Former ComEd exec-turned-FBI mole in Madigan probe sentenced to probation

CHICAGO — Former Commonwealth Edison executive Fidel Marquez, whose role as an FBI mole furthered the feds’ investigation into then-Illinois House Speaker Michael Madigan, was sentenced to two years of probation Thursday for his role in a bribery scheme meant to influence the powerful speaker.

Marquez’s sentence, which also includes a $50,000 fine, is punishment for his involvement in the scheme before January 2019, when the FBI confronted him with wiretapped recordings of him discussing do-nothing contracts for Madigan allies.

Marquez immediately agreed to cooperate, and over the following weeks he secretly recorded meetings with his colleagues, several of which were played during his testimony in the trials of those same colleagues and Madigan himself.

In handing down her sentence, U.S. District Judge Mary Rowland told Marquez it was “a credit to your parents” that he immediately agreed to cooperate “when the FBI came calling.” But referencing the current political climate, the judge implored would-be cooperators or whistleblowers: “We need people like you to stand up sooner.”

“In a time when we’re seeing people exhibiting courage when they’re being asked to do something that’s wrong, stand up and say, ‘I’m not going to do this ... that’s immoral, that’s illegal,’ ... You didn’t do that,” Rowland said.

In his statement to the court moments before, Marquez acknowledged the same.

“I sincerely regret my actions and participation in the bribery of Michael Madigan,” he said, reading from a prepared script. “I am ashamed. I did not like what was taking place, but I could have tried to do more. And I didn’t.”

Bribery scheme

As the utility’s chief governmental affairs executive, Marquez oversaw a roster of lobbyists including ComEd’s longtime top contractor, Mike McClain. Owing to their longtime friendship dating back to the 1970s when they were both young Democratic lawmakers, McClain was tasked with maintaining ComEd’s relationship with Madigan. Plenty of witnesses at both trials testified Madigan had never trusted utilities, but his relationship with ComEd had been particularly rocky. ComEd’s finances were also rocky; the utility had been contemplating bankruptcy in the mid-2000s, and by 2010 the company was struggling to keep up with demands to its power grid, which serves the northern half of Illinois. But after a multi-year legislative push, ComEd’s fortunes began

to change after 2011 when the General Assembly passed a law changing how the utility could recoup the costs of major infrastructure upgrades.

Prosecutors theorized that the utility’s success in Springfield could be traced back to the months before that legislation passed, when ComEd arranged for a do-nothing lobbying subcontract for a close Madigan ally and retained a law firm owned by another.

Along with a successful pressure campaign to appoint a Madigan-backed candidate to ComEd’s board and set-aside slots reserved for interns from the speaker’s power base in Chicago’s 13th Ward, the roster of do-nothing subcontractors paid indirectly by ComEd eventually totaled five Madigan allies. Over the course of eight years, they were paid more than $1.3 million.

All the while, ComEd and its parent company negotiated and the legislature ultimately passed two more laws favorable to the utility, which the feds say was made possible by the company’s accommodations of Madigan’s requests. Defense lawyers and even some trial witnesses maintained ComEd’s success in Springfield was due to the company’s effective lobbying strategy.

The passage of the 2011 “Formula Rate” law was worth hundreds of millions of dollars to ComEd. Witnesses at both trials testified that the infusion of capital was critical to the utility’s ability to modernize its aging electric grid, which also helped ComEd significantly reduce the number and length of power outages, especially after heavy storms.

Still, Judge Rowland on Thursday described the cost born by ComEd’s customers as “sickening.”

“I mean, what about the ratepayers?” she asked.

Plea deal

Rowland acknowledged Marquez wasn’t the “architect” of the bribery scheme; in secret recordings played at trial, McClain and Marquez’s predecessor, John Hooker, took responsibility for the subcontracting arrangements.

But he and ComEd CEO Anne Pramaggiore continued them beginning in 2012 when they both stepped into new leadership roles. Assistant U.S. Attorney Timothy Chapman grew emotional Thursday when describing Marquez’s career trajectory at ComEd, saying that even when promoted into leadership, he was still at his core “an engineer that wants to make things work well.”

Chapman said Marquez “sensed that there was some danger going into this world of politics and lobbying, especially the way Hooker set it up with McClain.”

“If there’s one checkmark on his character, it’s that when he came to this moral fork in the road, he made the wrong choice,” Chapman said.

Prosecutors were recommending probation along with a $250,000 fine and 320 hours of community service. But Marquez’s lawyer, Christopher Niewoehner, said his client’s “extraordinary cooperation” should be taken into consideration and wipe away a fine or mandated community service, as Marquez has already put in more than the government’s recommendation volunteering at Pima Community College in Tucson Arizona, close to where he lives.

Niewoehner pointed back to the FBI’s pre-sunrise meeting with Marquez more than seven years ago, when he immediately agreed to cooperate with the feds.

“He doesn’t say, ‘Let me think about it, let me talk to a lawyer.’ He doesn’t say, ‘Gosh, what’s in it for me?’” Niewoehner said of his client. “Because he truly didn’t think at that point in time that there was something in it for him. He saw it as a chance to stop something he thought was wrong.”

Niewoehner said he knew Marquez wasn’t thinking about a plea deal in January 2019 because when Marquez retained him as a lawyer, “I’m the one who laid it out for him.”

“And when his eyes were opened and he does indeed now understand why it was legally wrong, not just morally wrong, it doesn’t change him,” Niewoehner said.

“He continues to sit with the FBI session after session and do his best to explain.”

During Marquez’s cross-examination during the 2023 “ComEd Four” trial of his former close colleagues, including McClain and Hooker, he acknowledged that he told the FBI early on that “I did nothing illegal” and did not believe that he’d bribed Madigan during his years as the utility’s chief internal lobbyist.

Eventually, Marquez agreed to a plea deal, which he accepted in September 2020. Earlier that summer, ComEd agreed to a $200 million deferred prosecution agreement acknowledging the bribery scheme, which was laid out in charging documents that referred to Madigan as “Public Official A.” Marquez’s former colleagues were charged later that year, while the speaker himself wasn’t charged until 2022, more than a year after leaving office as the longest-serving legislative leader in the country.

The ComEd Four — McClain, Pramaggiore, Hooker and ComEd lobbyist Jay Doherty, who paid some of the ComEd subcontractors — are all currently serving one to two-year prison sentences. Madigan, who reported to a West Virginia facility in October to begin his 7 ½-year term, is continuing his legal fight with appellate arguments set in his case for April.

If you consistently eat blueberries every day with your oatmeal or add to a smoothie, you might be thinking if you could grow your own. The answer is yes but with hesitation. It is not as if the blueberry plant cannot grow in Northern Illinois. It can thrive really. The challenge is that it is very picky about having certain growing conditions, something that you may not be able to control.

Unlike other fruits and vegetables you grow, blueberries need a soil pH of 4.8 to 5.2. Within this range, it allows for the blueberry plant’s roots to take up the soil nutrients it needs during the growing

The challenging and rewarding blueberry plant

season. The issue is that your growing area, whether growing in the soil, a container, or raised bed, is probably not within this range. Most gardens we see are between 6.0 to 7.5, a range needed for every other fruit and vegetable. So if wanting to growing blueberries, you need to grow them in another area.

Another challenge with blueberries are that it can take some time to lower your soil pH. You probably do not have enough time to do this for spring planting. Sometimes elemental sulfur is recommended which is best applied in the fall. Ammonium sulfate can be used while the plants are growing to lower the soil pH though not always perfect. The rates for

ammonium sulfate are 1 ounce per plant at time of planting, 3 ounces for two year old plants, 8 ounces for four year old plantings, and 12 ounces for eight years or older.

To determine your soil pH, you need to take a soil test. The results will provide you with the current soil pH and some guidance on how to lower your soil pH for where you need to be.

For cultivars, recommended highbush types include ‘Blueray’ and ‘Jersey,’ as well as hybrids (cross between high bush and low bush) ‘Northland’ or ‘Patriot’. Spacing is about 4-6 feet apart. Blueberry plants do need to be pruned. Remove any diseased or broken branches laying

on the ground or branches that are size years or older. When pruning, aim for an open center. You may also remove blossoms in the first 2 years for stronger establishment.

If the growing needs of blueberry has you realizing you do not want to grow them, there is an alternative fruit. Honeyberry has a sweet-tart flavor with blue-purple color like the blueberry but without the soil pH needs. We have grown them at our Winnebago County Extension office for more than 6 years and pleased with the plant. It is very early with a crop of fruit starting Memorial Day weekend. Energy & Environment

Trying to move ahead on climate change

While last week’s article on planting trees was a little early, it was done in anticipation of the potential of the EPA repeal of the Endangerment Finding and emissions controls on cars and trucks. The reminder of the role of trees in controlling air pollution provides concerned citizens with one appropriate action to take to address climate change and air pollution. In anticipation of a warming climate pecan trees are being included along with the usual oak species being planted.

The Environmental Law and Policy Center is filing a lawsuit in the U.S. Court of Appeals for the D.C. Circuit challenging the EPA repeal of Endangerment Finding and the clean car and truck emissions standards. Other U.S. health and environmental groups are suing the EPA over its repeal of the Finding as well. In addition 13 Democratic states are taking the Trump administration to court for eliminating Congressionally mandated funding for

energy and infrastructure programs. It is expected that the policy conflicts will end up before the Supreme Court.

Fossil fuel interests and their supporters have resisted efforts to control air pollution and address climate change. One line of criticism has been directed at the models used to predict the adverse impacts of climate change.

A number of early predicted outcomes of climate change forecasts have already been realized. A recent article in The Conversation: Britain’s relentless rain show climate predictions playing out as expected, the official University of Readings rain gauge recorded 31 consecutive days of rain. As the temperature of the atmosphere rises the warmer air can hold more moisture. And when it rains, it rains harder, bigger and heavier downpours. Climate change also disrupts the patterns of current and cycles within the atmosphere and oceans bringing weather to the UK. Three contrasting air masses bring variable weather to the island. One air mass is the wet Atlantic, a second is the cold, dry arctic Iair and the third is

the variable weather from the Eurasian landmass.

Another factor impacting weather is the variable jet stream, high in the atmosphere. Sometimes it flows north of Scotland and other times if flows south toward Spain, bringing wet and windy weather as is occurring now.

Another article in The Conversation: 5 forecasts early climate models got rightthe evidence is all around you, describes the earliest climate models forecasts of global warming that are now proving true. Not only did they predict global average warming they also predicted geographical patterns of warming.

The five scientific forecasts that are considered verified in the article include the following:

1. Global warming is from CO2

2. The stratosphere is cooling- 7.5 to 31 miles above the earth

3. The arctic amplification- the arctic warns 2-3 time faster than the remainder of the globe

4. The land-ocean contrast- the land generally warms more than the ocean

5. Delayed southern ocean warmingthe vast, remote body of water has strong easterly wind blowing across Antarctic that draw up deep cold ocean waters to the surface.

The success of the early predicted outcomes from the climate models increases confidence in them regarding predictions of future trends. Since we have not implemented appropriately scaled solutions to limiting climate change what reason is there to simply ignore the problem and accelerate deteriorating environmental conditions.

Spring is a time of renewal and a great time to implement some fresh environmental goals for yourself. Some simple actions for spring might include planting some trees, a garden, volunteering with an environmental organization, going for walks in nature, letting your governmental officials know of your environmental views and enjoying the Rock River Trail System. Human service advocates say they are worried after Pritzker’s status-quo budget proposal

SPRINGFIELD — Lobbyists representing a coalition of health and human service organizations across Illinois packed a room Wednesday in the Illinois State Library to watch Gov. JB Pritzker’s annual budget address and came away concerned.

The lead organizer for the event and executive director of Illinois Partners for Human Service, Lauren Wright, said she was disappointed to not hear any mention of health and human services from Pritzker, but said she remained optimistic that the topic would be addressed in further conversations. Pritzker’s proposal kicks off a budget negotiating process in the General Assembly that usually concludes at the end of May.

“Community-based human services are vital and, in this moment, cannot be sacrificed,” Wright said. “The budget cannot be balanced on the backs of human services.”

Pritzker’s proposed budget for fiscal year 2027 calls for a 1.6% spending increase, a far cry from past years when base revenue sources were growing at a faster pace.

Pritzker said his budget “levels off and in some cases reduces programs that are important to me,”

“But I believe that the imperative of responsible governance and overcoming the fiscal irresponsibility of past decades must come ahead of the interest of any one politician, program or party,” he added.

At the health and human services coalition watch party across the street, several attendees let out audible sighs at the line. Otherwise, the participants frequently clapped and murmured in agreement as the governor spoke, despite the speech falling short of addressing any budget allocation to health and human services they were hoping for.

“I was hoping to hear that there would be marginal increases in support for things that impact not only TASC, but our partner organizations,” said Joel Johnson, the CEO of Treatment Alternatives for Safe Communities, a nonprofit organization specializing in care coordination for people with substance abuse issues and mental health disorders. “Flat funding is not sustainable.”

The Illinois Partners for Human Services coalition has 850 partners and is registered as a 501(c)(3) nonprofit organization, according to their website.

Amber Kirchhoff, senior vice president for public policy at Thresholds, one of Illinois’ largest mental health providers, said that thin margins would cause any

stagnant funding to have a more severe effect than it would otherwise.

“We have 1,200 employees and the cost of our employee health insurance is tremendous,” she said. “Trying to manage all those costs while not receiving increases in reimbursement that we get for delivering services is increasingly difficult.”

Approximately 4,000 Thresholds clients could be affected by impending Medicaid eligibility changes contained in President Donald Trump’s recently passed domestic policy law, Kirchhoff said. The Illinois Department of Healthcare and Family services has projected the state could lose as much as $51 billion in total federal funding for Medicaid over the next decade, with 300,000-500,000 residents losing coverage. Medicaid covers approximately 3.4 million people.

Andrea Durbin, CEO of the Illinois Collaboration on Youth, said that she was concerned about federal cuts to afterschool programs, which are services her company has tried to strengthen.

“There are lawsuits going on right now to try to protect afterschool funding that the federal government is trying to cut,” Durbin said. “(After-school programs) are how parents know that their kids are safe after school so they can be in the workforce.”

Durbin added that after-school programs contribute to higher graduation rates and

noted the 15-year high graduation rate Pritzker touted in his address.

“We’re contributing to that 15-year high,” she said.

Lawmakers will now spend the coming months negotiating a final spending package before FY27 begins on July 1st. Members of the coalition said they will try to push for increases to budget allocations for health and human services in that time in hopes they can be included.

Pritzker addressed the threat of impending budget cuts in his budget speech.

“So as we embark on this journey of maintaining our state’s now re-established record of fiscal responsibility, I want to say to anyone on either side of the aisle: If you want to talk about our FY 2027 budget, you must first demand the return of the money and resources this president has taken from the people of Illinois,” he said.

Battle over data centers in Illinois pits consumer costs vs. state competitiveness

SPRINGFIELD — The debate over how to regulate data centers in Illinois is intensifying as lawmakers struggle to balance costs to consumers and the state’s need to be competitive economically.

Data centers house computer systems that store, process and distribute data but require large amounts of energy to power that workload. A growing number of these facilities are used to power AI.

A state report published in December projects energy shortfalls would begin in northern Illinois by 2029 and the rest of the state by 2031, driven in large part by data centers’ increased power usage. That’s led Gov. JB Pritzker to backtrack on a proposal he signed in his first year as governor to incentivize data center development in the state.

“With the shifting energy landscape, it is imperative that our growth does not undermine affordability and stability for our families,” he said, proposing a two-year moratorium on the incentives in his budget address Wednesday.

Illinois consumers blame data centers — which often receive generous tax incentives in Illinois — for straining the grid and driving up prices, and they want relief. But companies that operate the centers are seeking ways to build more quickly and pushing for looser regulation, arguing the centers are key to the state’s economic future.

And the state, from the governor’s office to the legislature, is struggling with ways to balance the economic interests tied to data center development with environmental and consumer cost concerns.

“We don’t want them to overwhelm our electrical capabilities and our water resources,” Sen. Steve Stadelman, D-Caledonia, said. “If we’re going to allow them and track them, how can we make sure it benefits Illinois residents and rate payers in the state?”

Data center negotiations continue

These are the same issues and tensions legislators hoped to address in their fall veto session. But no broad consensus was reached, and instead, Gov. JB Pritzker signed the Clean and Reliable Grid Affordability Act, adding new air regulations for backup generators used by data centers.

Lawmakers in Springfield have already begun negotiating a new round of data center regulations.

Sen. Ram Villivalam, D-Chicago, recent-

ly announced the introduction of Senate Bill 4016, known as the POWER Act, to place prohibitions on cost shifting, introduce “bring your own new clean capacity and energy,” guarantee transparent public engagement and implement water efficiency standards on data centers.

“By establishing policies that ensure data centers, not consumers, bear the increasing energy costs, and critical protections for our environment and sustainable water use, we can work toward a future built for technology to support our daily lives,” Villivalam said, “not deplete our resources and price us out of our homes.”

Environmentalists want new data centers to build their own renewable energy sources on site to prevent new projects from further stressing energy infrastructure and creating more pollution.

Pritzker said something similar earlier this month: “If they are, in any way, going to increase the price of electricity for consumers, they should pay for that increase, not the consumers.”.

The data center companies oppose such mandates, preferring a voluntary “bring your own energy” policy, according to Brad Tietz, director of state policy for the Data Center Coalition industry group.

“I think, ultimately, when you try to mandate something, you get less of it,” he said.

States are competing to attract investments from companies that want to build more data centers as they seek an edge in the artificial intelligence race. Illinois has the fourth-largest number of data centers — 222 — in the country, but Tietz said the state is in danger of slipping because other states have friendlier policies.

Illinois has provided tax incentives for data centers since Pritzker signed bipartisan legislation in 2019. According to the state’s 2024 report, at least 27 data centers had received incentives totaling $983 million in estimated lifetime tax breaks and benefits. That would stop for at least two years under Pritzker’s plan.

Sen. Terri Bryant, R-Murphysboro, said she would like to see “a change in our policy here in Illinois” so the state does not fall behind, though she hopes those centers bring their own energy.

“We want to be able to do that because if we don’t, China will. If we don’t, Wisconsin will, Indiana will,” she said.

‘Little type of war’

As negotiations progress, the Data Center Coalition has signified another point of contention: A 2008 law known as the Biometric Information Privacy Act that prohibits private companies from

collecting personal data without informed consent. The law allows people to sue over the misuse of their biometric profile, such as fingerprint mapping, facial recognition and retina scans.

Stadelman said the privacy protections in the act, which Illinois put in place before any other state, are at the center of a “little type of war.”

“You have privacy rights advocates saying, ‘We’re a leader in the country as far as protecting people’s privacy rights and protecting their data,’” Stadelman said. “But the data (centers) say, ‘We’re not going to have more projects in Illinois unless you change the BIPA legislation.’”

Tietz said these regulations have factored into operators’ decisions to bypass Illinois, although lawmakers in 2024 drastically curtailed the way damages accrue and the liability private entities are likely to face if found in violation.

But the data center industry wasn’t satisfied, and its leaders say the legal liabilities are one reason they are building in other states.

Abe Scarr, state director of the Illinois Public Interest Research Group, said biometric information is uniquely sensitive.

“We should know who is collecting and commercializing information created from the stuff our lives are made of,” Scarr said. “And we should have to opt into — and be able to easily opt out of — pervasive, intrusive surveillance.”

Consumer backlash

The legislative debate comes as data centers have become increasingly controversial. In January, the Aurora City Council approved a moratorium pausing new data centers. The city had five data centers in development and had been receiving requests to build more even as residents and environmental groups complained about noise, water usage and rising utility costs.

Alison Lindburg, director of sustainability for Aurora, said the city passed the moratorium because it needed time to put requirements for data centers in place.

“We have tried to explain that to communities, that it’s not just about data centers in Aurora, it’s about the entire grid, but that doesn’t matter to them,” Lindburg said in an interview. “I think they’re just very frustrated overall with the rising electricity prices.”

Hannah Flath, Illinois Environmental Council’s climate communications director, said other communities are also opposing data centers.

“In that case (Aurora), the local government acted in accordance with what their

local constituents were saying,” Flath said. Tietz said he has been in conversations with officials from Aurora about the 180-day moratorium and is hoping he can help find a solution.

Lucy Contreras, GreenLatinos Illinois state program director, said communities should have a voice in whether, where and how these projects are built. She said developers must ensure host communities receive tangible benefits rather than bearing only the burdens of hosting these facilities.

“They contribute to air pollution and consume excessive amounts of water daily, which restrains local water systems that might already be struggling,” Contreras said. “Without strong and forceful regulations, data center expansion will deepen existing inequalities, harm public health and undermine our Illinois clean energy goals.”

Spreading the costs

Utilities are building billions of dollars of new power lines and plants to keep up with energy demand increases brought on by data centers — whether they’re built or in the process of being built. They, in turn, spread associated costs to ratepayers.

“Speculation about data center development has actually increased prices,” Sen. Bill Cunningham, D-Chicago, said. “It’s not just the immediate demand, it’s anticipated future demand, so it’s really important to sift out the wheat from the chaff on what’s a real proposal and what isn’t.”

Cunningham said he expects fellow Democratic lawmakers to work on safeguards for consumers when pending data center projects go uncompleted.

Recently, northern Illinois utility Commonwealth Edison announced it will require a 10-year guarantee of revenues upfront from big energy consumers. ComEd said this will help protect ratepayers from bearing the costs of high-load projects and ensure, even if they don’t come to fruition.

Maddie Wazowicz, Midwest Energy Efficiency Alliance policy director, said utilities function best when they can plan into the future.

“Whether or not data centers emerge — and how much, how many of them come, where and how long they last — does complicate utility long-term planning,” she said.
