Renovation loans tie together mortgage, cost of home projects

Market booming for luxury housing

M

etro Phoenix’s uberluxury home market is bucking the area’s slowdown in sales.

Sales of houses priced above $2 million were up 63 percent in August compared with a year ago, according to the latest monthly report on the northeast Valley from Walt Danley Realty and real-estate analyst Mike Orr’s Cromford Report.

The increase in the sale of pricier homes has come as some well-known Valley residents have listed multimillion-dollar mansions for sale.

Future Baseball Hall of Famer Randy Johnson is selling his Paradise Valley mansion. The left-handed pitching legend is asking $25 million for the 25,000-squarefoot Tuscan-style home near Mummy Mountain. And jazz musician George Benson is selling his 21â „2-acre Paradise Valley estate for $2.995 million.

Last week, the price dropped from $10.79 million to $7.9 million on a 10,000square-foot estate near the Camelback Golf Club. Personal-injury attorney Glen Lerner is selling the house he purchased for $2.7 million during the housing crash in 2010.

In August, 18 Phoenix-area houses sold for more than $2 million, up from 11 during August 2013.

Overall, high-end home sales in the northeast Valley spanning from Phoenix’s Biltmore area to Carefree are down. In August, 238 houses priced above $500,000 sold in the northeast. That’s down 17 percent from July and down 9 percent from August

$4,250,000 Gilbert and Judy Shelton paid cash for a 7,377-square-foot house with pool east of the Mountain Shadows Golf Club in Paradise Valley.

Gilbert Shelton is a private-equity investor. He has served as a director of Caesars Entertainment Inc. in Las Vegas since 1998. The house was sold by David M. Lunt, as trustee for the Sahwatch Trust, whose beneficiary is John Dawson, president of Plaza Resort Corp. and managing member of Scottsdale Plaza Resort, both of Scottsdale.

$2,700,000 Zupram Enterprises Inc., a Canadian real-estate investment firm whose president is Zach Carter, paid cash for a 6,245-square-foot house with pool built in 1998 at

Mockingbird Estates in Paradise Valley. The house was sold through a trust for the late Joe Bearden and his wife, Diane.

$2,528,711 Elliot Barkan and Michael Block, using an Arizona LLC, paid cash for a new house at Lombardi Estates in Scottsdale. Barkan is a realestate agent in the Valley. Block founded Michael’s Finer Meats and Seafoods in Columbus, Ohio. The house was sold by Sage Lentz, as principal of Sage Luxury Homes in Scottsdale.

Question: Four ago, months my wife and I signed a threeagreeyear ment to rent a home in Carefree. My wife passed away last month. I would now like to move to Los Angeles to be near my children. When I contacted my landlord to tell him I wanted to move out early, he was upset. He said he would cancel the lease with me only when he found a new tenant. In addition, he demanded that I sign a bill of sale transferring all of my furniture to him, surrender the security deposit of $3,000, and reimburse him for a leasing commission that he paid to a leasing agent. I told my landlord that I would be willing to stay in the home and pay rent for no more than six months before I move. What can the landlord do to me?

Answer: If the tenant breaches the lease, the landlord’s first obligation is to make reasonable efforts to find a new tenant, such as hiring a leasing agent and advertising in newspapers. If you notify the landlord that you intend to move out in six months, you have probably anticipatorily breached the lease. Therefore, the landlord will be required to make these efforts now to find a tenant. The landlord should be able to find a new tenant within six months.

Although you will have to reimburse the landlord for reasonable marketing expenses, you would be entitled to the return of your furniture. In addition, if your home is left clean you would be entitled to the return of your security deposit.

list of the desired home repairs or projects. The lender takes that list, and the upgrades are factored into the future value of the home. The amount lent out is based on the future value of the home, and the costs of the upgrades are held in an escrow account.

Two weeks after closing, that money can be dispersed for projects. The bank actually holds the money, and contractors must bill the bank, which cuts the checks after the work is inspected and completed in a satisfactory way.

The loan requires a 5 percent down payment on a home and a credit rating of 620 or higher. Often, a current homeowner is able to lower a current interest rate by restructuring the loan.

Rodarte says this type of financing is better than a construction loan because it does not require blueprints, and it’s more advantageous than a second mortgage because those usually carry a higher interest rate and add a lien on the property. In addition, the interest rate of a renovation loan usually is much lower than those on credit cards.

bersome and requires more work than other loans. The borrower has to estimate the amount for each renovation by comparing contractors — a process used by most people looking to renovate anyway.

But one benefit is that the bank holds the contractors accountable with a check-and-

balance system protecting their investment.

Realtor Russell Harris has used the loan for about eight of his clients. He describes it as “awesome” but agrees it is not for everyone.

“It is for a different kind of buyer, but a smart buyer,” said Harris, with Morrison Resi-

dential. “If they are willing to take the extra steps to do it.

“It is for a buyer who is looking for a good deal,” he continued, “and doesn’t want a house with bathrooms, kitchens and more picked out by another person. ... They want the home to look like them, and they don’t need to move in right away. A lot of people are not made for that. They want to buy a turn-key home. They want to move in, put on the TV and live. This is not for them.”

Frank Silva found out about the renovation loan when he went to buy a pool for his home in Goodyear. He loved the convenience of the loan and the accountability of the bank, and he was able to lower his monthly mortgage payments, going from a 5.5 percent to a 4.75 percent loan.

“I thought it would work best for what I needed to do,” he said. “It is sort of like having secondary supervision, someone dispersing the funds, inspecting the work and making sure all the work is done.”

Silva put in a play pool and had his backyard landscaped in the process, transforming his dirt yard into a lush oasis.

And he was not bogged down with the process.

“My main thing, to be honest, is convenience,” Silva said. “If it is convenient, I am all over it.”

Prices for luxury homes vary greatly by size, acreage and location. The Danley/ Cromford report uses a monthly moving average of square-foot costs to track luxury-home prices. The average sales price was $254 a square foot in August, up 19 percent from August 2011.

The average price per square foot of a metro Phoenix home sale in August was $124 a square foot, according to Arizona State University’s W.P. Carey School of Business.

Dealing with loud neighborhood Many of us think of our homes as a place of respite and decompression. When we get home, we want to kick back on the couch and relax in the relative peace after a long day.

However, itâ&#x20AC;&#x2122;s not uncommon to find yourself sharing in the loud music of a neighbor or the barking of a dog left

home alone. These intrusions can keep us from enjoying our homes or falling asleep. Âť Check out the neighborhood before you move.

If you are moving into one of the many new apartment communities around the state, be aware of the construction timeline. The same goes for communities being upgraded.

The management company will work with residents to

help mitigate noise. These are temporary noise issues and you can notify the management if the noise becomes too much, but be aware of construction plans before your sign your lease.

Check out the community at night and see how busy the streets are. Your proximity to the road may be a factor in how noisy your apartment is, so ask management if there is

extra insulation for those units or if they have extrathick windows. You may find that a street-side apartment is quieter than one elsewhere. Âť Check out ordinances.

Cities have outlined very clear noise ordinances that limit the hours that you can make noise. County and city guidelines generally limit noise levels between 11 p.m. and 7 a.m. but as a good neighbor, itâ&#x20AC;&#x2122;s best to turn down the music before 10:30 p.m.

Most construction noise is limited from 7 p.m. to 5 a.m.

The summer heat affects construction hours as teams tend to start early in the cooler hours of the morning. In the fall, some crews will wait until the sun is up around 6 a.m.

Cars and motorcycles equipped with special speakers or a bypass or removed muffler should be especially aware of noise restrictions.

and need extra assistance that my spouse cannot give me. We would like to have a caregiver move in for six months to help out, but the occupancy limit at my apartment community is two per bedroom and we currently live in a one bedroom. Does my landlord have to allow the caregiver to move in?

Answer: Yes, provided that you are really

in need of live-in care and that is the true purpose of the caregiver. Fair housing laws say it is unlawful discrimination to refuse to waive a rule when reasonable and necessary to accommodate the needs of a handicapped resident. Suffering the consequences of a major stroke is a handicap. It is common for persons recovering from strokes to need live-in care.

Thus, your landlord needs to make an exception to your occupancy limit and allow the caregiver to temporarily move in. If the landlord has a reasonable doubt as to the existence of the handicap or the need for a caregiver, he can normally request a doctorâ&#x20AC;&#x2122;s letter. But if the conditions are obvious, making such a request itself would violate fair housing laws.
