im Scott had been hunting for a new home for nearly two years. In February, she finally purchased one in Scottsdale for her family of four.

Now, she faces the real challenge: Selling her former home in what realestate experts say has recently become a buyer’s market.

“I don’t feel as good about selling my home right now as I do about buying one, because it’s a buyer’s market,” said Scott, who has already had two open houses and several private showings.

“When I bought it in 2005, everything was selling so fast,” she continued. “Now, I think buyers are more particular, and it’s harder to sell a home. People are more cautious about what they spend their money on, and they are looking for a bargain. And See BUYERS, Page RE3

Another crash isn’t expected

ost market watchers are talking about the housing market cooling off a bit this year. Prices and the number of sales were down in metro Phoenix in January, according to the latest figures.

But homeowners and potential buyers shouldn’t think that means there’s a bubble and that prices are going to plummet and foreclosures soar again.

Foreclosures in the Phoenix market fell to 521 in February, according to a new report from the Information Market. That’s the lowest level since April 2007, before the crash.

Also, the number of houses in the Valley held by lenders has plummeted to about 3,000 last month from 20,000 in 2011.

Banks are not holding a bunch of properties to sell for bargain prices, a move that could drive down home values again.

Metro Phoenix’s median home price has climbed more than 70 percent since bottoming out in 2011. That’s several months of double-digit gains.

Mike Orr, real-estate analyst with Arizona State University’s W.P. Carey School of Business, said prices in the Valley have recovered to the level where they would have been if the crash and recovery had not happened.

Whether home prices continue to climb depends on demand this year, he said. Fewer buyers and more houses for sale won’t translate to higher prices.

When we contacted our homebuilder, however, it refused to make any repairs. Does the homebuilder have any obligation to make repairs even though the one-year warranty period has expired?

On the other hand, under Arizona law, every home has an eight-year implied warranty by the homebuilder that the home was properly constructed. Since you discovered this construction problem after four years, you should have a claim against the homebuilder for the cost to repair this construction problem.

Before filing a lawsuit, however, under Arizona law you will have to give the homebuilder an opportunity to correct this construction problem.

many of them need to sell the home they are in before they can buy a new one.”

From 2010 to 2013, it was a seller’s market — mostly because investors and bargain hunters drove up prices trying to outbid each other for cheap foreclosed homes. Today, potential buyers don’t have as many bargains, but they have more choices as owners, finally able to sell for a profit, are listing their homes for sale.

So Arizona’s real-estate market has shifted in favor of those buying a home. Open-house signs are once again sprouting up on street corners across the Valley on weekends and even weekdays, and buyers are finally in a better position to bargain for the best house to fit their needs.

“A buyer’s market is exactly what it sounds like,” explained John Lotardo, senior vice president and general counsel for Stewart Title and Trust of Phoenix. “When there are more homes for sale than there are buyers, then buyers have time to pick and choose at their own pace and have more ability to dictate terms. It generally causes a softening of sales prices.”

Conversely, Lotardo said, in a seller’s market there are more buyers than homes to purchase.

“There is basically a low inventory and high demand,” said Lotardo, who writes and speaks on various real-estate topics. “In these cases, the seller is dictating more of the terms of the sales.”

The buyer’s market is relatively new and not necessarily blanketing the entire Valley, said Michael Orr, director for the Center for Real Estate Theory and Practice for the W.P. Carey School of Business at Arizona State University.

“The demand fell and the supply increased,” said Orr, breaking the buyer’s market down to the most basic of economic theories.

Orr said the buyer’s market started in February but is particularly strong in places like Maricopa, San Tan Valley, Buckeye, Gold Canyon and other areas that are “far out there.” Scottsdale also has become a buyer’s market. Paradise Valley is more of a balanced market now, with nei-

ther buyer nor seller being at a particularly stronger advantage.

According to the Arizona Regional Multiple Listing Service, there are nearly 30,000 homes listed for sale in the Valley. Based on data from Maricopa County’s and Pinal County’s recorder for deeds, Orr determined that home sales are down 21 percent from last year.

“The 30,000 is not an excessive amount of listings, but the problem is not the high supply but low demand,” Orr said. “The demand is the second lowest that it’s been in 14 years.”

“We don’t usually see that much of a drop,” he said of the 21 percent. “The only time we saw that was before when the market collapsed in 2007 and 2008. Although, unlike then, it is not an unhealthy market at all right now.”

His advice for sellers?

They need to understand the current market and not be too aggressive in pricing.

“At the moment, a lot of sellers think the market is hot, and it’s not,” Orr said. “They need to make sure they have high-quality pictures of their listing for view on the Internet and be ready to negotiate if a buyer makes an offer. Don’t be too difficult. Find ways to compromise.

“You need to treat people who may purchase your home with a lot more respect than last year when you would have had multiple buyers,” Orr added.

If you are trying to buy a house and sell another, it’s best to

do the hardest thing first, which right now would mean selling your home.

“Spring has historically been the hottest time to sell your home, and for buyers, it works best in the summer when people are away and there is a lot less competition for the home,” said Denise Flanagan, a realty agent for HomeSmart for eight years.

Flanagan cautioned that in the summer there may be less inventory and thus fewer homes to choose from. She also said that the lower the price on a home, the more competition a buyer will face, and the higher the price — $400,000 and more — the less competition buyers will face.

Industry specialists say staging a home goes a long way toward helping buyers see themselves settling into your house.

Flanagan says sellers don’t need to buy all the bells and whistles when strategizing their sale.

But she is a stickler for one thing.

“I always say you don’t need to spend a lot of money to get your house to sell, but the bar is set on cleanliness,” Flanagan said. “You need to be able to eat off the floor.

Cleanliness sells. It sends a message, probably more of a subconscious one, that if your home is well-maintained on the surface, chances are you have been taking care of other things like servicing the air-conditioner and cleaning the air vents. No one wants to buy someone else’s problems.”

The Arizona Multihousing Association is a founding member of the Crime Free program in Arizona. Crime Free brings together police officers, property managers and residents to help ensure a safer community for residents.

In the first phase of the Crime Free certification, managers and maintenance supervisors attend an eight-hour training session with local police officers to learn tools to keep their residents and prop-

erty safe.

During the second phase of the Crime Free program, a local officer inspects the property with the managers to make recommendations on physical updates. Then the problems started. Both bathroom sinks and the kitchen sink started leaking. Mold has started growing. The wall in our front room has the paint peeling off. The black dust has gotten into our scalps and onto our skin, forcing us to see a doctor about it.

When landlords are non-responsive to maintenance concerns, the tenant may issue a notice regarding the health-and-safety concerns under A.R.S. §§ 33-1324 and 1361. The landlord will then be required to remedy the problems within 5 calendar days. If the problems are not resolved, the resident may terminate the lease and depart the leased premises without further obligation. Alternatively, if this self-help remedy is not desirable, the tenant could contact the Maricopa County BarAssociation’s Lawyer Referral Service (602-257-4434) and seek legal assistance.
