t must be a horrific experience to return home from work only to find your furniture, clothes and children locked out of the flat and on the street. Unfortunately for many tenants in Johannesburg this is not uncommon.

There has been an increase in landlords using “strong arm� tactics to evict tenants. The municipality in some areas has also contributed its fare share through the use of the notorious Red ants. When it comes to evictions, the majority of tenants do not know what their rights are, and unscrupulous landlords have taken advantage of this and are virtually making up their own rules.

WHAT IS AN ILLEGAL TION.

An eviction is a legal proceeding that occurs when a landlord forces a tenant to move out of a rental property. The law governing eviction has evolved through the years and presently is governed by a law called “PIE Act” , you might ask what does a pie have to do with evictions? Pie stands for Prevention of Illegal Evictions.

Should the tenant defend the eviction, the landlord would have to, within ten working days, apply for a summary judgement challenging the tenant’s defence. The landlord will have to serve this notice with the tenant opposing this on affidavit.

The law clearly states that the landlord has to follow certain steps when evicting a tenant. It is illegal for a landlord to evict a tenant without following these steps, even when the tenant is at fault.

STEPS TO EVICTION. The law clearly stipulates steps that a landlord should follow in evicting a tenant.

The steps are as follows; The landlord must first serve a summons (an authoritative command) to the tenant of the property. Once the summons has been served the tenant has five week days to defend this summons in court.

Should there be no response from the tenant within the stipulated 5 days, the landlord will then have to apply for a default judgement.

Once this is done, the tenant should receive a notice from the Sheriff of the court informing them of the intended eviction. The application for default judgement documents will inform the tenant that they can obtain legal representation or go to Legal Aid to sought legal advise. This notice will also state the reasons as to why the landlord wants to evict and these

If the courts accepts the tenants defence, a court date will be set and the matter will be resolved in a civil court.

HARASSMENT. It is unlawful for a disgruntled landlord to threaten, lock out the tenant or disconnect lights and water.

The law states that a landlord cannot carry out an eviction by him/ herself. the law clearly state that a landlord can face a fine, or imprisonment not exceeding two years or both.

THE PIE LAW SAYS. The Prevention of Illegal Eviction and Unlawful Occupation is a part of the South African legislature.

This act provides protection against illegal evictions for tenants and requires a landlord to gain a court order to pursue an eviction.

This act was added to South Africa’s law books on June 2 1998.

The act defines the specific process that a South African landlord needs to follow in order to successfully pursue a legal eviction.

The court order must be served to the tenant by a sheriff of the court.

TENANT’S RESPONSIBILITIES. It is unimaginable that you can go

to a shop and pick your grocery to leave without paying, or take a taxi without paying.

The responsibility of the tenant is always to pay the rent in time. If the tenant does not the landlord must take this steps to evict.

It is important to remember that during this process the tenant will be liable for the rent, defending the eviction does not mean you don’t have to pay the rent.

TO CONCLUDE. There is no reason for a tenant to take advantage of the law and continue not paying rent or unlawfully occupying a flat without permission of the landlord or owner. The “PIE Act” was formulated to protect tenants against illegal evictions not tyrant or defaulting tenants.
