Justices urge lawmakers to allow more public access to rivers Access now limited to rivers with commercial traffic BY PETER HANCOCK

SPRINGFIELD – The Illinois Supreme Court has ruled that the public has no right to boat, fish or swim in small rivers that flow across private property, but two justices are urging the General Assembly to change that law. “The legislature should redefine navigability to be more inclusive because that would promote the State’s interest in recreational uses of waterways for all citizens of the State of Illinois,” Justice P. Scott Neville, joined by Chief Justice Anne Burke, wrote in a separate opinion to a recent case. “It is incumbent upon the legislature to realize that there is an increasing social and economic need that riparian rights be restricted for public recreational purposes.” That was part of a concurring opinion in a recent decision involving a dispute between two landowners who own property along the Mazon River in Grundy County. A portion of that river flows through a fossil-rich area known as the Mazon

Creek Fossil Beds, a national historic landmark near the river’s confluence with the Illinois River, and both parties in the case operate fossil-hunting businesses. Adam Holm and his family own two separate parcels of property, one of which is landlocked and only accessible from the river. To get to that parcel, he would launch a kayak from his other property and row down the river, taking him across property owned by Peter Kodat and others. Kodat complained, accusing Holm of trespassing on his property, but Holm claimed that as the owner of property along the river, he had a right to access all parts of the river. The case centered around an Illinois law that gives property owners the right to control access to waters along their property, unless the waters are classified as “navigable,” which, according to an earlier Supreme Court decision, means “of su�cient depth to a�ord a channel for use for commerce.” In other words, unless a body of water is deep enough to carry barge or ship tra�c, property owners along that water have a right to bar public access to it. whether or not a lake, river or stream is navigable. It currently lists 48 bodies of water, including Lake Michigan and six branches of the Chicago River, as falling in that category. Thus, in a unanimous decision, the court said Kodat had the right to prohibit Holm from kayaking on the portion of the river that flows across his property. “In our view, the legislature is the best venue to consider plainti�s’ request for the creation of a new public policy on riparian rights for nonnavigable rivers and streams in Illinois, which constitute the majority of waterways in this state,” Justice Robert L. Carter wrote for the majority. But writing in what’s known as a “special concurrence” – in which a justice agrees with the outcome of a case but not the opinion – Neville wrote that he thinks it is time to change the law. Neville argued that the doctrine used in Illinois, known as the “Riparian Doctrine,” that gives property owners the right to control access to rivers and streams that flow across their property is “archaic and anachronistic” and should be replaced with one that recognizes the public’s right to use those resources for recreation. He also argued that the riparian doctrine has hindered Illinois from developing more recreational use of waterways, noting that there are “more than 87,000 miles of rivers and streams within its borders, but only 32 rivers and streams are classified as navigable.” “There is no question that the adoption of the recreational navigation doctrine is supported by Illinois public policy favoring the use of waterways for recreational purposes,” Neville wrote, citing a 1976 case in which the court blocked the sale of a portion of Lake Michigan in Chicago to U.S. Steel Corp. for the purpose of developing a steel plant there. “According to this court, it is appropriate to observe that there has developed a strong, though belated, interest in conserving natural resources and in protecting and improving our physical environment.” Capitol News Illinois is a nonprofit, nonpartisan news service covering state government that is distributed to more than 400 newspapers statewide. Putin declares victory in eastern Ukraine region of Luhansk By Francesca Ebel Associated Press

POKROVSK, Ukraine (AP) — Russian President Vladimir Putin on Monday declared victory in the eastern Ukrainian region of Luhansk, one day after Ukrainian forces withdrew from their last remaining bulwark of resistance in the province. Russia’s Defense Minister Sergei Shoigu reported to Putin in a televised meeting Monday that Russian forces had taken control of Luhansk, which together with the neighboring Donetsk province makes up Ukraine’s industrial heartland of Donbas. Shoigu told Putin that “the operation” was completed on Sunday after Russian troops overran the city of Lysychansk, the last stronghold of Ukrainian forces in Luhansk. Putin, in turn, said that the military units “that took part in active hostilities and achieved success, victory” in Luhansk, “should rest, increase their combat capabilities.” Putin’s declaration came as Russian forces tried to press their offensive deeper into eastern Ukraine after the Ukrainian military confirmed that its forces had withdrawn from Lysychansk on Sunday. Luhansk governor Serhii Haidai said on Monday that Ukrainian forces had retreated from the city to avoid being surrounded. “There was a risk of Lysychansk encirclement,” Haidai told the Associated Press, adding that Ukrainian troops could have held on for a few more weeks but would have potentially paid too high a price. “We managed to do centralized withdrawal and evacuate all injured,” Haidai said. “We took back all the equipment, so from this point withdrawal was organized well.” The Ukrainian General Staff said Russian forces were now focusing their efforts on pushing toward the line of Siversk, Fedorivka and Bakhmut in the Donetsk region, about half of which is controlled by Russia. The Russian army has also intensified its shelling of the key Ukrainian strongholds of Sloviansk and Kramatorsk, deeper in Donetsk. On Sunday, six people, including a 9-year-old girl, were killed in the Russian shelling of Sloviansk and another 19 people were wounded, according to local authorities. Kramatorsk also came under fire on Sunday. An intelligence briefing Monday from

the British Defense Ministry supported the Ukrainian military’s assessment, noting that Russian forces will “now almost certainly” switch to capturing Donetsk. The briefing said the conflict in Donbas has been “grinding and attritional,” and is unlikely to change in the coming weeks. While the Russian army has a massive advantage in firepower, military analysts say that it doesn’t have any significant superiority in the number of troops. That means Moscow lacks resources for quick land gains and can only advance slowly, relying on heavy artillery and rocket barrages to soften Ukrainian defenses. Russian President Vladimir Putin has made capturing the entire Donbas a key goal in his war in Ukraine, now in its fifth month. Moscow-backed separatists in Donbas have battled Ukrainian forces since 2014 when they declared independence from Kyiv after the Russian annexation of Ukraine’s Crimea. Russia formally recognized the self-proclaimed republics days before its Feb. 24 invasion of Ukraine. In his nightly video address, Ukrainian President Volodymyr Zelenskyy acknowledged the withdrawal, but vowed that Ukrainian forces will fight their way back. “If the command of our army withdraws people from certain points of the front where the enemy has the greatest fire superiority, in particular this applies to Lysychansk, it means only one thing: We will return thanks to our tactics, thanks to the increase in the supply of modern weapons,” Zelenskyy said. Since failing to take Kyiv and other areas in Ukraine’s northeast early in the war, Russia has focused on Donbas, unleashing fierce shelling and engaging in house-to-

house combat that devastated cities in the region. Russia’s invasion has also devastated Ukraine’s agricultural sector, disrupting supply chains of seed and fertilizer needed by Ukrainian farmers and blocking the export of grain, a key source of revenue for the country. In its Monday intelligence report, Britain’s defense ministry pointed to the Russian blockade of the key Ukrainian port of Odesa, which has severely restricted grain exports. They predicted that Ukraine’s agricultural exports would reach only 35% of the 2021 total this year as a result. As Moscow pushed its offensive across Ukraine’s east, areas in western Russia came under attack Sunday in a revival of sporadic apparent Ukrainian strikes across the border. The governor of the Belgorod region in Western Russia said fragments of an intercepted Ukrainian missile killed four people Sunday. In the Russian city of Kursk, two Ukrainian drones were shot down, according to the Russian Defense Ministry. In other developments: — Ukrainian soldiers returning from the front lines in eastern Ukraine’s Donbas region — where Russia is waging a fierce offensive — describe life during what has turned into a grueling war of attrition as apocalyptic. — Two Russian airplanes departed Bulgaria on Sunday with scores of Russian diplomatic staff and their families amid a mass expulsion that has sent tensions soaring between the historically close nations, a Russian diplomat said.

Ruling could dampen government efforts to rein in Big Tech By Matt O’Brien Associated Press

The Supreme Court’s latest climate change ruling could dampen efforts by federal agencies to rein in the tech industry, which went largely unregulated for decades as the government tried to catch up to changes wrought by the internet. In the 6-3 decision that was narrowly tailored to the Environmental Protection Agency, the court ruled Thursday that the EPA does not have broad authority to reduce power plant emissions that contribute to global warming. The precedent is widely expected to invite challenges of other rules set by government agencies. “Every agency is going to face new hurdles in the wake of this confusing decision,” said Alexandra Givens, the president and CEO of the Center for Democracy and Technology, a Washington-based digital rights nonprofit. “But hopefully the agencies will continue doing their jobs and push forward.” The Federal Trade Commission, in particular, has been pursuing an aggressive agenda in consumer protection, data privacy and tech industry competition under a leader appointed last year by President Joe Biden. Biden’s picks for the five-member Federal Communications Commission have also been pursuing stronger “net neutrality” protections banning internet providers from slowing down or blocking access to websites and applications that don’t pay for premium service. A former chief technologist at the FTC during President Donald Trump’s administration said the ruling is likely to instill some fear in lawyers at the FTC and other federal agencies about how far they can go in making new rules affecting businesses. The court “basically said when it comes to major policy changes that can transform entire sectors of the economy, Congress has to make those choices, not agencies,” said Neil Chilson, who is now a fellow at libertarian-leaning Stand Together, founded by the billionaire industrialist Charles Koch. Givens disagreed, arguing that many agencies, especially the FTC, have clear authority and should be able to withstand lawsuits inspired by the EPA decision. She noted that Chief Justice John Roberts, who wrote the opinion, repeatedly described it as an “extraordinary” situation. Givens is among the tech advocates

calling for Congress to act with urgency to make laws protecting digital privacy and other tech matters. But she said laws typically stay on the books for decades, and it’s unrealistic to expect Congress to weigh in on every new technical development that questions an agency’s mandate. “We need a democratic system where Congress can give expert agencies the power to address issues when they arise, even when those issues are unforeseen,” she said. “The government literally can’t work with Congress legislating every twist and turn.” Empowered by Congress in the 1970s to tackle “unfair or deceptive” business practices, the FTC has been in the vanguard of Biden’s government-wide mandate to promote competition in some industries, including Big Tech, health care and agriculture. A panoply of targets include hearing aid prices, airline baggage fees and “product of USA” labels on food. Under Chair Lina Khan, the FTC also has widened the door to more actively writing new regulations in what critics say is a broader interpretation of the agency’s legal authority. That initiative could run into stiff legal challenges in the wake of the high court decision. The ruling could call into question the agency’s regulatory agenda — leading it to either tread more cautiously or face tougher and more expensive legal challenges. Khan “hasn’t really been someone who pursues soft measures, so it may be a damn-the-torpedoes approach,” Chilson said. University of Massachusetts internet policy expert Ethan Zuckerman said it would be hard to gauge any potential impact of the court’s ruling on existing tech regulation. That’s partly because “there’s just not that much tech regulation to undo,” he said. He said one target could be the Consumer Financial Protection Bureau, “a bête noire for many conservatives.” Big companies such as Facebook parent Meta could also potentially appeal tough enforcement actions on the idea that federal agencies weren’t explicitly authorized to regulate social media. “We’re in uncharted territory, with a court that’s taking a wrecking ball to precedent and seems hell-bent on implementing as many right-wing priorities as possible in the shortest possible time,” Zuckerman said. The ruling could dampen the appetite

for agencies like the FTC to act to limit harm from artificial intelligence and other new technologies. It could have less effect on new rules that are more clearly in the realm of the agency imposing them. Michael Brooks, chief counsel for the nonprofit Center for Auto Safety, said the ruling isn’t likely to change the government’s ability to regulate auto safety or self-driving vehicles, although it does open the door to court challenges. For instance, the National Highway Traffic Safety Administration has clear authority to regulate auto safety from a 1966 motor vehicle safety law, Brooks said. “As long as the rules they are issuing pertain to the safety of the vehicle and not anything that’s outside of their authority, as long as it’s related to safety, I don’t see how a court could do an end run around

the safety act,” he said. Unlike the EPA, an agency with authority granted by multiple, complex laws, NHTSA’s “authority is just so crystal clear,” Brooks said. NHTSA could have problems if it strayed too far from regulating safety. For example, if it enacted regulations aimed to shift buyers away from SUVs to more fuel-efficient cars, that might be struck down, he said. But the agency has historically stuck to its mission of regulating auto safety with some authority on fuel economy, he said. However, it’s possible that a company such as Tesla, which has tested the limits of NHTSA’s powers, could sue and win due to an unpredictable Supreme Court, Brooks said.

A golden opportunity to see Chicago By Charles Herbst Contributor

Chicago attracts 57 million visitors every year. It is one of the top travel destinations in America, and it is only a few miles down the road. The city has over 70 museums, fantastic neighborhoods, friendly people, free concerts, incredible shopping and places to eat, all in the midst of unrivaled, world-class architecture. I believe the Summer of 2022 is a Golden Opportunity to visit Chicago. This year, despite high gasoline prices and runaway inflation, getting to Chicago and getting around the city is a real bargain. Because of ridership declines caused by the pandemic, both the CTA and Metra have lost riders, and they are eager to welcome them back with special deals. For those in Boone and Winnebago Counties, I think the most economical and practical way to get to Chicago this summer is to take Metra trains from the Woodstock Station, located at 90 Church Street. Unlike other stations, there is free trackside parking and, for most readers, it’s probably the Metra station requiring the shortest driving distance. There are 10 trains daily from Woodstock to Chicago, so consult the timetable at metra.com or the Ventra app for train times. There is a 24-hour parking limit in Woodstock. To encourage ridership this summer, Metra is capping fares at $10 per weekday, $7 per weekend day, or $10 for the entire weekend. This not only includes a round trip to Chicago, but free travel

on any Metra line. This means you can take the train into Chicago, and take another branch, (such as the BNSF line to Brookfield Zoo or the Metra Electric to Hyde Park) for no additional fare! To take advantage of this offer, you must download and use the free Ventra app on your smartphone. Children ride Metra free through Labor Day and on weekends. CTA has its share of bargains, too. This summer, a 1-day, unlimited-ride CTA pass is available for only $5 at any rapid transit station. The pass is good on both CTA buses and trains. You can load the pass onto a Ventra card or your personal contactless bankcard, or you can buy a disposable 1-day Ventra ticket. Children pay reduced fares. The customer assistants will help you out. Both Metra and CTA offer reduced or free travel for seniors. Unfortunately, this requires getting a special ID card and is more complicated and time-consuming than it should be. You may have always been going to go to Chicago—someday—to see the sights, but perhaps, quite frankly, you have been too intimidated by Chicago’s size to follow through. You’ve probably heard the melodramatic crime stories pumped out by local television stations, politicians, and newspapers and wondered if it really is safe. Ask yourself, if 57 million people from all over the world are visiting Chicago voluntarily, would they still come if the city really was unsafe or all that hard to

get around? Seize the day and don’t be bashful! To visit the city, you don’t have to become an expert in Chicago geography or a transit maven. Directions to any destination are available online from Google or the CTA at transitchicago.com. Or you can call 312/836 7000 for RTA travel information. There are customer assistants at every rapid transit station as well. You’ll have no trouble finding detailed directions to get you where you are going. With gasoline prices reaching five and six dollars, this just doesn’t seem like a good year to take a family driving vacation to California, or anywhere distant, for that matter. Yet it’s summertime, and many of us are itching to go on vacation. That’s Chicago calling you home!

How to get to the El from Metra.

As you explore Chicago, you’ll often want to take CTA Rapid Transit (the El) to destinations beyond Downtown. Chicago has four different downtown commuter stations and CTA trains don’t connect to any of them. Fortunately, if you are riding the train from Woodstock, unlike other Metra lines, you do have a couple of convenient options. Probably the easiest way is to leave the Metra train at the Jefferson Park Station on the Northwest Side. There is a direct, in-station connection to the CTA Blue Line. Follow the signs downstairs. Going west, CTA trains run directly into the passenger terminal at O’Hare Airport.

In the opposite direction, trains marked “Forest Park” go to the Chicago Loop. There is a transfer at the Clark and Lake Station for all other lines except the Red Line. Transfer to the Red Line at Washington or Jackson. Another option is to sit near the fourth car of the Metra train. When you get to Ogilvie Station, take the stairway on the platform down to the Metra Market. Exit through the Clinton Street doors and turn right. The Clinton and Lake El Station is 1-1/2 blocks ahead of you. Take the Green (or Pink) Line trains one stop east (toward the Loop) to Clark and Lake. Transfer there to all lines except the Red Line. For the Red Line, transfer at the next station, State and Lake, or at Roosevelt. Remember, every CTA Rapid Transit station has customer assistants to help you pay fares, get directions or other information. Metra conductors are often another good source of information on this topic.

Going to the Cubs Game.

If you are going to Wrigley Field, get off the Metra Train at the Irving Park Station. Follow the crowd and take CTA bus 80 east on Irving Park Road. Use your contactless bankcard to pay the bus fare. Get off at Clark Street and walk 3 blocks south. With free parking at Woodstock and reduced Metra fares, you’ve saved almost enough on gas, parking, and tolls to pay for your admission ticket!

Local contractor represents Rockford at The World Games in Birmingham Submitted Local contractor Tim Mazurkiewicz has been appointed one of eight International Kickboxing Officials to serve at The World Games in Birmingham (AL), July 7–17, 2022. “I am honored to have been selected from such an elite group”, says Mazurkiewicz. “It’s very exciting to be on the verge of seeing Kickboxing in the Olympics and getting to officiate in the first Olympic Games for Kickboxing!” The World Games is an international

multi-sport event comprising sports and sporting disciplines that are not contested in the Olympic Games. The World Games are governed by the International World Games Association, under the patronage of the International Olympic Committee. T i m ‘Zu r k’ M a z u r k i e w i c z w a s Rockford’s 1998 Toughman Contest Champion and has since competed on an international stage as both an amateur and professional kickboxer. Now retired from the sport as a competitor, Zurk

remains actively involved, ser ving as Director of Officials for the World Association of Kickboxing Organizations (WAKO). WAKO is the world’s largest kickboxing organization, with over 3.5 million members and competitors. “This will be my second World Games”, Mazurkiewicz mentioned, as he also saw action as a ringside Judge at the 2016 World Games in Poland. Zurk points out that a local gym, Northern Illinois Combat Club (NICC) is serving as a training

ground for this region’s fighters preparing to do battle in Birmingham. “We are pushing these guys and gals hard every single day to make sure they’re ready to compete, come July,” said Shayne Adams, owner and Head Coach at NICC. Mazurkiewicz will see two full days of kickboxing proceedings, live from Boutwell Auditorium, July 13-14. Over 3,500 athletes from over 100 nations are expected to compete at The World Games 2022.

Supreme Court limits EPA on carbon emissions By Drs. Robert & Sonia Vogl

An article prior to last Thursday’s Supreme Court ruling appeared in the New York Times: The Supreme Court case that could doom U.S climate goals provided an excellent overview of the potentially broad consequences of the Court’s ruling on the Federal Government’s power to regulate. The West Virginia vs the EPA case was described as the most important climate change case to come before the Supreme Court in over a decade. The Times ar t icle describes how President Obama’s inability to get Congress to pass legislation to limit carbon emissions led him to take executive action to reach the goal of limiting carbon emissions by shutting down coal and natural gas power plants. He justified his America’s Clean Energy Plan based on a provision in the 1970 Clean Air Act passed during the Nixon Administration. In 1970 the Environmental Protection Agency was created and granted the broad authority to clean up the nation’s air and water. This authority was granted in anticipation of the need to regulate future pollutants as they came apparent rather than identifying specific pollutants such as carbon dioxide. The Obama administration used a section of the Clean Air Act that said nothing about carbon emissions or climate change to implement the directive. Following that a lawsuit was filed by Republican attorneys general challenging the legality of the action. When Trump became President he eliminated the regulation ending the Clean Power Plan. The Supreme Court recently ruled that the Environmental Protection Agency lacks the power under current laws to impose greenhouse gas caps on the nation’s electrical supply. The ruling is seen as erecting a road block to efforts by the Biden Administration’s ability to implement climate change policies. Beyond the outcome of this specific case is a concern of whether the ruling will limit the ability of other Federal agencies to regulate the economy. The Supreme Court ruling indicated the

authority to regulate carbon belongs to Congress and not the Administration. The Times article went on to describe that the Attorneys General intend to create a new legal precedent to rein in the Federal Government’s regulatory actions. The Environmental Law and Policy Center quickly assembled a video discussing the implications of the court ruling for the midwest. The court ruling is not seen as good news; the presenters conveyed that perspective. The ruling was described as conservative judicial activism which failed to address the reality that pollution does not recognized state boundaries and has national and global consequences. Ironically the ruling addressed a regulation that was never implemented. ItwaspointedoutthattheEnvironmental Protection Agency has other legal tools to regulate carbon emissions but they would provide less flexibility in how electric utilities can respond to the need to regulate emissions than those that existed under the proposed Clean Air Act. Other legal tools available to the EPA include the direct regulation of carbon releases or requiring the capturing of carbon emissions. The EPA is seen as having the technical capacity to implement such solutions as well. The court ruling relied on the major question doctrine that was never used before in a Supreme Court case. The case rose to the level of Supreme Court interest because it was seen as regulating an entire industry. It remains unclear at this point whether other cases regarding government regulations will be raised and meet the conditions of being of Supreme Court interest. What is clear is that the ruling is a blow to existing efforts to control carbon emissions from power plants. The ruling sends the issue of carbon controls back to Congress for it to authorize when it has rejected years of efforts to limit carbon emissions. The Clean Air act was an effort to overcome Congressional resistance.

FY 2023 – FY 2026 TRANSPORTATION IMPROVEMENT PROGRAM (TIP): The TIP is a federally required and fiscally-constrained document used to track all surface transportation projects that use federal transportation funding from the Federal Highway Administration (FHWA), the Federal Transit Administration (FTA) and state transportation funds from the Illinois Department of Transportation (IDOT) for the next four fiscal years (July 1, 2023-June 30, 2026). project development and project phases of all regionally significant highway and transit projects in the Rockford Metropolitan Planning Area (MPA). The current listing can be found at https://r1planning.org/tip. 2. 2050 METROPOLITAN TRANSPORTATION PLAN: The Metropolitan Transportation Plan (MTP) is a federally required document, as designated by the U.S. Department of Transportation Final Rule for Metropolitan Planning (Part 450.324 section b), that guides recommendations for local government entities to manage and support a balanced multimodal transportation system within the MPA. The overall goal of the MTP is to promote a safe and efficient transportation system for the movement of people and goods in the MPA through a continuing, comprehensive and cooperative (3-C) planning process. The intent is to provide a transportation system that minimizes costs and impacts to the tax payer, society and environment. The MTP addresses all modes of transportation and stresses the integration and connectivity of these components over the next 20 to 30 years. The current MTP was adopted by the Policy Committee in July 2020 (MPO Resolution 2020-06). New regulations for the MTP including the IIJA (signed November 15, 2021) and the Final Rule for Metropolitan Transportation Planning (issued May 27, 2016) will be further incorporated into the ongoing MTP update. Updates to the MTP occur on a five-year cycle. The next update to the MTP is scheduled for adoption in 2025. The current MTP can be found at www.r1planning.org/mtp. 3. COORDINATED PUBLIC TRANSIT-HUMAN SERVICES TRANSPORTATION PLAN (HSTP): The HSTP is a federally required document that is used to identify the current needs of transit-dependent populations including: persons with disabilities, seniors, and individuals with low-income. The HSTP aims to maintain and enhance existing service levels, improve coordination and communication of service delivery, and improve educational outreach of transit providers and services to the community. Key elements of the plan include FTA funding allocation recommendations for the use of Job Access and Reverse Commute (JARC), Enhanced Mobility for Seniors and Individuals with Disabilities Program, and New Freedom eligible projects within the MPA. The current MPO HSTP was adopted by the Policy Committee in August 2021 (MPO Resolution 2021-17). Future updates to the HSTP occur on an update cycle of five years. UNIFIEDWORK PROGRAM (UWP): The UWP is a federally required document that tracks federal, state, and local transportation funds the MPO receives for transportation planning. The UWP details the work activities that the MPO undertakes during its fiscal year (July 1, 2022 – June 30, 2023). These funds provide financial operational assistance for the MPO work tasks and ensures that the organization leads a cooperative, continuing, and comprehensive approach to the transportation planning process within the MPA. The UWP was adopted at the June 23, 2023 MPO Policy Committee meeting (MPO Resolution 202210). Future updates to the UWP occur on an annual basis. The MPO FY 2023 UWP can be found

PUBLIC PARTICIPATION PLAN (PPP): The Public Participation Plan (PPP) is a federally required document detailing the policies and procedures to give the public adequate opportunity to participate in and provide feedback on all MPO related transportation plans before their adoption. The purpose of the document is to create a platform for the general public to participate in the transportation planning process and development of MPO transportation planning initiatives. Key elements of the PPP include strategies to engage, inform, promote and improve the public participation process for all who live, work and visit the Metropolitan Planning Area (MPA). The current PPP was adopted by the Policy Committee in May 2018 (RMAP Resolution 2018-6). Future updates to the PPP are on an update cycle of five years. TITLE VI AND ENVIRONMENTAL JUSTICE: The Title VI & Environmental Justice Plan is a federally required document used to ensure that the transportation planning process is provided in a nondiscriminatory manner in the Rockford MPA. Title VI is a Federal statute and provides that no person shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. In addition, it ensures that persons with limited English proficiency are provided reasonable access to transportation programs and facilities. Key elements of the Plan include an outline of equitable transportation policies and procedures to accommodate underserved populations. The current plan was adopted by the MPO Policy Committee in June 2022 (MPO Resolution 2022-08). Future updates to plan occur on an update cycle of every three years. BICYCLE & PEDESTRIAN PLAN: The Bicycle & Pedestrian Plan focuses on the active transportation network for the Rockford Metropolitan Area. The purpose of the document is to provide a data-driven analysis of safe and efficient transportation methods to serve the unique needs of pedestrians, cyclists and vulnerable populations including children and the elderly. Key elements of the Plan include design standards for pedestrian and bicycle facilities, a summary of the existing pedestrian and bicycle network and recommendations for project and program implementation. The current Plan was adopted by the MPO Policy Committee in September 2017 (MPO Resolution 2017-9). The MPO is currently underway on an update to the current plan. GREENWAYS PLAN FOR BOONE, WINNEBAGO, AND OGLE COUNTIES: The Greenways Plan is a regional effort led by the MPO to create a regional vision for coordinated greenway and trail preservation development. The development of the Plan provides a platform for governmental jurisdictions, nonprofit organizations, and residents of Boone and Winnebago Counties to discuss environmental stewardship strategies for natural and cultural resources and develop growth management objectives for the greenways network. The current Plan was adopted by the MPO Policy Committee in April

2021 (MPO Resolution 2021-08). Future updates to the plan and associated maps occur every five years. Updates to the Plan will reflect recent changes in the green infrastructure network including trails, shared-use paths, bicycle lanes, sidewalks etc. The current plan can be found can be found at www.r1planning.org/ planning-activities. 9. TRANSPORTATION SYSTEM MANAGEMENT & OPERATIONS PLAN (TSMO): The TSMO Plan is a federally required document that is used by government jurisdictions and local transportation agencies to ensure that the transportation network can accommodate future growth. Management and operations strategies improve the performance of existing transportation facilities, identify methods to relieve vehicular congestion and maximize the safety and mobility of people and goods. The purpose of the TSMO is to evaluate the existing conditions of the transportation system, analyze network operations efficiency, and develop a framework to integrate the congestion management process into the MPA. The plan strengthens linkages between operations and planning of the regional transportation system to solve operational problems, improves system performance, improves communication across transportation agencies, and prepares for the incorporation of emerging technology. The current Management and Operations Plan was adopted by the Policy Committee in 2008 (MPO Resolution 2008-11). Updates to the Management and Operations Plan occur on an update cycle of approximately five years. An update for the Management and Operations Plan is underway. SURFACE TRANSPORTATION BLOCK GRANT (STBG) & TRANSPORTATION ALTERATIVES PROGRAM (TAP): The USDOT and FHWA provide flexible funding for state and local jurisdictions to address transportation needs as apportioned by FAST Act through the STBG and TAP programs. The MPO Policy Committee has authority to select projects to utilize these funds. The recent resolution and project selection criteria for the STBG Program was adopted by the MPO Policy Committee in April 2022 (MPO Resolution 2022-05). Awards for these projects occur on an annual basis. Public comments are welcomed on all the above MPO planning documents. Comments can also be provided at the MPO Technical and Policy Committee meetings or by contacting the MPO by telephone or email. Public comments regarding MPO planning documents will be accepted at any time. MPO Technical Committee meetings are scheduled on the third Thursday of each month. MPO Policy Committee meetings are scheduled in the months of February, April, June, August, and October.
