Changes to renter taxes, construction-defect claims, landlords’ rights and property valuations were all wrangled during the Arizona Legislature’s short, frenzied session.

A look at each issue and who benefited and who didn’t:  Legislation that would have done away with a tax on residential rentals, backed by the group representing apartment owners, was defeated by the cities that collect it.

The measure called for doing away with the 2 percent tax on residential rents. Arizona is one of only a few states that charge a rental tax. The legislation sparked intense lobbying efforts against it from the Arizona cities that report the tax adds an overall $87 million annually to their coffers. “We knew it would be an uphill battle, but it’s our mission to remove all barriers for people to rent,â€? Tom Simplot, CEO of the Arizona Multihousing Association, told me. “We lost, but the regressive tax is part of the conversation going forward.â€? Âť A bill that passed allows landlords to bring in the police to evict any of their renters’ guests who aren’t on the lease and don’t have specific permission to be in the home.

Housing advocates say the measure overrides renters’ legal protection from the Arizona Residential Landlord and Tenant Act, and they are trying to get Gov. Doug Ducey to veto it.  A bill that passed limits construction-defect litigation costs and limits the window homeowners have to sue a builder. The losing side in a lawsuit over construction problems is no longer required to cover the winning side’s legal costs. And homeowners have six years instead of eight years after a house is completed to sue a builder.

The legislation will save builders money, and limit what homeowners can do if their house is built badly. But not all homeowners lose with this one because it could limit class-action, construction-defect lawsuits. Those can hurt property owners who don’t want to sue and then can’t sell their house because of the lawsuit.  A measure to simplify Arizona’s See REAGOR, Page 3R

Question: An investor purchased a home in Apache Junction two years ago. The investor made some repairs and wanted to “flip� the home for a quick profit, but he has been unable to sell the home. The investor is now trying to rent the home.

Although we want to rent the home, my wife went online and found out that the investor has stopped making the mortgage loan payments. In fact, there is a foreclosure sale scheduled in two months.

If we rent the home now under a one-year lease, will we be able to stay in the home for the remaining 10 months of the lease if there is a foreclosure sale in two months?

Answer: Probably not. In 2009, Congress passed the Tenant Protection at Foreclosure Act, which generally allowed a tenant to stay in a rental home for the entire lease term after a foreclosure. This act, however, expired Dec. 31, 2014. Therefore, a purchaser now at a foreclosure sale, usually the bank, has the right to file eviction proceedings after five days’ written notice to the tenant.

As a practical matter, however, a purchaser at the foreclosure sale may want to have rental income from a tenant who should be able to negotiate a new lease.

Note: The banks that are doing the foreclosures of homes have historically been the buyers at more than 90 percent of foreclosure sales. Although numerous investors have entered the home foreclosure market in the real estate recession, banks still constitute more than 50 percent of the buyers at foreclosure sales. “Mom and Pop� buyers who actually want to live in the home are very rare at foreclosure sales because, one, there are no disclosures made by foreclosing banks such as a leaky roof or title problems, and, two, the purchase price must be paid by 5 p.m. the day after the foreclosure sale.

space tied up in a room that doesn’t get that much use. But for most homeowners, a media room is a luxury they can’t afford in terms of square footage, and although they’re still around in some market segments, their popularity seems to have already peaked.

Along with media rooms, several other seemingly desirable features aren’t necessarily being offered in homes nowadays, Lieb said. Those include:  Swimming pools. These watery playgrounds can be a great asset for a desert dwelling, but the truth is lots of homebuyers simply don’t want a pool in their yard. They may have a membership at the neighborhood club or fitness center, or they may have previously owned a pool (or not) and just don’t want the associated costs and maintenance issues that come with ownership.

As a result, many homebuilders don’t even offer the choice of a pool; other backyard amenities are also left to the discretion of the homebuyer.

And, in older neighborhoods, where it often was typical for builders to center the swimming pool in the backyard — essentially cutting the yard in half and making it a challenge to use the remaining space — Lieb said he’s noticing some homeowners opting to fill in those disused pools in favor of pool-free panoramas. Âť Fireplaces. Sure, some buyers love the romantic touch of a fireplace in the living room or master bedroom, but Lieb said he sees lots of fireplaces that never get used. “I go into a home where there’s a fireplace, and they have candles in it,â€? he said. “We are in a climate where, even during winter, it’s 80 degrees.â€?

Add to that the number of “no-burn�

days the Valley gets and fireplace usage can become pretty restricted, so some find it’s just not worth the effort. “I see people taking fireplaces out of their homes, because they say it’s just dead space and they’re never going to use it.â€? Âť A formal living and dining room.

You’ve seen the trend away from these rooms for awhile now, right? Although these two rooms were popular decades ago, unfortunately, they often “ended up being showcase rooms,� Lieb said.

The living room was “for furniture you never used,� he joked, and the dining room got used only when you threw a big get-together. A waste of space, once again. So builders knocked down the walls and, today, the great room and its open, airy approach has all but replaced the more chopped-up, isolated feel of days gone by. “Buyers don’t necessarily ask for a great room, but if it’s there, they like it more,� he said. “You can use a great room all the time, and people love the flexibility of it.�

receive information about their property’s 2014 value from the Maricopa County assessor, but tax bills won’t reflect that valuation until fall 2016. The legislation called for property owners to be taxed in the fall on a valuation they received earlier in the year.

Opponents of the legislation argued

it would cut the time property owners had to appeal their valuations. There is no appealing a property-tax bill in Arizona.

These legislative results are a win for many in the real-estate industry, but not most homeowners. And renters definitely lost.

notice that I would be out by the end of the month. I just found out that the apartment I was going to move into wouldnâ&#x20AC;&#x2122;t be ready by the end of the month. The landlord indicated that he had already re-rented my apartment for the first of the following month. I told him that I simply couldnâ&#x20AC;&#x2122;t be out by the end of the month. I would have no place to live. He told me that I would be charged as a â&#x20AC;&#x153;hold overâ&#x20AC;? tenant. Can he do that?

Answer: Maybe. The statute indicates that if a tenant remains in possession without a landlordâ&#x20AC;&#x2122;s consent after expiration of the lease agreement or itâ&#x20AC;&#x2122;s termination, a landlord may bring action for possession. In addition, if the tenantâ&#x20AC;&#x2122;s hold over is willful and not in good faith, the landlord may recover an amount equal to not more than tow monthâ&#x20AC;&#x2122;s periodic rent or twice the actual damages sustained by the landlord. Whichever is greater. The question here is whether or not the hold over is willful and not in good faith. Arguably, if another landlord told you that your new unit would be ready and it is not, then your failure to move is probably not willful or in bad faith. You may not be responsible for two monthâ&#x20AC;&#x2122;s rent or twice the landlordâ&#x20AC;&#x2122;s actual damages, however, you would be responsible for the actual damages incurred by the landlord, which could include the lost revenues for the new lease.
