The fixer-upper mortgage FHA loan product helps buyers get a house and rehab it

enifer and Greg Garner had saved up for a down payment on a home, but they hadn’t socked away enough to renovate one.

An FHA-insured mortgage called the 203k enabled them to buy the house they wanted and update it, too.

“We were able to move into a house that looked essentially new,” Jenifer Garner said.

The 203k program, administered by the U.S. Department of Housing and Urban Development, allows buyers to not only purchase a property but receive funds for repairs and remodeling in the mortgage.

This means they have little or no up-front, out-of-pocket costs for rehabbing. Homeowners who want to refinance also can apply for the mortgage.

Improvements can be structural or cosmetic. They can be as involved as adding a second story or repairing a cracked foundation or as simple as replacing a faucet or repainting rooms. Other eligible expenses include room additions, roof replacement and new faucets, flooring, appliances and sinks.

eople in metro Phoenix are more confident about the area’s housing market than people living in most other parts of the U.S. A new index tracking how residents of the nation’s largest metro areas feel about buying or owning a home has been produced by real-estate research firm and brokerage Zillow.

The Valley’s overall housing confidence index is 66.7 percent, higher than the national figure of 63.7 percent, according to the first Zillow Housing Confidence Index. More than 300,000 people nationwide were polled for the inaugural index.

The Housing Confidence Index is measured on a zero to 100 scale, with readings above 50 indicating positive sentiment. The margin of error is plus or minus 4.4 percent.

The survey also found 15 percent of current renters in metro Phoenix want to buy a home within the next year.

That’s higher than the national average of 10 percent.

“Even after a wrenching housing recession, this data shows that the dream of homeownership remains very much alive and well, even in those areas that were hardest hit,” said Stan Humphries, Zillow chief economist.

The number of houses for sale in metro Phoenix climbed 30 percent in the past year, and that is giving more people a chance to buy instead of rent, according to Zillow.

However, Arizona housing analysts say sales are down as inventory climbs because there aren’t enough buyers in the market now.

Seattle-based Zillow reports there are 4 million people across the nation who want to buy their first house this year. Renters in Miami, Atlanta and Las Vegas expressed the greatest desire to buy. New York has the fewest renters who want to buy a home, about 4 percent, according to the index, done in partnership with the Massachusetts-based research firm Pulsenomics LLC.

uestion: Three years ago, we looked at a lot in a subdivision near Flagstaff. We purchased this lot, and after getting a permit, we built a home. We now want to sell our home, but the listing agent says that we built our home on the wrong lot. In other words, we got a deed to Lot 63, but we had looked at Lot 64, got a building permit, and built a home on Lot 64. We are still the record owner of Lot 63, and no home has been built on Lot 63.

Lot 63 is a bigger lot with better CHRISTOPHER views. The COMBS ownership REAL ESTATE Q&A of Lot 64 is in the name of a limited liability company with owners in Canada, and our listing agent is now trying to locate these owners. What do we have to do to be able to sell our home which was built on Lot 64, which we do not own?

Answer: The simple answer is to locate the owners in Canada and trade the lots. Since Lot 63 is a bigger lot with better views, that may be workable. If the owners for some reason will not trade the lots, you will probably have to contact an attorney. The issues that would need to be addressed would include whether the owners in Canada were aware of any construction on Lot 64, who has paid the property taxes for Lot 64, and any contact the owners in Canada had with neighbors or real estate agents in the community in the past three years. In general, however, a court would not authorize “judicial waste” — that is, require you to tear down your home on Lot 64.

ing for less than the market price. Some houses are missing fixtures, appliances or lighting or need new plumbing. Others have fallen into disrepair. Still others look out-of-date.

The mortgage is timely now because so many homebuyers want their houses to be energy-efficient, said John Frazza, Arizona regional sales executive for Bank of America. Under the program, buyers can replace air-conditioners with more efficient ones, have solar panels installed and do other green rehabbing.

The loan program also is ideal for first-time buyers who may have only enough income to qualify for a fixerupper, Roush-Wedlake said.

Repairs are done after buyers purchase the house.

“We close on the home as-is, and immediately the contractor can get in there to do the work,” Frazza said.

This differs from most mortgages, which typically require that repairs be completed before loans can be funded, Roush-Wedlake said.

As with all FHA-insured mortgages, 203k buyers must qualify for the loan and make a 3.5 percent down payment.

One type is the standard or regular 203k. Among its features: » It allows for structural and cosmetic repairs. » There is a $5,000 minimum. » When applying for the loan, buyers must work with a HUD consultant. This consultant makes an initial visit to the

house and develops a report detailing the work to be done, the cost breakdowns and other information. After a contractor is chosen, the consultant makes subsequent inspections to the house, among other duties. He or she arranges for money to be drawn to pay the contractor. Five draws are allowed.

The other type is the Streamline 203k. As its name suggests, this loan requires less paperwork than the regular 203k, said Rita Wensel, a loan officer with Suburban Mortgage in Phoenix. Among its features:

There are several caveats associated with 203k mortgages, including that they tend to have slightly higher interest rates than regular mortgages.

Another is that 203k mortgages are offered by FHAapproved lenders.

Homebuyers also should keep market value in mind.

They should make sure the scope of the work doesn’t price the home out of the market.

The Garners got a Streamline 203k mortgage to replace flooring, remove wallpaper, repaint, and replace the kitchen sink and faucet in their 2,500-square-foot house. They

also replaced smoke detectors.

“Decoration-wise, it was in really sad shape,” Jenifer Garner said of the house, which is in Peoria. The couple had been contemplating buying the home and doing the work over time, once they saved the money.

They were thrilled when they learned about the 203k mortgage.

“Without a doubt, we wouldn’t have been able to do it” without it, she said.

As I understand your question you are a convicted felon, but are looking for rental options. Unfortunately, having a felony conviction is grounds to refuse to rent to you, regardless of the felony or how old it may have been. Properties do have the option of not requiring a crime free addendum, and offering to felons, but each property and owner sets their own standards in this regard. It is immaterial whether you are a sex offender or some other type of convicted felon. You would just have to ask each apartment community or property manager what is part of their rental criteria regarding felony convictions. Some landlords will rent to a tenant that has a felony conviction if it does not involve a crime against persons or property. Other than that, your only other option would be to purchase a home if you are able to qualify.
