State regulators once again flex muscle in rejecting utilities’ grid plans, lessening rate hikes Decisions continue shift at Illinois Commerce Commission toward tighter regulation of utilities By Andrew Adams

CHICAGO – The Illinois Commerce Commission on Thursday curtailed proposed rate hikes and rejected grid plans from two major electric utilities, mirroring a series of bombshell decisions rendered last month that cut increases for Illinois’ four largest gas utilities. The ICC rejected the pair of plans from Commonwealth Edison and Ameren Illinois that were meant to illustrate how the companies would comply with the state’s landmark climate legislation, the Climate and Equitable Jobs Act. Those plans would have laid out how the utilities plan to integrate with new renewable energy resources and meet decarbonization requirements while ensuring electric rates remain affordable for low-income communities. In rejecting the plans, regulators limited the companies’ proposed rate increases, meaning that next year’s impending increases will be significantly smaller than the utilities’ requests. ICC Chair Doug Scott said the plans had “significant shortcomings” and failed to meet the minimum standards set out by CEJA, including by failing to adequately address how the plans would benefit low-income communities. He also said the planning process lacked transparency among other criticisms. The companies now have three months to file updated plans, which will begin a new review process at the ICC. Consumer and environmental advocates praised the ICC’s decisions, saying they represent a continued, overdue shift toward tighter utility oversight. “This is not business as usual,” said Brad Klein, an attorney for the Environmental Law and Policy Center who argued in both cases. “This is really a very significant change in Illinois.” Klein also said the commission “sent a strong message” to utilities and other stakeholders that they would all be held accountable to the goals laid out in CEJA. Other advocacy groups, such as Illinois

News PIRG, the Union of Concerned Scientists and AARP Illinois, also commended the decisions. Sarah Moskowitz, head of the consumer advocacy group Citizens Utility Board, said she is “quite pleased” with Thursday’s outcome. CUB focused much of its arguments against the two cases on lowering the utilities’ proposed return on equity, or profit rate. While both companies requested a 10.5 percent return, the ICC approved an 8.905 percent return for ComEd and an 8.72 percent return for Ameren. While pleased, Moskowitz noted she was also surprised by the ICC’s recent decision making. “I’ve never seen this kind of action from the commission before,” Moskowitz said. While the profit rates for the two companies are now set, pending any potent ial appeals, key factors for rate-setting remain subject to change, based on the companies’ replacement grid plans. “Billions of dollars continue to be on the line,” Moskowitz said. Commissioner and former Illinois AFL-CIO President Michael Carrigan dissented in the decision – a rarity for the agency that mostly rules unanimously. In a written dissent, Carrigan said while he did not believe the plans were compliant with the state’s climate law, he thought that the commission could have modified, rather than rejected, the plans to bring them into compliance. “Based on comments made from the bench, we can say at this time that we are very disappointed with the outcome as described,” a ComEd spokesperson said in a statement released after the ICC announced its decision but before it issued its final order. Ameren’s Matthew Tomc, the head of the company’s regulatory affairs, was also “disappointed” by the decision and pushed back against the ICC’s characterization of the company’s grid plan. “Ameren Illinois’ plan was the result of a transparent two-year regulatory process with significant input from stakeholders, including the ICC’s own expert staff,” he said in a statement. “It meets the statutory requirements of the state’s Climate and Equitable Jobs Act.”

Tomc went on to say that Ameren’s now-rejected plan advanced the state’s clean energy goals. Representatives from both companies said they will review the full decision.

Peoples Gas’ failed request

In addition to the electric cases, the commission also revisited a gas rate case brought by Chicago’s Peoples Gas on Thursday. Earlier this month, the company requested clarification to part of the ICC’s November decision limiting their rate increase and placing a controversial infrastructure program on hold pending an ICC investigation. The company claimed the decision hampered their abilit y to conduct emergency repairs and requested the ICC increase the record rate increase it granted last month. But the commission rejected this request, instead finding it was procedurally improper and that the company has an “enduring responsibility” outlined in law to maintain system safety, according to the commission’s ruling. The company is “likely” to request a formal rehearing in the case, according to Peoples Gas spokesman David Schwartz. The now-rejected request was met with strong interest from Chicago-area unions and other groups. Illinois AFL-CIO President Tim Drea, a group of Chicago city council members, as well as representatives of several area businesses, sent letters to the commissioners sharing concerns about the proceeding. Scot t admon ished t he tact ic on Thursday and said these types of letters “frustrate the efforts of commissioners and commission staff to perform our duties.” Instead, Scott said, concerned groups should offer public comment online or in meetings. Love it or hate it, self-checkout is here to stay. But it’s going through a reckoning By Anne D’Innocenzio Associated Press

NEW YORK (AP) — The promise of self-checkout was alluring: Customers could avoid long lines by scanning and bagging their own items, workers could be freed of doing those monotonous tasks themselves and retailers could save on labor costs. All that has happened since the rollout of self-checkout but so has this: Customers griping about clunky technology that spits out mysterious error codes, workers having to stand around and monitor both humans and machines, and retailers contending with theft. “Going to the grocery store used to be simple, and now it’s frustrating,” said Cindy Whittington, 66, of Fairfax, Virginia. “You’re paying more. You’re working harder to pay for merchandise at their store. And it’s become an ordeal to check out. I should get a 5% discount.” In 2021, self-checkout usage represented 30% of transactions, almost double from 2018, according to a survey of retailers by FMI, an industry group. And 96% of retailers surveyed offer self-checkout. But the technology is also facing a reckoning amid the critical holiday shopping season. Some retailers are adding restrictions, while others are pulling out completely. This past fall, Walmart removed self-checkout kiosks in three stores in Albuquerque, New Mexico as part of a location by location approach, but on the whole it is adding more than it is taking away. To reduce wait times, Target is now limiting the number of items to 10 that shoppers can scan in a handful of stores nationwide. British supermarket chain Booths has been getting rid of its self-checkout at the majority of its stores for the past 18 months in reaction to customer backlash. A year ago, grocery chain Wegmans, citing “losses,” discontinued its self-checkout app that lets shoppers scan and bag items while they shop. However, it continues to offer self-checkout registers at its stores. Self-checkout, first tested in supermarkets in the late 1980s, gained momentum 20 years ago. But grocers ramped it up even more three years ago to address the pandemic-induced severe labor shortages. T he Bu r e au of L ab or St at i st ic s says technological advances such as self-checkout and online sales have been the main driver in the declining number

of cashier jobs, although there are no precise estimates on how many cashiers have been replaced by self-checkout. According to Labor Department data, there are about 1.2 million people currently working as cashiers, compared to 1.4 million in 2019 and the BLS expects the number to fall by another 10% over the next decade. “We are at an inflection point where if Americans are willing to do this and show an interest, then stores will probably expand it because they want to slash that labor cost,” said Christopher Andrews, associate professor and chair of sociology at Drew University and author of “The Overworked Consumer: Self-Checkouts, Supermarkets and the Do-It-Yourself Economy.” “But right now they’re just seeing downside. They’re seeing frustrated customers. They’re seeing increased costs and shoplifting.” Theft is indeed an issue. Andrews said a technology that relies on shoppers to do their own scanning and punch in product quantities tempts even law abiding citizens to be dishonest. It’s easy to just scan every other item or punch in codes for a cheaper item. Shoppers could also make honest mistakes, leading to losses for stores. John Catsimatidis, chairman and CEO of Red Apple Group, owner of Gristedes and D’Agostino’s food stores in New York City, said he has no interest in self-checkout because of theft. “Anybody who does it might as well hit your head over with a pipe,” he said. Still, self-checkout isn’t going away, especially with still stubborn labor shortages. And plenty of people love it. El len Wulf horst, 65, said using self-checkout brings back her childhood when she played with a toy register. “There’s something childish and fun about it,” Wulfhorst said. “I get a big kick out of sliding the product across the reader, and it goes beep. There’s a certain satisfaction to it.” For Robin Wissmann Doherty of South Salem, New York, who has a progressive neurodegenerative disease and uses a walker, self-checkout makes her shopping experience easier. The 67-year-old said she likes to shop at Stop & Shop because it has a “scan and go” technology that allows her to scan her items with a device as she shops and then tallies up her bill. She can either pay at a kiosk or at a manned register. “The laser gun works for disabled

people,” she said. Stew Leonard Jr., president and CEO of Stew Leonard’s, a supermarket chain that operates stores in Connecticut, New York and New Jersey, said 25% of its customers use self-service. That number could be up to 50% in the next few years. He noted one-third of its registers are unmanned, but he’s in a “holding pattern” and is thinking of limiting the number of items to be scanned. Retailers have been adding cameras or sensors at kiosks to monitor shoppers. Kroger, for example, has deployed artificial intelligence technology at a majority of stores that triggers alerts when something is amiss. For example, if a shopper fails to scan a particular item successfully, the system flags the error on the screen and prompts the customer to self-correct. If customers are unable to resolve the issue themselves, a light above the self-checkout blinks to attract workers’ attention. There have been inroads for more advanced technology. Amazon’s “just walkout technology” is in more than 70 Amazon-owned stores and more than 100 third-party retailers across the U.S., including airports. It uses sophisticated cameras and allows shoppers to enter the store with a credit or debit card or by simply hovering their palm over an Amazon One palm payment device, and then walk out without having to stand in line to check out. Japanese fashion retailer Uniqlo has RFID chips embedded in price tags to power a self-checkout system at its Fifth Avenue store in Manhattan, as part of a widescale rollout at its stores. Customers place their items in bins at self-service stations and pay — without having to scan items. Still, for some workers who were supposed to be liberated from the monotonous task of ringing up customers, the tedium just comes in a different form. Bernadette Christian, 59, a worker at Giant Food in Clinton, Maryland, mans six self-service stations at once, and she’s afraid to help or confront shoppers who she said have become angrier since the pandemic. “It would be easy for us to be cashiers, and it would be a lot more safer in today’s world,” she said. ______ Follow Anne D’Innocenzio: http:// twitter.com/ADInnocenzio

North Korea conducts first long-range missile test in months, likely firing a solid-fueled weapon BY HYUNG-JIN KIM AND MARI YAMAGUCHI ASSOCIATED PRESS

SEOUL, South Korea (AP) — North Korea on Monday conducted its first intercontinental ballistic missile test in five months, likely launching a developmental, more agile weapon, as it vows strong responses against U.S. and South Korean moves to boost their nuclear deterrence plans. T h e S o ut h K or e a n g o ve r n m e nt described the missile tested as a solid-fueled weapon, a likely reference to the North’s road-mobile Hwasong-18 ICBM whose built-in solid propellants make its launch more di�cult for adversaries to detect than liquid-fueled weapons. North Korean leader Kim Jong Un previously called the Hwasong-18 the most powerful weapon of his nuclear forces. South Korea’s military said the North Korean missile flew about 1,000 kilometers (620 miles) before landing in the waters between the Korean Peninsula and Japan. It said the missile was launched on an elevated angle, an apparent attempt to avoid neighboring countries. Japanese lawmaker Masahisa Sato, citing Japan’s Defense Ministry, said the missile rose as high as 6,000 kilometers (3,730 miles). The reported flight details matched those of North Korea’s second test of the Hwasong-18 missile in July. The North first test-fired the missile in April. Since 2017, North Korea has carried out a slew of ICBM tests in a bid to acquire the ability to launch nuclear strikes on the U.S. mainland. But all of its previous tests before April’s Hwasong-18 launch involved liquid-propellent ICBMs, which need to be fueled before launch and cannot stay fueled for long periods. U.S. national security adviser Jake Sullivan spoke with his South Korean and Japanese counterparts on the phone and condemned the North Korean launch as a violation of multiple U.N. Security Council resolutions that ban any ballistic activities by the North. South Korean President Yoon Suk Yeol separately ordered o�cials to maintain a solid South Korean-U.S. joint defense posture and respond “swiftly and overwhelmingly” to any North Korean provocations against South Korea. The North’s ICBM test was its second weapons firing in less than a day. On Sunday night, it launched a short-range ballistic missile designed to strike South Korea that also splashed in the water o�

its east coast, according to its neighbors. Obser vers said the back-to-back launches were likely to protest announcements by South Korea and the United States that they will bolster their joint nuclear deterrence capabilities in the face of North Korea’s evolving nuclear threats. Senior U.S. and South Korean o�cials met in Washington on Friday for their second Nuclear Consultative Group meeting. They agreed to update their nuclear deterrence and contingency strategies and incorporate nuclear operation scenarios in their combined military exercises next summer, according to o�cials in Seoul. The consultative body is responsible for sharing information on nuclear and strategic weapons operation plans and joint operations, though the U.S. will retain operational control of its nuclear weapons. U.S. o�cials said the group’s establishment and other steps to solidify U.S. security commitment were meant to ease South Korean worries about North Korean provocations while keeping Seoul from pursuing its own nuclear program. North Korea’s Defense Ministry on Sunday called its rivals’ decision to include nuclear operation scenarios in their joint drills an open threat to potentially use nuclear weapons against the North. It said any attempt by enemies to use military force against North Korea will be met with “a preemptive and deadly counteraction.” Park Won Gon, a professor at Seoul’s Ewha Womans University, said North Korea’s latest ICBM launch was seen as an e�ort to improve its military capability to attack the U.S. mainland because it views the South Korea-U.S. nuclear deterrence strategy as a security threat. Park said the launch was also likely designed to boost Kim Jong Un’s military credentials at home ahead of a key ruling party meeting next week as he appeared to lack economic achievements. Since last year, North Korea has performed about 100 ballistic missile tests in what experts say is an attempt to enlarge its arsenal and wrest greater U.S. concessions. The U.S. and South Korea have responded by expanding their military drills and increased the temporary deployments of strategic U.S. assets such as aircraft carriers, nuclear-capable bombers and a nuclear-armed submarine in and near South Korea. Du Hyeogn Cha, an analyst at Seoul’s Asan Institute for Policy Studies, said

North Korea is expected to continue weapons testing to pressure the U.S. to change its policy on the North. “No matter whether the Biden administration stays or steps out (of the White House) after the presidential election next year, North Korea will raise tensions on the Korean Peninsula to bring change of the U. S. government’s policy on it,” Cha said. A nimosities bet ween the Koreas further deepened after North Korea launched its first military reconnaissance satellite into space on Nov. 21 in violation of U.N. bans. South Korea, the U.S. and Japan strongly condemned it as an attempt by the North to improve its missile technology as well as establish a space-based surveillance system. The U.S., South Korea and Japan are pushing to put into operation the sharing

of real-time missile warning data on North Korea within days, South Korea’s Defense Ministry said Monday. Ministry o�cials said the three countries closely shared their information about Monday’s launch. Meeting with reporters in Tokyo, Adm. John Aquilino, commander of the U.S. Indo-Pacific Command, expressed concerns about North Korea’s increasing missile capabilities. But he said that the United States, Japan and South Korea are working more closely than ever and that they were even ready for Monday’s launch and had mobilized their missile defense ships forward earlier this week. “The fact that we were able to predict a launch and then posture forces in advance that was pretty, pretty impressive,” Aquilino said, adding that it was not the first time but hard to do.

Pruning fruit trees: Knowing your branches BY GRANT MCCARTY CONTRIBUTOR

As I’ve covered in previous weeks, now is the time to prune fruit trees. You have until March 1 to accomplish this task. Pruning fruit trees is truly an art and I always recommend taking photos before determining what needs to stay and what needs to be taken out. If your tree has not been pruned in some years, this can be intimidating. Yet there are great online guides that can walk you through the pruning process. The key to all of this is to know your branches. Your first step is to identify the three main types of branches: water sprouts, suckers, and deadwood. Water sprouts

are vigorous vertical shoots that grow from the main branches; they often need removal to redirect energy to more productive areas. Suckers, arising from the tree’s base, should be promptly eliminated to prevent them from sapping nutrients. Deadwood, as the name suggests, are lifeless branches that must be pruned to maintain overall tree health. Now, let’s focus on the specific limbs you need to remove for optimal apple tree growth. Start by targeting any diseased or damaged branches. These are not only unsightly but can also harbor pests and diseases. Use clean, sharp pruning tools to make precise cuts, minimizing stress on the tree.

Next, turn your attention to the crowded interior of the tree. One of your main goals is to bring sunlight into the tree and you want to identify branches that crisscross, rub against each other, or grow inwards. These limbs hinder proper air circulation, creating an environment conducive to diseases. By removing such branches, you promote a well-ventilated canopy and ensure that sunlight reaches all parts of the tree, fostering uniform fruit development. Consider the age of your apple tree when deciding which limbs to prune. Younger trees benefit from forming a strong sca�old structure (like a Christmas tree). These sca�olds are where your apples will develop. Remove competing central

leaders and encourage well-spaced lateral branches to establish a sturdy framework. On mature trees, focus on maintaining the balance bet ween fruit-bearing branches and vegetative growth. As you prune, be mindful of the 3 Ds: Dead, Diseased, and Dying. Remove these branches first to safeguard the tree’s overall health. Additionally, take into account the natural growth habit of the apple tree – aim for an open canopy to allow sunlight to reach the inner branches and promote fruit development. Further, your aim is 30-40% of branch removal each year. Your tree can only take so much pruning. Grant is the Local Food and Smalls Farms Educator of the University of Illinois Extension.

In Nate Hagens’ recent interview, billionaire fund manager and green investor Jeremy Grantham mentioned the potential use of naturally occurring hydrogen which is being discovered in various parts of the world. When consumed, hydrogen releases water as a waste product. The presence of naturally occurring hydrogen is still being explored; the amount available around

the globe remains unknown. It could serve a major role in the energy future. In agriculture, a small robot travels slowly across a field gathering half the available corn stubble and converting it at a high temperature to biochar which is known to support beneficial microorganisms, increase water retention and improve carbon retention in the soil. While cleaner energy options are being expanded, they alone cannot solve the myriad environmental and social problem documented by scientists. Given the range of environmental problems already documented, some scientists are describing it as a multi-faceted crisis caused by overshoot of planetary boundaries. Underlying questions regarding the energy transition are: who will own the new energy technologies; will their use serve the common good and include the environmental and social costs of their widespread use? Or not.

Our last article raised the issue of peak oil and the lack of an energy dense fuel to replace it in the global economy. The existing industrial society based on low cost dense energy supplies has left a damaged planet. We have been paying only the cost of fossil fuel extraction, not the environmental and social impacts of massive energy use. Industrial development has provided many benefits to the world’s populations but has failed to address the many problems it created. Generally, people are focused on staying alive and living comfortable lives while not adequately addressing the resulting damages and the need to redesign the economy to address environmental and societal impacts although we may solve the energy supply issue with new technologies. Placing a tax on carbon could raise the price of energy and

provide incentives to redirect society to address its excessive use. What is becoming the new energy systems is currently under development. A spirited advocacy of renewable energy recently appeared in an article by Kate S. Petersen in USA Today. She laid out four ways wind, solar and water can power the U.S. The transition to cleaner energy sources is seen as essential to reduce carbon emissions and curb global warming from the fossil fuel based electrical system. Illinois home owners are increasingly turning to solar power. According to the Solar Energy Industries Association, 12,600 new residential rooftop solar systems in northern Illinois were connected to the ComEd grid by November of this year. In central and southern Illinois an additional 6,900 residential rooftop systems were connected to the Ameren grid during the same period. Other energy sources are also being
