Transgender ban blocked Second US judge blocks Trump’s military transgender ban, says the decision was “capricious, arbitrary, and unqualified” IANS, WASHINGTON

A

second federal judge has blocked the US administrations proposed ban on transgender troops, saying President Donald Trump’s announcement of the ban earlier this year was “capricious, arbitrary, and unqualified”. In a preliminary injunction, Judge Marvin J. Garbis of Maryland halted a policy that would have discharged all current transgender troops and barred prospective ones from enlisting, saying it likely violated equal protection provisions of the Constitution, the New York Times reported. Judge Garbis’s order went further than a similar ruling in October by Judge Colleen KollarKotelly of Columbia, which also said the ban likely violated the Constitution. “There is absolutely no support for the claim that the ongoing service of transgender people would have any negative effective on the military at all,” the ruling said. But while Judge Kollar-Kotelly did not specifically block a Trump administration policy prohibiting gender-reassignment surgery for

service members at the government’s expense, Judge Garbis’s order does. The ruling leaves in place an Obama-era policy, announced in 2016, that allows transgender troops to serve openly and receive the required medical care for their

gender transition through the military. Shortly after the ruling the Trump administration appealed last month’s decision, signalling it would continue to press for the removal of transgender troops. In July, Trump said on Twitter

that the military could not afford the “tremendous medical costs and disruption” of transgender troops and that the government “will not accept or allow them to serve in any capacity in the US military”. A presidential memorandum released in August said all transgender service troops would be discharged. A number of service members immediately filed suit, arguing the new policies were discriminatory. There are an estimated 2,000 to 11,000 active duty transgender service members, according to a 2016 RAND Corporation study commissioned by the Pentagon. The American Civil Liberties Union, which filed the suit on behalf of six service members, said the ruling was a victory over what it called in a statement “uninformed speculation, myths and stereotypes”. “Today is a victory for transgender service members across the country,” said Joshua Block, who represented the service members. “We’re pleased that the courts have stepped in to ensure that trans service members are treated with the dignity and respect they deserve,” he said.

US asks SC to allow entire travel ban WASHINGTON: US President Donald Trump’s administration has asked the Supreme Court to allow the latest version of its controversial travel ban to go fully into effect, pending appeal, the media reported. The third version of the travel ban places varying levels of restrictions on foreign nationals from eight countries: Chad, Iran, Libya, North Korea, Syria, Venezuela, Somalia and Yemen, reports CNN. A district court in Hawaii blocked this iteration of the travel ban from going into effect last month. But a three-judge panel of the 9th US Circuit Court of Appeals partially lifted that order on November 13, allowing the ban to go into effect except for foreign nationals who have “bona fide” relationships with people or entities in the US. In the latest filing this week night, Solicitor General Noel Francisco sought to differentiate the President’s latest ban from prior iterations, reports CNN. “It is the product of a review process undertaken by multiple Cabinet officers and government officials... And it is based on express findings of inadequacies in the information sharing practices, identity-management protocols, and risk factors of certain countries.” —IANS

In a statement, the White House said that the two leaders reaffirmed their support for the joint declaration they both adopted during the recent Asia-Pacific Economic Cooperation (APEC) summit in Danang, Vietnam, in which they committed to work together defeating the Islamic State terror group in Syria. he Congress Working Committee has approved the road map for what looks like an unopposed elevation of its Vice President, Rahul Gandhi, as party President, barring an unexpected contest, enabling the passing of the mantle from his mother, who was at the helm for 19 years. It would be clear on December 11 whether there would be a contest for the top party post. The last date for filing nominations has been set as December 4, and scrutiny will be done on December 5, Mullapally Ramachandran, Chairman of the Central Election Authority said after a CWC meeting that cleared the schedule. The last date for withdrawing nominations is December 11 and the date of poll, “if necessary”,

Bankruptcy code ordinance approved NEW DELHI: An ordinance that bars willful and habitual defaulters from bidding for stressed assets was promulgated on November 23 with tough provisions to prevent any attempts by them to regain control of companies in difficulty. President Ram Nath Kovind on November 23 signed the ordinance that amends the Insolvency and Banking Code (IBC) 2016 which was sent to him by the Union Cabinet on November 23. Breaking the news at a meeting of select editors, Finance Minister Arun Jaitley said: “The ordinance disentitles the big defaulters and makes it difficult for them to bid for distressed assets which was of their own making.” He said the ordinance does not ban them from bidding for the stressed assets but would make it difficult for them and disentitles them from doing it. Giving an example he said: “You can’t say my account is NPA (non performing asset) but I have to bid. This is ethically completely unacceptable to the Indian political system. “I also have a political cost to pay. You can’t be a stressed asset and you want to join the process for bidding.” He said one solution could be that the NPA holder at least comes forward and services the interest by Rs 10 to Rs 15 -thousand crore in an asset of, say, Rs one lakh crore. The Ordinance aims at putting in place safeguards to prevent unscrupulous, undesirable persons from misusing or vitiating the provisions of the Code. — IANS

Dasmunsi joined the Congress (Socialist), became its West Bengal president. But he returned to the Congress fold after the party rode back to power in 1980. In 1985, Prime Minister Rajiv Gandhi appointed him as Minister of State for Commerce. In 1999, Dasmunsi successfully fought the Lok Sabha elections from Raiganj and repeated his success in 2004.

Modi’s silence doesn’t augur well for India’s democracy

ven as camera-friendly and Internet-savvy Prime Minister Narendra Modi waxes eloquent on his “Beti Padhao Beti Bachao” campaign, the right-wing fringe elements openly threaten a leading actor under his government’s nose. Modi and his government have done nothing but maintain silence, ultimately amounting to indirect approval and further encouraging these elements. The volunteers of Shri Rajput Karni Sena had earlier physically assaulted “Padmavati” director Sanjay Leela Bhansali on the sets of the movie. It’s deja vu as they are out on the streets again, mocking the “law and order” that Modi claims to have improved. While the controversy around the movie may be looked at from different lenses — that of creative freedom and sentiments of a large community — Mahipal Singh Makrana, president of the Rajasthan unit of the outfit, shamed his community as well as the country when he stated

that they would not hesitate to chop Deepika Padukone’s nose like Shurpanakha, a character in the “Ramayana” whose nose was chopped off by Lakshmana. His comments show the deeply rooted patriarchal views at the core of his outfit’s thinking. It’s more

than just the controversy over the movie and many would argue that the boiling “Rajput blood” of Makrana couldn’t resist a woman openly asserting her creative freedom. It’s that sick feeling when a man from the Stone Age has no heart to listen to a woman.

Makrana is not the only one — our proud country is testimony to open barbs of many like him. The Prime Minister’s grooming too has been under an organization with similar views — the RSS. What is sad is the Prime Minister has not to put aside the motivations

of his ideological parent and placed “India first” in his actions, as he does in his words. And it is not an isolated instance, but the new order of the day. It seems just yesterday when Paresh Rawal, a BJP parliamentarian, had openly threatened Booker-winning author Arundhati Roy. Rawal had kicked up a storm by his tweet that urged violence against the much-acclaimed author of “The God of Small Things”. That was in sharp contrast to the otherwise comic personality he was thought to adorn. In 2015, when leading writers returned their Sahitya Akademi awards to protest growing intolerance, many from the ruling dispensation, including Culture Minister Mahesh Sharma, had spewed venom against them. The Modi government, as it is today, remained a mute spectator to all of these instances.

omen achievers from Haryana — which has lived with the tag of being a “girl killer” with the worst sex-ratio among Indian states — are re-writing the script of the state’s infamy. The crowning of Manushi Chhillar, 21, who was born in Rohtak town and whose family hails from the dominant and conservative Jat community, as Miss World 2017, has again brought the focus back on women from the state making it big at the international level. Till last year, Haryana had the dubious distinction of being the worst among all states in terms of sex ratio — a dismal 850 girls for every 1,000 men. The Bharatiya Janata Party (BJP) government in the state, led by Chief Minister Manohar Lal Khattar, now claims to have arrested the rot with the

xternal Affairs Minister Sushma Swaraj has said the government is following up on the killing of an Indian student in the US, in which a person of Indian origin has been arrested. Sushma Swaraj tweeted that she had received a detailed report on the “unfortunate death” of student Dharampreet Singh Jassar in California. “It was a case of armed robbery at a gas station in which robbers shot at Dharampreet who was working there. Athwal’s vehicle was also registered in another name. “Dharampreet was a completely innocent victim, just doing his job, when he was senselessly killed,” Madera Sheriff Jay Varney said. Athwal faces robbery and murder charges. He does not appear to have a lengthy criminal history, Varney said. His bail is set at $1 million.

The apex court directed Karti Chidambaram to file an undertaking within three days on his flight details and that he will come back by December 10. “Needless to say, if the undertaking is not complied with, the first respondent (Karti Chidambram) shall face such consequences as may be deemed fit and proper,” a bench of Chief Justice Dipak Misra, Justice A.M. n a startling revelation, ridehailing platform Uber has disclosed that two hackers “inappropriately accessed” names, email addresses and phone numbers of 57 million customers and drivers and the license numbers of around 600,000 drivers. In a blog post this week, Uber CEO Dara Khosrowshahi revealed that the company in late 2016 became aware that two individuals outside the company had inappropriately accessed user data stored on a third-party cloud-based service that it uses. “The incident did not breach our corporate systems or infrastructure. However, the individuals were able to download files containing a significant amount of other information,” he posted.

‘Flowing’ water on Mars may be sand and dust: Study WASHINGTON: Dark features earlier proposed as evidence of liquid water flowing on Mars may actually be granular flows, where sand and dust move rather than liquid water, says a study published in the journal Nature Geoscience. It indicates that the water-restricted conditions that exist on Mars would make it difficult for Earth-like life to exist near the surface of the planet. The study is based on observations made with the High Resolution Imaging Science Experiment (HiRISE) camera on NASA’s Mars Reconnaissance Orbiter. The researchers analyzed narrow, down-slope trending surface features on Mars that are darker than their surroundings, called Recurring Slope

Lineae, or RSL. These features have evoked fascination and controversy since their 2011 discovery, as possible markers for unexpected liquid water or brine on an otherwise dry planet. These RSL features grow incrementally, fade when inactive and recur annually during the warmest time of the year on Mars. RSL are mostly found on steep rocky slopes in the dark regions of Mars, such as the southern mid-latitudes, Valles Marineris near the equator and in Acidalia Planitia on the northern plains. The appearance and growth of these features resemble seeping liquid water, but how they form remains unclear, and this research demonstrated that the RSL flows seen are likely sand and dust.

NEW YORK: A drug already in use to treat malaria and certain autoimmune diseases in pregnant women has shown promise in reducing transmission of Zika virus from mothers to their foetuses, according to a new study led by an Indian-origin researcher. The drug, Hydroxychloroquine, works by inhibiting autophagy, a process by which cells remove toxins and recycle damaged components to generate energy. Researchers showed that Zika virus may manipulate this process in the placenta to infect the developing foetus. The app — called as Epic Health — replaces the need for diabetics to prick their fingers several times a day. BY A STAFF WRITER ILWAUKEE, WI -- A shoplifter who beat to death an Indian American gas station attendant in Milwaukee, Wisconsin, with a baseball bat, has been sentenced to life in prison. A jury in September found 33-year-old Derrick Williams guilty of first-degree homicide in the January death of 34-year-old Harjinder Singh. Milwaukee County District Judge Jeffrey Wagner made Williams eligible to seek supervised release after 33 years in prison. The assailant had been charged with one count of first-degree reckless homicide, use of a dangerous weapon, and habitual criminality repetition. Court documents indicate that on January 5 morning, Williams came into the BP gas station and mini-mart where Singh worked. He stole something from the shop and then fled on foot. Singh chased him on foot, wielding the baseball bat. At some point, the victim threw the bat at Williams and yelled, “don’t come back,” according to court documents. Singh then started walking back to the store. Williams picked up the bat, and ran after Singh. He admitted during his trial that he struck Singh four times with the bat. An autopsy revealed Singh suffered blunt force injuries to the head. His death was ruled a homicide.

Avomeen claimed Thanedar made fraudulent and misleading claims to inflate the value of a company he sold in 2016 that banked the candidate about $20 million. The parent company of Avomeen Holdings, High Street Capital, purchased a controlling stake in the Avomeen chemical testing business. The complaint alleges the Ann Arbor, Mich.-based Democrat and entrepreneur misrepresented his company’s monthly income streams and personally directed employees to smooth over volatile revenue growth in the months leading up to the sale. Thanedar is also accused of instructing bookkeeping staff to back-date invoices so revenue could be recognized in prior months to suggest a more stable income stream. Attorneys allege he violated the federal Securities Exchange Act of 1934, the Michigan Uniform Securities Act, the Delaware Securities Act, common law fraud and breach of contract.

IHCNJ holds health fair again for needy BY A STAFF WRITER ECAUCUS, NJ -- A health screening and disease awareness and prevention fair was held recently at Shree Swaminarayan Temple in Secaucus, NJ. The November 12 annual health fair was organized by the Indian Health Camp of New Jersey (IHCNJ) in collaboration with Secaucus Temple to benefit needy people in the South Asian community. The health fair was open to all preregistered participants above the age of 40 without any medical insurance or people who are underinsured with high deductible to receive preventive screening, education and counseling on medical, dental and mental health disorders. Besides the comprehensive health screening by physicians, dentists, mental health providers and other allied health care professionals for various ailments, a dedicated team from the State of New Jersey Commission for the Blind provided thorough eye screening to qualified patients to promote their noble cause of preventing blindness in the community. ‘Careless’ mother of toddler is arrested BY A STAFF WRITER ICHARDSON, TX -- Sini Mathews, the Indian American adoptive mother of toddler Sherin who was found dead in a Richardson, Texas, culvert last month, was arrested on November 16 on felony child endangerment and abandonment charges. According to an affidavit issued by the Richardson, Texas, Police Department, on October 6–the night before Sherin went missing–Sini and her husband Wesley, along with their biological child, went out to dinner at a restaurant about five miles away from their home, leaving the little special needs toddler at home alone for over an

physical or mental impairment,” wrote Det. J. Farmer, in Sini Mathews’ arrest warrant. Sini is being held on $250,000 bail. Using cell phone records, the police confirmed that the couple went out to dinner that evening and an itemized receipt showed they had purchased only one child’s meal. Even a restaurant waiter said only one child had been present. Sherin was left alone in the kitchen of the Mathews home. The little girl was adopted 17 months ago from an orphanage in Nalanda, Bihar. She was laid to rest at a private funeral in Texas. Wesley and his biological daughter did not attend the service.

BY A STAFF WRITER OCKY HILL, CT -An Indian American resident of Rocky Hill, Connecticut, was arrested last week and charged with felony injury to a minor, for driving with his unresponsive infant, for whom he neither sought nor provided medical attention. Divya Bharat Patel, 34, is being held at the Hartford, Connecticut Correctional Center, on bail of $1 million. The police said that the active investigation into the death of onemonth-old Aayan will attempt to establish whether his father had any role in his death. In such case, Divya Patel may face a murder charge. The Medical Examiner’s office had not released a cause of death for Aayan, as of November 20. On November 18 evening, Patel’s wife frantically called 911 to say Aayan was not breathing. She stated that the infant was with his father in a car parked outside the Residence Inn in Rocky Hill. The police arriving at the Residence Inn found the wife but not the father or his son. The mother told police Patel had taken off, with Aayan in his car. Rocky Hill police officers reached Patel by cell phone, but said in the arrest warrant that Patel was uncooperative and refused to tell officers where he was. Cellphone GPS information was used, which showed that Patel was driving around in Glastonbury, about 15 miles away, and in the Rocky Hill area. After 30 minutes, Patel returned to the Residence Inn and turned an unresponsive Ayaan over to Rocky Hill police officers, according to his arrest warrant. Officers provided first aid and emergency services transported Ayaan to Connecticut Children’s Medical Center, where he was later pronounced deceased. The Rocky Hill Police Department then turned the case over to the Connecticut State Police’s Major Crimes unit, for further investigation. CSP determined that Patel was aware that Ayaan had died and did not render first aid or seek emergency care, according to the arrest warrant. In addition, Patel was uncooperative and elusive when Rocky Hill officers tried to determine his location and render aid to Ayaan.

His portrait titled ‘Morning Walk’ won the first place award in the 2017 Fall Juried Competition of the Portrait Society of Atlanta. This painting was inspired by the beautiful early morning sunlight playing on his friend, Larry Hall, on the highway of the Mexico Beach city. The exhibition, currently running in the Marietta Cobb Museum of Art, will be on display here till December 17. Earlier, his portrait titled ‘Keertana” enthralled the artists during the opening reception of the 2017 Juried competition of the 28th Georgia National Fair, Perry, GA. It won the third place award. Further, Sivananda’s painting titled ‘Damon Carter’, a portrait of his artist friend, won a merit award. His charcoal sketch of ‘Mother Theresa’ also hangs at the exhibition. ith the growth of antibiotic resistance already complicating treatments for several diseases in India, including common urinary tract infections, the country appears to be in an advanced position to immerse itself in the ignominy of the fastarriving post-antibiotic world in which even common infections would once again become incurable. Antibiotic resistance, a global threat to health and well-being of people, is part of a bigger problem called antimicrobial resistance

(AMR). It refers to the ability of a microorganism (like bacteria, viruses, and some parasites) to stop an antimicrobial (such as antibiotics and antivirals) from working against it. As a result, standard treatments become ineffective, infections persist and may spread to others, according to WHO. Each year, drug-resistant infections kill around 700,000 people worldwide, and by 2050, the figure could increase to 10 million, according to an estimate. In India, the problem of antibiotic resistance is even more as the country bears a huge burden of infectious diseases.

“The tropical wet and dry climate of India provides suitable conditions for proliferation of bacterial diseases,” Rajeshwari Sinha from Centre for Science and Environment (CSE) said. “This, along with largely unsanitary conditions, limited infection prevention and control, poor environmental regulations and practice, and inadequate health systems allows more diseases,” Sinha added. With easy availability of cheaply priced antibiotics overthe-counter (without prescription), there is growing antibiotic use and consumption to quickly tackle

these infections leading to antibiotic resistance. “‘Bad bugs, no drugs’ is turning into reality. There is a surge in patients with multidrug resistant bacteria both on outpatient and inpatient basis,” said Monica Mahajan, Associate Director, Internal Medicine, Max Healthcare.
