O

n September 9th, 2010 life as they knew it changed for many people in the city of San Bruno. The recent gas line explosion and fire catastrophe affected a great number of people…neighbors, friends, family, clients, and residents.

On the evening of the explosion, I got in touch with one of my clients who lived in San Bruno.

I just wanted to know that the whole family was safe. That was a simple request. Their life changed dramatically and became complicated and uncertain in an instant, as they had no idea if they even had a home standing. Their house was on Glenview Drive, where much of the destruction occurred. To everyone’s relief, they were all safe and together. They heard the explosion and saw the fire from a nearby school since it was “Back to School Night.” A neighbor called and told them not to come back home that night since no one knew what was going on with their homes.

The day after the explosion, many of you took action.

Knowing how tragic this event was, you mobilized to help the San Bruno fire victims. One of our SAMCAR directors took it upon herself to make housing available to people who were displaced because of the fire. Many of you took up the call for donations while others of you volunteered your time to help out in any way possible. It was truly heartwarming to witness the many ways you all stepped up to help those

in our community in a dire time of need.

It took over 48 hours, but my clients did find out that their home was still standing. Life is not back to normal for them and it may take a while to settle back into their normal routine.

The house will need repairs and there is a tremendous amount of cleanup yet to be done.

The children are concerned about the safety of their house and their school. The parents are doing what they can to get some semblance in their lives, yet there are still questions left unanswered.

Through the tragedy of this ordeal, I witnessed with amazement how people come together and assist one another in times of need. I noticed neighbors talking to each other more, truly concerned about one another. I saw the fire and police personnel of various cities and towns of San Mateo County come together to assist each other. I had the privilege of seeing the American flag raised up among the ashes of the neighborhood. It was unbelievably touching to see this symbol of courage and strength; a true reflection of the people in our community. Despite the enormity of this catastrophe, I know people will come together and rebuild their neighborhood.

My theme this year is “REALTORS® Make a Difference.” In this great time of need for the citizens of San Bruno, let’s come together and make a difference for this community.

resh off the completion of a successful inaugural year, BARLA, the Bay Area REALTOR® Leadership Academy, is accepting applications to its second year class. BARLA is an exclusive leadership development program that is designed specifically for REALTORS®, and is the product of an alliance between SAMCAR, SILVAR and SCCAOR. BARLA provides its students with an intensive seven month program that builds abilities in both personal and professional realms. For those who may be interested in the leadership of their local association BARLA is an excellent opportunity to build the requisite skills. If a REALTOR® is making a profit from the sale, then it must be clear to the client there may be tax consequences, and the client’s credit could be adversely affected. If your client suffers an unexpected tax consequence they did not understand prior to the transaction, they could come back and sue you,” Mr. Hubbard said.

The importance is stressed on your connecting the lending institution’s modification department with the foreclosure department to insure the bank does not complete a foreclosure while the modification is in process.

The Brokers heard a panel discussion on “Short Sale Legal Pitfalls and Tales the Trenches,” from Howard Hibbard, real estate and civil litigation attorney and Arton Chau, Distressed Sales Solutions. Mr. Hibbard shared how to avoid legal pitfalls and litigation when a REALTOR® is involved in short sale and foreclosure transactions.

Mr. Chau shared what he is currently seeing happening in the distressed sales market.

Currently, Mr. Hibbard is seeing a lot of litigation against agents, brokers and banks. He shared the following advice to help REALTORS® and brokers stay out of the courtroom: He strongly recommended agents and brokers maintain errors and omissions insurance, even if they are no longer selling real estate, as homeowners are starting to bring legal action against agents,

suing Bank of America to enforce a loan modification. The bank had agreed in writing to modify a loan for his homeowner client, but then withdrew their agreement.

“Debt relief is very important concept to understand”, Mr. Hibbard stressed. When a home is either foreclosed upon or sold in a short sale for less than the total amount of indebtedness, that sum is called debt relief. This term describes the amount of debt not paid to a secured creditor. The amount of the debt relieved is considered ordinary income in the year of the foreclosure or short sale, just as if you took your ordinary income and paid the debt yourself. Debt relief is not taxed by the State of California, (with some limitations), or by the federal government, if the property sold was an owner occupied

property. If the property sold was a second home, investment, rental, or non-owner occupied property, there is debt relief and thereby tax consequences. So, if you are the listing agent in a short sale, selling someone’s second home, or commercial property, there will be tax consequences due to debt relief.

To keep out of litigation, Mr. Hibbard advocates it is critical the listing agent have their client sign a separate form specifying the seller’s obligation to seek independent legal and CPA counsel on the consequences of the potential short sale. Mr. Hibbard created such a legal form for listing agents. This form, along with a free resource booklet, is also available on his website at www.HLHibbardAttorney.com.

Information Reporting irs form 1099 During 2010, two new information

reporting requirements have been added to the duties of property owners and owners of small businesses (including self-employed individuals and independent contractors). Both provisions are permanent.

Current Law

Anyone engaged in a trade or business is required to file a Form 1099 for payments of $600 or more in any year. The business that makes certain expenditures must file a Form 1099 to reflect payments made for items including (but not limited to) rent, salaries, wages, and gains. The rule is imposed to assure that those who have received payments actually report the income. The payor files the Form 1099 with the IRS and with the party who received payments.

In the case of real estate, persons engaged in a trade or business would include full-time property managers and those whose primary business is property

management and other real estate services.

Some engaged in leasing activities could also fall within this requirement if they receive rental payments on the lease or otherwise manage the property.

This requirement of current law is different from (and in addition to) the requirement that BROKERS file Forms 1099 for their sales agents compensation and for proceeds related to certain transactions.

Additional 1099 Reporting Requirement for 2011 Landlords

The recently-enacted small business legislation (HR 5297) included an expansion of the 1099 reporting related to a trade or business. To date, only those real estate professionals engaged in property management-type businesses have been required to file Forms 1099. Congress has extended the Form 1099 requirement to any person who receives rental income.

This requirement would apply to any landlord (including a small investor), rather than only those who are in the business of managing property.

Starting in 2011, any person who receives rental income must provide a Form 1099 for all payments of $600 or more made to service providers such as plumbers, carpenters, yard services and repair people. The purchase of goods is not included within the reporting requirement.

The Form 1099 is provided to the IRS and to the service provider. The new requirement applies to both residential and commercial property.

Note: NAR had a Call for Action opposing this proposal in May 2010. Our message was that extending the 1099 reporting rules to small landlords is burdensome and is a trap for the “little guy.” The Call for Action had a high response rate, but Congress adopted the provision to help “pay for” provisions in the small business bill, including bonus depreciation and expensing for leasehold improvements.

I was born and raised in the Bay Area and have lived the majority of my life in the Silicon Valley/South Bay. I graduated from Homestead High School in Cupertino and spent some time at De Anza College before joining the workforce.

Northern California is truly a land of opportunity. It’s those opportunities that have offered me experience in many industries, including restaurants, high tech, construction and shipping/production before jumping into the realm of real estate. I have worked at my current position for just over 8 years and have found it to be an extremely educational

time. Learning the ins and outs of the real estate transaction, becoming familiar with the various services involved and digging into the fairly technical natural hazard disclosure report has left me more confident and well versed in this industry. Regardless, I will always concede that our industry is ever changing and I have to continually seek out further information to stay ahead of the curve.

During the past 8 years, I have been involved with a majority of the real estate associations in the Bay Area, finally making SAMCAR my home away from home. I have served on the SAMCAR Affiliate Council, participated with the R.S.V.P. program, supported our local chapter of WCR and have spoken numerous times at the local tour meetings. I have been shown a tremendous amount of support by

the REALTOR® membership of SAMCAR and have always considered it part of my job to give back to the community that has given so much to me.

I approach my business as more of a partnership with my clients. Whether it’s equipping them with tools & resources for their businesses, educating them about the changes of natural hazard zones and laws, helping their buyers understand the implications of the natural hazards in proximity to their homes or just getting involved and lending a hand whenever needed. I truly feel like more than just a provider of NHD reports for my clients, I am a part of their team.

Foundation Update

SAMCAR Foundation Update Contributed by Julie Ziemelis SAMCAR Foundation Matches Funds Raised for San Bruno Fire Fund In the hours and days after the terrible San Bruno explosion, SAMCAR Foundation leadership looked for avenues to help the victims. They decided to offer the SAMCAR membership an opportunity to double their donations to help the residents affected by the fire by offering to match whatever contributions the members made up to $5000. To date, $3329 has been raised for the effort, effectively giving fire victims almost $6500 in donations. The SAMCAR Foundation thanks the members who donated to the fund for their generosity and want you to know that the funds will go directly to benefit the victims.

Final Spaghetti Feed Numbers Are IN! Over $10k Raised!

We are excited to announce that the Annual Spaghetti Feed and Auction raised $10,075 at the September event. Thank you to everyone who came, bid on auction items, donated their time, products and services and entertained the crowd.

The funds raised will go directly into the community in the form of grants to a variety of local non-profit organizations that serve San Mateo County residents.

Holiday Season Auction is November 2 Please come to the Combined Meeting at the Elks Club on 20th Avenue in San Mateo on Tuesday, November 2 from 8:30 to 10 a.m. for some holiday kick-off fun! Thanks to the Affiliate Council for spearheading this second annual auction to raise funds for both the SAMCAR Foundation and the Second Harvest Food Bank of San Mateo County. Over 2000 meals were purchased last year with the funds raised from the Pumpkin Auction in 2009.

the tech detective Are QR Codes The Next BIG Thing?

QR codes are being hyped as the “next big thing” for connecting prospects to your marketing, according to several tech experts during both the REBarCamp San Mateo County and the California Association of REALTORS® Expo.

So what are QR codes and what can you do with them? QR codes, (which means “quick response”) are like “image hyperlinks” in the form of a bar code. Businesses and marketers use them today to take their consumer to a customized URL using their cell phone. They can be added into your marketing materials, such as on your flyers, brochures, signs, even business cards. You may have seen these codes in newspapers, magazine advertising, etc They look like a black and white square with an odd pattern inside of the box. Potential clients can scan and snap a photo of the code using their smart phone’s QR code reader app, which is basically available on any phone.

The code reader transcribes the code and then instantly sends the encoded materials and information to that person’s phone.
