Koepke said they took a proactive approach to maintenance: winterizing the home, putting the water heater on vacation mode, turning off pilot lights, etc.

“We have not hired a caretaker, but do common sense things people do when they own a second home and basically hope nothing goes wrong,” she said. “And we have it well insured.”

Koepke encourages people to contemplate the extra costs of a second home — expenses such as furnishings, landscaping, maintenance and general amenities.

“Think about the incidental expenses,” she said. “We loved our home, because it had a beautiful lawn.

Lowe, a former owner and chief operating officer of Realty Executives Southern Arizona, has held the commissioner’s position since May 2009.

The department provides oversight for Arizona real-estate salespeople, associate brokers, designated brokers, brokerages, timeshares, cemeteries and campground memberships, Lowe said. For information on licensing and disciplinary actions, go to azre.gov.

The state agency also regulates real-estate schools and residential developments and subdivisions. And people can go to the Real Estate Department website’s message center to ask questions.

Lowe advised a homebuyer or seller who has a dispute with a real-estate agent in Arizona to first contact the designated broker at the brokerage who is responsible for the real-estate activities of all licensees affiliated with their brokerage. In most cases, the issue can be resolved without a complaint being filed.

Many issues are outside of the jurisdiction of the Arizona Department of Real Estate, such as most contract issues, all commission disputes and all civil-action issues.

Consumers who can’t find a resolution that way should obtain an ADRE Complaint Form on the website, making sure to complete it with as much information as possible and attach all documentation pertaining to the complaint.

She said every complaint is thoroughly reviewed and investigated.

In many areas, buying a second home is a luxury. In metro Phoenix, it can seem like a necessity.

Suffer through enough scorching summers and the idea of buying a second home will eventually work its way onto your wish list.

And one look at the lineup of cars heading for cooler climates each summer shows that a substantial chunk of people have already done so.

Penny Koepke was one of them. In 2009, she and her husband, Dave Koepke, bought a three-bedroom house in Munds Park near Flagstaff.

“We wanted a place to get to quickly and easily to escape the heat,” said Koepke, 45, of Paradise Valley.

The Koepkes chose Munds Park in part because the area brought back

memories of their childhood summers — warm days, cool nights and kids running for the ice-cream truck each afternoon.

“It reminds my husband and me of the Midwest where we grew up, and it takes two hours door-to-door to get there,” said Koepke, a lawyer with Ekmark & Ekmark LLC in Scottsdale.

They partnered with another family to cut costs on their second home, which came fully furnished.

“They were thinking of getting a second home, too, so part of it was financial,” she continued. “We didn’t think we would use the cabin all the time, but we wanted a second home, and we had vacationed with them numerous times and got along famously.”

Initially, Koepke had concerns about the purchase.

Question: Just before her death, my aunt deeded her home in Chandler to me and my wife. We recorded the deed for her. We now want to sell this Chandler home.

We thought that the title to the Chandler home was free and clear because the mortgage had been been paid off years ago. The title search, however, shows that my aunt had given a lien on the Chandler home to a bonding company in 1994 in order to keep her son out of jail on an assault and battery charge.

Both the bonding company and the title company that handled the lien are no longer in business. How can we clear the title to this Chandler home?

Answer: You may be able to find a title company that will “insure over” this lien with the bonding company. In other words, the title company will give a buyer of your aunt’s home a “clean” title report with no mention of the lien of the bonding company. The reasoning of the title company would be that the “reward” of the escrow and title insurance fees outweighs the minimal “risk” of the defunct bonding company enforcing this 1994 lien. If a title company will not “insure over” this lien of the bonding company, you will have to file a quiet title lawsuit naming the bonding company as a defendant. Since the bonding company is no longer in business, the bonding company probably can be served by newspaper publication, and, assuming that the company does not answer the suit, you will get a court order eliminating the company’s lien.

but eventually we hired a landscaper. That was an added expense.”

The cost of propane in the winter was another factor, as was the expense of trash pickup, phones and cable TV. Koepke thinks it’s also important to consider how easy it is to access your home: “The I-17 can back up for hours when an accident takes place.”

And plan for exit strategies if you are buying with another couple or person.

One exit strategy would be getting the house appraised (each owner could use a separate appraiser, if necessary) to establish a buy-out price, for example.

“We trust each other that when time comes we would still be able to work something out. But that being said, I would still put something in writing, because circumstances change,” Koepke said.

Grab the opportunity

Tina and Todd Gilbreath had been traveling to Munds Park every summer for 10 years to celebrate the Fourth of July at the small-town street parade.

But it was not until Todd found a foreclosure near his

parents’ house that they were able to finally make Munds Park their second home.

“We had been talking about it for ages, and the opportunity just presented itself,” said Tina Gilbreath, 47, a whiz with restoring and creating special spaces. “We had always looked, and it was always more than we could afford.

But since this one was in foreclosure, and it was a train wreck, it just sort of happened.”

Todd, a subcontractor, was able to transform the wreck into a restful retreat for family, friends and future tenants, whose rent payments will help offset the expenses.

Tina recommends buying at a good price and trying to be creative with your purchase.

Having a real-estate agent and talking to neighbors can help buyers be in the know about what is on the market.

“I would have never thought of myself as a landlord,” she said. “But once you get a system in place, it’s pretty easy.”

Investment property?

The Gilbreaths bought their foreclosure without a loan, but those who have to borrow for a second home need to be able to cover both their primary and secondary mortgages.

“The biggest challenge with carrying two mortgages is being able to qualify for the

second one,” said Chantal Huff, senior loan officer for CNN Mortgage. “You have to have the income to be able to withstand both mortgages, and once you have that second mortgage, there are additional reserve requirements on second homes.”

If the second house is an investment property, that too has special considerations.

“Many people think it’s acceptable to finance a property as a second home, enjoy it for a short period and then rent it out,” said Jay Barbour, president of V.I.P. Mortgage Inc. “But they need to be careful.

Financing a property as a second home with the intent to convert it to a rental can result in legal problems as it should have been financed as an investment property requiring a higher down payment and interest rate.”

Paul Guidera, 57, bought his second home in a gated community in Pinetop-Lakeside when his five children were young.

Two years ago, when his older children became teens and refused to go, the hand surgeon reluctantly sold the house.

“If we were in the same situation, in the same point in our lives, we would have bought it again,” he said.

Anyone practicing Arizona real estate for someone other than him or herself must have an active Arizona real-estate license, Lowe said.

There are two types of realestate licenses issued in Arizona: the salesperson license and the broker’s license.

Salespersons and associate brokers must be affiliated Judy Lowe with a designated broker who supervises their real-estate activity.

According to Arizona law, applicants for a state real-estate license must have the following qualifications: » Be at least18 years of age. » Complete 90 hours of inclassroom real-estate salesperson or broker prelicensing education through an ADREapproved school, and pass the school’s final examination as well as the state and national licensing exam. Apply for a license within one year of passing the state exam. » Provide certificates from the “contract writing” course for a salespersons license, or

the broker-management clinic courses for a broker license. » Complete a Disciplinary Actions Disclosure Form, which must be approved by AZDRE. » Obtain an Arizona Fingerprint Clearance Card issued by the Arizona Department of Public Safety.

Like any market, real estate has risks. Lowe listed some issues that consumers should be aware of and offered tips to avoid a bad situation.

She also said consumers should always ask the question, “Do you have an Arizona real-estate license?”

Then they should check azre.gov to confirm the license and see whether there are any disciplinary actions against the licensee.

If no licensing information can be found, find a licensed Arizona real-estate person do work with, Lowe said.

Lowe advised consumers to be wary of paying upfront fees, particularly for a foreclosure or short-sale deal.

And property owners should research the credentials of anyone offering management services and understand all documents before signing.

Know rules for a successful sublease Most renters sign a yearlong lease, but there are lots of circumstances in which a renter needs to leave home for a couple of months. At the same time, summer interns often need a short-term lease, which can be tough to find.

When done correctly, subleasing can be a viable option

for both parties.

In bigger cities like New York and Boston, subleasing an apartment is common. In Arizona, subleasing requires some due diligence on the part of the renter, who is still on the hook for the legal contract. To find a tenant to take over your lease, you need to use caution and be sure to do this legally.

Here are some tips: » Check with your apart-

ment manager or landlord to see if you are allowed to sublet your apartment or home. If you rent a condo, there may be HOA rules as well. Get the new tenant to sign all of the proper documents to protect both parties. » Decide whether or not you will require a security deposit. Some wear and tear is normal, but a deposit will at least mitigate some damage if

it occurs. Asking for first and last month’s rent is also permitted. Be sure to stipulate all of this in the sublet documents. » If you’re subletting a furnished apartment, be sure your renters insurance is up to date and require your sublet tenant to get insurance as well. Then, photograph and inventory all of the major furniture and any existing damage.

Ask your sublet tenant to sign the checklist. » Finding the right tenant is key. Ask good questions and

check references. Younger tenants may not have enough credit history to gauge if they will be a good tenant, but find out about their employment and credit history. » Decide if your new tenant can bring his or her pets, and find out if these pets require another deposit or contract.

With a little planning, subletting can be a great deal for you and your renter.
