FROM THE PRESIDENT Is it just me or has the 2020 March Madness been the maddest of them all?!

I am beyond grateful for the month of April. It is filled with new beginnings.

Flowers popping through the earth, trees budding, songbirds chirping.

Warmer months also allows for a surge in different segments of our industry.

Home exterior finishes, landscaping, digging holes, pushing dirt instead of snow, and let’s not forget our favorite, ROAD CONSTRUCTION! Thank you so much for hanging in there with me for the winter months and debatably the Maddest March ever. Good times are ahead!

As you may be aware, we have chosen to postpone several events due to the uncertainty we are facing with COVID-19. While the decision to postpone events was not easy, we have chosen to put the safety and wellness of our membership above all else and abide by our state’s enforcement of the “Stay At Home” order.

Studs, Struts and Stilettos: This staple event supports a local non-profit, Habitat for Humanity, and features handcrafted original fashion designs modeled by members of RAB and our community. Due to the postponement of this event, we have been granted more time to create and submit design entries. If you find yourself needing a creative outlet during this time of social-distancing, consider creating a design to be entered in the show! The event is supported by sponsorships and donations to the cause. If you find that you have been called to contribute to a charitable event, please feel free to reach out to Rebekah Nielsen or any of the Studs, Struts and Stilettos committee members about sponsorship opportunities. Updates and information about tickets to the show can be found on the Studs, Struts and Stilettos Facebook page or the RAB Website.

Spring Showcase of Homes: Picture this… it’s a sunny day, light breeze, 65 degrees…the Rochester community is released back into the wild after practicing social distancing for the last several weeks. And what better thing to do on a weekend after being

cooped up than attend the Showcase of Homes?! Our members can use this opportunity to flaunt our best work and generate leads for consumers ready to build or purchase. We have a tentative reschedule date for the showcase, but will wait to release this date until we have a better grasp on what executive orders from our Governor will be in place in order to proceed in compliance.

April Networking Night: Are all the extroverts going as stir crazy as I am since not getting the networking fix in March? April will not have any networking nights. However, if you would like to have a Facetime happy hour with me, I could make that happen…I hear they are all the rage right now.

Golf Outing: Do not panic. This event is a member favorite and we are doing everything in our power to ensure it must go on! The date has been set for June 1st, however, we are monitoring the situation daily and will adjust as necessary. We greatly appreciate your patience and understanding! I am very excited we have a valued member, Somerby, hosting this year’s golf outing!

Highlights: • John Eischen was kind enough to put together individual take home

“build your own toolbox” packages for families that needed an extra activity to keep their little ones entertained at home. This fun activity is one simple, fun way that we can introduce a career in the trades to our youth.

• Rochester Area Builders was also featured on KIMT News about gathering N95 masks to donate to our healthcare workers. Thank you to all who donated. We try to limit the amount of emails we send to you to only the very important things, and I hope you have found our communication in the past few weeks to be informative and helpful.

The City of Rochester supports local businesses March 26, 2020 – Rochester, Minnesota – City of Rochester continues its efforts to support local businesses during the COVID‐19 pandemic. “This is a challenging time for all of us,” says Rochester Mayor Kim Norton, “the impact to our local small businesses is very tangible and very real.” Norton encourages Rochester residents to continue to frequent local businesses that remain open during the Stay at Home order whenever possible but recognizes that won’t be enough. “I am pleased we were able to quickly respond to the Chamber of Commerce’s suggestions on further steps to support our local businesses. The City continues to implement new practices during this time to ease the financial burden caused by COVID‐19.”

Below are a variety of options that are now in effect:

NEW Options for deferment of liquor license renewal payments The City of Rochester will allow deferral until November 13, 2020 of annual on‐sale liquor license renewal fees—an expansion on previous deferral options. The City is considering additional measures to reduce the burden on businesses that have already paid renewal fees but have been unable to be open for business.

NEW Municipal parking ramps Contract parkers affected by business closures or other COVID‐19 related impacts may request a temporary suspension of their monthly contract parking for the month of April. Doing so will not affect your future contract eligibility. Refunds will be provided for those who have already paid for the month. Contact Reef Parking at rochesterparking@reefparking.com to initiate the process.

COVID‐19 Emergency Economic Development Loans The City of Rochester has allocated $250,000 from the City’s Economic Development Revolving Loan Fund to the COVID‐19 Emergency Loan Fund.

The newly established fund provides assistance to small local businesses to help keep them operating, including helping to support their employees in times of loss of or declining business. On‐street parking The City of Rochester is extending through the end of April temporary changes suspending the enforcement of both residential permit‐only parking zones and metered parking spaces.

COVID-19 Basic Infection Prevention Measures COVID-19, caused by a new coronavirus, is a respiratory illness that can spread from person to person.

The following infection prevention measures may help prevent transmission on construction job sites.

Stay home if you are sick. DO NOT WORK. Wash hands frequently or provide alcohol-based hand rubs containing at least 60% alcohol.

Cover coughs and sneezes.

Practice social distancing — try to maintain 6 feet between each worker.

Reduce the size of any group at any one time to ten (10) people or less or LIMIT all in-person meetings.

Minimize ride-sharing. While in vehicle, employees must ensure adequate ventilation.

Avoid sharing tools with co-workers, if possible.

Clean and disinfect frequently used tools, equipment, and frequently touched surfaces (door handles, handrails, machinery controls, cell phones, tablets) on a regular basis.

If N95 respirator masks are not available, minimize dust and airborne contaminants by using engineering and work practice controls.

Use proper personal protective equipment (PPE) when cleaning and disinfecting, such as gloves and eye protection.

2020 MINNESOTA STATE BUILDING CODE ADOPTION On Tuesday March 31, 2020, six new Minnesota construction codes are scheduled to take effect. Although this adoption is occurring during the COVID-19 pandemic, the construction industry has been fully engaged in the process of developing changes to the new codes over the past two years and are anticipating their implementation.

COVID-19: PREVENTING THE SPREAD IN THE WORKPLACE This talk discusses practices to prevent the spread of COVID-19 in the workplace, including how the disease is transmitted, symptoms of COVID-19, and ways to stay safe and healthy.

Symptoms of COVID-19 include fever, cough, and shortness of breath. In severe cases, patients can develop pneumonia and multiorgan failure. In general, older people and those with preexisting medical conditions are more likely to experience severe or fatal cases of COVID-19.

How is COVID-19 spread?

Are face masks a good way to prevent yourself from getting the virus?

TALK Coronavirus disease 2019, or COVID-19, is a respiratory illness caused by a virus in the group of viruses known as coronaviruses. Other coronaviruses include Middle East Respiratory Syndrome, or MERS, and Severe Acute Respiratory Syndrome, or SARS. Most cases of COVID-19 are

COVID-19 mainly spreads between people who are in close contact with one another and through respiratory droplets that are produced when an infected person coughs or sneezes. It is also possible to get COVID-19 by touching a surface or an object on which a virus-containing respiratory droplet has landed and then touching your mouth, nose, or eyes, but according to the Centers for Disease Control and Prevention, or CDC, this is not the main way the virus spreads. It may also be possible to spread the virus before developing symptoms.

Because there is currently no vaccine or specific treatment for COVID-19, the best way to prevent illness is to avoid being exposed. To prevent the spread of COVID-19 and other infectious diseases Continued on page 2

COVID-19: PREVENTING THE SPREAD IN THE WORKPLACE remember the acronym WASH, which stands for Wash, Avoid, Sanitize, and Hold: •

•

Wash your hands with soap and water for at least 20 seconds, especially after a cough or sneeze, after using the restroom, before eating, and after touching a surface like a door handle or coffeepot that has been touched by many people. If soap and water aren’t available, use an alcohol-based hand sanitizer with at least 60 percent alcohol.

Apply hand sanitizer to the palm of one hand, rub your hands together, and rub the gel all over the surfaces of your hands and fingers until your hands are dry. This should take about 20 seconds.

Avoid close contact with people who are sick.

Stay at least 6 feet from infected people, and minimize unnecessary physical contact in general, such as shaking hands. If the virus is spreading in your community, consider avoiding crowds and large gatherings. Take extra precautions if you or someone you are in close contact with is in one of the groups at higher risk of severe illness from COVID-19.

Sanitize surfaces that people frequently touch, such as microwave and door handles, bathroom fixtures, countertops, phones, copiers and printers, elevator buttons, shared hand tools, and machinery controls. Use a commercial disinfectant or a solution of 1part bleach to 10 parts water.

Hold the inside of your elbow to your mouth to cover coughs and sneezes to stop the spread of the virus through hand contact. Try to cover your nose and mouth with a tissue when coughing or sneezing, and properly dispose of the tissue immediately after use.

If you develop symptoms of COVID-19 and you have been in close contact with an infected person or you live in or recently traveled to an area where the virus is spreading, call your healthcare provider. He or she will determine whether you need to be tested for COVID-19. If you have the virus, stay home except to get necessary medical care, and stay away from other people in your home as much as possible.

The CDC does not recommend face masks for people who are not sick, working in health care, or taking care of someone infected with COVID-19. You should only wear a mask if a healthcare professional recommends it.

It is also very unlikely you will catch COVID-19 from packages or products that ship from areas where the virus is widespread. Coronaviruses do not survive very long on surfaces, and there is no evidence that any cases have been contracted this way.

Finally, it is important to remember that COVID-19 is not associated with any particular nationality or racial group. Although people who live in or travel to affected areas have a higher risk of catching and spreading the virus, anyone who is exposed to the virus may become infected. It is important to avoid stereotyping, making negative remarks, and behaving unkindly to people based on assumptions.

The most important thing you can do to protect yourself, your family, and your community from COVID-19 is to follow the good hygiene practices we discussed.

Local law enforcement supports Governor Walz’s “Stay at Home” Executive Order through education and encouragement efforts March 26, 2020 – Rochester, Minnesota – The Olmsted County Sheriff’s Office (OCSO) and Rochester Police Department (RPD) are strongly encouraging residents to abide by the regulations put forth in Governor Walz’s “Stay at Home” Executive Order (EO #20-20), but local law enforcement will not be actively looking for violators of the EO on the roadways.

“The data we’re seeing so far confirms our belief that Minnesotans are self-regulating,” said Rochester Police Chief James Franklin. “People are implementing social distancing guidelines and – for the most part – staying home.”

OCSO and RPD will continue to enforce traffic and other violations, but they will not be pulling over citizens in relation to the EO #20-20. They also want to reinforce that individuals are encouraged to get fresh air and exercise outdoors, but do so while maintaining social distancing recommendations.

Other States are requesting drivers receive employer-issued permissions to travel for their work, but at this time, this paperwork is not being requested or checked by local law enforcement in Minnesota.

While the Governor’s Order does not specifically address every workplace or employee function, Olmsted County Sheriff Kevin Torgerson reminds residents that it does offer a general sense of what is deemed essential while the “Stay at Home” order is in effect. “We encourage people to use their best sense of judgment in determining whether they must travel,” said Sheriff Torgerson. “Staying at home and isolated away from other people is in the best interest of everyone’s health and safety at this time including our deputies and officers.” ###

City of Rochester Announces Declared State of Emergency While Highlighting Continuity of City Services March 20, 2020 - ROCHESTER, MINN. – The health and safety of our Rochester community continues to be the City of Rochester’s top priority. On March 13, 2020 Governor Walz declared a peacetime emergency and on March 17, 2020 Olmsted County declared a health emergency due to COVID-19. The City of Rochester is declaring a local emergency with the hope that it brings clarity to the community that Rochester is and will continue to comply with the recommendations of those orders, as well as have the authority to enact additional authorities. In addition, the City continues to work on ensuring community members and businesses have the information and resources they need.

Mayor Kim Norton shares, “It is vitally important that all community members take seriously the current situation our city, state, nation and the world faces. We ask that you follow the guidelines and recommendations of our public health entities. This is especially important with social distancing, which includes the need to have our youth stay away from congregating together. SALES TAX GRACE PERIOD Restaurants, bars and other hospitality businesses impacted by the temporary closure order have a 30-day grace period in paying sales and use tax. During this time the Minnesota department of Revenue will not assess penalties or interest. This means that affected businesses with a monthly Sales and Use Tax payment due March 20, 2020 will have until April 20 to make that payment.

I wanted to reach out to let you know about a couple changes that are happening right now with continuing education at DLI. First, management has decided to extend the continuing education reporting deadlines 90 days for anyone whose license expires in March, April, or May 2020 per Minn. Stat. § 326B.0981, subd. 13. Licensees will still have to submit a timely license renewal in order to avoid late fees, but we will renew their licenses without all CE completed. DLI will follow up with these licensees to ensure CE compliance down the road.

Second, I know the restrictions on group gatherings have created a lot of difficulty for everyone. I have had several sponsors reach out to me about the use of using Zoom. I have done my own research on the product, and it is acceptable to use on approved classroom courses during this time. If you make the decision to use Zoom or any other product of that type, you will need to follow some guidelines. First you will need to email me your plan to use it and what courses you will be teaching. The instructor will need to be able to see all of the attendees at all times, and the attendees need to be able to see the instructor at all times. These are treated the same as a classroom course, just safely from their homes.

If you have internet courses nothing will change for those. If you are interested in putting on online courses you will need to first have your course approved through either the IDECC or IACET, and then submit it to DLI for approval.

I will be working be working from home a couple days a week during all of this, so the best way to reach will be by email. Please email if you have any questions or concerns about continuing education.

Dear Rochester Area Builders Inc With recent events, some of our business customers have inquired if claims related to Coronavirus Disease (COVID-19) would be covered. One answer does not fit all circumstances. As with any situation, a claim may be submitted and the carrier will take the appropriate steps to evaluate the coverage of a Coronavirus-related claim under the policy in question.

What we can share is an excerpt published by the Executive Director of the Independent Insurance Agents and Brokers of America (Big I) Virtual University, Christopher J Boggs, about Coronavirus and Business Income Losses and Workers Compensation, found below: Q. Is there business income coverage if a governmental authority (civil authority) requires businesses to close?

A. Generally, no, there is no business income coverage. This is the short answer. Before business income responds there must be damage to property leading to the cessation of a business. This requirement applies to business income dependent property losses (supply chain) and civil authority losses covered by business income policies. Additionally, there is a specific property exclusion applicable to viruses that may (generally will) apply. This is true of standard business income forms; there may be some proprietary forms that respond, but these are rare.

Q. Does Coronavirus create a workers’ compensation exposure?

A. Two tests must be satisfied before any illness or disease, including the Coronavirus, qualifies as occupational and thus compensable under workers’ compensation:

The illness or disease must be occupational, meaning that it arose out of and was in the course and scope of the employment; and The illness or disease must arise out of or be caused by conditions peculiar to the work.

Whether an illness arises out of and in the course and scope of employment is a function of the employee’s activities. The simplest test toward determining whether an injury arises out of and in the course and scope of employment is to ask: Was the employee benefiting the employer when exposed to the illness or disease? Be warned, this test is subject to the interpretations and intricacies of various state laws.

Qualifying as occupational is the relatively low hurdle. The higher hurdle is whether the illness or disease is peculiar to the work. If the illness or disease is not peculiar to the work, it is not occupational and thus not compensable under workers’ compensation. An illness or disease is peculiar to the work when such a disease is found almost exclusively to workers in a certain field or there is an increased exposure to the illness or disease because of the employee’s working conditions.

For example, black lung disease in the coal mining industry is a disease that is peculiar to the work of a miner. Coal miners are subject to prolonged exposure to higher-than-normal concentrations of coal dust leading to black lung disease. This makes the disease peculiar to the coal mining industry. Another example of an exposure peculiar to the work is a healthcare worker contracting an infectious disease such as HIV or hepatitis as a result of contact with infected blood. The worker’s unusual or peculiar exposure to such diseases results in an illness that is occupational and compensable.

Does the Coronavirus create a workers’ compensation exposure? The short answer is, not likely. Other than the fact that the Coronavirus is currently garnering intense attention, in most cases it is no more occupational than the flu.

CITY OF ROCHESTER BUILDING SAFETY DEPARTMENT PUBLIC SERVICE DESK CLOSURE AND PROCESS CHANGE INFORMATION IN TIME OF THE COVID19 PUBLIC HEALTH EMERGENCY Purpose: This information sheet serves to update the status and changes to our processes resulting from the health emergency precautions related to the COVID19 pandemic. Our goal is to protect the health and safety of both our staff and our community partners during this time with minimal impact and disruption to services. Process changes currently enacted are listed below.

Current Operational Status: City Leadership has closed all public service desk locations throughout the City of Rochester.

City employees are still working, answering phone calls and emails, processing permits and making inspections. We are also applying social distancing when performing inspections and using special protocols where possible.

To be clear, the office is not closed, just closed to the public from direct in-person interactions.

Communications: 1. Face-to-face: There shall be no face-to-face meetings or direct in-person contact at City buildings. No exceptions to this will be allowed (excluding field work described below) 2. Telephone: Telephone communications shall occur using the department phone number 507-328-2600 as normal or by calling directly to the person you need to reach 3. Email: Email communication shall continue as normal working directly with staff or using the general department mailboxes: a. For general department items contact buildingsafety@rochestermn.gov b. For rental housing items contact rbsrental@rochestermn.gov Permit Request & Issuance: 1. Electronic: Online access for many services is still available on the Citizen Access website at https://aca.rochestermn.gov/CitizenAccess/Default.aspx where the following can be done: a. Permits, building and trades, can be paid for by credit card when ready to issue b. Licensed professionals can submit applications for trade permits c. Inspections can be scheduled for building and trade permits d. Rental housing fees can be paid 2. Via Email: Communication related to permit applications and plans can be handled via email with the staff appropriate to addressing your questions. During this time, anyone unable to submit permit applications can send them in by email to the appropriate email address as noted above. As permits are approved for issue and paid, 1|P a g e

Building Safety COVID19 Health Emergency Operations Guide by online payment, checks mailed in or dropped off, or using a Trust Account, staff will communicate once the permit package is ready for pickup at the department in the cordoned off section of the lobby as marked by signs.

3. Drop Off: Permit applications, not submitted online or via email, may be left in the appropriately marked drop off box just inside the Building Safety entrance. Applications dropped off can be paid with a credit card online once they are ready to issue on the Citizen Access website, by dropping off or mailing in a check clearly marked with the permit details, or using an existing Trust Account.

4. Pick Up: Approved permits may be picked up in the designated section of the Building Safety lobby. When a permit packet is ready to be picked up, you will be contacted by the department. Please confirm an estimated time and date the permit and approved drawings will be picked up so they can be ready to be pick up in the designated area of the lobby.

Inspections and other Guidance: 1. Rental housing a. Inspections are cancelled until further notice with nothing being scheduled until after May 1st, which is subject to change as the situation progresses 2. Occupied dwelling construction inspections (building & trades) a. Inspectors will not enter occupied dwellings and Building Safety does not consider the residents not being home at the time of inspection as unoccupied b. Inspectors will work with permit holders to conduct inspections (building and trades) of occupied dwellings by alternative means if possible i. This means conducting the inspection by recording a video, taking photos, or a video call (using Face Time for example) ii. Please provide contact information when scheduling the inspection c. We will conduct emergency inspections such as electrical service or fuel gas 3. Non-occupied dwellings and buildings a. New construction inspection will continue with no change at this time b. Commercial inspections will continue with no change other than any protocols to observe put in place by the customers 4. Investigations and inspections of citizen concerns/service requests will continue

Economic Forecast On the economic front, NAHB's current outlook calls for markedly nega ve second quarter GDP growth and a jump in job losses. The Federal Reserve acted aggressively to lower the federal funds rate to effec vely zero and restart a program to purchase mortgage-backed securi es. These ac ons should help stabilize mortgage interest rates.

State of the Industry In the near-term, builders should be prepared for approval and other business delays, check on their subs and workforce, and watch their cash reserves. Once mi ga on efforts end to check the spread of the coronavirus, housing should be set for a rebound given low mortgage rates.

Legisla ve Outlook In Washington, the House passed and the Senate approved the Family First Coronavirus Response Act. The bill will guarantee free coronavirus tes ng, establish paid leave for all employees, enhance unemployment insurance, expand food security ini a ves and increase federal Medicaid funding.

GRADUATING HIGH SCHOOL STUDENTS POST-SECONDARY SCHOLARSHIPS Rochester Area Builders, Inc. is proud to announce their 2020 scholarship program.

Either $1000 or $500 non-renewable scholarships are available for graduating high school seniors and college freshmen. Scholarships are made available through the Remodelers Council, the Commercial Builders Council, the Builders Exchange of Rochester, and the Youth Sporting Clay Shoot.
