Luxury home sales slowed in September
M
ore owners of metro Phoenix’s high-end houses are trying to sell, but there are fewer buyers in the market for a costing between house $500,000 and $3 million. The Valley’s luxury housing market had been bucking the overall slowing trend until recently. In September, 213 houses priced above $500,000 sold in east Phoenix and the northeast Valley. That’s down 10 percent from August and down 7 percent from September 2013, according to the latest Luxury Market Summery published by Walt Danley and Arizona housing analyst Mike Orr’s Cromford Report. The report tracks luxury-home sales in Scottsdale, Paradise Valley, Fountain Hills, Rio Verde, Arcadia, Biltmore, Cave Creek and Carefree, where most of metro Phoenix’s more expensive neighborhoods are located. Listings of houses priced above $500,000 in these areas climbed to 2,295 in September, up 3.6 percent from August and 19 percent from September 2013. Surprisingly, the priciest end of the Valley’s housing market is the strongest. In September, nine mansions costing $3 million or more sold. That’s up from 2 sales in that price range during September 2013. Demand from high-end buyers has enticed more owners of the Valley’s most expensive houses to try to sell. This month, a 25,851-square-foot estate in Paradise Valley was listed for $24 million. The house, built in 2013, has views of Camelback Mountain, 13 bathrooms, six bedrooms, a 3,225-squarefoot master suite, a two-story library, indoor shooting range and commercial elevator that can hold 25 people. This house joins three other Valley homes priced at $24 million or higher, including retired Diamondbacks pitcher Randy Johnson’s 25,000-square-foot Paradise Valley mansion. A few weeks ago, former Phoenix Suns basketball star Steve Nash put his 6,500-square-foot Paradise Valley house on the market. His asking price is $4.15 million, a little more affordable by millionaire standards.

Question: Several years ago, we purchased a home on a golf course in Ahwatukee. Not only did we pay a premium for our home being on a golf course, but our purchase contract stated that “the golf course will remain a golf course.� In addition, our community had deed restrictions that limited the use of the golf course for golf purposes only, unless a majority of the homeowners agreed to amend these deed restrictions. The problem is that the golf course is no longer in operation, and the landscaping is in terrible condition. Being on the golf course is no longer a positive for us. A major homebuilder now wants to buy the golf course to build homes, which would totally destroy any view that we have. Do we have a claim against the developer for the loss in value of our home not remaining on a golf course? Even if the golf course is not financially viable, doesn’t the developer have an obligation to at least properly operate and maintain the golf course? Answer: Until a majority of the homeowners amend the deed restrictions to eliminate the requirement of a golf course, the developer should at least have the obligation to maintain the course. The developer, however, should not have the obligation to actually operate a golf course if it is not financially viable. Finally, if the deed restrictions are properly amended, any misrepresentation that “the golf course will remain a golf course� probably does not result in any claim against the developer. The representations by a developer of a community are generally subject to deed restrictions; covenants, conditions and restrictions; and any other recorded documents. You as the buyer of a home in the community as a matter of law had knowledge of these recorded documents, including the amendment provision by a majority of the homeowners. homes and serving clients long after their peers in other fields have retired. As long as you can handle mentally taxing work and stay current on technology, they say, real estate is practically an ageless profession. “It’s a young person’s business, but it’s an experienced person’s business as well,� said 69-year-old Charles McLean, who has worked in real estate for more than 30 years and is general manager and designated broker for Berkshire Hathaway HomeServices Arizona Properties in Scottsdale. “I really truly believe this: Age is a state of mind.�
One-page contracts and pagers McLean, by the way, lives by those words. Most Saturdays, he can be found indulging in his only “vice�: playing streetball — informal basketball — at a Glendale park with buddies who are decades his junior. He was amused when one player lamented a recent milestone. “He turned 40 and he’s talking about how old he is,� McLean said. A former educator and coach whose first job was farming his family’s land in Colorado, McLean got interested in real estate while buying investment properties in the 1970s. By 1981, he was working as a sales agent. Those were simpler times, he said, when there were no home appraisals or inspections; contracts were limited to one page; and there was room for creativity in the loan process. Circa

1990, McLean recalled, he heard something about computers coming to the workplace and, slowly, he witnessed the evolution of technology. “I remember when we had a (mobile) phone in the office, then a phone in the car, then a cellphone and a pager,� he said. “We also had contract presentations where we went to the seller’s home and figured out how to put the deal together. Now, it’s (done via) text, e-mail, Twitter or phone.� Although some of the job’s duties were simpler in years gone by, Joan Zimmerman, an associate broker with HomeSmart in Phoenix and a Realtor emeritus, said they were also considerably more time-consuming. “There was no MLS (Multiple Listing Service), a listing would be half a page, and we all carried a shoe box around and filed everything in that box,� said the 81-year-old, who began her real-estate career in Arizona on Jan. 2, 1972. “You had to go to the title company, be at the closing, show the property and take the time to get the keys to the house. It’s not easier now, but it’s more efficient.� Bob McDermott, an 82-year-old sales associate entering his 19th year with Coldwell Banker Residential Brokerage, remembers thinking fax machines were “the greatest things ever� and said he has had no trouble adjusting to the computer age. A former soft-drink-plant manager who moved to Arizona from the Midwest in
the 1980s, he said it was a short stint in car sales that convinced him to try real estate. He didn’t like the late hours on the car lot and figured selling homes might keep him at the office only until 7 p.m. at the latest. Of course, he recently mused, modern technology now means he — and nearly every other agent alive — is available nearly 24/7. “I still work till all hours of the night sometimes, and round the clock,� said the Iowa native.
They don’t go it alone These pros don’t take all the credit for their longevity, though. They’ve had help, and they’ve not hesitated to ask for it. When it comes to technology, for example, Becky Engstrom has a couple of secret weapons: grown daughters Kate Anderson and Kari Salvato, who form the Engstrom Team with their mother at their Coldwell Banker Residential Brokerage office in Mesa. “I have a unique situation,� said Engstrom, 71, who has been in the field for 33 years. “Having a team means I can play bridge a couple nights a week or travel. I taught them what I know about real estate, and it’s great to have them with me. They do a lot, especially in the technological portion of the business. It’s a relationship business, but you have to be technologically savvy.� McLean has a son who works in
information technology, so when he needs help, he also has someone to lean on. “The challenge is keeping up with (technology) but also continuing to learn,� said McLean, whose wife, Nancy, is also a Realtor with 30-plus years of experience. “That’s what takes people out (of the profession). They’re tired of all the new stuff.� Zimmerman even took a few months off to take classes on how to navigate an iPhone, iPad and other devices, knowing doing so would benefit her clients. “(A house) is the biggest item the majority of people ever buy, and you can’t mess around with their money, their time or their lives,� she said. In the meantime, these four have no plans to slow down. Quite simply, they like people and they like working. Engstrom, a self-described type-A personality, said, only half-jokingly, that she’s “absolutely petrified� of being at home. “I just can’t do it,� she said “I’ve worked my whole life, so if I take off several days, I feel like a slug.� Zimmerman said she simply thrives on working with clients, and repeat buyers are especially dear. “One couple, in particular, I remember back when they were dating, and I sold them their first home,� she recalled. The couple’s business grew, and she sold them their second home. Then their business grew again, and she sold them their third home. Then the couple retired and Zimmerman sold them a place in Sun City. “A lot of people do think I’m nutty for still working,� she said, “but I really like what I do.�

Ready apartment for winter The cool spell has me reaching for the thermostat to get the house a bit warmer at night. Arizona winters may seem tame to those from back East, but we still need to prepare a few things: Turn on the heat and check the thermostat. In the first few minutes, there can be a musty smell coming from the vents, which might be dust burning off the furnace. It will clear quickly. If it
persists for more than a few hours, contact your apartment manager to check on the air filters or the system. If your apartment has a thermostat, you can program it to keep your home warmer at night and cooler in the day when electricity is more expensive. It’s worth the savings on your energy bill to reprogram the timers. Low tech, inexpensive fixes. When it’s just starting to get cold outside (and inside), you may only need a draft snake
at the foot of your door to prevent cold air from leaking into your apartment. Close the drapes in the evening, too, to keep heat inside. Room heaters. Small space heaters can be an inexpensive way to heat your apartment. It’s best to unplug the appliance when you leave for the day, and turn it off at night so it’s not running for hours. And kids need to be careful near space heaters. Fireplaces need cleaning. Before you light the logs in the fireplace, check that the flue is open and when the chimney was cleaned last because creosote can build up and cause a fire. Make sure
that there are no blockages that could cause a fire or smoke hazard. Watch your fireplace for embers or logs falling outside the fireplace. Have a fire extinguisher close by. (Always check to see if it’s a “no burn� day. Lighting a fire on a no-burn day could mean a hefty fine.) One of the great pleasures of living in in the Valley is the mild winters.
