Lawmakers try to appease both sides in drug pricing controversy

SPRINGFIELD — Illinois lawmakers gave hospitals and community health centers much of what they wanted this session by passing a bill that prohibits drug manufacturers from interfering with their access to discounted medications through a federal drug pricing program.

But they also gave drug companies what they wanted by passing another piece of legislation that calls on the Illinois Department of Insurance to conduct an audit to find out how much money these hospitals and clinics are making off that program, and what they are doing with the profits.

Both bills focus on the federal 340B drug pricing program. Although it is established under federal law, with tens of billions of dollars’ worth of healthcare revenue at stake nationwide, it has increasingly become the subject of state-level political battles as well.

Launched in 1992, the 340B program requires drug manufacturers that participate in Medicaid to provide outpatient medications at substantial discounts to providers that serve large numbers of uninsured, underinsured and Medicaid patients.

Those providers, in turn, typically mark up the price they charge their patients for the drugs and use the difference to support their operations.

As the Medicaid program has grown in recent years, so too has the 340B drug program. According to an analysis by KFF, a nonprofit health policy research, polling and news organization, the 340B program has mushroomed in size in recent years, growing from $2.4 billion in drug purchases nationally in 2005 to $66.3 billion in 2023. That growth has resulted in heightened tensions between hospitals and clinics on one side, and the pharmaceutical industry on the other, with each side accusing the other of abusing or manipulating the program for their own benefit.

The 340B-eligible hospitals and clinics have accused drug companies of unfairly restricting their ability to contract with outside pharmacies to dispense the discounted drugs to their patients. That limits the volume of 340B-discounted drugs.

Drug manufacturers, meanwhile, have accused hospitals and clinics of profiting off the system instead of passing the savings on to their patients or using the profit they make from the program to offset their cost of providing charity care.

The battle in Illinois over the 340B program began last year when, at the

urging of federally funded community health centers, the Senate adopted an amendment to House Bill 2371. It was sponsored by Rep. Anna Moeller, D-Elgin, in the House and Sen. Dave Koehler, D-Peoria, in the Senate.

Passed in the final week of the 2025 session, it called for prohibiting drug manufacturers or any other party from interfering with the ability of a 340B-qualified hospital or clinic to acquire the discounted drugs.

That bill also prohibits drug companies from interfering with the hospitals’ and clinics’ ability to dispense the drugs through contract pharmacies. And it shields them from any requirement to disclose any of their cost or income data related to the program beyond what is required under state or federal law.

The bill passed the Senate on a 55-0 vote on May 29 and was sent back to the House for concurrence. But amid strong opposition from the industry lobbying group Pharmaceutical Research and Manufacturers of America, or PhRMA, it was initially not called for a vote, even though hospitals and clinics continued pushing for its passage.

Testifying before a House committee May 26, PhRMA lobbyist Peter Fotos said the bill effectively made it “illegal to ask for receipts.”

“Lawmakers should demand real transparency, real accountability, and a full understanding of the financial impact on state programs,” Fotos said. “We believe those questions must be mentioned before considering a bill to prohibit guard rails.”

It took the inclusion of a bill creating greater transparency around the program to bring the main bill over the finish line in the House by a vote of 113-1 in the waning hours of the session.

‘Transparency’ bill

House Bill 4327, which was described as a “transparency” bill, calls on the Illinois Department of Insurance to conduct an audit of the 340B program in Illinois to determine how much revenue hospitals and clinics are earning through the program and how that money is being used. It was sponsored in the House by Rep. Camille Lilly, D-Chicago, passing 106-8, and Koehler in the Senate, where it passed 57-0. Specifically, it directs the department to gather information from the 340B-eligible hospitals and clinics about how much they pay and how much they’re reimbursed for the medications they acquire through the 340B program. The audit will also examine how much of the money they earn through that price spread is used to fund charity

care or any other program that provides unreimbursed or subsidized care.

The bill also calls on those hospitals and clinics to provide demographic data about their patient population, including the percentage of people they serve who are members of “vulnerable communities.”

Those are defined in the law as uninsured, underinsured and Medicaid patients, people who are billed on a sliding fee scale, racial and ethnic minorities, residents of rural or medically underserved areas, populations with high rates of chronic diseases or poor health outcomes that are linked to social determinants of health, and individuals who are elderly, disabled LGBTQ+ or “justice involved.”

The bill also calls for an examination of how the 340B program affects the cost of other healthcare programs such as Medicaid and state employee group health insurance plans.

And it calls on manufacturers covered by the program to report the aggregate amount of discounts they have provided under the program each year since 2020.

Both bills cleared their final legislative hurdles during the final hours of the session. Afterward, groups representing hospitals and federally funded community health centers claimed victory.

“Today, our legislative champions stood strong in the face of intense industry pressure, to put patients first,” Ollie Idowu, president & CEO of Illinois Primary Health Care Association, a group that represents federally funded clinics, said in a statement. “Because of their courage and leadership, 1.5 million Illinoisans who rely on community health centers will continue to have access to the affordable medications and comprehensive services they need to live healthy lives.”

A.J. Wilhelmi, who leads the Illinois Health and Hospital Association, also issued a statement praising passage of HB 2371.

“Illinois now joins more than 20 other states that have enacted protections for the 340B program, safeguarding patients’ access to 340B medications and the healthcare services those savings support in communities across the state,” he said.

But PhRMA, which had urged passage of HB 4327 on its own, without HB 2371, issued a statement suggesting the 340B program needs broader national reforms.

“Across the country and here in Illinois, 340B is driving up costs for patients, taxpayers and employers instead of ensuring that these savings reach those who need them most,” PhRMA spokesman Will May said in a statement. “PhRMA will continue working with policymakers to advance solutions that protect patients.”

National redistricting battles may turn to statehouses and city councils

After a blitz of congressional redistricting ahead of the midterm elections, a national battle for partisan control is about to enter a new phase that could affect representation on everything from tax rates to social safety net programs, teacher salaries, housing regulations and local road repairs.

Georgia’s Republican-led Legislature will convene June 17 for a special session focused on redistricting for the 2028 elections. The agenda includes new voting districts not only for Congress, but also for the state House and Senate — and potentially even the state’s utility regulatory commission.

It will mark the first time since a recent U.S. Supreme Court ruling weakened minority voting protections that a state legislature will attempt to redraw its own districts. Mississippi Republicans and New York Democrats also could undertake legislative redistricting before their 2027 and 2028 elections, respectively.

Ir remains to be seen, though, how many legislatures will follow, and whether the outburst of mid-decade redistricting will extend down to county commissions, city councils and school boards that make myriad decisions affecting people’s lives. The impact could be widespread.

“The stakes here are not political, they are deeply human,” said Joe Kennedy III, founder of Groundwork Project, a nonprofit that supports local civil rights and democracy organizations.

What’s fueling the redistricting movement?

Voting district boundaries typically are redrawn once a decade after each U.S. census to account for population changes. But last summer, President Donald Trump urged Texas Republicans to redraw congressional districts to try to win additional seats in the midterm elections. Other states followed with their own partisan gerrymandering.

Then a 6-3 Supreme Court ruling in late April jumpstarted even more redistricting. The court struck down a majority-Black congressional district in Louisiana as an illegal racial gerrymander, providing grounds for Republicans in other states to reshape districts with large minority populations that have elected Democrats. Why is Georgia redrawing its districts?

A federal judge ruled in 2023 that some of Georgia’s congressional, state Senate and state House districts were drawn in a racially discriminatory manner. The Legislature quickly approved revised maps with new majority-Black districts, though

they resulted in little change to Republican majorities in the 2024 elections.

Republican Gov. Brian Kemp has called lawmakers into special session to again redraw districts in light of the Supreme Court’s decision in the Louisiana case. That could allow Republicans to undo the court-ordered changes they made in 2023 and potentially redraw other Democratic-held minority districts to the GOP’s advantage.

Republicans have yet to unveil details of their plans. But Democratic state Rep. Tanya Miller, who is running for attorney general, denounced the upcoming redistricting as a means of “rigging maps to maintain power.”

How many seats are at stake?

Several months before the Supreme Court ruling, a report by Fair Fight Action and Black Voters Matter forecast that Republicans in 10 Southern states could eliminate 191 Democratic-held legislative seats — including 140 districts with Black or Hispanic majorities — if the Supreme Court gutted federal Voting Rights Act protections for minorities.

“If anything, our report was an understatement,” Cliff Albright, co-founder and executive director of Black Voters Matter, recently told The Associated Press. “What’s at stake is the future of this democracy.”

Other analysts don’t expect that many seats to be redistricted. But they do expect the Supreme Court’s decision to ripple through states.

“We’re going to potentially see a lot of frenzied efforts at every level, including at the local level, to try out undoing district maps and configurations that have performed quite well in providing improved representation for communities of color,” said Kareem Crayton, vice president of the Washington office of the Brennan Center for Justice.

What states have pending court cases?

The precedent from the recent Supreme Court decision already is being applied in several states. In light of the ruling, a federal appeals court is allowing Alabama to use a state Senate map approved by Republican lawmakers in this year’s election instead of one imposed by a federal judge who found the state had diluted the voting power of Black residents. The change affects two state Senate districts in the Montgomery area.

The Supreme Court has sent legislative redistricting cases filed on behalf of Black voters in Mississippi and Native Americans in North Dakota back to lower courts for further consideration in light of its Louisiana decision. The Washington attorney general has asked the Supreme

Court to do the same for legislative redistricting cases involving Hispanic voters in that state.

What’s stopping states from redistricting?

About half the states have provisions in their constitutions prohibiting mid-decade redistricting of state legislative seats, said Justin Levitt, a law professor at Loyola Marymount University in Los Angeles who runs the “All About Redistricting” website.

But even in states where it’s allowed, lawmakers may have fewer reasons to redraw their own districts than those for Congress, Levitt said. Politicians who promoted congressional redistricting for the 2026 midterms often justified it as a way to counter gerrymandering in other states and win as many seats as possible for their party. They had extra motivation because a swing of only a few seats nationally in the November elections could affect control of the closely divided U.S. House. By contrast, most state legislative chambers already are dominated by one party.

“There’s a lot less incentive, if you already control the state legislature by 10 or 12 seats, to eke out an incremental one or two at the expense of really ticking off your own party membership, or at the expense of maybe risking losing seats in a broader way,” Levitt said.

Could local governments also redraw districts?

The Supreme Court decision making it more difficult to prove Voting Rights Act violations already has affected some local governments.

Plaintiffs have voluntarily dismissed a challenge to commission districts in Meriwether County, Georgia. A federal court has accepted new legal briefs in a challenge to Board of Supervisors districts in DeSoto County, Mississippi. And Indiana’s attorney general has asked a federal appeals court to take note of the Louisiana case when deciding a challenge to how judges are selected in Lake County. Over roughly the past four decades, data from the University of Michigan shows that cities, counties and school boards have been involved in more than three-fifths of the 466 lawsuits alleging violations of Section 2 of the Voting Rights Act, which forbids providing minorities less opportunity than other voters to elect the representatives of their choice.

But that doesn’t necessarily mean local governments will rush to redistrict as a result of a weakened Voting Rights Act. The Supreme Court decision cleared the way for officials to justify redistricting based on partisan ambitions. But many local offices are officially nonpartisan.

Gov. JB Pritzker to suspend tax breaks for data centers, urging more discussion

CHICAGO — In a surprise move, Gov. JB Pritzker announced Friday that he is putting a pause on all new state tax incentives for data centers and calling on lawmakers to pass new data center reforms during the fall veto session.

The governor has directed the Illinois Department of Commerce and Economic Opportunity to pause all new agreements starting July 1, fulfilling a proposal he made during his budget address earlier this year. The data center tax incentives have been in place as part of bipartisan legislation signed by Pritzker during his first year in office.

From 2020-24, there were 27 data centers that benefited by more than $983 million from these tax incentives, according to a state report.

In his announcement, the governor cited growing impacts on energy affordability and water resources.

“Illinois has an opportunity to continue leading in technological innovation and economic growth, but we also have a responsibility to protect working families and local communities as the data center industry rapidly expands,” Pritzker said.

“I am directing my administration to pause the processing of data center agreements while we continue working with the General Assembly and stakeholders on a comprehensive framework that protects affordability, safeguards our natural resources, and ensures responsible growth across Illinois.”

The move comes after lawmakers failed to pass House Bill 5513, known as the POWER Act, by the spring session deadline on May 31, following months of committee conversations and advocacy from environmental groups.

The bill would have required data centers to pay for and supply their own renewable energy, track and report water usage and enter community benefits agreements with the municipalities where they’re based. After the bill failed to pass, lawmakers said negotiations would continue over the summer.

Advocates earlier lamented a ‘lack of engagement’ from Pritzker on supporting the bill.

When it was clear the bill wouldn’t be ready for prime time by the spring deadline, lawmakers from both chambers sent a letter to Pritzker calling for a tax credit pause.

“We believe the responsible course of action is to pause the data center tax credits and exemptions in the FY 2027 budget

until common-sense guardrails are in place,” they wrote in the letter, obtained by Capitol News Illinois. “It is not only fiscally irresponsible, but also unconscionable to continue to provide millions of taxpayer dollars to Big Tech corporations harming our climate, straining our grid, and making electric bills unaffordable for working families.”

However, House Speaker Emanuel “Chris” Welch, D-Hillside, told Capitol News Illinois earlier this week that the pause on data center credits did not have the support of the Democratic caucus to get through session, saying “not only did it struggle, it wasn’t even close.”

“Now, let’s be clear, we certainly hear people’s concerns about data centers. We’ve had numerous hearings about them. I represent parts of DuPage County, so I hear those conversations about noise, water consumption, and energy costs,” Welch said. “I know how hard our friends in the environmental energy space are working on this very topic. They’re complex issues that just don’t get done right away.”

Resource strain

Data centers have already put a major strain on energy infrastructure, driving up demand and prices for regular customers — and many more are seeking access to Illinois’ grid.

Actual and projected demand from the data centers raised costs by $13 billion over the past two energy auctions on the PJM interconnection, an electric grid that provides energy to 13 states, including northern Illinois.

A February report from the Union of Concerned Scientists found those costs could increase by another $37 billion in Illinois alone over the next 25 years.

Those rising supply costs have added an average of $12 per month to residential customers’ bill over the last four years, according to ComEd CEO Gil Quiniones. It would have been even higher, around $16 per month, absent ratepayer relief built into the state’s 2021 landmark climate bill. ComEd, which receives energy from the PJM grid, has nearly 100 data center requests in its pipeline. If all were to come to fruition, they would draw more than 30,000 megawatts — nearly 1.3 times higher than ComEd’s historic peak rate of less than 24,000 megawatts in July 2011.

The requests from data centers seeking to access the grid in ComEd’s service territory are increasingly larger in size and scale.

“Really, it used to be the average size of data center applications are in the 150- to

200-megawatt range,” Quiniones said. “Now it’s 700- to 750-megawatt range. It’s because of those big training data centers.”

The huge surge in demand by data centers, which ComEd said has accelerated at an “exponential pace” since 2019, comes at a time when the state is facing projected energy shortfalls that are expected to drive up energy costs if not resolved.

Labor calls for ‘pause on pause’

Organizers from Climate Jobs Illinois and the Illinois AFL-CIO called Pritzker’s tax credit pause “shortsighted” and called on him to “pause his pause.”

The tax incentive legislation required data center owners and operators to require their contractors to enter into approved project labor agreements to qualify for the benefits.

In a joint statement, the labor leaders accused Pritzker of issuing an order “to generate headlines, rather than practical results.”

“This pause does nothing to lower utility bills, protect the grid, or advance clean energy,” they wrote. “Instead, it will send billions of dollars in investment and thousands of union jobs to Indiana, Kentucky, and Ohio — states that sit on the same electrical grid, where those data centers will be built anyway, just without Illinois workers protected by nationally leading labor standards and without the clean energy requirements we’ve collaboratively fought to establish here.”

Other legislative proposals

In addition to ordering a pause on the tax incentives for data centers, the governor proposed six other principles for reform.

Pritzker urged lawmakers to work with consumer advocates, labor organizations and environmental stakeholders to pass legislation in the veto session that would: require data centers to pay for the costs of their energy and water demand, require them to support the generation of new renewable energy, to track and report water use, to adhere to air quality standards and to enter agreements with the communities that host them.

He also advocated for legislation that would allow utilities to prioritize power to residential and regular business customers in times of high energy demand.

“Data centers should temporarily go dark when the grid is strained to ensure reliable electric service for Illinoisans,” the proposal said. “Data centers that don’t supply their own clean energy could have their electric service interrupted when the grid is strained so Illinoisans’ lights

stay on.”

ComEd CEO Quiniones told Capitol News Illinois in a recent interview that the utility also sees interruptible service for data centers as part of the solution to protecting energy affordability, along with more deployment of solar power and battery storage — both elements of a major energy reform package Pritzker signed at the start of this year.

Consumer and environmental advocates applauded the governor’s announcement and said they expected to continue conversations with lawmakers.

Abe Scarr, director of the Illinois Public Interest Research Group said “the devil is in the details” but that the organization supported the “direction” of the framework. Illinois Environmental Council CEO Jen Walling also cheered the news.

“We’re thrilled to see Governor Pritzker’s comprehensive framework to address the growing impact of data centers on our energy, water resources, and local communities,” Walling said. “We look forward to working with Governor Pritzker, state lawmakers, and other stakeholders toward our common goals: holding data centers accountable for their outsized impact on our natural resources and communities while prioritizing fairness, transparency, and Illinois’ clean energy future.”

The transition to renewable energy continues

Assuming energy supplies from fossil fuels are in overall decline and are leading to intense competition between countries to secure them to support their existing economies we hope the war in Iran will not expand. Such wars involve heavy environmental damage including climate change.

The impacts of climate change will not disappear even if governments succeed in suppressing reports on the damages occurring from using fossil fuels. In our early efforts to advocate for energy efficiency and renewable energy we sponsored a meeting on climate change. The meeting included a presentation addressing the increasing amount of ice melt occurring in Greenland associated with climate change. After the session a reporter commented to me that he was told by executives for whom he worked to not mention climate change on his weather reports.

The silencing of the discussion of climate change interferes with the concept of a free press but fortunately other sources still exist to report on it. The overall trends from the global impacts of climate change indicate the increasing adverse consequences of it on people, property, animals and the planet. The impacts include hotter summers, warmer evenings, more intense storms, increase floods, droughts, water shortages, damage to agriculture and more refugees fleeing ravaged areas.

Even though federal government support for renewable energy has been cut there are reports of increases in installations of solar, wind, and battery storage systems in the U.S. The closure of the Straits of Hormuz has stimulated interest around the globe in renewable energy sources as a means to provide a measure of energy security.

In an article appearing in the Tom Dispatch in June 2024 laid out an optimistic perspective on supporting the transition to the Power of Clean Energy.

It provides a historic perspective on the three energy transitions that have occurred over the past 500 years and postulates that a fourth transformation could prove critical for humanity’s survival. Back in in 1896 Swedish physicist Svante Arrhenius reported that burning carbon held the potential threat of climate change. It could eventually raise the temperature of the Arctic regions by 8 to 9 degrees Centigrade. (A 9 degree C is equivalent to a 48 degree Fahrenheit temperature.)

During the early years of sponsoring Energy Fairs the cost of the technologies limited the number of installations. But now the cost constraints holding back the adoption of these technologies have been eliminated .According to the International Energy Agency that the world’s best solar schemes are already providing the “cheapest electricity in history”. Reports from the Solar Campaign in the U.S. verify that the cost of electricity from solar and wind are the least costly electricity being produced. In

a recent discussing with an engineer he reported that his solar system provides him with enough electricity to meet his electrical demand for 9 months of the year. Other owners of solar system have purchased electric vehicles to use their own solar system production to fuel their vehicles. The vehicle batteries can also provide backup electricity for the home if grid power is disrupted.

Back in 2024 the author of the article in Tom Dispatch declared that there are signs that we are on the cusp of a transition to alternative energy of sufficient power to support a new American industrial revolution, As renewables continue to fall in costs their role in the economy will increase.

The increase in the use of solar energy will not eliminate the use of fossil fuels in the economy. However if we are to avoid the worst consequences of climate change we need to more quickly than has been the case to dramatically reduce the use of fossil fuels.

Stacey King, longtime Bulls broadcaster who played on three NBA championship teams, dies at 59

CHICAGO (AP) — Stacey King, who played on three consecutive NBA championship teams with the Chicago Bulls from 1991-93 before returning to the organization as an Emmy-winning, fan-favorite broadcaster, has died. He was 59.

The Bulls announced that King died Sunday and said they were notified by a family member. No other details were immediately available.

“Stacey King was a cherished member of the Bulls family and one of the truly unique personalities in our organization’s history,” Bulls chairman Jerry Reinsdorf said in a statement. “His connection to Chicago, the Bulls and our fans spanned more than three decades — first as a player and later as the unmistakable voice that helped bring Bulls basketball into the homes of generations of fans. We will miss

him deeply and remember the joy, energy, humor, candor and passion he brought to our organization, our broadcasts and our fans every day. Our thoughts are with his family and loved ones.”

King began his NBA playing career with the Bulls, who selected the 6-foot11 forward/center out of Oklahoma with the sixth overall pick in the 1989 draft. He averaged 6.6 points and 3.3 rebounds over his five seasons with the Bulls.

He played a total of eight seasons in the NBA during a career that also included stops in Minnesota, Miami, Boston and Dallas. King posted career averages of 6.4 points and 3.3 rebounds.

As a broadcaster, King endeared himself to a new generation of Bulls supporters. He spent more than two decades as a commentator on Bulls games.

“Stacey loved being a Bull,” Bulls pres-

ident and CEO Michael Reinsdorf said in a statement. “You could feel it in everything he did — the way he played, the way he called games and the way he connected with our fans. He had a unique gift for bringing people together and making every game feel personal. He brought an energy and love for the game that came through in every broadcast, helping fans feel connected to our team. Whether it was through a broadcast, a conversation or a photo with a fan, Stacey made people feel seen and valued.
