It’s projected to cost ComEd $3.1B to connect data centers to the grid By Maggie Dougherty

Capitol News Illinois mdougherty@capitolnewsillinois.com

CHICAGO — Data centers have been the focus of growing debate across the U.S., facing a push for regulation that would require operators to pay for the energy and water resources they use, among other proposals. But beyond paying to generate new energy, consumer advocates warn that the costs of infrastructure to connect data centers to ComEd’s grid will be paid in part by households and small businesses in northern Illinois — something the utility disputes. Records filed by ComEd in an ongoing regulatory matter show that new infrastructure and system upgrades needed to connect 30 data centers to the grid will cost $3.1 billion. Some of those projects are already connected, with the rest expected to come online by 2031. Developers of those data centers have paid $721 million in advance deposits, just under 25% of the total cost, an amount that consumer groups including the Citizens Utility Board and Environmental Law & Policy Center say could leave a potential shortfall of $2 billion to be spread across regular customers’ bills. “Ordinary households should not foot the bill to provide power to data centers,” said Nick Wallace, a senior associate attorney with the environmental law center. “ComEd and the (Illinois Commerce) Commission can protect ratepayers and the grid by requiring data centers to pay for 100% of their power supply and infrastructure investments.” ComEd contends that the consumer groups’ analysis overlooks $1.1 billion secured by lines of credit that guarantee rate payments from the data centers for 10 years.

Electricity delivery

The $3.1 billion in costs comes from two components of the electricity delivery system: transmission and distribution. Both include using poles and wires to move electricity from one place to another, but at different stages in the process. Transmission lines carry high-voltage electricity long distances along highways and across state lines from power plants to local substations where it can be reduced into lower-voltage electricity. Distribution lines then carry that

electricity to the homes and businesses that use it. The data center connection costs are split roughly equally, with $1.6 billion expected in transmission costs and $1.5 billion in distribution costs. The transmission costs for several individual projects each exceed $100 million, with one project alone expected to cost $289 million and another expected to cost $269 million. Max Leichtman, ComEd’s director of economic and workforce development, said only the distribution costs are an appropriate apples-to-apples comparison for the $721 million in deposits. Some of those projects won’t come online until 2030 or 2031 and are in early stages of development, so the full cost of equipment needed has not been calculated, he added. “The deposits that today stand at $721 million may continue to increase as these projects move forward and become more mature and more well-defined,” Leichtman said. “That doesn’t mean that’s all we’ll ever collect.” Leichtman said any remaining distribution costs would not be spread among all customers, but rather between similar types of customers in the large-user rate class. Consumer advocates, though, say the data center developers cannot be taken at their word to pay the bills. “These data centers are some of the wealthiest corporations in the world,” CUB spokesperson Jim Chilsen told reporters. “They always say, ‘Trust us, we’re going to pay our energy bills,’ but Illinois customers can’t afford to take big tech’s word for it.”

Reducing speculation

Hyperscale data centers’ requests for energy usage are often understood to be largely speculative. The massive projects — often operated by multibillion-dollar tech companies looking to compete in the race for artificial intelligence — sometimes place duplicate requests with different utilities, meaning some do not come to fruition. The projects have also faced growing opposition from local communities in recent years, causing many to withdraw. ComEd, in cooperation with Illinois and federal regulators, has sought to weed out speculative requests that drive up energy

demand prices by requiring deposits for large customers and requiring them to sign long-term contracts known as transmission security agreements, or TSAs, that require customers to provide a line of credit guaranteeing payment of transmission rates for 10 years, even if the project does not materialize. Regulators approved ComEd’s TSA requirement in 2025, meaning that projects after that point have them in place. Of the total $1.6 billion in planned transmission costs, ComEd has $1.1 billion protected through transmission security agreements. Nineteen of the 30 projects pre-date the TSA requirement. Implementing the TSAs has also resulted in “substantial attrition” of data center requests in ComEd’s queue, Leichtman said.

Payments now or later

Like many of the utility watchdogs, ComEd also endorses the idea that large-load customers like data centers should be directly allocated the cost of their projects. The electric utility has proposed a new approach in which it would directly assign rates to individual data centers based on their costs rather than assigning costs within groups. ComEd says that proposal, in combination with the TSAs and deposit requirements, shows it has been proactive in protecting customers. “We really believe that in totality, the suite of proposals that we put together are industry-leading,” Leichtman said. But unlike its watchdogs, ComEd does not think the data centers should be asked to pay for the infrastructure costs up front, which it said would make it difficult for those customers to do business in Illinois. Eric DeBellis, general counsel for CUB, agreed the TSAs are an improvement but said they would still leave a “substantial gap” that households and small businesses should not be left to pay. “We don’t want to pay for grid bridges to nowhere,” DeBellis said. “If they don’t have these up-front payments, then we’re left footing the bill for all of it.” Capitol News Illinois is a nonprofit, nonpartisan news service that distributes state government coverage to hundreds of news outlets statewide. DCFS director found in contempt for noncompliance with judge’s order By Ben Szalinski

Capitol News Illinois bszalinski@capitolnewsillinois.com

SPRINGFIELD — A Sangamon County judge held the director of the state’s child protective agency in contempt of court Thursday for the department’s ongoing mishandling of a records request by Capitol News Illinois. “I understand this is not a department with 10 employees. It’s a department with thousands of people who work there, but the buck stops at the director’s office,” Judge Jack Davis said Thursday in explaining his indirect civil contempt finding, a decision that found the agency director willfully violated a court order and allows remedies to ensure future compliance. Davis ruled Director Heidi Mueller’s Department of Children and Family Services violated his June 10 order requiring DCFS to release personnel records for two caseworkers involved in the death of Mackenzi Felmlee, and pay attorney costs, fees and a $5,000 civil penalty within 30 days. The order came after DCFS attorneys failed to appear at multiple hearings. Mueller took the witness stand on Thursday and blamed a long series of missteps by DCFS administrative employees for why the department failed to appear. She said she learned about the case the day after Capitol News Illinois reported on Davis’ Aug. 11 ruling that required her to appear in court and explain why the department was not following his June order. Davis said he was willing to give DCFS the “benefit of the doubt,” saying the failures that happened prior to Aug. 12 “can be classified, I think accurately, as ineptness and as incompetence, a lack of oversight, a lack of communication” — but not as “willful” contempt. But he also faulted the agency for failing to produce records within five days of learning of the court action and for still not having paid the civil penalties he ordered nearly 80 days after the director confirmed she learned of his order. “As of August 12, the buck had been sufficiently transferred up the chain of command to the desk where it stops,” he said, later adding that noncompliance after that point equates to “willful” contempt.

History of the case

The case dates back to March, when CNI sued the agency for erroneously denying its Freedom of Information Act request by

citing, among other points of denial, that the news organization’s records request had not requested records. Springfield attorney Don Craven’s office, which is representing CNI, served DCFS with a summons on March 23, but the department did not respond to that lawsuit. That led CNI to file a motion for default judgment and to once again cause the agency to be served. Those documents were handled by an administrative assistant, but the agency said they were never properly logged or sent to DCFS’ legal team. Mueller said the initial summons was found on the desk of an administrative assistant at its Springfield office, where it sat for months. Her executive assistant, who died unexpectedly last fall, had been in charge of overseeing nonlawyer administrative staff, she said. The administrative team that took over the process didn’t handle it properly, Mueller testified, adding they’ve since put a new process in place. “I did not ignore it and my legal team didn’t ignore it. It was served on an administrative assistant who didn’t know, who didn’t handle it properly,” Mueller said. “There wasn’t an intentional attempt to ignore it.” Davis also grew annoyed with the department’s filing — or lack thereof — of a motion to vacate his June 10 order. Assistant Attorney General Jennifer Haas, who represented DCFS, filed the petition electronically after 5 p.m. Wednesday, arguing the agency complied with the order by releasing heavily redacted documents. But it never reached Davis’ desk until Thursday morning’s hearing, during which Haas handed him a copy. “It seems to kind of work in lockstep with the history of what the department has done by taking a laissez-faire approach,” Davis said. It’s at least the second time in the last five years a judge has found a DCFS director in contempt of court. In 2022, then-Director Marc Smith was assessed contempt charges after the agency failed to follow a Cook County judge’s order to place children discharged from psychiatric hospitals into appropriate care settings. Those charges were later overturned by an appellate court. Gov. JB Pritzker stuck by Smith until Smith resigned in October 2023. Mueller was appointed in early 2024. “The core of the legal matter – which was the release of documents – was completed by DCFS on September 3, 2026, and Director Mueller has the full confi-

dence of the Governor,” a spokesperson for Pritzker said in a statement.

Tardy records and payments

A s fo r t h e d e n i e d F r e e d o m o f Information Act request, Mueller said that a staff member filling in for the department’s FOIA officer, who was at a conference at the time, sent a template response to CNI denying the records request. “We had previously created an electronic system with dropdowns to help us manage the huge volume of FOIA requests that we get,” she said. “She clicked the wrong dropdown and it produced automatically a letter that was incorrect.” Mueller acknowledged that was a mistake and the department should’ve produced the records. DCFS produced the records in early September, months after the initial request, with heavy redactions, though state law and the judge’s order require FOIA requests to be fulfilled within five business days. Haas said the FOIA officer was dealing with a medical issue in August, which caused the delay in responding once the department learned of the lawsuit. “You don’t get to just say ‘oops,’” Craven told Davis on why the late-arriving documents proved willful contempt. Craven said the case is the “epitome of bad faith” by DCFS. Mueller also said DCFS intends to pay the court-ordered fines and fees, which it has not, leading Davis to ask why DCFS is “picking and choosing” which parts of the order it has followed thus far. Haas said she believed she was negotiating the fees with Craven, sending a settlement offer that the news organization ultimately denied in mid-October.

Davis set a 30-day deadline for DCFS to comply with the records request and court-ordered fines and fees. The next hearing is scheduled for Dec. 4 to determine whether the contempt charge will be purged. The judge granted Capitol News Illinois’ Thursday motion to amend its initial request to receive further documents regarding Felmlee’s care.

Mackenzi Felmlee’s care

CNI requested the documents while trying to learn more about the care Felmlee, 18, received before she was found dead in her Fairview Heights foster home in May 2024. Her foster mother, Shemeka Williams, and foster grandmother, Cornelia Reid, are charged with murder in connection with Mackenzi’s death. Both are being held in the St. Clair County Jail. Williams was licensed through Lutheran Child and Family Services, a nonprofit agency that provides foster care services on contract for DCFS. According to a timeline of the incident released by DCFS, Williams purportedly told an LCFS caseworker during an in-person visit that Mackenzi was “struggling” two days before her death. The caseworker, however, did not document that conversation until five days after Mackenzi’s death. LCFS later reported the visit was made by phone, not in person. Where things stand on Iran after tense weekend as its delegation has left Qatar By Cara Anna

Associated Press

JERUSALEM (AP) — The Middle East is bracing for a possible return to all-out war amid concerns that the United States and Israel could strike Iran shortly after Tuesday’s U.S. midterm elections. A regional official briefed on the talks said an Iranian delegation left Qatar on Sunday after negotiations aimed at reaching a deal to end the war. A draft proposal has been circulated for feedback, and a follow-up meeting is under discussion. The official spoke on condition of anonymity because of the sensitivity of the talks. Iran has expanded its threats but says it is awaiting the latest U.S. response. The latest proposal Iran has publicly discussed would fully reopen the Strait of Hormuz to shipping within two days if Washington meets several conditions, including lifting its blockade of Iranian ports. Here’s where things currently stand.

Netanyahu

U.S. President Donald Trump on Sunday evening told reporters he and Israeli Prime Minister Benjamin Netanyahu had a “very good” call on Saturday. He said they discussed Iran but gave no details. Even before Netanyahu and his bloc of allies lost their majority in parliament in last week’s election, there were growing fears that Netanyahu was pushing for new strikes against Iran in an effort to stay in power in an emergency government during renewed war. Since last Tuesday’s election, the prime minister has publicly commented only on the vote. There was no word from Netanyahu and his office on the latest call with Trump, who has continued to alternate between public comments about pursuing talks with Iran and threats to strike it hard. “The standoff in the Gulf between the U.S. and Iran is really between Qatar and Israel,” Andreas Krieg, a professor at King’s College London, said on X. “Qatar is tirelessly working on a diplomatic offramp with the region’s backing while Israel is looking for military ways to throw the region under the bus.”

Iran broadens threats while pursuing diplomacy

The Islamic Republic has stepped up its public messaging during the uncertainty, saying it is ready for both diplomacy and renewed fighting.

The new supreme leader, Ayatollah Mojtaba Khamenei, met with Iran’s military chiefs and said the response to “any kind and level of threat” from the U.S. or Israel should be immediate and without “geographic limits,” and urged an expansion of the list of potential targets. Khamenei still has not been seen publicly since the opening strikes by Israel and the U.S. on Feb. 28 killed his father, the previous supreme leader. Iran’s security chief, Mohsen Rezaei, warned on X that any attack would bring “devastating blows on the aggressor using new weapons.” In an interview with state television, Rezaei said “the tone has completely changed” from the U.S. and called it a “very good sign.” He gave no details about the letter he received from U.S. Vice President JD Vance, which Iran acknowledged last week, and said he had not responded. Rezaei also said no decision had been made to change Iran’s nuclear doctrine, though some Iranians had questioned whether it should change if the country were attacked again. Tehran has insisted its nuclear program is peaceful. Washington seeks to prevent Iran from obtaining a nuclear weapon and wants to address the issue in any new talks. Iran wants to discuss it later. Ira n ia n Foreig n M i n ister A bbas Araghchi, who was on a one-day visit to neighboring Turkmenistan on Monday, has said the final outcome depends on U.S. answers to the “Iranian questions.”

Middle East is caught in the middle and China offers help

More attacks on commercial ships were

reported on the Strait of Hormuz during October, in the busiest month for reported assaults since March, during the war’s opening weeks. The mood was grim at the Manama Dialogue, an annual security summit in Bahrain organized by the International Institute for Strategic Studies. United Arab Emirates presidential adviser Anwar Gargash told attendees that “the rules of logic” show the U.S. and Iranian stances are far apart, and “if these positions are not bridged, then we have to worry about the worst.” Gulf nations have spent billions of dollars to boost their defense capabilities since the war began. Egypt’s Foreign Minister Badr Abdelatty told the gathering in Bahrain that the next escalation “will be more dangerous, more destructive, and it will lead to nowhere.” Russian Foreign Ministry spokesperson Maria Zakharova described reports of possible new strikes against Iran as “alarming.” Meanwhile, China will send a special envoy to Iran, Oman and Saudi Arabia in early to mid-November, Foreign Ministry spokesperson Mao Ning told reporters Monday. Chinese Foreign Minister Wang Yi also met with Ali Bagheri Kani, deputy secretary of Iran’s Supreme National Security Council. “The Middle East Gulf region should not become an arena for great-power rivalry and geopolitical conflict,” Chinese President Xi Jinping told Oman’s sultan, according to a readout from China’s Foreign Ministry. China and Oman called for a return to dialogue.

Health Insurance

What to know about the Affordable Care Act’s open enrollment period now underway By Fatima Hussein Associated Press

WASHINGTON (AP) — People heading into the Affordable Care Act open enrollment period with plans to sign up for insurance should expect a variety of changes in 2027, including higher premiums and fewer coverage options. The sign-up window for the marketplace, also known as Obamacare, starts Sunday in most states and runs through Jan. 15. Big changes to the exchange include expiring financial assistance, rising rates, potential delays in working with a broker, new restrictions on immigrants, and stricter enrollment checks. Financial help, including premium tax credits and cost-sharing reductions, is now restricted for many groups of people who were previously eligible. Across the board, healthcare experts predict less coverage and higher prices, with the average price of health insurance purchased through the marketplaces expected to rise by 13% in 2027, according to

analysis of new CMS data by the healthcare research nonprofit KFF.

Increases are driven by multiple factors

Cynthia Cox, a vice president and director of the ACA program at KFF, said the increase is primarily driven by rising healthcare costs, hospital market concentration, and potential factors such as the No Surprises Act, which took effect in 2022 and bans surprise billing, or the rising availability of GLP-1 drugs. The people who will be most affected by the new increases are those who do not qualify for a subsidy. “They may or may not be able to afford to continue to keep their coverage into next year,” Cox said, adding that “a lot of them have already moved into bronze plans, which are the cheapest plans.” A CMS fact sheet about open enrollment that was distributed Friday says “Americans using HealthCare.gov will have robust access to low-cost plans.” The price of ACA insurance has skyrock-

eted for many people during Trump’s second term after Republicans opposed extending COVID-era subsidies that had helped offset the costs of health insurance for most enrollees during Democratic President Joe Biden’s administration. That resulted in 1.2 million fewer people signing up for coverage in the exchanges.

uals over time. Meanwhile, the Trump administration has been removing ACA enrollees from the program as part of the ongoing campaign against what it characterizes as waste, fraud and abuse. In September, Vice President JD Vance and other officials in the Republican administration announced plans to remove 760,000 ACA enrollees from public healthcare exchanges, alleging the individuals were fraudulently enrolled in the program or simply did not exist. Vance said the discovery and canceled subsidy payments for hundreds of thousands of people from the exchanges, part of an administration-wide crackdown on fraud, would result in $2.2 billion in cost savings. It’s unclear how many more people will drop off of ACA coverage in 2027, Cox said. But with higher premiums, immigration eligibility changes and the anti-fraud efforts, “I think there’s going to be fewer people enrolled in this market, but it’s going to be harder to understand why.”

Nearly 20 million people in US are actively enrolled in ACA plans

As of February, roughly 19.2 million people in the United States were actively enrolled in ACA marketplace health plans, according to the Department of Health and Human Services website. The number of enrollees grew during the COVID-19 pandemic when enhanced subsidies became available through the American Rescue Plan Act and Inflation Reduction Act, both signed into law by Biden. New regulations starting in 2027 will also limit tax credits for certain lawfully present immigrants, which could result in an additional 1 million uninsured individ-

Three November tasks for the vegetable garden By Grant McCarty Contributor

With potentially sunny and tolerable days in November, you might still be working outside, managing your leaves and putting away outdoor furniture. There are some garden tasks that you can still do that are good practices to close out your 2026 garden season and prepare for 2027. Of course, some of these tasks are ones that you do not need to do every year. Compost or manure could be added to your vegetable garden. In fact, If the manure is raw, we would recommend you apply it in the fall for it to overwinter and age. Compost and manure are fairly

equal in what they do to your soil and are considered good additions to address problems that you may be encountering in the growing season. If you were to add a lot of manure and compost in the fall, then you would want to reduce how much you add in the spring. Still, you could wait until the spring to add finished compost and aged manure if you so choose. The fall is also a good time to get a soil test. Soil tests are conducted in the fall as they can sometimes be more accurate in what your soil is telling you. It can also take 3-6 months to raise or lower your soil pH, a measurement that can limit your plants productivity. A standard soil test

will tell your soil pH, soil nutrients, and organic matter. We usually recommend a soil test every 3-5 years. The University of Illinois Extension maintains a website with a list of soil testing labs that you can contact for further information: extension.illinois.edu/soil One of the other recommendations is to clean your tomato cages, pruners, stakes, and any other hand tools you plan to store back between seasons. These tools, with dried soil and plant material, can sometimes harbor the pathogens that cause disease and bring them into next season when you use them. Try to scrub these materials with soap and then

clean with rubbing alcohol/wipes. Let the tools dry and then store back. There are some wonderful guides online for how to clean and sharpen your pruners, a tool that could benefit greatly from a good sharpening. Of course, I find when I do this that I come up with tools that I want to buy/replace. These three tasks can still be accomplished in the next month and if you do not get around to them, you’ve got the spring to do many of them before planting. Grant is the Local Food and Smalls Farms Educator of the University of Illinois Extension.

Can AI enable us to escape the limits to growth By Dr. Robert Vogl, Ph.D.

Illinois Renewable Energy Association Contributor

This past July Illinois passed the A r t i f ic ia l Intel l igence a nd Sa fet y Measures Act which require large AI developers to publish a framework for assessing catastrophic risks and undergo mandatory annual third-party audits to ensure compliance with safety and transparency standards. The legislation is similar to acts passed in California and New York. Capital News Illinois described the combined actions by the three states as effectively establishing a de facto national standard in lieu of federal regulations. Given the immense impact of the push for AI data centers across the economy and the strong public opposition to them in many communities based on their potential adverse consequences it is likely to remain a public issue for many years. The Illinois law includes the nations first requirement of an annual independent third party audits. Firms prefer to keep control over information which could involve legal and competitive consequences for the firms being subject

to government regulations. The public wants protection from the potential harmful impacts on their interests from actions taken by firms as they pursue their corporate goals. A recent video by NPR under the column Machine Guide takes a closer look at one firm’s effort to employ a third party to provide them with a safety analysis of their AI model. The video is based on an interview of two third party analyst hired by Open AI to provide the firm with an analysis of the firm’s AI model regarding safety concerns involved in its use. A leak occurred of sensitive firm information that reached the news media and the two fired analysts denied any involvement in the release of the information. AI acknowledged that its agents were involved in the leaks after the firm Hugging Face acknowledged the leaks and notified the FBI. Open AI indicated it has taken corrective actions. The incident issue illustrates the sensitive nature involved in bringing in outsiders to assess a firm’s handling of its sensitive information. Some government regulations do involve using the services

of outside interests that serve the public interest. A basic question regarding such leaks is who benefits from them. Beyond the limited clarity on the Hugging Face leaks Nate Hagens posted a long list of 20 concerns regarding the rapid expansion of data centers across the country and around the globe. He sees the overall impact of AI’s use on the economy as an upgrade as it starts from using intelligence as the first input required for all other inputs. He points to the consumption of fossil fuels as being equivalent to an army of five hundred billion fossil workers as supporting the global population of 8 billion people. And we are in the midst of fueling and building a second army built on brains and minds and not muscle consisting of trillions of cognitive workers tireless, cheap and getting smarter and injecting itself into our civilization. What was built with the first army based on fossil fuels turned out to be a cage limiting growth on our finite planet. He envisions AI as a promise to escape from the limits to growth on a finite planet. Yet he reminds us that the AI boom that will require a massive amount

of energy and materials. He goes on to remind us that transformers and gas turbines are already on long waiting lists. Water supplies are being drawn down where supplies are already in decline. Copper demand is rising as the grade of the ore is declining while chips get replaced on a four year cycle with improved efficiency which ends up adding to the electronic waste stream. He suggests that we will end up with the same questions that limited the fossil fuel economy. What surplus is left for everyone else, and for whom and who gets to decide? The reason for the AI transition is to make everything more efficient and cheaper and yet it involves a much higher demand on the environment. Hagens points at two centuries of evidence that more productivity and cheaper AI does not mean we consume less. Whatever AI saves it is spent on something else. He goes on to list other reasons to be concerned about AI and promises to expand on them in subsequent presentations which will include references. Hagen’s views cited in this article can be found at the Great Simplification site #161; Humanity’s Icarus Moment: The wings, the sea, the sun.

Baker, Bochy, Maddon and Piniella among 8 men on Hall of Fame contemporary era committee ballot Associated Press

COOPERSTOWN, N.Y. (AP) — Retired managers Dusty Baker, Bruce Bochy, Joe Maddon and Lou Piniella are among eight men on the ballot for the Hall of Fame’s contemporary era committee for managers, executives and umpires that meets on Dec. 6 at the winter meetings in San Diego. Former general managers Sandy Alderson and Brian Sabean also are on the ballot along with the late Atlanta Braves owner Ted Turner and former player, broadcaster and National League President Bill White, the Hall announced Monday. The identities of the 16 voters will be announced closer to the meeting, and 75% of the vote is needed for election. Anyone chosen will be inducted into the Hall next July 25 along with players voted in by the

Baseball Writers’ Association of America, whose balloting will be announced on Jan. 19. Piniella received 11 votes in 2023, when Jim Leyland was elected, and 11 in 2018, when Harold Baines and Lee Smith were voted by the today’s game era committee. The Hall in 2022 restructured its veterans committees for the third time in 12 years, setting up panels to consider the contemporary baseball era from 1980 on and classic baseball era from before 1980. The contemporary baseball era holds separate ballots for players and another for managers, executives and umpires. Baker, 77, was a two-time All-Star outfielder who hit .278 with 242 homers and 1,013 RBIs for the Los Angeles Dodgers, Atlanta, the Oakland Athletics and San Francisco Giants from 1968-86, then managed the Giants (1993-2002),
