An Adobe Home with Heart

W

as it something about this 1907 adobe home that inspired its long-term owners to contribute to the community? Fernand Lungren, a famous landscape artist, built the home and lived here for 25 years. He was one of the founders of Santa Barbara’s School of the THE GREAT HOUSE DETECTIVE Arts, and when he passed away, he donated his paintings and artifacts to local institutions. Barbara Tellefson, another owner, lived here for 35 years and created The Unity Shoppe, an organization to benefit the members of our community who need it the most.

In the early 1900s, Santa Barbara adobes were being bulldozed to make way for modern buildings. Down by West Beach, an old

by Betsy J. Green adobe was erased to make way for the Potter Hotel. In 1902, the local paper wrote, “The people of Santa Barbara … will witness the speedy change from the picturesque old mound, with its adobe house, to the modern, up-to-date tourist hotel.” But up in Mission Canyon, Lungren and his wife, Nettie (Henrietta), were having their dream home and art studio built of adobe.

The Potter Hotel is gone; the adobe at 679 Mission Canyon Road is still here.

Did luck have something to do with the home and its owners? In 1907, the cornerstone for the home was laid on the seventh day of the week, which happened also to be the seventh day of the seventh month of the seventh year of the century.

La Casa Nichita When the home and studio were completed, the local paper described them as “snuggled away in the very heart of Nature, and still within a stone-throw of the arteries of commercial life … the walls are 18 inches thick … every window has a pretty view.” The Lungrens named their home La Casa Nichita, after Nettie’s nickname Nichi.

Lungren was well known for his paintings of desert landscapes of the Southwest. One of his fellow artists here in Santa Barbara included Thomas Moran (see my January 2021 column to learn about Moran’s house). You can view some of Lungren’s works in the Borein and His Circle of Friends exhibit at the Santa Barbara Historical Museum from now until January 22, 2022. Lungren willed his paintings to the Santa Barbara State Teachers’ College, now UCSB. Many of the Native American cultural items he collected were left to the Santa Barbara Museum of Natural History. Some of the items — tiles created by a famous Hopi artist — are still in the house decorating the fireplace surround. Jan Timbrook, curator emeritus of ethnography at the museum, told me, “I hope a future owner will respect the tiles and the distinguished history of the house, La Casa Nichita, as subsequent owners did for so many years.”

regardless of their ability to pay. Lungren’s philosophy was, “The greatest thing in the world is love, and love’s best expression is service to humanity.”

Another Owner with Heart This philosophy could apply equally as well to the home’s most recent long-term owner — the late Barbara Tellefson — who lived in the home for 35 years. To quote from her obituary in this paper, “Barbara arrived in Santa Barbara in the mid-1960s – penniless and alone. She secured work as a travel agent and soon after met and married Clair Tellefson, an engineer, in 1969. It was then that Barbara vowed never to forget her roots or life’s rough patches.

She began to actively focus on volunteer work to help struggling single mothers raise their children, much as she had.”

In 1987, she founded the Unity Shoppe, an organization that enables Santa Barbara’s low-income families, seniors, people with disabilities, and disaster victims to receive the help they need. On Sunday, December 12, the Unity Shoppe will hold its 35th Annual Holiday Celebration to honor their community of volunteers. Tune in to KEYTNewsChannel 3 from 4 to 8 p.m.

Foodbank’s Empty Bowls Event Raises Awareness

O

n December 5, 700 supporters turned out for a creative, COVID-modified version of The Foodbank’s popular Empty Bowls annual fundraiser, this time held outside at The Foodbank’s Santa Barbara warehouse. The sold-out event raised funds and significant awareness about The Foodbank’s incredibly valuable programs that provide healthy groceries, including lots of fresh produce, and nutrition education to lowincome residents.

As in pre-COVID years, guests reserved in advance an arrival time and got to select a locally handcrafted ceramic bowl. Instead of the usual community luncheon format, guests received a soup-to-go from the Catering Connection and a packet of discounts from local restaurants. They shopped at their leisure at the marketplace, which included a wide variety of locally handcrafted ceramics, with planted succulents being especially popular and all proceeds going to The Foodbank. A variety of silent auction and raffle items offered even more ways to support this nonprofit.

Guided tours of the warehouse were popular among guests who wanted to learn more about The Foodbank’s mission and programs.

The event was founded locally 24 years ago by Danyel Dean, who continues to chair it with great enthusiasm each year. A humble Dean shared that the event comes from her heart and she feels privileged to be able to raise awareness about The Foodbank, which serves so many in need each year. With a background that includes teaching pottery for 45 years at SBCC School of Extended Learning and opening five restaurants, she is quite well-positioned for the chair role.

Dean strives each year to expand the giving circle and marvels at people’s eagerness to participate in various capacities. This year, 4th and 6th grade Crane County Day School students decorated some of the bowls, though the vast majority is still created by SBCC Extended Learning students. Dean hopes students at other schools can participate in the future. She keeps ticket prices low ($30) to encourage broad community attendance.

Even in non-pandemic times, a significant portion of the county’s population relied on The Foodbank for support, and COVID-induced financial hardship caused demand to skyrocket. In the year ending June 2021, The Foodbank

distributed 18.1 million pounds of food to an estimated 192,000+ residents, about double the amount of food provided in recent, pre-COVID years. More than a third of the food was fresh fruits and veggies. About 70 percent of the distribution was in North County, with 30 percent in South County. Staff was assisted by 1,600+ volunteers, and, for 18 months, a contingent of varying size from the CA National Guard.

Demand spiked in the beginning of COVID as a large number of people lost their jobs or had hours cut back. There was an uptick in demand again more Past Board Chair Vibeke Weiland and Senior Communications Manager Judith Smith-Meyer recently, according to Senior Communications Manager Judith Smith-Meyer, as federal COVID relief programs ended and inflation heated up. On The Foodbank’s supply side, donations from grocery stores fell at the start of the pandemic as people hoarded and cooked more because of the lockdown, causing The Foodbank to have to purchase more food. Food donations now have rebounded.

According to CEO Erik Talkin, The Foodbank’s mission goes well beyond feeding the hungry. There is a dual emphasis on healthy food and the skills and knowledge to use it. Nourishment and education are provided through its own programs and those of 300+ partner agencies.

According Smith-Meyer, The Foodbank uses multiple data sources to target areas at high risk for food insecurity.

Q: Marsha, I’m confused about the term “agency” in California real estate. I’m involved in a home purchase, and I keep signing “agency disclosures.” What am I signing?

A: Good question! Join the club in not understanding what

agency means in real estate. It seems as if the relatively benign concept of who is working for whom should be easily understood and clear. Wrong! Most civil lawsuits in real estate involve agency: negligent misrepresentations, breaches Real Estate Q&A of fiduciary duty by real estate licensees, and failure to disclose professional relationships. Note: I am not an attorney, so don’t take what I say as legal advice.

One of the forms you’ve undoubtedly signed is “disclosure regarding real estate agency relationship.” This form defines different configurations of agency and

by Marsha Gray what the duties of the real estate agent is to the principal parties. There is the seller’s agent, the owner of the property, the buyer’s agent, the purchaser of the property, or one real estate agent or firm representing both parties.

It’s vital to know who the principals are and who represents them in the transaction. Agents owe a fiduciary duty to their principals. That means they must hold their principal’s financial concerns above their own.

Confused? It’s easy to become bogged down in termi-

nology. California has worked steadily over the years to bring transparency and clarification to the subject. Agents are required to have potential and new clients sign agency disclosure forms as soon as they begin a real estate relationship with a buyer or seller.

A few years ago, California Association of Realtors (CAR) upgraded the residential purchase agreement to further emphasize agency. The first paragraph of the purchase agreement states the names of the buyers, the property address, and purchase price offered. The second paragraph discloses and confirms who is representing whom. Agency is stated as soon as possible; it’s that important.

The traditional way real estate agents are paid has created much of the mystification. Real estate commissions are always negotiable. In Santa Barbara, commissions are generally 5 or 6 percent of the ultimate purchase price. The listing agent presents the home for sale in the Multiple Listing Service and agrees to split the commission with a buyer’s agent. It would appear the seller is paying for both the agents. So, aren’t both the agents working for the seller?

But wait, an argument can be made that the buyer actually pays the commissions. The seller settles all debts of the transaction from the buyer’s purchase money. This is an ongoing discussion in real estate.

What’s important is not who is paying the agents; it’s whom the agents represent. Agents owe their loyalty and

fiduciary responsibility to their principal clients. They owe honesty, ethical behavior, and full disclosure to the other agent’s client. If a dual agency arises, the agent, who now represents both seller and buyer, has a fiduciary duty to both principals.

I hope this gives you some understanding of what agency means in real estate. It’s a fundamental and critical concept in residential property transactions. Who’s looking out for your best interests? It had better be your agent.

The Hotel Santa Barbara, an iconic landmark 75room property in the heart of this coastal city’s vibrant downtown, has been sold for $41.9 million, as announced by Berkshire Hathaway HomeServices California Properties.

n December 7, outgoing Mayor Cathy Murillo and Councilmember Oscar Gutierrez are pushing to enact whatcould be some of the strictest rent controls in the state of California. The two of them have proposed a rent increase cap of just 2% each year. That far exceeds the recently enacted AB1482 that already restricts the ability of property owners to raise rents to 5% annually with an additional CPI increase allowed. You will notice that Ms. Murillo and Mr. Gutierrez’s proposal does not allow for any additional cost of living adjustment. I suppose they assume that utility companies, insurance companies and building supply companies will stop raising their rates too. Oh wait, those prices are all going up a lot more than 2% each year.

They also want to start a “rent registry” that will track the price of every rental unit in the city and gather information on them and their owners. Who will pay for that? Who will be running it and maintaining that private information? What security can Ms. Murillo and Mr. Gutierrez guarantee that someone’s personal information will not be stolen through a data breach?

This overreach might explain why she is soon to be the former mayor of Santa Barbara.
