Harris ousted in special RMS Board meeting By Eugene Heathman Editor eugene@ruidosofreepress.com Citizens vocally expressed dismay during a special Ruidoso Municipal School Board meeting Tuesday at the Horton Complex. The board voted to place RMS Superintendent Bea Harris on administrative leave with pay pending an investigation for unknown reasons. The special meeting opened at 8 a.m. following a busy Memorial Day holiday weekend and the start of summer vacation. Harris remained poised as she left the room following the decision. Assistant Superintendent Patty White was appointed interim Superintendent. The gallery filled to capacity with citizens and elected officials from the Village of Ruidoso and Ruidoso Downs and immediately erupted with discontent and tears from supporters of Harris when the decision was announced. Some citizens present angrily demanded the recall of the school board members who voted to oust Harris after being refused the opportunity for public comment. The decision was adamantly opposed by board members Kerry
Gladden who vehemently proclaimed the decision as a personal mission to stain Harris’s position by certain board members. Gladden read a prepared statement before the board which said; “I would like to address what I believe is a grave injustice to an outstanding superintendent who has been targeted by certain members of this school board that are trying desperately to camouflage whatever their real reasons are for wanting to get rid of her. What those reasons are, I don’t know. You will have to ask them, and I hope you do. For it is clear that the reasons stated for this action have not been investigated and seemingly have no basis in fact. I could literally spend the morning reciting the specific merits of Dr. Harris. With her leadership, she has brought progressive programs to our district, the most recent being the Balanced Literacy Program which has shown amazing results in one short school year. She has also made sure that every school has a true instructional leader. She worked to develop a comprehensive Facilities Master Plan and worked tirelessly with the Blue Ribbon Committee to pass see HArris, pg 9
Village of Ruidoso accused of discrimination
By Eugene Heathman Editor eugene@ruidosofreepress.com No sooner than being cleared in the Tom Gavin rights violation case, the Village of Ruidoso must now defend itself from a 2009 sexual discrimination complaint filed by April Payan. Payan had applied for a position with the Ruidoso Police Department and contends that her qualifications of being a certified peace officer, a military veteran and having a bachelor’s degree qualified her for the position. She was passed over when the village hired a male, who she believed was less qualified and at the time wasn’t a certified peace officer in New Mexico. An investigation ensued and the U.S. Equal Opportunity Commission ruling on Aug. 8, 2011 sided with Payan stating: The Charging Party (Payan) is a member of a protected class (female). The Charging Party applied for the position of Police Patrol Officer with Respondent (Village of Ruidoso Police Department) on June 11, 2009. Respondent did not hire Charging Party, citing failure to pass a background check “... due to the negative information
that was received. An examination and comparison of the background checks for Charging Party and the selected male candidate indicate that the selected candidate’s background check included equally and/or more questionable offenses. Respondent offered the Police Patrol Officer position to a male candidate on Aug. 28, 2009, and hired the candidate on Oct. 26, 2009. Witness testimony supports bias against females by Respondent’s decision makers. The evidence shows underemployment of female Police Patrol Officers by Respondent.” Village Manager Debi Lee, who was not yet employed by the village at the time of the complaint, expressed disappointment with the decision and contends the village is very fair and ethical in their hiring procedures. Lee believes the police department did not discriminate against Payan. “I am quite confident the RPD selected the right candidate for the position based on the merits of each applicant including a very thorough and quite personal background investigation, not gender.” Lee said. Lee added that the RPD does have female employees and one currently serving as a patrol officer. AL ERCI COMM

Payan contends a settlement was offered by the village following the ruling but rejected it as being unacceptable due to the fact the village was not admitting wrongdoing and refused to establish a sound policy and education regarding gender bias in the workplace. “At this point, it’s not about the money. It’s about changing policy in the hiring process and the workplace. I feel that I have done nothing wrong,” Payan said. Due to the ongoing investigation, Debi Lee was unable to comment on specific terms of a settlement but did say the EEOC suggested conciliation to settle the matter but an agreement had not been reached. The case is now in the hands of the U.S. Department of Justice for litigation consideration. The DOJ will determine whether it will file suit on Payan’s behalf. The DOJ statement dated Sept. 29, 2011 reads; if the DOJ files a lawsuit under Title VII. The charging party may seek to intervene in such a suit. If the DOJ does not file a lawsuit based on your Charge of Discrimination, it will notify the charging party and issue a Notice of Right to Sue which will entitle the charging party to file suit against the respondent.
