State law banning concealed carry on public transit ruled unconstitutional Limited ruling applies only to plaintiffs; both sides considering next steps

A federal judge in Rockford has declared a state law banning concealed firearms on public transit systems unconstitutional – at least as it applies to four individuals who challenged it in court.

But the law remains in effect for everyone else as the parties in the case consider their next steps.

In a decision released Friday, Judge Iain D. Johnston said under current U.S. Supreme Court standards, the law violates the Second Amendment of the U.S. Constitution.

“After an exhaustive review of the parties’ filings and the historical record, as required by Supreme Court precedent, the Court finds that Defendants failed to meet their burden to show an American tradition of firearm regulation at the

time of the Founding that would allow Illinois to prohibit Plaintiffs—who hold concealed-carry permits—from carrying concealed handguns for self-defense onto the CTA and Metra,” he wrote.

Johnston cited the 2022 Supreme Court decision, New York State Rifle & Pistol Association v. Bruen, which struck down a century-old law in New York requiring individuals to show “proper cause” for needing to carry a firearm before they could be issued a concealed carry permit.

The Illinois case challenged a portion of the state’s 2013 Firearm Concealed Carry Act, which allows certain individuals to obtain permits to carry concealed firearms in many public places.

But the law also lists several prohibited areas where it remains illegal to carry concealed weapons, including “Any bus, train, or form of transportation paid for in whole or in part with public funds, and any building, real property, and parking area under the control of a public transportation facility paid for in whole or in part with public funds.”

Four individuals who hold concealed carry permits filed suit in 2022 to challenge the law, saying it prevented them from carrying their firearms for self-defense on mass transit trains and buses in the Chicago metropolitan area. They included Benjamin Schoenthal, of DeKalb County; Mark Wroblewski, of DuPage County; Joseph Vesel, of suburban Cook County; and Douglas Winston, of Lake County.

Johnston’s ruling held that the law is unconstitutional, but only as it applies to the four plaintiffs, meaning the law remains in effect for everyone else.

A spokesperson for Raoul, a defendant in the case, said that office would likely appeal the ruling. A spokesperson for Cook County State’s Attorney Kimberly Foxx, who was also named as a defendant, declined to comment.

Asked about the decision at an unrelated event Tuesday, Gov. JB Pritzker said he disagreed with Johnston’s opinion. He said the rights protected under the Second Amendment are not absolute and that there should be limits on the kinds of weapons people are allowed to carry and where those weapons should be permitted.

“So it’s clear that there are some misguided decisions that get made at the circuit court level, the federal court level, and I’m hoping that it will be overturned along the way, if it has to all the way the Supreme Court,” he said. “It will be disappointing if they uphold this. But I’m hopeful that the law that was passed in Illinois a number of years ago, that’s frankly done a lot to keep people safe, will be upheld.”

In July, the Supreme Court declined to hear an appeal of challenges to the state’s 2021 ban on assault-style weapons and large-capacity magazines, at least for the time being. Several lawsuits seek preliminary injunctions to block enforcement of that law while the cases are being tried, but the court said it would not hear those challenges until after the lower courts have conducted their trials.

The first of those trials is scheduled to begin Sept. 16 in U.S. District Court in East St. Louis.

AP Top 25: SEC grabs six of the first seven spots in rankings as Notre Dame tumbles to No. 18

After the first shake-up of the college footba l l season, t he Sout heastern Conference grabbed six of the top seven spots in the AP Top 25 — a first in the 88-year history of the rankings — and Notre Dame tumbled all the way to No. 18 on Sunday after being stunned at home.

Georgia received 54 out of a possible 63 first-place votes to keep a firm hold on No. 1. No. 2 Texas jumped a spot after dominating defending national champion Michigan on the road and received four first-place votes. The Longhorns have their best ranking since finishing second in 2009.

The Wolverines were down to No. 17.

No. 3 Ohio State from the Big Ten Conference slipped a spot. Then it was four more SEC teams. Alabama held steady at No. 4 and Mississippi moved up a spot to No. 5.

Missouri moved up three spots to No. 6 and Tennessee made a big jump from No. 14 to No. 7 after routing North Carolina State in Charlotte.

With the SEC bigger (16 teams) — and seemingly better — than ever given the additions of Texas and Oklahoma — the circumstances were right for an early season takeover like never before.

Not only is six of the top seven teams from one conference a record for a poll, but never before had a single league held as many as five of the top seven places.

Those teams will start playing each other in the coming weeks so it is unlikely the SEC can keep this up, but it’s a stark example of what’s possible in the superconference era.

Especially after the first huge upset of the college football season. Notre Dame’s 16-14 loss to Northern Illinois marked the first time a top-five team lost to an unranked team since the 2022 season, when Purdue knocked off then-No. 2 Iowa on Nov. 5, 2022.

The Huskies’ victory, the first top-five win for a Mid-American Conference team in league history, landed Northern Illinois at No. 25 in the rankings. NIU is ranked for the first time since 2013 and is the first team from non-Power Four conference to be ranked this season.

Rounding out the top 10 were No. 8 Penn State and No. 9 Oregon of the Big Ten and No. 10 Miami. The Ducks slip two spots after a wild, comeback victory against Boise State.

Poll points

Northern Illinois is one of four teams to move into the rankings this week for the first time this season, most notably Nebraska at No. 23.

The Cornhuskers are ranked for the first time since 2019 after easily handling Colorado at home. That was a brief stay.

After starting that season ranked No. 24, the Huskers lost in Week 2, fell out the rankings and have been gone ever since.

The last sustained season in the rankings for Nebraska was 2016, though even that season ended with the Huskers unranked. They have not finished a season ranked since 2012. That’s what second-year coach Matt Rhule and freshman quarterback Dylan Raiola are aiming for.

Just a reminder: Nebraska still owns the record for the longest streak of poll appearances with 348 under coach Tom Osborne from 1981-2002. The second-best streak is Alabama’s active 264 straight weeks ranked.

In and out

The turnover came from the bottom of the rankings, where Kansas, Iowa, Georgia Tech and North Carolina State all fell out after losses.

No. 21 Iowa State essentially switched places with its Cy-Hawk rivals by beating Iowa.

Last week, Georgia Tech made its

first appearance in the AP Top 25 since 2015, snapping one of the longest active droughts among power conference teams.

The Yellow Jackets lasted only a week after losing at Syracuse, but another Atlantic Coast Conference team snapped its own lengthy drought.

No. 24 Boston College is ranked for the first time since 2018.

The only other time a conference had four of the top five teams was the SEC on Oct. 19, 2014, when Mississippi State was No. 1, Ole Miss was third, Alabama was fourth and Auburn was fifth.

Georgia School shooting

Mother’s warning to Georgia school raises questions about moments before shooting

ATLANTA (AP) — The mother of a student at the Georgia high school where a teen allegedly killed four people says information indicating staff were warned he was having a crisis shows the shooting could have been prevented.

“The school failed them, that they could have prevented these deaths and they didn’t,” Rabecca Sayarath said Sunday in a telephone interview with The Associated Press. “I truly, truly feel that way.”

Sayarath’s daughter, Lyela, told reporters on Wednesday, the day of the shooting at Apalachee High School in Winder, Georgia, that administrators appeared to be looking for Colt Gray, the 14-year-old who has been charged with four counts of murder, before the gunfire began.

Others, though, are declining to blame school or law enforcement officials.

“I’m not going to referee or second-guess what happened with the authorities the other night,” U.S. Sen. Raphael Warnock, a Georgia Democrat, said on CNN’s “State of the Union” on Sunday. “I applaud our first responders. When others are running away from danger, they run toward the danger in order to do the best they can.”

Officials say Gray shot and killed students Christian Angulo and Mason Schermerhorn, both 14, and teachers Richard Aspinwall, 39, and Cristina Irimie, 53. Eight other students and a teacher were injured — seven of them shot — and are expected to recover.

Annie Brown told The Washington Post that her sister, Colt Gray’s mother, texted her saying she spoke with a school counselor and warned staff of an “extreme emergency” before the killings. Brown said Marcee Gray urged them to “immediately” find her son to check on him.

Brown provided screen shots of the text exchange to the newspaper, which also reported that a call log from the family’s shared phone plan showed a call was made to the school at 9:50 a.m. Warrants for Gray’s arrest say the shooting started at 10:20 a.m.

Brown confirmed the reporting to The Associated Press on Saturday in text messages but declined to provide further comment.

Marcee Gray expressed remorse for the shootings Saturday to The Washington Post and The New York Post.

“I am so, so sorry and can not fathom the pain and suffering they are going through right now,” Gray told The Washington Post in a text.

“It’s horrible. It’s absolutely horrible,” Gray told The New York Post outside her

father’s home in Fitzgerald, Georgia, about 150 miles (240 kilometers) south of Atlanta.

Charles Polhamus, the boy’s grandfather, has told multiple news outlets that Marcee Gray got a text from her son on Wednesday saying he was sorry. Polhamus told CNN that Marcee Gray drove to Winder, more than 200 miles (320 kilometers) from Fitzgerald, immediately after the shooting.

The Washington Post also reported that texts show relatives contacted the school about the boy’s mental health a week before the shooting, and that Brown told a relative he was having “homicidal and suicidal thoughts.” The newspaper reported that the teen’s grandmother, Deborah Polhamus, met with a school counselor to request help.

The boy “starts with the therapist tomorrow,” Polhamus wrote in a text to Brown after that meeting.

Investigators haven’t said what they believe might have motivated Gray or whether they believe he targeted particular victims.

Authorities have said Gray’s father, Colin Gray, gave him access to the semiautomatic AR-15 style rifle used in the shooting. It’s not clear how Gray brought the gun to campus or what he did with it in the two hours between school starting at 8:15 a.m. and when shots first rang out.

Colin Gray became the first parent of a school shooting suspect to be charged in Georgia, District Attorney Brad Smith said Friday. He’s accused of second-degree murder, involuntary manslaughter and cruelty to children for providing his son with the rifle.

Colin Gray is jailed in Barrow County after declining to seek bail in a brief court hearing Friday in Winder. Colt Gray is being held in a juvenile detention center after declining to seek bail. Neither has been indicted or entered a plea.

Lyela Sayarath said Wednesday that Colt Gray had left her algebra classroom and that she believed he was skipping class.

In the minutes before the shooting, a female administrator came to her class looking for a student with the same last name and almost identical first name as Gray, she said. That other student was in the bathroom, but the administrator demanded to see his bag. That student returned with his bag moments later, Sayarath said, and told her that administrators had concluded he wasn’t the student they were looking for.

Someone also called the teacher on the intercom, apparently asking about Gray, Sayarath said. She said as the intercom buzzed a second time, the teacher responded, “Oh he’s here,” seeing Gray outside the

classroom door.

When students went to open the door, which automatically locks from the inside when closed, Sayarath said they backed away. She said she saw Colt Gray turn away through the window of the door and then she said she heard gunshots — “10 or 15 of them at once, back-to-back.”

Rabecca Sayarath, Lyela’s mother, has said she believed the school erred by sending an unarmed administrator to look for Colt Gray instead of one of Apalachee High’s armed school resource officers.

When she questioned Barrow County Sheriff Jud Smith about her daughter’s account at a Wednesday night news conference, Smith cautioned, “With all due respect, ma’am, I think your information is incorrect.”

It’s unclear if Barrow County school authorities knew before the shooting that Colt and Colin Gray previously had been interviewed by a sheriff’s deputy in neighboring Jackson County in May 2023 after a report of an online threat to shoot up a middle school that Colt Gray, then 13, attended.

Colt Gray told the deputy that “he would never say such a thing, even in a joking manner,” according to a report filed by investigators. No action was taken because of inconsistent information about the social media account used to make the threats.

Colin Gray told the investigator back then that Colt had access to unloaded guns in the house but knew “how to use them and not use them.” He also said his son had struggled since he and his wife separated and that Colt was picked on in school.

Nicole Valles, a spokesperson for the Barrow County school district, declined to comment Sunday in response to emailed questions seeking more details about what may have happened before the shooting.

“Because this is an active investigation and now court proceedings have begun, we are not commenting on specific details,” Valles wrote, referring questions to the district attorney.

Smith didn’t immediately respond to emails Sunday with similar questions, while the Georgia Bureau of Investigation referred requests for comment to the district attorney.

Growing great garlic

As garlic curing ends around the first week of August to wrap up your 2024 season, we wait 8 more weeks to then turn around and plant garlic for the 2025 season. This quick movement between seasons is expected when growing garlic in Northern Illinois. Garlic is one of the main vegetables (or you might call an herb) that we get questions about throughout the spring and summer. Yet the problem with garlic is that we forget that we need to plant it in the fall where it overwinters and is harvested the end of June. If you do not plant at the right time, you will find that your garlic will not grow well for you.

Garlic should be planted in Northern Illinois in October. Even if you plant in September and mulch, you may have green growth from the garlic beyond the mulch layer and need to add more mulch.

Any exposure of the green tips to winter may damage your garlic.

One clove will yield one head of garlic.

Basically, this garlic clove is cloning itself to create that garlic bulb. There is a direct correlation between the size of the clove and how the rest of the bulb will develop.

If you plant a small clove, expect small cloves in the bulb you harvest in June 2025. You want a hardneck type as these perform well in Northern Illinois. You might try softneck varieties but know that they still tend to perform poorly

even with layers of mulch. Much of that will depend on our winter.

Hardneck varieties that are recommended are ‘Spanish Roja’, ‘Carpathian’, and ‘Georgian Crystal’. Growers I know also like ‘German Porcelain’, ‘Chrysalis Purple’, and ‘Red Chesnok’.

To get garlic for planting, visit a farmers market in your area and talk to the vendor. If you purchase a head of garlic from them, these cloves can be planted in your garden this fall. Garlic can be ordered online from reputable businesses though shipping can be expensive. I typically set aside bulbs from my 2024 harvest to plant in the fall while supplementing with new garlic bulbs I order.

As you think about where you want

to plant it, keep in mind that garlic has a long growing season. This space will not be available for crops until June/July of next year.

Garlic should be planted twice the height of the clove with spacing 6-8 inches between. You need to mulch. A good mulch layer of 6-8 inches is needed to provide insulation for the garlic as it develops. You may find that you need to keep laying this down in winter months.

Straw tends to be the best as it allows for protection and air flow. It is not uncommon to have to reapply a mulch in December.

Predicting how climate change will impact forests in Illinois

We have periodically burned the ground level vegetation of our small woodland for years to maintain the oak woods and the spring flora associated with it. We started burning it when it was recommended by ecologists to prevent garlic mustard from dominating the floral understory. For years periodic burning helped to maintain the spring flora and it continues to thrive.

The spring flora in our woods was spectacular and we provided tours for groups and individuals interested in them. The spring flora remains attractive but we have been losing both young and old oak trees to disease. Our trees grown on a hilly, sandy site and a few back to back drought years may have weakened the trees and allowed bark beetles to enter the trees and consume the cambium layer slowly killing the trees.

We hired an arborist to assess the damage and while the woodland is small, he estimated it would be too costly to chemically treat the woodland of the

size of ours. It is likely to have ecological adverse effects on other species as well.

In conversation with foresters, arborists, ecologists and other woodland owners they also reported that they are experiencing the death of some oak trees.

So far the damage is not on the scale of what occurred in Wisconsin wetlands inhabited by ash trees due to emerald ash borer. But consideration is being given to what trees are likely to survive as the climate continues to change.

An article in Climate Connections provides a brief overview of a tree planting project in St. Paul, Minnesota in which volunteers are helping scientists to determine which trees will thrive as the climate gets warmer.

The volunteers planted more than 1000 trees in 24 plots research plots. The trees planted including species already common in the area and others common farther south. The volunteers will help maintain the plots and report on their condition.

Another approach considering what trees might survive as the climate contin-

ues to warm is based on models developed to match the traits of trees, habitat types and climate projections 100 years in the future for Illinois. The study sponsored by the Illinois Native Plant Society and titled: Past, Present, and Possible Future Trends with Climate Change in Illinois Forests was done by Louis R. Iverson and John B. Taft and published in Erigenia in Spring of 2022.

The study indicates that following the last ice age, Illinois supported a boreal ecosystem similar to what now exists in Canada. It was replaced by an ecosystem of deciduous forest and grasslands maintained by fires. By 1820 with the arrival of European-American Settlement around 42% of the land was covered with woodlands and savannas. The forests have changed since then under the pressures of habitat destruction, the absence of fires, livestock grazing and invasive species.

Today only 13.5% remain as forests with 68% classified as oak-hickory.

The anticipated climate changes over the next 100 years of warmer winters, warmer and wetter springs and hotter and

drier summers are expected to influence which tree species are likely to surviving in our future forests. The predictions for the potential futures of the 113 tree species in response to climate change in ten primary Illinois ecoregions were based on computer models The existing dominant oak-hickory forest stands are projected to have a fair to good capabilities to survive the expected changes in the Illinois climate . If they do, the spring flora are likely to as well. However, the maple forest of Acer sacharum is an existing rival to oak woodlands is projected to have a fair to good capabilities of survive as well.

When it dominates a forest, too little light penetrates to the forest floor to support a rich, diverse forest fauna as occurs in an oak woodland. We would loose the rich species diversity of the understory of a oak woodland.

Having a sense of how climate change will impact vegetation is an important factor to consider in efforts to sustain biodiversity as well as impacting planning of conservation practices and their designs.

76th Greenwich Village Art Fair Sept. 14 + 15 at Rockford Art Museum From Rockford Art Museum

The 76th Greenwich Village Art Fair (GVAF) takes place Saturday, September 14 and Sunday, September 15—rain or shine—on the grounds of Rockford Art Museum (RAM) at Riverfront Museum Park, 711 N. Main St., in downtown Rockford, Illinois. The annual outdoor event features over 70 juried artists, live music by local musicians, an artisan marketplace, children’s art activities, food trucks, cocktails and more. Established in 1948, Greenwich is the longest running art fair of its kind in the Midwest. Premier sponsors are: Bergstrom Inc; Hard Rock Casion Rockford, Forest City Gear; Anne and David Boccignone, Cathy + Rob Funderburg, Dean Alan Olson Foundation, GreenState Credit Union; Aqua Aerobic Systems Inc, City of Rockford, and Dickerson Nieman Realtors/Becky Collier.

Admission gates are located at the Rockford Art Museum parking lot. Gates are open 10 a.m.–6 p.m. Saturday (afterhours event until 7:30 p.m.) and 10 a.m.–5 p.m. on Sunday. Admission is $5 for adults, free for children 12 and younger.

Tickets are available at the gate (cash only). Ticket proceeds help support RAM programs throughout the year.

Exhibiting at this year’s fair are 72 artists and 11 artisan marketplace vendors from across the nation. Types of artwork represented include paintings, jewelry, sculpture, glass, ceramics, textiles, photography, wood, mixed media, and more. Artists compete for awards on the first day of the fair, where their work will be viewed by 2024 Judge Juan Fernandez.

Awards, including Best of Show, Judge’s Choice awards, and honorable mentions will be presented Sat, Sept. 16. List of exhibiting artists at end of article.

Special events at the fair include live music by regional bands, Art Raffle (announced Sunday, with raffle prizes of original artwork donated by 6 exhibiting artists), cocktails and champagne at Point Lounge and Spark Champagne Bar both days, kid’s art activities, and after-hours music event Saturday night from 6-7:30 p.m. featuring Rock and Roll Institute.

Greenwich Main Stage, features LIVE MUSIC all day by local musicians including JB Project, Steve McClanahan, 3 Good Men, Hard Knock Kings, Law and Love, Rock and Roll Institute, H!P Pocket, Vince Chiarelli Band, Red Ball Jet, and Bobby Steele and the Singed Souls. All sets included with fair admission.

Local food trucks will be on-site serving everything from bao sandwiches to woodfire pizza and homemade ice

cream. Village Pub will serve sodas, and LaMonica brands of beer, wine and hard seltzers. Craft beer will be served by local brewery, Pig Minds Brewing. Local and regional vendors at the Greenwich Artisan Marketplace this year include Canine Crunchery, Caricatures by Chuck, Craft + Foster Candles, Dip N Good Dips, Dreamflow Works, Handicraft Soul, Iconic Quilling, SPoRT Makeup, The Licorice Guy, Victoria Sweeney, and Yours Truly Bath Co. Food and drink vendors include Bings, Catch N Crisp, Citrus Squeezer, Gelato Joe’s, Ka Bao, My Café Amore, Ole Folks BBQ, Quixotic Bakery, Rustic Oven Wood Fire Pizza, Thai Jasmine, and Vintage Goose.

Kortman Gallery Point Lounge celebrates it’s 20th year at Greenwich and features signature cocktails, mixed drinks and fine wines and, returning this year, J.R. Kortman Center for Design also presents Spark Champagne Bar featuring champagne cocktails. The RAM Membership Booth is also located near the entrance, where visitors can easily join the art museum or renew their membership for the upcoming year.

2024 Art Raffle tickets, $5 each or 3 for $10, are available at the GVAF Info Booth.

Drawing will be held Sunday, Sept. 17, at 5 p.m.; ticketholders need not be present to win.

Kids can make their own take-home art at the popular Creations by Kids tent.

Hands-on art activities are $1 each. The Creations tent opens at 10 a.m. and closes at 5 p.m. on Saturday and 4 p.m. on Sunday (one hour before the fair closes).
