While New Mexico has some spectacular wilderness areas presenting hiking, skiing, and other recreating opportunities, please consider staying closer to home for any outdoor exercise activity. NM Search and Rescue Teams are comprised of volunteers who routinely put themselves at risk to help people in need. The Centers for Disease Control and Prevention issued new guidelines on Friday advising the use of cloth face masks made of “common materials” in public in light of new evidence that a significant number of individuals who have and are spreading the COVID-19 virus are asymptomatic.

During the Facebook live event held just minutes before the new voluntary public health measure was released, Gov. Michelle Lujan Grisham also advised the use of homemade cloth face masks to help slow transmission of the virus.

“Will that prevent you from getting the virus? Will it prevent you from spreading it? I don’t think the answer to either of those questions is yes…I do think it can make a difference by just slowing it up,” Lujan Grisham said. She also implored New Mexicans not to purchase N95 masks or surgical masks unless they are first responders or health care workers.

Santa Feans with sewing skills had already began heeding online and community calls for handmade masks.

Patricia Wagner, a professional seamstress and owner at Castro Alterations, has begun to make masks out of cotton and wool felt and is selling them for between $10-12 for adults and $3-4 for children to cover cost of materials and to make up income lost due to the statewide stay-at-home order. Her husband, Peter, says

the state health department allowed the business to reopen for the sole purpose of mask making.

“If we all wear them, healthcare workers can have a little bit of relief. We are all connected, and our actions impact the lives of everyone else in the community,” says Nedret Gürler, one woman who has been making masks by the dozens and handing them out to anyone who needs them for free.

Gürler says she learned how to sew working in a sweatshop in Brooklyn when she first arrived to the United States as an immigrant in 1983. Now, stuck at home, she says she’s happy to put her skills to use to make masks for people across the city and can barely keep up with requests.

She’s made over 100 small masks in recent days, and 25 N95 covers for healthcare workers. (Full disclosure: She provided masks for the SFR staff last week.)

Medical Officer Dr. Wendy Johnson says medical staff at the center are not using the donated masks themselves, but are redistributing them to “people in vulnerable positions” in the community, such as the homeless, high risk patients and people who do not have the ability to socially isolate.

Yet access to materials for masks is already being impacted by the same hoarding mentality that has left grocery store shelves bare of toilet paper and canned goods. In addition, fabric stores are not considered essential businesses and are closed.

Alert: Health officials say everyone should wear face masks in public to prevent spread of COVID-19

Freyr Marie, another local with professional certificates in sewing and pattern design who is contributing masks to the cause, cautions folks who want to help “try not to respond from a panic or scarcity mentality.”

“Talk to people who are in real need and ask them what they actually need.

That’s the place to start,” advises Marie, acknowledging that some people have greater access than others to harm reduction strategies including social distancing, masks and hand washing.

Johnson from La Familia Medical Center says those are still the important things people can do to protect themselves, but that any kind of DIY cloth mask made with several layers of fabric could reduce risks of transmission as long as people only wear them for a short period of time, do not take them on and off frequently, and wash them immediately after use. For homeless people and others who do not have the ability to wash their masks, she recommends hanging them in direct sunlight for a few hours.

“The point of the mask is not so much to protect yourself, but to stop you from spreading the virus if you don’t know that you have it,” she says. “It could also stop you from unwittingly touching your face.”

Lab officials say tritium waste containers like these require ventilation before long term storage.

Second-hand Notice Tribal leaders say they didn’t get a chance to weigh in on now-stalled plans to vent radioactive tritium gas

ribal government leaders say Los Alamos National Laboratory and the US Department of Energy failed to consult with them about a nowstalled plan to vent radioactive tritium gas from four containers of Cold War-era waste.

While the DOE got clearance to release the gas last year, according to a March 30 statement by the All Pueblo Council of Governors, tribes and pueblos didn’t have a chance to review the plans.

LANL’s initial plan to begin ventilation on April 17 was later postponed due to the COVID-19 pandemic.

“These operations…won’t be executed until the laboratory is able to support the activity with a full complement of operational personnel,” confirms DOE National Nuclear Security Administration spokeswoman Toni Chiri by email. The containers in which the waste is stored “do not

represent a risk to the public or the environment,” she writes.

The tritium-contaminated waste is inside four 50-gallon, high-pressure storage vessels at Technical Area 54, less than 5 miles upwind from the White Rock community on the border of Pueblo de San Ildefonso land.

The containers need to be vented, lab officials say, because over time, the decomposition of tritiated water vapors inside them could cause a buildup of hazardous gasses that could rupture the containers during handling.

The lab anticipates the release will result in up to 8 millirems of off-site radiation, which is under the 10-millirem limit set by the federal government.

Chiri says the DOE “briefed” the two pueblos nearest the site about plans and issued a notice on April 3 about the delay.

The agency’s failure to notify and consult with the tribes would conflict with federal statutes, treaty agreements and the United Nations Declaration of the

Rights of Indigenous Peoples. These include agency specific DOE policies that require tribal consultation and, at a minimum, “timely notice” to tribes for any actions that could potentially impact a federally recognized tribal nation.

At the most granular level, Santa Clara Pueblo, Pueblo of Cochiti, Pueblo of Jemez and Pueblo de San Ildefonso all have individual cooperative agreements with LANL regarding environmental monitoring that require communication between the pueblos and the lab in the event of possible contamination.

The All Pueblo Council of Governors noted the potential overlap of the tritium venting and the COVID-19 emergency was particularly concerning because tribal leaders would not have the ability to meet in person to discuss the issue, and families are more likely to be at home.

“April is one the most active times of the year for our Pueblo communities practicing traditional and cultural responsibilities outside, and it’s also one of the windiest,” David Toledo, governor of Jemez Pueblo says in a statement. “On top of that, because of school closures more of our younger generations are outside.

Releasing even small amounts of radioactive materials is unacceptable as many Pueblo borders are located within five miles of LANL and the prevailing winds are directed toward the Pueblos.

“For LANL to continue with their undertaking is a painful reminder of our Pueblos’ history of health impacts associated with the radioactive exposure by the labs, during a time when our communities deserve to feel safe and focus on their health,” Toledo concludes.

Small amounts of tritium from natural and manmade sources are commonly found in water, soil and air. The radioactive hydrogen isotope can be harmful when ingested in high doses.

Officials assure the planned tritium release will not exceed regulatory limits established by the EPA. However, some scientists argue these standards do not account for non-cancer risks of tritium exposure, which may include miscarriages and birth defects.

A petition by Santa Fe group Tewa Women United garnered more than 3,000 signatures and cites potential negative health impacts on females and infants as one reason to postpone the release and engage in a full public participation process.

The levels of tritium that are considered safe also vary greatly among countries. For example, the level of tritium allowed in drinking water ranges from 100 Bq/L in the European Union to 76,103 Bq/L in Australia. In the US, 740 Bq/L (20,000 pCi/L) is the standard; however, there continues to be scientific controversy about how this standard is calculated.

“The standards are not entirely health based,” says Charles de Saillan, an attorney with the New Mexico Environmental Law Center, who tells SFR standards are “as much a policy decision as a health decision.”

Sovereign tribal nations set their own environmental and health standards, which can sometimes differ from standards set by the EPA. The tribal consultation process could include negotiations to come to a mutual agreement about acceptable standards for a specific release or contamination event.

Big Three Summer Art Markets Gone International Folk Art joins Indian Market and Spanish Market in one-year hiatus

F

irst it was Indian Market, then came Traditional Spanish Market and now, the International Folk Art Market, slated for this July, has announced its cancellation due to the COVID-19 pandemic.

Southwestern Association for Indian Arts announced Saturday, April 4 it is postponing the August 2020 Indian Market. This year’s market—the 99th— won’t happen until 2021. And the centennial event is now scheduled for 2022, leaving countless Indigenous artists from around the country without one of their largest moneymaking opportunities of the year.

SWAIA’s board member and artist Dominique Toya acknowledges in the official announcement that the decision was a difficult one “because Indian Market is a big part of my livelihood.” Nonetheless, she says, “it is more important to protect the well-being of fellow artists, their families, our customers and all of our communities.”

“It was a devastating decision. This year is going to be a huge financial blow for a lot of people,” Board Chairman Thomas A Teegarden tells SFR, “so it was not a decision we took lightly.”

The Spanish Colonial Arts Society pulled the plug on its June market with an Monday announcement. The International Folk Art Market report came late Tuesday.

made the call a day earlier.

“We had been pondering this for the last two weeks or so. The predictions you see in the media about the virus don’t look like it would be possible. It’s not going to be like, OK, the virus is over— everybody get together,” Ashman says.

“We start ticket sales in May, which is what? Three weeks away? It would have been crazy to do that; it just seems like it would be difficult to get visas for people; and we have a lot of preparations we have to do that really [usually] start around now. It just didn’t seem like we could get it done.”

All three markets have said artists who were already accepted into the canceled events can assume they are automatically accepted into the 2021 markets. They are also all making strategies about how to replace the massive events with some sort of online presence.

“It’s tough and people are definitely going to feel the pinch,” painter and Indian Market artist Nocona Burgess (Comanche) tells SFR. “But I think we’re, as Americans, we’re not taking it seriously enough, and that curve isn’t going to be squashed, and if you have 100,000 people coming in from all over the world or states that maybe aren’t taking it as seriously, it would be dangerous.”

Burgess tells SFR the market is the one big show he still does annually outside of his gallery events.

“You can still buy from these artists and not have to come to Santa Fe,” he says. “Collectors know the quality of the work; I just think it’s kind of a new way of dealing with stuff this year.”

Hotels and restaurants that benefit from market season are already under stress with state closure and capacity restrictions.

Science Rules Researchers in Santa Fe and beyond use knowledge and reason to fight the pandemic. Let’s join them, shall we?

t the end of March, SFR staff writer Katherine Lewin, a Report for America fellow, interviewed me for the paper’s “Reported” podcast on the role of journalism during crises such as COVID-19. I can’t bear to listen to my own voice at the moment (I hear it enough while talking to myself at home and transcribing interviews), but recall mentioning that the current coronavirus outbreak is just as subject to confirmation bias as any other news event.

By confirmation bias, I’m referring to the phenomena by which people choose to cherry pick or remember only information that confirms what they already believe. And in this particular case, I mean the growing COVID-19 conspiracy theories in which, as is usual with conspiracy theories, a complex network of government, tech and private entities have devised this virus as a means of enslaving the human race. I have no idea why this scenario is somehow more appealing than the actual situation, which I think is factually complex and alarming enough.

In a recent Texas State University article, Twister Marquiss, a senior lecturer and director of the school’s Common Experience program, says that often people who subscribe to conspiracy theories, “want to believe there is a structure to the world, that there’s an order that’s easy to follow, even if it’s complex.” The danger, he

says, is that doing so “creates a false understanding about an event or about people. It can feed stereotypes. It can feed racism. It can feed xenophobia.”

(Marquiss also has a compelling Twitter thread on this topic, relating conspiracy theories to pre-modern narrative structure, which made this former English grad student ridiculously happy).

Moreover, sociology professor Nathan Pino says in the same article, “Those who believe in conspiracy theories often erroneously believe they are exercising independent critical thinking. They believe they’re thinking outside of the box.

The fact is their critical thinking skills are not up to par and they’re not weighing evidence.”

Lastly, Department of Philosophy lecturer Elizabeth Kanon differentiates concisely the difference between conspiracy and scientific theories, noting: “What marks a scientific theory is the possibility that it could be replaced by a better theory down the road. New evidence will test the theory to see if it will fail. Most conspiracy theories are not like that. They use every piece of evidence as confirmation of the conspiracy.”

Long before this pandemic, I’ve grown used to calling on the Santa Fe Institute Scientists and others gathered for a Santa Fe Institute workshop on Zoom to share data and ideas for how to respond to COVID-19.

for scientific insights, so it was natural after falling down a dispiriting rabbit hole of nonsensical paranoid posts about COVID-19, I turned there to see what its scientists are saying about the current situation. I plan to follow up in the coming weeks with more of the work that is happening there, but plenty of information is already available to the public.

For example, last week, I sat in on a Zoom workshop, “After the First Wave,” in which more than 130 researchers heard presentations from scientists in the field who are actively working on modeling the COVID-19 outbreak (you can also watch it on SFI’s website, www.santafe.edu) One of them, Lauren Ancel Meyers, a professor of Integrative Biology at the University of Texas at Austin and a member of SFI’s External Faculty and Scientific Advisory Board, recently co-authored a new paper paper highlighted in an April 3 New York Times story mapping estimated “hidden transmissions” of the virus. The study estimates, among other statistics, “70 percent of all counties in the United States—making up 94 percent of the country’s population—are likely to have epidemics.” Santa Fe County, by the way, was among them. In fact, the story’s mapped data shows we have a 100% probability of already having one here.

In welcoming the virtual group, co-organizer Sam Scarpino, an assistant professor in network science at Northwestern University and former SFI post-doc, noted one of the reasons for the gathering was, “Santa Fe is a very special place for meetings like this. Since the early 1980s, it has been a hub of complexity science gathering researchers across the disciplines to

tackle some of the world’s most challenging problems, one of which is pandemics; pandemics both from the sense of trying to understand their ecology, their evolution, their population dynamics, their epidemiology, but also to understand the feedback on our economies, on our global societies, on our mental and physical well being.”

To that end, the scientists are working on how to approach the myriad challenges we will all face after this first wave.

For similar reasons, SFI also has launched a new article series titled “Transmissions” intended to introduce “ideas from complexity science [including] why systems collapse, the nature of an evolving virus and its ecology, how networks spread disease and economic instability, the mathematics of modeling outbreaks, the way decision-making modifies disease spread, and many other ideas that touch on the disease,” SFI President David Krakauer writes in his introduction.

Two batches of these articles include scientists considering timely topics such as how to reduce mortality from COVID-19 while easing “economic decline” and one that examines and argues for the use of disease modeling in guiding policy (and as an added bonus, I am sure by the time I finish reading and understanding many of these essays, we will definitely be over the peak…it may even be next year).

Ever the English major, I gravitated toward first reading a piece by SFI Davis Professor of Complexity Melanie Mitchell (also a professor of Computer Science at Portland State University who lectured in Santa Fe last year on artificial intelligence). Mitchell writes: “The way people conceptualize a situation drives their behavior in that situation. This means that the analogies we use to make sense of new situations can be powerful forces—for better or worse—in determining how we act.”

I thought of Mitchell’s essay as I reluctantly turned, again, to looking at some of the more disturbing posts I’d seen in the last week postulating various pandemic conspiracies (none of which I am going to repeat here). I looked for analogies but mostly found metaphors and hyperbole: “lab rats,” “rabbit holes” and “villain class,” for example.

I wondered why I found irrational paranoia more worrisome than the actually worrisome data scientists such as Meyers are producing.

The answer, of course, is simple.

Science will lead to solutions; conspiracy theories, by design, will lead nowhere.

New Mexicans, especially in rural areas, see a gap for justice access

A

lia Attallah’s shift from professional actor to law school student was unexpected. But so was going to court two years ago to take out a restraining order against her former boyfriend.

“I had never thought twice about the law until I needed the law’s protection,” Attallah tells SFR. Newly accepted to the University of New Mexico law school, Attallah’s personal journey intersects with a critical problem facing the state: diminishing numbers of lawyers leaving vulnerable people—rural and lower income residents in particular—unable to find help when they need it most. Experts refer to this as the justice gap—and behind each instance lies a story like Attallah’s.

television show Elementary and NBC’s The Blacklist. Until recently, she split her time between Santa Fe, Los Angeles and New York. During one stint in Santa Fe, her life took a turn with a toxic relationship she says led to a physical attack and months of harassment.

When she sought an order of protection, the man came to court with an experienced local attorney who slapped Attallah with a counter petition. Like many litigants who choose to represent themselves, she felt outgunned and hired a pro. Even so, Attallah pored over law books, researched evidence rules for the hundreds of text messages sent to her phone and generally obsessed about the case.

A month later, a District Court judge granted her petition and dropped his. She went back to New York to audition for pilot season, but her mind had opened to a new possibility.

“I was realizing what a difference the law had made in my life,” Attallah says.

In 2019, New Mexico averaged one lawyer per 430 people—just about the same as the national average a decade ago, according to recent state bar reports and a nationwide study.

But the numbers skew wildly between urban and rural counties. Santa Fe, for instance, has one lawyer for every 147 residents, while Guadalupe County has just one for every 4,341, the new workgroup study says.

“I was shocked to learn that three counties don’t have a single lawyer,” Santa Fe plaintiffs attorney Kate Ferlic says.

“I personally like the David and Goliath fight, but when individuals don’t have access to a lawyer to fight a corporation or fight a building owner that is not main-

“The fact that it was there as something I could grab onto and rely on, and that justice had really won out, that the truth had been seen.”

She’ll be pushing 40 by the time she takes the bar exam in three years or so, but Attallah would still be on the younger side of New Mexico’s pool of lawyers.

The average age of lawyers across the state is 52; it’s as high as 58 in some judicial districts.

That lawyers are aging out of the profession is a window on a deeper problem identified by a New Mexico Supreme Court working group assigned last year to dig into the state’s “access to justice gap.” That justice gap translates as roadblocks stacked in front of residents who need the courts to resolve everything from divorces to landlord-tenant disputes to wrongful deaths at the hands of government employees or large corporations.

In a 47-page report the working group delivered to the Supreme Court late last year, which the court formally adopted in January, authors say the justice gap impacts rural New Mexicans the most, along with low-and-middle-income residents: More than half the state’s residents can’t afford legal services for civil matters. Right now, some counties lack any lawyers, while applications to law schools have been on the decline.

Moreover, the gap doesn’t stop at lawyers but can be felt across the entire legal spectrum.

In interviews with SFR, judges, lawyers and the dean of the UNM law school acknowledged the gap, and endorsed some of the working group’s recommendations to close it, including providing financial incentives for lawyers who choose to practice in rural areas. None of the proposals offer a rapid solution.

Closing the Gap A 47-page report delivered to the Supreme Court in December and formally adopted a month later makes four recommendations for increasing access to justice for New Mexicans: • Recruit lawyers from other states to join New Mexico’s workforce because the state has the lowest Uniform Bar Exam scores required in the nation.

• Establish a “court navigators” program to offer assistance to self-represented litigants.

• Begin a rural law opportunity program that includes student loan forgiveness and/or stipends for attorneys.

• Conduct more study on empowering limited nonlicensed legal professionals to perform some services only lawyers can do now.

Ferlic, a 40-year-old who’s the second name in the Egolf + Ferlic + Harwood + Martinez firm, went to law school after four years as a journalist. She works mostly on contingency, and approximately 40% of her clients are from outside Santa Fe, especially in wrongful death, sex abuse, catastrophic injury and civil rights cases.

“The real need in the state in rural communities is probably more likely family law and landlord-tenant issues and things like that, where the disputed value of a case can be low and sometimes difficult to litigate because the cost of litigation is so high that it largely makes it not worth it to pursue,” Ferlic says. Of course there’s no value on the safety of children or the security of housing, but “the reality is that a lot of people spend a lot of money fighting on these issues. And when one party has resources and one does not, real injustice can occur.”

the rounds before lawmakers earlier this year, and the low lawyer inventory was among her talking points. Before committee after committee during the session, she reiterated the startling statistic to which Ferlic refers: Of New Mexico’s 33 counties, a third have 10 or fewer attorneys, 20% have five or fewer and three have no active attorneys at all.

“We are now experiencing what a lot of the nation is, this shrinking pool of attorneys,” she told senators in late January.

At the same time, Nakamura was in the Roundhouse to ask for money to expand the number of judgeships in the state, which was one of the judiciary’s priorities from this year’s session. A workload study conducted by the National Center for State Courts showed a need of about 17 judgeships. The state appropriated money to add five of those positions this year.

Part of the shortfall comes straight back to the issue of attorneys.

“Even though throughout the state we are seeing a slippage in the number of new case filings, we’re seeing an increase in the number of hearings,” the chief justice said. “Why? A lot of it is due to self-represented litigants. More people are representing themselves, and there are more hearings to help folks navigate the judicial system. It does not go as quickly as when lawyers are involved.”

Nakamura told lawmakers the courts have already taken a number of recent steps to make the law more accessible to people who don’t hire lawyers, including simplification of common forms and an online “virtual receptionist” that speaks Spanish and Diné as well as English.

The court adopted several ideas from the working group of lawyers, judges, paralegal experts and academics geared at addressing the lawyer shortage, which included recruiting lawyers from other states and creating an official program to help self-represented litigants navigate the courts. So far no one has estimated what these ideas will cost.

The working group initially formed to consider allowing non-licensed legal professionals to perform services that right now only lawyers can do. That idea, though adopted by the court, is moving the slowest.

And then there’s the issue of the next generation of lawyers. One adopted idea would include student loan forgiveness and/or stipends for attorneys who go to work in rural communities. But law schools are having problems of their own.

Attallah took her time to prep and pass the LSAT and to learn about the judicial system before she applied. She shadowed Ferlic over several months on several occasions and spent lots of time with a different lawyer who represented her in the order of protection case. She says the idea of working on family law and domestic violence definitely appeals to her, but she is still figuring it out.

UNM law school applications have been on a steady decline for the last five years, with 339 in 2014 and 273 in 2019, and the current class is 14% smaller than the one from two years ago, the report cites. Those trends, the school’s dean Sergio Pareja says, respond to unemployment rates.

Meanwhile, Pareja is dealing with potential delays to the admission season and the start of classes for the new crop of law students amid the COVID-19 pandemic. The school began preparing for online learning in mid-March.

“Kind of the weird silver lining on the downturn that seems to be hitting the country and the world right now is that historically when the economy has gotten bad, like in 2008 or 2012 right after it tanked, our applications went through the roof,” Pareja tells SFR. “We had over double the number we have now. Law school applications then shot up for the same reason, people couldn’t get a job and they applied to law school…but who knows, there are tons of variables.”

The school canceled a prospective applicants’ activity that had been planned for April 3, and normally would be giving law school tours and classroom visits right now, “but all of that is canceled because of COVID-19,” he says.

Even before that, Pareja recognized a problem for which he had not landed on a solution.

“Heavily, our graduates stay in the Albuquerque and Santa Fe area,” he says.

“Despite our best efforts. I think when they go to school here, for whatever reason, they like it, they make their contacts here. We actively try to recruit people from the more rural parts of the state to become law students...We’d like to get people to apply in the hopes that when they graduate they will go back and practice in those areas because particularly in rural parts of the state there are real access to justice issues, and we need more lawyers in the rural parts of the state.”

The cost of school, the length of time for the degree and the perception that Albuquerque is dangerous are among reasons that’s a challenge. Of the students who do come from rural parts of New Mexico to attend law school and pass the bar, many then don’t leave the city to practice. The working group report highlights a New Mexico State Bar Association program to urge new lawyers to practice in rural reaches, but it’s only three years old and hasn’t resulted in anyone locating a new practice outside of Albuquerque.

Pareja thinks the Supreme Court workgroup’s idea to create a student loan forgiveness program could have the most immediate benefit for current and future students.

“If you can get somebody to move to certain parts of the state for just a few years,” he says, “they often end up staying once they are there.”

Others also support the idea. Every lawyer and judge SFR interviewed for this story raised student loan forgiveness for rural service as a good path forward.

It’s not dissimilar to an approach that’s helped in the medical field.

Nakamura told legislators the courts have a committee “actively working on that,” noting she expects the issue will come before the Legislature next year and at interim committee hearings.

In another way, New Mexico’s judiciary is not ready to move in medicine’s direction.

“The legal emergency room is still too full with patients,” reads an introduction to the working group report. “The medical system would triage the patients in the emergency room, treating the most ill or most seriously injured first.

Miller drove more than 4,974 miles last month from Albuquerque to represent clients on a contract with the Law Office of the Public Defender in Lincoln and Doña Ana counties as well as to far reaching places like Clovis, which is in the Ninth Judicial District on the state’s southern border and is identified by the workgroup as among those with lowest attorney density per population. Only the 6th district, which encompasses the state’s bootheel, has a lower density of attorneys.

Miller will turn 58 this year and has a few private clients, but most of his practice is on contract for the notoriously stretched-thin public defenders office.

The two other lawyers active in Lincoln County are also nearing or older than 60, he says. The workgroup report emphasizes the problem, noting “active members of the bar are aging out and not being replaced by younger members.” And the younger generation, as the law school

The lack of lawyers on the job is something that’s been well documented all the way up the court ladder.

Nakamura told legislators this year that the deficiency impacted the pool of qualified applicants for judicial positions.

In some cases, just one qualified person applies for a vacant seat on the District Court bench.

“We continue to attract primarily public defenders and district attorneys from government positions, and there’s nothing wrong with that, except the majority of our cases continue to be civil,” she said on January 27 before the Senate Judiciary Committee.

“It’s not just not enough lawyers,” echoes Albuquerque attorney Jonathan Miller. “I think there are not enough judges and there are not enough prosecutors. So sometimes it can take a while for a case to go through the system because with so few lawyers, lawyers have to do cases in one county that can delay cases in another county,” he says, adding later that because of the economic changes from COVID-19, “I’m terrified right now because we don’t have enough money for the system and it’s going to get worse.”

In some ways, the number of lawyers isn’t so important as what they’re working on. The Legal Services Corporation, a nonprofit established by Congress to provide financial support for civil legal aid to low-income Americans, calculated in its 2009 study that although the national average is one lawyer per 430 residents, the rate of lawyers available to people in poverty on average is more like one for every 6,415.

to surgeons, laboratories, and radiology.”

The legal system, it concludes, should triage as well.

“We are going to continue to study this use of speciality-trained, legal-licensed technicians without a full law license,” Nakamura told senators. “They’ll be able to offer affordable legal services to civil matters to low and moderate income New Mexicans. The problem is we are not ready for that. It’s going to take a lot more study.”

Others share the slow acceptance of that idea. Judge Frank Mathew, who runs one of Santa Fe’s criminal dockets in the First Judicial District, concedes there’s great need among rural New Mexicans, including even in the rural parts of Santa Fe County. At the same time, he tells SFR he’s seen nonlawyers and disbarred lawyers alike give damaging advice to defendants.

“Just saying we need to graduate more or put unlicensed attorneys to work may be creating another problem,” he says.

Even in one of the three counties that makes up Santa Fe’s first Judicial District, a lower number of attorneys is a factor. Chief District Court Judge Mary Marlowe Sommer says applications for vacancies on the court don’t typically come from Rio Arriba County for the job that’s stationed there in Tierra Amarilla.

The court has found ways to adapt, including its twice-monthly “resolution days” wherein self-represented litigants are paired with volunteer lawyers, a selfhelp desk and legal fairs, she notes.

New Mexico allocates a small pot of money to the family court each year to hire a private attorney for guardianship matters and other cases, and New Mexico Legal Aid gets public funding to provide some service to very low income individuals. But neither service can make much of a dent.

Judge Sylvia Lamar, one of two judges on the family court docket, says there’s always room for more help.

“Most of the people who appear before us appear without attorneys,” she tells SFR. “In the family law arena, we are really set up to deal with self reported litigants to the extent we can. We try to give them opportunities to be heard.”

Is a civil version of the public defenders office warranted? She let a laugh escape at the question.

“It will never happen,” Lamar says. “ Representation in a civil case is not a constitutional right...”

Yet, it’s not a totally laughable proposition: In 2006, the American Bar Association House of Delegates encouraged legislatures to “provide legal counsel as a matter of right at public expense to low income persons in those categories of adversarial proceedings where basic human needs are at stake.” Those basic needs include housing, medicine, child custody and personal safety, among others.

Lamar happens to be the judge who ruled in Attallah’s 2018 order of protection. At the end of the trial, she asked each party what they were going to do to move on. It took a while to sink in, but Attallah believes she knows the answer.

“I started to see great crossovers with trial law and training in acting. I started to see that my skill set could be uniquely suited to that type of law, in the ability to really paint a picture for a jury, to be really incisive about what creates a compelling story and how to get the strongest testimony,” Attallah says. “That is where the marriage of my skills and the law might come into play. Obviously, I say that with all humility. I have a great deal to learn about the law.”

Reading in the Arroyo: An Occasional Column About Books Postcolonial Love Poem by Natalie Diaz and April Twilights by Willa Cather

I

t’s difficult to be a poet, right?”

Natalie Diaz asks in a recent interview with Remezcla.

“When the world needs so many things and all I have to offer are poems.”

But man—what poems.

Postcolonial Love Poem, Diaz’s glittering second collection, turns desire inside out. It shouts declarations of love from a hotel room in midtown Manhattan, a rez basketball court, amidst a woman’s thighs; quotes Jacques Derrida and Rihanna; and locates both a river and a pack of wolves inside the body of the poet.

The book is a feast of love, and welltimed, too—in this hungry season, Diaz’s 31 new poems are more than substantial. Diaz, who is Mojave and an enrolled member of the Gila River Indian Tribe, begins Postcolonial Love

Poem with a quote from current US poet laureate Joy Harjo: “I am singing a song that can only be born/after losing a country.”

The journey is one of rebirth, certainly, in the wake of cultural devastation, violence and addiction.

It celebrates resilience, too, of life and love and rivers.

“I learned Drink in a country of drought,” says the title poem.

“There are wildflowers in my desert which take up to twenty years to bloom.

The seeds sleep like geodes beneath hot feldspar sand until a flash flood bolts the arroyo, lifting them in its copper current, opens them with memory— they remember what their god whispered into their ribs: Wake up and ache for your life.”

Diaz negotiates a tough tangle of yearning and identity politics, both of which thread her work. In “Manhattan is a Lenape Word,” the poet is alone on the

eighth floor of the Ace Hotel at 2 am, wondering where the original inhabitants of the island went, contemplating her numerous non-Native lovers in the city: “All my loves/are reparations loves.”

In “They Don’t Love You Like I Love You,” through the lyrics of Beyoncé, the Yeah Yeah Yeahs, and her own mother, she explores the complexity of her younger self desiring the validation of white lovers, “to be held in something more/than the loud light of their projectors,/as they flicker themselves— sepia/or blue—all over my body.”

Postcolonial Love Poem is well-paced.

Just as you’ve read a couple slamming prose-poem odes to “run ’n’ gun” reservation basketball—Diaz is a former professional player—and are wondering about the connection between the game and love, she lays it neatly on the line.

Number one in “Top Ten Reasons Why Indians Are Good at Basketball?”

“The same reason we are good in bed.”

Diaz upholds a poetic tradition of wrestling with mythology, sexily situating the Minotaur’s maze within her lover’s body and replacing it with a currented body of water. Within this wet and wild landscape, the speaker’s travels are “More pilgrimage than wandering. More mercy/than amaze.”

Other mythological explorations include those of her own country.

“America is my myth,” she writes in a poem about the Colorado River, also noting that despite Natives always being called “red,” the only red people she’s seen were sunburned white tourists who stayed out too long on the river.

Like love itself, Postcolonial Love Poem is complicated, generous, kind and replenishing. Whether or not we knew we were thirsty, we are quenched by its gifts.

the sedate 1903 collection of poems called April Twilights.. But in these studiously formal stanzas, all written before the author turned 30, I found a melancholy solace.

April Twilights is Cather’s only book of poetry (one she frequently disavowed) and it twines around themes of spring, myth and death.

Last year, the book was re-printed by University of Nebraska Press with a new introduction by scholar Robert Thacker, who tells us Cather’s poems stand “at the Modernist crux,” using literary references that Ezra Pound and T.S. Eliot made famous two decades later, and forecasting the “striking, allusive, and poetic prose” of the novels for which she would become famous.

“April is the cruelest month,” Eliot famously wrote, and Cather hammers that point home before him. This is poetry for the pandemic spring, for those who find delicate apricot blossoms and raucous neon daffodils jarring in our present reality.

For every bloom in these poems, there is an equal and opposite death.

“Roses, roses, locust and lilac, perfuming” become “Foot-trod, sweatsour over and under, entombing.”

The poem “In Media Vita” celebrates the Bible verse (or Morrissey lyric, whatsoever you worship) “in the midst of life we are in death.” Cather perversely sings out the spirits of spring—“Birds from the Southland winging,/Buds in the grasses below”— before heartily bursting our bubble: “Lads and their sweethearts lying In the cleft o’ the windy hill; Hearts that hushed of their sighing, Lips that are tender and still.

Stars in the purple gloaming, Flowers that suffuse and fall, Twitter of bird-mates homing, And the dead, under all!”

Strangely, the effect of these morbid odes is not depressing. Cather equally celebrates the joy and the wear and tear of life. In “The Tavern,”

she compares her heart to an abandoned bar in which many have come, lifted glasses of red wine, recited poetry, scrawled graffiti on the walls and then left. Rather than bemoan her loneliness, she entreats the current visitor to “defile the wretched place/None will come, forevermore.”

We are here for a good time, as a cruder soul might put it, and not a long time. Since we’re all seeing the world through a lens called COVID-19, social distancing in our dreams and yelling at too-close lovers on screens, we might well heed Cather’s century-old advice: “Let us pour our amber wine and drink it To the memory of our vanished kingdom, To our days of war and ocean venture, Brave with brigandage and sack of cities; To the Odysseys of summer mornings, Starry wonder-tales of nights in April.”

Feeding Folks YouthWorks and El Rancho de las Golondrinas come together to feed hungry Santa Feans

T

hough YouthWorks founder and executive director Melynn Schuyler says the youth-based nonprofit has been working inside El Rancho de las Golondrinas’ massive industrial kitchen for over a year, the new world order required the organization to rethink how it does things. In this case, it’s to focus on the food insecure during the COVID-19 pandemic.

As it stands, YouthWorks already has a contract with the Children Youth & Families Department to deliver roughly 1,200 meals a day to after-school programs, but as schools closed, effectively cutting off food from vulnerable kids, Schuyler and crew leapt into action. The early days were tricky, however, as YouthWorks’ funding is specific to “congregate” meals, Schuyler says.

“We had to beg,” she says. “There are some weird regulations, and it took us until the 26th of March to get a waiver.

[We were] calling the governor’s office, the food czar, talking to CYFD and asking the city to help.”

In the end, YouthWorks won out and has since been allowed to offer take-home dinner meals alongside Santa Fe Public Schools at various elementary school pickup locations across the city seven days a week.

“The cool thing is that we get to make really creative, yummy meals,” Schuyler explains. “This isn’t just a sandwich.”

The kitchen show is run by Jackie Gibbs, a local chef who came up through the YouthWorks programs, including the culinary curriculum, herself.

“We’re working to cook about 700 meals a day, and we’ve actually upped our numbers for the adults who moved into the Midtown campus,” Gibbs says, referring to homeless Santa Feans who have been sheltered in the dorms on the former Santa Fe University of Art and Design campus.

“We’re about 20 people rotating in and out; about five who are over the age of 24, the rest are 17 to 23.”

Both Schuyler and Gibbs say there are never more than five people in the kitchen at a time, and Gibbs adds that the work is particularly rewarding since she and the other young kitchen staff understand what it’s like to not know from where their next meal is coming.

“They’re used to being in these situations,” she tells SFR. “We know how to make do with what we have, and we take pride in making these meals for people in need—and I’m not just some adult telling them what to do, I also went through this program.”

For the most part, the meals include casserole-type dishes, Gibbs says; enchiladas, green chile chicken stew, hot dogs— whatever makes sense.

“It’s pretty price-productive,” she says.

“Making casseroles is also easier than what some of the other local programs are doing, and Golondrinas has been a great help to us.”

“YouthWorks is our food provider during the season, and we have this huge commercial kitchen,” says El Rancho de las Golondrinas’ Museum Director Daniel Goodman. “As soon as the superintendent announced the school closure, Jackie called and we said ‘How can we help out with this?’ For a lot of these kids, this is the only meal they get throughout the day.”

Goodman also says he’s hoping Golondrinas might itself become a pickup location. Its Southside locale along with that part of town’s food desert make it ideal. However, he says, he and YouthWorks

are still working toward that. The living history museum also boasts farming acreage, which could potentially mean growing ingredients for the YouthWorks meals.

“We’d like to develop more of that stuff,” Goodman notes. “There’s opportunity for us to be more proactive with farm-to-table programs and providing healthier food to people—maybe with produce that’s been grown right on the property.”

Golondrinas has already provided thousands of pounds of produce to The Food Depot annually, and donations might expand if the museum doesn’t have its season this year. Golondrinas has long been host to site rentals, wine festivals, renaissance faires, weddings and such—it’s why it has the kitchen in the first place— but, Goodman points out, “even after everything blows over, there’s still going to be some fallout, so we need to plan now.”

It’s just the Golondrinas way, he says.

“You’re never too big to do the small things,” he says. “Everybody out here is responsible for everything. In some ways, it’s just us trying to do our part, but we’re also uniquely positioned—if it’s a benefit to the community in even a small way, we’re honored to do that.”

The words don’t come easily. If any do, they pretty much form the phrase “buckle up, assholes,” because Butt Boy from writer/director Tyler Cormack easily has the strangest premise for a film this year, and that’s saying something.

It begins with a rectal exam for Chip (played

by Cormack), a bored middle-ager with a bland home life and a void to fill. Turns out he loves the feeling, and so begins his obsession with cramming things up his ass—a bar of soap, the TV remote, maybe even a fucking dog. Children go missing, Chip’s wife is concerned, the police come knocking. What. The. Fuck?

Jump ahead nine years and Chip’s in AA, the newly-minted sponsor of hard-boiled detective Russell Fox (Tyler Rice). Fox is just trying to clean up his act but positive a new missing child case can be traced back to Chip. But there’s nothing on Earth that can prepare either of them for the brutal reality of the man’s anal obsession, and as the dragnet closes in, Chip discovers just how deep he’s willing to go. Fox’s career hangs in the balance and his theories alienate his superiors. A darker secret than anyone’s prepared for is

+ A FAIRLY FRESH HORROR TAKE - SOME PADDING; SOME IRRITATING PERFORMANCES

Writer/directors Mike Ahern and Enda Loughman come out swinging with Extra Ordinary, their first feature and a clever bit of horror-comedy that may recall the likes of Edgar Wright, but that carves out a dry identity all its own. Think Peter Jackson’s The Frighteners meets Wright’s Shaun of the Dead, but with a secret weapon—the delightful Maeve Higgins.

Higgins is Rose, a former medium grappling with the years-earlier death of her similarly supernaturally gifted father. With a ghostly television series in their past, the father was almost like a Robert Stack type, though rather than just hosting the unsolved mysteries, he lived and solved them; Maeve blames herself for his death and has since become a driving instructor. But with a bit of lingering celebrity in her town, she still fields the odd request for ghost-busting help. “I haven’t done that stuff in years,” her answering machine implores as the prank calls keep rolling in.

Meanwhile, a has-been 1970s rockstar (SNL‘s Will Forte) who moved to town for tax purposes has entered a pact with a demon on the lookout for virgin sacrifice. Rose thus finds herself swept up in a battle against the literal devil alongside a neighborhood father (Barry Ward) who might just be haunted in his own right. Hilarity ensues.

slowly uncovered; you think you’ll know, but we promise you—you really don’t know.

Butt Boy is thus incredibly hard to evaluate.

Is it experimental genre cinema or some kind of frat humor descent into nonsense? Is it absurd beyond measure as a test for audiences, or is it over-the-top silly and disgusting because its makers sincerely think ass jokes are funny?

Much of Cormack’s writing does the job, as does his turn as the anal-obsessed Chip (mostly, anyway). Some things feel funny and natural, others not so much. Rice’s alcoholic detective, meanwhile, looks and acts, as Chip says at one point, like every detective ever. As for whether this means he’s good or bad…well, it’s not realistic to assign that line of thinking to this film. He does what he must, and it’s fine.

Higgins rules Extra Ordinary with a painfully relatable knack for playing shy kindness and tortured self-doubt, while Ward’s dorky dad shtick hits all the right notes against Forte’s over-the-top brand of devil worship.

This is that UK humor you’ve heard so much about, shot and lit like a 1980s occult horror flick and with an obvious reverence for the genre’s tropes. Yes, the filmmakers are riffing on any number of fright flick conceits, but it’s good-natured ribbing solidified by Higgins’ hysterical and spot-on delivery. Forte’s cowardly devil worshipper is a treat as well, though Ward’s range particularly enamors and surprises with lightning fast phasing between sheepishly adorable and caustic wit. Claudia O’Doherty sadly flails as Forte’s dickish wife, however, perhaps because she’s given too little to do or because her turn as the lovable Bertie in the Netflix series Love was a far more natural space for her.

And so, some place between the self-referential absurdity, a little bit of the old gross-out action and a studied, starry-eyed grasp of horror filmmaking, Ahern and Loughman find a unique story that maybe could have used a little more time in the incubator and gussying up, but still winds up one of the funnier and more interesting options streaming right now.

Even better? For a mere $12, streamers can support Santa Fe’s Jean Cocteau Cinema by purchasing a ticket for home screening.

As a lampooning of the genre, then, Butt Boy almost works out; as a very niche film doing things that almost make Human Centipede look like high art (whatever that means), it’s hard to understand. As a standalone project judged by its own merits, it’s even harder to recommend Butt Boy to anyone outside the most ardent horror/ gross-out flick fans. Even then, attempts at mocking corporate America or the ostensibly empty suburban dream are overshadowed by its final disgusting act, one you’ll admittedly never see coming.

+ HYSTERICALLY WEIRD; ODDLY COMFORTING

- MOST WILL BE BAFFLED

Tim Robbins and Susan Sarandon have a filmmaker son named Jack Henry Robbins, and to his credit, he shamelessly roped them into producing and appearing in his first widely-released feature, VHYes. And though normally I’d say something about how it must be nice, how it’s kind of gross, in the case of Robbins’ first opus, it’s a godsend that his folks helped him realize his movie. VHYES is one of the most delightfully strange and self-aware pieces of filmmaking I’ve ever seen.

In fact, if I were hard-pressed to pick a shortfall when it comes to Robbins’ work, the only thing that comes to mind is how it’s aimed squarely at ’80s and ’90s kids; those born after need not apply—this is not for you. It’s shot entirely on VHS, and no, it’s not like a Stranger Things situation wherein it doesn’t matter if you remember riding bikes with dorks or the mall being a mecca of lust and commerce and kicky hairdos…VHYes captures a look and a vibe you truly need to have experienced to appreciate.

That’s not meant to exclude, nor does it inherently make VHYes a better movie than others. It’s just what it is.

We open with a kid named Ralph (Mason McNulty) on Christmas Day as he unwraps a VHS camcorder. Any semblance of normal quickly dissipates as two things start happening: Ralph repeatedly shoots short and pointless footage of the world around him, and he realizes

he can record late night television directly to the camcorder. We descend powerlessly into various shows and movies already in progress, and Robbins’ versions of programming reads like the dream version of something one barely remembers.

There’s the Bob Ross-esque Joan (The State’s Kerri Kenney) who begins her painting with trees and happy clouds before advising us to “move on to the spaceships;” later, she watches us sleep. There’s the QVC-esque salesman (Thomas Lennon, also of The State) at odds with his onscreen partner/offscreen ex-wife, both of whom are selling cocaine as cooking supplies.

There’s even second-rate pornography, with the good stuff edited for television, of course, and a spineless Antiques Roadshow-like host (Mark Proksch of What We Do in the Shadows) with a penchant for the macabre. There’s the painfully uncomfortable live music show with host Lou (Charlyne Yi) and her parents, a number of absurdly violent fake commercials, literal aliens and, wonderfully, an ode to classic horror that makes it in under the wire and weirds everything out even further…maybe there’s even a murder.

Meanwhile, Robbins throws in references to political unrest with blink-and-miss-it nods to climate change and immigration, all while peripheral concepts of infidelity and skewed realities cinch tighter around us amongst Ralph’s filming habits—habits that will read familiar to literally anyone whose folks had a camcorder.

This is pure nostalgia distorted by a visionary that, while at times unnerving and challenging, is truly special. (ADV)

MOSI and her brother MOKI were found living outside under a dumpster. A caring person took them in and they are now thriving in a foster home. MOSI and her brother MOKI (Cat and Dear in Tewa language) are very social cats that love to cuddle up in the morning or at nap time. MOKI loves to play fetch and MOSI enjoys watching her brother play. Both are inquisitive and investigate everything at every turn.
