‘Snooping row won’t affect ties’

US to sell Harpoon missiles to India WASHINGTON: The United States Government has notified the United States Congress of its plans to sell to India 22 anti-ship missiles at an estimated cost of $200 million, saying it would help strengthen the US-India strategic relationship.

The Pentagon’s Defense Security Cooperation Agency, which handles foreign arms sales, said it had delivered the required certification notifying Congress of this possible sale following approval of India’s request by the State Department. India, it said, has requested a possible sale

tainers, spare and repair parts.

This Harpoon missile system will be employed on the Indian Navy’s Shishumar class submarine (Type209) and will provide enhanced capabilities in defense of critical sea lines of communication.

India has already purchased Harpoon missiles for integration on Indian Air Force Jaguar aircraft and Indian Navy P-8I maritime patrol aircraft.

India will have no difficulty absorbing these additional missiles into its armed forces, the agency said.

Burns, who will be in India on July 10-11, “will discuss the full range of bilateral issues — including economic, energy, and security cooperation — with senior Indian officials,” a State Department announcement said. “This trip is an opportunity to further strengthen and deepen this important bilateral relationship,” it said. Burn’s trip to New Delhi is expected to be followed by a visit of U.S. Secretary of State John Kerry later this month for the India-US Strategic Dialogue with the External Affairs Minister Sushma Swaraj although it’s Washington’s turn to host it.

The U.S. was much behind its European partners in reaching out to Modi in the run up to India’s parliamentary victory, but his “resounding” victory quickly ended U.S. hesitation. As soon as the results were announced Obama made a call to congratulate Modi and invited him

Thus “Washington has largely been pleasantly surprised at how responsive the new Indian Government has been to American outreach,” as Richard M. Rossow, Wadhwani Chair in U.S. India Policy Studies at the Centre for Strategic and International Studies, put it.

Another expert believes that recognizing India as one of its most important strategic partnerships, the U.S. is keen to push boldly on expanding the envelope of cooperation with Modi government.

Mumbai court on July 7 announced life sentence for a man found guilty of assaulting, molesting and killing young lawyer Pallavi Purkayastha in her flat in 2012.

Sajjad Ahmad Moghul, 22, the watchman at Pallavi’s apartment building, was given life term after being found guilty by the court last week. During the hearing on the quantum of sentencing last week, Special Public Prosecutor Ujjwal Nikam had sought the death penalty for Sajjad.

He told reporters, “The crime was committed in the most ghastly manner possible. Her cut her trachea so that she could not speak, shout or weep. The postmortem shows that she had over 16 injuries. This crime falls into the rarest of rare category and he

he Hindutva fundamentalists may be slowly realizing that the Bharatiya Janata Party’s victory is unlikely to help their cause as much as they would have liked. For instance, any sense of elation which they felt when Narendra Modi said during the election campaign that the Bangladeshi infiltrators would have to pack their bags and leave on the day the results were announced must have dissipated by now.

It isn’t only the good neighborly relations which New Delhi wants to establish with Dhaka which must have disheartened the saffron camp but also the suggestion for visa free entry for Bangladeshis below the age of 13 and above 65 years, which has been opposed by Assam Chief Minister Tarun Gogoi. What these overtures emphasize is the primacy of development on Modi’s agenda, calling for eschewing any possibility of tension in the South Asian region.

Since this may not be feasible where China and Pakistan are concerned, New Delhi is apparently keen to establish benign ties at least with Dhaka, ignoring the earlier imputations by the Rashtriya Swayamsevek Sangh (RSS)-led

Sangh parivar that the illegal immigrants not only intended to tilt the demographic balance in India in favor of Muslims but also act as “sleeper cells” associated with terrorists.

What is evident from these turns of events is that development has aspects other than mere economic growth. It is not only a matter of roads and bridges — and bullet trains which seem to hold a special fascination for Modi — but also

reducing all manner of controversies to the minimum since they may queer the pitch for investment. The government’s exhortations, therefore, to its supporters to be careful in their comments on the social scene are in sync with its desire for a business-friendly environment. Any hint of misogyny, or an attempt at what has been called a psycho-analytic explanation for crimes against women, are to be avoided.

But outside the field of economics, Modi’s main achievement may well be the taming of the saffron extremists. clearly aware that neither an egregious display of conservatism nor an uncalled-for trip at the tax-payers’ expense will enhance its image of purposefulness.

It is aware that an economic program, which highlights the capitalistic agenda represented by glittering malls and multiplexes, cannot be implemented in an atmosphere where women have to be careful of not offending ultra-orthodox sentiments.

But by openly disapproving of such sections in the saffron ranks, the Modi government has shown an assertiveness which is not common among the Indian politicians who tend to take the line of least resistance, especially where conservative sensibilities are concerned.

However, by sidelining some of the key preferences of the Hindutva camp on matters of religion such as the Ram temple, or on the social scene such as women’s dresses, the government has underlined its wish to follow a new course, which is markedly different from what used to characterize the BJP and the RSS in the 1990s when the traditionalists held sway.

Modi can be said, therefore, to have prevailed against the traditionalists. His trump card is economic revival.

If the growth rates go up and there is hope that the employment situation will improve, his acceptability will be even wider than at present even if his “bitter medicines” in the shape of extracting user charges from the public are criticized by his political opponents.

But outside the field of economics, Modi’s main achievement may well be the taming of the saffron extremists.

Her husband Sukrit said the romance of passing above the clouds and venturing into them was memorable. Manmohan Singh, director of the Shimla meteorological office, told IANS that monsoon hit the state July 1.

Though the monsoon was delayed by three-four days the state has been experiencing moderate to heavy rains since its onset, he said.

ne of the largest ethnic organizations in the United States, representing about 100,000 Indian doctors settled in the U.S. is working on a plan to help India improve its health services in a coordinated fashion.

The outlines of the plan were discussed with India’s new health minister, Dr. Harsh Vardhan, at a strategic planning session during the annual convention of the American Association of Physicians of Indian Origin (AAPI) in San Antonio, Texas last week.

“What he wants us to do is to get a firm written commitment from AAPI members about what they can do in India,” Dr. Jayesh Shah, who handed over charge to the new AAPI President Dr. Ravi Jahagirdar at the convention, told IANS in an interview. “Whether they want to spend two days or one week a year in India or want to give money or go to a university to provide continuing medical education (CME) or want to do camps there, they should give a firm commitment.”

US court to hear woman’s case in Sept NEW YORK: A U.S. court will hear in September the case of an Indian-American woman who has been accused of neglect in the death of her newborn a year ago, a media report said.

Purvi Patel, 32, has been charged with Class A felony in connection with the death of her seven-month-old infant, who was found dead in a dumpster in Mishawaka in the US state of Indiana in July last year, South Bend Tribune reported.

The judge officially set September 29 for a jury trial after numerous trial dates had been set for Patel throughout the past year.

Patel’s defense attorney, Jeff Sanford, had previously asked for the trial to be postponed for a few more months.

Suresh is the ninth president of the Carnegie Mellon University.

From 2010 to 2013, he served as director of the National Science Foundation. Appointed by U.S. President Barack Obama, he led the federal science agency in its mission to advance the fields of science and engineering research.

Sethna was born in India in 1948 and served as the sixth president of the University of West Georgia - the first Indian-American to lead a university in the US.

Bangladesh to get disputed waters DHAKA: A United Nations court has ruled that most of the disputed 25,602 sq km exclusive economic zone and territorial waters in the Bay of Bengal belong to Bangladesh.

In a press briefing on July 8, Bangladesh’s Foreign Minister A.H. Mahmood Ali has welcomed the ruling, saying it was a “victory for both sides”. “The Permanent Court of Arbitration (PCA) verdict awarded us with 19,467 sq km out of 25,000 sq km disputed area with India in the Bay of Bengal,” he said at a press briefing.

The official said the island, known as New Moore Island to the Indians and South Talpatti Island to the Bangladeshis, has fallen in India’s part of the Bay of Bengal.

The Bangladeshi government Monday received the copy of the verdict from the PCA on the maritime boundary dispute between Dhaka and New Delhi, Xinhua reported.

Dhaka lodged the case against New Delhi with the PCA in October 2009 as both the countries failed to come to a solution in the past decades since Bangladesh’s independence in 1971.

The court conveyed its verdict to both the parties Monday but imposed an embargo on making it public before 24 hours as part of its rules.

Nepal seeks two ALH Dhruvs from India KATHMANDU: Nepal has proposed purchase of two advanced light helicopters (ALHs), generically named HAL Dhruv, from India at a highly subsidized price. The Nepali proposal, forwarded at the 11th Bilateral Consultative Group meeting here, envisages a 40 percent down payment by Nepal and an Indian waiver on the remaining 60 percent, a top diplomatic source told IANS following the conclusion of the two-day talks on July 7. The Indian side was reportedly positive on Nepal’s request but detailed negotiations for procuring the ALHs will be carried out later.

Earlier, India had provided two ALHs to the Nepal Army during the second

Constituent Assembly elections in November last year for monitoring of election security. According to the official, the Nepal Army purchases only military stores, weapons and logistics from India but “we hoped the Indian side will be agreeable to providing the helicopters at a modest price”.

Arrest warrant against Pakistan TV anchor ISLAMABAD: A court in Islamabad on July 7 issued an arrest warrant against Pakistani TV anchor Mubashir Lucman, media reported. Lucman is a talk show host on the channel ARY News, Dawn online reported.

The arrest warrant was issued during a hearing initiated by the Independent Media Corporation (IMC) and Independent Newspapers Corporation (INC).

Lucman has been accused of defaming and ridiculing public officials, including senior court judges, during his talk show.

Earlier this month, he was barred by

the Islamabad High Court (IHC) from presenting any more shows.

The IHC on July 2 had also issued a bailable arrest warrant against Lucman.

The hearing of the case was adjourned to September 6.

roposing to hike the tax exemption limit by `50,000 for all individuals, Finance Minister Arun Jaitley on July 10 presented the national budget for this fiscal with concerns over economic slowdown while promising bold corrective measures to unburden the poor from rising prices, revive investor confidence and cut excessive expenditure.

“People of India have voted decisively for change,” Jaitley said in what was the maiden budget for himself and Prime Minister Narendra Modi’s government. “Steps I unveil in the budget aim at 7-8 percent growth over the next threefour years, lower inflation, less fiscal deficit and a manageable current account deficit.”

The finance minister said he proposed the tax exemption limit for individuals below 60 years at `250,000, subject to parliament’s approval, and `300,000 for senior citizens. Deductions allowed under various heads such as investments in insurance, pension and house rent are also proposed to be raised by `50,000 to `150,000.

The minister said given the state of the economy today, high inflation, low growth and moderate rise in tax collections, the fiscal deficit target of 4.1 percent of India’s gross domestic product set by his predecessor P. Chidambaram was a “daunting” task.

“But I have decided to accept this target as a challenge,” he said, adding he will seek to further bring

down the fiscal deficit to 3.6 percent for the next fiscal and to 3 percent in the year after.

He said the country cannot be made to suffer due to indecisiveness and populism and there was an urgent need to revive growth in manufacturing and infrastructure.

“We will also examine proposals for more autonomy to banks.”

The finance minister said the possibility of a poor monsoon and

the Iraq crisis were key challenges with a bearing on both government finances and inflation. But he said the situation will be monitored closely to initiate immediate corrective steps.

“Financial stability is the foundation of our recovery.”

Jaitley also promised early introduction of the pan-India goods and services tax, while assuring the domestic and global investment

community of predictability in the tax regime to restore confidence about the country’s prospects.

The budget for current fiscal comes against the backdrop of the Economic Survey 2013-14, the annual report card on the state of the nation, which has termed inflation-control, job creation and pushing growth as the three main challenges, while calling for a fresh dose of reforms.

Expectations have been high from the budget after Modi came to power with a landslide victory in the general elections, mainly on the promise of ushering in happy days for India’s 1.2 billion people by creating more jobs, providing relief from price rise and reviving growth.

Among the various measures, Jaitley announced a national multi-scale programme called Skill India for providing training to youth and their employment, a national irrigation scheme and a smart city with an investment of over $1 billion as part of the larger plan for 100 such projects.

He also announced many other schemes, such as one to help farmers realize right prices for their produce, at least four more institutions modelled on the All India

Institute of Medical Sciences (AIIMS), more money for people’s welfare, many new airports on public-private partnership mode, a target of total sanitation in five years, greater autonomy for banks and higher investments by staterun enterprises.

OPPOSITION SLAM BUDGET Opposition parties on July 10 criticized the union budget, saying it did not reflect the aspirations of the common man.

“The budget does not reflect the aspiration of the common man.

Most of the announcements are ministry programmes, which the finance minister is announcing encroaching upon their domain,” Congress leader Veerappa Moily told IANS. Congress leader Shashi Tharoor said it lacked direction. “There is no policy direction in the budget.

There are no clear measures to improve revenue deficit,” Tharoor told IANS. Nationalist Congress Party chief Sharad Pawar termed the budget disappointing.

“The announcements made in the budget are only a bouquet of words. There are no real measures,” said Pawar.

ullet trains are set to become a reality in India with the first service between Mumbai and Ahmedabad as Prime Minister Narendra Modi’s government sought to make Indian Railways — one of the world’s largest — run like a “commercial enterprise but serve like a welfare organization”.

In the railway budget presented to parliament Tuesday, Railway Minister D.V. Sadananda Gowda unveiled many new measures to make Indian Railways, which runs about 20,000 trains and ferries 23 million passengers daily, a modern, efficient and commercially viable utility. He presented proposals, subject to parliamentary approval, for introduction of 58 new trains, paperless office in five years, digital reservation charts, wi-fi in select stations and trains, wake-up call for passengers, separate freight terminals, office-on-wheels for business travelers, more money for cleanliness and safety, food courts at stations, expansion of rail tourism and better connectivity in hilly areas and northeastern states.

He also promised a diamond quadrilateral project of high-speed rail connectivity between the four metros.

He said some identified stations will be developed like modern airports.

“Tourism is one of the larger job creators globally. Many economies world over are supported by tourism. In order to give a major boost to tourism in India, the facility would be introduced in a phased manner at nine airports,” Jaitley said while presenting the budget for 2014-15.

He also said the necessary infrastructure would be put in place within the next six months. “Travel authorization facility would be extended in a phased manner.

This would further facilitate the visa on arrival facility,” he said.

Earlier this year, India has also extended visa on arrival (VoA) facility to 180 countries and barred eight countries from this service. These eight countries - Pakistan, Sudan, Afghanistan, Iran, Iraq, Nigeria, Sri Lanka and Somalia - are categorized as “sensitive countries”.

The implementation of visa on arrival to all these countries is expected to start by the end of this year.

India currently offers visa on arrival to tourists from 11 countries: Finland, the Philippines, Singapore, South Korea, Vietnam, Laos, Myanmar, Indonesia, Luxembourg, Cambodia and Japan. This facility is available at international airports of Delhi, Chennai, Kolkata, Mumbai, Kochi, Hyderabad, Bengalore, Kochi and Thiruvananthapuram.

DUTY FREE BAGGAGE ALLOWANCE HIKED

NEW DELHI: To encourage tourism, Finance Minister Arun Jaitley Thursday proposed an increase in duty free baggage allowance limit from `35,000 to `45,000. Earlier, anyone above 12 years visiting a foreign country for even three days was allowed to bring goods worth up to `35,000 without paying any duty.

CBI to probe Jiah Khan’s mystery death MUMBAI: Thirteen months after actor Jiah Khan was found dead in her Mumbai home, the Bombay High Court Thursday ordered the city police to hand the case over to the CBI. A division bench of Justice V.M. Kanade and Justice P.D. Kode ordered the Central Bureau of Investigation (CBI) to take over the probe from a Special Investigation Team (SIT), on a plea filed by Jiah’s mother Rabia Khan last October.

“The case is handed over to CBI for further investigations and to assess whether Jiah Khan committed suicide or was murdered,” the division bench said. Not satisfied with the probe, Rabia Khan had moved the high court, submitting reports by independent experts to support her contention that Jiah was murdered. The court also pulled up the CBI for its reluctance to take up the case investigation on grounds of shortage of manpower, as stated by CBI counsel.

“It is not expected of CBI to come out with such an excuse, that they do not have enough officers to conduct a probe. In a country of one billion people, an agency like CBI should not take such a stance otherwise, where will the citizens go to seek justice,” said Kanade Police however again stated that Jiah had committed suicide and charged Sooraj for abetting it. Fearless in her quest for solving the truth behind her daughter’s death, Rabia mentioned several circumstances in her petition which indicated that Jiah could have been killed, and how police had allegedly refused the opinion of a private forensic expert she had provided.

EW JERSEY-The IndoAmerican Cultural Foundation of Central Jersey (IACFNJ) held its annual summer picnic at Mercer County Park on June 29. The fun-filled eight-hour outdoor picnic in a beautiful weather was attended by more than 200 people from the local community.

South Br unswick Councilman and Deputy Mayor Chris Killmurray attended the picnic and expressed his sincere appreciation to the foundation for organizing community events and bringing the community together.

The IACFNJ has been a leading community organization in Central Jersey and has been very popular among young generation of Indian Americans in South Brunswick and the South Asian-dominated surrounding areas of North Brunswick, Franklin Park, Princeton, Princeton Junction, Monroe, East Brunswick and East and West Windsor who have witnessed successful Navratri Garbas for more than 10 years.

The foundation has been successfully organizing picnic, Independence Day celebration and other festivals to bring the community together for so many years.

It has been organizing a summer picnic every year for the past 15 years to bring the communities together and celebrate

outdoor summer activities.

Throughout the day, so many fun-filled activities were enjoyed by the attendees. The breakfast, lunch and dinner were provided to all participants. Watermelon, corn, gota, jalebi, papdi no lot, khichadi, kadhi, shaak and pizza for kids were available during the day. New Jersey State Assemblyman from 33rd District Raj Mukherjee attended the event and provided his support to the IHCNJ and congratulated and appreciated all the volunteers for their dedicated service and time for the health screening efforts.

IHCNJ president Dr. Tushar Patel and pharmacist Ritesh Shah provided detailed information and toured various stations at the health fair with Mukherjee and explained in detail about the mission and objectives of the screening.

For the 13th consecutive year, the Indian Health Camp of New Jersey (IHCNJ), a non-profit organization and Shree Balaji Temple, jointly organized the camp which was open to all pre-registered participants above the age of 45 without medical insurance or under-insured people.

Attended by more than 100 participants, the health screening consisted of services like blood test, EKG, physical examination, cancer screening and prevention education for prostate, breast, cervical, colo-rectal and oral cancer, eye screening, pharmacy counseling and medication management and physical therapy counseling and other ancillary services.

According to court documents, beginning in January, 2009, Dr. Khan and others agreed that he would refer Medicare beneficiaries to Advance Home Health Care Services, Inc., Perfect Home Health Care Services, LLP, and other Detroit-area home health care agencies for medically unnecessary home health services.

Dr. Khan signed medical documents such as home health care certifications and plans of care for these beneficiaries, falsely

certifying that they required home health care and they were under his care.

He also received cash kickbacks and other forms of payment from home health agency owners. He also paid kickbacks to a doctor in exchange for that doctor falsely certifying patients for home health care that would be billed to Medicare.

According to prosecutors, Dr Khan’s fraudulent claims to Medicare totaled $6,123,044.28 in billings, of which $5,504,733.31 was paid.

E WA R K ( N J ) - - T h e Newark Liberty Airport has become the latest to debut electronic passport kiosks for international passengers, a technology said to trim lines at the Customs by up to 45 per cent.

The kiosks were officially unveiled at the airport on July 3. There are 20 in Newark Liberty’s Terminal C, with 10 more scheduled to be installed, say US Customs and Border Protection.

Arriving travelers scan their passports at the kiosks, have a self-photo taken and answer questions on whether they are declaring any goods. The process takes about two minutes. A law enforcement check is done electronically through the kiosk.

Previously, those steps were taken with a Customs agent at the desk. Agents will still screen travelers after they leave the kiosk.

Irate customer assaults gas station staffer

ARSIPPANY — A Gulf gas station attendant was assaulted last week after a dispute arose between him and a customer over 60 cents of gasoline.

The police responded to the Gulf station on Route 46 East at 10 pm where an employee told them that a customer assaulted him after he filled up the man’s tank.

The customer requested $60 of gasoline, but when the pump stopped at $56.40, “the employee proceeded to pump another 60 cents to an even $57.

The customer, who became irate with the employee’s actions and began to yell at the attendant, exited the vehicle and struck the employee in the face.

The police later dispatched an ambulance to evaluate the employee’s injuries.

The employee and a witness at the scene both told officers that the individual fled the scene in a gray Audi sedan with New York license plates

DISCLOSURE OF OVERSEAS ASSETS MADE EASY

ASHINGTON: As elaborated earlier US citizens, Green Card Holders, H1B Visa holders and all USA tax residents are required to report global income in their Federal tax return and Federal tax on such global income is payable subject to credit being granted for tax paid overseas.

US tax residents are also required to report maximum value of specified foreign financial assets to the US treasury on or before 30th June every year and since 2011 reporting of overseas financial assets has become mandatory if the maximum value of overseas assets exceeds US$ 50,000 as on 31st December or US$ 75,000 during the tax year and in case of married couple taxpayers filing US$ 100,000 and US$ 150,000 respectively in Form 8938 together with Federal Tax return in Form 1040.

Out of ignorance great majority of US tax residents had not disclosed their foreign income or assets but unfortunately ignorance of law not being an excuse such defaults were subject to civil and criminal penalties. To mitigate this difficulty IRS had offered Offshore Voluntary Disclosure Initiative (OVDI) and Offshore Voluntary Disclosure Program (OVDP) requiring tax residents to pay taxes for 8 years and file Foreign Bank Account Report (FBAR) returns for 8 years and also pay penalty of 25% / 27.5% penalty of maximum value of overseas assets during last 8 years.

The Internal Revenue Service of USA probably sensed that this penalty of 27.5% was a hurdle for defaulting US tax residents to opt for OVDP and therefore the IRS has extended a friendly gesture to the defaulting taxpayers by forgiving them for their genuine and bonafide negligence of not paying federal tax on such overseas income and not declaring overseas financial assets to the Treasury by reducing the penalty to a token 5% of the peak year end balance of the preceding six years and federal tax for previous three years only under the Streamlined Filing Compliance Procedures “ (SFCP) being introduced recently on 18th June, 2014.

For availing the benefits of SFCP the tax payer should not be under audit or criminal investigation by the IRS. The tax payer is also required to certify under penalty of perjury that non compliance of US tax and reporting of Foreign Assets were “non willful”. Each case will be reviewed independently by the IRS and if the Financial Institutions is under investigation by IRS where in the US resident is maintaining a financial account offshore penalty will be 50% of maximum value of overeas financial assets. For such Financial Institutions wherein IRS is already investigating tax payers will have the option of buying peace of mind by paying miscellaneous offshore penalty of 50% of the value of overseas assets.

US tax payers residing outside USA have been granted exemption from the token 5% penalty too. As such they are required only to pay federal tax for preceding 3 years and file delinquent Foreign Bank Account Report (FBAR) returns for preceding 6 years together with appropriate applications.

The IRS has shown extreme leniency and granted total immunity from civil and criminal penalties by requiring innocent non-willful defaulter US tax payers to pay a token penalty and minimal tax. A backof-the envelope calculation shows that the IRS leniency results in tax savings bonanza for a tax payer who could have skipped tax payment on overseas income for a period of 20 years and also results in substantial

tax savings for tax payer defaulting for 10 years or more. Calculations for a US$ 1 mn deposit in an overseas account in 1994 show interesting results of interesting tax savings.

Over 20 years US$ 1 mn would have grown to US$ 2 mn at nominal interest of 4% per year resulting in an income of US$ 1 mn. This overseas income of US$ 1 mn would have attracted tax liability of say US$ 0.30 mn.

Now under SFCP, only 5% penalty will be applicable to maximum balance over last 6 years say US$ 2 mn which amounts to US$ US$ 0.10 mn only. And the tax payer will be required to pay tax for previous three years say US$ 40000 being 30% tax of US $ 0.135 mn. So the total payment will amount to US$ 0.14 mn and the SFCP results in tax savings of US$ 0.16 mn.

The relief from penalties is extended in case of non filing of FBAR returns too as even civil penalty for failure of FBAR filing is catastrophic. Penalty for non-willful FBAR filing failure is $10,000 for each year whereas if proved willful the penalties can be as high as $100,000 or 50% of the amount in the account for each violation. A taxpayer in Florida was penalised recently with 150% of his overseas account balance. Now under the SFCP a defaulting tax payer is required just to file FBAR returns for previous six years and the 5% penalty takes care of FBAR failures too.

Salient features of the SFCP are: I. ELIGIBILITY: 01 Only individual US tax payers are eligible to opt for SFCP. 02 This would include US citizens, Green Card Holders, H1B visa holders covered by the definition of US tax residents and any of such tax residents residing abroad can also opt for SFCP. 03 The tax payer must have filed tax returns for most recent preceding 3 years. i.e. Year 2011, 2012 and 2013 04 If the tax payer has sought extension for filing tax returns for the year 2013 then most recent preceding 3 years are year 2010, 2011 and 2012.

II. NON ELIGIBLE INDIVIDUALS: 01 Tax payers in whose cases IRS has initiated civil examination of tax returns for any taxable year.

02 It is not necessary that the examination results in undisclosed overseas assets or income.

03 Tax payers under criminal investigation

by IRS are also not eligible.

04 Tax payers who have submitted applications under Overseas Voluntary Disclosure Program (OVDP) can also opt for SFCP. III. PENALTY & TAX: .01 Penalty will be computed at 5% of amount of highest value of overseas assets during the period over last 6 years. .02 Federal Tax of hitherto undisclosed overseas income for last 3 years is to be paid.

IV. DEFAULTS COVERED: .01 Failure of reporting overseas income and pay tax thereon under US tax laws. .02 Failure to file FBAR reports. Earlier FBAR reporting was required to file on form TD F 90- 22.1 which is now replaced from the current year by form FIN CEN 114 which be filed online and .03 Failure to file in specified information regarding such overseas assets in various forms e.g. Form 3520 ; 8938 etc.

.04 Such failure of filing should be by way of “ Non-willful conduct “ which is defined to mean any conduct that is due to negligence, inadvertence, or mistake or conduct that is the result of a good faith misunderstanding of the requirements of the law.”

V. PRECONDITIONS: .01 Tax payers opting for SFCP declaration should be a tax payer who has failed to fulfill statutory obligations as a result of “non willful conduct”. .02 Non willful conducts has been explained as. “Non-willful conduct is conduct that is due to negligence, inadvertence, or mistake or conduct that is the result of a good faith misunderstanding of the requirements of the law.” .03 Taxpayers who do not qualify for SFCP may opt for OVDP and pay 27.5 percent offshore penalty on the highest balance held during previous eight years. .05 However if the taxpayer has an undisclosed account at a bank listed on the IRS posted list the penalty is 50 percent. .06 The SFCP does not guarantee that the IRS will not recommend criminal prosecution if rejected.

VI. PROCEDURES: .01 Tax payers must file amended US Tax Returns together with all required information for last 3 years. .02 One should file delinquent FBAR (New Form FinCEN 114) of last 6 years for which due date has passed. .03 One is required to pay tax, interest and 5% offshore penalty on aggregated highest balance of all foreign financial assets as at end of last 6 years. .04 “Streamline Domestic Offshore Procedures” should be read in red at the top of the page of amended tax returns.

VII. CONCLUSION: .01 Procedural compliance should be strictly adhered to by filing specified documents together with receipts of tax and penalty payment which are required to be physically submitted to the IRS office Austin, Texas.

The tax payer will be free to opt for SFCP till the IRS declares closure of said scheme .02 The SFCP is once in a life time opportunity for defaulting tax payers who have not paid taxes on overseas income or not filed appropriate forms or provided information about overseas Financial assets. .03 Besides the advantage of peace of mind and exemption from civil and criminal liabilities the tax payers actually saves on tax. .04 Post SFCP tax payers can freely repatriate his overseas wealth into USA and enjoy the liquidity in USA. .05 One can freely and legally enjoy the income and corpus of overseas financial assets in any place across the world too.

Society is structured around rules and regulations and citizens are expected to abide by the same. For easy enforcement of rules statutes provide for strict civil and criminal penalties for the law-breakers laws the rules. But when the law breaking is across the board and that too more out of ignorance it is pragmatic for a Government to offer immunity and give one time opportunity to citizens to revert back on the legal ways with lenient penalties. IRS has chosen to take this path breaking step of one time amnesty and it would therefore be appropriate for defaulting taxpayers to approach and take advice of an experienced Certified Public Accountant and also a Law Attorney and proceed ASAP.

Two stores closed for selling banned drugs

TLANTIC CITY (NJ) -- Officials have closed two stores on the Atlantic City Boardwalk after they were found selling synthetic drugs that were banned two years ago.

The police have arrested the owners of the businesses and two clerks on drug charges.

The investigation began last month after two teenagers said they were offered to try a Hookah pen filled with an unknown liquid at Angels and Saints Boutique. One teen passed out and the other became severely confused.

The police said the teens were given a synthetic cannabinoid.

Undercover officers said they were offered the substance in a vegetation state at Boardwalk Outlet.

Officials said they banned synthetic cannabinoids because of their potentially devastating psychological and physical effects.

The business licenses will remain suspended until the criminal cases are heard.

Vital Voices honors Indian social worker Taxi driver faces life term for honor killings

ASHINGTON, D C - - V i t a l Vo i c e s Global Partnership, a non-governmental organization founded by former US Secretary of State Hillary Clinton in 1997 to identify and bring to light remarkable women around the world, on June 17 honored five women working to strengthen democracy, increase economic opportunity and protect human rights.

One of the five women from India, Iraq, Guatemala, Tanzania and Syria who were honored was Indian social worker Priti Patkar, who was given the group’s Human Rights Award.

Clinton, fashion designer and activist Diane von Furstenberg and CBS News anchor Norah O’Donnell hosted the 13th annual Vital Voices Global Leadership Awards in front of more than 2,500 guests at the John F. Kennedy Center for the Performing Arts in Washington, D.C. Patkar grew up in Mumbai, where her father was a public servant and her mother ran a daycare business. At university, she concentrated on social work and visited red light districts in Mumbai, where she helped women caught in the web of prostitution.

Deciding that a night shelter was needed, Patkar opened a childcare center in Kamathipura, a red light area in Mumbai. Her organization, Prerana, now operates four shelters and offers childcare 24 hours a day.

Children receive meals, healthcare, education, and have a safe place to play.

The mothers have access to medical care and vocational training.

Prerana also trains police officers to recognize traffickers and advocates for laws and services to protect vulnerable children.

Among the other Vital Voices awards, Rana Zaitouneh accepted the Global Trailblazer Award on behalf of her sister, Razan Zaitouneh, who was kidnapped in Syria six months ago because of her advocacy for human rights and empowering women.

The Fern Holland Award, given annually in memory of US lawyer Fern Holland, who was killed while working for women’s rights in Iraq, was given to Iraqi lawyer Suaad Allami.

Former Attorne y General of Guatemala Claudia Paz y Paz was presented the Leadership in Public Life Award and Tanzanian entrepreneur Dr. Victoria Kisyombe received the Economic Empowerment Award.

EW YORK — A New York City taxi driver was convicted on July 3 of arranging two killings in Pakistan because he was dismayed that his daughter had left an arranged marriage.

Mohammad Ajmal Choudhry 61, was so humiliated that he arranged the honor killings of two relatives of a man who had helped her flee, prosecutors in federal court in Brooklyn had alleged.

Jurors deliberated about an hour before delivering the verdict in a murder conspiracy trial that featured emotional testimony by the daughter.

In recorded phone calls played for the jury, Choudhry explained to his daughter that in their culture, sons were free to come and go, but “when a daughter runs away, parents are demeaned forever.’’ He held out a warning in another recording, “If you don’t come back, there is only death.’’

The defense claimed that Choudhry, who

was in Brooklyn at the time of the killings in Pakistan, had no hand in them. They say government agents coached the daughter on how to manipulate her father into making empty threats.

The daughter, Amina Ajmal, wept when she first took the stand as the government’s star witness. She testified that after growing up in Brooklyn, her father tricked her into visiting Pakistan so the family could force her to marry one of her cousins there.

“He told me I was too Americanized, and I needed to learn my culture,’’ she testified.

Shortly after her wedding in a traditional ceremony in 2012, Ajmal asked a man she described as her true love to help her flee. She slipped away and flew to the United States early last year, where she went into hiding but stayed in phone contact with her father.

When Choudhry began threatening to track down the man and kill him unless she returned home and restored the family’s honor, she agreed to let federal agents record their phone calls.

LEFT IN THE LURCH, BUT NO MORE C

ASE 1: Highly-educated Ria Parikh left her lucrative job in a topdrawer information technology company in Ahmedabad inthe western Indian state of Gujarat to marry a non-resident Indian, an engineer, and settle in the United States. But soon she realized that her husband was not a technocrat but an unlettered ordinary mechanic and an alcoholic at that.

CASE 2: Just three months after Kalpana Shah, daughter of a Surat diamantaire, tied the knot with a Singapore doctor, the 29-yearold pregnant woman is desperate to return to India. She is being physically tortured by her hubby and in-laws for more dowry from her well-heeled father and is being beaten black and blue day after day.

CASE 3 : For cash-strapped Mita Patel’s family, every was hunky-dory for a year after her internet romance with a London marketing executive led to the altar. Six months ago, the couple came to the Patels’ one-room-kitchen home in Vadodara in Gujarat but the man played the vanishing trick after two days.

Well, for distressed Gujarati women like Ria, Kalpana and Mita (not their real names), now there is some light at the end of the tunnel.

They will be provided free round-the-clock legal help by the newly-launched Non-Resident Gujarati (NRG) Centre, an alliance between the Gujarat government and the Gujarat Chamber of Commerce and Industry (GCCI).

Indeed, ever since the NRG Centre opened in Ahmedabad a few months ago, harried wives and young mothers have been making frantic calls from abroad and their worried parents and relatives in Gujarat have been rushing to its golden-hearted chairman Kulin Patel for useful advice and early end to their pitiable plight that has made them a laughing stock in Indian society.

During the November-to-February period when many of the 6.5 million Gujaratis among the 25 million non-resident Indians (NRIs) visit their home state every year, at least six NRG women also met him and narrated their tale of woe while weeping like a child.

Patel, a former Indian High Commissioner to Uganda and Ambassador to Rwanda and Burundi, told Hi India that a majority of cases were related to cheating or the husband deserting the wife for different reasons like

dowry and his extra-marital affair.

Says Patel: “Many men get married because their parents want them to, and abscond right after the wedding. In some cases, he runs off because he is having an affair with somebody else. In other cases, the couple comes to the city for a holiday after a year and the husband finds some excuse to fly back alone. The wife, in most cases, is left in a very helpless situation”.

Patel has formed an experts’ panel comprising IPS officer Anil Kumar Pratham , seasoned Gujarat High advocate Gopinath Amin and reputed travel professional Manish Bhatt who go an extra mile to lead the downhearted complainants out of the sorry mess they are in.

While Inspector-General of Police Pratham who also heads the women’s cell of the Gujarat police, instantly brings relief to the aggrieved victims by ordering investigations, often even taking the help of Interpol through the Central government, Bhatt, who has travelled across the globe, not only sorts out visa-related problems in a jiffy but also directs them to his countless bleeding-heart advocate friends based all over the world for consultations without any fee.

According to Amin, who is aIso the chairman of the legal advisory committee of the GCCI, the victims seeking divorce or justice in some other way rarely keep in mind the Compulsory Registration of the Marriage

HELP AT HAND In order to check fraudulent NRI marriages and prevent Indian women from being deserted by their husbands abroad, the Indian government has taken a series of steps over the years.

The federal ministry of external affairs has set up a cell in each mission abroad to help victims of fraudulent NRI marriages.

For providing information about legal remedies, the Centre has launched a campaign which will help the brides approach authorities if they are deserted by their spouses abroad.

The Overseas Indian Affairs ministry has launched the educational-cumawareness campaign for the Indian brides getting married to NRIs and published a guidance pamphlet on ‘Marriages to Overseas Indians’.

The pamphlet has been made available in English, Hindi, Telugu,

Malyalam and Punjabi. Also published is a booklet in English containing information on safeguards available to women deserted by their NRI spouses, legal remedies available, authorities that can be approached for redress of grievances and NGOs which can provide assistance.

The same has also been posted on the ministry’s website for the benefit of people.

The Ministry has also made a scheme for providing legal assistance to Indian women deserted by their overseas husbands.

It provides an assistance of $3000 in developed countries and $2000 in developing countries through Indian Missions for filling cases in the local courts or for legal counselling through the NGOs empanelled with Indian missions.

Act 2012, and never conduct a thorough background check of the groom.

“The women’s family feels that the inlaws-to-be will be offended if they ask for the groom’s details but they must know the complete address, contact numbers of at least two friends who live within the area and one contact number of his colleague”, explains Amin adding that most of the times the girls are very young and unaware of the laws in a foreign country.

But the NRG Centre, which organized two seminars in Anand and Mehsana recently, has been creating awareness among Gujaratis about the possible dangers of NRI marriages and distributes literature giving useful tips.

Ramesh Rawani, father of a woman who has approached the NRG Centre to recover Rs 2.5 million paid as dowry from her husband, told

this correspondent that the process of seeking justice for a woman was very complicated as the Indian law did not apply to NRIs. Says another parent, Parag Desai: “The deserted wives, in about 30 per cent of cases, live there all by themselves and struggle to find a way to come back. Most of them are unaware of the legal procedures and, in some cases, the American courts declare a divorce through video conferencing”.

However, more people seeking an NRI groom will now benefit in Gujarat as, apart from Ahmedabad, NRG Centres have been set up in Surat, Rajkot, Vadodara, Anand and Mehsana and more are coming up soon in Navsari and Bhuj.

FIGURE IT OUT Indian missions in five countries have received 179 complaints about fraudulent NRI marriages since 201011.

According to data released in the Lok Sabha by Overseas Indian Affairs Minister Vayalar Ravi recently, 66 such cases were reported in five countries-New Zealand, Slovak Republic, China (Hong Kong), the UK and the US in 2012-13.

In 2011-12 the total number of cases was 50 and in 2010-11, there were 45 such cases. In 2013-14, at least 15 cases have been reported so far in the UK and three in the US. Since 2009, the ministry has received 213 complaints of fraudulent NRI marriages from across India. As many as 386 complaints were received by the ministry in 2012-13 from Indian women who had been abandoned by their NRI husbands.

Since its inception in 2009, the NRI cell of National Commission for Women has received as many as 1,316 complaints from Indian women deserted by their NRI husbands.

-----------------------------------------------For women deserted abroad, the Ministry of Overseas Indian Affairs (MOIA) of the Central government provides an assistance of $3000 in developed countries and $2000 in developing countries through Indian Missions for filing cases in the local

courts or for legal counselling through the NGOs empanelled with Indian missions.

During 2008-09 to 2012-13, a total 101 women had received assistance under the scheme. In addition to this, the MOIA also disbursed ` 32,86,709 to NGOs and 77 women deserted abroad between 2008 and 2011.

-----------------------------------------------Gujaratis number 6.5 million among the 25 million non-resident Indians settled across the globe. Gujarat is No. 2 in India when it comes to fraud by NRI grooms.

According to an estimate, over 10% of the complaints were reported from Gujarat while the maximum cases were from Punjab.

According to a paper published by New Jersey-based NGO, Manavi, there were 12,000 abandoned women living in Gujarat in 2004.

-----------------------------------------------According to a 2007 study, an estimated 25,000 wives of NRIs have been deserted in Punjab.

In 2008, in Punjab alone, at least 20,000 legal cases were pending against NRI husbands, presumably for abandoning their wives.

A special Air India flight from Erbil, capital of Iraq’s Kurdistan region, carrying the 183 landed in Kochi close to noon with Chief Minister Oommen Chandy and his cabinet colleagues, legislators, Lok Sabha members and state government officials waiting to receive them. The 78 from Telangana and Andhra Pradesh, including the 76 nurses, later reached Hyderabad by the special flight and officials were making arrangements to send them to their respective hometowns.

If you are a shift worker, donating blood could be an easy option to reduce the risk of heart disease, says a new study

T

he high incidence of heart disease seen in shift workers could be due to the tiredness resulting from the disruption to the body’s biological clock as jetlag has a severe effect on red blood cells.

These effects can be counterbalanced by fresh, young red blood cells — making blood donations a potential therapy for shift workers,

the findings showed.

“Blood donations in humans also stimulate the generation of new fresh erythrocytes. Therefore, blood donations on a regular basis might be a very simple measure to help decrease the cardiovascular risk in human shift workers,” said Margit Egg from University of Innsbruck in Austria.

The scientists worked on

The fish were subjected to alternate short (seven hour) and long (21 hour) days, resembling shift patterns common in industry.

It was found that “jet-lagged” animals showed higher numbers of aged red blood cells, which accumulated in the blood vessels.

New microbes linked to severe diarrhea

R

esearchers, led by Indian origin scientist Ravindra Uppaluri, from Washington University School of Medicine in St. Louis have found a way to predict the aggressiveness of oral tumors in people.

Working on mice, the investigators found a consistent pattern of gene expression associated with tumor spreading in mice.

Analyzing genetic data from human oral cancer samples, they also found this gene signature in people with aggressive metastatic tumors. “We didn’t automatically assume this mouse model would be relevant to human oral cancer, but it turns out to be highly reflective of the disease in people,” said Uppaluri. Rather than use genetic methods to induce tumors in the mice, the research team repeatedly applied a known carcinogen, in

much the same way humans develop cancer of the mouth.

“Patients often have a history of tobacco and alcohol use, which drive the development of these tumors,” Uppaluri added.

Further analysis identified a common signature in the expression of about 120 genes that was associated with the more aggressive tumors, whether in mice or people. Subsequently, using oral cancer samples from patients treated at Washington University, they developed a proof of concept test from their signature that identified the aggressive tumors with about 93 percent accuracy.

“These kinds of tests are available for other types of cancer, most notably breast cancer,” he said.

“They are newly born genetic tests that can alter the clinical management of patients, altering cures especially for them. It’s our goal to develop something like that for head and neck cancer,” he said.

NEW YORK: In a finding that may prevent thousands of deaths, researchers have identified new micro organisms that may trigger diarrhea disease and others that may protect against it.

“We were able to identify interactions between microbiota that were not previously observed, and we think that some of those interactions may actually help prevent the onset of severe diarrhea,” said lead researcher O. Colin Stine, professor of epidemiology at University of Maryland School of Medicine in the U.S. A better understanding of these interactions may lead to possible dietary interventions.

Moderate to severe diarrhea (MSD) is a major cause of childhood mortality in developing countries and ranks as one of the top four causes of deaths among young children in sub-Saharan Africa and South Asia.

The researchers used a technique called high-throughput 16S rRNA

genomic sequencing to examine both “good” and “bad” microbiota in samples taken from 992 children in Bangladesh, Gambia, Kenya and Mali under the age of five who were suffering from MSD. The researchers identified statistically significant disease associations with several organisms already implicated in diarrhea disease, such as members of the Escherichia/Shigella genus and

Campylobacter jejuni.

They also found that organisms not widely believed to cause the disease, including Streptococcus and Granulicatella, correlated with the condition in their study.

In addition, the study revealed that the Puertoreal genus and Lactobacillus ruminis may play a protective role against diarrhea.

rthritis patients do not use the wrist splints that are in current use as often as they should as they find them "ugly, bulky, and (ones that) can make a patient's arm sweat".

This may change soon as a lecturer at Britainbased based Loughborough University has developed a computer software concept that can help print splints that are not only more comfortable and attractive but potentially cheaper than those in current use.

The splints, which provide joint protection and rest and promote pain relief, could be a major boost for sufferers of rheumatoid arthritis, said Abby Paterson,

from Loughborough University.

The splints are made by scanning a patient's arm in the appropriate position.

A 3D model splint is then designed based on the scan to generate a computer model.

The 3D printer can then produce as many splints as are needed at the touch of a button.

They can be of any color, feature multiple materials, and have a lattice design to aid ventilation and any type of fastening the patient requires. The software may enable even clinicians with no experience in Computer Aided Design (CAD) to design and make custom-made 3D printed wrist splints for rheumatoid arthritis sufferers.
