Well, the rain is now behind us, and the welcome warmth of summer has arrived! For all who have been waiting for dry weather to dig basements and get outside work done, this is a welcome relief! In the midst of summer busyness, my thoughts turn not just to watermelon and cold beer (though I do have an appetite for both on a hot summer day), but also to all the work that must be done before the FALL SHOWCASE OF HOMES! I don’t know about all of you, but I always seem to time my showcase home to be completed the day before the showcase begins…stressful!!

Do you know that Rochester Area Builders, Inc. is celebrating its 60th birthday!? We will be celebrating this remarkable achievement on Tuesday, July 30th, at our monthly general membership meeting to be held at RAB office. This association has been going strong for 60 years, and it’s all because of YOU, the loyal members, builders and associates. Without your dedication and commitment to the building industry, we would have never made it this far. Kudos to all of you! I hope to see all of you at our summer general membership meetings! This is a fantastic time to network, see old friends, and make new ones! You’ll also have a chance soon to sign up for the Sporting Clay Shoot, and I highly encourage you to do so. As much as I love summer, the season is way too short, so get out and enjoy it while you can! The Fall Showcase of Homes is a reminder that warm summer days will be turning into cool autumn nights. Calling all Hunters, Shooters, and Outdoorsmen. RAB is hosting our annual SPORTING CLAY SHOOT! We’ll have 20 stations, and each one is different! Teams will rotate through the stations, trying to rack up the highest score possible. Registration forms will by mailed out soon, so get your team of shooters together, or register by yourself and we’ll put you on a team. This event has been so popular that we’re expanding the number of groups and allowing groups of 4-6 to register, to accommodate more shooters. But we still expect it to fill up quickly, so sign up soon!

RAB’s 5 Stand League

As a lead up to the Sporting Clay Shoot, we’ve been running a 5 Stand League this summer! This event is open to RAB members, their spouses, and/or children 12 years or older who have passed hunter safety. You can sign up for as many or as few dates as you want! Participating in the league is not required to participate in the September 5th Sporting Clay Shoot, but if you love to shoot, we encourage you to participate in both! The League will be held at the Gamehaven Boy Scout Camp located at 5015 Simpson Rd SE Rochester, MN 55904. ���������������������� The 2013 Minnesota Legislative Session concluded at midnight May 20th. BAM has prepared a New Law Summary for members only available online. Below is a summary of the above-the-fold issues BAM worked on all session. Sprinklers: The majority of legislators get it: homes built today are the safest in the marketplace and sprinklers are a costly mandate that remove homeowner choice. Bipartisan support to prohibit this costly mandate became abundantly clear this session. From a stand-alone bill introduced by Representative FitzSimmons (R-Albertville) to Senator Senjem’s (R-Rochester) unrelenting quest to amend bills including: Senator Tomassoni’s (DFL-Chisholm) Omnibus Jobs Bill and Senator Schmidt’s (DFL-Red Wing) Game and Fish Bill, the Legislature continues to signal to the Governor that this code mandate is not good policy. Unfortunately, even with overwhelming legislative support, Governor Dayton’s (DFL) unwavering veto threat has derailed the efforts of the industry and thoughtful policy makers. Minnesota Radon Awareness Act: Signed into law as Chapter 43 and effective January 1, 2014 is a provision that, with limited exceptions, will require a seller to provide a good faith disclose to the buyer in writing on whether the seller has knowledge of radon concentrations in the dwelling. Risk Transfer / Anti-Indemnification Law: SF 561 (Sen. Jensen, DFL-Owatonna / Rep. Atkins, DFLSouth St. Paul) is a bill that alters Minnesota’s construction contract statute by making void and unenforceable clauses requiring insurance coverage to other parties for the negligence or intentional acts or omissions of those other parties. BAM worked long and hard to make sure the final bill permits contract clauses to allow for workers compensation, performance or payment bonds, project-specific insurance, and builder’s risk policies. Also protected in this bill are contract clauses that require insurance coverage for vicarious liability and warranty liability (read: homebuilder’s statutory warranties as well as express and implied warranties). Street Improvement Districts: By all accounts, legislation to authorize municipalities to create special “taxing” districts to aggregate and pay for a whole host of street-related improvements met with repeated and unceremonious deaths this session. Despite its success to move out of committees and flirt its way into a variety of Omnibus Bill, we believe the idea is mortally wounded and will not become law in 2013. Fair Market Value – Park Fees: Hidden away in the Omnibus Jobs bill is language first found in HF 321 (Rep. Hornstien, DFL-Minneapolis / Sen. Dibble, DFL-Minneapolis). The language defines fair market value for purposes of calculating park fees by linking the value to annual tax valuation or other relevant data. Applicants may object to a municipality’s calculation of value and negotiation the determination using information gleaned from an independent appraisal. State Tax & Spend Budget Thumbnail: The state’s newly inked $38 billion 2013-2014 biennial budget has some notable tax revenue features. The state will be raising an addition $2 billion in tax revenue to offset an earlier projected $627 million deficit (as well as funding new spending). • Smokers will be paying double the existing cigarette tax as the tax increases from $1.60 a pack to $2.83 a pack. • There will be an income tax increase for high-income earners – the rate will be 9.85% for those making $250,000 filing married-joint and for single filers making $150,000 or more. • We understand that limited business-to-business sales taxes will become law including warehouse and storage sales tax (excludes farm products, refrigerated storage, and electronic data storage) and sales tax on electronic and commercial equipment and repair (to include farm and capital equipment). • The tax bill also includes financing to help Rochester handle the planned expansion of the Mayo Clinic. Much of the spending will be geared toward education and property tax relief.

The New Construction Storm Water Permit: What’s New and How You’re Affected!

Your best defense against permit violations is learning the details of the state’s revised construction storm water permit which goes into effect on August 1, 2013. Because federal rules have changed since the last permit was issued in 2008, the Minnesota Pollution Control Agency (MPCA) updated the general permit to comply with these federal changes. This brief summary of changes described below highlights some significant changes, but is not all inclusive. Get a current copy of the new permit at: www.pca.state.mn.us/y3dqf96. Site considerations during construction • Maintain a 50-foot natural buffer or use redundant sediment controls near surface waters if a buffer is not feasible. • Control flow rates and the total stormwater volume from the site to minimize downstream impacts. • Use conveyance channels to route water around un-stabilized areas, including erosion controls and velocity dissipation devices to limit potential for erosion. • Direct stormwater control discharges to vegetated areas and use velocity devices if necessary to prevent erosion. • Minimize the disturbance of slopes 3:1 or steeper. • Initiate soil stabilization immediately by taking action as soon as practicable, but no later than the end of the next work day when earth-disturbing activities will cease for at least 14 days. • Minimize soil compaction and preserve topsoil at the site. • Temporary sediment basins outlet structure must be designed to withdraw water from the surface. • Sediment basins must be located outside of any natural buffers.

(concrete, stucco, form release oils, curing compounds, and others) at the site must be contained for treatment or proper disposal. • The SWPPP must have a fueling operation plan and emergency spill plan. • Portable toilets on the site must be secured and sanitary waste must be properly disposed of.

Stormwater controls help protect lakes and streams from sediment and other pollutants. Additional Changes

Economic Forecast for 2nd Half 2013:

Sunny with Cloudy Periods Elliot Eisenberg, Ph.D.

Looking ahead at the second half of 2013, the economic news is pretty solid. The US economy is on the mend, the labor market is slowly healing and house prices are up about 10% from year-ago levels. In addition, Europe (while in recession) appears to be holding together, DC budget brinksmanship is fading, car and light-truck sales along with consumer sentiment are rising, and new home construction continues its steady ascent. The only serious domestic fly in the ointment is the significant fiscal drag from Washington as the result of sequestration and year-end tax increases. The biggest foreign drag is Europe’s recession is hurting US exports. With all this in mind, I expect Q3 GDP to be about 1.75% and Q4 GDP to come in slightly higher at 2.1%. As for housing starts, in Q3 they should, for the first time in years, exceed a million units (seasonally adjusted and annualized) with single family starts coming in at 675,000 and multifamily starts reaching a pace of about 340,000. In Q4 single family starts should hit to 700,000 with multifamily starts unchanged. Inflation will remain benign. The combination of weak global growth, flat to declining energy and commodity prices, and flat to mildly rising food prices will keep CPI growth well below 2%. Moreover, the combination of tiny rises in import prices, producer prices, consumer prices and anemic wage growth means that personal consumption expenditure inflation, the Feds preferred inflation measure, will barely exceed 1%, giving the Federal Reserve ample room to continue its program of quantitative easing. As for jobs, despite an improving labor market,

the unemployment rate at the end of the year will remain above 7%. And combined with an annual inflation rate of well below 2%, it makes me think Bernanke and the rest of the voting members of the interest rate-setting Federal Open Market Committee will continue purchasing $85 billion/month in Treasuries and mortgage-backed securities at least through October 2013. Any tapering of QE3 will commence in late 2013 and more likely in early 2014. Another reason why QE3 will be maintained in that due to weak wage growth, consumer spending is rising quite slowly and is being fueled, at least in part, by a decline in the personal savings rate which now stands at a scant 2.5%. Of course rising stock prices, improving home values and easing credit market conditions are also aiding the rise in consumer spending. But a sudden rise in interest rates could derail these positive developments and weaken manufacturing, which is currently neither expanding nor contracting. As such, the risk is simply not worth the return, at least for now. What would change my thinking about QE3 would be consistent monthly non-farm payroll job growth of greater than 187,000. If we manage to achieve that, the Fed would likely reduce the amount of its monthly bonds purchases and interest rates would rise. However, given a growing economy, the rate rises would not be growth-sapping and I put the chances of a new recession at no more than 10%. In the meantime, I look forward to continued, slow and steady improvement the rest of the year.
