Mills and Miquelon are also founders of the Mazo Movement Arts Center where they provide teaching, practice and performance space for all kinds of movement and musical forms.

Biden heaps praise on Pritzker, touts economic recovery ahead of 2024 during Chicago visit

President hypes ‘Bidenomics,’ reclaiming term coined by critics

CHICAGO – In a whirlwind visit to Chicago on Wednesday, President Joe Biden trotted out a re-election campaign message built on economic recovery – and effusively praised Gov. JB Pritzker for helping him win the White House in 2020.

“There’s a guy that helped me more than – I can say this without equivocation – helped me more than anybody in America get elected last time. A single person: your governor,” Biden said during a speech in Chicago’s Old Post Office, the first stop before a pair of private fundraisers, including one hosted by Pritzker and his wife MK, where the minimum donation was $3,300.

“He stepped up. He raised money, he raised support,” the president continued. “Governor, you’re the best. Thank you for being such a good friend. I really mean it.”

In April, Biden officially announced his re-election campaign for 2024, finally putting an end to more than a year of speculation that Pritzker would throw his hat into the ring. The billionaire governor had repeatedly said he would support Biden for a second term.

Pritzker won a second term as governor in November, promising to spend the next four years working to deliver many of the same progressive policies in Illinois that Biden listed as goals during his speech Wednesday.

In Chicago’s Old Post Office, the pres-

ident was flanked by nearly a dozen blue signs bearing the term “Bidenomics” – a term coined by critics in the conservative-leaning financial press. He redefined it as an opposing framework to the supply-side economic theory dubbed “Reaganomics” under former President Ronald Reagan in the 1980s.

Supply-side defenders believe tax cuts, particularly for the wealthiest Americans and businesses, will spur job creation and economic growth. It’s a framework sometimes derided as “trickle-down economics.”

Biden said the economic theory has “failed America’s middle class for decades.”

“I’m tired of waiting for the trickle-down,” the president said. “It doesn’t come very quickly. Not much trickle-down at my dad’s kitchen table growing up.”

Biden’s record on economic recovery from the COVID-19 pandemic rests on a foundation of four packages he signed into law: the American Rescue Plan Act, the Bipartisan Infrastructure Law, the CHIPS and Science Act and the Inflation Reduction Act. All were passed during Biden’s first two years in office, when Democrats controlled both chambers of Congress.

Pritzker seized on the opportunity to tout Illinois’ complementary laws, which take advantage of the availability of federal funds to invest in infrastructure and renewable energy projects.

“President Biden made us the envy of the world when he led the passage of the Inflation Reduction Act, which has brought clean energy and climate action

to the forefront and once again created millions of jobs across the nation,” Pritzker said before the president took the stage Wednesday. “And together with Illinois’ Climate and Equitable Jobs Act, we will reach 100 percent clean energy production by 2045.”

Biden got big applause from the friendly audience when he hit on themes Pritzker included in Illinois’ budget for the new fiscal year that begins Saturday: reduced costs and greater availability of child care, preschool and community college education.

“I’m determined to keep fighting for universal pre-K and free community college,” Biden said. “We’re also fighting to make child care more affordable because we know one benefit is that it opens up significant opportunities for parents to be able to go back and join the workforce.”

Addressing the crowd at the private fundraiser hosted by the Pritzkers afterward, Biden hit on many of the same themes, though he displayed more fiery rhetoric at the campaign event.

Per a pool report, the president got a standing ovation when he said Roe v. Wade – the landmark 1973 U.S. Supreme Court decision legalizing abortion that was struck down by a conservative-majority court last year – should be codified into federal law.

Illinois Democrats are eyeing putting a referendum question to voters on the November 2024 ballot, which, if approved, would enshrine the right to abortion access in the Illinois Constitution.

Biden received another standing ovation when he threw his support to Illinois’ ban on firearms classified as “assault weapons,” which Democrats pushed through the General Assembly in January, though its future is in the hands of federal appellate judges set to hear the case on Thursday.

“Who the hell needs a magazine that holds a hundred rounds?” Biden asked the crowd of loyal Democrats.

The Supreme Court rejects Biden’s plan to wipe away $400 billion in student loan debt

WASHINGTON (AP) — A sharply divided Supreme Court on Friday effectively killed President Joe Biden’s $400 billion plan to cancel or reduce federal student loan debts for millions of Americans. “This fight is not over,” he said.

The 6-3 decision, with conservative justices in the majority, said the Biden administration overstepped its authority with the plan, and it leaves borrowers on the hook for repayments that are expected to resume in the fall.

Biden was to announce a new set of actions to protect student loan borrowers later Friday, according to a White House official who was not authorized to speak publicly beforehand and discussed the matter on condition of anonymity. The president said in a statement the ruling was wrong and accused Republicans of “stunning” hypocrisy on the issue.

The court held that the administration needed Congress’ endorsement before undertaking so costly a program. The majority rejected arguments that a bipartisan 2003 law dealing with national emergencies, known as the HEROES Act, gave Biden the power he claimed.

“Six States sued, arguing that the HEROES Act does not authorize the loan cancellation plan. We agree,” Chief Justice John Roberts wrote for the court.

Justice Elena Kagan, wrote in a dissent, joined by the court’s two other liberals, that the majority of the court “overrides the combined judgment of the Legislative and Executive Branches, with the consequence of eliminating loan forgiveness for 43 million Americans.” Kagan read a summary of her dissent in court to emphasize her disagreement.

Roberts, perhaps anticipating negative public reaction and aware of declining approval of the court, added an unusual coda to his opinion, cautioning that the liberals’ dissent should not be mistaken for disparagement of the court itself. “It is important that the public not be misled either. Any such misperception would be harmful to this institution and our country,” the chief justice wrote.

Loan repayments will resume in October, although interest will begin accruing in September, the Education Department has announced. Payments have been on hold since the start of the coronavirus pandemic more than three years ago.

The forgiveness program would have

canceled $10,000 in student loan debt for those making less than $125,000 or households with less than $250,000 in income. Pell Grant recipients, who typically demonstrate more financial need, would have had an additional $10,000 in debt forgiven.

Twenty-six million people had applied for relief and 43 million would have been eligible, the administration said. The cost was estimated at $400 billion over 30 years.

Advocacy groups supporting debt cancellation condemned the decision while demanding that Biden find another avenue to fulfill his promise of debt relief.

Natalia Abrams, president and founder of the Student Debt Crisis Center, said the responsibility for new action falls “squarely” on Biden’s shoulders. “The president possesses the power, and must summon the will, to secure the essential relief that families across the nation desperately need,” Abrams said in a statement.

The loan plan joins other pandemic-related initiatives that faltered at the Supreme Court.

Conservative majorities ended an eviction moratorium that had been imposed by the Centers for Disease Control and Prevention and blocked a plan to require workers at big companies to be vaccinated or undergo regular testing and wear a mask on the job. The court upheld a plan to require vaccinations of health-care workers.

The earlier programs were billed largely as public health measures intended to slow the spread of COVID-19. The loan forgiveness plan, by contrast, was aimed at countering the economic effects of the pandemic.

In more than three hours of arguments last February, conservative justices voiced their skepticism that the administration had the authority to wipe away or reduce student loans held by millions.

Republican-led states arguing before the court said the plan would have amounted to a “windfall” for 20 million people who would have seen their entire student debt disappear and been better off than they were before the pandemic.

Biden said GOP officials “had no problem with billions in pandemic-related loans to businesses. ... And those loans were forgiven. But when it came to providing relief to millions of hard-working Americans, they did everything in their power to stop it.”

Roberts was among those on the court who questioned whether non-college workers would essentially be penalized for a break for the college educated.

In contrast, the administration grounded the need for the sweeping loan forgiveness in the COVID-19 emergency and the continuing negative impacts on people near the bottom of the economic ladder. The declared emergency ended on May 11.

Without the promised loan relief, the administration’s top Supreme Court lawyer told the justices, “delinquencies and defaults will surge.”

At those arguments, Justice Sonia Sotomayor said her fellow justices would be making a mistake if they took for themselves, instead of leaving it to education experts, “the right to decide how much aid to give” people who would struggle if the program were struck down.

The HEROES Act — the Health and Economic Recovery Omnibus Emergency Solutions Act — has allowed the secretary of education to waive or modify the terms of federal student loans in connection with a national emergency. The law was primarily intended to keep service members from being hurt financially while they fought in wars in Afghanistan and Iraq.

Biden had once doubted his own authority to broadly cancel student debt, but announced the program last August. Legal challenges quickly followed.

The court majority said the Republicanled states had cleared an early hurdle that required them to show they would be financially harmed if the program had been allowed to take effect.

The states did not even rely on any direct injury to themselves, but instead pointed to the Missouri Higher Education Loan Authority, a state-created company that services student loans.

Nebraska Solicitor General James Campbell, arguing before the court in February, said the Authority would lose about 40% of its revenues if the Biden plan went into effect. Independent research has cast doubt on the financial harm MOHELA would face, suggesting that the agency would still see an increase in revenue even if Biden’s cancellation went through. That information was not part of the court record.

A federal judge initially found that the states would not be harmed and dismissed their lawsuit before an appellate panel said the case could proceed.

In a second case, the justices ruled unanimously that two Texans who filed a separate challenge did not have legal standing to sue. But the outcome of that case has no bearing on the court’s decision to block the debt relief plan.

Alan Arkin, Oscar-winning ‘Little Miss Sunshine’ actor, dies at 89

LOS ANGELES (AP) — Alan Arkin, the wry character actor who demonstrated his versatility in everything from farcical comedy to chilling drama as he received four Academy Award nominations and won an Oscar in 2007 for “Little Miss Sunshine,” has died. He was 89.

His sons Adam, Matthew and Anthony confi rmed their father’s death through the actor’s publicist on Friday. “Our father was a uniquely talented force of nature, both as an artist and a man,” they said in a statement.

Hollywood was in mourning, with Paul Reiser, Michael Rapaport and Patton Oswalt among those praising Arkin.

“Such a wonderful, original voice for comedy. And on the few occasions I was in his presence, a kind and generous soul. I learned so much from watching him. And the laughs I got from his glorious work seem endless,” tweeted Jason Alexander.

A member of Chicago’s famed Second City comedy troupe, Arkin was an immediate success in movies with the Cold War spoof “The Russians Are Coming, The Russians Are Coming” and peaked late in life with his win as best supporting actor for the surprise 2006 hit “Little Miss Sunshine.” More than 40 years separated his fi rst Oscar nomination, for “The Russians are Coming,” from his nomination for playing a conniving Hollywood producer in the Oscar-winning “Argo.”

In recent years he starred opposite Michael Douglas in the Netfl ix comedy series “The Kominsky Method,” a role that earned him two Emmy nominations.

“When I was a young actor people wanted to know if I wanted to be a serious actor or a funny one,” Michael McKean tweeted Friday. ‘I’d answer ‘Which kind is Alan Arkin?’ and that shut them up.”

Arkin once joked to The Associated Press that the beauty of being a character actor was not having to take his clothes o� for a role. He wasn’t a sex symbol or superstar, but was rarely out of work, appearing in more than 100 TV and feature fi lms. His trademarks were likability, relatability and complete immersion in his roles, no matter how unusual, whether playing a Russian submarine o�cer in “The Russians are Coming” who struggles to communicate with the equally jittery Americans, or standing out as the foul-mouthed, drug-addicted grandfather in “Little Miss Sunshine.”

“Alan’s never had an identifiable screen personality because he just disappears

into his characters,” director Norman Jewison of “The Russians are Coming” once observed. “His accents are impeccable, and he’s even able to change his looks. ... He’s always been underestimated, partly because he’s never been in service of his own success.”

While still with Second City, Arkin was chosen by Carl Reiner to play the young protagonist in the 1963 Broadway play “Enter Laughing,” based on Reiner’s semi-autobiographical novel.

He attracted strong reviews and the notice of Jewison, who was preparing to direct a 1966 comedy about a Russian sub that creates a panic when it ventures too close to a small New England town. In Arkin’s next major fi lm, he proved he could also play a villain, however reluctantly. Arkin starred in “Wait Until Dark” as a vicious drug dealer who holds a blind woman (Audrey Hepburn) captive in her own apartment, believing a drug shipment is hidden there.

He recalled in a 1998 interview how di�cult it was to terrorize Hepburn’s character.

“Just awful,” he said. “She was an exquisite lady, so being mean to her was hard.”

Arkin’s rise continued in 1968 with “The Heart Is a Lonely Hunter,” in which he played a sensitive man who could not hear or speak. He starred as the bumbling French detective in “Inspector Clouseau” that same year, but the film would become overlooked in favor of Peter Sellers’ Clouseau in the “Pink Panther” movies.

Arkin’s career as a character actor continued to blossom when Mike Nichols, a fellow Second City alumnus, cast him in the starring role as Yossarian, the victim of wartime red tape in 1970’s “Catch-22,” based on Joseph Heller’s million-selling novel. Through the years, Arkin turned up in such favorites as “Edward Scissorhands,” playing Johnny Depp’s neighbor; and in the fi lm version of David Mamet’s “Glengarry Glen Ross” as a dogged real estate salesman. He and Reiner played brothers, one successful (Reiner), one struggling (Arkin), in the 1998 fi lm “The Slums of Beverly Hills.”

“I used to think that my stu� had a lot of variety. But I realized that for the fi rst twenty years or so, most of the characters I played were outsiders, strangers to their environment, foreigners in one way or another,” he told The Associated Press in 2007.

“As I started to get more and more comfortable with myself, that started to shift. I got one of the nicest compliments I’ve ever gotten from someone a few

days ago. They said that they thought my characters were very often the heart, the moral center of a film. I didn’t particularly understand it, but I liked it; it made me happy.”

Other recent credits included “Going in Style,” a 2017 remake featuring fellow Oscar winners Michael Caine and Morgan Freeman, and “The Kominsky Method.” He played a Hollywood talent agent and friend of Douglas’ character, a once-promising actor who ran an acting school after his career sputtered.

He also was the voice of Wild Knuckles in the 2022 animated fi lm “Minions: The Rise of Gru.”

Arkin also directed the fi lm version of Jules Fei�er’s 1971 dark comedy “Little Murders” and Neil Simon’s 1972 play about bickering old vaudeville partners, “The Sunshine Boys.” On television, Arkin appeared in the short-lived series “Fay” and “Harry” and played a night court judge in Sidney Lumet’s drama series “100 Centre Street” on A&E. He also wrote several books for children.

Born in New York City’s borough of Brooklyn, he and his family, which included two younger brothers, moved to Los Angeles when he was 11. His parents found jobs as teachers, but were fi red during the post-World War II Red Scare because they were Communists.

“We were dirt poor so I couldn’t a�ord to go to the movies often,” he told the AP in 1998. “But I went whenever I could and focused in on movies, as they were more

important than anything in my life.”

He studied acting at Los Angeles City College; California State University, Los Angeles; and Bennington College in Vermont, where he earned a scholarship to the formerly all-girls school.

He married a fellow student, Jeremy Ya�e, and they had two sons, Adam and Matthew.

After he and Ya�e divorced in 1961, Arkin married actress-writer Barbara Dana, and they had a son, Anthony. All three sons became actors: Adam starred in the TV series “Chicago Hope.”

“It was certainly nothing that I pushed them into,” Arkin said in 1998. “It made absolutely no di�erence to me what they did, as long as it allowed them to grow.”

Arkin began his entertainment career as an organizer and singer with The Tarriers, a group that briefly rode the folk musical revival wave of the late 1950s. Later, he turned to stage acting, o�-Broadway and always in dramatic roles.

While some insect vegetable pests have felt lower in populations this season, one insect the University of Illinois Extension has received calls on may be new to you. If you are growing potatoes, you may see di�erent forms of the same insect: Colorado potato beetle. I do not see them too often in my home garden; but I know of other growers, both commercial and backyard, that encounter these beetles season after season.

The adults become active in the spring around the same time that the potato plants are beginning to emerge. These

adults are oval in shape with black strips on a yellow and orange body. Though you may not see the adults, sometimes I notice the egg sacs fi rst. These bright yellow clusters are on the underside of the potato leaves. The larvae can also do damage. When hatched, these larvae look like copper-red grubs with black spots on their bodies. Older larvae may look more salmon in color too.

Primarily, this insect targets the potato plant. It may harm other members of this plant family like tomatoes, peppers, or eggplant. The Colorado potato beetles eats the aboveground foliage. So when you dig your potatoes, you will not see

damage. However, if the population of this insect is severe, it may lessen the amount of potatoes you eventually dig up. Typically, you should be concerned if more than 30% of the above ground foliage is eaten. The most important time to reduce insect damage is soon after the potato plant flowers. For our area, this may mean the end of June and into July. If you have an outbreak of beetles during this time, you should ultimately take steps to address it.

So what can you do? As stated, the plants can tolerate some damage without impacting your potato yield. If your plot was small, you could remove and destroy

the insects and eggs by hand. You might also use floating row cover, fabric that allows for water and light penetration but creates a barrier to keep the insects out. Commonly, insecticides do not work for this insect as they have built up resistance. We also recommend crop rotation next season as these insects will emerge each spring. You may also look to keep the area as weed-free as possible so that these insects will not build up populations before moving into your potato patch.

Peak Oil and renewable energy growth

In December, 2021, an article by the energy skeptic, Alice Friedemann, addressed the question of why we hear so much about climate change and so little about peak oil. The article points out that over the previous five years the New York Times mentioned climate change 15,000 times while only referring to peak oil nine times primarily focusing on “It did not happen and never will happen.”

What is receiving more attention regarding the transition to renewable energy is illustrated by an article by Art Berman, available on his web page. In the article, Unanticipated Consequences of the Energy Transition, he notes that the e�ort to reduce our carbon footprint, including biomass, fossil fuels, metals and minerals, is likely to influence the material impact on the planet. It has been increasing at a rate of nearly 3% over the last decade. This rate of growth suggests that the energy transition will increase the material footprint.

In 2020 the US Energy Information Administration showed that both

conventional and unconventional oil peaked in 2018. The International Energy Agency in 2018 predicted there would be oil shortages in four to six years as little new oil has been found or drilled and fracking is expected to peak around 2025.

Friedemann wonders why the majority of our leaders have said nothing about peak oil. Her article covers numerous reasons for not addressing peak oil. While the arrival of peak oil does not mean that oil will no longer be available, it does mean that less of it will be available over time and eventually governments at all levels will be forced to do something about declining oil resources.

By focusing on climate change as the primary threat to the environment and human welfare, actions are being taken to reduce our reliance on fossil fuels which appears consistent with a decline in the availability of fossil fuels, particularly oil. The transition to renewable energy systems is underway in response to climate change but such systems are dependent on fossil fuels. Fossil fuels are essential for mining and processing materials used in renewable energy systems, transporting, installing

and servicing and disposing of them when they are no longer useful. A similar processes will occur replacing them with new technologies.

We have selected a few examples of new projects from the semi-weekly story excerpts provided by the Sun Day Campaign published on June 27 to illustrate a range of new projects supporting the transition to renewable energy. In Wyoming, construction has started on the Trans West Transmission Project which will deliver wind-generated electricity to the California power line. Blackstone Invested $1 billion in Invenergy in support of its solar, wind, storage, transmission and green hydrogen projects.

A 2-GW solar panel factory is slated for construction in Brighton, Colorado, supported by $1.5 billion from Vikram Solar and its investment partners. A solar module recycling facility is targeted for Coachella Valley, California, by Renova Energy, a solar developer, to process end of life solar panels from California and Arizona. Rutgers University has selected DSD renewables to install 14.5 MW on 16 solar carports on parking lots on the university’s property.

O�shore Wind projects are contracted to build transmission lines to bring power to New York. In Illinois, Enel North America is operating a 200 MW wind farm in Dewitt County to provide electricity to Meta’s Dekalb Data Center.

Virdi and AOE have partnered to develop a project in New York to process food waste to renewable natural gas via anaerobic digestion. Some of the gas will be used to produce fertilizer.

LG manufacturing of South Korea is dramatically scaling up its US production of lithium ion batteries for electric vehicles and grid storage. Both existing and new facilities will expand production in Michigan, Arizona, Georgia, Ohio and Tennessee. In Illinois, Rivian is adopting Tesla charge port standards for charging its vehicles starting in spring, 2024. Hyundai and Stellantis are reportedly considering joining Tesla as well.

The new projects represent only a small sample of some of the corporate sized projects occurring in the US. Growth in the renewable energy transition is impressive and ongoing. As it expands the impact of peak oil and increased material consumption will become clear.

ORDINANCE NO. 23-02

AN ORDINANCE ESTABLISHING RULES, REGULATIONS, CHARGES AND FEES FOR THE USE AND SERVICES OF THE WATERWORKS SYSTEM OF THE NORTH PARK PUBLIC WATER DISTRICT, WINNEBAGO COUNTY, ILLINOIS

BE IT AND IT IS HEREBY ORDAINED by the Board of Trustees of the North Park Public Water District, Winnebago County, Illinois, as follows: Section 1. That there shall be and there are hereby established Rules and Regulations for services supplied by the water works system of the North Park Public Water District, Winnebago County, Illinois, as follows:

A. PERFORMANCE BOND

Contractors/developers shall provide a performance bond in favor of the North Park Public Water District in an amount equal to the Engineer’s Cost Estimate shown in Schedule A of the IEPA Construction Permit Application. This bond shall guarantee completion of all proposed facilities shown on development plans and permit applications. The bond shall cover the period of 48 months as set forth in the IEPA Construction Permit. Should the proposed facilities not be completed within a 42-month period, the District reserves the right to complete the project and collect on contractor’s/developer’s bond. Alternative bonding methods (i.e., other agency bonds covering water facilities, etc.) may be accepted at the discretion of the District. Every bond provided for in this Section shall have as security thereon one Surety Company qualified to do business in the State of Illinois and acceptable to the District.

B. MAINTENANCE BOND

Upon completion of proposed improvements, contractors/ developers shall provide a maintenance bond in favor of the North Park Public Water District in an amount equal to ten (10) percent of the final contract price. This bond shall guarantee performance by the contractor/developer under Guarantee Warranty requirements detailed in the District’s Standard Specifications on file with the IEPA. This bond shall be furnished upon the District’s final acceptance and prior to submission of the IEPA Operating Permit Application and shall remain in effect for a period of one (1) year thereafter. Alternative bonding methods (i.e., other agency bonds covering water facilities, etc.) may be accepted at the discretion of the District. Every bond provided for in this Section shall have as security thereon one Surety Company qualified to do business in the State of Illinois and acceptable to the District.

C. DEVELOPMENT, CONTRACTS, AMENDMENTS REVIEW & PROCEEDINGS

Applicant/petitioner/contractor/developer shall be responsible for paying for the Professional Services Fee and costs incurred by the District as a part of each Professional Consultants’ performing their Development Review and participation in Development proceedings. No Development Review or Development Proceeding shall commence until the appropriate escrow account has been established and funded and a professional services fee agreement entered into.

D. ESCROW ACCOUNT AND PROFESSIONAL SERVICES FEE AGREEMENT

1. In order to secure payment by the contractor/developer for any Professional Services Fee and costs incurred by the District, an escrow account (hereinafter referred to as “escrow account”) will be created and maintained by the District. The applicant/petitioner/ contractor/developer shall deposit such amounts as in accordance with the schedule set forth in Section 2 and an overall cost estimate of the Professional Services Required for the project.

2. Applicant/petitioner/contractor/developer shall enter into a “Professional Services Fee Agreement (hereinafter referred to as the “Agreement”).

3. Notwithstanding anything to the contrary contained in this Section, the District General Manager shall have the right to adjust

Upon submission of invoices for services by a Professional Consultant deemed necessary by the District, the District shall pay said invoice out of the specified escrow account. At such time as the balance of the specified escrow account reaches twenty-five percent (25%) of the original amount deposited, the District may require that an additional sum of money be deposited in the escrow account, inclusive of the present balance in the specified escrow account, which could equal or exceed the amount originally required by the District.

F. GOOD STANDING ACCOUNT STATUS

The District will conduct a monthly reconciliation of escrow account and forward its findings to applicant/petitioner. Should the account balance in escrow fall below the required amount, District shall notify the applicant/petitioner/contractor/developer of the same and escrow account brought into good standing by applicant / petitioner / contractor / developer. Any deficiency shall be paid to the Water District prior to the issuance or release of an IEPA construction permit, NPPWD Connection Permit, or service connection to the water system.

G. REFUNDS

Upon a determination being made by the District that payment of all Professional Service Fees and costs associated with a particular project or request has been made, any balance remaining in the escrow account shall be returned to the applicant / petitioner / contractor / developer within ninety (90) days of such determination.

Section 2. That there shall be and there are hereby established charges and fees for the use of and for the service supplied by the waterworks system of the North Park Public Water District, Winnebago County, Illinois, as follows:

A. CONNECTION FEES

1. New Service Permit Deposit: $350.00 each

Shall be assessed for all new water service installations to ensure the integrity of the water service line during the construction process. Once landscaping is complete and final inspection is passed, the District shall refund this deposit in its entirety, unless additional cost has been incurred by the District to address any deficiencies*.

*Note: It is the District’s intent to have all new service installations completed and approved within six months of the substantial completion of the building. In the event the permittee fails to pass final inspection within this given time, or the property is sold prior to the six month periods completion, the District reserves the right to make any and all corrections and retain this deposit. Any costs for these corrections will be charged at Time and Material charges**, if costs beyond the deposit value are incurred, they will be billed to the owner of the property, payment will be required before the property can change hands.

2. Permit Fee: $225.00 each

The fee shall be payable upon issuance of the required Water Connection Permit and shall cover the initial installation inspection of the service connection. All connections shall remain open for inspection. Failure to keep the connection open for inspection may result in the District requiring re-excavation of the service connection at the plumber’s expense. Permittee must give notice that the property is plumbed and ready for a meter to be installed, and said notice must

publication, or within three (3) months from the date of mailing or delivery of Notice to creditors, if mailing or delivery is required by Section 18-3 of the Illinois Probate Act, 1975, as amended, whichever date is later. Any claim not filed by the requisite date stated above shall be barred.

Claims against the estate may be filed in the Office of the Winnebago County Circuit Clerk-Probate Division at the Winnebago County Courthouse, Rockford, IL 61101, or with the estate legal representative, or both.

If after 365 days from the date the permit was issued the service line to the permitted property has not been installed the permit will be considered void. The permit fee will be retained by the District, however the permit deposit will be returned to the permittee if said permit is void.

3. System Development Charge

a. Single family residential lot and condominium unit (individually metered): $1,901 for each single-family lot and each residential unit.

b. Commercial business/office, motel, manufacturing, apartment, modular (mobile) home developments or other commercial building (served by a single meter):

$3,396 for each building service of less than 2-inch.

$4,074 for each building service of 2 through 3 -inch.

$4,753 for each 4-inch building service.

$8,149 for each 6-inch building service.

$10,187 for each 8-inch building service.

$12,223 for each 10-inch building service.

The System Development Charge for Apartments (served by a single meter), including modular (mobile) home developments and Commercial business/office, motel, manufacturing, or other commercial building (served by a single meter) shall be based upon the size of the water service or fire service, whichever is larger.

The System Developmental Charge shall be paid at the time of Water District approval of new water service construction permit applications (IEPA, if applicable) or new water service application (NPPWD).

4. Water Stub Fee (if applicable)

Single family residential service (plus meter charge): $3,396

Up to 1” commercial service (plus meter charge): $4,074

Over 1” commercial service (minimum $3,775): Time and Materials**

The “Connection Fees” do not include surface restoration costs to utility easements or right-of-way areas. These additional costs, if any, will be the responsibility of the subscriber. “Connection Fees” include a water service line installed to the nearest private property line and does not include the cost of the meter. “Connection Fees” include materials and labor for a maximum service distance of 75 feet. Any service footage greater than the maximum will be subject to time and material charges**. Time and material charges** will also apply for all service installations when the frost depth is greater than 12 inches.

5. Water Meter Charge

For all meters (both residential and commercial, size determined by Water District), the cost of the meter will be based upon the actual cost of the meter or materials and installation labor plus 10%**.

The Meter Charges shall be payable upon issuance of the required New Water Service Permit. Properties occupied without a North Park Public Water District meter installed will be in violation of this Ordinance and are subject to a minimum fine of $400.

6. Recapture Fee (if applicable)

Recapture fee will be dictated by the conditions of an intergovernmental agreement whereby a water stub had been installed and paid for by another government entity.

B. WATER MAIN INSPECTION FEES

For all new construction projects, developers shall be responsible to reimburse the District for inspection services during the construction of the water system being installed by themselves or their contractor. In addition, this fee shall also be applicable when contractors are working near the District’s water system and its appurtenances so as to require close inspection of the construction process in order to protect the District’s facilities. The inspection fee will be based upon actual time spent on the project multiplied by the published labor rates (regular time and overtime). The inspection fee will be payable upon completion of the project and prior to an IEPA Water Operating Permit being issued. Estimated Construction Observation costs will be included in the Professional Services Fee Agreement and

the aforementioned escrow account.

C. OTHER CHARGES

Labor Charges:

Labor – (one hour minimum): $75.00 per hr.

Equipment Charges:

Backhoe Time (one hour minimum, plus labor charge): $100.00 per hr.

Track Skid Steer (1 hour minimum): $45.00 per hr.

Mini Excavator (1 hour minimum): $50.00 per hr.

Utility/Pickup Truck Time (1 hour minimum): $20.00 per hr.

Dump Truck Time (1 hour minimum): $25.00 per hr.

Utility Trailer (1 hour minimum): $20.00 per hr.

Portable Equipment (pumps, saws, generator etc.) (1 hr. min.): $10.00 per hr.

** Material or rented equipment charges are calculated at cost or rate plus 10%

Additional Fines and Penalties: Any violation of this ordinance not otherwise provided for herein, shall be punished by a fine of not less than one-hundred dollars ($100.00) and not more than five-hundred dollars ($500.00); and in addition, thereto, the District shall not issue permits of any kind within its jurisdiction to the offending party until the said party has complied with the provisions of this ordinance.

Section 4.The District reserved the right to withhold New Service Permits if circumstances regarding other permits to a permittee warrant such withholding.

Section 5. Applicable legal fees for any required collection proceedings will be added to amounts due.

Section 6. All ordinances, resolutions or orders, or parts thereof, in conflict with the provisions of this ordinance are, to the extent of such conflict, hereby repealed.

Section 7. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.

Section 8. This ordinance shall be published within 30 days after its adoption and shall become effective a minimum of 10 days after such publication as provided by law.
