Question: In 2005 we purchased a home in Mesa. We made the monthly mortgage payments for almost eight years. After my husband lost his job due to an industrial accident, however, we stopped making the payments. At the August 2014, foreclosure sale there was a deficiency of $80,000. Our understanding from the Internet is that the Mortgage Debt Relief Act of 2007 provides that no income tax is owed by a borrower for any deficiency after the foreclosure (or short sale) of a mortgage used to purchase a home.

This act expired December 31, 2013. Therefore, on our 2014 income tax return we were planning on paying income tax on this $80,000 deficiency. In December, 2014, however, Congress and the president extended the act through December 31, 2014. Does this extension apply to us when our foreclosure sale occurred in August 2014, before the act was extended?

Answer: Yes. The extension of the act was passed in December 2014, to retroactively apply to all foreclosure sales occurring prior to Dec. 31, 2014. Even though the act had not yet been extended at the time of your August 2014, foreclosure sale, the extension of the act protects you now. Bottom line: On your 2014 income tax return, you should not owe any income tax for the $80,000 deficiency.

People looking to get more use out of their backyards are building or converting sheds for a variety of purposes.

There are backyard pubs. “She sheds,” a women’s version of the “man cave.”

Home offices. Art or yoga studios. TV rooms.

“As we continue to explore other ways we can utilize our backyard space, we will continue to see trends like this,” said Stacy Nelson, who owns a backyarddesign consulting firm, Backyard Mamma, in Weston, W.Va. “We want to be in nature and unwind.”

The do-it-yourself element and the sheds’ visual impact have made them popular on social-media sites, Nelson said.

“It’s gaining in popularity. It’s all over the board what people are using them for.”

The sheds range from stylized structures with sliding-glass doors to buildings made from re-purposed materials.

Ford-Workman and her husband spent about $300 fixing up their structure, which friends have dubbed “Bar Shed.”

They furnished it with cast-off furniture from friends.

“Our Bar Shed is nothing to put in a home-design magazine by any stretch of the imagination, but all our friends rave about its existence,” Nelson said.

Studio Shed in Louisville, Colo., sells pre-fabricated structures to people who want more living space or to enhance their backyard, said Jeremy Horgan-

Kobelski, the company’s creative director. The buildings, which range in price from $7,500 to $20,000, offer flexibility and are less expensive than adding a room to the house.

Jennifer and Eric Antonow added a shed to their Palo Alto, Calif., property because they can’t afford a bigger house.

“It made so much economic sense,” she said.

They use their shed as a home office and recording studio. It sits next to their hot tub, so sometimes they use it as a changing room. She also anticipates serving drinks there while entertaining outside.

The Antonows needed a permit to install the shed, which rests on a concrete slab. City and county rules vary, so check with the local zoning department before adding a structure, said Jim Ayers, a contributor to hometalk.com, an online home and garden forum for do-ityourselfers.

He did not need a permit to build the gardening shed that he later converted into a tiki bar at his Nashville home. The building, which sits on concrete blocks, is not a permanent structure, he said.

He transformed the shed into a party spot at the urging of his wife, Monika. “It didn’t take much for me to go her way,” he said.

He estimates he spent about $500 on the project. He already had some of the lumber. Many of the items are re-purposed.

The Ayers spend a lot of time in their backyard and love to invite friends.

“If we’re not at somebody else’s place or away on a trip, we’re out there,” he said. “My wife loves it. In her younger years, she was a bartender.”

has 3 days to rescind a contract or can an apartment community enforce a signed agreement even though they were contacted within a 3-day period?

Answer: Yes. The apartment community with which you signed a lease agreement can enforce the agreement. There is no 3-day right of rescission for a lease agreement. The rescission rights that you are alluding to are found in A.R.S. 44-5002. These rescission rights only apply when a person or entity come to your place of residence to sell you something. In that case you have 72 hours to rescind the contract. However, when you go to the apartment community and sign an agreement, you are bound by the terms of the agreement. If you simply do not move in, you will be responsible for all of the payments under the lease agreement or until the property is rerented, whichever comes first.
