach Apartments built by the Santa Fe Community Housing Trust and Santa Fe Community Living built by the Santa Fe Civic Housing Authority. “[The fund is] a small but very important piece of the pie that makes everything else work and makes these projects pencil out,” says Rebecca Velarde, senior director of policy and planning at the New Mexico Mortgage Finance Authority.

Since the Legislature created the New Mexico Housing Trust Fund in 2005, the MFA has used the meager $22 million lawmakers have put into the fund to leverage more than $500 million in investments in affordable housing across the state.

In light of the pandemic, lawmakers passed legislation this year that also al-

lows funds to be used for rental and mortgage assistance.

“Frankly, the New Mexico Housing Trust Fund is one of the best bangs for your buck in the state’s investment,” Velarde tells SFR. That’s true of your investment, too, if you choose to donate all or part of your tax refund.

In 2019 and 2020, New Mexicans donated $23,405 to the fund in voluntary contributions.

It’s not a huge sum, but with a return-on-investment capacity of 25 to 1, each donation goes a long way and is constantly recycled as the MFA gives small, low-interest loans to developers that are eventually paid back into the fund and can be used again.

You can also donate your refund to 17 other programs, including the Sexual Assault Examination Kit Processing Fund and the National Guard Member and Family Assistance Fund, or to a political party.

All you have to do is attach a form to your personal income tax return indicating which fund you want to contribute to.

No tax refund? No worries. The state’s Affordable Housing Tax Credit Program is yet another way you can use your taxes to help fund affordable housing and stretch the value of your dollar to make some pretty cool projects possible.

A few miles north of Santa Fe, Ohkay Owingeh Pueblo is using the program to help fund the restoration of adobe homes surrounding the pueblo’s historic plaza into affordable housing with modern amenities.

Generations of people once lived and worked in these traditional structures, yet most were abandoned over the last 50 years and fell into disrepair.

The pueblo’s Housing Authority started the Owe’neh Bupingeh Preservation Project in 2005, and 34 buildings have since been restored, providing homes for 42 families. Now the Pueblo is seeking to raise $4 million to restore an additional 25 homes.

“We are literally saving our pueblo, our culture and our language through this project,” says Tomasita Duran, executive director of the Ohkay Owingeh Housing Authority. “This plaza is what we call the heart of our tribe. It’s the most sacred space on the reservation.

It’s where our kivas exist and where we practice our spiritual dances.”

Because the project is eligible under the New Mexico Affordable Housing Tax Credit program, you will get 50% of the money you donate back in state tax credits and could get another 40% back in federal tax credits as well.

So, if you give $100, $90 could end up back in your pocket. Meanwhile, the Pueblo can use your donation to bring in significant sums from other sources.

The pueblo recently used $300,000 in donations to leverage $1.5 million in a grant from another tribe. The project qualified for an even larger grant that will pay for the restoration of an additional nine houses.

In Santa Fe, the Siler Yard project by the New Mexico Interfaith Housing Corporation and a number of Habitat for Humanity homes in Oshara Village are also eligible for the tax credit program.

To donate, just write a check specifying the developer of the project in the check memo. You’ll get a certificate for 50% back in state tax credits.

ix topics and a little over seven hours of discussion later, the Santa Fe City Council issued preliminary approval for a proposed development on both sides of Zia Road near the train station on April 8. But last week’s long-winded meeting, which followed weeks and, in some ways, even years of bitter debate was only a stepping stone in a process that has a lot of work ahead.

The Zia Station project is not yet completely in the clear to start—there are still votes for the developers to win if the project is to see a shovel in the ground on schedule, from the Planning Commission, other city committees and the City Council itself. Realigning Galisteo Road, installing new traffic lights and bringing each new construction phase before the Planning Commission call for additional public hearings.

Developers hope to have a plan for phase one construction in front of the commission by August or September, “moving dirt” before the end of the year and laying concrete by next spring, the developer’s representative, Jennifer Jenkins of the firm JenkinsGavin Inc., tells SFR. Each subsequent phase goes before the Planning Commission, though it can skip the governing body.

“Now we really start drilling down on all of the engineering, the terrain management, utilities, all of those details and any refinements to the site plan, refinements to the building design,” Jenkins says. “All those types of things play into a final development plan submission.”

Zia Station Timeline: Moving Dirt

The Zia Station development, approved by the City Council last week, would have nearly 400 apartments and townhomes, a dog park, and space for restaurants and retail.

Developers will now have to start a completely new and separate process to change the current alignment of Galisteo Road and set it farther back from St. Francis Drive as part of a traffic mitigation effort. Moving Galisteo Road will also be a public process with a chance for more public comment and has to come before the City Council and Planning Commission.

All in all, completing the project could take six to 10 years.

On April 8, councilors passed five different items, including zoning changes and the overall development plan—although not unanimously. City Councilor Carol Romero-Wirth voted against excluding the property from the much-discussed highway overlay (allowing the development to have three stories) and cast the only vote against the overall design of the project.

Councilors Chris Rivera and Signe Lindell were absent from the meeting.

The topics—including affordable housing, density, arroyo stabilization, traffic and pedestrian safety, building height and overview of the legalities of changing the zoning for the 21 acres under consideration—took several hours each for councilors to discuss and ask questions. Earlier in the week, the council held a standalone hearing for public comment. The height of the project, which includes one part that will be three stories, also took up a bulk of the meeting. Jenkins says that the project can’t move forward without a third story in order to fit in affordable housing and create enough density to make a profit.

Councilor Romero-Wirth, who voted against several of the developer’s proposals, said at the meeting that amending the entire overlay district along St. Francis Drive should be taken up by the city so that the public and the governing body would not have to deal with zoning issues for each

new development in a “piecemeal way.”

“It would also allow us to have much more public participation so that we get the buy-in and the understanding of, alright, if you want affordable housing, where do you want to put it? How are we going to afford it? It may require height because, as we’re seeing with this project, you’ve got to have the density,” RomeroWirth said. “We’ve got to figure out what the trade-offs are; what we’re willing to do.

And maybe we don’t want that. Maybe we don’t want affordable housing. Maybe we want views.”

Last week’s approvals also came with some conditions, however: Short-term rentals are prohibited, and the developer must work with the city and utility companies to manage land erosion at the site as well as prepare the nearby arroyo for a potential 500-year storm event.

Developers Zia Station LLC and SF Brown plan to comply with the city’s requirement for developers to provide affordable housing by both providing units and paying a fee.

This project’s construction is planned in two phases. The first would include the construction of 14 townhomes and 244 apartments on the north side, as well as roadway improvements.

The second phase would include another 14 townhomes, 112 multi-family units, the office, restaurant and retail space, and parking.

“While we’re finalizing plans and then going through the city review process on the phase one development plan…we’ll probably have to go to a Public Works Committee, Finance Committee and then we go to the full City Council,” Jenkins says of the Galisteo Road realignment.

“When phase one goes to the Planning Commission for the final development approval, we would hope that the realignment of Galisteo was also on that same agenda. That would make a lot of sense, so you’re not approving something out of context.”

New Mexico breaks through prohibition—now the work starts current medical cannabis growers and outof-state operations to apply for licenses at the same time. Next, the Regulation and Licensing Department must craft and get public input on rules for how the complicated program will operate. That includes permits for another 11 kinds of related businesses, including retail storefronts; manufacturing of goods; and testing and research.

As department superintendent, Linda Trujillo was the face of the Lujan Grisham administration as cannabis reform grinded through the legislative process. Now that she’s on the other side of it, her load gets even heavier. The new Cannabis Control Division in her department will have 51 employees when it’s fully staffed. As of now, that number is zero. In the near future, she needs to hire a division director and general counsel.

“We are going to start at the top and we are going to have to go down as we get more resources. We don’t have the luxury

ith this week’s windy bill-signing ceremony, celebration about New Mexico’s status as the newest recreational cannabis state is in full swing and will surely ramp up as the 4/20 holiday approaches. But it will still be a few months before people can freely partake and nearly a year before retail sales begin.

Between now and then, the state has a plethora of regulations to craft before the industry envisioned by the Cannabis Regulation Act takes root.

The Legislature adopted the act after efforts in six consecutive regular sessions (and decades before that) in which advocates attempted reform. Debate stalled out during the 60-day session that ended March 20, leading the governor to call lawmakers back for a special session that lasted less than 36 hours and concluded on April 1. In addition to the rules that establish a taxation and licensing structure, the governor also signed a bill mandating the automatic expungement of past criminal records for cannabis possession charges for an estimated 150,000 people.

The next milestone is the 90-day mark.

On June 29, it becomes legal for adults to possess cannabis and to grow it at home (with limits on both; see the graphic on page 13). Next comes the state’s issuance and acceptance of applications for producers in the fall. The head start on Sept. 1 allows those businesses the required five months or so to get a commercial crop of the plant from seed to flower and ready for sale.

While licenses are significantly less expensive for new businesses that plan to grow up to 200 plants, the state expects

of waiting until the money becomes available….We are going to have to start now to get this up and moving,” she tells SFR, noting lawmakers allocated $1.7 million for the new division in the special session and will need to revisit paying for the programs long-term in the next regular session.

A drafter from the Legislative Council Service will begin work soon on the voluminous administrative literature, but that’s also supposed to happen in concert with a specifically prescribed advisory board that Trujillo must also appoint.

The much-amended section of the act creating the Cannabis Regulatory Advisory Committee stipulates that it must include three members who are designated by their positions (the chief public defender or designee; a municipal police chief appointed by the New Mexico association of police chiefs; a county sheriff appointed by the New Mexico Association of Counties) and 14 appointed by the superintendent of RLD from various groups or

professional qualifications. They include a cannabis policy advocate and qualified patient; a representative of an Indian nation; and people with expertise in public health, regulating commercial activity for intoxicants, cannabis lab science, environmental science and small business development, among other qualifications.

There’s no official process for putting one’s name in the hat for a spot on the committee as of presstime, but Trujillo says that will happen soon.

As production starts to kick off, the state also has created a complicated task for itself in regulating supply and avoiding market saturation. The topic was one of the hotly contested portions of the new rules, with proposals from lawmakers ranging from an outright prohibition on state supply limits to the kind of unpopular “plant counts” that rule the medical program.

In the end, the RLD must consider the market demand based on average sales in other states paired with New Mexico’s population. The department might also choose to determine production floors based on calculations from square footage, “canopy” or other means. That provision sunsets Dec. 31, 2025.

“A lot of eyes are watching how this number gets set,” said Sen. Jacob Candelaria, D-Albuquerque, during the final legislative debate. In his professional life, Candelaria represents cannabis producer Ultra Health in a lawsuit against the health department’s plant counts.

Candelaria has publicly said he’s a medical cannabis patient.

In one of the more dramatic moments of several he was a part of during the session, he waved a vape pen in the Senate chamber during debate and noted it contained 1 gram of indica cannabis “that will be vaped later by me…a lot of it—maybe all of it.”

Sales tax revenue will also undergo a change related to the reform. First, on June 29, the act would put to rest longstanding debate about the legality of applying gross receipts tax to medical cannabis sales by creating a specific exemption in the tax code. Then the big one: After sales begin, a new excise tax and existing gross receipts tax levies will be applied to purchases by anyone not certified by the medical program.

While backers say the “sweet spot” for taxation that raises revenue for the state and still pushes the illicit market out of business is about 20%, the tax structure for new cannabis sales would put the final rate higher than that in Santa Fe on the day sales begin. The act would levy an initial 12% excise tax on top of local GRT (currently 8.4375% in the city limits) with an escalation of the excise tax up to 18% by 2030—meaning that the local rate would

be 20.5% the first year and grow to 26.5%.

At first, local governments probably won’t notice the change to cash flow, says Taxation and Revenue Department Secretary Stephanie Schardin Clarke.

Revenue from the last medical taxable sales in June hits local coffers in August, and then new cannabis revenue from recreational sales—assuming they start in April 2022— won’t be distributed until July of that year.

Schardin Clarke tells SFR she doesn’t think any one jurisdiction will notice a big change from the loss of medical cannabis revenue, noting that those sales “aren’t such a large portion of the economy that I think it would be in the noise. There is just so much variation in GRT revenues month by month anyway.”

Once the new revenues start, the act calls for the state to return a third of its excise tax collections to local governments, and Schardin Clarke says the amounts would be pro rated based on the location where sales occur.

Locals are likely to notice those numbers, which analysts expect to grow over time. Tourism from Texas, for example, where cannabis remains limited to medical program participants, is expected to bump sales in Southern New Mexico, whereas Northern New Mexico counties are currently seeing bleed into Colorado for sales that will probably taper off and stay closer to home.

Revenue estimates vary as much as cannabis strains.

Analyst Kelley O’Donnell estimates statewide sales at $318 million in the first full year of legalization, growing to $800 million in year four and $1.1 billion by year five. But legislative budget planners predicted it will be much lower. For comparison, last year, Colorado sales hit the $2 billion mark.

Consumers aren’t the only cross-border traffic the state anticipates. Colorado growers who have been at it since that state legalized adult use in 2012 have made no secret about expansion into New Mexico’s new market. (Federal interstate commerce laws don’t protect cannabis crossing state lines.)

Maggie’s Farm, an organic outdoor business with storefronts in Manitou Springs and other locations, hired local lobbyist Mark Duran to advocate for the legislation.

“The Maggie’s Farm team feels that the cultivation climate for growing marijuana in New Mexico is one of the best in the country,” he said at a February committee hearing.

New Mexicans who want in on the first wave of commercial production should get ready by completing business basics, Trujillo says. Establishing a state tax ID, corporate structure and line of credit will make the licensing process smoother when it begins.

How Big is It? “How much is 2 ounces? Is it like a handful?”

House Speaker Brian Egolf asked during a legislative committee hearing last month. “I have zero concept of how much volume. Is it the size of a baseball? I mean, how big is it?”

“Well,” answered Emily Kaltenbach of the Drug Policy Alliance at the behest of bill

sponsor Rep. Javier Gonzales, “One ounce could be the size of a small coconut—it could fit in your hand.”

Not having a coconut handy, Egolf asked how much cannabis would weigh the same as, say, a pack of cigarettes.

A pre-rolled joint might contain an average of 1 gram of dried flower. There are 28 grams in an ounce, so at 20 smokes per pack, that’s about 2.8 packs to equal 2 ounces.

They come in various strengths and dosages, but for the sake of argument, let’s say you wanted a bag of gummies. At 10 mg of THC each, you can stuff 80 candies in your pocket.

The law allows not more than six mature cannabis plants and six immature cannabis plants per person with a household maximum of 12 mature cannabis plants.

Provided that the maximum number of cannabis plants is not exceeded, the person may possess the cannabis produced by the cannabis plants notwithstanding any weight limits.

Recreational cannabis will likely boost the local economy in Santa Fe, city officials and business owners say, but there are still plenty of details to sort out as the clock ticks toward the recently passed legalization law kicking in.

One possibility: For months, city councilors have mused about revenues from the fledgling sector becoming a primary funding source for the city’s Affordable Housing Trust Fund.

“Because this is a new industry, it could definitely tie into a new sustainable stream of funding for affordable housing,” confirms Economic Development Director Rich Brown, telling SFR that the idea is “definitely now up for review,” and that cannabis could provide for a sizeable chunk of the $3 million annual baseline target for the fund.

But before the city can begin to move that conversation forward, says Brown, there’s a whole lot officials still need to know.

In coming months, the New Mexico Regulation and Licensing Department’s new Cannabis Control Division must craft rules for production, marketing, sale and consumption of cannabis, including standards for documentation and health and safety protocols.

While the Legislature’s fiscal analysis of the bill says it gives municipalities “some authority” to regulate things such as the permitted density of cannabis establishments, Brown says the city needs clarity.

“Basically, there are three categories or entry points into the cannabis industry,” he explains.

“That’s production, manufacturing and complimentary services. We need to do research into these three areas and decide which one we can go deep in in the City of Santa Fe and whether some activities are more appropriate for us than others.”

Brown continues: “With each of these categories there will be sep-

arate regulations and impacts, and we need to consider all of them: the citizen impact, tourism impact, environmental and outdoor impact, law enforcement impact, etc.”

As one example, officials must consider how much water is used by the typical grow operation to determine how many should be allowed within city limits.

City staff have more questions than answers.

Industry professionals, on the other hand, are ready for the change.

Lyra Barron co-founded the local medical dispensary Fruit of the Earth Organics with her son, Jaum. She anticipates the legalization of recreational cannabis will bring more cash and jobs into the local economy as well as additional tax revenues the city could put to use in positive community programs.

Barron tells SFR her company is planning to add recreational marijuana to its offerings and expects it will result in a significant uptick in business. Keeping up with demand will likely be the greatest challenge.

“We have already been preparing additional facilities to accommodate the growing and processing of even more cannabis flowers and products,” she tells SFR. She also envisions creating a community consumption area where visitors will be able to enjoy live music and events.

Fruit of the Earth grows its own product on an outdoor organic farm, and Barron says the company will continue to ensure the highest quality standards for products sold to both medical and recreational customers.

“I’m committed to it as a medicinal plant, and whether people have a medical card or not I will still always hire the most knowledgeable staff I can,” she says.

“We train and educate our staff in the medicinal properties and give all of our customers extensive consultations as needed, and that will continue.”

magine, at some point in the spring of 2022, you are driving in New Mexico and your cellphone drops onto the floor of the car. As you bend down to pick it up, you accidentally swerve briefly across the white line. You correct easily, but suddenly there are red and blue lights flashing behind you.

Coincidentally, you also have a pinch of cannabis in a small bag in the center console. You feel a moment of panic, until you remember—you’re in the New Mexico of the future, and cannabis, in certain amounts, is now legal to possess.

Those flashing lights don’t mean what they used to—an officer seeing a certain amount of cannabis in your car no longer serves as probable cause for a search and it isn’t a crime.

This will all be thanks to the Cannabis Regulation Act, which tackles some thorny issues around our Fourth Amendment rights for lawful searches and seizures, but leaves some (like the presence of paraphernalia) to be tackled by future Legislatures.

April 12, 2021 Gov. Michelle Lujan Grisham signed a bill that taxes and regulates cannabis and another that wipes past cannabis convictions.

Soon Taxation and Regulation Department to hire top-level workers for the new Cannabis Control Division (CCD); convene the Cannabis Regulatory Advisory Committee and begin drafting rules.

June 29, 2021 Cannabis possession and homegrow provisions of the law begin, allowing individuals over the age of 21 to hold on their person and/or in their vehicle 2 ounces of cannabis, 16 grams of cannabis extract and 800 milligrams of edible cannabis at one time, and to grow six mature plants per person or 12 per household. Public smoking is prohibited.

No later than Sept. 1, 2021 CCD accepts and begins processing license applications for cannabis producers, cannabis producer microbusinesses and properly licensed medical cannabis producers.

Last day for rules to be promulgated on a variety of regulatory topics, including product purity and safety tests; businesses licensure; inspection, recordkeeping, labeling; purchase limits; physical and cyber security. Rules must undergo public hearing and be available for review 30 days before such hearings occur.

No later than Jan. 1, 2022 CCD issues licenses to conduct commercial cannabis activity for people properly licensed in the medical cannabis program.

handle enforcement once cannabis is legal—and it’s still not clear how law enforcement will be able to tell if someone is impaired from marijuana.

Unlike with alcohol, there is no scientific test to determine whether someone is high at the time of driving.

(That said, Megan Dorsey, the technical expert on the legislation, tells SFR the law permits research designed to improve cannabis impairment detection. “As the science develops, so too will the law,” she says.)

According to the law, the smell or visibility of cannabis products (or even the suspicion of having more than 2 ounces of cannabis) is not probable cause for an officer to stop, detain or search someone. Sixteen grams of extract, 800 milligrams of edibles or multiple containers of cannabis are all legal to have on your person or in your vehicle.

“We are still evaluating the new legislation and its impact on DPS operations,” Ray Wilson, a spokesman for the Department of Public Safety, writes SFR in an email. “In the very near future we will be providing our officers with direction on how to proceed in reference to cannabis enforcement.”

Jennifer Burrill, vice president of the New Mexico Criminal Defense Lawyers Association and a public defender in Santa Fe, tells SFR that once the law takes effect, previous issues defense lawyers have had around probable cause, such as an officer pulling someone over for a broken taillight and then smelling marijuana and getting a search warrant for the entire car, should be moot.

“You’re going to have to establish probable cause for search warrants that they used to be able to get just off of a smell of marijuana that often led to other evidence of different types of crimes,” Burrill says.

Burrill is still concerned about people getting in trouble for having paraphernalia on them, saying that could be “troublesome.”

But Dorsey says that paraphernalia possession was decriminalized in recent years. It is only a penalty assessment citation unless there is evidence of something other than paraphernalia possession. In that case, a search would likely not be justified.

Some things show no signs of changing, including several certification programs in New Mexico designed for officers, such as the Drug Recognition Expert program and the Advanced Roadside Impaired Driving Enforcement (ARIDE), both of which teach law enforcement how to recognize signs of impairment.

A DRE is trained specifically to identify individuals under the impairment of drugs, even where it is highly likely the impairment is not caused by alcohol and any breath test would turn up no result. A DRE is supposed to be an “expert” in determining whether someone is too drunk or high to be driving legally.

It’s a relatively niche training. Of the thousands of law enforcement officers in New Mexico, only 62 are DREs, according to data provided by DPS. Only two of the 84 Santa Fe Police Department officers are DREs. There is no extra funding on the horizon or specific plan to train more officers, according to New Mexico Drug Expert program spokesman Charles Files.

“Although the bill is new, driving under the influence of marijuana is not,” writes SFPD Capt. Matthew Champlin. “Officers will continue to enforce the law to ensure our roads are safe.”

Around the World Nonprofit Littleglobe continues Littleglobe TV project; announces NEA grant The team at local nonprofit Littleglobe is embracing the beginnings of springtime with a new episode in its ongoing Littleglobe TV series.

“We are finding ourselves ­hopefully coming through most of COVID-19,” says Littleglobe Executive Director Chris Jonas. “We’re emerging changed. Our town has changed and Littleglobe has changed, and it is ­really important that we take the efforts to make sure we’re telling a broad base of complex stories.”

Littleglobe TV was founded at the onset of the pandemic as many of the world’s cultural and nonprofit offerings were phasing into more robust versions of online communications. The next episode’s particular set of stories are all about the spring season, including a vignette about carrying on a mother’s gardening tradition from contributing producer Nadine Oglesby, and a piece about Santa Fe’s Thai community coming together to build and maintain a greenhouse full of Thai-centric veggies by producer Nutthapol Ma. The episode will feature at least seven other pieces as well, which represent as wide a swath of people as could fit within a reasonable amount of time.

“One of the things that drives me crazy about Santa Fe is that everybody is trying to reach consensus about who we are, but we’re this complex weave of people,” Jonas says. “Santa Fe is expanding. We’ve got more people, the same housing crunch we’ve always had; we’ve

got people whose families have lived here hundreds of years, and people who are just starting their connection to this place. We need to start to understand who lives in our town right now. We’re just saying you have neighbors—know them.”

Littleglobe also announced a $30,000 windfall from the National Endowment for the Arts, which will go toward ­future versions of its ¡Presente! program of live storytelling events—­ including ­stipends for storytellers.

Previously, ¡Presente! events have taken place in more traditional theater settings, like the Lensic Performing Arts Center.

Jonas says he envisions new installments in outdoor spaces, possibly even at block parties, but only time will tell.

“We really want it to be stories about Santa Fe by Santa Fe,” he explains. “It isn’t this colonial notion of the outsider looking in—it’s people telling their own stories, and it should run parallel to the work that’s going on in other parts of town—our monuments and public spaces and how we hold such a complicated history. We see it as kind of being a way for us to ask the questions of who’s in the room. How do we occupy the same space together?” (Alex De Vore)

Santa Fe Film Institute Announces Grant, Scholarship Local nonprofit hopes to ease daunting filmmaking expenses

With film productions once again shooting in New Mexico, the Santa Fe Film Institute last week announced a new scholarship and grant program for local and regional filmmakers who need a financial boost. The institute is the nonprofit arm of the Santa Fe Independent Film Festival and was founded in 2013 by Liesette Paisner Bailey, her brother Jacques Paisner (also artistic director of the Santa Fe Independent Film Festival), filmmaker Chris Eyre and Central New Mexico Community College English professor Marissa Juarez.

“At any stage of making a film, you’re going to need a little help,” Paisner Bailey, the Santa Fe Independent Film Festival’s executive director and treasurer for the Santa Fe Film Institute, tells SFR. “We really want to advance the artistic v­ ision of the filmmaker.”

The newly announced programs o ­ ffer up to $2,500 to New Mexico ­filmmakers and up to $2,000 to filmmakers from Arizona, Colorado, Oklahoma and/or Texas. Additionally, two aspiring or c­ urrent New Mexico-based film students can apply for a $500 scholarship to be used toward their studies. The announcement builds onto SFFI’s already-established fiscal

sponsorship and mentorship programs for filmmakers in search of professional guidance, though this will be its first foray into the scholarships and grants game. Paisner Bailey says this is just the beginning.

“We’re definitely looking to make it annual,” she says, “and growing the amount given out, both in grants and scholarships.

And the more sponsors we have, the more we can give.”

Even better, the new program eschews the traditional qualifiers of similar artistic funding opportunities. According to Paisner Bailey, many other film scholarships and grants require certain criteria be met, such as specific production needs or narrative requisites that reflect a particular theme, genre or subject. The Santa Fe Film Institute’s new process opens the doors to filmmakers in all stages of production, however, from screenwriting to the final post-production touches—and the filmmakers can keep their vision intact.

Paisner Bailey predicts the funds could herald long-term positive results throughout New Mexico, even if filmmakers in neighboring states are eligible.

“Our preference is for New Mexico filmmakers,” she explains, “but still, there are not a lot of scholarships for people in film out there, so we wanted to encourage people even beyond the state to apply.”

It’s also about making opportunities for young creatives in New Mexico, who often leave the state in search of better opportunities. As the film industry has ebbed and flowed over the years—most notably ebb-

ing during Gov. Susana Martinez’s administration—New Mexico has always kept a strong toehold in the industry. If newer and/or younger filmmakers have even a small financial cushion, there’s no telling where that might lead.

“By having a scholarship and granting program,” Eyre tells SFR, “SFFI is showing its commitment to local youth.”

We want to entice filmmakers to come here and to talk more about New Mexico productions.

Eyre and Paisner Bailey also hope to bolster more community-based film education opportunities in Santa Fe. That might be as simple as film screenings in Railyard Park, or panels, Q&As and workshops from and for filmmakers. The Santa Fe Film Institute also hosts a weekly radio show on Saturday mornings. Led by Paisner Bailey and brother Jacques, Film Talk Weekly airs on Talk 1260 and 103.7 KTRC.

SFFI’s scholarship and granting a­nnouncement comes at a time when the state’s film industry shows signs of making a particularly strong comeback.

The New Mexico Film Office announced seven productions of various sizes and budgets in March and, last November, streaming juggernaut Netflix announced a $1 billion expansion to its studios in Albuquerque. In January, MovieMaker magazine even listed Santa Fe as the second-best small town for filmmakers in America (trailing only New Orleans) and Albuquerque as the best large city, edging out traditional heavyweights like Austin, Chicago and Atlanta­—the latter of which is seeing more productions packing up and leaving in response to Georgia’s racist voting laws.

Applications for Santa Fe Film Institute grants and scholarships open May 1 and recipients will be selected by committee. Grant submissions are open until July 26, while scholarship applications will remain open until July 31.

Paisner Bailey says she expects to announce the first-year beneficiaries in early November.

“We want to entice filmmakers to come here and to talk more about New Mexico productions,” she says. “Ultimately, we want what’s best for a filmmaker. We want to support someone who grows up here and makes films. If they have to leave and make a film and then come back to make more, we’re going to support them. It’s ­exciting to see the boom.”

This year, that boom also includes federal funding. In February, the institute received a $20,000 grant from the National Endowment for the Arts—one of only 16 New Mexico-based arts organizations to do so. And just last month, the Santa Fe Community Foundation’s Native American Advised Fund granted SFFI $5,500 to continue its mission of promoting Indigenous filmmaking.

“It’s all for the filmmakers,” Paisner Bailey says of the money. “We want New Mexico to feel like home for them.”

...and it was the best croissant I ever had

s I write this, my friend Angelo is visiting from New York City for family reasons. It’s been ages since we’ve seen each other, but since we’re both fully vaccinated and feeling better about responsible forays into the real world, we hit up Cafecito (922 Shoofly St., 310-0089) in the Baca Street Railyard for hugs and brunch.

Not to split hairs, but I first visited owner Anders Paglayan’s spot in the former Opuntia location within the Trailhead Compound when it opened in 2019. At the time I was wildly unimpressed with the sandwich I sampled, and took the eatery off my to-do list in the hopes it would improve over time. Then, of course, 2020 happened, and not only was I making a point to not set foot in restaurants for the good of my ­fellow human, I was spending my to-go bucks at restaurants I knew I loved and wanted to stick around (as if my $25 order was the one thing standing between a locally owned New Mexican joint and the terror of the COVID-19 economic slowdown).

Turns out this was a really hasty move for several reasons, not least of which is the Cafecito croissant (dubbed the medialuna). Now I’m thinking a mile a minute things like: New restaurants

slices instead of meat, a fresh croissant and a side of dulce de leche. I wasn’t familiar with the latter item as a breakfast item, but when in the Baca Street Railyard….It was brilliant, frankly. The croissant was laminated to a crispy, flaky perfection and, unlike most other croissants I’ve eaten in my life, at least outside of France (which is for sure a flex), it was served warm. I ­assembled a makeshift breakfast sandwich with the eggs, cheese and avocado, and the medialuna’s soft and chewy inside added strong yet pleasant butter tastes and textures.

Even better, the scrambled eggs were obviously not made from some half-gallon carton of the stuff emblazoned with the Shamrock Foods logo—these were literal eggs the ­kitchen had to crack and scramble and cook. They were also seasoned ever so slightly, but well enough that I didn’t need to salt or pepper myself.

Our server told us the restaurant makes baked goods daily; the croissant I’d eaten had been baked that very morning. And though we didn’t get a chance to try the empanadas ($3.65 apiece or $13 for a sampler with a side salad), doing so has since become an obsession.

“They do a good job,” our server said.

Too true. I even took one home, as well as a slice of the pasta frola dessert—a sweet tart made with quince—which was delicious even after a few hours in my fridge. I only wish I’d asked about a side of dulce de leche to take home. I could have eaten it with a spoon. I might still.

And this isn’t even getting into Cafecito’s regular dinner service (they also serve rice pudding at night!) or the small but impressive beer and wine list.

In other words, Cafecito went from the “skip it” column to the “we can’t get back there soon enough” column, and I’m going to just go ahead and recommend it to anyone reading as a “get there now” sort of thing—but only if you promise to be safe.

My companion—who, by the way, is a highly sought-after pizza expert and consultant—said he was missing the flavors of the area. He grew up here and longs for chile, as we all do. There’s a little bit of that on Cafecito’s menu,

though its style is really more informed

by Paglayan’s Argentinian background.

Still, my buddy zeroed in on chilaquiles with house-made tortilla chips, green chile, roasted potato and provolone over fried eggs ($13.50). Arriving piping hot with a beautiful green salsa topping, it not only looked gorgeous, it tasted divine. I struggle with chile that emphasizes heat over flavor.

At Cafecito, at least with this dish on this day, that wasn’t a concern. Yes, purists, it had a spicy kick, but also that deep tang of well-roasted green—the kind that makes New Mexico famous and makes former residents say things like, “Why did I ever move?”

Forceful and often intense, Moffie strikes a blow at the destructive nationalism of 1980s South Africa

One would suspect 1980s South Africa isn’t high on any list of time-travel destinations.

Director Oliver Hermanus’ Moffie thankfully doesn’t drench us in revisionist nostalgia that’s all the rage in queer filmmaking these days. At the height of the South African border wars, the apartheid-governed country drafts all men over the age of 16 into the armed forces—including Nick (Kai Luke Brummer), who’s thrown into a dehumanizing boot camp that makes middle school PE class look inviting.

Nick’s homosexuality is more a backdrop in the story. The boot camp ordeals are violent and hard to watch, so much so that the actual border wars feel moot in comparison. Meanwhile, per the rules of queer cinema, Nick’s blossoming relationship with his fellow recruit Stassen (Ryan de Villiers) is there—and it’s not. The connection comes suddenly and redirects just as quickly, detailing how the South African society of the time

You’d think at a certain point Hollywood itself would grow sick of ignoring new ideas and/ or cinematic properties hitting the big screen (and, thanks to COVID-19, the small screen), but when it comes to Godzilla vs. Kong, we’ll just direct you to a text from a friend who also watched this thing on HBO Max over the weekend: “This movie feels like it was written by a MadLib.” Some spoilers follow, but it doesn’t really matter.

Indeed, when we rejoin King Kong following 2017’s Kong: Skull Island, he’s now living it up in some corner of the island paradise, only, uh-oh—it’s actually a super-advanced simulation program a la Star Trek‘s holodeck.

But he knows it, so he smashes stuff. He also has a tight butt for some reason. Anyway, turns out Kong built up an affinity for a little girl from the island who has been teaching him sign language like he’s Amy from Congo. Like MadLibs, the ultimate narrative of the piece feels pointless; like MadLibs, the end product feels like a joke.

Elsewhere, Godzilla is kicking it in the ocean, but decides to attack humanity, even though he was buddy-buddy with humans in 2019’s King of the Monsters. He particularly

was possibly made up of men who saw emotions as foreign and confusing entities.

The central critique of South Africa holds firm throughout—apartheid was destructive not merely for those it oppressed, but for those on top who surrendered humanity for power. And it’s not just the military. Hermanus’ film goes to great lengths showcasing how the struggle exists in every aspect of South African life, constructing a society of parents unable to express love and children baffled by the very concept.

Moffie can thus be read both as a classic queer story and coming-of-age tale, but to see it as ­simply one or the other would be to miss the point. Queer people are less defined by romantic attractions and more by the societies that shape

likes Millie Bobby Brown of Stranger Things, who doesn’t buy the attack and wonders aloud why he would “flash an intimidation display,” as if she’s some kind of giant lizard behavioral specialist. Spoiler alert: The Apex corporation tricked Godzilla, and Brown’s character joins forces with a podcast host who works for said corporation (but only to dig up dirt; Brian Tyree Henry) and a friend from New Zealand to whom she’s very mean (Julian Dennison).

And so it comes to pass that the humans decide Kong is their friend, that Godzilla needs to get real and that it’s vital to get that great ape to the center of the planet where, for some other baffling reason, there’s a whole stinking ecosystem full of fantastic beasts (and, somehow, a sun-like light source). See, that’s where Kong is from and that’s where he keeps this totally bitchin’ weapon he made from Godzilla spines or something. Good lord.

You may be enticed, during the heat of a Kong/Godzilla slug-fest, to think about how this movie isn’t so bad. Fight that feeling, because no matter how many cities they level or sci-fi things they engage with or Godzilla spine weapons they brandish, even the least studious film fan simply must feel on an instinctual level that this is trash of the highest caliber.

This is the movie that gets made when some glad-handing focus group schmuck pulls together a group of complete assholes in a middle America mall someplace to ask what they

them. Don’t go into Moffie hoping for escapist cinema. But if you’re in a “destroy the patriarchy by psychoanalyzing stupid men” mood, you’re on the right track here.

Like an indie, queer, art house-leaning Full Metal Jacket, the film becomes an ­anxiety-riddled experience and succeeds in diagnosing the trickle-down effects of a societal foundation which seemingly exists on self-inflated superiority.

think should ­happen. No slick CGI or neon-festooned streets of Hong Kong or callbacks to the yesteryear characters from the Godzilla periphery can save this dreck. The animated short films nominated for Academy Awards this year are, to be frank, bleak. Animation is often wrongfully disregarded as a medium for kids and therefore dismissible—but this year’s collection tries to prove naysayers wrong.

Burrow is Pixar’s yearly innocuous offering, and follows a little bunny with dreams of a multi-room burrow, complete with a disco ball and other consumerist items. Her neighbors’ burrows are far more ornate than hers, leaving our heroine to dig as far away as she can to avoid their judgement. It’s cute, harmless and simple, plus devoid of any really meaning other than “awwwww!”

On that note, the French short Genius Loci will give your children nightmares. A Picassolike style here gives us a 16-minute odyssey

into…something. A journey into the schizophrenic mind? An eventful late-night walk? It’ll be hard for even the artistically sophisticated to grasp, but thankfully, it’s visually stunning, even if not engaging (and somewhat frightening).

Netflix’s If Anything Happens I Love You is Oscar-bait on steroids. This was the best animation of the bunch, a beautifully fluid cross-hatched world wherein a husband and wife grow distant while trying to come to grips with their daughter’s death. While timely, it feels exploitative upon the reveal, even if there’s sincerity to be found.

The Icelandic Yes-People fits the yearly “I ­cannot believe this got an Oscar nom” bill. Six people in an apartment building slowly reveal their day-to-day coping mechanisms, from video games to a little whiskey in mother’s teacup. It believes itself profound, but the credits rolled and an involuntary shrug followed. Life sucks, people need therapy, etc.

Lastly, former Pixar animator Erick Oh’s Opera features humanity’s history within a pyramid of rooms, an individual action promoting a reaction into another room; and another, and so on until the entire pyramid is filled with activity eventually eradicated by war. Then it starts again. Opera is absolutely mesmerizing and easily the best of the bunch. So, while this year’s nominees aren’t the strongest, there are still pockets of brilliance. And if you open it, you’ll be led to potential opportunities for interesting changes that offer you liberation. This is a rare blessing. Please be sufficiently loose and alert and brave to take advantage.
