On the night of June 2, 2018, after seeing the broken body of New Westminster’s Olivia Malcom on the pavement between his bumper and her family’s smashed Honda Civic, 42-year-old Chao Chen admits he went back to his Jeep Wrangler.

He reached in, grabbed an open bottle of whiskey and threw it over a fence.

That bottle was never found, but a police officer who arrived at the scene shortly after reported smelling liquor on Chen’s breath, and Deas Island Traffic Services launched a 14-month investigation.

“Because it is being investigated as an impaired driving fatality, the threshold for charge approval is high,” RCMP E-Division Traffic Services spokesperson Cpl. Mike Halskov told media a month after the crash.

Just over a year later, Surrey Crown counsel approved two charges against Chen: impaired driving causing death and impaired driving with a blood alcohol level over 80 milligrams causing death – both of which carry a maximum sentence of life in prison. But those

charges had effectively vanished by the time Chen appeared in Surrey provincial court last Monday to plead guilty to the lesser charge of dangerous driving causing death.

Olivia Malcom’s parents want to know why – but no one is talking.

“Not once were we asking for a stiffer sentence; we’re not trying to change the laws.We weren’t doing any of that.This is just ‘What happened?’”Tony Malcom, Olivia’s father, said to the Record.

‘SUBSTANTIAL LIKELIHOOD OF CONVICTION’ Before approving any charge, the Crown’s job – according to the B.C. Prosecution Services Crown Counsel Policy Manual – is to determine whether there is a “substantial likelihood of conviction” based on the evidence and possible defences or other legal or constitutional barriers.

The Crown did that and charged Chen with impaired driving causing death in 2019.

Less than two weeks before the trial, however, Crown prosecutor Jodie Harris announced the situation had changed.

She told the family the

Crown would not be able to proceed to trial with the impaired driving charges, according to Malcom.

Then she announced they were laying a new charge of dangerous driving causing death, to which they believed Chen would plead guilty.

He did that last week – with his lawyer stating in court that Chen “adamantly” denies having been impaired on the night of the crash.

Harris, who up to that point had been great at communicating with the family, according to Malcom, wouldn’t explain the sudden change.

“Once they said the charges were dropped, she just completely wouldn’t answer any questions or anything,” he said.

PLEA DEAL? Prosecutors insisted to the family there hadn’t been a plea agreement, according Malcom.

But before Chen pleaded guilty to the lesser charge last week, his lawyer, Michael Mines, noted to the judge that Chen understood “the Crown’s position” and said, “(Chen) understands ultimately thatYour Honour is not bound by any agreements and thatYour Honour has

the ultimate decision with respect to sentence.”

And Harris noted later that Mines had actually suggested the plea “very early on.”

“It’s the Crown’s understanding that Mr. Chen was willing to enter a guilty plea to a count of dangerous driving causing death much earlier than it’s actually been entered, and that’s as a result of actions that had been taken on the part of the Crown,” Harris told the court.

Why the Crown reversed those “actions” and proceeded with the new charge is a question that plagues Malcom, along with his immense grief.

In impaired driving cases, the Crown counsel policy manual says prosecutors may only accept a guilty plea to a lesser or different offence if the standard for the impaired driving charge is no longer met, say, because of doubts about the evidence or they find out the accused’s rights were violated.

If a charge falls apart, Crown prosecutors are restricted from talking about the specific reasons, but Malcom said Harris has declined to clarify even generally for his family whether that is what hap-

pened in Chen’s case.

Speaking to Malcom, it’s clear he’s spent a lot of time as a result racking his brain trying to come up with an explanation for what could have happened so close to the start of the trial.Was a breathalyzer test challenged? Was there a Charter challenge?

“We understand that people make mistakes, but why wasn’t this caught earlier?” Malcom said.

The possibility that the new, lesser charge was part of a plea deal is even more distressing to him, since he said the Crown told the family it wasn’t.

“We’re very suspicious something’s going on.We don’t know what,” he said.

‘NO COMMENT’ The vast majority of criminal convictions in Canada are secured through guilty pleas, according to legal experts, and without plea bargaining, Canada’s justice system would grind to a halt.

But the tendency of plea deals or “resolution agreements” to create mistrust and a sense – especially among victims and their families – that backroom deals between lawyers help criminals get off easy, has long led to calls for more openness.

In the Martin Report, an often-cited 1993 report for Ontario’s Attorney General, an advisory committee recommended Crown counsel should state on the record in open court that resolution discussions have been held and that an agreement has been reached.

That’s what Crown prosecutors with the Public Prosecution Service of Canada are supposed to do, according to their policy book.

But no such policy exists for B.C. prosecutors, according to their manual, and media spokesperson Dan McLaughlin declined to clarify whether there had been a deal in Chen’s case or why the prosecutor couldn’t clarify for the Malcoms what had happened in the case of the man responsible for their daughter’s death.

“I cannot speak to the application of our policies to hypothetical situations, nor will I discuss the application of our policies to the case against Mr. Chen,” McLaughlin said in an emailed response to questions from the Record. “As I indicated earlier, the BCPS will have no comment on the proceedings while the matter is before the court.”

Trudeau itching to call an election

Even though this country’s COVID-19 vaccine rollout has been anything but impressive, do not rule out a pandemic federal election this spring or early summer.

Prime Minister Justin Trudeau has had numerous opportunities to rule out an early vote but has yet to do that. His standard answer is along the lines of, “We don’t want an election.”

Publicly, he may insist he does not want one. Internally, however, there appears to be no question the federal Liberals would love to strike when the pandemic poker is hot.

The experiences of the pandemic elections in B.C., Saskatchewan and New Brunswick makes it tempting for Trudeau to find some way to trigger another vote.

In each province, incumbent governments were returned with strong majorities, which is exactly the outcome Trudeau is hoping for whenever he next tests the electorate.

Many voters seem to be wary of “change” in this pandemic and are looking at incumbent governments as lifelines, not as political animals. It is obvious opposition parties are struggling to be heard in a pandemic that has turned politics on its ear and, in some cases, has vanquished them (the one exception may be in Alberta, where Premier Jason Kenney’s struggles have given unexpected life to the provincial NDP and its leader, former premier Rachel Notley).

Last fall’s election campaign in this province was a stark reminder of how much has changed.

There essentially was no “campaign” in the traditional sense. Gone were the rallies of supporters and a series of events that can develop a “buzz” amongst the electorate.

Instead, party leaders

were reduced to standing in front of a microphone maybe once or twice a day and talk to reporters over a telephone line. It was not a way to build excitement, which opposition parties need to do if they want to convince enough of the electorate to embrace “change” in government.

Trudeau knows this. He knows that once the writ is dropped, it will be difficult for Conservative leader Erin O’Toole and NDP leader Jagmeet Singh to generate a lot of news coverage that penetrates through to the voters.

Of course, it is still unclear how Trudeau can trigger an election.

O’Toole has said he will not vote them out and the NDP may have the most to lose from any early election (the Liberals have invaded enough NDP policy territory to potentially crowd that party off the stage in a number of ridings).

Then there is the vaccine rollout.

Until we see a vaccine dose administered to literally millions of Canadians, Trudeau would be foolish to force an election. A backdrop of impatient Canadians waiting for a vaccine would make it seem like the federal Liberals favour electioneering over making people safe, and that spells political disaster.

However, once those vaccines begin arriving in massive amounts, Trudeau’s election triggerfinger will bound to become itchier. If all goes as planned, those doses should start arriving soon.

Cross-border vote urged

When the City of Port Moody sent out a letter urging other municipalities to oppose a fast border crossing lane at Peace Arch because the lane encouraged cross-border gasoline shopping, New West city council passed a motion – but it didn’t get Ald. Helen Sparkes’ vote. Port Moody faced the closure of its Petro-Can and possibly its Esso refinery and blamed a drop in Lower Mainland gasoline sales. But Sparkes, who used the crossing regularly, said the idea refineries were closing because of the fast lane was “absurd.”

Fund B.C. parks

Streets need fixing up

Editor: Winter is in full swing, and people are heading outside to stave off boredom amid travel and gathering restrictions. When I’m out in B.C.’s provincial parks, I meet people of different backgrounds, skills and experience levels.

Unfortunately, years of chronic underfunding has created bottlenecks for the crowds who are eager to get out this season.

While the B.C. government has made promises to improve and expand parks, trails and campgrounds, I see an immediate need for this in my local and favourite parks.

We need more than just promises.

This winter, we’ve heard warnings from Avalanche Canada about underprepared adventurers heading to the outdoors, sometimes with tragic outcomes. North Shore Search and Rescue say they, along with many of their partner organizations around the province, have had their busiest winter ever.

An investment in B.C.’s parks can help keep people safe and healthy now and after the pandemic.

I hope that Premier John Horgan’s government will turn the tide for B.C.’s beloved but beleaguered parks.

Editor: Has anyone noticed the state of disrepair on the streets of New Westminster?

Drive down Carnarvon Street from Sixth Street to 10th Street and you are in for a very bumpy ride. The street is a disaster.

The city has been busily putting in these extended curbs at crosswalks and intersections (around the city) and making it almost impossible to turn the corner without going into the oncoming lane or up on the curb.

Not to mention the cost, plus loss of parking and turn lanes. It does not make sense to spend money on these senseless extensions to the sidewalks when the streets in the city are in such need of repair.

It seems to me that the city digs up the streets and then does a lousy job of patching them up and never getting around to repaving them properly. The city did do some paving on Third Avenue from Eighth Street to 10th Street a couple months ago – only to do it up again in three spots two weeks later. What the heck is going on?

Is this why our taxes keep going up?

Forget the bike lanes and extended curbs, and fix the roads.

Residents divided on affordable housing project Theresa McManus

A proposed affordable housing project in Glenbrooke North is garnering mixed responses in the community.

The Aboriginal Land Trust Society has applied to the city for an amendment to the official community plan, a rezoning and a development permit as part of its plan to build a 96-unit apartment building at 823 to 841 Sixth St. The proposed six-storey apartment building is intended to provide affordable, multi-generational and multicultural homes for members of the urban Indigenous and Swahili communities.

At a special meeting on Feb. 11, the Glenbrooke North Residents’ Association voted 74-40 in favour of writing to the mayor and council stating the group opposes changing the official community plan to allow a six-storey building on the sites.

The project has caused divisions within the community, with opponents wanting the city to stand by land uses approved in the 2017 official community plan (OCP) and supporters advocating for affordable housing.

In an email to the Record, the residents’ association’s secretary out-

lined some of the comments made by residents attending the meeting.

Glenbrooke North residents who voted against the motion feel the project would be good for the neighbourhood and the city, support zoning and OCP changes to allow a six-storey building and believe the OCP is a living document that’s meant to change.They also stated the location is near transit, schools and other amenities and is on a busy street, so it’s better suited to this project than single-family homes. Supporters said the neighbourhood needs more housing, community and cultural diversity.

According to residents’ association, the individuals who support the project don’t live next to the site.

All of the residents directly impacted by the project, along with 37 other Glenbrooke North residents, oppose the project.

Residents who oppose the project want the development to conform to the existing OCP designation of residential-infill townhouse and believe the project would set a precedent for further OCP amendments in the neighbourhood. Some indicated they would prefer a two- or three-storey building, saying a six-storey building is too tall and would shadow their properties and affect

their privacy.

Other concerns expressed by those opposed to the development include the loss of three rental homes. Some are concerned about the traffic impacts the apartment building would have on the narrow lane between Fifth and Sixth streets, and would prefer vehicle access be from Sixth Street and not the lane.

Some residents suggested the applicant should find another location.

Lynn Roxburgh, senior policy planner with the city, said the next step in the development review process is for the applicant to review the feedback received from the community, the NewWestminster design panel and city staff, and to consider revisions to its application A December 2020 city staff report stated the project is reliant on the applicant receiving funding from each level of government. Staff is exploring the enhancement of the city’s affordable housing reserve fund and the use of that fund to financially support this project.

Roxburgh said no date has been set for when that report will go to council.

The city is continuing to accept feedback about the project through www. beheardnewwest.ca.

In January 2016, council

considered a staff proposal to designate some parts of the west side of Fifth Street as residential-townhouse – an idea that was scrapped after opposition from some residents.

In April 2017, council approved a motion to designate Glenbrooke North

properties on Eighth Avenue, First Street and Colborne Street as residential-detached and semi-detached housing.

Council felt that struck a balance by providing options through sensitive infill and addressing concerns about townhouses.

Community Cyclist rides for Moms Stop the Harm Theresa McManus AROUND TOWN

A cyclist who is riding from Saskatoon toVancouver in the middle of winter recently made a pit stop in NewWest.

Iliajah Pidskalny embarked on a 1,600-kilometre bike ride with the goal of raising $20,000 for Moms Stop the Harm and the Canadian Drug Policy Coalition. Along the way, Pidskalny stopped at the Lower Mainland Purpose Society’s offices on Begbie Street, where he toured the NewWest-based nonprofit’s harm-reduction services on Jan. 28.

“It’s time (long overdue) for humanity to change its approach on drug policies,” he wrote on his Go Fund Me page. “Let’s look at the research and realize that the war on drugs has been a complete failure. It’s time to stop criminalizing people for needing help. It’s time to start asking ourselves, ‘why are drugs being used in the first place?’ and to shed light on the socioeconomic and psychological factors which coerce people into a life of drug abuse and crime, if not suicide.”

10,000 medical-grade face masks to five First Nations communities in B.C.The face masks were sent to the Ulkatcho government in Anahim Lake region, the Heiltsuk government in Bella Bella region, the Nazko government in the Quesnel region, the Canim Lake government and the Nuxalk Nation in the Bella Coola region.

Puchmayr said he discovered there was a “real need” for facemasks when he was speaking to a councillor with the Nuxalk Nation.

“They had a huge outbreak,” he said. “Masks are more difficult and costlier to purchase in those remote areas. I thought, because we are so close to the ports, they are actually quite cost efficient.We were able to go in and order with KeyWest Ford. I think they ordered about 70,000 masks so we were able to purchase some at a really low price.”

Puchmayr said he hopes the donation will help the First Nations combat the COVID-19 pandemic. He thanked KeyWest Ford for its contribution.

According to Puchmayr, his colleagues heard what he was doing and asked if they could jump in and help out.

“The cost of the masks was $1,300 and the shipping was about $200,” he said. “This was all paid for by the two MLAs, the MP and myself. It was a fourway split.”

It’s not the first time NewWestminster has helped out First Nations in B.C. during the pandemic, as the city previously sent face shields and “gallons and gallons” of hand sanitizer to some schools and health-care centres, Puchmayr said.

“They were all quite overwhelmingly appreciative,” he said. “Certainly, the gesture is quite significant. … It (COVID) is really accelerating in some of these remote communities.”

Community Families stand up against pipeline expansion Theresa McManus

Some NewWest residents celebrated Family Day by taking a stand against the Trans Mountain pipeline expansion project.

A contingent of local residents spearheaded the #FamiliesfortheFuture event to highlight their concerns about the pipeline expansion, including safety risks, environmental impacts and the danger of leaks or explosions.

Participants toured portions of the pipeline route, held signs showing their opposition to the project and posted selfies on social media.

“It was a cold, drizzly Family Day, but dozens of people and families of all sorts braved the weather across the Lower

Mainland to show their concern on social media about the Trans Mountain pipeline expansion project,” participant Maya Russell said in an email to the Record.

In recent months, Sapperton resident Ruby Campbell reached out on social media to see if other residents were concerned about the project and wanted to learn more.

Some suggested they could still try to convince the federal government to stop construction of the pipeline expansion.

“A lot of people said, ‘It’s not too late – only 20% of it is built’ and ‘maybe we can make this an issue.’ If there is a federal election, that would bring awareness to it again,” she told the Record. “It really is going to impact our waterways.

The group includes “everyday families” who will be impacted by the project and want to do what they can to stop it from being built, Campbell said, and includes people supportive of various political parties.

Community-based organizations including New West Environmental Partners, Colony Farm Park Association and Burnaby Residents Opposed to Kinder Morgan Expansion supported the plans for the #Familiesforthe Future events.

On Family Day, people attended events at three locations near the pipeline route – Lower Hume Park, Stoney Creek in Burnaby and Colony Farm Regional Park in Coquitlam.

Campbell said she often walks in the Brunette Fraser Regional Greenway, which is on the pipeline route and is home to endangered species.

“There are endangered species in the Brunette, Fraser River and Stoney Creek that are part of our ecosystem that are going to be destroyed,” she said, when asked about her concerns. “The trees – the destruction of the trees.”

quired to obtain city permits to remove more than 1,300 trees along the route in Burnaby. Burnaby’s tree bylaw states that protected trees – those with diameters of 20.3 centimetres or greater – cannot be damaged or removed without a permit from the city, but the CER panel determined that section of the tree bylaw doesn’t apply to Trans Mountain’s work.

“It’s not just 1,300. It’s going to be more because they only measure trees of a certain diameter. It’s going to be more trees.When I think of that, I am horrified,” Campbell said.

“You look at Texas right now with the snow storm

they have; that is climate change.When you look at trees being removed, my gosh, that’s baseline what we need for the environment. It’s not just esthetics.”

Campbell is also concerned the federal government bought the pipeline with public funds after Kinder Morgan decided it wasn’t going to be economically feasible for them to build – at a time when she believes the federal government should be divesting from fossil fuels.

“It really is grounded in community and grounded in people who happen to be at a point in their life where they have this time to bring awareness,” Campbell said of the group. “This is about our community. It is not about winning elections. It’s about supporting whoever our public official is that can help to stop this.”

Although construction of the pipeline is already underway, opponents believe there’s still a chance to stop the project.

“It can never be too late to do better,” Campbell said.

For 14 years, NewWestminster has supported the goals of Pink Shirt Day to eradicate bullying in many ways, especially through school efforts.

In recognition of two Nova Scotia students who organized a high-school protest in 2007 to wear pink in sympathy with a Grade 9 boy who was bullied for wearing a pink shirt, Pink Shirt Day has been supported through numerous efforts.

This year, Pink Shirt Day is Feb. 24 and the community is asked to acknowledge the importance of kindness even as COVID-19 stretches people, and asks them to do more to stop the spread of the coronavirus.

While in-person events will be cancelled or curtailed, like every year, we can expect teachers and students to wear pink, students to work on posters and do acts of kindness, including during Real Acts of CaringWeek, Feb. 14 to 20, and businesses and politicians to make proclamations against bullying.

But what is bullying exactly, and where do we find it? According to Rob Zambrano, who has worked in public schools for more than 30 years, bullying is

a very specific type of aggression.

“For a situation to be considered bullying, the act must be intentionally hostile, enacted by a person or group of people with a real or perceived imbalance of physical or social power, and repeated behaviour (or have the strong likelihood to be repeated),” said Zambrano.

CYBERBULLYING A PROBLEM Similarly, Public Safety Canada defines bullying in its most basic form as social bullying in school. It involves making up hurtful nicknames, name-calling, excluding and spreading fake rumours.

When bullying moves online, it has the potential of causing great harm, as the victims have no relief,

even when they are away from school.

Some of the social media apps used for bullying, according to Public Safety Canada are Facebook, Instagram and TikTok. People in MetroVancouver are particularly aware of the problems of cyber bullying, something that was revealed after a cyberstalker threatened Port Coquitlam teen Amanda Todd, who died by suicide in 2012 after posting a video of her experience.

Here are some statistics according to Public Safety Canada: Ð 47% of Canadian parents have at least one child that has been a victim of bullying Ð Around one-third of the population experienced bullying as a child.

When faced with a possible bullying situation, an investigation is carried out, at which point schools must look at the entire context of the situation, he said, because they “are often more complex than they seem.”

The outcome, he said, is “to teach, learn and then restore,” and, while firm

and fair intervention can be useful and often necessary, schools try to deal with the issue through a compassionate lens, Zambrano said.

“There are always developmental, sociological, and sometimes even physiological factors to consider in each circumstance.

What we require is more compassion, understanding and perspective to help students,” Zambrano further stated.

Community Community rallies to help Fraserside replace stolen truck Theresa McManus

Fraserside Community Services Society is overwhelmed by the community’s response to its efforts to raise money for a new truck for its mobile work crew.

The mobile work crew is a social enterprise that benefits adults with developmental disabilities in the community.

On Halloween 2020, the team’s truck was stolen – leaving the program’s future uncertain, as the truck is used to transport the team and the tools and equipment they need to

complete their work.

Fraserside recently launched a campaign to raise $40,000 to purchase a new truck for the program.

In response to media coverage, the New Westbased non-profit was flooded with donations – and 144 donors helped it meet its goal after only one week of fundraising.

“We are so grateful for the incredible response from the community,” Fraserside CEO Lynda Edmonds said in a news release. “The crew is thrilled that they will have a new truck in time for spring and will now have a

reliable vehicle to take on jobs.”

All donations exceeding the cost of the vehicle will

be put toward the nonprofit’s highest priority needs.

Connie is an absolute doll of a rat. She came to us from another shelter who was overwhelmed with a large intake. Connie and her friends were left behind by their owner when they moved out. The males and females were housed together, so many of the rats were pregnant. We thought Connie was pregnant, but 3 weeks passed, and no little babies arrived. So now Connie is looking for her own home!

She is extremely hand-tame and easy to handle. She loves riding around on your shoulder and doesn’t mind being picked up gently. She would love to live with someone who can hang out with her a lot, since she’s a singleton. She *might* be able to join neutered males or female rats, but a lot would depend on the introduction plan.

Mara is a gorgeous girl who came to our shelter with her younger friend, Shimmer. The girls were very nervous when they arrived. While Shimmer has blossomed, Mara has remained quite shy. She loves to hide under her bed like a turtle. Despite her shyness, she is very gentle and has never shown us any aggression at all.

Shimmer and Mara have lived together for a long time, but we do not see bonded-cat behaviour here at the shelter, so we think they could be adopted together or individually.

Mara is approximately 15.5 years old. She might be a senior gal, but she seems to be in good health. She has recently had bloodwork completed, and is awaiting a dental surgery in early March. Lyra is a sweet girl. She’s a bit cautious at first, but you can tell she is used to humans. We think she has the most beautiful eyelashes and colouring!

Lyra is pretty clean in her kennel, with some toileting outside of her litterbox. We typically see a big improvement with litterbox use after rabbits are spayed/neutered, so we are optimistic that she will become even cleaner.

Lyra doesn’t really care for pellets, and isn’t super keen on hay, either. Of course, we offer both all the time, as rabbits do need hay. She likes her veggies!

Lyra is approx. 2 years old. She has been examined by a veterinarian, has been RHDV2 vaccinated, and will be spayed and microchipped mid-February.

The adoption fee is $50 for a fully vetted rabbit.

Shimmer is a gorgeous girl who came to our shelter with her older friend, Mara. The girls were very nervous when they arrived, but Shimmer quickly showed us her loving personality. She is very chatty and friendly. She likes to flop over in all her glory.
