lready 2009 is moving quickly! As we end January, I am closely monitoring the membership renewal numbers. This year, we have projected about a 15% decrease in both the number of renewing members, as well as the number of those joining throughout the year. These projections are on top of a decrease of about 13% in 2008.

The membership number is one of the main drivers of the annual budget, so it requires close attention.

During these challenging economic times, we have been meeting to discuss additional ways SAMCAR may be assistive to members.

The continual challenge lies in trying to identify the types of education and services needed by those members that may be struggling in this market, while continuing to serve those members that are actively buying and selling.

This year, SAMCAR will continue to offer the “Lunch & Learn” series, taught by a variety of instructors. These hands-on computer sessions teach you how to effectively use Excel, Word and Outlook, in addition to relevant hardware technologies for REALTORS®. The classes are offered free to SAMCAR members. Please see the SAMCAR calendar to find out when the next session is scheduled. These classes have been very well received and fill up quickly, so be sure to sign-up early. At the Fall Brokers & Managers meeting, Dave Hamerslough spoke about the legal pitfalls of foreclosures. This timely subject drew close to 200 members and we are scheduling a similar program on this topic for the general membership. Keep an eye out for this as the final date and location have not been finalized yet.

New Rules for Taxing Gain When a Second Home is Converted to a Principal Residence: Changes to the $500,000 Exclusion (Effective January 1, 2009)

The 2008 Housing and Economic Recovery Act (HERA), H.R. 3221, included a $16 billion package of tax incentives intended to facilitate refinancing and also to encourage first-time purchasers to come into the market. These tax incentives required offsets so that the housing package would be revenue neutral. Only one offset was real estate-related. That change, described below, provided $1.4 billion of revenue to “pay for” the $16 billion of incentives. (The balance comes from the credit card industry and from some multinational corporations.)

This real estate-related provision affects only a limited set of circumstances. The new revenue raiser modifies the application of the $250,000/$500,000 exclusion, but ONLY in situations in which an individual who owns a second home converts the second home to use it as his/her principal residence. When the former second home is sold, some portion of the gain may be taxable, even when the owner has lived in the home for the required two of the previous five years.

Affected second homes are any residences the individual owns that are not used as a principal residence. Thus, both vacation and rental properties could be affected.

from investment/rental use will be taxed as investment gains at capital gains rates, just as gains from a second home or investment property would be taxed if the owner had never lived in the residence. Gains from principal residence use will be taxed under principal residence rules and, depending on the amount of the gain, be eligible for part or all of the $250,000/$500,000 exclusion.

Starting January 1, 2009, individuals who convert a second home to a principal residence and then later sell that property will use a fraction to determine the taxable portion of any gain and the amount eligible for the exclusion. The numerator of the fraction will be the amount of time, starting January 1, 2009, that the property is used as a rental or investment property or as a second home. The denominator of the fraction will be the total number of years of ownership, dating from the original purchase date. No appraisals will be required and people who have held properties for a long time will not suffer any disadvantage.

The original policy objective of the $250,000/$500,000 exclusion was to provide tax benefit for property that is used as a principal residence. Thus, the new rule allocates the exclusion only to use as a principal residence. In all events, the full amount of a gain on the sale of the second home that is converted to a principal residence after 2008 will be taxed at lower rates than gains on the sale of a second home that is not converted to principal residence use. This is because

Another way to describe the goal of this change: a principal residence will be eligible for the full $250,000/$500,000 exclusion of gain on sale only when the property is used solely as the owner’s principal residence.

(As in the past, gains above the exclusion amount remain taxable.)

The new rule is a so-called “use” test. It requires the owner of a second home that becomes a principal residence to compute the exclusion amount and any taxable gain based on the use of the property. Gains

part of the gain associated with use as a principal residence will be non-taxable.

The formula does not penalize individuals who own non-principal residence property before 2009. After 2008, when a second home is converted to a principal residence, the rule of thumb will be that the longer the period of use as a principal residence, the greater the amount of the excludable gain.

Federal Political Coordinator and Key Contact Appointments Member Involvement in Government and Political Affairs We are pleased to announce that Anne Oliva has been named SAMCAR’s FPC (Federal Political Coordinator) to Congresswoman Jackie Speier. Anne and Claire Earley, who has been our long-time FPC to Congresswoman Anna Eshoo, serve as our primary liaisons to our federal legislators. In addition to meeting from time to time with Reps. Eshoo and Speier, here in the district and in Washington, D.C., our FPCs are responsible for communicating with our representatives throughout the year, as real estate-related legislation comes before Congress.

Bobbi has also been named our 2009 Fundraising Chair. In this capacity, she will help to communicate and emphasize the importance of investing in the REALTOR® Action Fund.

Joining Bobbi as a Key Contact to Assemblyman Hill, is Geoff Craighead. Geoff was SAMCAR’s 2007 President, and currently serves on the Nominating Committee for C.A.R. Over the years, Geoff has represented SAMCAR and played an active role in our political endeavors.

Congratulations to Anne, Bobbi and Geoff on their recent appointments!

At the state level, Bobbi Decker was appointed as a Key Contact to Assemblyman Jerry Hill, who was recently sworn in as one of newest members of the state Assembly. She joins Tim Auran, who has served for years as our Key Contact to Assemblyman Ira Ruskin. Much like FPCs, Key Contacts are SAMCAR’s primary liaisons to our representatives in the state legislature. In addition to her appointment as a Key Contact,

San Mateo County Board of Supervisors & San Mateo City Council

New Legislators Recently, former C ounty Supervisor Jerry Hill was elected to the State Assembly.

His departure for the state legislator triggered movement at the local level. Former San Mateo Mayor, Carole Groom, was subsequently appointed to fulfill the remainder of Assemblyman Hill’s term on the County Board of Supervisors. Her departure then left

a seat open on the San Mateo City Council.

On January 22nd, the City Council appointed Fred Hansson to fulfill the remainder of Supervisor Groom’s term. Mr. Hansson will have to run for re-election in this November’s general election, and Supervisor Groom will have to run in 2010, to hold her seat.

n Saturday, January 10th at the Hyatt Regency in Burlingame, the San Mateo County Association of REALTORS® held its annual Installation and Awards event. The event, attended by 220 real estate professionals, served to install the incoming Association President, Olivia Edwards, McGuire Real Estate and the 2009 SAMCAR Board of Directors. The evening also included recognition of outstanding SAMCAR members who have dedicated themselves to the success of organized real estate and to the community.

Installing Officer, Alexis Summerfield, called upon the incoming Board of Directors to adhere to the REALTOR® Code of Ethics and be strong leaders in the real estate community.

Bobbi, a former high school biology teacher, teaches at the Anthony School of Real Estate and has helped develop education for SAMCAR members and motivates new REALTORS®. Bobbi currently serves as SAMCAR’s Fundraising Captain and received the award to a standing ovation.

The 2008 Affiliate of the Year Award was presented to Moe Arshad, Old Republic Title, for going above and beyond the call of duty to service all of his clients and colleagues’ needs. He is known for his dedication to helping others within the real estate community.

The 2009 Community Service Award winner was Anne Oliva, Marshall Realty, for her dedicated service to helping spearhead the “Coats for Kids” fundraising campaign which raises thousands of dollars and hundreds of donated coats each year to local children during the winter. She organized teams to get involved with Strides for Life, as well as participating. She also is involved with Climb California which involved gathering a team to climb the Bank of America stairs and raise money for lung disease. To help raise funds for the SAMCAR Foundation, she devised an arm wrestling contest at the SAMCAR’s annual Spaghetti Feed, which not only added humor to the event, but encouraged attendees to increase their donations to the Foundation.

MLSListings Perks Program Poised for Launch Formerly referred to as its Affinity Program while in development, MLSListings’ Perks Program is poised to launch in the next couple of weeks. MLSListings Perks is a one-stop array of discounted or FREE services available only to our subscribers that will help them close more business. This collection of services will include the following

This opt-in service, at each broker’s discretion, meaning there is no need for agents to pay for and re-enter their listings on a site-by-site basis.

Clarus™ MarketMetrics is offering a FREE TRIAL

of its customized reports which allow REALTORS® to better understand what is happening in the market and knowledgeably and intelligently communicate this market insight to clients.

MarketMetrics is a web-based set of tools specifically designed to answer the two most important consumer questions: “What’s going on in the current market?” and in light of current conditions, “How should I price my property?”

MLSListings Update

were enabled for Single-Sign-On Reciprocal Access to the MLS’s of the San Francisco Association of REALTORS, BAREIS, and MetroList. All subscribers are able to enter free reciprocal listings into 3 key MLS’s in the Bay Area and Central Valley with no additional log-in or password via the newly activated links on MLSListings Pro. They will also be able to search listings in these MLS’s at no charge.

Interim East Bay Promotional Access Program Extended into 2009 Until the larger Bay Area-wide Reciprocal Access Program is completed, the East Bay MLS’s have extended the promotional access program through June 30.

Participants are asked to remember that each MLS has its own set of rules that must be followed when entering and maintaining listings.

Subscribers will need to renew for the second 6 months for an access fee of $49 (CCAR) - $50 (Bay East) - $55 (EBRDI), covering the entire six months, just like before. This program will not allow listing input.

If you’d like to enter listings, the current fee of $25 (EBRDI) -$50 (CCAR/BE)/listing applies.

No initiation fee will be charged. Access through any one program provides access to listings in all 3 East Bay MLS’s.

During this “soft” (no fanfare) phase of the launch, MLSListings, Inc. has received approximately 20 calls per day, more than half of which are simply general questions.

This “soft” launch will continue for the next several days.

This new service is the result of concerted efforts on the part of all the participating MLS’s. It represents ONE step in an evolving, industry-wide effort to bring you a wider geography of MLS data with fewer barriers and costs. This step simply provides the option to enter free reciprocal listings across a large common market area. That area will be enlarged in the next couple of months when the three MLS’s from the East Bay join this effort.

Also in development is a data-share between these MLS’s so that you can use one system to search listings across the entire 17-county area from Mendocino to Monterey and from the coast to the Nevada state line. More information on the East Bay addition and the upcoming data-share will be available later this quarter.

Baynet World, Inc. has agreed to sell its e-agents product Instanet Solution’s DocBox™ document suite through MLSListings, with NO SET-UP FEE. The program offers agents a professional website presence with hundreds of customizable templates, custom web pages, IDX MLS Search, personalized website domain name. e-agent users can create custom newsletters, drip email campaigns, and eFlyers along with custom content libraries. Additionally, Baynet has incorporated state of the art customer relationship management and lead generation tools into the e-agent suite.

At the January 6th Combined Tour Meeting, Marc Weissman gave a witty legal update to a capacity crowd. He reviewed a number of cases with the group, and stressed the point that during most legal conflicts, the only people that really win consistently are the lawyers!

He noted that arbitration was a major topic in 2008, and used case examples to highlight what REALTORS® need to consider when they sign binding arbitration contracts.

Mr. Weissman also discussed cases that covered premises liability to warn REALTORS® about lawsuits seeking to make those that carry insurance coverage pay hefty amounts due to plaintiffs who go after those with the deep pockets. The last topic covered was licensing cases. Specifically, Mr. Weissman said that if a contractor does not have a license, or if he does not cover all of his workers with workman’s compensation insurance, the homeowner does not need to pay the contractor for the work completed.

Storm Drain Issue

a month for commercial buildings. If passed, it is estimated that the upgrades could be completed within 8 years.

A public hearing is slated for January 20th. Thereafter, all property owners will be given the opportunity to vote by mail between April 5th and May 5th. A simple majority is needed for approval and implementation. If the fee is approved, a citizen’s oversight committee will be established to provide advice and counsel to the city.

For more information about this issue and how you can help, please contact Michon Coleman, your Government Affairs Director. She has copies of the brochures explaining the fees and need for repairs.

On January 13th at the San Mateo tour meeting, Burlingame Mayor Ann Keighran and Syed Murtuza, Burlingame Director of Public Works gave an update regarding the city’s urgent storm drain needs. Previously, the city put a bond measure on the ballot to raise the millions of dollars needed to fix the system. Ultimately, the measure did not get the needed 2/3rd majority for passage. Undaunted, the City is determined to deal with this problem now, despite current economic conditions. The risks posed to property and public safety during each storm that strikes the system, are simply too great to leave unresolved.

The city now proposes creating a property-related fee to provide the funding needed to upgrade the system. The fees would be equitable, based on the impervious area/square footage of the property and would be collected for the next 30 years.

The fees would be approximately $150 a month for a single family home, $45-50 a month for a condominium, and $225
