inding a friend or family member with a real-estate license is like running into a cactus in the Valley. They are everywhere, and there are both positive and prickly sides to using them for your home purchase or sale.

According to Michael Orr, director of the Center for Real Estate Theory and Practice at Arizona State University’s W.P. Carey School of Business, there are 50,840 active real-estate licensees in Arizona. So you don’t have to go far to find someone in the business.

The upside of using friends and family is that they have your back in a business deal in a way others might not.

efinancing is tougher now for many homeowners because of tighter lending guidelines.

Even former Federal Reserve Chairman Ben Bernanke says he is having trouble lowering the interest rate on his house.

This month, he told a crowd at a Chicago conference on senior housing that lending guidelines are so tight he hasn’t been able to refinance. “Unfortunately, Bernanke, like many, found that tightened credit guidelines do not discriminate, especially to those who recently became self-employed,� said Amy Swaney, manager of the Scottsdale office of Citywide Home Loans.

She said the stricter mortgage requirements that went into effect in January have caused many lenders “to go overboard� on income documentation, particularly for borrowers who run their own businesses.

Justin Oliver, a mortgage adviser with the Chandler-based Oliver/Whalen team at Nova Home Loans, said it’s hard for some to understand why people who own a business, have high FICO credit scores and equity like Bernanke can’t qualify for a mortgage. “It’s much harder to prove income when you own a business. Other than tax returns, there isn’t a lot more that we can use to verify a potential borrower’s income,� he said. “In 2008, everyone was upset we didn’t ask for any documentation, which was one of the many reasons that resulted in the mortgage meltdown. Now, a majority of people get upset that we do ask for documentation.�

Arizona mortgage lenders and brokers say concerns from borrowers about tighter guidelines are partly why there hasn’t been as much interest from homeowners in refinancing. “The refinance market in Arizona is almost non-existent,� said Marcia Volin, a mortgage banker with Chandler-based V.I.P Mortgage. “There are still many people who could benefit.�

The seller said that because his wife was on the title to the apartment complex, his wife also would have to sign the contract. The seller’s wife was in Europe at the time, but the seller said that, because his wife was not involved in his business affairs, it would be no problem to have his wife sign the contract when she returned from Europe.

The seller’s wife has now returned from Europe, but the seller said that she refuses to sign the contract. A major factor in her decision not to sign the contract I believe is that, because apartment prices are rising, the seller has received a better offer from another buyer for the 90-unit apartment complex.

Can I require the seller to sell this 90-unit apartment complex to me even though his wife will not sign the contract?

Answer: If the seller promised you that his absent wife would sign the contract when she returned from Europe, the seller should be liable for monetary damages to you for breach of the contract for the 90-unit apartment complex.

Unless you can prove, however, that the seller and his wife are fraudulently using the wife’s failure to sign the contract to get out of the contract, you probably will not be able to get title to the 90-unit apartment complex.

The contract should have had a contingency that would require the wife to approve and sign the contract within a specified time — for example, 10 days — or the contract could be canceled by you.

That obligation may come from what some people have described as a sense of entitlement that friends and family members often have to their home sales. Others may just want to help loved ones who are real-estate agents.

But it doesn’t always work.

Disadvantages “I’ve seen it destroy families. I’ve seen it tear people apart,” said Steve Valentine, a real-estate agent for 16 years and broker with Realty Executives Professional Standards in Glendale.

“Sometimes people feel they were not treated fairly or given enough attention,” he said. “The biggest complaint I hear later down the road, when a friend or family member might not be very qualified, is that they sold the home too cheap. I’ve also seen people get into predicaments with potential lawsuits because of representation they received from a part-time or inexperienced Realtor.”

Kimberly Ryan is an associate broker for Realty One Group in Scottsdale.

Last year, one of her agents complained that her own mother had decided to use someone else to sell her home. Ryan said it was a learning experience for her agent.

“The daughter was very offended,” Ryan said. “She said to her mother, ‘Why wouldn’t you think of me?’ Her mother’s response was that she had thought of her but didn’t want her up in her business.”

their financial situation.

“Sometimes they are your best clients and sometimes they are your worst clients,” Ryan said.

She said that often family members or friends might not be as respectful toward one another as they would be if they were buffered by the boundaries of a business relationship.

“These transactions can be very emotional, and a lot of times what can happen is that because they are family, it is easy to speak more freely,” Ryan said. “There is a certain level of respect an agent has with a client by nature of the fact that they are not family, and we can be more guarded in how we speak to each other. If you are family, those things can go sideways.”

How to make it work Ryan said the most important thing to consider when choosing a real-estate agent, whether he or she is a friend, family member or a stranger, is whether the person is working full-time.

“The market is changing, and if you don’t do this full-time, you have no way of knowing what’s happening in the marketplace,” Ryan explained.

Ryan said that working full-time gives her greater knowledge of Valley neighborhoods and common standards for writing and negotiating offers.

“Right now, the seller is contributing toward the buyer’s closing costs. Five years ago, that was not typical,” she said. “Also you need to have strong negotiation skills, and if you’re not using

“I work with my family, and things are great,” Ryan said. “I advocate for them and protect them just like any oth-

er clients. I’m very confident in my knowledge so I know they are getting the best service they can get.”

She said friends or family members often have an advantage over a stranger in helping a person buy a home.

“They have an idea of your needs, and if they know you well, they know what your tastes are,” Ryan said.

Angie Wigand of Gilbert decided to use her stepfather’s sister when she and her husband were buying a home last year. Both her sister and mother had used her and had a great experience.

“I was on the fence,” Wigand said. “If she had known that I bought and sold a house without using her, I would have felt bad. I didn’t know if it was going to work out, but when it comes down to it, family is the most important thing.”

Wigand was very pleased with how well everything worked out. She was impressed with her agent’s organization and negotiating skills and felt that her agent truly had her family’s best interests at heart.

But Wigand still cautions others in a similar situation.

“If I had someone in my family that was not professional, I wouldn’t trust them with such a huge investment,” she said. “In my case, it worked out. But it is up to the individual and the circumstances. Just because someone has a real-estate license doesn’t mean they are qualified to do the best job for you.”

Like any other business situation, people should consider several candidates before they hire one. Friends or family members should compete alongside others for business. Ryan also suggests checking the number of transactions the agent has done for the year.

That information must be provided by the agent or their broker. The public also can search for an agent through the Arizona Department of Real Estate to see whether he or she has had complaints.

“Give your friends or family members an opportunity to compete. When I am a consumer, I want multiple bids to see who is capable and what they are capable of,” Ryan said. “Anyone can talk the game, but they have to be able to deliver. If you have no confidence in their ability, you have the responsibility to do due diligence and vet out anyone who is not going to represent you well.”

But, Ryan said, “If you have confidence in their ability, if you believe they are 100 percent capable of protecting you and keeping you out of harm’s way and navigating the transaction, by all means use them.”

Address noise issue politely Noise is one of the most common complaints in apartment communities. Clustered housing brings singles, families, young and old together in closer proximity. This can create lasting friendships for many residents. And for some, the noise levels can be too much.

Itâ&#x20AC;&#x2122;s important that residents be thoughtful about their approach to addressing noise issues. Remember that

you live here and so does your neighbor.

Youâ&#x20AC;&#x2122;re both entitled the peaceful enjoyment of your homes.

Last weekâ&#x20AC;&#x2122;s column dealt with checking out the neighborhood before you move and researching noise ordinances.

This week we deal with what to do when the noise happens.

If your neighbors upstairs are hosting a one-time Friday-night party that is disturbing you, it may be best to let it go and let them enjoy.

If your next-door neighbor is hosting

boisterous gatherings all the time and they keep you and your family awake, itâ&#x20AC;&#x2122;s time to address the issue with your neighbor (if you feel comfortable). A short, but clear conversation about the noise levels and its impact on your enjoyment of your home should do it. Try to be polite but direct.

If the noise issues continue, itâ&#x20AC;&#x2122;s time to visit with your community manager and log a complaint. The management will keep a record of the issue, and this could be important if your noisy neighbor becomes a nuisance. Your community manager can also help to deal with construction noise and work with the contractors to limit the hours or impact.

Apartment communities are hubs of activity and connections. Itâ&#x20AC;&#x2122;s important that you do your part to keep noise levels at an acceptable level and have reasonable expectations about noise in a community.

You can use fans inside your home to dull outside noise. Furniture arrangement can help, too. If your bed or couch sits close to a window, there may be more noise in that part of the room. Consider a little redecoration to mitigate noise, and sound machines are great for light sleepers.
