Illinois House Speaker’s staff could test limits of Workers’ Rights Amendment

Labor expert says it could be a hard legal argument to make

SPRINGFIELD – Efforts to form a union by staff in House Speaker Emanuel “Chris” Welch’s office could provide an early and unexpected test of the new Workers’ Rights Amendment to the Illinois Constitution.

Brady Burden, a staffer in the speaker’s office who is part of the organizing committee of the Illinois Legislative Staff Association, said efforts to unionize have thus far been stymied by a provision in state law that specifically exempts the General Assembly from the Illinois Public Labor Relations Act.

But there is no such exemption in the Workers’ Rights Amendment, approved by voters less than a year ago. That addition to the state’s constitution provides, in part, that all employees have a “fundamental right” to organize and engage in collective bargaining over wages, hours and working conditions.

But at least one expert in Illinois labor law says relying on that amendment may be more difficult legally for the workers than it might first appear.

“Anytime this (constitutional amendment) is going to be litigated, if ever, it’s going to require some degree of interpretation. It just will because it’s just not clear,” said Michael LeRoy, a professor at the University of Illinois College of Law and the School of Labor and Employment Relations. “It’s not exactly clear what this means.”

According to Burden, efforts to form a union began last year but they did not go public with their campaign until May. He said well over half of the 38 employees who would be part of the bargaining unit – analysts, researchers and people who work with legislators – have signed a petition calling to form a union, which would be enough for automatic recognition by most other public employers.

Among the issues they’d like to negotiate, Burden said, are wages and hours. He said the starting salary for Democratic House staffers is around $43,000 annually, which he said is significantly lower than comparable jobs in the Senate or even for House Republican staff. He also said they would like better compensation for overtime.

Legislative staff jobs are exempt from wage and hour laws, so those workers do not receive the standard time-and-a-half when they work more than 40 hours in a week – which they do routinely during legislative sessions. Instead, Burden said, they receive roughly one hour of comp time for every three hours of overtime they work.

But because current law specifically exempts the General Assembly from the definition of a “public employer,” Burden said they are asking Welch to recognize their union voluntarily.

Welch’s office, however, has said he prefers they hold an election because recognizing the union voluntarily would deny staff the chance to weigh in on which organization they’d like to represent them.

Burden said that can’t be done because of the exemption in current state law,

leaving them with the options of voluntary recognition or a lawsuit.

“It’s in the Constitution. We have a right to organize,” Burden said. “The only issue that we need, is that the speaker recognize the union.”

LeRoy, however, said the Worker’s Rights Amendment is actually vague on that issue because it’s written in prospective terms, referring to future enactments by the state or local governments.

He said that although the first sentence of the amendment says employees have a fundamental right to organize, the next sentence says, “No law shall be passed that interferes with, negates, or diminishes” collective bargaining rights.

“They use the term ‘shall be.’ That’s future tense,” he said. “It doesn’t reach back. It doesn’t say any law that has been enacted that interferes with collective bargaining is hereby nullified. It doesn’t say that.”

LeRoy said the purpose of the amendment was to prevent the enactment of so-called “right-to-work” laws at either the state or local level. Those are laws that say employers cannot require someone to be a member of a union as a condition of employment.

“This constitutional amendment really grew out of the experience with (former Republican) Gov. Bruce Rauner, who really wanted to make Illinois a right-to-work state,” he said. “That was a Democratic reaction to, or response to, (Rauner).”

LeRoy said that from a legal standpoint, he believes the Workers’ Rights Amendment is not a convincing argument for those trying to form a union. But he added, “Politically, it is very convincing.”

“I mean, in effect, this is really calling out the Democratic-controlled General Assembly as a group of hypocrites,” he said. “You’re legislating for thee, not me. And I think in the court of public opinion, that’s where this battle can be waged with a better chance of success.”

Centuries after Native American remains were dug up, a new law returns them for reburial in Illinois

SPRINGFIELD, Ill. (AP) — For centuries, Europeans carving up the prairie to suit their own idea of settlement dug up the graves of Native Americans as they conquered lands and pushed tribes to the West.

Now, Native Americans whose ancestors’ remains ended up held for study in sterile, nondescript boxes on shelves in educational facilities or displayed in cultural locales hope a new Illinois law will speed their recovery for proper reburial in their homeland.

“I always have a bit of unease because I know if I’m going to a university or to a museum ... that chances are pretty high that we’ve got some ancestors sitting in a basement or in a closet somewhere,” said Raphael Wahwassuck, tribal preservation officer for the Prairie Band Potawatomi Nation in Mayetta, Kansas. “I hope that this (law) will help ease those concerns, knowing that we are working on correcting that and taking care of our ancestors to put them in a good resting place.”

Illinois Gov. J.B. Pritzker signed The Human Remains Protection Act last month, which updates a rudimentary 1989 state statute. It also complements a federal law adopted a year later, the Native American Graves Protection and Repatriation Act. It requires the return of human remains and funerary, sacred and cultural objects unearthed in the past 200 years by plows and bulldozers, by archeologists, or by profiteering marauders to the associated tribe.

Key to the measure is first-time authority for tribes to rebury recovered remains in Illinois, which they much prefer to relocating them to states to which the U.S. government forced their relocation nearly two centuries ago.

The Illinois State Museum, which holds remains from about 7,000 individuals, is prepared to reunify 1,100 of them with their tribes, according to Brooke Morgan, the museum’s curator of anthropology. Overall, institutions in Illinois can identify nearly 13,000 individuals that must be repatriated.

state, from Chicago’s Field Museum to Southern Illinois University, as well as the state museum.

Illinois is the nation’s fifth-largest repository of human remains, according to the National Park Service, which administers the repatriation program. And large numbers of remains recovered from Illinois are held by institutions in other states. Nationally, the remains of nearly 209,000 individuals have been reported to the federal government and must be surrendered to descendants.

Information about past cultures and lives lived gleaned from anthropologists’ study of the remains is not without merit, Morgan said, but research must be “ethically informed.”

“While there’s a lot that can be learned, it’s not it’s not without consequences or outcomes that could be damaging to modern communities,” Morgan said.

The law also toughens monetary penalties, including required restitution, for disturbing human remains and items buried with them or for displays — something the Illinois State Museum did at Dickson Mounds in Lewistown, 200 miles (322 kilometers) southwest of Chicago, before disbanding the feature in 1992.

While repatriation in Illinois during the federal law’s first three decades has been sluggish, at best, in 2020, the late Cinnamon Catlin-Legutko, the museum’s director, pushed her staff to gauge interest with Native American tribes in repatriating the Dickson Mounds holdings.

Now, the museum is on the cusp of returning the remains of 1,100 individuals from Dickson Mounds to 10 tribes whose ancestors were laid to rest there, Morgan said. The process has wrought stronger relationships with affected tribes, which could could prove critical as the new state law requires consultation — meaningful dialog among holding institutions and tribes about handling and transferring remains — rather than simple notification.

“It can be emotionally taxing. It can be really traumatic to learn about how their ancestors have been studied or how they’ve been housed or how they’ve been cared for or not cared for,” Morgan said.

What scholars now call a period of ethnic cleansing began with President

Andrew Jackson’s signature on the Indian Removal Act of 1830. It forced indigenous people to move west of the Mississippi River, clearing the eastern United States for white settlers, particularly for expansive cotton cultivation in the south.

Prior to the new law, “repatriation” meant turning remains over to tribes who had little choice but to take them back to the states to which they were forcibly removed.

“The tribes that I talked to — one, specifically, the Cherokee of Oklahoma — said, that is like recreating the Trail of Tears,” said the legislation’s sponsor, Rep. Mark Walker, a Democrat from the Chicago suburb of Arlington Heights. He was referring to the 1838-39 westward death march which claimed the lives of 4,000 Cherokee.

Walker said the Cherokee told him, “’Our ancestors were buried where our ancestors wanted to be buried. And now you’ve dug up their bones and you’re going to bring them to where we were forced to go.”

Walker said negotiators have compiled a list of 30 potential sites for burial. Tribes will ultimately choose which sites will be used.

Matthew Bussler, tribal historic preservation officer for the Pokagon Band of Potawatomi in Dowagiac, Michigan, said the practice and ceremony of final rites differs by tribe. Generally, he said, it is critical to see that ancestors are returned “to the womb of Mother Earth” not only so they may continue their journey in the hereafter, but to “redeem all of the pain and the suffering” of their tribe, especially their descendants.

There are costs associated with repatriation, of course, for the tribes as well as the state. The law provides money for travel and other expenses the tribes incur. The account is partially funded by fines for desecrating burial grounds, including for the first time, restitution to cover collecting, cleaning and reburying remains illegally taken, just as other remains before them had been for centuries.

“Those human remains were never treated as human beings...,” Bussler said. “Those who had been deceased for hundreds of years who are just being found, or your grandmother who just passed away — we need to treat them all with utmost respect.”

US-Iran Prisoner Exchange

5 prisoners freed in US swap with Iran, arrive in Qatar

DOHA, Qatar (AP) — Five prisoners sought by the U.S. in a swap with Iran were freed Monday and headed home as part of a deal that saw nearly $6 billion in Iranian assets unfrozen.

Despite the deal, tensions are almost certain to remain high between the U.S. and Iran, which are locked in various disputes, including over Tehran’s nuclear program. Iran says the program is peaceful, but it now enriches uranium closer than ever to weapons-grade levels.

The planned exchange has unfolded amid a major American military buildup in the Persian Gulf, with the possibility of U.S. troops boarding and guarding commercial ships in the Strait of Hormuz, through which 20% of all oil shipments pass.

“Today, five innocent Americans who were imprisoned in Iran are finally coming home,” President Joe Biden said in a statement released as the plane carrying the group from Tehran landed in Doha, Qatar.

After the plane slowed to a stop, three of the prisoners walked down the ramp and were greeted by the U.S. ambassador to Qatar, Timmy Davis. The former prisoners hugged the ambassador and others.

The three — Siamak Namazi, Emad Sharghi and Morad Tahbaz — then wrapped their arms around their shoulders and walked off to a building in the airport.

In a statement issued on his behalf, Namazi said: “I would not be free today, if it wasn’t for all of you who didn’t allow the world to forget me.”

“Thank you for being my voice when I could not speak for myself and for making sure I was heard when I mustered the strength to scream from behind the impenetrable walls of Evin Prison,” Namazi said.

In addition to the five freed Americans, two U.S. family members flew out of Tehran, according to a senior Biden administration official, who spoke on condition of anonymity when the exchange was ongoing.

Earlier, Iranian Foreign Ministry spokesman Nasser Kanaani said the exchange would take place Monday after nearly $6 billion in once-frozen Iranian assets reached Qatar.

“Fortunately Iran’s frozen assets in South Korea were released and God willing today the assets will start to be fully controlled by the government and

the nation,” Kanaani said.

“On the subject of the prisoner swap, it will happen today and five prisoners, citizens of the Islamic Republic, will be released from the prisons in the U.S.,” he added. “Five imprisoned citizens who were in Iran will be given to the U.S. side.”

He said two of the Iranian prisoners will stay in the U.S. Meanwhile, Nour News, a website believed to be close to Iran’s security apparatus, said two of the Iranian prisoners had arrived in Doha for the swap.

Mohammad Reza Farzin, Iran’s Central Bank chief, later came on state television to acknowledge the receipt of over 5.5 billion euros — $5.9 billion — in accounts in Qatar. Months ago, Iran had anticipated getting as much as $7 billion.

The planned exchange comes ahead of the convening of world leaders at the U.N. General Assembly this week in New York, where Iran’s hard-line President Ebrahim Raisi will speak.

The deal has already opened Biden to fresh criticism from Republicans and others who say the administration is helping boost the Iranian economy at a time when Iran poses a growing threat to American troops and Mideast allies. That could have implications in his reelection campaign as well.

In his statement, Biden urged Americans not to travel to Iran, and he demanded more information on what happened to Bob Levinson, an American who went missing years ago. Biden also announced sanctions on former Iranian President Mahmoud Ahmadinejad and the Iranian Ministry of Intelligence.

The prisoners freed Monday were: Namazi, who was detained in 2015 and was later sentenced to 10 years in prison on spying charges; Emad Sharghi, a venture capitalist sentenced to 10 years; and Morad Tahbaz, a British-American conservationist of Iranian descent who was arrested in 2018 and also received a 10-year sentence. All of their charges have been widely criticized by their families, activists and the U.S. government.

U.S. officials have declined to identify the two other released prisoners.

In a statement, Sharghi’s sister, Neda, said she “can’t wait to hug my brother and never let him go.”

“This is my brother, not an abstract policy,” she added. “We are talking about human lives. There is nothing partisan about saving the lives of innocent Americans and today should be a moment of American unity as we welcome them home.”

U.S. Secretary of State Antony Blinken thanked the Qataris, Swiss, South Koreans and Omanis for helping in the exchange, and pledged in a statement to keep pressing for “accountability for Iran and other regimes for the cruel practice of wrongful detention.”

The five prisoners Iran has said it seeks are mostly held over allegedly trying to export banned material to Iran, such as dual use electronics that can be used by a military.

The two that Nour News said were in Doha were: Mehrdad Ansari, an Iranian sentenced to 63 months in prison in 2021 for obtaining equipment that could be used in missiles, electronic warfare, nuclear weapons and other military gear, and Reza Sarhangpour Kafrani, an Iranian charged in 2021 over allegedly unlawfully exporting laboratory equipment to Iran.

The cash represents money South Korea owed Iran — but had not yet paid — for oil purchased before the U.S. imposed sanctions on such transactions in 2019.

The U.S. maintains that, once in Qatar, the money will be held in restricted accounts to be used only for humanitarian goods, such as medicine and food. Those transactions are currently allowed under American sanctions targeting the Islamic Republic over its advancing nuclear program.

Iranian government officials have largely concurred with that explanation, though some hard-liners have insisted, without providing evidence, that there would be no restrictions on how Tehran spends the money.

Iran and the U.S. have a history of prisoner swaps dating back to the 1979 U.S. Embassy takeover and hostage crisis following the Islamic Revolution. Their most recent major exchange happened in 2016, when Iran came to a deal with world powers to restrict its nuclear program in return for easing sanctions.

The West accuses Iran of using foreign prisoners — including those with dual nationality — as bargaining chips, an allegation Tehran rejects.

Negotiations over a major prisoner swap faltered after then-President Donald Trump unilaterally withdrew America from the nuclear deal in 2018. From the following year on, a series of attacks and ship seizures attributed to Iran have raised tensions.

Meanwhile, Iran’s nuclear program now enriches closer than ever to weapons-grade levels. While the head of the United Nations’ nuclear watchdog

has warned that Iran now has enough enriched uranium to produce “several” bombs, months more would likely be needed to build a weapon and potentially miniaturize it to put it on a missile — if Iran decided to pursue one.

Iran maintains its nuclear program is peaceful, and the U.S. intelligence community has kept its assessment that Iran is not pursuing an atomic bomb.

Iran has taken steps in recent months to settle some issues with the International Atomic Energy Agency. But the advances in its program have led to fears of a wider regional conflagration as Israel, itself a nuclear power, has said it would not allow Tehran to develop the bomb. Israel bombed both Iraq and Syria to stop their nuclear programs, giving the threat more weight. It also is suspected in carrying out a series of killings targeting Iran’s nuclear scientists.

Iran also supplies Russia with the bomb-carrying drones Moscow uses to target sites in Ukraine in its war on Kyiv, which remains another major dispute between Tehran and Washington.

Hollywood strikes enter a new phase as daytime shows like Drew Barrymore’s return despite pickets

NEW YORK (AP) — “The Drew Barrymore Show” will begin airing fresh episodes on Monday but a lot of off-air controversy will be clinging to its typically bubbly host.

Barrymore — a daughter of a proud acting dynasty — is making new batches of her syndicated talk show despite picketers outside her studio, as daytime TV becomes the latest battlefield in the ongoing Hollywood labor strife.

“We’re four months approximately into this strike and it’s not surprising that there are defectors,” said Michael H. LeRoy, a professor of labor and employment relations at the University of Illinois at Urbana-Champaign. “I couldn’t predict that this would happen on daytime TV, but everybody has a breaking point in a labor dispute.”

“The Drew Barrymore Show,” operating without its three union writers, isn’t the only daytime show to resume. “The View” has returned for its 27th season on

ABC, while “Tamron Hall” and “Live With Kelly and Ryan” — neither are governed by writers guild rules — have also been producing fresh episodes. “The Jennifer Hudson Show” and “The Talk” are also restarting Monday.

As long as the hosts and guests don’t discuss or promote work covered by television, theatrical or streaming contracts, they’re not technically breaking the strike. That’s because talk shows are covered under a separate contract — the so-called Network Code — from the one actors and writers are striking. The Network Code also covers reality TV, sports, morning news shows, soap operas and game shows.

“I know there is just nothing I can do that will make this OK to those that it is not OK with. The ongoing strike pits Writers Guild

of America and the Screen Actors GuildAmerican Federation of Television and Radio Artists against the Alliance of Motion Picture and Television Producers, which represents Disney, Netflix, Amazon and others.

The return of daytime hosts, producers and studio crews will make for some awkward exchanges, predicted Zayd Ayers Dohrn, a writer, professor and director of the MFA in Writing for Screen and Stage at Northwestern University.

“It’s kind of amazing that they’re going to go back to work with their own writers picketing outside the doors of the studios,” said Dohrn, a writers guild member. “They’re literally walking past the picket line of the workers who they say they’re supporting.”

Barrymore’s decision to return to the air was met with pushback on social media. “You have the heart and mind to be more tapped into the needs of the community than this,” wrote one viewer on Instagram. Another was more blunt: “You don’t get to play a generous and relatable character when it’s financially expedient for you and then scab when your pocketbook is at risk.”

Actor and activist Alyssa Milano, whose friendship with Barrymore stretches back years, also criticized the return, calling it “not a great move.”

“I love her very much — I grew up with her — but I’m not sure that this was the right move for the strike. I’m sure in her eyes it’s the right move for her and the show, but as far as the WGA and SAG and union strong — not a great move.”

Barrymore’s stance was also met with some puzzlement since she walked away as host of the MTV Movie & TV Awards in May, the first big awards show to air during the strike. Back then, she wrote: “I have listened to the writers, and in order to truly respect them, I will pivot from hosting the MTV Movie & TV Awards live in solidarity with the strike.”

Pumpkin and gourd options

Pumpkin season is upon us in Northern Illinois. In the next couple of weeks, you should be able to find pumpkins and gourds available at your local pumpkin patch and even many of the orchards in our area. For the most part, the pumpkin season has been fairly good if you were able to supplement with watering during the dry periods we encountered.

As you see a multitude of pumpkins, gourds, and squash, you may be wondering what the main di�erences are. In general, there are not any di�erences other than color, texture, shape, and use.

All are members of the cucurbit family with similar growing characteristics. Some are more suited for long term storage as more of a winter squash or gourd. Typically, we call pumpkins any squash that has the orange color. From there, some pumpkins are better for eating known as a pie pumpkin. Pie pumpkins are the traditional orange color but are smaller in size.

Some of the gourds you use as display are good eating gourds with flesh that can be used just as you would pumpkins. “Rouge Vif d’Estampes”, “Long Island Cheese”, and “Jarrahdale” are all commonly found as decorative display

but are good eating gourds. While these gourds have traditional round shape, they are flatter. The color varies among these three with “Jarrahdale” being blue-green and “Rouge Vif d’Estampes” is orangered. Like it’s name denotes, “Long Island Cheese” is shaped like a cheese wheel with a tan-orange color.

Acorn and butternut squash are available this time of year too. These are similar to summer squash but they develop a hard outer shell that allows them to be stored for a period of time. Both acorn and butternut should be stored in a cooler area of your home away from heat. Depending on how these are stored, they could last

Widespread tree mortality

We are accustomed to concerns expressed regarding destruction of the Amazon rainforest, often called the lungs of the world since trees take up carbon dioxide and release oxygen to the atmosphere. In addition to their role in sequestering carbon, they release a substantial amount of moisture into the atmosphere which later falls as rain. As their release of moisture decreases one consequence is the spread of desert conditions with less moisture available to support tree growth.

The cleared land is turned into pasture to raise cattle for human consumption. The jobs, products and revenue from forest destruction is tallied as an economic gain but one that ignores the untallied benefits of the ecological services provided by existing forests.

Less dramatic but increasingly visible is the loss of trees and woodlands in the United States, including the Midwest. Recently the Midwest has escaped recent fi res raging across the world and

in other parts of North America. But we have succumbed to the loss of woodlands and landscape trees, much of which has resulted from global trade.

As undergraduate students we witnessed the widespread death of American elms lining urban streets. While it was known as Dutch elm disease it is believed to have originated in Asia but became known as the Dutch Elm after scientists working with the disease. Some elms were resistance to the disease; since then, researchers have produced disease resistant trees commercially. Elm trees without resistance will grow for about 25 years before succumbing to the disease.

As doctoral students at the University of Michigan, we spent two summers teaching environmental courses at a private school in New Jersey. At the time there was controversy raging there regarding how to protect the woodlands under assault by gypsy moths. Starting in spring, both larvae and caterpillars consume a tremendous amount of leaf material. They can defoliate a tree, which if done repeatedly, can lead to tree death. Even if a tree survives defoliation it is

more vulnerable to insects and diseases. Oaks and many other tree species are vulnerable to attack.

Gypsy moths moved westward, eventually reaching Illinois and the rest of the Midwest. In June, 2020, a gypsy moth spraying program was conducted in JoDavies, Kendall, Ogle and Will counties following earlier programs in counties east of the area. In 1869, gypsy moths were brought to the United States to Massachusetts to crossbreed with silkworm moths to establish a silk industry in the United States. Some of them escaped and flourished as there were no predators to limit their proliferation. It is estimated that in some years gypsy moths have devasted more than two million forest acres in the Northeast.

Following the gypsy moth invasion was the arrival of the emerald ash borer which arrived in cargo shipped from Asia. Within two years of being infected much of the canopy is lost and within a year or two the trees are dead. Millions of trees have died; Their standing remains dominate swampy areas of Wisconsin. We now find ourselves in a widespread

until spring. “Pink Banana” and “Candy Roaster” are two winter squashes that you may find this season. Both have a banana shape with a pink, salmon color. The flavor is similar to butternut squash though can be sweeter.

If you want to use pumpkins or gourds for display, pick those that do not have any insect damage or disease on them as this can speed up decomposition. You should dip them in a rubbing alcohol solution to keep them from rotting faster. Gourds that are good for cooking can be processed the same way you would cook a pie pumpkin.

Oak decline. There still is uncertainty about what is causing the deaths of large, old oaks. It could be from a combination of factors.

For several years we have been involved in a cooperative project between the Living Land and Waters and The Rock River Trail Initiative of providing oak saplings along the Rock River corridor in Illinois and Wisconsin to restore native oak woodlands. Oaks have dominated the woodlands of this area for many years providing a wide range of ecological services which benefit people, animals and other living things.

The global loss of trees is only one aspect of the widespread environmental decline being documented by the scientific community who, along with informed citizens, are calling for appropriate actions to address the issues. Some actions need to be taken at the local level. Sustain Rockford is one of many initiatives addressing local environmental issues and in need of ongoing community support.

Beyond a local response is the need to address the risks of invasive species.
