Study: Homes sold by agents bring in more

H

ire a real-estate agent? List the property ourselves? Some homeowners who are ready to sell debate the issue.

For-sale-by-owner listings, known as FSBOs, are believed by some to be the cheapest way to sell a house. But new research on metro Phoenix home sales from the Information Market shows houses sold by real-estate agents bring in higher prices.

Analyst Tom Ruff of the Information Market computed the difference in prices by comparing public records on sales with home sales listed on the Arizona Regional Multiple Listing Service during the first nine months of this year. Only licensed real-estate agents and members of ARMLS can list houses with the state’s biggest multiple listing service.

The median price of a house sold through the multiple listing service by a real estate agent was $218,000, compared with $161,000. That’s a 35 percent difference.

The difference between the average price for houses sold by real-estate agents and homeowners on their own is 29 percent, or 18 percent based on price per square foot.

Ruff readily acknowledges more lower-priced houses are sold without real-estate agents, so that can skew the data. So he went a step further and took the Maricopa County assessor’s valuations of houses and then used that figure to compare with the properties’ actual sales prices.

That calculation shows Valley houses sold with real-estate agents fetch prices 10 percent higher than FSBOs. Full disclosure: The Information Market is owned by the Arizona Regional Multiple Listing Service. But Ruff’s data looks solid. I spent a few hours trying to pick it apart.

Other interesting findings from the Phoenix-area real-estate agent vs.

FSBO analysis:  About 84 percent of houses sold between January and September of this year were listed on ARMLS.  Ninety percent of all houses that sold above the Valley’s median home price were listed by an agent.  Single men are slightly less likely to use an agent to sell a house.  Couples are more likely to hire an agent to sell.  And 84 percent of fix-and-flip investors list those houses with agents.

Laws can protect new-home buyers from shoddy work

Home prices and features vary by neighborhood. Here are two examples of what you can buy for around $250,000.

Robert Atkins bought a 6,826square-foot house with pool built in 2001 at Oakwood Hills in Chandler. Atkins is a patent attorney in Chandler. The house was sold by Raymond and Glenna Lewis, principals of Adobe Drywall in Phoenix.

Question: In a recent column you said that the buyer of a home to be constructed within two years has no right to cancel the transaction after signing the purchase contract. That makes no sense.

A buyer can cancel within seven days after signing a purchase contract for a vacant lot in a subdivision. A buyer of an existing home can cancel within the 10-day inspection period. Why don’t new-home buyers get the same type of protection?

Answer: The reason is that in the purchase of a new home, there are additional laws to protect the buyer for poor construction. — as opposed to the purchase of a vacant lot in a subdivision or the purchase of an existing home.

If a buyer complains about a construction defect within two years of the home being built, the Arizona Registrar of Contractors requires the builder to correct the defect. If the builder fails to correct this defect, it can lose its license. Also, under Arizona law the homebuilder furnishes an implied warranty of eight years that the home will be free of construction defects.

On the other hand, the homebuilder has protections in the construction of a home. For example, a homebuilder is entitled to insert a clause in the purchase contract that requires arbitration if the buyer claims damages for defective construction. The buyer then will not be able to file a lawsuit or to have a jury trial. The homebuilder is also entitled to a 90-day period, after notice from the buyer, to make repairs of any construction defect before the buyer can even have a claim for damages.

Although the legislative purpose of this 90-day notice provision was purportedly to make resolution of construction defects quicker and less expensive, it and similar delays by the homebuilder, plus legal costs of the buyer, can prevent the correction of any construction defects by the homebuilder. Bottom line: Let the buyer beware. Although “good� homebuilders will stand behind their construction, other builders have earned their “bad� reputation.

Doug Eaton is president and CEO of Vantage Mobility International in Phoenix, a company that modifies cars for disabled drivers.

The house was sold by Christopher and Kristi Synek. Chris Synek is chief operating officer of Tervita Corp., an energy and environmental services company headquartered in Houston.

$2,450,000 Matthew and Nancy Likens paid cash for a 7,603-square-foot house with pool built in Diamond Point at Las Sendas Mountain in Mesa in 2007. Matthew Likens is president and CEO of Ulthera, a medical-device company in Mesa.

The house was sold by Charles and Lisa Maxwell. Charles Maxwell is a principal/shareholder with Maxwell & Morgan in Mesa.

$2,350,000 Michelle Smith bought an 8,103square-foot house with pool built in 2001 at Collice Portnoff Estates in Paradise Valley. Smith is president of Alaska Events Inc., dba Maricopa County Home Shows, in Phoenix. The house was sold by Stuart Moss. Moss paid $4.16 million in cash for a 11,675-square-foot house at Camelback Lands in Paradise Valley back in March.

The good thing is that being in Arizona makes it easy to do both — enjoy the holiday season and buy or sell a home, said Re/Max Solutions real-estate agent and associate broker Kay Wood. In fact, there are several reasons why fall/ winter is a good time to be active in the Valley’s real-estate market, including: Âť The cooler weather, which makes it more bearable to tour homes for sale, let alone move into or out of one. Wood speaks from experience, having purchased her most recent (and 24th!) home — and completed the move — in December 2013. “The cooler temperatures were a plus from the standpoint of packing and unpacking, and it was easier to find a mover midweek for a 40 percent discount,â€? she said, pointing out another advantage savvy homebuyers might want to seek when scheduling a move. Âť The increased number of buyers, such as snowbirds seeking a semipermanent nest or out-of-town relatives who come for a visit and decide to invest a little more time here. “Canadians usually come down in October and are here for six months, and then there are those buyers who are here at the tail end of winter season, in February or March, and may be desperate to find a place to live for the next winter season,â€? she said. cause some people put real-estate transactions on the back burner during the holidays. “The competition is not as fierce from October to December but come January, that January 1-to-April 1 time period is the hottest time to sell a home in Arizona, no matter what kind of house you have,� Wood said. “But there are people who need to move during that October through December period, so you want to capitalize on their timing need.� Case in point: Years ago, Wood had some sellers who wanted to wait until Jan. 1 to list their home, but she urged them to list it Dec. 26. “The first person who looked at it wrote an immediate contract because the house was move-in ready, a cash sale and a quick close. And the house had the warmth of the holiday season, wel-

coming (the buyer) to sunny Arizona.â€? Âť And the bottom line: Lower prices. “Historically, prices go up January through March,â€? Wood said, adding that three years ago, they went up about 28 percent; two years ago saw a 25 percent increase, and last year’s inflation factor was about 5 to 6 percent. That said, there may be tax concerns depending upon your situation, so Wood said it’s always best to consult with a financial adviser or CPA prior to the purchase or sale of a home.

So even if there are visitors staying over throughout the holidays, Wood encourages homeowners wanting to sell their home to make the extra effort to keep the place tidy and, when necessary, duck out for 15 to 20 minutes so potential buyers can do a walk-through

But don’t be afraid to share the season’s festive spirit, which can give prospective buyers a sense of warmth and welcome. “Sometimes, if you offer the potential buyers a morsel of food or something cold to drink, the next thing you know, they’re standing at your kitchen counter, wanting to buy your house,� she said, adding that she has witnessed that kind of thing happen. “Remember that buyers are looking for lifestyle, neighborhood and a place to make new friends, so be warm and welcoming.�

If you are trying to sell your home, remember to keep the seasonal decor simple and the place “show ready� because an agent could call any moment. Wood has been in that situation as well. While taking down her Christmas tree on New Year’s Day several years ago, Wood received a call from someone who used to live in the Valley and needed a home for her college-age kids. “Putting on my professional hat, even on a bad-hair day, I took the clients to the home that they had driven by, pre-Internet, and wrote and executed a full-price offer,� she recalled.

After all, she knows there’s no place like home for the holidays.

Welcoming a new puppy to an apartment For every dog owner who has visited a park recently, you can see that there are lots of new puppies joining in the fun. Apartment dwellers who adopt dogs need to plan carefully for the transition.

Check your lease before bringing your new family member home.

For years, I had two older golden retrievers, and moving them into a highrise went fairly easily. They quickly took to high-rise living because of their age and temperaments.

Just over three weeks ago, I brought home Sophie, my first puppy in years (she took over my column photo today). Sheâ&#x20AC;&#x2122;s reminding me every day that thereâ&#x20AC;&#x2122;s a unique set of responsibilities when you have a young one in an apartment.

House-training Sophie requires more time and commitment. When Iâ&#x20AC;&#x2122;m up, she needs to be out. Sometimes, in these early days of house-breaking, we have made frequent trips downstairs to the grassy corner so we can train. Once we have this training down and sheâ&#x20AC;&#x2122;s a little older, she can wait a little bit, but for now, her needs

come first.

Some communities will allow you to house-train your puppy on the patio or deck. Never leave your dog outside on a patio or balcony alone. Puppies are curious and donâ&#x20AC;&#x2122;t understand heights.

Spend time exercising your puppy. It creates a healthy bond and helps tire out your puppy so she will sleep while you are away at work. Puppies can be particularly destructive if they are bored or anxious. Find toys that your puppy enjoys.

Check out the Arizona Humane Society for tricks on working with your dog on

separation-anxiety issues. Puppies who are left alone can be prone to barking. In an apartment community, this can be very disruptive to your neighbors.

Outside, keep your puppy on a leash at all times, until you are in a safe play area.

Dog parks are great for socializing, and more apartment communities are adding them. Most cities also feature off-leash parks where your puppy can play.

Register your pet with the county and get a license. Lost animals are often returned through the county.
