Turbidity settlement outlines water utility monitoring plan NMED withdraws complaint and $48,000 fine, with conditions
By Eugene Heathman Editor Eugene@ruidosofreepress.com During a special council meeting Tuesday with New Mexico Environment Department (NMED) attorneys standing by to answer questions, an elated village council unanimously ratified a settlement in the 2012 Grindstone water turbidity filter violation. The report presented by the Village of Ruidoso for the record in regards to the settlement outlined the timeline of the activities leading up to the violation and the collaboration with the NMED to correct what was essentially a compounded crisis with the extended drought and surface water affected by the Little Bear Fire. Withdrawal of the complaint and suspending the $48,000 comes with specific performance conditions the village must abide by for a minimum of five years. End of the line: Commission looks to leave GSWA By Erik LeDuc Reporter erik@ruidosofreepress.com CARRIZOZO – Commissioners did some housecleaning during the regular Tuesday meeting with a motion to end their participation in the Greentree Solid Waste Authority, a cooperative waste disposal service between local municipalities that was established in 1991 through a Joint Powers Agreement. “I would recommend we dissolve the JPA, as well as start putting together a (Request For Proposals) for waste removal and disposal,” Commissioner Mark Doth, the county’s representative at GSWA meetings, said. “I think we have had enough. We have done our best to try and reconcile our differences, but at each path along the way we’re hindered. There’s a refusal from Greentree to recognize the county as anything other than paying fees. I can only say that this has been wildly unsuccessful.”
Doth’s motion was seconded by Dallas Draper, who said county residents could receive better services elsewhere. “In the end, that’s who has to benefit – not Greentree, not the county, but the citizens. I think there’s a lot of work to be done.” GSWA Operational Supervisor Debra Ingle was not present at the meeting to give her monthly report or answer commissioner’s questions about the JPA. She later declined to comment via an email, as “GSWA has not received any official notice of the county position or their intent.” Commissioner Kathryn Minter cast the sole dissenting vote, stating she was “not ready to go this far. I don’t know what else we could do, if we could sit down, face-to-face with them, without a mediator – I don’t know if that would be any better – and actually go over the JPA with them. I am concerned, because we have to split that debt – somebody’s going
to have to pay that debt, it’s not unilateral, all members will have to agree to dissolution. It’s going to be a hard road.” What will happen to the debt, about $4.7 million, is still up in the air. “Towards the end of the meeting, the mediation, if I remember correctly there was a discussion about meeting with the (New Mexico Finance Authority) about financial issues,” Commissioner Preston Stone said, turning to County Attorney Alan Morel for clarification. Morel said he had yet to receive a response from the Finance Authority and recommended commissioners send notice to all other municipalities participating in the JPA. “We can sit down and divide the debt amongst us, or it could go to litigation. There are things we were hoping we could sit down and resolve through the mediation,” Morel said. “What I’m hoping it the notice to the other governments
will give the other governments the ability to actually question whether they want to support their representatives positions on Greentree or sit down with the county. If we send notice and none of the other governments want to sit down and discuss issues that we have, I guess that’s your answer. It takes two to negotiate a resolution.”
Ongoing issues
Prior to the vote, County Manager Nita Taylor suggested the commission “discuss options to move forward, including a Notice of Intent to withdraw from the Authority.” Backing her recommendation, Taylor cited a relationship with GSWA that “spiraled downward significantly when Alto Lakes Water & Sanitation District decided to provide services to its residents, resulting in its termination of the Authority’s services” – this removed about 1,100 customers from See GSWA, pg. Hammer blows didn’t stop clerk from quick action By Todd Fuqua Reporter todd@ruidosofreepress.com Considering the ferocity of the attack, David Ogilvie is a lucky man. Ogilvie – a night clerk at Allsup’s convenience store at the corner of Sudderth and Mechem – was attacked early Thursday morning by an assailant with a hammer. Ruidoso Police are continuing the investigation. After suffering lacerations requiring eight stitches and 17 staples in his head, Ogilvie was humble about his ordeal, even though his actions may have directly contributed to saving a fellow employee from harm and kept the suspect from stealing anything from the store. “I’m not a hero,” Ogilvie said. “I have no problem with the outcome of this. I’ll be sore for a couple of days, but he could have really hurt me. He got me before I even knew what was happening.”
